The invocation was given by Councilperson Tom Simons 3. Council considered the minutes of the regular meeting of the La Porte City Council held on October 21, 1981. A motion was made by Councilperson Kibodeaux to accept and approve the minutes as presented. Seconded by Councilperson Simons. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Malone, Longley, Faris, Kibodeaux, Simons, Gay, Westergren and Mayor Meza Nays: None 4. Mayor Meza recognized Mr. Henry Stange. Stange: Your honor and ladies and gentlemen, my name is Henry Stange and I am the President of Coast Container Corporation, Inc., as well as the operator of the company. T have been in the container business for nine years and by profession I am a ship's captain. Since 1976 I have put up container storage and repair in Hamburg, Germany, in Antwerp and in Italy, and in the last year in New Orleans. I appreciate that the Council • • Minutes, Regular Meeting, November 4, 1981 Page 2 • gave me additional time to explain my request for the re- zoning of tracts 12 and 21 and the "Special Use Permit" for container repairs and storage. I don't have to explain to you that since Barbour's Cut Termi- nal was put in this area it has and will change the entire structure of this area to quite some extent. When I came first to Houston in 1979, I was convinced .that this area would be the future site for the hub of container operations, especi- ally with the plans of the Port Authority to increase numbers of ships berths up to double the present number. When I ap- proached back in August the City of La Porte with my plans for said tracts 12 and 21, I was told by the Planning and Zoning Commission that my request fit the long term zoning plan because the sites north of Barbour's Cut Boulevard and east of Highway 146 are dedicated from container and other port-related operations. T'is my opinion that it is advisable that a City like La Porte that is so close to a major con- tainer terminal is prepared with the proper zoning for these kinds of operations instead of allowing or just accepting • container facilities all over the City. Where else would be a better area than north of Barbour's Cut Blvd. and east of Highway 146? It is still close enough to the port terminal to facilitate profitable operations, which includes good and easy entrance off of the main traffic routes. Second, there are already-two major container outfits in this area, and third, Fort Authority already owns a lot of other tracts in this area and will use these sites for similar opera- tions. Finally, there's a big landfill which cannot be used for any commercial operation within the next time of period. All these new facilities will create a big improvement economy- wise within the future period and create a lot of new jobs, and by that will attract additional business like warehouse and even production plants. There will be additional basic income and general improvement for the City of La Porte. This planned facility here in La Porte will create, after the first year's operation, at least 25 new jobs. The complete investment will be more than one million U. S. dollars. Just the improvements without the cost of the land itself, and will go more or less into local business, as several people from the public can judge from issuing bids to me. With our knowledge in this kind of business we can guarantee jobs for the future, but also proper care of the facility according to European standards. As I committed myself with •-- a letter to each Councilman, I will put in a 3 to 5-feet deep • • Minutes, Regular Meeting, November 4, 1981 Page 3 • green belt outside the fence on the west border fronting on the Highway 146, and furthermore, I will do everything pos- sible to make this site attractive and pleasing to the eye, including continued maintenance to the site itself. Finally, the City of La Porte has approved in the past, two similar operations in this very area, and even one in the commercial area of the City. I hope,- therefore, that you will not turn down my request for the same kind of operations. Thank you for your attention. 5. City Attorney Askins read:' AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF A motion was made by Councilperson Faris to approve and adopt Ordinance No. 780-UUU as read y City Attorney As ins rezoning Blocks 12 and 21 of the Nebraska Syndicate, from Commercial classification to Industrial classification with a special use permit to allow a container storage and repair yard. Seconded by Councilperson Gay. The motion carried, 5 ayes and 3 nays. Ayes: Councilpersons Longley, Faris, Gay, Westergren and Mayor Meza Nays: Councilpersons Malone, I~ibodeaux and Simons Faris: Mr. Mayor, this is the first ordinance we have had be- fore this Council since I have been a member which required a green belt or visual screen between the actual operations and the Highway 146. I know that is not the situation we have with the other businesses out there now, but I personally think it's a pretty good idea. I would like to, since we are re- quiring it in this ordinance, require it in any future ordi- nance that the Council considers concerning this type of business in that area or along any thoroughfare to make sure that we are camouflaging the entrance ways to the City. I notice that when T go to Clear Lake and in Deer Park, that they have a good deal of planting and greenery around their major thoroughfares and in the case of Clear Lake, they have a tot of greenery in the medians, even. I think that's a real good idea, and something we should look forward to in our City. 6. Mayor Meza stated the Ordinance amending Ordinance No. 705 would be tabled at this time. L~ • u Minutes, Regular Meeting, November 4, 1981 Page 4 • Meza: This item will go back to Planning and Zoning with the recommendation that .they be located along a major thoroughfare and we are looking for some additional modifications to it. There is another ordinance that goes with this ordinance that was not put on the agenda. This item. will have to be tabled until such. time as we can hold a public hearing on the second ordinance. This is the ordinance on mobile home subdivisions. 7. Council considered casting their ballot for Director of the Harris County Appraisal District for a term beginning January 1, 1982. A motion was made to cast La Porte's ballot in favor of Fred Hartman, by Councilperson Simons. Seconded by Councilperson Kibodeaux. The motion carried, 8 ayes and 0 nays. City Attorney Askins read: AN ORDINANCE PROVIDING FOR CERTAIN ADDITIONAL PENALTY IN CONNECTION WITH DELINQUENT TAXES OWED TO THE CITY OF LA PORTE (HEREINAFTER REFERRED TO AS THE "TAXING UNIT") A motion was made k adopt Ordinance No. by Councilperson M~ The motion carried, 8 ayes and 0 nays. Mayor Meza stated item 9, appointing Directors to the La Porte Area Water Authority is to be tabled.. 10. Council considered Change Order No. 6 on the Lomax paving and drainage project. The change order is for an additional 10 tons of lime to produce a more workable subgrade on Houston Avenue, resulting in a net increase on the project of $735.00, bringing the total contract price to $1,277,585..00. Council considered Change Order No. 7 on the Lomax paving and drainage improvement project. The change order is for the construction of a storm sewer junction box (actually an extension of the 42" RCP) resulting in a net increase on the project of $1,200.00, bringing the total contract cost to $1,278,785.00. A motion was made by Councilperson Faris to approve change order no. 7 as recommended by Joerns. Seconded by Council- person Longley. The motion carried, 8 ayes and 0 nays. Council considered Change Order No. 3 - Contract III, Lift Station - EPA Project - Big M Contractors. The change order is for the installation of a 10" gate valve in the discharge side of the new pump installation at Fairmont Parkway at a cost of $1,349.00 in addition to the installation of six (6) air release valves (one for each pump) at both lift stations, at a cost of $3,000.00. The total net cost of change order no. 3 being $4,349.00. Both items are Grant eligible and 75~ of the costs will be paid for by EPA upon their approval. A motion was made by Councilperson Simons to approve change order no. 3 - EPA project - Contract III - Lift Station - Big M Contractors, subject to approval by Texas Department of Water Resources and EPA. Seconded by Councilperson Malone. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Malone, Longley, Faris, Kibodeaux, Simons, Gay, Westergren and Mayor Meza Nays : None 13. Council considered Change Order No. 2 - Sewer Construction Project for Service Center - David Wight Contractor. The change order is for shell used as bedding material when wet trench conditions were encountered on the project, requiring 41 tons of shell.. The net increase in the project is $541.72. • A motion was made by Councilperson Kibodeaux to approve change order No. 2 -David Wig t Construction. City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE N0. 1285, "AN ORDINANCE IMPLEMENTING POLICEMEN'S CIVIL SERVICE; ESTABLISHING CLASSIFICATIONS; NUMBER OF AUTHORIZED POSITIONS IN EACH CLASSIFICATIONS; ESTABLISHING PAY SCHEDULES; CONTAINING A SEVERABILTTY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; CONTAINING A REPEALING CLAUSE; AND PRO- VIDING AN EFFECTIVE DATE HEREOF". A motion was made by Councilperson Faris to pass and approve Ordinance No. 1285-A as read by the City Attorney. Seconded by Councilperson Westergren. The motion carried, 8 ayes and 0 nays. Administrative Reports: Public Works Director Jerry Hodge presented costs for new Christmas street decorations for the City. of La Porte. Hodge gave costs for several plans. President of the La Porte Bayshore Chamber of Commerce Lou Lawler addressed Council concerning the need for new Christmas decorations for the streets of La Porte this year. She re- vealed the date and plans laid by several civic organizations and the school to light La Porte for the Christmas season on December 5, 1981. Lawler further committed $2,000.00 towards the purchase of Christmas decorations for the streets of La Porte this year. A motion was made by Councilperson Malone declaring an emer- gency due to the short time for o taming t e nee a ecora- tions and appropriating 5, 4 .00 from t e General Fund Contingency to purchase new C ristmas street decorations. Seconded by Councilperson Simons. The motion carried, 8 ayes and 0 nays. Council Action: Malone: Questioned load limits on residential streets. Asked about effects and specifications for using Macadoo on streets in La Porte. Simons: Requested an executive session on personnel. Gay: Questioned truck traffic on 8th Street. Westergren: Consider landscaping thoroughfares coming into the City in next year's budget. Mayor Meza: Mayor Meza read Resolution. 81-26, A Resolution authorizing Harris County to install and maintain traffic lights at Spencer and 16th Street. Council returned to the Council table at 8:30 P.M. Mayor Meza asked that the minutes reflect that the Council has taken under consideration the case of Officer Jack Maxwell. Officer Maxwell was injured in an on-duty accident in May of 1979 and has continued problems relating to that injury. Mayor Meza advised the Council he had discussed the demolition of the old Public Works building. 18. Meza, Mayor ~ ~ • ORDINANCE NO. 780-UUU AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit, on the 28th day of October, 1981, at 7:00 P.M., a joint public hearing, recessed from October 21, 1981, due to a lack of a quorum of the Planning and Zoning Commission, was held before the Planning and Zoning Commission, and the City Council, of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible re-classification of the zoning classification of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. Section 2. The Publisher's Affidavit of publication of notice of said hearing is attached hereto as "Exhibit B," incor- porated by reference herein and made apart hereof for all purposes. Section 3. Subsequent to such public hearing, the City of La Porte Planning and Zoning Commission met in special session on October 28, 1981, to consider the changes in classification which were the subject of such joint public hearing. The City Council of the City of La Porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Com- mission, by letter dated October 28, 1981, the original of which letter is attached hereto as "Exhibit C," incorporated by ref- erence herein, and made a part hereof for all purposes. • • Ordinance No. 780-UUU, Page 2. Section 4. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the zoning classification of the herein- after described parcel of land, situated within the corporate limits of the City of La Porte, is hereby changed in accordance therewith, and the zoning classification of said parcel of land shall hereafter be "Industrial," and with a special use permit, • with use strictly limited to allow a container storage and repair yard. The description of said parcel of land re-zoned is as follows, to-wit: TRACT A That certain 7.7 acre tract of land on State Highway 146, as described by metes and bounds on the plat attached hereto as Exhibit "D", incorporated by reference herein, and made a part hereof for all purposes; TRACT B That certain x.1869 acre tract of land on State Highway 146, as described by metes and bounds on the plat attached hereto as Exhibit "E", incorporated by reference herein, and made a part hereof for all purposes. Section 5. It shall be a condition of this Special Use . Permit that, at all times while the above-described property is used as a container storage and repair yard, that the West five feet (5') of said property be densely planted and continuously maintained as a "green belt" visual screen, using pine trees and shrubbery. Failure to keep and maintain such "green belt" shall cause this Special Use Permit to be subject to revocation by City Council. . Section 6. In order for this process to be instituted by the City of La Porte an ordinance must be adopted by the City Council. The City of La Porte retains the services of a delinquent tax attorney to represent the city in all matters pertaining to delinquent taxes. For this service our tax attorney is paid fifteen percent (15a) of all monies collected from delinquent taxes, including taxes for. the current year which are still due and which may be collected after July 1st of the current tax year. This means the taxpayer that pays his taxes on time is paying this fifteen percent (15~) penalty for the attorney fees for the delinquent taxpayer. As an example, a delinquent taxpayer paying a delinquent tax statement under our present system, the tax statement is for the tax years 1979 and 1980, a total of $358.50 which includes taxes, penalty and interest. Of this $358.50 the city must take out the 15o for attorney fees, $53.78 and send this amount to our delinquent tax attorney, the city would net $304.72 from this delinquent tax collection. If the "Additional Penalty" (attorney fees) were instituted the city would collect $358.50 plus $53.78, a total of $412.28, the city would net $358.50, and send our tax attorney the "Additional Penalty" of $53.78. It is the consensus of opinion from .the tax office and our delinquent tax attorney that the "Additional Penalty" (attorney fees) ordinance should be adopted and the fifteen percent (150) attorney fees ("Additional Penalty") should be passed on to the delinquent taxpayer who i fired the additional fees . ~-,: .~=~~~~v Tax Assessor Collector City of La Porte E/ • ORDINANCE N0 . r'~ c~ AN ORDINANCE PROVIDING FOR CERTAIN ADDITIONAL PENALTY IN CONNECTION WITH DELINQUENT TAXES OWED TO THE CITY OF LA PORTE (HEREINAFTER REFERRED TO AS THE "TAXING UNIT") BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. It shall be the declared policy of the Taxing Unit that the expenses of collecting delinquent taxes owed to the Taxing Unit now an unfair .burden on the general revenue and the taxpayers who pay on time, should be borne instead by the delinquent properties and their owners who are responsible for causing such expenses; and to effectuate this policy, the Taxing Unit hereby orders that such costs be charged against the delinquent properties and their owners as "Additional . Penalty" as herein provided, and the same are hereby made a part of the tax liens against the delinquent property to which each such costs is attributable. Section 2. The Taxing Unit's designated Attorney with whom the Taxing-Unit has contracted pursuant to Section 6.30 of the Property Tax Code, VTCA, shall assist, by suit or otherwise, in the collection of delinquent taxes owed to the Jurisdiction, and to recover such costs, Jurisdiction shall be entitled to and shall collect an Additional Penalty of fifteen percent (15~) of the delinquent taxes, penalty and interest due on each delinquent property at the time of collection, before or after suit and/or foreclosure sale, provided further that as to payment of taxes delinquent and owing from the most current year, the Additional Penalty as to that year shall be added as • specified above at the maximum of fifteen percent (150) commencing July 1 of the calendar year next succeeding the year for which taxes are due. Section 3. If any provision of the Ordinance or the application thereof to any person or circumstances is held to be invalid, such invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provisions or application, and to this end provisions of the Ordinance • Ez • Ordinance No. ~ Page 2. are declared to be severable. It is further specifically provided that if any of the Additional Penalty herein provided ever should be determined upon final adjudication to be in excess of the amount(s) allowed by any applicable law(s), then any such Additional Penalty nevertheless shall be valid and collectable for the maximum amount(s) allowed by law, the same as if such maximum amount(s) had been .specifically ordained herein in words and figures. Section 4. If it ever should be determined by a final adjudication that this action should have been in some form other than an Ordinance, then and in that event, the above and foregoing shall be considered to have been passed, approved and adopted by the governing body of the Taxing Unit as a Resolution or an Order or in whatever form is legally necessary under Section 33.07, Property Tax Code, VTCA, or any other applicable statute, to impose the charges above specified. Section 5. This Ordinance shall be effective on and after January 1, 1982. All previous Ordinances currently in effect imposing a Collection Expense on delinquent taxpayers in the nature of an Additional Penalty are hereby revoked effective January 1, 1982. SUBJECT: Lomax Paving Project - Houston Avenue Change Order ~~6 McKey Construction has agreed to mix and compact Station 0 + 40 to Station 13 + 40 on Houston Avenue. The City will pay for 10 tons of lime Only. The original percentage of lime specified for this project did not produce a workable subgrade in these areas. Unfortunately, at the same intersection there is a sanitary sewer manhole, gravity main, and force main paralleling the road. Due to the crowded conditions, the alignments of the 42" RCP left the sanitary sewer partially exposed in the ditchline. In order to protect the structural integrity of the manhole, it was necessary to construct a storm sewer junction box (actually an extension of the 42" RCP). This item was discussed once before when a similar • junction box was approved by change order 4~2. The additional cost for change order 467 is $1,200.00. The approximate contingency available on the project is shown on the next page. After the October construction estimate is reviewed, the Engineering Dept. will update the contingency fund figure. The valve shown on the old Fairmont Park plans and therefore, can't be used as originally to complete the plant time and 10" gate does not exist intended. • 2) Installation of 6-Air Release Valves (one for each pump) at both lift stations. These are recommended items on all large lift station operations. The air release valves; however, were not included in the lift station equipment and need to be added by change order. Estimate includes miscellaneous piping. $3,000.00 $4,349.00 Both items are Grant eligible and 75% of the costs will be paid for by EPA upon their approval. The Engineering Department recommends the acceptance of change order ~~3, subject to T.D.W.R. and EPA approval. CITY OF LA PORTE INTER-OFFICE MEMORANDUM T0: Jim Hudgens, City Manager DATE: October 19, 1981 FROM: Jerry Hodge, Director of Public Works SUBJECT: Christmas Decorations After reviewing several different types of Christmas decorations, we are asking that you consider the attached decorations and price list: Item A - Ornament Skyline - across the street - $581.00 each Item B - Double Halo Candles - pole mounts - $481.00 each Item C - Santa Face - pole mounts - $349.00 each Item D - Tree Skyline - without 18 inch bell - $570.00 each with 18 inch bell - $670.00 each The decorations will be prefabricated, which will save the city shipping charges. All decorations will be lighted with approximately 900 watts to each 100 foot line and 800 watts to each 80 foot line. The decorations are also equipped with snap on hooks for easier installation. We find that there is a difference in width between Main and Broadway Streets of 20 feet. This will cause the price to vary if you were to decide to use the across the street decorations citywide. We have a total of nine (9) across the street mounts from previous years and a total of five (5) pole mounts from the previous years, totaling 14 decoration needed, if decided to purchase. A. First alternate is to use the Ornament Skyline along with the Double Halo Candles. The cost of this would be approximately $6,204.00. B. Second alternate would be to use the Tree Skyline along with the Santa Face. The cost of this would be approximately $6,775.00. Both of the above is using nine (9) across the street and five (5) pole decorations. There could be any combination of the four decorations, but the abovestated are the two I recommend.
