MEMBERS OF THE CITY COUNCIL PRESENT: Mayor J. J. Meza, Councilman John Tomerlin, Councilman I. J. Kibodeaux, Councilwoman Virginia Cline, Councilman Tom Simons, Councilman Norman L. Malone MEMBERS OF THE CITY COUNCIL ABSENT: None OTHER CITY OFFICIALS PRESENT: City Manager James R. Hudgens, City Attorney Knox Askins, City Secretary Betty T. Waters, Chief of Police H. F. Freeman, Public Works Director Jerry Hodge, City Engineer John Joerns, Chief Inspector David Paulissen Fire Marshal Paul Hickenbottom, Parks Director Stan Sherwood OTHERS PRESENT: Lou Lawler, Dave Corbin, Mike Johnson 2. The invocation was given by Councilman Tom Simons 3. The minutes of the January 7, 1981, Regular Council Meeting were presented. Motion was made by Councilwoman C-line to approve the minutes ashresented, second by Councilman Tomerlin. The motion carried 4 ayes and 0 nays. • Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 4. The minutes of the January 14, 1981 Special Called Meeting of the La Porte City Council were presented. Motion was made by Councilman Tomerlin to approve the minutes as presented, second by Councilman Simons. The motion carried 2 Ayes and 0 Nays and 2 abstain. Mayor Meza voted Aye Ayes: Councilman Tomerlin, Councilman Simons, Mayor Meza Nays: None Abstain: Councilwoman Cline(Due to absence from the meeting) Councilman Kibodeaux (Due to absence from the meeting) 5. City Attorney Askins read, AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE ALLEY IN BLOCK ELEVEN HUNDRED THREE (1103), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. A motion was made by Councilman Simons to approve and adopt Ordinance No. 1246 as read. Councilwoman Cline ask if Greater Houston Lumber and Truss was aware this would not close the entire alley. Askins stated he had discussed the matter with Mr. Berringer. Cline ask if • Minutes of R~lar Meeting-1-21-81 • Page 2 • anyone had tried to contact the owner of the other lots. Councilman Kibodeaux replied that the owner of those lots is a lady who lives in Houston and a year or so ago Mr. Berringer and the City had talked to her about closing the lots and she was not interested. The motion was second by Councilman Tomerlin. The motion carried 4 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 6. City Attorney Askins read, AN ORDINANCE VACATING, ABANDONING AND CLOSING THE STREETS AND ALLEYS LYING WITHIN A 96.242 ACRE TRACT OF LAND OUT OF THE T.W.LEE SUBDIVISION OF A PORTION OF THE RICHARD PEARSALL 1/3 LEAGUE A-625, HARRIS COUNTY, TEXAS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. A motion was made by Councilman Tomerlin to approve and adopt Ordinance 1247 as read. There was discussion by Council as to what streets and easements would be left open in this tract. Councilwoman Cline ask to • see the statements from the three utility companies which are normally a part of the process of street and alley closings. Askins stated this had been by passed in this case. Cline stated she felt the City had a policy for street and alley closings and she felt there should be no exceptions. Councilman Tomerlin withdrew his motion to approve Ordinance No. 1247. Councilman Tomerlin made a motion to table any action on this item until such time as the utility easements have been cleared with H.L.&P., Enter and B-ell Telephone. The motion was second by Councilman Kibodeaux. The motion carried 4 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 7. City Attorney Askins read, AN ORDINANCE CONFERRING UPON THE CITY MANAGER GENERAL AUTHORITY TO CONTRACT FOR EXPENDITURES WITHOUT FURTHER APPROVAL OF CITY COUNCIL FOR BUDGETED ITEMS NOT EXCEEDING THREE THOUSAND DOLLARS ($3,000.00); AND PROVIDING AN EFFECTIVE DATE. Motion was made by Councilman Tomerlin to approve and adopt Ordinance No. 1247 as read, second by Councilman Simons. The • motion carried 2 ayes, 1 nay, 1 abstain. Councilwoman Cline stated she voted nay to express her opposition to the newly approved City Charter which confers this authority by ordinance. Mayor Meza Cast a vote Aye. City Attorney Askins read, AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY OF LA PO.RTE; CALLING A RUN-OFF ELECTION, IF NECESSARY; DESTGNATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS; PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING; PROVIDING FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING FOR NOTICE; PROVIDING FOR FILING DEADLINE AND FILING FEES FOR CANDIDATES; PROVIDING FOR THE HOLDING OF A JOINT ELECTION WITH THE LA PORTE INDEPENDENT SCHOOL IDSTRICT; PROVIDING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilwoman Cline to approve and adopt Ordinance No. 1248 as read by the City Attorney, second by Councilman Simons. The motion carried 4 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 9. Mayor Meza read an application for a sewer extention from Mr. B. T. Wright. • After discussion with Public Works Director concerning cost and additional services off this line, Mr. Hodge stated Mr. Wright was very satisfied with the service and the cost. Motion was made b~ Councilman Kibodeaux to a rove the sewer extention agreement for B. T. Wright, second by Councilwoman Cline. The motion carried 4 ayes and 0 nays. Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman Cline, Councilman Simons Nays: None 10. ADMINISTRATIVE REPORT: City Manager Hudgens advised Council he had requested a complete up-date on all existing projects for the Jan. 28th Workshop. City Manager Hudgens requested a brief executive session to discuss a personnel matter. 11. COUNCIL ACTION: Councilman Kibodeaux ask if the Engineering Department was fully staffed yet? Joerns advised him he was still one man short. Councilwoman Cline reported on the Election Seminar she attended in San Antonio. She stated, she and Lou Lawler had • found the seminar very informative and had visited with Gerald Jones from the U. S. Justice Department. • • Minutes of Regular Meeting 1-21-81 Page 4 • Councilman Malone ask when the Lomax Street project would be ready to bid and Mr. Carlos Smith advised him he would be ready in two (2) weeks. Malone advised the Bayshore Sun representative that La Porte Dog Tags were in and they might want to advise the Citizens of that fact. Mayor Meza discussed the Legislative breakfast held in Austin on January 20th by the Harris County Mayors and Councilmens Association. • 12. Council adjourned into executive session to discuss a personnel matter at 7:35 P.M. Council returned to the Council Table at 8:20 P.M. Mayor Meza stated no action had been taken and entertained a motion to adjourn. 13. Motion to adjourn by Councilman Tomerlin, second by Councilman Kibodeaux. WHEREAS, the hereinafter described portion of said alley in Block Eleven Hundred Three (1103) of the Town of La Porte has never been opened or used as a public thoroughfare, and the public utilities now making use of such alley have all given their written consent for its closing; and WHEREAS, the City Council of the City of La Porte has determ~~ned and does hereby find, determine and declare that the hereinafter described portion of the said alley is not • suitable, nee~;ed, or beneficial to the public as a public alley, and should be vacated, abandoned and permanently closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1'. Voting at said election, including absentee voting, shall be by the use of voting machines, and the ballots of said elections shall conform to the Texas Election Code, as amended. Section 4. Absentee voting by personal appearance shall begin on the 20th day and shall continue through the 4th day preceding the day of the election. Except as authorized herein, the clerk shall not permit anyone to vote absentee by personal • appearance on any day which is not a regular working day for the clerk's office, and under no circumstances shall he permit anyone to vote absentee by personal appearance at any time when his office is not open to the public. ~• Absentee voting by mail shall begin on the 20th day pre- ceding the date of the election and shall continue until ten o`clock (10:00) A.M. on the second day preceding election day. Absentee voting shall be conducted by a clerk for absentee voting, namely, Lou Lawler , and the place at which the absentee voting shall be conducted is designated as the La Porte City Hall, 604 West Fairmont Parkway, La Porte, Texas, to which address ballot applications and ballots voted by mail may be mailed. Said clerk shall keep said office open for • absentee voting during his regular working hours and in any event for at least eight (8) hours on each day which is not a Saturday, a Sunday, or an official State holiday. Section 5. At that time Mr. Wright's septic ~•- .- tank system had become inoperative and he desired to tie onto public sewer. Due to the emergency nature of this problem, an estimate was made to install 75 ft. of 6" sewer main from an existing manhole on 13th street: This estimate was for $454.25 ' and was paid by the iJrights on 12-30-80. This line was installed on 01-14-81 due to the urgent need in completing this work. We find that the actual cost of installing this line was $551.23 which means a balance of $96.98 will have to be billed to the Wrights. Upon completion of plans and specifications City will place the project for bid. It is agreed and understood that • the deposited escrow amount made by Owner does not relieve Owner from paying for any unforseen costs and/or cost overruns in the. project that result from circumstances beyond the control of City. (6) City agrees to accept the value of the extension(s) that abutt said Owner's property as a pro rata portion of the prevailing square footage and/or front footage connection charge for water and/or sewer service against said property belonging to Owner. Owner shall be responsible for all other customary charges. ~(7) Upon execution of this agreement and compliance with terms herein, City agrees to begin the preparation of engineering plans and construction specifications for said extension(s), and to begin construction thereof as soon as the same may be let for contract as herein provided. City shall require the contractor under such contract to diligently pursue the construction of the project to completion.
