There were 12 other citizens present. 2. The invocation was given by Councilman Malone. 3. P4ayor stated this was to be a Joint Public Hearing. However, a quorum of the Planning and Zoning Board is not present. [4ith everyone's permission we will drop to item six and go into our regular meeting until such time as we have a quorum. 5. Regular meeting called to order by Mayor Meza. 6. Consider approving minutes of the regular meeting of April 1, 1981; special called meeting April 4, 1981, special called meeting April 8, 1981. Motion • as pre; motion Ayes: Nays: was made by Councilman Kibodeaux to accept the minutes aented. Seconded by Councilwoman Westergren. The carried, 5 ayes and 0 nays. Dickerson, 1718 Roscoe. P~Ir. J. Hudgens: Mayor, this is the item that was convered in the last work session. Under administrative reports, we asked the Council to go ahead and give preliminary approval for the variance because of the individual's contract for the work. We are now asking Council to formally approve that variance. Motion by Councilman Faris to grant the flood zone variance to L. W. Dickerson. Seconded by Councilman Simons. The motion carried, 5 ayes and 0 nays. Ayes: Councilpersons Malone, Faris, Kibodeaux, Simons, Wester- gren Nays: None 3a. The Joint Public hearing was then held by Planning and Zoning and City Council to consider a request to rezone a parcel of land between Highway 146 and Southern Pacific Railroad, being part or all of block 1177, 1178, 1179, 1180, 1181, 1182, 1183, 1196, 1197, 1198, 1199, 1200, from Commercial to Industrial • (with a special use permit to permit construction of a rail and truck-served freight terminal with rail spur). The Mayor stated that at this time the public is invited to come forth and express their feeling concerning this rezoning. Pdr. Frank Burleson with an architectrual firm is here to represent Interamerican Public Distribution Corporation. Mr. Burleson's firm is designing the facility. This facility will eventually hire in the neighborhood of 130-140 people. There will be a dock, 4-foot dock high warehouse, rail served, which 10 percent of their goods will be coming in by rail and they will be shipping in and out by trucks. Mayor ldeza: Where is this parcel of land located? Mr. Burleson: It is about 2000 feet south of Fairmont Parkway. Mayor Meza: South of Fairmont Parkway? Mr. Burleson: That's right. Mayor Meza: Are these blocks 1177, 1178, 1179, 1180, 1181, 1182, 1183, 1996, 1197, 1198, 1199, 1200? Mr. Burleson: Yes, sir, I believe that is correct. • Councilman Kibodeaux: How far is this from the townhomes or the apartments? Pat Muston: Probably the width of the highway. The apart- ments are directly across the highway from the proposed project. Councilman Kibodeaux: Would this be west of the apartments? Mr. Hudgens: I believe the state right-of-way on 146 is 500 feet in width. Councilman Kibodeaux: Nearly all of that is commercial on that side, isn't it? Mr. Hudgens: I believe all of that property south of Fairmont Parkway is currently zoned commercial. Is that right, Pat? Pat Muston: That is all commercial with a portion zoned light industrial. Mr. Hudgens: Well, I mean there is no residential zoning in • that area. Pat Muston: The only building in that entire area south of Fairmont Parkway is the Union Hall on 16th. Councilman Kibodeaux:; That building belongs to the people working at DuPont. Councilwoman Westergren; Mr. Burleson, what products do you intend storing? You say this is mainly in by rail and will be distributed by truck? Mr. Burleson: A portion of this material comes in by rail; the majority will be coming in by trucks but they will be storing polymer resins. At this time they believe the first phase is 214,000 square feet. They believe they will have one user that will take this entire first building and will mean just polymer resins. Councilwoman Westergren: That is this darker area you show on your drawing, the first building? Mr. Burleson: Yes. Councilwoman Westergren: Will you also have office space in that building? • Mr. Burleson: Yes, there will be approximately 2000 square feet of offices. • • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 4 Councilwoman Westergren: It is my understanding the rail goes down through the middle of that. Mr. Burleson: Yes, it comes off of the Southern Pacific lead track, crosses Powell Road and up to the first building. Councilwoman Westergren: What are your plans in the future for expansion? You have all this drawn on there, do you have any schedule as to when you intend to do the others? Mr. Burleson: If the first user takes the entire first build ing of the first phase, possibly they will start the second building before the completion of the first. Councilwoman Westergren: So some of the buildings are more or less on a spec basis? Mr. Burleson: Yes, ma'am, it sure is. Councilwoman Westergren: Do you have a scheduled time when • you intent to complete the entire project? P~Ir. Burleson: All six buildings, no ma'am. I sure don't; that will be up to how many users they get. Mayor Meza: Could you turn that picture, that rendering, around so the public may see it? Show them that portion of the warehouse that will be started. Councilman Malone: Is there anything on either side of that property now, any type of business? Mr. Burleson: No, it is all vacant over there. Councilman Kibodeaux: I would like to ask Knox one question. Does this require a guard or fence around it, like the rail- way equipment? Mayor Meza: Kibby, this is a warehouse with a spur for it. Councioman Kibodeaux: This will have tracks in this spur? ~~Iayor Meza: It will be down the center of the buildings. Mr. Burleson: It will have one spur. • Councilman Kibodeaux: One spur is all you are going to have? Mr. Burleson: It will not have much rail traffic. • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 5 Councilman Kibodeaux: Oh, Okay. Mr. Burleson: It will probably have four cars a day at the most. They will switch the cars before 7;00 A.M. in the morning or after 7::00 P.M. in the evening. Councilman Kibodeaux: Oh, I thought you were going to build more than one spur. Mr. Burleson: No, sir. Mr. Askins: Is the spur that curved line that comes up and down between the buildings? Mr. Burleson: Yes, sir, the track is here and the spur curves down and between the buildings. Mr. Askins: Where the corner is clipped off the building is where you make the curve? Mr. Burleson: Yes, sir. • Councilwoman Westergren: Where will your truck access and exits be; will they be directly off the 146 feeder road? Mr. Burleson: The first phase will be off 146; we will have stop signs for trucks leaving. After the second building is built, we will have access from Powell Road. Councilwoman Westergren: From 16th Street. This initial building you are going to do - what do you estimate your cost to be for that building? Mr. Burleson: Well, we are still in the working drawing stage; we have not gotten a final cost from the contractors, but I would estimate 4 to 5 million dollars. Councilman Faris: This entire facility is designed specifically for storage; there won't be any industrial or manufacturing processes taking place on the premises. Mayor Meza: Pat, I'll ask you this. If it were not for the rail spur, would that fit the criterion as far as commercial is concerned? Pat Muston: Yes, I think it would. It is not really considered • a truck terminal because the trucks would not be using that as their base. • • • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 6 Councilman Simons: There will be no rigs stored there, no 14 or 18 wheel flat beds stored there, just come and go? Mr. Burleson: Possibly overnight, but that would be just for the use of transfer of material to their customers to transfer the product to and from the warehouse. Mr. Askins: In other words, this will not be a terminal for a trucking company; it won't be a base; it will be strictly a warehouse, trucks will call upon it? Mr. Burleson: Yes, sir. • .Councilman Simons: Do you anticipate any chemical hazards being stored? rZr. Burleson: No, sir, it is not hazardous materials at all; it is polymer resins. We anticipate one user taking the entire first building; that one user storing polymer resins. Mayor Meza: Do you have another rendering? Mr. Burleson: Yes. This shows elevation of the building. Councilman Kibodeaux: What is the height? Mr. Burleson: It will be about 25 feet. Mr. Askins: Is it concrete tilt~up? Mr. Burleson: Yes, it is. Councilwoman Westergren: That is the front of it, that smaller drawing, that would actually front on 146? Mr. Burleson: Yes, sir. Mayor Meza: Would you pass it and let the public view it? Mayor Meza: I would like to hear from the public at this time. I would like to have this input; this is a public hearing. T would like to hear from those who have comments, either pro or con. Can everybody hear? This is a public hearing and I would like to hear the input from the public. P+Ir. Ralph Mains, a resident of North 12th Street: This seems • like a good project for that location, as there are no homes in that area. • • C~ Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 7 Mr. Harold Pfeiffer, a resident of 619 South Brownell: Apparently, this is a good, clean type of construction that will blend in with the area. It can only add to the City. Mayor Meza: Anyone else? I would like to hear from Planning and Zoning. Pat Muston~ Our only concern is visual clearance on 146. • U Mayor Meza: If there are no further comments, we will go on to item B. 3b. A joint Public Hearing held by Planning and Zoning and the City Council to consider a request to rezone a parcel of land be- tween State Highway 146 and 16th Street. All and part of Blocks 1174, 1173, 1179 and 1180 from Commercial to Industrial zoning with a special use permit for containers. This request is made by Pierside Industries, Inc. Phillip Beeson, General Manager of Pierside Industries, Inc.: We came to La Porte better than two years ago, at the invita- tion of one of the steamship lines that are normally doing busi- ness at one of our five other branches on the east coast. We have been doing on port repairs of oceanic containers and chassis for the past two years and trading in La Porte for the past two years. It is now time for us to build our container yeard storage repair facility. Some of you may recognize me; I was here before you about a year and a half ago with a similar request, for a different location. After reviewing that location's size limitation, location and things like that, we settled on this area south of Fairmont Parkway on 16th Street between Highway 146 as a much more suitable and larger area for our type of buisness. It is undeveloped and will be a good opportunity for us, and it looks like Interamerican established some sort of precedent in that undeveloped area down there, for clean, carefully though out warehousing, storage, light repair type facility. We have appeared before the Planning and Zoning Commission; we were pleased to get a favorable recommendation from them. The land encompasses exactly 13 acres, bordering on 16th Street itself; there is approximately 1300 feet of woods separating our easternmost boundary from the right-of-way of Highway 146; the yard will be virtually invisible from Highway 146 or Fairmont Parkway. The land, improvements, and building are projected to cost right at $900,000. We have already got $182,000 invested in it at this time. We are ready to go to work. Ede will employ within six .months, right at 35 people, clerical and mechanical people. • • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 8 Mayor Meza: How many people do you employ now? Mr. Beeson: I have eight count. Mayor Meza: Will you try to hire local folks? Mr. Beeson: Yes, absolutely. Most of them are now; as a matter of fact, three of the boys moved from other parts of Houston and are now residents of La Porte and have children in schools here to be closer to the job. Councilman Malone: You won't be storing any filled containers; they will all be empty? Mr. Beeson: Yes, sir, that is correct. This is strictly a repair only type operation. I outlined in a letter to Planning and Zoning the similarities between our business and T don't know if it has ever really been presented to Council this way. This is more or less a body repair shop; containers, either of fiberglass, aluminum, or steel constructed unit. Steel • units are straightened just like an automobile body, cuts are welded up and a little bit of paint on them, the finishes are not exact. There is no sand blasting involved, there is no heavy duty painting involved, that is reserved for a refurb- ishing operation. These are spot repairs to be made to put the containers back in a structurally sound, watertight condi- tion to accept cargo to go back overseas. Councilman Faris: I assume you will be storing these containers in the yard? Mr. Beeson: Yes, sir. Councilman Faris: Do you have any plans for paving of the yard? Mr. Beeson: Yes, sir, the initial plans right now, we have already let bids and have made contacts with the macadam sur- facing, seems to be very popular here. Councilman Faris: Over the entire surface. Mr. Beeson: The initial stages will be for 6.36 acres of the 13 to be improved, paved. The building will be 8500 square feet, will be a ceiling height of 24 feet, a 20 foot eave heid~ht. The other 6-3/4 acres will remain wild. We do not intend to develop the whole thing until space-limitations • require it. • • • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 9 Councilwoman Westergren: Is this a sketch or a rendering of what you intend to do? Mr. Beeson: Yes, ma'am, it is not a sketch. This is not real bit, let me get this down. This is an aerial photograph of our yard in Charleston, South Carolina, which does exactly the same type of operation. Councilwoman Westergren: How many acres are involved here? Mr. Beeson: That is a 12 acre tract. Councilwoman Westergren: Would you build your building and office like this one? Mr. Beeson: Very similar, yes, ma'am. It is an open building; the concept and the plans we have right now is a 3-sided building. Both of the ends being closed and the back wall be- ing closed to shield against the normally southeasterly winds we get off Galveston Bay. The front side will be open with a • 60-foot stretch at one end for equipment, parts storage and things like that. Councilman Faris: What type of construction is the building? Mr. Beeson: Steel. We have contacted Marathon and three local builders. Fortunately the three local builders were low bidders. Mayor Meza: You are almost as close to the railroad here as you are in Charleston. Mr. Beeson: It looks like it will turn out to be that way, although we have nothing at all to do with rail traffic; we don't need a spur. Councilman Malone: You will bring all containers in by truck? Mr. Beeson: Yes, sir. It is an in-and-out operation that normally takes, when you do it right, between 5-7 minutes. A truck comes in, we load the container on a chassis, fill out the paper work, and the truck will be gone. Councilman Kibodeaux: Where will they be coming from? Mr. Beeson: They will follow the mainly established routes coming from Barbour's Cut Boulevard to 146 to Fairmont or down 146 from town to Fairmont onto 16th Street. Southbound con- tainers will be going to Galveston down 16th Street to McCabe Road to 146. • • • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 10 Councilman Faris: I see there are some containers there with wheels, some without; that would be standard conditions? Mr. Beeson: Those are normally a dropped-off type situation. Those would be containers already mounted on the chassis. They look just like vans as opposed to removing the containers from the chassis and putting them in stacks. These in this instance are most likely units that are prepared to go out. When we know, for example, in advance that such-and-such steam- ship line will need seven of their containers, we will pre-- mount seven of their containers on chassis so the truckers may get them and leave right away without going the the for- mality of waiting while we get them ready. Mayor Meza: I would like to hear some input from the public on this hearing. This is a public hearing. Mrs. Franks, a resident of North 13th: I think it"s a good project for the location. • Mrs. Joyce Smith, 1516 Cedar Cove: I have a.townhome across the street from this proposed facility. I have known these people for a while and they are good people. I am in favor of the project. Mayor Meza: Is there anyone else? If not, Planning and Zoning, you will retire to the conference room, and come back with your recommendations. 8. Administrative Reports Mr. Hudgens: I have note; we covered the waterfront last week, Mayor. 11. Council Action Councilman Malone: Mayor, I would like us to consider rezoning Lomax to the way it was before the consolidation. Mayor Meza: There is no problem with that, if Planning and Zoning could take that into consideration and come up with a recommendation and put it on the next workshop as an agenda item and on the agenda at the regular meeting, if everybody agrees. Is everybody agreeable with that? . Councilman Faris: Speaking of zoning, I would like to see this Council, this being the first time I have really been prepared to say anything at a meeting like this. I would like to see this Council put together a consolidated or concerted effort to have a consistent plan to work with in the future. As for as specifics are concerned, I am not prepared right now to mention any particular specifics, but would like to look at a consistent plan for zoning throughout the City to promote the growth of the City in a sound and responsible manner. Mayor Meza: That has been the intent of this Council all along. Councilman Simons: The fact is, Planning and Zoning is doing that now. Mayor Meza: We will continue to work at it with that intent in mind. Councilman Kibodeaux: I don't have anything. Councilman Simons: I would like to repeat something that Councilman Malone said. The same thing on Spur 105, we talked about that a while back, about putting that back the way it was. Mayor Meza: Yes, I agree, I will give that also to Planning and Zoning to take into consideration and come by with some • recommendation on that. • • • Minutes, Joint Public Hearing and Regular Meeting April 15, 1981, Page 12 Councilwoman Westergren: I don't have anything. Mayor Meza: While we are still under Council action, I would like to announce there is a public hearing in Clear Lake for the Clear Lake Water Shed Authority that Mr. Brown is trying to pursue along with representative Pennington, to have a unified multi-county flood control. That will be tomorrow at 4:00 P.M. at the Harris County-Galveston County Subsidence District Office and that is at 1660 West Bay, I think it is called Friendswood in the area where they are now. It is a public hearing and I would like someone from the City to attend. I will try to be there part of the time, but I have another commitment after that. I would also like to remind you all there is a public hearing on redistricting for the Congressional Districts in the State Senatorial districts. That hearing will be April 24th; there will be two hearings on that date, one at 1:30 in the afternoon and the following meeting will be at 4:30 in the afternoon. Those are going to be held at the Commissioners Court Conference Room. That's all I have. If that is all the order of business for the City Council, I will remind the citizens that tonight at midnight is the filing deadline for your income tax. I entertain a motion to adjourn. 12. Mr. Frank Burleson, architect, met with Planning & Zoning on March 2, 1981, to present a request for rezoning from Com- mercial to Industrial to permit construction of a rail and truck-served freight terminal with rail spur. Another representative had met with Planning & Zoning on February 2, 1981, but the request was tabled for further inform- ation. Mr. Burleson was not aware of the previous questions by commissioners, therefore he did not have the information re- quested. • Planning & Zoning's questions dealt with specific placement of buildings for aesthetic and safety reasons, type of loading and unloading equipment to be used, placement of the rail spur, and rail road requirements for crossings. Planning & Zoning has again tabled the request until March 9, 1981, or until such time as Mr. Burleson can get specific answers to our questions. At such time as he obtains the information requested, we will again place this item on the agenda. Respectfully, Pat Muston, Chairman PM/cb U • MEMORANDUM March 17, 1981 TO: Mayor and City Council FROM: Planning and Zoning Commission SUBJECT: Request for Rezoning from Commercial to Industrial, Interamerican Public Distribution Corporation Planning and Zoning met on March 16, 1981, to consider the request by Interamerican for rezoning a parcel of land approxi- mately 42 blocks south of Fairmont Parkway, and extending from Highway 146 west to the Southern Pacific Railroad. Interamerican wishes to build a public warehouse facility served by a rail spur. The facility would deal primarily with the storage and shipment of plastics in pellet and granular form. Planning and Zoning feels that the property is well suited for such use in that it is located in an undeveloped area which is well-removed from residential neighborhoods and is accessible • to established truck routes. Our primary concern is the place- ment of buildings on the property to assure visual clearance at rail and truck crossings. Planning and Zoning requests a public hearing to consider this rezoning request. Our preliminary recommendation is that the property be rezoned Industrial under the provisions of Ordinance 780XX to allow construction of a rail and truck-served public warehouse/freight terminal including rail spur, with mini- mum setback of 20' from all public rights-of-way. BEESON, MANAGER • MEMORANDUM March 3, 1981 TO: Mayor and City Council FROM: Planning and Zoning Commission SUBJECT: Request for Rezoning from Commercial to Industrial Under Ordinance 780XX, Pierside Industries On March 2, 1981, Planning & Zoning met to consider a request from Pierside Industries to rezone a 13-acre tract from Commercial to Industrial. No representative of Pier- side Industries was present. Subject property lies 22 blocks south of Fairmont Parkway with frontage on 16th Street. Pierside Industries proposes to construct a facility for storage and repair of oceanic containers. Purchase of the property was contingent upon such use. A letter to the seller, Mr. Stuart Haynsworth, from the City Inspection Department verifies such use to be consistent, at that time, • with the Commercial zoning classification. However, that letter has been superceded by Ordinance 780XX. Pierside Industries' request was denied. The following reasons for denial were cited: problems with truck traffic, visual pollution, possibility of radioactive materials leakage, noise level, and proximity to local housing. Planning & Zoning feels the need for more information regarding the container industries, and better guidelines for placement of such facilities. After discussion with Mr. Phillip Beeson, manager of Pier- side Industries, I find that he was not notified of last night's meeting. A • special use permit will bring the property into compliance with La~ Porte guide lines so that we may conduct our business, which is: 1. The repair of empty oceanic cargo containers and chassis. 2. The storage of said empty containers and chassis upon complete tion of the repairs. The repair of steel units involves cutting away the damaged area with torches and arc welding new patches or panels in its place, In some instances damages may be repaired by simple hand Hammering. The cut and welded areas are finished 6y priming and painting with spray cans. On aluminum units the damaged areas are cut away with saws, holes are drilled, and new aluminum parts are riveted into place with pneu- matic hammers. A third type of container is the fiberglass reinforced plywood unit. Again the damages are cut away with saws, a new panel is inserted and glassed into place, The patch. is then sanded and painted, From this description you can see the parallel between our business and an auto body repair shpp, the only difference being, our bodies are larger and our finished aren't nearly as exacting. Once the repairs are accomplished, the unit would be stacked on our yard, until the owner calls for it, At that time, the owner or lessee of the container, and or chassis, would dispatch a truck to our location and the needed units would then be transported away, • PIERSIDE INDUSTRIES, INC. • P.O. The site lies within easy access to established, approved, truck routes. Fairmont Parkway, state highway 146, and Barbours Cut Boulvard. B. It will set a precedent for non polluting, carefully thought out, light industrial growth, in a basically undeveloped part of the city. C. The location is virtually invisiable from Fairmont Parkway and highway 146 becauue of the areas natural vegetation. We are not new arrivals, seeking to take advantage of La Porte's proximity to the expanding Barbours Cut Terminal, We have been in business in La Porte for more than two years, and are sensitive to the • city's feelings concerning growth, which is why we chose the 16th street location so carefully. La Porte is our sixth branch in the United States. This report by the City of La Porte Planning and Zoning Commission shall rescind the preliminary report dated March 3, 1981, regarding the request by Pierside Industries, Inc., for rezoning. Mr. Phillip Beeson, Manager, and Mr. Dick Gregg, Attorney, met with Planning and Zoning on March 9, 1981, at a special called meeting. When this item came up on the agenda of our regular meeting on March 2, 1981, several questions and objec- tions were raised by Planning and Zoning Commissioners. No representatives of Pierside Industries, Inc., were present at the March 2 meeting. At that time, our preliminary recommenda- tion to City Council was to deny approval of the rezoning re- • quest. Members of Planning and Zoning are split on this issue. Some feel that all container storage and repair yards should be located in the Northeast section of La Porte, thus limiting the unsightly aspects of the operation to one area and possibly relieving the truck traffic through the city. Other commissioners consider the property ideally suited for such use, in that it is well removed from residential areas and has access to established truck routes. In addition, the property owner has offered to screen the container yard with a fence or plantings. After hearing additional information from Mr. Beeson on March 9, Planning and Zoning wishes to change its preliminary report and recommend that Council consider approval of the re- zoning request. We request a joint public hearing with City Council to consider this proposal.
