1. Meeting called to order by Mayor Meza at 7:00 P.M.

2. Invocation was given by City Attorney Knox Askins
Mayor Meza called for anyone from the audience who wishes to
speak for the rezoning of a 10-acre tract of land bounded by
State Highway 225 and State Highway 146, Strang Road and S. P.
Railroad tracks on the south.

Faris: Mr. Mayor, the last time we discussed this in work-
shop, I had asked Mr. Angel if he intended to put a greenbelt
around the entire yard, and I really didn't get an answer at
that time. Since he is here in the audience, T would like to
ask the question again.
Angel: Gus, if a container yard goes in out there, yes, I
will put a greenbelt in.
Skelton: That's covered in the ordinance, I believe.
Faris: Are we not rezoning this piece of property for a con-
tainer yard?
Meza: A truck terminal, I understood.
Angel: A truck terminal is what's really what's going out
there on this piece of land, but as of right now I do not have
a lease on this piece of land. I thought at one time that I
did have, but today I don't have. T'm still working on it.
• I don't know if it's going to be a container yard today or not.
Skelton: Will this be rented to a truck terminal?
Angel: Well, what y'all call a truck terminal and container
yard I think is two different things. It's going to be a
truck terminal like Central Freight Line is out there. It's
going to have your chassis out there with a container on it;
they stay overnight or two or three days and they're gone.
That's not a container yard as far as I'm concerned. But
y'all say it is, but it"s not.
Skelton: I'm not saying one way or the other. I'm asking a
question. It will not be a repair place.
Angel: No, it will not be a repair place.
Faris: What happens if you don't get the lease on it?
Angel: I still am requesting it be rezoned to industrial land;
that's what it should be anyway. What's going to happen, I'm
going to lose my money, that's all. I just don't lease it,
period, not to these people, it don't look like.
Faris: Do you own the property?

Meza: Any further questions?
Westergren: Are we considering this as a container storage
yard and truck terminal?
Meza: Because of the containers being on this yard, it has
to be covered under the container yard ordinance.
Angel: Mayor, can I say something about the "truck" container
yard that y'all are talking about?
Meza: You can say all you want, but the fact that containers
are going to be on it, it will have to be zoned for Industrial
use because, isn't that correct, Knox?
Askins: That is the way we did Central.
Angel: Well, can I still go ahead and say something about the
City of La Porte and these container yards, or am I getting
off the subject?
Meza: You are getting off the subject,
Gay: Mr. Mayor, he has already been pointed out that Mr. Angel
would like to rezone this from Commercial to Industrial. Our
ordinance the way it is read even though it's a truck terminal,
this has been said before, but it is in contrast with, for it
to be a truck terminal we must rezone it industrial even though
it may be containers there. But as Mr. Angel is trying to say
right now, his lease that he had on the property, in other
words the deal has fell through. But he is still wanting to
rezone the property for future use, and we have discussed this
before and Planning and Zoning have approved it, so I think
there shouldn't be any more discussion, I recommend that Mr.
Angel's property be rezoned from------
Meza: This is a Public Hearing and the comments are that it
should be rezoned. If there are no further comments, I will
adjourn the public hearing. I will ask the Planning and Zoning
Commission to confer to prepare their recommendation on this
matter. Council will have a brief recess,

Motion was made by Councilperson Malone to approve the minutes
as presented. Seconded by Councilperson Tn7estergren. The
motion carried, 8 ayes and 0 nays.

4. The City Council at this time canvassed the returns from the
January 16, 1982, Special Called Election to fill a vacancy
in Position A - Councilperson-at-Large, to serve through
April 3, 1982, and the La Porte Area Water Authority. Returns
were presented to Mayor Meza who opened each set of returns
and read publicly the number of votes cast in each of the six
(6) voting districts and absentee voting returns. Returns
were then passed to each Councilperson to canvass and review.
After review, Council declared the returns in order and asked
the City Attorney to read the Ordinance declaring the results
of the election.

A motion was made by Councilperson Longley to pass and approve
Ordinance No. 1294 as read by the City Attorney. Seconded by
Councilperson Skelton. The motion carried, 8 ayes and 0 nays.

6. City Attorney Askins read: AN ORDINANCE DECLARING THE RESULTS
OF THE ELECTION ON THE QUESTION OF THE CREATION OF THE LA PORTE
AREA WATER AUTHORITY, HELD WITHIN THE CITY OF LA PORTE, AND
WITHIN THE BOUNDARIES OF THE PROPOSED LA PO RTE AREA WATER
AUTHORITY, ON JANUARY 16, 1982.
A motion was made by Councilperson Gay to pass and approve
Ordinance No. 1295 as read by the City Attorney. Seconded by

7. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING THAT PORTION OF SOUTH 9TH STREET; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
A motion was made by Councilperson Simons to pass and approve
Ordinance No. 1296 as read by the City Attorney, closing a
portion of South 9th Street for Bayshore National Bank.
Seconded by Councilperson Gay. The motion carried, 8 ayes and
0 nays.

8. At this time Council heard the recommendations of Planning
• and Zoning concerning the rezoning of that certain parcel of
land described as a 10-acre tract of land bounded by State
Highway 225 and State Highway 146 on the North and East, and
bounded by Strang Road on the West, and bounded by the Southern
Pacific Railroad tracks on the South.
City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING
THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN
DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF.
A motion was made by Councilperson Simons to pass and approve
Ordinance No. 780 VW as read by the City Attorney rezoning
from Commercial to Industrial the 10-acre tract of land owned
by Bruce Angel with a Special Use Permit. Seconded by Council-
person Malone.
Faris: Mr. Mayor, may I make a statement? Mrs. Muston, is it
correct that the overall zoning program that P & Z has been
working on dedicates all the north side of Barbour's Cut Boule-
vard for this type of usage?
Muston: We haven't made our final recommendation on the placing
of the different classifications.
Faris: Is that the area generally being discussed by P & Z
• for this type of operation?
Muston: Yes.

Faris: Mr. Askins, I understand that within the next couple
of weeks you will have available for us a preliminary draft
of an ordinance requiring a green belt on all the container
yards within the City.
Askins: I thought you were referring to the Zoning Ordinance.
Faris: Similar to what was done in Houston a few years back
with junk yards; fencing rules.
Askins: I think several areas have come up which seem to
dictate that we need to pull the container yard regulations into
a separate ordinance away from zoning; green belt is one, fencing
is going to be one, and access to streets, and perhaps there
are other areas of concern. One that has particularly come up
recently, that we have been working with the staff on, is the
paint booths in the ones that have repair facilities. There
are some unique things about container yards that all need to
be pulled together in one ordinance.
• Malone: Knox, don't you feel one of those things to be con-
sidered should be drainage? If he should cover this 10 acres
with a concrete pad, where would the water go? Towards 225?
Towards the bayou?
Meza: It would go through that drainage ditch that runs right
through it.
Malone: But isn't this something that should be considered in
such an ordinance?
Askins: Of course, in this particular one there is a dedicated
Harris County Flood Control ditch, but there could. very likely
on others would not be,'but of course good engineering would
dictate that the engineer place the drainage properly. In
our ordinance we probably should coordinate this with the City's
engineers.
Faris: Will we be able to do that retroactively?
Askins: Yes.
Faris: Drainage? Green belts?
Askins: Well, I don't know about drainage. I was being res-
• ponsive to your concern, green belts. We passed an ordinance
some years ago requiring fences on junk yards. We based it on
Houston's ordinance after they had tested it in court and that

ordinance applied to every junk yard in La Porte regardless
of how long it had been there. As long as it has to do with
health or safety you can pass an ordinance any time.
Faris: Mr. Mayor, I guess I find myself in a position where
I am going to vote for this ordinance, but I would like to go
on record that I will not be voting for any more container
yards that are not on the north side of Barbour's Cut Boule-
vard until the new zoning proposal is before us and that I
really have the distinct impression that the City has become
over populated with container yards, number 1, and number 2,
I am of the opinion that a lot of our highway frontage is
being used for this type of operation when it would return
more taxes and more benefit to the community.

9. City Attorney Askins read: A RESOLUTION CONCERNING THE RE-
ALIGNMENT OF TTiE RIGHT-OF-WAY FOR THE EXTENSION OF BAY AREA
BOULEVARD BETWEEN WEST MAIN STREET (SPENCER HIGHWAY) AND
FAIRMONT PARKWAY, IN THE CITY OF LA PORTE
A motion was made by Councilperson Skelton to pass and approve
Resolution No. 82-3 as read y t e City Attorney. Seconded by
Councilperson Longley. The motion Carrie 8 ayes and 0 nays.

10. Council reviewed the Lomax Street Bond Project (Accounting and
Engineering memo an official part of these minutes). A motion
was made by_Councilperson Westergren to appropriate $28,690.00
from the 1980-81 Genera Fun Contingency an 3, .2 from
the 1981-82 General Fund Contingency to fund the 1, 7.25
deficient amount for the project. Seconded by Councilperson
Simons. The motion carried, 8 ayes and 0 nays.

11. The City Council considered the recommendation of Chief
Inspector Paulissen on bids received for the demolition of
the "Old Public Works Building" on Fairmont Parkway, as
follows:
Olshan Demolishing Company $ 6,450.00
BWF General Contractors 12,750.00
Daniels' Dump Truck Hauling 3,995.00
Paulissen reported all insurance and worker's compensation
requirements have been met by Daniels.
Motion was made by Councilperson Simons to award the bid to
Daniels' Dump Truck Hauling in the amount of 3,995.00.
Seconded by Councilperson Gay. The motion carried, 8 ayes
and 0 nays.

12. Council considered the recommendation of Public Works Director
Hodge on bids received on a "Used Front Loading Garbage Truck".
Bids were received as follows:

Hodge recommended the low bid submitted by Industrial Disposal
Service be accepted as the best and most responsible bid.
A motion was made by Councilperson Gay to award the bid for
one (1) "Used Front Loading Garbage Truck" to Industrial Dis-
posal Service of San Antonio in the amount of 32,500.00 and
that the City-owned side loader e retained y the City until
the next City-sponsored auction. Seconded by Councilperson
Simons. The motion carried, 8 ayes and 0 nays.

13. City Council considered the request of Director of Public
Works Hodge for the purchase of a new heat lamp vacuum ap-
plicator which is used to make traffic control signs. This
machine is a one-source item manufactured by the 3M Company.
The City received a quote from 3M Company for a 4 foot by
6 foot machine in the amount of $6,485.00.
The 1981-82 budget allows $5,000.00 for the purchase of this
machine. Hodge suggests the balance of $1,485.00 be trans-
ferred from Street Department, since there is $2,730.00
remaining from the purchase of a new tar pot.
A motion was made by Councilperson Skelton to purchase a 4
foot by 6 foot Heat Lamp Vacuum Applicator sign machine),
a one-source item, from 3M Company in the amount of 6,485.00.
Seconded by Councilperson Malone. T e motion carried, 8 ayes

14. City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 1000 OF THE CITY OF LA PORTE, TEXAS, DESIGNATING THE AREAS
WHERE BEER FOR CONSUMPTION ON THE PREMISES MAY BE SOLD AND
PROHIBITING THE SALE ELSEWHERE; PROVIDING FOR HOURS OF OPENING
AND CLOSING; PROVIDING SALE OF BEER FOR CONSUMPTION OFF PREMISES
SHALL NOT BE AFFECTED; DEFINING SOURCE OF AUTHORITY; PROVIDING
THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS HEREIN
DESIGNATED; FINDING COMPLIANCE WITH THE OPEN MEETINS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
A motion was made by Councilperson Simons to approve and adopt
Ordinance No. 1000M as read by the City Attorney for Speedy Taco,
500 West Main. Seconded by Councilperson Faris. The motion
carried, 8 ayes and 0 nays.

15. Council considered declaring an emergency due to the inopera-
bility of Unit 703-2, a 1979 Ford sideloader garbage truck.
The 3 cylinder industrial engine, which operates the lift for
containers, requires a complete overhaul. This is a critical
• piece of equipment. Funds are available in the 1981-82 budget.

A motion was made by Councilperson Simons to declare an
emergency and waive the bid process for immediate purchase
of a side diesel 3 cylinder industrial engine. Secon e y
Councilperson Faris. The motion carried, 8 ayes and 0 nays.

16. Council considered authorizing the emergency purchase of a
new engine for Unit 703-2, a 1979 Ford sideloader, from
Eberling Manufacturing in Plainview, Texas. Funds for this
item are available in the 1981-82 budget.
A motion was made by Councilperson Simons to authorize the
emergency purchase of the needed 3 cylinder industrial engine
for Unit 703-2. Seconded by Councilperson Faris. The motion
carried, 8 ayes and 0 nays.

17. Administrative Reports: There were none.
18. Council Action
Mayor Meza read a letter written by Spenwick Place Municipal
Utility District, thanking the City of La Porte and the La
Porte Public Works Department for the work done in some of
the worst weather of the year last week to serve the District
with water (letter a part of these official minutes).
Councilperson Skelton: I've had some complaints from some of
the constituents regarding the rough railroad tracks on 225
and. would like to get a letter written to the Railroad to
cover this and see if we can't get this repaired. It's tearing
up our cars and it is a dangerous situation.
Mayor Meza: We will write to the State
the Southern Pacific Railroad to see if
done about the situation.
Councilperson Skelton: Some of you may

The area cities will get an extra five years. T guess we are
really fortunate to have our sewage treatment plant as far
down the line as we do. According to this article, all of
the funds that require for planning, design and preparation
before the construction starts has to be borne by the City or
it can be borrowed from the State as long as they pay it back
if they don't build it. The HGAC officials told the Board
members Tuesday that newly authorized amendments to the Clean
Water Act will significantly affect areas' efforts to improve
sewage treatment facilities. The amendments which spell out
funding stipulations for federal grants were signed by Presi-
dent Reagan on December 29, 1981. I noticed that Kemah Council
was opposing the waste dump by the proposed Bayport Industrial
District to be built by the Gulf Coast Waste Disposal Authority,
and it mentioned that El Lago, Seabrook and Shoreacres were
alwo opposing the location and there was no mention of La Porte.
I know we passed a Resolution some time ago on this same issue.
There is another item that I would like to bring up, in the
event that La Porte should be affected. The City of Liberty
was fined $1,000.00 by the EPA for improperly keeping records
on the electrical transformers containing suspected cancer
causing chemicals, PCB. The $1,000.00 replaced a $28,000.00
fine and ends a two-year battle between the City and the EPA,
and the City spent $15,000.00 cleaning ~zp 2 cup fulls of the
suspected PCB and built a special building for storage of the
transformers. I don't know whether we have anything like that
in La Porte, but it is something we should consider if we do,
or if anyone else is storing them in La Porte we should know
about them.
Councilperson Gay: Mr. Mayor, I would like to thank the citizens
for coming out tonight, and also I would like to thank those
that voted for the Water Authority, because myself, personally,
I feel that this is something the City and the Gulf Coast area
needs within the near future. I would just like to thank all
the citizens that came out to vote.
Councilperson Simons: Mr. Mayor, I would like to get on Gus's
soap box and thank the people of Spenwick for coming down and
the Public Works Department for turning out and helping.. This
shows that we are good neighbors. Steve, I want to compliment
you and your crew for the good job you did.
Councilperson Faris: I have two items: one is an ongoing
issue, I guess. First, we have a minor problem with the State's
timing on these stop lights on 146 and Fairmont Parkway. It

seems that when the light is green on the west side, it is
red on the east side, and vice versa, so the traffic doesn't
flow smoothly across that intersection.
Mayor Meza: That is an ongoing problem. I believe Chief
Freeman will agree with me on that. The funds have been set
aside to•rejuvenate all that stuff and they tell me it should
be forthcoming about May. The State Highway Department works
in their own time.
Councilperson Faris: Also, the light at.Barbour's Cut Boule-
vard on 146 gives the northbound traffic about 15 to 30 and
the left turn from south to east about a minute and a half in
the morning.- If somebody here in the: Ci.ty~has a .name to call,
I'd be happy to see if we can't do something sooner than May.
Second item, is an ongoing item, and that's the Gulf, Coast
Waste Disposal Authority and their planned chemical dump at
Bay Area Boulevard and Red Bluff Road.
Mayor Meza: I'm glad you brought that up, Gus. I would like
®. for you to chair a committee to oppose all hazardous waste
and chemical dumps within the City of La Porte and,Harris
County. If you will, tomorrow night attend the Harris County
Mayors' and Councilmen's Association meeting, I will appoint
you County-wide. Will you accept that?
Councilperson Faris: Yes, I would. I ,just wanted to point
out that sometime next week I will be writing a letter to all
the surrounding communities, newspapers and some television
stations, to see if we can't coordinate our efforts to have
this dump site moved away from here.
Councilperson Longley: Mr. Mayor, I appreciate your starting
on the other side tonight. It gave Don an opportunity to
remind me that while we are writing the letter about the rail-
road tracks on 225 we should include Underwood and Houston
Drive.
Councilperson Skelton: We should add East Main, if you are
going to go that far.
Councilperson Longley: The second item I have, I would like to
comment on Gus's statement concerning container yards. My
concern is that as the population of these yards grow without
a need for them, it could cause some economic difficulties. I
would assume they know more about their business than I do,
• but I would hate to see them go out of business and then we are
stuck with a macadoo yard with a green belt, which is not going

to do the City or anybody else any good. I think we should
try to investigate them a little deeper as far as need before
we push forward with them.
Councilperson Malone: Mr. Mayor, I was reading about a $400
million dollar County Bond election.
Mayor Meza: Yes, sir. I have a letter from Judge Lindsay
which we will take up at the next workshop. They would like
the support of all the area cities.
Councilperson Malone: Pasadena expects to get about $15 million
of that. Is there something we can do to get our name in the
po t now?
Mayor Meza: We haven't gotten our 1975 share for Fairmont
Parkway yet.
Councilperson Malone: But they want our support for this bond
• issue and. we haven't gotten our 1975 share that was promised.
Councilperson Skelton: In 1975 we voted bonds to widen Fair-
mont Parkway from Precinct 1 through Precinct 2, and we still
don't have it.
Mayor Meza: We have Precinct 1 widened but never did get
Precinct 2.
Councilperson Skelton: We have such a problem turning on Broad-
way or trying to cross it. Sometimes one or maybe two cars
gets across on each light. If the Commissioners are going to
take two or three more years to get this thing widened, T think
the least thing we could do is ask them to put a turn out to
permit these cars to pull to the side and let the others get on
across there. There is one obstacle that would have to be
removed in the middle of the road, but that shouldn't be hard.
This would get the traffic through there, especially with the
school and all the buses.
Mayor Meza: We will take this up at the work shop.
Councilperson Gay: I have one item. What it is, is considering
all the buildings being built on the north side. My constituents
are asking me if they have any say-so about what is going to be
put in those buildings. Like the various shops and so forth.
• Do they have anything to say, since they were there before the
shops came in. These people have been there 30 or 40 years.
You understand what I am trying to say. They want to know if

they can determine what's going to be put in the shops
instead of the City issuing a permit saying here's a shop.
When they wake up in the morning or get home, it's bang-
bang-bang-boom-boom. So what they want to know how we can
determine what is going to be put in these shops.
Mayor Meza: It's commercially zoned. You would have to get
that information from the Chief Inspector.
Inspector Paulissen: There is a long list of permitted uses
in a commercial zone, and that's what governs the use of these
shops.
Mayor Meza: The commercial zone is from 146 to z block east of
8th Street.
If there is no further business, we stand adjourned.

Final Acco ing - Lomax Street Bond Project
This memorandum amends my previous final accounting memorandum
of December 28, 1981. At the March 18, 1981 council meeting, when
the project was initially funded, Mr. Hudgens indicated to Council
that if during construction the project needed funds; the recom-
mended source was $28,690.00 from General Fund Contingency (1980-81).
The accounting department has already reserved these funds for the
expenditures on the project. Council minutes indicate that Council
was in general agreement with this measure; however, the funds were
not actually appropriated at that time. It is recommended that
Council approve the additional $28,690.00 plus an additional $3,167.25
from the 1981-82 General Fund Contingency which has a fund balance
of $179,000.00.

On Monday, January 11, 1982, bids were received and opened for the
purchase of one (1) used frontloading commercial solidwaste vehicle,
and for the trade-in of two (2) City owned sideloading commercial
vehicles. The breakdown of bids received is as follows:

*Bid reflects value to vendor of both City owned vehicles and
approximately 130 1/2 and 2 yard sideload containers to be removed
from service during the transition to a frontload system. Additionally,
bidder tenders offer to purchase above items .for 7?IVE THOUSAND DOi;LARS
($5,000) cash if not awarded bid on used frontloader.
It is the recommendation of the Public Works Department that the low
compliant bid, as submitted by Industrial Disposal Service, of THIRTY
TWO THOUSAND FIVE HUNDRED DOLLARS ($32,500) be accepted as the best and
most responsible bid. It is also our recommendation, that in lieu of
accepting the Davis Truck & Equipment bid of FIVE THOUSAND DOLLARS
($5,000) for the City owned vehicles, we instead retain ownership
of the equipment until the next City sponsored auction. This has been
necessitated by the fact that several emergency repairs, costing
approximately FIVE THOUSAND DOLLARS ($5,000), have been performed on the
1979 motel sideloader. This work included the purchase of a new auxiliary
engine valued at FOUR THOUSAND FOUP. HUNDRED SEVENTY EIGHT DOLLARS ($4,478).
The repairs were performed after representatives of Davis 't'ruck &
Equipment inspected the vehicles in preparing their bid. It is our
feeling that the City owned equipment should have marketable value of. nearly
ELEVEN THOUSAND DOLLARS ($11,000).

Spenwick Place Municipal Utility District's Board of Directors, at
its meeting of January 11, 1982, authorized the City of La Porte to
construct a temporary emergency wa-ter connection from the City of
La Porte to Spenwick Place MUD.
Spenwick Place MUD agrees to pay all associated costs to the City
of La Porte for this construction. Documentation of all costs
associated with the emergency water connection shall be furnished
by the City of La Porte.

The Board of Spenwick M.U.D. would like to take just
a few minutes of the Council's time to say Thank's
for the help that the Public Works Dept. of La Porte
gave to the residents of Spenwick.
On Sun Jan. 9, we had some problems with our Water
pump, ~lhich left our community with out water. Mayocv
M~a, Mr. Hodges and Mr. Journ offered a salutation
to our problem,x3y Tues. afternoon we had full water
service from La Porte.
On Wed. in all the snow and bad weather the Public
Works Crew cont + N Ue-~__ the work to help us .
We know that just words cannot say how we feel. So at
this time we'd like to say many Thanks to the City of
La Porte. If every our Board can be of any help please

The Traffic Control Department is in need of a new heat lamp vacuum applicator,
which is used to make traffic signs. This machine enables this department to
make signs at 30 to 40% less than ready made signs.
This machine is manufactured by the 3M Company, anal is a one-source item.
The City has received a written quote from the 3M Company for a 4" X 6' machine,
in the amount of SIX THOUSAND FOUR HUNDRED EIGHTY FIVE DOLLARS, ($6,485.00).
The 1981-82 budget allows FIVE THOUSAND DOLLARS ($5,000.00) for the purchase of
this machine. This is the amount that was originally quoted by 3M last year.
The remaining ONE THOUSAND FOUR HUNDRED EIGHTY FIVE DOLLARS ($1,485.00) can
be transferred from the Street Department budget, of which TWO THOUSAND SEVEN
HUNDRED THIRTY DOLLARS ($2,730.00) is remaining from the purchase of a new
tar pot.
I recommend that the City purchase a 4' X 6' heat lamp vacuum applicator from
the 3M Company, per their written quote, as this is a one-source item.

On August 19, 1981, the City Council passed Resolution 81-19, authorizing
the City Manager to request grant funds from the State of Texas Office of
Traffic Safety in the amount of $5,865.20, to place all warning and regulatory
signs in the City into compliance with the Texas Manual on Uniform Traffic
Control Devices.
The Office of Traffic Safety is withholding approval of the contract until the
City submits warrants for the 14 four-way stop signs and one (1) three-way
stop sign. Four-way plaques were requested under the grant for existing
four-way stops. These intersections have been four-way for several years, and
only two (2) meet the warrants as per the Manual on Uniform Traffic Control
Devices.
The confusion, as well as possible accident rate increases, and citizen complaints,
caused by the removal of these installations could cause multiple problems.
The Traffic Control Department has funds available to go ahead with this project,
and the project cost was based on supplied prices. Actual costs, excluding
hardware, will be less than the contract amount.
I recommend that the City pay for materials to upgrade the City's regulatory
and warning signs to conform to the Manual on Uniform Traffic Control Devices,
due to the difficulty of removing unwarranted installations.

STOP signs are intended for use where traffic is required to stop.
The STOP sign shall be an octagon with white message and border on
a rerl background. The standard size shall be :30 x 30 inches. Where
greater emphasis or visibility is required, a l;trger size is recolnmendecl..
On low-volume local streets and secondary roads with low approach
speeds, a 24 x 2-l inch size mxy he used.
At a multi~~•ay stop intersection (sec. `~B-fi), a supplementary plate
(Ri-:3) ~huulcl be mounted just below each 5'fOP sign. If the number of
approach legs to the intersection is three or• more, the numeral on the

Because the STOP sign cauaes a suhtitantial inconvenience to motor-
fists, it should be used only where ~~•arranted. A STOI' sign muy be

continuous flow of traffic, making STOP sighs unnecessary even on the
entering roadways. Where at-grade intersections are temporarily
justified for local traffic in sparsely populated areas, STOP signs should
be used on the entering roadways to protect the through traffic. STOP
signs tnay also be required at the end of diverging roadways at the in-
tersection with other highways not designed as expressways. In most of
these eases, the speeds will not warrant any great increase in the sign
sizes.
STOP signs shall not be erected at intersections where traffic control
si~mals are operating. The conflicting commands of two types of control
devices are confusing. If traffic is required to stop when the operation
of the stop-and-go signals is not warranted, the signals should be put
on flashing operation with the red dashing light facing the traffic that
must stop. •
'".;~~ Where t~vo main highways intersect, the STOP sign or signs should
normally be posted on the minor street to stop the lesser flow of traf-
fic. Traffic engineering studies, however, may justify a decision to in-
stall STOP sign or signs on the major street, as at a three-~vziy in-
tersection where safety considerations may justify stopping the greater
flow of traffic to permit cleft-turning movement.
STOP signs should noC be installed indiscriminately at all unprotected
railroad crossings. The allowance of STOP signs at all such crossings
would eventually breed contempt fo: both law enforcement, and obe-
dience to the sign's command to stop. STOP signs may only be used at
selected rail highway grade crossings after their need has been deter-
mined by a detailed traffic engineering study. Such stuilies should con-
sider approach speeds, sight distance restrictions, volumes, accident
records, etc. This application of S'!'OP signs s}tould be an interim use
period clurirg which plans for lig;his, gates or other means of control
arc being prepared.
Portable or part-time STOP signs shall not be used except for emergen-
cy purposes. Also, STOP Si;,ms should not be used for sp~rc.l control.

tion in a 12=month period. Such hccidents include right- and left-turn
colL'sions as well as right-angle collisions.
3. Minimum traffic volumes:
ta) The total vehicular volume entering the intersection from all
approaches must aver::ge at ~ least SOU vehicle=s per hour for

(b) The combined vehicular and pedestrian volume from the minor
street or highway must average at least 'l00 units per hour
for the same 8 hours, with an average delay to minor strut
vehicular traffic of at least 30 seconds per vehicle during the

traffic exceeds 40 miles per hour. the minimum vehicular
volume warrant is i0 percent of the above requirements.
An alternate set of warrants which utilize traffic volumes and delay is
provided in the Appendix. The above warrants as well as those provided
in the Appendix may be used in determining the justification of a ntulti-
way stop based on minimum traffic volumes.

TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE
PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVID-
ING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEER
FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED; DEFINING
SOURCE OF AUTHORITY; PROVIDING THAT NO LICENSE SHALL BE ISSUED
EXCEPT FOR THE AREAS HEREIN DESIGNATED; FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE

WHEREAS, the City of La Porte desires to regulate the
closing hours for the sale of beer by retailers selling beer
for consumption on premises in accord with provisions of Article
667-10-1/2 of the Penal Code of the State of Texas.
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. In addition to the locations specified in Sec-
tion 1 of Ordinance No. 1000, passed and approved by the City
Commission of the City of La Porte on August 19, 1974, the sale
of beer shall also be permitted during the hours set by the
general laws of the State of Texas at the following location
by a retailer selling beer for consumption on premises, to-wit:
The property located at 500 W. Main,
La Porte, Harris County, Texas, known
as "Speedy Taco," being more particu-
larly described as Lots Twenty-one (21),
Twenty-two (22), and Twenty-three (23),
Block Fifty-six (56), Town of La Porte,
Harris County, Texas, reference to which
is here made for all purposes.
. Section 2. The sale of beer at said location shall be
permitted only in connection with the sale of food.
Section 3. Except and to the extent amended hereby, Ordi-
nance No. 1000 shall remain in full force and effect.
Section 4. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at
the City Hall of the City for the time required by law preceding

SUBJECT: Motor Replacement
Unit 703-2, 1979 Ford sideloader is equipped with a side diesel 3 cylinder
industrial engine, which operates the lift for containers.
January 5, 1982, vehicle was brought in to Vehicle i~iaintenance and found to
require a complete overhaul on side engine.
G]ith 132 sideloading containers, we attempted to borrow from neighboring
cities, plus possible rental with negative results. We called Hatze Equipment
Company in Oklahoma City for the required parts. They stated a minimum of ten
(10) days on delivery and no guarantee that all required parts would be available.
We also discussed a new engine and was quoted $5,000 plus $300 air freight.
At this time, we contacted Eberling Manufacturing in Plainview, Texas, which
quoted $4,477.99.
Based on the downtime which would have exceeded three (3) weeks and being a
critical piece of equipment, a decision was made to purchase and pick up the
engine, resulting in four (4) days downtime.
Funds for the abovementioned motor were available in the budget.
