SPECIAL CALLED MEETING
OF THE
LA PO RTE CITY COUNCIL
APRIL 4, 1981
•
1. Meeting called to order by Mayor Meza at 7:00 P.M.
Members of the City Council Present: Mayor J. J. Meza,
Councilperson John Tomerlin, Councilperson I. J. Kibodeaux,
Councilperson Virginia Cline, Councilperson Tom Simons,
Councilperson Norman L. Malone
Members of the City Council Absent: None
Other City Officials Present: City Manager James R. Hudgens,
City Attorney Knox Askins, City Secretary Betty T. Waters
There were 39 citizens present in the Council Chambers.
• 2. Mayor Meza stated Council will at this time consider an item
tabled at the April 1, 1981, Regular Meeting and that is the
rezoning of a particular site on the Bayview Block for Happy
Harbor from residential to commercial.
City Attorney Askins read Ordinance No. 780LLL: AN ORDINANCE
AMENDING ORDINANCE 780, THE CITY OF LA PO RTE ZONING ORDINANCE,
BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF
LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Cline to adopt and approve
Ordinance No. 780LLL. Seconded by Councilperson Tomerlin. The
motion was tied with a vote of 2 ayes and 2 nays.
Ayes: Councilpersons Tomerlin and Cline
Nays: Councilpersons Kibodeaux and Simons
The motion carried when Mayor Meza case an aye vote, stating he
felt bound to uphold the recommendation from Planning and
Zoning.
3. Election returns were brought in by the district Judges and
returns were read aloud and officially canvassed by the City
Council.

A motion was made by Councilperson Simons to accept and adopt
Ordinance No. 1255 as read. Seconded by Councilperson Tomerlin.
The motion carried, 4 ayes and 0 nays.

Nays: None
4. City Attorney Askins read Ordinance No. 1256: AN ORDINANCE
DECLARING THE RESULTS OF THE ELECTION ON THE QUESTION OF
ADOPTION OF CIVIL SERVICE FOR POLICEMEN"[aITHIN THE CITY OF
LA PORTE; HELD IN THE CITY OF LA PORTE ON APRIL 4, 1981.
A motion was made by Councilperson Simons to accept and adopt
Ordinance No. 1256 declaring the majority of the qualified
voters of the City of La Porte have cast 1186 votes for and
410 votes against the adoption of Civil Service for Policemen
within the City of La Porte, Texas. Seconded by Councilperson
Cline. The motion carried, 4 ayes and 0 nays.
Ayes: Councilpersons Tomerlin, Kibodeaux, Cline, Simons
Nays: None
5. Motion

6. At this time Mayor Meza presented a plaque to Councilman John
Tomerlin and Councilwoman Virginia Cline. Mayor Meza stated
this was a small token of appreciation for their service to
this community.
7. There being no further business to be brought before the
Council, the meeting was adjourned at 8:45 P.M.

ORDINANCE NO. 780- LLZ
AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
finds, determines and declares that heretofore, to-wit, on the
1st day of April, 1981, at 7:00 P.M., a joint public hearing
was held before the Planning and Zoning Commission, and the City
• Council, of the City of La Porte, Texas, pursuant to due notice,
to consider the question of the possible re-classification of
the zoning classification of the hereinafter described parcel
of land. There is attached to this Ordinance as "Exhibit A,"
and incorporated by reference herein and made a part hereof for
all purposes, a copy of "Notice of Public Hearing" which the
City Council of the City of La Porte hereby finds was properly
mailed to the owners of all properties located within two hundred
feet (200') of the properties under consideration.
Section 2. The Publisher's Affidavit of publication of
notice of said hearing is attached hereto as "Exhibit B," incor-
porated by reference herein and made a part hereof for all purposes.
• Section 3. Subsequent to such public hearing, the City of
La Porte Planning and Zoning Commission met in special session
on April 1, 1981, to consider the changes in classification
which were the subject of such joint public hearing. The City
Council of the City of La Porte is in receipt of the written
recommendations of the City of La Porte Planning and Zoning Com-
mission, by letter dated April 1, 1981, the original of which
letter is attached hereto as "Exhibit C," incorporated by ref-
• erence herein, and made a part hereof for all purposes.

Section 4. The City Council of the City of La Porte hereby
accepts the recommendation of the City of La Porte Planning and
Zoning Commission, and the zoning classification of the herein-
after described parcel of land, situated. within the corporate
limits of the City of La Porte, is hereby changed in accordance
therewith, and the zoning classification of said parcel of land
shall hereafter be "District C--Apartment and Commercial District,"
with use limited to a 51-unit, 3-story apartment complex for the
elderly and handicapped. The description of said parcel of land
re-zoned is as follows, to-wit:
All of Bay View Block, Bayshore Park
Subdivision, Harris County, Texas.
Section 5. All ordinances in conflict herewith are repealed,
to the extent of conflict only.
Section 6. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
• Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 7. This Ordinance shall be in effect from and after
• its passage and approval.

WHEREAS, there was held in the City of La Porte, on the
4th day of April, 198.1, an election for the purpose of elect-

person--District 5; and Councilperson--District 6; in accordance
with Section 8.10 of the Home Rule Charter of the City of
• La Porte.

AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION ON THE
QUESTION OF ADOPTION OF CIVIL SERVICE FOR POLICEMEN WITHIN THE
CITY OF LA PORTE; HELD IN THE CITY OF LA PORTE ON APRIL 4, 1981.
WHEREAS, there was held in the City of La Porte, on the
4th day of April, 1981, an election on the question of adoption
of Civil Service for Policemen within the City of La Porte,
pursuant to Revised Civil Statutes of Texas, Article 1269m; and
WHEREAS, there were cast at said election for and against
such question, the following votes:
FOR the adoption of the Policemen's Civil Service Act
AGAINST the adoption of the Policemen's Civil Service Act
as shown in the official election returns heretofore delivered
by the Election Judge and officials to the Mayor and City
Council of the City of La Porte and submitted to the City
Council .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:

thereof given in accordance with law; that said election was
