Members of the City Council Present: Mayor J. J. There were some 19 other persons present in the Council Chambers. 2. The invocation was given by Councilperson Norman L. Malone 3. The City Council considered the minutes of the Regular Meeting of the La Porte City Council held December 19, 1981. A mo- tion was made by Councilperson Skelton to accept the minutes as presented. Secon ed by Councilperson Simons. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Malone, Longley, Faris, Simons, Gay, Skelton, Westergren and Mayor Meza Nays: None 4. Council considered an ordinance read by City Attorney Knox Askins: AN ORDINANCE AP'iENDING ORDINANCE NO. 1000 OF THE CITY OF LA PORTE, DESIGNATING THE AREA LQHERE BEER FOR CONSUMPTION ON PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE. A motion was made by Councilperson Simons to approve the pas- sage of Ordinance No. 1000E as read by-City Attorney As ins, permitting the sale of beer for consumption at 1018 Highway 146 South, La Porte, Harris County, Texas, nown as Tooney's. Seconded by Councilperson Westergren. • Westergren: Mr. Mayor, I have a few questions about this. We have an attachment here from Mr. Paulissen in regards to the septic system. It is not very clear concerning any agreement • • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 2 to tie onto the sewer line when it becomes available. Danny Barfield: Mr. Mayor, may I address the Council, please? My name is Danny Barfield and I represent Hardy Interests, Inc. which is the owners of the property in question. We under- stand there is a problem or there could be a problem with the sewer on the property which is the subject of the ordinance just read. My client is prepared to submit a letter tonight in .which reads that it is their understanding that a sewer line is soon to be available to the property. At the time that it is made available we would definitely hook up to the sewer line. We would present that to the Council at this time. We understand that the sewer line is across Fairmont Parkway would require a core and things, but still that would be bet- ter for everybody concerned on that side of the street to proceed and to develop that side of the street. We don't want to put a septic tank in there either. I think there have been some problems with it, and knowing the problems we have here we would like to make our intentions known; that when the City makes the sewer available and that line is on stream with the new City plant, we intend to hook up to it. Tf there are any other questions, I have my client here if there are any questions regarding this matter. Westergren: Do you have any idea regarding the span of time until you plan to open? About how long do you plan to be on a septic system? Barfield: Yes, Ma'am, my clients are in the process of obtaining the other necessary permits for the sale of beer which we must receive from the County and State, and that will probably take about six weeks, which will put us into the middle of February. If in fact it occurred, and we knew--ah--we don't want to spend the money for a septic tank--if we knew that line was going to be on stream within a reasonable time, we would wait for the opening so as to hook up to that line first. Malone: Mr. Barfield., are you aware that the business estab- lishment next door to you has its restroom doors locked be- cause of a septic tank system that does not work? Barfield: Yes, sir, we understand that, and that's why we are prepared to spend a little. extra time. Now, we could not say that we are going to wait forever, of course, for the City to open that line. It might come about that we would have to build a septic tank, strictly from an economic standpoint. At • the present time, knowing somewhat that the line is there and will be in use soon, just what we could find out. We haven't • • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 3 really. discussed it with you people, but from what we have been able to find out, we are told you intent to open this line and we want to hook up to it. Skelton: Mr. Barfield, am I interpreting what you have said correctly? You do not intend to put in a septic tank presently, but you are going to wait until the line is complete? Barfield: We would rather. wait. We have the plans to put in a septic tank. We have consulted with the engineer here in La Porte and have been advised as to the size and requirements would be needed. We would, however, rather wait if there is a possibility that the line is going to be opened. If we get to hook up it would enable several others to be able to hook up to that same line and not have to use septic tanks on their property. Faris: Would the Gulf station be required to .hook up to that line if Tooney's did? • Meza: Yes, sir. G_~; I was referring to some of the same things some of the others have touched upon concerning the septic tank. Sir, are you aware of the saturation in this area for the use of a septic tank? You are not going to get proper use out of a septic tank, especially with the gumbo soil. This doesn't matter really, sir, how far you run the lines or even if you put in a pump. The saturation wouldn't take care of it. I don't know what other alternatives that you would use in order to keep -- with-this establishment; you know this is an on premises permit. So there is going to be more use than it was at the Gulf station. These facilities are going to be used more. So we are looking at, you know what T mean, improper use for sanitation purposes. Barfield: Councilman Gay, we are looking to the City of La Porte who has a line very near that area, to open that line so that we may be availed to that service. We intend to hook up to that service. Gay: Sir, is it compulsive that you hook onto the line? Barfield: No, sir, I don't think it is compulsory that we do if it's not furnished by the City. We can deliver the service by the use of septic tanks. It would be extremely costly to us if we did not hook onto the City sewer line. That's why • we choose to hook on. But I think we could meet the require- ments,the City would put on us for services by doing it either way, but the most economical way would be hooking on to the sanitary sewer line. L_I • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 4 Meza: Is the Council aware that a certificate of occupancy will not be issued until such time as there is either a work- able septic tank or a sewer tap made into our sanitary sewer line? Skelton: Mr. Mayor, I have some questions of our City Inspector and. Mr. Joerns, but after Mr. Barfield is finished. Barfield: Sir, I understand there may be some question as to the plans that were submitted not having a kitchen facility, inasmuch as the ordinance requires that food must be served before any beer may be sold for on-premises consumption. The reason the facility has no kitchen facility located in the plan as submitted, is that this is a barbecue facility and the pit will be located outside. This matter has been discussed by my client with your City people and. there will not be a flame which would require fire code ordinances to be enforced within the building. There will be food served. I have here a let- ter from my client, again setting out in writing, not a verbal affirmation to the Council, that there will be food served • before any alcoholic beverage is sold on those premises. Westergren: I have one more question. I am a little concerned about the traffic problem there. Ts there anything your client can do, or cannot do, in people leaving there and going directly back out on 146? If you get enough traffic going in and out of there, we already have a traffic problem at that intersection. There have been a number of accidents at that intersection. I understand you have a driveway that goes out on Fairmont Park- way. That can only go one direction; it won't help much for traffic going the other way. That is my only other apprehension. Barfield: There is more property there than is needed to ser- vice this one business, and that property location is not in- tended solely for the use of Tooney's Restaurant. It is the intention that in the future it be developed, in which case I am sure both driveways would be used. Longley: Mr. Barfield, I had some desire expressed to me that Tooney's have a fence along the back of their property to screen the residential area. I know that is not required, but are there any plans for a fence? Barfield: That is a possibility, but I know of no plans at this time. I think we are going to have to do some serious negotia- tions with our neighbors on both sides, especially when it comes to the sewer tap. • • Minutes, Regular Meeting, La Porte City Council January 6,.1982, Page 5 Angel: I am Bill Angel. I am fifty percent of this corpora- tion. This sewer situation is bad, and to me it's a disgrace. You say the restrooms at the Gulf station are closed. They may be closed, but stand over there for about an hour some evening and see where the people are using the restroom. They are going to go somewhere. Just walk behind the building. It is a shame. The Gulf people want to tie into the sewer; they already have an on-premises license. Those people are going to relieve themselves. somewhere, and they do because T have stood out there and seen it. It is going to go on if we are there or not, and I think we can help the situation. I think what is going on now is much worse than our proposed solution to the problem. When the City offers the service, we beg to hook up, and so does the Gulf station. There is raw sewage draining out on the open ground right now over there. A fence is a minor cost; it is definitely feasible. Skelton: I have a question for Mr. Paulissen. What is the present requirement for the approval of septic tanks? Can you enlighten me on this? • Paulissen: First, if a residence or business establishment is within 200 feet of a sewer line, they are required to tie in to that sewer line. To my knowledge,. as long as I have been here this City has never had a moratorium on building permits where sewer was not available. There are certain requirements in the building code that must be met for a septic tank system. Mr. Reeder, of Reeder Plumbing., is the plumber on the Tooney's job, and has been quite concerned about the sewage problem. He has consulted an engineer and has come up with a workable solution. Neither Mr. Reeder nor the engineer will guarantee the system because the ground in this area. is gumbo, as Mr. Gay said, and the percolation tests come back pretty close to zero. Skelton: Yes, this is why I wanted to find out if we take into consideration the number of people that will use restroom facilities when we issue permits, especially when they have septic tanks, is this true? Paulissen: Yes, sir. Skelton: My second question is for Mr. Joerns. Do you have an idea of the cost of runming the sewer line from across Fair- mont Parkway to this site? Joerns: It will be sizable. Fairmont Parkway probably approaches 200 feet; maybe not quite. They have measured it to be 180 feet • from the manhole to property corner. I feel the City should go ahead and consider oversizing that line to take care of the entire corner property. You are probably looking at an 8 to 10 inch range. Skelton; For 200 feet? To bore under the road? Joerns: Right. Now if it were just one business, 4 inch would be enough. You are probably looking at $20.00 a foot. Westergren: This would be large enough for anyone on the north side of Fairmont? Joerns: Well, we would size it to carry as far as we could. Skelton: The point I was getting at is that if these businesses take care of the payment of the line to service their facility and then the City picks up any additional sizing, what happens when new tenants tie on in the future? • Joerns: The original people would get a rebate. Skelton: So later on, it wouldn't really be that much. Westergren: Mr. Barfield, do you have that agreement with you? Skelton: I doubt that you can put in a septic tank that will work for $4,000.00. Barfield: I have here the two letters of agreement of which I previously spoke, your honor. I would like to submit them for Council's acceptance. Meza: Would Council want to review those at the present time? Before acting on this matter? Skelton: Mr. Mayor, we have much more to review on this matter. I think we ought to put it on the workshop and study it some more. If you have some other proposals we would like to see them. Barfield: No other proposals, your honor. It's simply what we agreed to do, given to you in writing rather than an oral statement. Two matters, one to tie on to the sewer line and the second to serve food before any beer is served. • Meza: May I see the letter, please? C • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 7 Askins: Let the minutes reflect that two letters have been submitted from Hardy-Angel Interests, Incorporated. This one letter states, "beer and wine will only be served on our premises with the customer's option to buy food." I think it should say, "food will be served with the customer's option to buy beer and wine. The intent of the ordinance is that beer not be served unless the customer buys food, not just that food be available. (Askins read both letters, and they are a part of these official minutes.) Skelton: If we're going to have this, and I know that according to this letter we are assured that the plumbing or septic system is going to work. I'm not aware that we are going to have this line available behind his place or in the alley or wherever. Meza: Mr. Skelton, the line is not going to be available be- hind their place, but it is available according to the diagram across Fairmont Parkway. Faris: Mr. Skelton, the line is in the ground. • Meza: The line is there. As I understand from John and Jerry, the new sewer plant will be on-stream by the first or middle of March. Is that correct? That is what we are shooting for. And it will be their responsibility to tap into that line. Skelton: Then it would be your client who would be paying for this boring and this additional cost. Hodge: Mr. Mayor, let me just say that this will be out of the 200 foot range which requires that they hook on to the sanitary sewer. Paulissen: No, sir, it is not. According to our. measurement, it is approximately 180 feet from the manhole to the property line. Hodge: Then I withdraw my comment. Mayor Meza stated he had a motion to approve and pass Ordinance No. 1000E as read and a second. The motion carried, 8 ayes and 0 nays. City Attorney Knox Askins read: A RESOLUTION URGING VOTERS TO SUPPORT THE LA PORTE AREA WATER AUTHORITY A motion was made by Councilperson Faris to approve and accept. Resolution No. 82-1 as read. Seconded by Councilperson Skelton. Malone: Mr. Mayor, I have been in the situation where my city pays a water bill to another city, and it's not a very good situation to find yourself in. I think since this was approved and passed by the State Legislature for the City of La Porte, I feel we should be on the controlling end of this thing. There is a real public need for this. We are all victims of subsidence and flooding. This is one of the reasons for having this. That's why we all had to get off of our water wells 20 years ago in Lomax. Maybe not 20 years ago. This action would pint us in the driver's seat, selling it to the other cities. Hopefully, by selling water to other cities and industries would enable us to sell to our citizens a little cheaper. It is my understanding that the revenue generated from the sale of treated water will wholly support this Authority. I have studied this and talked to other people, and I see no • reason why this is not to the best interest of the City of La Porte. Skelton: Mr. Mayor, I, too, think this would be best for the City of La Porte. I would rather our city be in control, and I know that Deer Park would rather have this and sell us water. I know that it is going to cost more money, more out of my pocket, as well as the citizens in my area. But T think over- all it is best for the City. I might add, recently Harris- Galveston County Subsidence District recently cut the water supply to League City about half. They have had to buy more water from Houston. This same thing could happen to La Porte at any time. I'm definitely in favor. Gay: Mr. Mayor, I also would like to touch on the situation. Water is one of our most critical items within the next 10 years. We just as well get down to brass tacks and realize we have a need. I am wanting to be on the end to sell water, not the end that has to pay and pay. T'm like Mr. Skelton, I know it will cost more out of my pocket, but this is something the citizens of La Porte must realize, that water is going to be one of the main items, so this is almost mandatory that we get on surface water, and I believe we should be the controlling interest. •_ Simons: I am in favor of everything my colleagues have stated. We also have to stop and remember one thing: if we put this in today it will be a lot cheaper than 5 or 10 years from now. • • Minutes, Regular Meeting, City of La Porte January 6, 1982, Page 9 Besides, I know that sooner or later we are going to have to go to surface water. WITHIN THE CORPORATE LIMITS OF THE CITY OF LA PORTE, STRICTLY FOR THE PURPOSE OF CARRYING PASSENGERS FOR HIRE UNDER CONTRACT WITH THE VETERANS ADMINISTRATION A motion was made by Councilperson Simons to approve Resolution No. 82-2 as read by the City Attorney. Seconded by Council- person Longley. The motion carried, 8 ayes and 0 nays. • Ayes: Councilpersons Malone, Longley, Faris, Simons, Gay, Skelton, Westergren and Mayor Meza Nays: None 7. Council considered the recommendation of Park Director Sherwood concerning bids received on December 14, 1981, for one (1) 1982 Z-ton pick-up truck. Bids were received. as follows: Joe Camp Ford $8,010.37 Jay Marks Chevrolet 8,149.10 Timmers Chevrolet 8,259.84 Sherwood stated the vehicle bid by Joe Camp Ford meets the bid specifications and it was Sherwood's recommendation that the bid be awarded to Joe Camp Ford, Tnc., in the amount of $8,010.37. A motion was made by Councilperson Westergren that the bid be awarded to Joe Camp Ford, Inc., in the amount of 8,010.37 for one 1) 2-ton pick-up truck. ,Seconded y Counci person Malone. City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE NO. 1290, APPOINTING DIRECTORS TO THE LA PORTE AREA WATER AUTHORITY; AND PROVIDING AN EFFECTIVE DATE HEREOF A motion was made by Councilperson Gay to approve and ado Ordinance No. 1290A as read by the City Attorney. Seconde by Councilperson Simons. The motion Carrie , 8 ayes and 0 nays. Ayes: Councilpersons Malone, Longley, Faris, Simons, Gay, Skelton, Westergren and Mayor Meza Nays: None 9. Mr. Buck Thomas appeared before Council to discuss the La Porte Area Water Authority. Thomas - 816 South Virginia: I am a concerned citizen of the City of La Porte. I have lived and paid taxes at the same address for the past 45 years. I was elected and served as the last elected City Marshal the City of La Porte had. I • have been elected to two terms as City Commissioner, two terms as Mayor of the City of La Porte. I was appointed as a charter member of the Board. of Directors of the Harris-Galveston Coastal Subsidence District. I served six years on this Board, of which the City of La Porte was one of the cities I represented. I'm not here to point a finger at anyone. Mr. Mayor, I feel like the people of La Porte, including my- self, are entitled to some answers about this water authority you and your Council have asked the people of La Porte to vote on, January 16, 1982. Mr. Thomas proceeded to read several questions, then read page by page from H.B. No. 1311. Meza: We have copied some of the questions Mr. Thomas has asked, and within reason we will answer as many as we can. We have some of the answers, and if it is the Council's desire, we will try. Faris: I would suggest, Mr. Mayor, that we ask Mr. Thomas to reduce his questions to writing and I will donate a sufficient amount of time to give answers to those questions. Meza: It is up to the Council. We have jotted down some of the questions, and Knox has the legal answers to some of them. • From the floor, Mr. J. R. Spradling, 3302 Valley Brook Drive, aaked to speak to the Council. • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 11 Mayor Meza agreed to recognize him if he would be brief. Spradling: I've read about the subsidence for some .time. I'm acutely aware of it. All of us are that live in this area. I understand from some of the things I have read, that since industry has gotten off of underground water, the subsidence has stopped and the ground is coming back up some. Now this is what I read. I've always thought that I would not like to drink surface water. I've read, over a period of years, how people that live down stream and all the toxic waste that runs into it, septic tanks and disposal plants that run into it and it is just nauseating to think of having to drink all that. Plus, I always thought it was a lot more expensive than well water. We live in a highly industrialized community here and we all know that by accident and on purpose that there's a lot of chemical waste goes into the water sheds. There's a lot of agri- culture runoff, there's dead animals, septic tanks and sewer plants. There is all kinds of things goes into sur- face water. Also, just recently, I think it's just a week • or two ago, in the news about Baytown's surface water. That they had a - I don't remember what the word is - but they had a cancer-causing agent in their water and they were having to use a lot of chlorine. Maybe the chlorine was acting with something else to cause it, I don't know; but anyway, this is something I'd like for y'all to consider. I like to drink well water as long as I could. If we are forced to do it someday, O.K., but until that time I'd think we ought to stay on well water. We have heard some conflicting statements here tonight. I believe Mr. Skelton says League City or somebody was required to only pump so much. I don't know that, and Thomas says that's not true. I really don't know, but anyway, what I'm saying is, I'd much rather drink well water than sur- face water, and the cost. I don't know what kind of water bill you've been getting, but my last two water bills, in my opinion, have been pretty high. My last two was $56.23 and $56.43. I think that's pretty high for a water bill, and that's in the winter; I haven't watered anything. In the sum- mer time I water and I can see a $200.00 water bill come sum- mer if I water. If it's going to cost more for .surf ace water we are looking at one heck of a water bill for everybody in La Porte. So this is something I think you'll need to take into consideration. Also, I think you need to do some more checking on subsidence. As I said, it is my understanding that subsidence has stopped. Also, years ago I read in the paper that La Porte, Deer Park, Morgan's Point, Shoreacres, • Seabrook, several of these municipalities around here, that we didn't take out as much water collectively as some of this • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 12 industry took out in one day. I'm not so sure that what we're taking out is going to cause subsidence. I wondered tonight when I heard all of y'all talking about subsidence and we are still plating subdivisions out here in these rice fields, and I guarantee you all the surface water is not going to keep those people from flooding. If you are really wor- ried about people's houses flooding, you might ought to do something about that. Thank you. Meza: Mr. Simons says he would like to hear some of these questions answered; Gus says he would not. I want to know how the Council feels so that we can go on. G_~: Not deviating from the questions or anything, I just wanted to take this opportunity to tell Mr. Spradling this Council ggets literature from the Board telling us what sub- sidence F~ere and in the entire area is doing and we read it. I just want you to know that we do know what subsidence is doing today and yesteryear. We do know about it. Mr. Mayor, I just had to say that. • Meza: What is the Council's wish on this matter? Malone: I feel we should answer what we could. Westergren: As far as I am concerned, we can put it in writing and give it to him. Skelton: I think you should answer some. I don't think you had time to write down all of his questions and I'd prefer that they all be answered, but if you want to do a partial job and then come back and do a thorough job in writing. I think he deserves an answer to all his questions, and I know there is a good answer for every one of them. Meza: Thank you, and that's what we will try to do. I will probably call on Mr. Dave Corbin or Mr. Joerns as I go along. First question was the reason for the creation of the Authority, and the basic reason the previous Council and this one are sup- portive of it is that they wanted to see local control. By local control it does not necessarily mean the City officials were in direct control of it. The Director will be local people. You won't be using water bought from Pasadena or Bay- town or even Houston as far as treated water is concerned. The Directors are subject to recall, they are answerable to the people of La Porte. Now as far as being a party to the law • suit, Mr. Askins, can you answer that? • • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 13 Askins: That suit was a constitutional attack on the creation of the district by a good number of cities, Katy and several cities in southeast Harris County. To my knowledge, it is now being appealed to the upper courts. Meza: As far as Pasadena having a new water contract with Houston, no, I was not aware of Pasadena having a new contract. Of course, I'm not involved with the City of Pasadena in the negotiations of their contracts. Now a feasibility sutdy or an in-depth study has not been done. A preliminary feasibility study was made back before I was mayor. At that particular time, that study told those folks on that Council there was a need. Those folks were desirous of doing something to prepare La Porte for whatever may happen, if we did have to go off ground water. Since then we have been in different meetings with the City of Houston, C.I.W.A. folks and with the subsi- dence district on it. The City of Houston, in fact, at one particular time, Mr. Corbin was there, agreed to sell the area down here water, in fact in a peculiar situation where there was not another treatment facility, and at that time the cost • of water was estimated to have been 18 cents. I understand that today it is somewhere around 22 cents per thousand gallons. The potential customers, well before the sale of anything we are going to have to create potential customers. We had a meeting back in 1979, if I remember correctly, at the Civic Center. I don't have all of the detailed work here in front of me. There were representatives from 13 different industries and representatives from several cities outside our immediate jurisdiction that were interested in paying a share of the cost for an in-depth feasibility study. However, the only way all of these could be brought together is through a water authority that would have the authority to do something, instead of the City of La Porte doing it with everybody else participating. As far as lines going to Fairmont Park, there are adequate lines going to Fairmont Park and there are already emergency connec- tions to Morgan's Point and BayMUD. The line going to Fairmont Park is a 16 inch line. The loop going around McCabe Road is a 12 inch line. If anybody else is desirous of purchasing water, I believe it has been the policy of any city that dis- tributes water, that the purchaser bear the cost of the line laid to that City. The City of La Porte presently pumps 3 mil- lion gallons of water per day. The La Porte Area Water Authority will not operate the La Porte Water Department. The City of La Porte will purchase water from the Authority. The City of Houston indicated to the City of La Porte that a proper water • authority would be allowed to distribute water to other entities in the surrounding area. That is potable water. As far as 40 year contracts, I'd have to ask legal counsel about that as far as the limits of a contractural agreement are concerned. • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 14 Askins: On that section of the bill, the Texas Constitution puts a limit of 40 years on contracts by governmental agencies and also the life of bonds. I think it is important to realize this, this entity would strictly have the power to pass revenue bonds, no ad valorem tax power, and in sequence you would have to have your engineering study, develop your customers, cost estimates then contracts with your customers, and the bond purchasers are going to determine the coverage or how much net revenue will the authority have after paying its normal opera- tion for principal and interest. Very similar to the way La Porte Water Bonds are done. You have to have one and a half times coverage. No bond will ever be offered for sale unless there was a signed contract with a purchaser. The major pur- chaser being the City of La Porte. Those contracts would be collateral for the payment of the revenue bonds. The Attorney General is not going to approve the bonds until he approves the contract and approves that there is adequate revenue gener- ated by the contracts from the various entities purchasing to cover operational expenses and to cover the bonds. So you would never have any disastrous financial situation because the law determines the Attorney General is not going to ap- • prove the bonds until he sees through the paper work that the financing is in order, that there is going to be enough income to engineer it, develop it, build it and operate it on a day- to-day basis at a sufficient profit to pay the bonds. The full faith and credit of the City is never pledged in any way, directly nor indirectly to these bonds. The City of La Porte, nor any other customers of the Authority would ever have any direct obligation on these bonds. The obligation would be under the purchase contract to buy the water. It's got to be a long term obligation over a period of years to give you a sufficient. number of years to amoritize that investment. The large capitol investment you are going to have to build these facilities. So all of this would be subject to your final engineering study. We have the preliminary reports that were done June 1976 and submitted to the Subsidence Board, and by the way, these are public record and available to any citizen or the newspaper. The City's Municipal Bond advisors would have to study it and pass on the financial soundness of it because you are talking about several million dollars in bonds. One of the reasons for the creation of the district is the fact that the potential customers of the Authority are entities in addition to the City of La Porte. What you get into in a situa- tion like that is when you go out to negotiate the contract every- one is going to want to know what are the costs, and it has been found. I'll get back to this later; what we have done on this • bill is, it was very closely modeled after the Baytown Water • • • Minutes, Regular Meeting, La Porte City Council January 6, 1982, Page 15 Authority, which it was written by a bond attorney in Houston in cooperation with the Texas Water Resources Board. In the very structure of it is to have a really clean operation, in other words, a set of books on the Authority that's going to have nothing on them of any municipal function except the pur- chase of raw, untreated surface water, the construction of the plant and the day-to-day operation of that plant and the pump- ing of it to the customers. There won't be any fire depart- . ment on it or anything else. It's going to be clean in that sense. That way, when you go to a customer they won't say, well, have you put some of the overhead of the light bill of some of La Porte City Hall on this water contract? We can say, no, these expenses are just the expenses of the Authority. Now another reason that Baytown did their authority the way they did, Baytown is about 9 years ahead of the City of La Porte on this effort. They have been very cooperative in this effort, by telling us what they did. In some cases we made some changes in their bill because they said if they had it to do over again, we would have done this and this different. Sort of like an older brother on the playground. Fritz Lanham, their City Manager, is Executive Director of it and he has been most helpful. Meza: If it pleases the Council, we have answered most of the questions and I feel we should move on. If any citizen wishes to approach any Councilperson after this meeting or by telephone, they will be more than happy to answer any questions. At this time we will move on to Administrative Reports. 10. Administrative Reports: John Joerns reported Brown & Root is installing an eight (8) inch water line to serve their 18-acre tract south of Fairmont Parkway and adjacent to the Southern Pacific Railroad. It is recommended that a portion of the water main be oversized to twelve (12) inches to accommodate the City's plan of extending a twelve (12) inch water main from S.H. .146 westward along Fairmont Parkway to Underwood Road. The total estimated cost of participating in the oversizing is $4,265.00. The Engineering Department recommends that Council approve and fund the over- sizing. A motion was made by Councilperson Faris to allocate $4,265.00 from the Water and Sewer Improvement Fund for t e oversizen of the 8 inch line being lai by Brown & Root to a 2 inc line. Council Action: Malone: I think we really need to use some foresight when we talk about a subject such as an on-premises beer license. If you can just visualize the site for the one we authorized tonight. There are more accidents at that location than any other in town. I read. in the paper all the things the Chamber has said about beautifying the City, and that location is al- most at the entrance of our City from several directions. This establishment is right behind a residence, and we know for a fact men are going out behind the facility that is al- ready there to use the restroom. This is considered prime property, or was. • The other thing I wanted to call your attention to is one of our employees has had a very serious accident - Leta Brown, who works in Code Enforcement. We have a memo put out to the employees by one of the employees, setting up a fund to help with expenses for Leta and Cecil Money (also injured), at Bayshore National Bank. I think it is great that our employees care about one another and I am making the public aware of Leta and Cecil's need. Meza: The Blood Mobile will be here on January 22 for donations to replace blood that has been used in this case. I was moved by the concern expressed by our employees when they wanted to set up this fund and. then the blood donations. T agreed to this action and they are doing a real outstanding job. Longley: A few weeks ago, Gus Faris's Extra Action Tide had disappeared, and I see tonight it has returned. I have dis- covered why it was missing - it seems. to have a little one. It is not Extra Action, however - obviously not a pure breed. Faris: To Mr. Paulissen and the Inspection Department - I have a Tips to Builders that was in my mail box, and I think it is very informative and very nice to give to citizens and builders in La Porte. I think it is another fine example of the work done by some of our Departments. WHEREAS, the City of La Porte has provided facilities for the collection and treatment of wastewater to promote the health, safety, and convenience of its people and for the safeguarding of water resources common to all; and WHEREAS, provision has been made in the design, construction and operation of such facilities to accommodate certain types and quantities of industrial wastes in addition to normal wastewater; and WHEREAS, it is the obligation of the producers of industrial waste to defray the costs of the wastewater treatment services rendered by the City of La Porte in an equitable manner and, in- sofar as it is practicable, in proportion to benefits derived; and C i WHEREAS, protection of the quality of the effluent and proper operation of the wastewater collection and treatment facilities and quality of effluent may require either the exclusion, pre- treatment, or controlled discharge at point of origin of certain types or quantities of industrial wastes; and WHEREAS, the City of La Porte shall require future compliance with any rules and regulations promulgated under Section 307 of the Clean Water Act: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE, TEXAS: SECTION 1. DEFINITIONS. As used in this ordinance (1) "APPROVING AUTHORITY" means the City Administrator or his duly authorized representative. (2) "B.O.D." (Biochemical Oxygen Demand) means the quantity of oxygen by weight, expressed in mg/l, utilized in the biochemical oxidation of organic matter under standard laboratory conditions for five (5) days at a temperature of twenty (20) degrees centigrade. ORDINr~~1CE NO. ~/ Page 3 (19) "SLUG" means any discharge of water, wastewater or industrial waste which in concentration of any given constituent or in quantity of flow, exceeds for any period of duration longer than fifteen (15) minutes more than five (5) times the average twenty-four hour concentration or flows during normal operation. (20) "STANDARD METHODS" means the examination and analytical procedures set forth in the latest edition, at the time of analysis, of "Standard Methods for the Examination of Water and TrTaste- water" as prepared, approved, and published jointly by the American Public Health Associa- tion, the American Water Works Association, and the Water Pollution Control Federation. (21) "STORM SEWER" means a public sewer which carries storm and surface waters and drainage and into which domestic wastewater or industrial wastes are not intentionally passed. (22) "STOR~tii WATER" means rainfall or any other forms C of precipitation. i (23) "SUPERINTENDEVT" means the Water and Wastewater • Superintendent of the City of La Porte, Texas or his duly authorized deputy, agent or representa- tive. (24) "SUSPE~7DED SOLIDS" (SS) means solids measured in mg/1 that either float on the surface of, or are in suspension in, water, wastewater, or other liquids, and which are largely, removable by a laboratory filtration device. (25) "TO DISCHARGE" includes to deposit, conduct, drain, emit, throw, run, allow to seep, or other- wise release or dispose of, or to allow, permit, or suffer any of these acts or omissions. (26) "TRAP" means a device designed to skim, settle, or otherwise remove grease, oil, sand, flammable wastes or other ha :~ful substances. C (27) "UNPOLLUTED WASTEWATER" means water containing (A) no free~or emulsified grease or oil; (B) no acids or alkalis; (C) no phenols or other substances producing -taste or odor in receiving water; (D) no toxic or poisonous substances in sus- pension, colloidal state, or solution; (E) no noxious or otherwise obnoxious or odorous gases; (F) not more than an insignificant amount in mg/1 each of suspended solids and BOD, as determined by the Texas Department of Water Resources; and (G) color not exceeding fifty (50) units as measured by the Platinum-Cobalt method of determination as specified in Standard Methods. (c) No waste, wastewater, or other substance may be dis- charged into public sewers which has a pH lower than 5.5 or higher than 9.5, or any other corrosive property capable of causing damage or hazard to structures, equipment, and/or personnel at the wastewater facilities. (d) All waste, wastewater, or other substance containing phenols, hydrogen sulfide, or other taste-and-odor pro- ducing substances, shall conform to concentration limits established by the Approving Authority. After treatment of the composite wastewater, concentration limits may not exceed the requirements established by state, federal, C or other agencies with jurisdiction over discharges to receiving waters. SECTION 4. HAZARDOUS METALS AND TOXIC MATERIALS. (a) No discharges may contain concentrations of hazardous metals other than amounts specified in subsection (b) of this section. SECTION 9. IMPAIRMENT OF FACILITIES. (a) No person may discharge into public sewers any substance capable of causing (1) Obstruction to the flow in sewers; (2) Interference with the operation of treatment processes of facilities; or (3) Excessive loading of treatment facilities. (b) Discharges prohibited by Section 9(a) include, but are not limited to, materials which exert or cause concentra- tions of (1) Inert suspended solids greater than 250 mg/1 including but not limited to ( (A) (B) (C) (2) Dis but Fuller's earth lime slurries; and lime residues; solved solids greater than 500 mg/1 including not limited to (A) sodium chloride; and (B) sodium sulfate; (3) Excessive discoloration including but not limited to (A) dye wastes; and (B) vegetable tanning solutions; or (4) BOD, COD, or chlorine demand in excess of normal plant capacity. (c) No person may discharge into public sewers any substance that may (1) Deposit grease or oil in the sewer lines in such a manner as to clog the sewers; (2) Overload skimming and grease handling equipment; (3) Pass to the receiving waters without being effectively treated by normal wastewater treatment processes due to the nonamenability of the substance to bacterial action; or (4) Deleteriously affect the treatment process due to excessive quantities. APPROVING AUTHORITY REQUIREMENTS. (a) If discharges or proposed discharges to public sewers may (1) Deleteriously affect wastewater facilities, processes, equipment, or receiving waters; (2) Create a hazard to life or health; or (3) Create a public nuisance; the Approving Authority shall require (A) pretreatment to an acceptable condition for discharge to the public sewers; (B) control over the quantities and rates of discharge; and (C) payment to cover the cost of handling and treating the wastes. C (b) The Approving Authority is entitled to determine whether a discharge or proposed discharge is included under sub- section (a) of this section. (c) The Approving Authority shall reject wastes when i t determines that a discharge or proposed discharge does not meet the requirements of subsection (a) of this section. SECTION 12. APPROVING AUTHORITY RE VIE69 AND APPROVAL. (a) If pretreatment or control is required, the Approving Authority shall review and approve design and installa- tion of equipment and processes. (b) The design and installation of equipment and processes must conform to all applicable statutes, codes, ordi- nances and other laws. (c) Any person responsible for discharges requiring pre- treatment, flow equalizing, or other facilities shall provide and maintain the facilities in effective operat- ing condition at his own expense. Page 11 (b) When discharges of any waste into the City of La Porte system are approved by the Approving Authority, the City or its authorized representative shall enter into an agreement or arrangement providing (1) Terms of acceptance by the City; (2) Payment by the person making the discharge, in accordance with the User Charge System as estab- lished in Subpart (e} of this Section; (3) Sewer connection procedures and requirements shall be in accordance with the Southern Standard Plumb- ing Code, as amended; (4) A sewer application approved with connection fee paid; and (5) Construction of sewer connections shall be approved by City inspectors prior to sewer use. (c) Each User of the wastewater treatment system will be notified, at least annually, in conjunction with a regu- lar sewer bill, of the rate and that portion of user charges which are attributable to the Operation and Maintenance of the wastewater treatment system. (d) Th Cit ill l e y w app y excess revenues collected from a class of users to the cost of operation and maintenance attributable to that class for the next year and adjust the rates accordingly. (e) User charges shall be in conformance with Chapter 26, Article II, Section 26-15, Sewer Service Charges, of the City of La Porte Code of Ordinances. SECTION 17. INDUSTRIAL COST RECOVERY SURCHARGE. Persons or owners discharging industrial wastes which exhibit none of the characteristics of wastes prohibited in Section 2, other than excessive BOD, or suspended solids, having a concentra- tion during a twenty-four (24) hour period average of suspended solids of BOD content in excess of "normal domestic sewage" shall be required to pretreat the industrial wastes to meet the require- ments of "normal domestic sewage"; however, such wastes may be C accepted for treatment if all the following requirements are met: (a) The wastes will not cause damage to the collection system. (b) The wastes will not impair the treatment process. (c) The discharger of the wastes enters into a contractual agreement with the City of La Porte providing for a sur- charge over and above the existing sewer rates. SECTION 19. CONDITIONS OR PER~~IITS. Page 13 (a) The City may grant a permit to discharge to persons meeting all requirements of. the savings clause pro- vided that the person (1) Submit an application within 90 days after the effective date of this ordinance on forms sup- plied by the Approving Authority; (2) Secure approval by the Approving Authority of plans and specifications for the facilities when required; and (3) Has complied with all requirements for agreements or arrangements including but not limited to, pro- visions for (A) payment of charges; t (B) installation and operation of the facilities and of pretreatment facilities, if required, and (C) sampling and analysis to determine quantity and strength when directed by the City; and (4) Provides a sampling point, when requested by the City, subject to the provisions of this ordinance and approval of the Approving Authority. (b) A person applying for a new discharge shall (1) Meet all conditions of subsection (a) of this sec- tion; and (2) Secure a permit prior to discharging any waste. SECTION 20. POt~lER TO ENTER PROPERTY. (a) The Superintendent and other .duly authorized employees of the City bearing proper credentials and identifica- tion are entitled to enter any public or private property at any reasonable time for the purpose of enforcing this ordinance. (b) Anyone acting under this authority shall observe the establishment's rules and regulations concerning safety, internal security, and fire protection. (c) Except when caused by negligence or failure of person(s) to maintain safe conditions, the City shall indemnify the person(s) against loss or damage to their property by City employees and against liability claims and demands for personal injury or property damage asserted against the person(s) and growing out of the sampling operation. CONTINUING PROHIBITED DISCHARGES. No person may continue discharging in violation of this ordinance beyond the time limit provided in the notice. SECTION 24. PENALTY. (a) A person who continues prohibited discharges is guilty of a misdemeanor and upon conviction is punishable by a fine of not more than two hundred dollars ($200.00) for each act of violation and for each day of violation. (b) In addition to proceeding under authority of subsection (a) of this section, the City is entitled to pursue all other criminal and civil remedies to which it is entitled under authority of statutes or other ordinances against a person continuing prohibited discharges. SECTION 25. FAILURE TO PAY. c • In addition to sanctions provided for by this ordinance, the City is entitled to e:~ercise sanctions provided for by the other ordinances of the City for failure to pay the bill for water and sanitary sewer service when due. SECTION 26. PENALTY FOR CRIMINAL MISCHIEF. The City may pursue all criminal and civil remedies to which it is entitled under authority of statutes and ordinances against a person negligently, willfully or maliciously causing loss by tampering with or destroying public sewers or treatment facilities. SECTION 27. SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this ordinance are declared to be severable. SECTION 28. EFFECTIVE DATE. • This ordinance shall be in full force and effect from and after its passage, approval, recording, and publication as provided by law. Resource Engineering, Inc., consultants for Atlanta Truck Wash, Inc., has applied to the City of La Porte for an Industrial Waste Discharge Permit under Ordinance #1221. The City of La Porte has historically not allowed industrial waste discharges into its sanitary sewer system. However, Atlanta Truck Wash, Inc., proposes to pretreat its washwater discharge before discharging into the City's sewer system. If the company produces wastewater of the quality it has proposed, then the wastewater should be compatible with the domestic wastewater already in the system. Their wastewater sampling point should be located so that the City can monitor the company's wastewater discharge at all times. If the quality of the wastewater ever becomes too highly concentrated with heavy metals or solids loading, the City can impose the appropriate penalties prescribed by the Industrial Waste Ordinance. (B) We will agree to special provisions in the permit to include: ' (1) Provision will be made for delivery of wastewater to the sanitary sewer at the rates and times specified by the City. (2) No discharge will occur during periods when the pretreatment equipment is not operating properly, and the City will be notified in the event that such a malfunction should occur. (3) Analytical data from representative wastewater samples will be provided on a frequency specified by the City to establish compliance with Ordinance No. 912 and to establish the appropriate user charge. (C) 4Je recognize that additional water delivery capacity may be necessary. Our plans in this regard will be provided following receipt of flow testing data to be supplied by you. This system is to be installed by Reeder Plumbing Company, who has a great deal of experience in septic system installations. Mr. Reeder has been in contact with an engineer to help with the design of this septic system. Note also that care has been taken to reduce the amount of effluent by installing momentary flush type valves on the urinals. The City has had a sewer line laid along Fairmont Parkway that will be within 200 feet of the exit of Tooney's onto Fairmont Parkway. This line will be in service when the new sewer plant goes on line in the spring. It will be very expensive for Tooney's to tie on to this line, as there is a major storm sewer line between Tooney's and the sewer line. In addition to the locations specified in Sec- tion 1 of Ordinance No. 1000, passed and approved by the City Commission of the City of La Porte on August 19, 1974, the sale of beer shall also be permitted during the hours set by the general laws of tze State of Texas at the following location by a retailer selling beer for consumption on premises, to-wit: The property located at 1018 Hwy. 146 S., La Porte, Harris County, Texas, known as "Tooney's," being more particularly described as Lots Twenty-five (25) through Twenty-sight (28), both inclusive, and a part of Lot Twenty-nine (29), Block One Hundred Sixty-nine (169), Town of La Porte, Harris County, • Texas, reference to which is here made for all purposes. Section 2. Tie sale of beer at said location shall be permitted only in connection with the sale of food. Section 3. xcept and to the extent amended hereby, Ordi- nance No. 1000 shall remain in full force and effect. Section 4. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTS: WHEREAS, tree Texas Legislature has enacted a Bill creating the La Porte Area ;Water Authority, subject to confirmation by the voters of the City of La Porte, and within the surrounding area included wit in the boundaries of said Water Authority; and • WHEREAS, the La Porte Area TrVater Authority vas created by tYle Texas Legislature at the req uest of the City of La Porte, to provide a vehicle for the planning, financing, construction and operation of facilities to provide potable surface water for the City of La Porte and surrounding areas; and WHEREAS, there is an urgent public necessity for the City of La Porte and surrounding areas to convert from ground water to surface water, for its potable water supply, to prevent fur- they subsidence of the land area, and consequent danger of loss of life and property from flooding, in the City of La Porte and surrounding areas; and 6•dHEREAS, the Sill creating the La Porte Area Water Authority provides for its confirmation by the residents of the Authority at a special election to be called for that purpose, which elec- tion has been called for January 16, 1982; and WHEREAS, the 3i11 creating the La Porte Area Water Authority • gives the Authority no taxing power, with all revenues of the Authority to be derived from the sale of potable water, and any bonds to be issued by the Authority to be revenue bonds: N06•J, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTS: ~~ ~ ~ • Resolution No. 82- Page 2.
