1. Meeting called to order by Mayor Meza at 7:00 P.M.

2. The invocation was given by Councilperson Douglas Latimer
3. The Council considered the minutes of the Joint Public Hearing
and Regular Meeting held March 3, 1982.
A motion was made by Councilperson Skelton to approve the
minutes as presente Secon y Counci person Westergren.
Faris: Mr. Mayor, before the voting takes place, there is an
error in the minutes. After the public hearing.
Skelton: There is one small error on A3. The minutes state
"Broadway", it should have been "Fairmont." At the bottom of
the page.
Faris: Yes, I noticed that, but that wasn't the one in my
mind. On page A8, after the vote was taken on item 6, I left
the room for a few moments and was not back in the room until
item 8 had begun and was not present to vote on item 7 or
enter into any discussion. I have no discussion here, but it
does count me as voting for the motion, and I wasn't in the
room. So I hereby move to amend these minutes by correcting
the vote on item no.

4. Mr. Sonny Black, representing the La Porte Rodeo Association
will address the Council.
Black; Mr. Mayor, Council, Ladies and Gentlemen, on behalf
of the La Porte Livestock Show and Rodeo Association, we would
like to extend an invitation to each of you to join us at the
show and fair and auction at Sylvan Beach on the 27th of this
month. That is a week from this Saturday. Also, we have the
play games, horsemanship games at the Lomax Riding Arena on
April the 9th and 10th, and at this time I would like to say
"thank you" for all the efforts that have been put forth -
the lights, the sand and everything involved in preparing the
arena out there. It looks very good. However, we would like
a little tune-up in the area of some dirt left in piles. We
are in a crunch now for a little parking. The Association
definitely supports the baseball program. We think it's one
of the best in the country, but we would like to see a little
help to update the grading and so forth in this area so we
can get our people in. ~~e have people coming from Cleveland,
Dayton, Baytown, and all over the country. So you can see we
will have a large amount of trailers coming into this area.
We have information that there is 2~ acres for sale at this
time next to the arena. We would like to solicit a little
help to see what progress we could make in purchasing this
land. If the folks do not know, this arena is very important
to our operation. We now have four young ladies in our area
who are recognized state wide from the Live Stock Show in
Houston. They are top-notch horsewomen and we are dadgummed
proud of them. Thank you.

5. Mayor Meza recognized Mr. Steve Richards and. Mr. Jack Hoff-
man, Consulting Engineers representing the Texas Department
of Highways and Transportation.
Richards: First of all, I would like to brief you on some work
we are doing for the Highway Department. In the course of this
work we have identified three special concerns which we need
to bring before the Council tonight and get some input from
them. Let me start out with those two objectives. I guess,
to begin with, I'll give you some background information.
The State Department of Highways and Public Transportation,
through their District 12 office, several years ago installed
traffic signals at five intersections along Main Street in La
Porte: Main at SH 146, Main at 8th, Main at 4th, Main at 2nd,
and Main at Broadway and San Jacinto Street. I believe that
intersection is called Five Points, locally. It is Highway
Department policy to assume full responsibility for maintaining
such traffic signal installations in small towns. Small town
meaning below 15,000 population. As you are probably aware,
La Porte has passed the 15,000 mark, and in keeping with De-
partment policy, we are turning the responsibility for main-
taining the signal system along Main Street over to the City
of La Porte. The County will actually do the maintenance, I
believe, through an agreement La Porte has with the County.
But it will be the City of La Porte's responsibility to up-
keep these traffic signals. Before the Department actually
turns over these signals to the City they are going to up-grade
and modernize these signals. It will be paid for completely
by the Highway Department. There will be no cost to the City
of La Porte.
My Company, Walton and Associates, has been engaged by the
Highway Department to do the preliminary engineering studies
for upgrading the system and the design work. Let me brief
you with some of the problems with the present system and why
the Highway Department feels that they should .upgrade and
modernize the system before turning it over to La Porte.
Richards presented slides of East Main and then some of the
Five Points intersection showing the old signal heads and
proposed to synchronize the lights on East Main to provide a
better flow of traffic along Main. He stated the new elec-
tronic control equipment would be installed to save the City
of La Porte some money in repairs. He stated there aim was
to bring the traffic signals up to date with other equipment
through the state. He stated there were basically 3 areas
where he needed Council input before he could finalize plans.

The first was the traffic signal at 2nd Street and East Main.
Richards stated after numerous traffic counts, volume just
did not justify a signal at that intersection. That signal
is actually creating a needless delay to motorists on the
major street. Based on this, he recommended the signal at
2nd and East Main be removed.
Hodge: I have talked to the Fire Chief and the Police Chief,
and neither one of them have any objections to this light being
removed.
Richards: The second area involves a short block between 8th
Street and 9th Street. There is a pretty bad alinement problem
there created by left turn lanes at 146. Right now, both sides
of the road are reserved for on-street parking. However, in
our many visits down here we have seen almost no parking in
this short block. We are asking the Council input on removing
this on-street parking for this short block. It would greatly
improve traffic operations and could enhance traffic safety.
We propose two main travel lanes and a right-turn lane. Our
•. final problem area is really the most critical, at the Five
Points intersection. We will be replacing the signal equipment
but no matter what we try to do to signalize this intersection
as it is, our design will be inefficient. There is just no
good way to signalize a 5-legged intersection. There is driver
confusion at this type of intersection. We have done an acci-
dent study and the number occurring is slightly higher than at
2nd and 4th, but it's not all that high at this point. The
condition is so bad that drivers are adjusting their driving
and driving extra safe through this intersection. We do fore-
see a problem as the City grows. We propose to make the 5th
leg (the San Jacinto leg) one way out-bound from the inter-
section to A Street. Traffic would be southeast bound to A
Street, beyond A it would be two-way flow just like it is now.
Traffic coming north along San Jacinto to Main would be routed
along A Street over to Broadway. We would do this with signs
and paint stripes and maybe some of the raised jiggle bars.
The traffic volumes are not all that great and we feel this
would be a very adequate method to control present and future
problems.
Faris: Who pays for all the additional striping and signs?
Richards: I believe that would fall within the budget, so the
Highway Department would pay for it.
Skelton: Do you know what the annual operating and maintenance

Richards: I couldn't come up with a figure.
Hoffman: It will usually run about $1,000 a year for regular
and emergency operations and maintenance.
Simons: Have you made a study on traffic going south on San
Jacinto from Five Points?
Richards: Yes. Peak hours it's about 150.
Simons: What about weekends?
Richards: We have not made any weekends.
Simons: We have a lot of traffic in the summer traveling that
particular route to Sylvan Beach.
Richards: This plan would favor that traffic.
Skelton: When all these people co

Latimer: Most of the people coming that way are going to be

Richards responded to questions from the Council and the pub-
lic present at length. Richards stated he was here to get
input and to present these recommendations based on their
findings. He stated he could design the system without these
three changes, but he felt it would not be the most efficient
nor the safest, in his opinion. He further stated he was not
contesting the Council; he was just presenting the facts for
them to make a decision.
Hodge: Remember, Fairmont Parkway will take a lot of this
traffic when it is widened.
Faris: That work-will be begun late third or early fourth
quarter of this year, according to Commissioner Fonteno's
office. I see no reason not to procede with these gentlemen's
recommendations at this time. If it is in line for a motion
• to that effect, I'll make it.

none directed to the moderator.
Faris: Mr. Mayor, you have a motion on the floor.
Meza: We were not going to vote on this. We were only going
to hear their recommendations, and if Council is ready to make
a decision on the information they have now, we can proceed.
However, if the Council feels they need time to think about
it or to gather more information, we can postpone it for a week.
Skelton: I think we need more time for further consideration.
Meza: Have you taken into consideration that A Street is uded
by the County Court House for parking during court hours?
Skelton: Mr. Mayor, is San Jacinto not a County maintained
street? Does the County have any say as to what we do with
San Jacinto?
Meza: Well, it will have to be an agreement between County,
City and State Highway Department.
Cline: Mr. Mayor, may I say something, please? Since I have
been. the street commissioner .here in La Porte and know a lot
of this stuff. T don't disagree with what Mr. Richards has
told you, but I would like to ask the Council to consider one
other thing that he has brought before you tonight, and I think
it is a very good idea. Now, he is advocating no parking on
the east bound traffic coming into Main from the Highway to
8th Street. Please consider no parking on the west bound, also.
Meza: There used to be no parking on the west bound. I don't
know what happened to the signs, but I haven't seen any parking
there in years.
Rib.hards: We certainly agree with that. In fact, we have a
sketch showing just that.
Faris: Mr. Mayor, you have a motion on the floor. In light
of what Mr. Skelton pointed out. about San Jacinto being a
County maintained street, I would amend my motion to state
that we accept these proposals we have heard here tonight pro-
vided the County also agrees to accept them; that's the pro-
posal on San Jacinto Street.
Meza: There is a motion on the floow to accept the recommenda-
tions of the consulting engineers with the County being a party
to accepting these recommendations.

6. The Council considered the recommendation of the Public Works
Director for awarding a bid on three (3) 2-ton pickup trucks
in the amount of'$8,131.81 each, a total bid price of
$24,395.43, to Joe Camp Ford. The trucks are budgeted for
the Warehouse, Street Department and Solid Waste Commercial
Department. Each department has funds to make up the $131.81
difference between the bid and the budgeted amount.
Motion was made by Councilperson Gay to award the bid to Joe
Camp Ford. Second by Councilperson Westergren. The motion
carried, 8 ayes and 0 nays.

7. Council considered the recommendation of Parks Director Stan
Sherwood to .award a bid to Gloger Kubota in the amount of
$28,844.00 for tractors and tractor equipment (equipment list
is a part of these official minutes). Gloger Kubota has met
all specifications and is well within the budgeted amount.
Motion was made by Councilperson Skelton to award the tractor
and equipment bid to Gloger Kubota in the amount of $28,844.00.
Second by Councilperson Simons.
Faris: Mr. Mayor, can you tell us what these tractors are
going to be used for?
Meza: Mowing in the Parks and Recreation Department.
Faris: Are the tractors we have now are not particularly
adequate?

Meza: According to the department's report, they need the
additional equipment to keep maintenance up.
Skelton: This is a budgeted item.
Faris: Is this the smaller tractors that will fit in the
alleyways?
G-`~: No, they already got those.
Faris: This doesn't have anything to do with that?
Westergren: Mr. Sherwood, do you have any problem getting
parts for this type of tractor as opposed to some of the others?
Sherwood: No.
G_~: These are handled by International?
Sherwood: Jim Ball International in Baytown does handle these.
Gay: So it's no problem at all to get parts for these. The
reason why T am saying this is, because I have an International
tractor and it costs me $900 just for a part. I had to order
it and it was made in Belgium.
Sherwood: Anything under 30 horse is made overseas. Ford is
made in Japan.
Faris: I notice you have a 19 h.p. Kubota with a 16 inch
bucket and a 50 inch loader for that 19 h.p, tractor. This
front end loader is going on the same tractor, is that correct?
I'm not being picky, but T used to own a Kubota tractor and
my father still does, and we have had nothing but maintenance
problems with them.
Sherwood; I have had two for four years and one for three
years and I have had no problem.
Faris: Do they have backhoes and front end loaders, or lawn
mowers?
Sherwood. Lawn mowers.
Faris: Mr. Hodge, have yours got lawn mower or backhoes on
them?
• Hodge: I've just got two small ones with mowers.

Faris: The problem we had was with the hydraulic system.
The equipment was too big for the tractor.
Latimer: Are these gas or diesel?
Sherwood: Diesel.
Latimer: Satisfied with diesel?
Sherwood: Yes.

8. Council considered Change Order #8 - Lomax Street Paving and
Drainage project.

9. Ordinance No. 780-XXX was read by City Attorney Askins:
AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CER-
TAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFEC-
TIVE DATE HEREOF.
Motion was made by Councilperson Skelton to approve the
Ordinance rezoning the east of Bloc 1 3 from Residential II
to Commercial. Second by Councilperson Faris. T e motion
carried, 8 ayes and 0 nays.

10. Council considered the Harris County Fire Fighter's Protec-
tion Contract for 1982.

Mayor and City Secretary to sign the contract. Second by
Councilperson Westergren. The motion carried, 8 ayes and

11. Administrative Reports:
City. Manager Owen reported on the Solid Waste Meeting in Deer
Park and stated another meeting will be held March 23rd at
7:00 P.M. at the Deer Park City Hall.
Owen reported the Flood Insurance maps have been received
and were being reviewed by the Engineering Department.
12. Council Action
• Councilperson Gay thanked the citizens for coming out and
thanked Public Works for cleaning the ditches on the north side.
There being no further business to come before the Council,
the meeting was duly adjourned at 8:26 P.M.

SUBJECT: Traffic urvey
March 10, 1982
The Texas Department of Highways and Transportation is considering upgrading the
signalization of Main Street from San Jacinto, to Highway 1~+6. They have hired
Walton and Associates Consulting Engineers, Inc. to survey this area and propose
specific improvements.
Three (3) questions have come up in the survey that need City Council attention.
They propose to eliminate the signal at Second Street as unwarranted, to eliminate
• parking in the eastbound lane between Eighth Street and 1~+6, and to change San
Jacinto to a one-way, Southbound, between Main Street and "A" Street.
Steve Richards and Jack Hoffman of Walton and Associates, will attend the March 17,
regular Council meeting to explain their proposals and answer any questions.

2 ton pickup trucks for EIGHT THOUSAND ONE HUZJDRED THIRTY ONE DOLLARS AP1D EIGHTY
ONE CENTS ($8,131.81) each, or TWENTY FOUR THOUSAIV'D THREE HUNDRED NINETY FIVE
DOLLARS PND FORTY THREE CENTS ($24,395•x+3) total, for the Warehouse, Street and
Solid Waste Comrrercial Departments. Budgeted amounts were EIGHT THOUSAND DOLLARS
($B,000.GO) each. Eacr. department has funds to make up the ONE HUNDRED THIRTY
ONE DOLLARS AND EIGHTY ONE CETdTS ($131.81) difference in budgeted amo~_int and
bid amount.
• Bids were sent to four (x4) dealerships, but only Joe Camp Ford submitted a bid.
'The Public Works Department feels tYiis is a fair bid in that last year's trucks
were purchased for SIX THOUSAND EIGHT HUNDRED FIFTY EIGHT DOLLARS ARID FIVE CENTS
($6,858.e5) each. Because only one (1) bid was received, I feel that Council
should determine whether to accept or reject the bid.

SUBJECT: Awarding Tractor Bids
On Monday, February 22, we received and opened four (4)
bids on tractors and attachments for Parks and Recreation
Department. Lora bid was from Gloger Kubota in the amount
of $28,844.00. The remaining bids were as follows:
Trinity Valley Tractors Inc. in the amount of $31,940.60,
Jim Ball International in the amount of $32,100.53 and
Landsdowne Moody Company in the amount of $32,742.71.
Gloger Kubota has met all specifications of bidding; it is,
therefore, my recommendation that we award this bid of
$28,844.00 to Gloger Kubota. All tractors and attachments
were budgeted items in the amount of $48,900.00.
If there are any further questions, please advise.

SUBJECT: Project #1288-80: Lomax Bon' Program - Street Paving
and Drainage Improvements =- hange Order #8
Near the end of the Lomax Street Bond Improvement Project
there were three (3) final reconciliation change orders (#6, #7
and'#8) which needed Council action in order to complete the
project and tie up loose ends.Unfortunately due to an over-
sight change orders #6 and #7 were approved by Council; however,
change order #8, which was discussed at a workshop, was never
formally approved by Council. This item is presented here
for your approval so that Council minutes can reflect the
approval of change order #8 and the Accounting Department
can close their books. The amount of the change order was
$650.00 and it was for North "H" Street at Duane Lane -
Add 1 ea. junction box on South side of "H" Street to
intercept storm drain system coming out of Plane View
Subdivision. Thanks.

AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte
hereby finds, determines and declares that heretofore, to-wit:
on the 3rd day of March, 1982, at 7:00 P.M., a joint public
hearing was held before the Planning and Zoning Commission and
the City Council, of the City of La Porte, Texas, pursuant to
due notice, to consider the question of the possible re-
classification of the zoning classification of the hereinafter
described parcel of land. There is attached to this Ordinance
as "Exhibit A," and incorporated by reference herein and made
a part hereof for all purposes, a copy of "Notice of Public
Hearing" which the City Council of the City of La Porte hereby
finds was properly mailed to the owners of all properties
located within two hundred feet (200') of the properties under
consideration.
Section 2. The Publisher's Affidavit of Publication of
notice of said hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.
Section 3. Subsequent to such public hearing, the City
• of La
Porte Planning and Zoning Commission met in special
session on March 3, 1982, to consider the changes in classi-
fication which were the subject of such joint public hearing.
The City Council of the City of La Porte is in receipt of ttie
written recommendations of the City of La Porte Planning and
Zoning Commission, by letters dated March 3, 1982, the original
of which letter is attached hereto as "Exhibit C," incorporated
by reference herein, and made a part hereof for all purposes.

Section 4. The City Council of the City of La Porte
hereby accepts the recommendation of the City of La Porte
Planning and Zoning Commission, and the zoning classification
of the hereinafter described parcel of land, situated within
the corporate limits of the City of La Porte, is hereby changed
in accordance therewith, and the zoning classification of said
parcel of land shall hereafter be "District C--Apartment and
Commercial District." The description of said parcel of land
re-zoned is as follows, to-wit:
The East one-half (E.1/2) of Block Eleven
Hundred Thirty-one (1131), TOWN OF LA PORTE,
Harris County, Texas.
Section 5. This Ordinance shall be in effect from and
after its passage and approval.

THIS AGREE*~ NT, made and entered into by and between HARRIS COUNTY, a
body corporate and politic under the laws of the State of Texas, hereinafter sometimes
called "County", acting herein by and through its County Judge duly authorized to
so act by an Order of the Harris County Commissioners Court, and the City of
LaPorte , a municipal corporation duly organized and existing under
the laws of the State of Texas, hereinafter sometimes called "City", acting herein by
and through its Mayor duly authorized to so act by an Ordinance duly passed by the
~ty.
W I T N E S S E T H:
WHEREAS, Harris County desires to provide fire fighting and fire protection
services to certain unincorporated areas of Harris County as hereinafter designated;
and
WHEREAS, the City of Laporte is willing to furnish fire
fighting and fire protection services to said unincorporated areas of Harris County
for the considerations hereinafter provided;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That in consideration of
the mutual covenants, agreements and benefits to both, parties, it is AGREED as follows:
I.
During the term of this agreement, the City agrees to furnish fire fighting
and fire protection services to the unincorporated areas adjoining the corporate limits
this City designated by zone number 11-34 on the official fire protection
zone map of Harris County, to which reference is here made.
II.
Harris County agrees to pay the sum of $ 6,660.00
to the City for
fire fighting and fire protection services to the unincorporated areas of Harris
County pursuant to Paragraph I of this agreement. The County agrees said sum is to
be paid to the City within thirty (30) days after the execution of this contract.

VIII.
• The City agrees to deliver to the Fire Marshal of Harris County a certi-
fied copy of the ordinance authorizing the City to enter into this agreement within
five (S) days after the execution of this agreement.
IX.
The City agrees to furnish the Fire Marshal of Harris County, not later
than the fifth (Sth) day of each month, a monthly report listing the total number of
runs made into the unincorporated areas of Harris County for the previous month and
such other information relating to fire fighting and fire prevention services of the
~ty as nay be requested by Fire Marshal of Harris County. Said report shall be made
on the fora provided by the Harris County Fire Marshal and shall be signed and certi-
fied by an of ficial of the City.
