City Attorney Askins read, AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. " 2.8818 Acres Laying 420 Feet North of McCabe Road and Fronting on Old Highway 146" A motion was made by Councilman Tomerlin to accept the recommendation of Planning and Zoning and adopt Ordinance No. 7 0EEE, rezoning that certain tract -from residential to commercial, Apartment use only, second by .Councilman Simons. The motion carried 3 Ayes and 0 Nays. Ayes: Councilman Tomerlin, Councilman Simons, Mayor Meza Nays: None 3. City Attorney Askins read, AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. "6 Acres, More or Less, Being Parts of La Porte Outlots 339, 340, 320 and 321, Enoch Brinson Survey, Harris County, Texas" A motion was made by Councilman Simons to accept the recommendation made by Planning and oning o rezone the tract in Ordinance 7 OFFF from residen ial to commercia ~ • Minutes, Special Called Meeting - January 14, 1881 • page 2 it's statis prior to the La Porte-Lomax the motion was second by Councilman Tom The motion carried 3 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Simons, Mayor Meza Nays: None 4. After reviewing the bids on the 12 inch water main and other costs associated with the project, it became evident that the project could not be completed with the available funds unless the scope of the project is reduced. John Joerns, Carlos Smith and Joe Sease reviewed the project and suggested deleting fire hydrants which are not at this time necessary to the project. Review of the project revealed 22 fire hydrants could be deleted and we would still have more than adequate fire protection and bring us within the budgeted funds. A motion was made by Councilman Tomerlin to award the contract to McKey Construction Co. for the construction of 12 inch A.C. water mains and appurtenances in the amount of 252,542.55 subject to successful negotiations with the contractor to • delete 22 fire hydrant assemblies from the proposed construction second by Councilman Simons. The motion carried 3 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Simons, Mayor Meza Nays; None 5. Mayor Meza advised the Council of the grant received to be applied to the purchase of the 36 passenger bus, he reminded the Council they had agreeded to take the balance needed from the Revenue Sharing Contengency. Sherwood reviewed the three bids submitted: Jay Marks Chev. $22,730.07 Longhorn Bus 30,450.00 Joe Camp Ford 22,707.73 Sherwood stated the low bid submitted by Joe Camp Ford met the bid specifications. Motion was made by Councilman Tomerlin to accept the bid submitted by Joe Camp Ford and appropraite 10,70 .00 from • the Revenue Sharing Contengency to fund the balance needed, sec©nd by Councilman Simons. Sherwood ask the Council to formally award the bid for the "Tree Spade" submitted by Vermeer Sales of Texas since this was the only bid received. Sherwood stated he had adequate funds to purchase the Tree Spade since several of his expen- ditures for capital outlay items were under budget. Motion was made by Council Simons to award the bid for "One ermeer TS- A Tree Spade to Vermeer Sales of Texas for £Fie i price o 00.00, second by Councilman Tomerlin. e mo ion carried 3 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Simons, Mayor Meza Nays: None 7. Motion to adjourn by Councilman Tomerlin, second by Councilman Simons. The meeting was duly adjourned at 7:55 P.M. MEMORANDUM TO: Mayor and City Council PROM: Planning and Zoning SUBJECT: Request for Re-zoning from Residential to Commercial - District C, F. Carrington Weems The subject property consists of 2.8818 acres lying 420 feet xiorth of McCabe Road and fronting on Old Highway 146. Mr. Weems had previously obtained temporary re-zoning of the property to permit construction of apartments. The two-year limitation of the re-zoning has recently expired, and Mr. Weems is now requesting permanent re-zoning to allow construction of apartments. Planning and Zoning requests a public hearing to consider this reques u eliminary recommendation is that the property be perms. ntly re-zoied according to the terms of the previous ordinan # 780NN. Box 1115 La Porte, Texas 77571 Dear Ms. Waters: I own a tract of land approximately 420 feet North of the intersection of Old Highway 146 and McCabe Road containing 2.8818 acres. This property was re-zoned on the 6th day of March, 1978 in accordance with Ordinance No. 780-NN. The property was re- zoned for a period of two years, which of course, has now expired. We had intended to build 92 apartment units back at that time, but were unable to secure sufficient financing because of developments in the money market. Therefore, the project was not constructed. We would like to attempt to reapproach the project at this time and, therefore, request that the zoning ordinance be renewed. We believe that the property's location and corresponding value indicates that the highest and best use would be for higher density, such as apartments, etcetera. We therefore request that the re-zoning.., of the tract be on a permanent basis. With the money market so uncertain, we cannot be sure when all of the elements allow us 'to commence construction. Therefore, we would greatly appreciate the additional flexibility provided by such permanent zoning. If you would like to see the working drawings and specifica- tions for the apartments, I would be most happy to supply same. I enclose herewith a copy of the old Ordinance and a survey plat along with the $100.00 Application Fee. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 14th day of January, 1981, at 7:00 P.M., a joint public hearing was held before the Planning and Zoning Commission and the City Council, of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible re- classification of the zoning classification of the hereinafter described parcel of land_ There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. Section 2. The Publisher's Affidavit of Publication of notice of said hearing is attached hereto as "Exhibit B," • incorporated by reference herein and made a part hereof for all purposes. Section 3. Subsequent to such public hearing, the City • of La Porte Planning and Zoning Commission met in special session on January 14, 1981, to consider the changes in classi- fication which were the subject of such joint public hearing. The City Council of the City of La Porte is in receipt of the written recommendations of the City 'of La Porte Planning and Zoning Commission, by letter dated January 14, 1981, the original of which letter is attached hereto as "Exhibit C," incorporated by reference herein, and made a part hereof for all purposes. ~ ~ • Ordinance No. 780- ~ /=/= , Page 2. Section 4. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the zoning classification of the hereinafter described parcel of land, situated within the corporate limits of the City of La Porte, is hereby changed in accordance therewith, and the zoning classification of said parcel of land shall hereafter be "District C--Apartment and Commercial District." The description of said parcel of land re-zoned is as follows, to-wit: 2.8818 acre tract, Tidewood Subdivision, 420 feet North of McCabe Road facing Highway 146, Wm. P. Harris Survey A-30, Harris County, Texas. Section 5. This Ordinance shall be in effect from and after its passage and approval. PASSED AND APPROVED this 14th day of January, 1981. Meza, Mayor • I /1 J MEMORANDUM December 2, 1980 TO: Mayor and City Council • FROM: Planning and Zoning SUBJECT: Request for Re-zoning Parts of Outlots 339, 340, 320, and 321 from Residential to Commercial, ~~, Donald F. Ford Mr. Donald Ford met with Planning and Zoning on December 1, 1980, to request that his property be re-zoned from Residential to Commercial. The subject property is located on 26th Street near North "P". Mr. Ford stated that the property had a com- mercial classification prior to the consolidation o:~ La Porte and Lomax. Mr. Ford's purpose in requesting such classification is to allow construction of a gas compression facility on the property. Planning and Zoning requests a public hearing to consider such rezoning. Our preliminary recommendation is to grant the request. J .~ ~-.'_ ~~ , y~ , .; •~ ,.~ ~ ; ~ -3- ~~ ~ 1? ~ • ORDINANCE N0. 780- fFF AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 14th day of January, 1981, at 7:00 P.M., a joint public hearing was held before the Planning and Zoning Commission and the City Council, of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible re- classification of the zoning classification of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. Section 2. The Publisher's Affidavit of Publication of notice of said hearing is attached hereto as "Exhibit B," incorporated by reference herein and made a part hereof for all purposes. • Section 3. Subsequent to such public hearing, the City of La Porte Planning and Zoning Commission met in special session ,on January 14, 1981, to consider the changes in classi- fication which were the subject of such joint public hearing. The City Council of the City of La Porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Commission, by letter dated January 14, 1981, the original of which letter is attached hereto as "Exhibit C," incorporated by reference herein, and made a part hereof for all purposes. f ~ 1~ u Ordinance No. 780- , Page 2. Section 4. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the zoning classification of the hereinafter described parcel of land, situated within the corporate limits of the City of La Porte, is .hereby changed in accordance therewith, and the zoning classification of said parcel of land shall hereafter be "District C--Apartment and Commercial District." The description of said parcel of land re-zoned is as follows, to-wit: • 6 acres, more or less, being parts of La Porte Outlots 339, 340, 320 and 321, being more particularly described on Exhibit "D", incorporated by reference herein, and made a part hereof for all purposes.
