1. Meeting called to order by Mayor Meza at 7:00 P.M.
Members of the City Council Present: Mayor J. J. Meza,

2. The invocation was given by City Attorney Askins
3. The Council considered the minutes of the Regular Meeting of
March 17, 1982, the Joint Public Hearing and Special Called
Meeting of April 3, 1982.
A motion was made by Councilperson Westergren to accept and
approve the minutes as presented. Second by Councilperson
Simons. The motion carried, 8 ayes and 0 nays.
Ayes: Councilpersons Malone, Longley, Latimer, Simons, Gay,
Skelton, Westergren and Mayor Meza
Nays: None
4. Mayor Meza presented Certificates of Appreciation to Council-
person Latimer and Councilperson Simons. Councilperson Faris
was not present to receive his certificate.
5. Mayor Meza asked that the newly elected Councilpersons come
forward to receive the Oath of Office. Mayor Meza adminis-
tered the oath for Councilperson Edward Matuszak, Council-
.. person Y.evin Graves and Councilperson Lindsay Pfeiffer.

The duly-sworn Councilpersons were seated at the Council
table, where they received certificates of election and
the congratulations of all present.
Matuszak: I would like to thank those people who have sup-
ported me in the past two elections. I must say, the thrill
of victory is better than the agony of defeat. I would like
to especially thank my wife, my daughter Tracey, who put up
without me while I was campaigning. During this campaign I
got to meet an awful lot of people, some of the finest people
I could ever imagine meeting. ;~Jith their great support, I
believe we have come to a like thinking, and I believe that
this is one of the reasons that I was elected. Thank you
very much, and it will be my pleasure to serve the people,
citizens of this town, for the next three years.
Graves: I would like to say, also, that I appreciate the
citizens that came out this last Saturday and voted, It was
a good return on the elections. It's been a great year, and
I have met a lot of great people and had a lot of great help.
My family, especially, has put up with me being gone many
hours and has helped me many hours. I'm glad I-have the op-
portunity to serve the citizens of La Porte, .and I will do so
to the best of my ability. I will invite any comments or
criticisms any time. I want to be your seven day a week
servant. Thank you, and T am looking forward to this next
year..
Pfeiffer: I do, too, thank everyone who helped me win the
election. I also want to thank Tom for his six years of de-
voted service. He was very unselfish in his time and his ef-
forts. I think he did a good job for the City of La Porte.
I hope I can do equally well or better. T would like to point
out I didn't have anything to do with his office being cleaned
out, and I hope I can serve y'all.
6. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING ALL THE ALLEY IN BLOCK SIX HUNDRED FIFTY^THREE
(653) IN THE TO4JN OF LA PORTE, HARRIS. COUNTY, TEXAS
A motion was made by Councilperson Gay to adopt and approve
Ordinance No. 1304 closing t e alley in Block 5 for Mr.
Bill Fleener as read y t e City Attorney. Secon y Council-
person Skelton. Councilperson Skelton asked that the formula
by which the fair market price is set be reviewed by the City
Attorney. Mayor Meza instructed the City Attorney to review
• the formula and report to the Council on April 14.

7. Council considered authorization of payment of the increased
costs of employee insurance for the remainder of the 1981-82
fiscal year with Business Men's Assurance, Tnc.
City Manager Owen stated that with certain interdepartmental
and intradepartmental transfers authorized by City Council,
there would be adequate budgeted funds to cover the increases
in the employee insurance.
A motion was made by Councilperson Skelton authorizing payment
of the new rates for employee insurance with Business Men's
Assurance for the remaining months of the 1981-8 fisca year
and further authorizing the necessary inter epartmenta an
intradepartmental transfers to provi e necessary un s to
• meet t e insurance o igations. S e ton urt er instructed
staff to research possibilities for service for the proposed
1982-83 budget. The motion was seconded by Councilperson
Westergren. The motion carried, 9 ayes and 0 nays.

8. Council considered the recommendation of Public. Works Director
Hodge concerning bids received for. a "Rubber Tire Loader".
Four bids were received; the bid by Lansdowne-Moody Company
did not meet bid specs. Low bid received was from Hyco Equip-
ment Company in the amount of $53,423.00. This is within the
budgeted amount of $55,000.00
Skelton: I have a question. In the specs on page 02, this
doesn't show that this particular piece of equipment has the
gauges No. XIII.
Hodge: Yes, it does.
Gay: Mr. Mayor, before we go on, this is quite a sum that is
being spent, even though it was discussed in workshop. T
would like to know what is this going to be used for? We are
talking about spending $53,423, the public would really like to
know. This would take a load off of my shoulders, also.

Hodge: The loader will be used in our street maintenance
and drainage program and our street construction program.
It is a versatile machine. This has been under considera-
tion ever since I have been here by the past Council. It
is an item we studied a long time before I made the recom-
mendation.
Longley: Mr. Mayor, I understand that John Deere has a manu-
facturing plant in Argentina. Is that going to be a problem
for parts?
Hodge: All John Deere tractors are made here in the States.
I don't know what they build outside, but this is an American
made machine.
Skelton: Mr. Mayor, since this is a budgeted item, we have
a large street program underway; we are anticipating recon-
structing over nine hundred thousand dollars worth of streets.
I make a motion to approve the low bidder, Hyco Equipment
Company in the amount of 53, 23.00.
• The motion was seconded by Councilperson Matuszak. The motion
carried, 8 ayes and 1 nay.

9. Council considered appropriating additional funds for the
awarding of a bid on a "Heated Asphalt Storage Tank".
City Manager Owen explained why there was a shortage of
budgeted funds for this item. When quotes were received last
summer during budget preparation, the quotes given were for
a cold oil storage tank without a heater and necessary piping.
6Vith these quotes, $20,000 was budgeted in the 1981-82 budget
for the Heated Asphalt Storage Tank. Owen stated this item
is a necessary or essential item for the street program, and
asked. that the Council appropriate an additional $9,2.00.00
from the 1979-80 Capital Improvement Contingency Fund.
A motion was made by Councilperson Skelton to accept the low
bid y Plains Machinery Company of 2 ,200.00 for a Heated
Asphalt Storage Tank and to appropriate the addit~.onal
9,200.00 needed for t e purc ase from t e - 0 Capital
Improvement Contingency Fun Seconded by Councilperson Longley.

10. Council considered the recommendation by Public Works Director
Hodge for two diesel powered tractors and two mowers. Five
bids were received on the tractors; two did not meet speci-
fications. Low bid for the tractors was from Hyco Equipment
Company in the amount of $13,262..00 each. Low bid for the
mowers was from Lansdowne-Moody Company in the amount of
$1,464.95.
Motion was made by Councilperson Westergren to award the bid
for two diesel powered tractors to Hyco Equipment Company in
the amount of 26,52 .00 an t e i for two mowers to Lans-

Councilperson Gay. Tie motion Carrie 9 ayes and 0 nays.

11. City Attorney Askins raised a procedural point concerning
Ordinance 780-YYY and 780-ZZZ, ordinances rezoning a 23 acre
tract of land on 146 for container storage and an ordinance
rezoning from Residential to Commercial a 4.5 acre tract on
McCabe Road. The public hearings have been held; the three
newly elected members of Council did not participate in those
public hearings. There are two courses of action open to
Council. If the Council wishes to vote on these ordinances
tonight, the three newly elected members would have to ab-
stain because they didn't participate in the hearing. The
other course of action would be to table the ordinances, redo
the public hearings so the full Council could participate in
the vote.
G_~: Mr. Mayor, I feel that the new Council should take part
in this because this is gonna not only affect today, but 20
years from now. So I think they should have time to study
these ordinances for rezoning. This would give them time so
they wouldn't go into this blind. I make a motion that we
table this until a new public hearing can be el on April
8 at 7:00 P.M.
Matuszak: Mr. Mayor, may I ask a question? Is this to say
that we are going to have to have another public hearing so
• that we can participate in it, or is it just a matter that we
haven't had time to study this?

Askins: For the three newly elected Councilmen to be
entitled to legally vote, you would have to participate in
a public hearing. You may have sat in the audience during
the public hearing, but you didn't hear it as a Councilman.
To have an opportunity to vote on it, we must reschedule the
public hearing.
Matuszak: So this means we must have another public hearing
or I must abstain. Well, T do not intent to abstain on this
matter.
Skelton: Mr. Mayor, since this is the pleasure of the new
Council; since they were given the opportunity to vote on
this by a former Councilman, I second Mr. Cay's motion to
table this and hold a new public hearing on April 28.
Matuszak: Mr. Mayor, T'd like to make a comment on this ordi-
nance, even though I was not a participant in the public
hearing. I find that Section 5 needs considerable rewrite.
I find it amazing that it has gotten this far without a re-
• write, especially when we have a perfect example of what
happens when you apply Section 5. For the interest of the
people in the audience, Section 5 is the section concerning
the green belt which seems to be included now as part of our
container ordinances, at least the last two. (Mr. Matuszak
read Section 5.) T believe, Mr. Askins, correct me if T am
wrong, but this is essentially the same Section 5 as Container
Services has in their Special Use Permit?
Askins: Yes, that is correct. However, I would like to inform
the new Councilmen that a particular ordinance on green belts,
which will have particular application to container yards but
perhaps may have application to other matters if the Council
wishes to apply it, is under preparation. Our office is
consulting a gentleman who is a horticulturist professor out
at San Jacinto College for help of more specifics to have
more detailed requirements written by someone who is an expert
on how this might be done in a more detailed fashion, .and that
will take the place of the green belt requirements in the
former zoning ordinance. Tt will also be retroactive to the
container yards now existing in La Porte. That ordinance is
now in preparation and will quite likely be presented at the
same time as or before this zoning comes up for final approval.
It is quite likely that by the time this comes up for approval
we won't have the green belt section in the ordinance, but will
refer to the new green belt ordinance which will specifically
. address it. I would expect in a great deal more detail, and
perhaps we may recommend the approach in the ordinance to
actually have this gentleman make drawings as a landscape
architect would do, just how it should look.

Matuszak: I would just make one other observation along
that line, that T think this existing one is practically
worthless because it has no time limit on it. A person
could plant a dense green belt starting with. acorns, and
50 years from now not have much in the way of trees there.
I frankly think there are enough loopholes to drive a con-
tainer through. I don't believe as it stands right now it
will ever stand up in court.
Skelton: Mr. Mayor, T would like to point out that if this
had come up tonight I was prepared to offer an amendment.
I am sure Mr. Matuszak would also have had an amendment to
include more on this and probably down Strang Road, but since
it didn't come up and since it has been tabled., I suggest we
take care of this at the public hearing.
Matuszak: Mr. Skelton, I believe I had the floor, and I'd
like to say one more thing on this. It"s not only the green
belt. This is tantamount to giving permission to a four
story building, and I don't see how a 5 foot deep or even a
• 20 foot deep green belt is going to hide a four story building
that's a block long, a block wide, and basically covering
35 acres. Green belts of this sort, I don't believe are going
to solve this problem. I think it's a smoke screen. I think
that these things have to be far enough away from our public
thoroughfares that they are hidden by whatever and not ex-
posed. They just give a wrong image of this town. Especially
when they are located at such an intersection which to me,
as I drive through it is a very important one. I think it
gives a bad image to this town and I'm glad we tabled it for
another public hearing.
Meza: I have a motion and a second to table Item 11 and Item
12 until April 28 when a public hearing and a Special Called
Meeting will be held to consider them.

13. Administrative Reports:
An emergency addendum was posted at 9:00 A.M. this morning.

1. The cancellation of a contract with Fire Fox Corporation
for a fire truck ordered several months ago after the
first company went bankrupt. It seems Fire Fox has filed
bankruptcy procedings and is unable to fulfill their con-
tract with the City of La Porte.
2. Consider awarding the bid to Claude Wright & Associates,
Inc., for one (1) American La France Century 1500 G.P.M.
Custom Pumper. Claude Wright & Associates will hold
true to the bid they submitted originally and supply us
with a 100 percent performance bond.
3. Consider appropriating an additional $11,159.00 from the
1979-80 Capital Improvement Contingency Fund for this
bid.
A motion was made by Councilperson Malone to cancel the con-
tract with Fire Fox for a truck, award the id to Claude
Wright & Associates, Inc., for one American La France Century
1500 G.P.M. Custom Pumper and appropriate , .00 rom
• the 1979-80 Capital Improvement Contingency Fun or t is
truck. Second by Councilperson Westergren. T e motion car-

14. Council Action:
Malone: In the minutes it refers to Sonny Black making a
presentation to the Council. I want to thank all the people
that came out to support the FFA boys here with the La Porte
School District. It was an outstanding program. They will
have a play night April 9-10. I wouldn't always speak for
the young people, but about 25 years ago, Lin was on my Little
League Ball Club and he turned out pretty good. I appreciate
the people getting out to vote. I think it was an outstanding
turnout and congratulations to all of you.
Longley: Mr. Mayor, I would like to welcome the new members
to the hot seat.
Matuszak: Mr. Mayor, I remember the first Council session Mr.
Faris had last time, and he raised an issue about some side-
walk repairs in our district. I'd like to see Mr. Hodge
• resurrect that, or Mr. Owen, to see what the possibility of
repair is. I urge everybody to vote in the next election.

It takes responsibility to vote, and I think the majority
of people in this town have taken this responsibility. T
think those that vote should be heard above others, but we
represent everybody. The louder they vote the louder we hear.
Graves: Get out to vote and take your neighbor to vote. I
am looking forward to working with the Council. T'll have a
learning period to bring me up to speed with the rest of the
Council, and I'll do it as quick as I can. I know I'll have
plenty of help.
Pfeiffer: I just hope we don't spend this much money every
night. I do thank you all for your support.
Gay: I'm always glad to see such wonderful people out. This
shows that they are. interested in their government. I want
to welcome the new Council aboard. I also want to say to
those T have worked with this past year that T have enjoyed it
and have learned from you. This has been a learning period
for me and I think I have got my feet on the ground.

Skelton: I certainly want to express my congratulations to
the new Councilmen, and I am looking forward to working with
you. I think we should give a lot of thanks to those who
sat in these seats before us. They left some big shoes for
you to wear.
Westergren: I, too, would like to say. congratulations on
your win. I appreciate people who are willing to put them-
selves to the responsibilities we all have to face up here.
I think it takes a big person to do that. I hope everything
works out well for us this year. I am looking forward to
working with you.
Meza: I wish to welcome the new members of the Council.
Thank all of you for being here. We need an executive session
to discuss a legal matter.

ORDINANCE NO. 3Q
AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY
IN BLOCK SIX HUNDRED FIFTY-THREE (653) IN THE TOWN OF LA PORTE,
HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block Six Hundred Fifty-three
(653 ) of the Town of La Porte has never been opened or used as
a public thoroughfare, and the public utilities now making use
of such alley have all given their written consent for its
closing; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that
the said alley is not suitable, needed, or beneficial to the
public as a public alley, and should be vacated, abandoned and
permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. The alley located in Block Six Hundred Fifty-
three (653) of the TOWN OF LA PORTE, Harris County, Texas, is
hereby permanently vacated, abandoned and closed by the City
of La Porte.
Section 2. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this .ordinance and the subject
• matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting
thereof.

Section 3. This Ordinance shall take effect and be in
force from and after its passage and approval.

Powered Loader. Four bids were received, but the one from Lansdowne-
Moody Company does not meet specifications.
Of the remaining bids, low bid was received from Hyco Equipment Company
in the amount of Fifty Three Thousand Four Hundred Twenty Three Dollars
($53,23.00). This is within the budgeted amount of Fifty Five Thousand
Dollars ($55,000.00).
I recommend that the bid be awarded to low bid meeting specifications
from Hyco Equipment Company for the bid amount.

Last summer, while preparing the upcoming budget, quotes were solicited
for a heated asphalt storage tank. Through a misunderstanding, Public
Works Department was quoted on a cold oil storage tank without heater
and necessary piping. This amount, Twenty Thousand Dollars ($20,000.00),
was approved by Council for inclusion in the 1981-1982 Budget.
Bids were submitted by Plains Machinery Company and R.B. Everett &
Company. Low bid, from Plains, was Twenty Nine Thousand Two Hundred
Dollars 0 29,200.00). This amount is Nine Thousand Two Hundred .Dollars
09,200.00) over the budgeted amount.
This tank is essential for the street program. In the past, heated oil
was shipped in tank trucks and the City was charged freight on Five
Thousand (5,000) gallons, regardless of the amount shipped. In addition,
• a demurrage charge of Twenty Dollars ($20.00) per hour is charged for a
tank truck to sit idle, which is necessary because the distributor truck
holds only Fifteen Hundred (1500) gallons. Often it takes all day to
empty the tank truck, as the oil must be reheated on the distribution
truck. This results in more demurrage charge as well as idle time for
crews waiting for the oil to heat.
In order to more efficiently carry on the Street program, I request
that Council appropriate the additional Nine Thousand Two Hundred
Dollars ($9,200.00) from the General Fund Contingency and award the
bid to Plains Machinery Company in the amount of Twenty Nine Thousand
Two Hundred Dollars 0 29,200.00).

In April 1980 the City Council awarded a bid to the Seagraves Company
fora 1500 GPM pumper. In July of 1981 the City Council rewarded the
bid to Fire Fox Corporation because Seagraves Company could not
deliver under the contract.
Fire Fox Corporation has passed its contracted delivery time and is
having financial problems. It is evident they will not be able to
deliver anytime soon or possibly at all.
I recommend that we ask the City Council to cancel our contract with
Fire Fox Corporation and award the contract to American La France
• Corporation for the sum of $126,900.00. This is $11,159.00 over Fire
Fox's price and will require a budget appropriation by Council.
American La France Corporation can deliver the truck in 3 to 6 weeks.
