OF THE
REGULAR MEETING OF THE LA PORTE CITY COUNCIL
APRIL 21, 1982
1. The meeting was called to order by Mayor Meza at 7:00 P.M.
Members of the City Council Present: Mayor J. J. Meza,
Councilpersons Norman L. Malone, John Longley, Edward Matuszak,
Kevin Graves, Lindsay Pfeiffer, Deotis Gay, Don Skelton,

ates, Inc. There were 94 interested citizens present in the
Council Chambers.
2. The invocation was given by Councilperson Malone
3. The Council considered the minutes of the Regular Meeting of
the La Porte City Council held April 7, 1982 and the Special
Called Meeting held April 17, 1982.
A motion was made by Councilperson Skelton to approve the
minutes as presented. Second y Councilperson TiVestergren. The
motion carried, 9 ayes and 0 nays.
Ayes: Councilpersons Malone, Longley, Matuszak, Graves,
Pfeiffer, Gay, Skelton, Westergren and Mayor Pdeza
Nays: None
4. Mayor Meza introduced Harris County Judge Jon Lindsay, who
would administer the oath of office to the newly elected of-
ficials, Mayor Virginia Cline and Councilperson John D. Carr
Longley.

Mayor Meza made the following statement:
I want to express my thanks to the City Council for the
support they have given me in the past six years. Jack, I
want to thank you for the short time you have been here,
and the staff for making the past six years as easy as they
have been. We have come a long, long way. Economic stability
cannot be achieved verbally, it takes sound planning, commit-
ment and positive action. We enjoy a strong and sound
economy in La Porte because City Council has been able to
work together, set plans and attain goals. Puny things have
been accomplished, but in a growing community there remains
many unfinished plans and a lot of goals to be set. Tn
order to complete these goals as we have before, we have to
work together. I am proud to have been the Mayor for the
past six years, and to have achieved the many things that we
have. I appreciate the support from our e.itizens, past
Council members, past staff members and the present City
Council. The future of La Porte is still number one with
me. I urge all of you to support your new Mayor and City
• Council in all the plans that they have. It is only through
a united City Council that anything can be achieved. Thank
you for letting me be a part of it for the last six years.
Malone: I want to say I have enjoyed working with you. I
appreciate what you have done for the City, and I personally
want to thank you and past City Councils for what you and
past City Councils have accomplished in the City of La Porte.
I wish you well.
Skelton: I want to say that I also appreciate working with
you and the new Council this past year. I know your family
was deprived of you at home and they gave up a lot these past
six years. It's a big, big job and I am sure we are going to
continue to do a good job in the fixture.
G_~: I am kind of on the lines of Mr. Skelton. I appreciate
working with you and I have learned over the year. It has
been a learning period where I have learned a great deal from
you. I am also saying that your family has been deprived of
many hours and many things you could have done with them.
Thank you, Mr. Mayor.
Pfeiffer: I'd like also to thank the Mayor. I know it takes
a lot from your family since my father once served. I ap-
preciate your dedication to the City.

Westergren: I, too, would like to thank you for your guidance
and assistance this past year. I appreciate your concern for
your City and the time you have dedicated. to this community.
Longley: Mr. Mayor, I also want to express my appreciation
for your guidance and help this past year and for all the
things you have done for La Porte. You certainly will be
missed.
Matuszak: Mr. Mayor, T would like to thank you for the many,
many hours you have given this City and the citizens. T am
sure they will be remembered for a long, long time. I person-
ally want to thank you for the many courteseys you have given
me as a citizen when I have appeared before this Council. I
wish you the best of luck.
Graves: I would like to thank you and reflect back on the
time when I was employed with the City. I look at you as a
boss. I appreciate you and all you have done.
• Mayor Meza asked that Virginia Cline come forward to receive
the oath of office of Mayor of the City of La Porte and John
D. Carr Longley as Councilperson District 2. The oath was
administered by Judge Jon Lindsay.
Mayor Cline and Councilperson Longley were seated at the
Council table.
Mayor Cline presented a certificate of appreciation to
J. J. Meza for service to the City of La Porte.
Mayor Cline made the following statement:
I am extremely proud to have the opportunity to serve you.
My deepest appreciation and heartfelt thanks go out to each
and every one who voted for me. You have demonstrated the
democratic process wherein lies the strength of this great
nation. Democracy starts with each of you and prevails as a
privilege to enjoy freedom as we know it. The wars of politics
are now over for us for awhile, and it's time to forget polit-
ical rhetoric and statements to sway the voters. We must now
join together and strive in harmony and cooperation with each
other and to regulate our affairs to benefit the people of
La Porte. I hope, above all else, to keep your desires fore-
most in my endeavors and to attempt to satisfy the majority
most of the time. Let us join together in unity and work to
• improve our City, provide the best possible services to our
citizens and cooperate fully with each other to make these
goals possible. I shall cherish always your support in my

successful campaign. I sincerely appreciate each and every
one that worked so hard to make it successful. T pray for
God's grace that I will never disappoint you. Thank you so
very, very much.
Longley: I would like to thank Judge Lindsay for taking time
out of his busy schedule to come down to perform this service
for us. I'd also like to say that I have discovered how far
it is from that bench out there to this chair. As I start my
second year on the Council, it is with a lot of optimism and
I am anxious to pursue a positive course that will make our
City a better place to live. I want to thank the many, many
people who worked very hard in my campaign. My special thanks
to my campaign manager, Jane Without her
untiring work, all this would not have been possible.
5. Mayor Cline declared a public hearing on dangerous buildings

Chief Inspector Paulissen brought the Council up to date on
the list as to correspondence from owners (a part of the
• official minutes), then presented slides he had made of the
listed buildings.
Mayor Cline then asked to hear from anyone present who wished
to address the proposed dangerous buildings.
Mr. Anderson asked for an appointment with the Chief Inspector.
Mr. Montalbano spoke on behalf of Mrs. Michael Montalbano and
asked for a conference with the Chief Inspector to work out
either demolish or repair.
Victoria White addressed the Council, stating she was going
to have the house at 218 North 5th moved. Mr. Paulissen was
directed to work with Mrs. White.
6. A motion was made by Councilperson Matuszak to table a resolu-
tion appointing the members of t e appraisal review oar
until the April 28 workshop. Second y Councilperson S elton.
The motion carried, 9 ayes and 0 nays.

7. City Attorney Askins read: AN ORDINANCE AMENDTNG CHAPTER 23,
"TAXATION", OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE,
BY EXEMPTING $60,000.00 OF THE ASSESSED VALUE OF RESIDENCE

A motion was made by Councilperson Graves to adopt Ordinance
No. 1306 as read by the City Attorney. Second by Council-
person Gay. The motion carried, 9 ayes and 0 nays.

Pfeiffer, Gay, Skelton, Westergren and Mayor Cline

8. Council considered awarding bids for street material as
follows:
1. Gulf States Asphalt Co. for:
Emulsions
Cut-back asphalt
Asphalt cement
• 2. APAC, Texas, Inc., for:
Asphalt stabilized base
Hot mix asphaltic concrete pavement
3. White's Mines for:
Cold mix limestone mix
4. Chemlime Corp. for:
Lime slurry
upon the recommendation of Director of Public Works Hodge and
Purchasing Agent Jackson Ray.
Skelton: Madame Mayor, inasmuch as we have an aggressive
street restructuring program and this is the recommendation
from the purchasing .agent and the Public Works Director, we
would like to buy at the lowest price. I would like to make
a motion to accept their recommendation and award t ese i s.
Matuszak: I, on the other hand, would like to say I don't
think it is proper to award a year long contract when we only
have one bidder and two no-quotes. T think there's two things
wrong with this, and in Mr. Hodge's statements last week, he
stated that there is really no guarantee or price assurances
on a number of these items, that the price could fluxuate
either up or down. As Mr. Askins had stated., this is really
a formality to somewhat circumvent a state law requiring bids.

I think one of two things is wrong with this; either our
specifications are too high or we haven't pursued the matter
far enough to assure ourselves that we have the best price,
at least on these asphalt cut-backs. I would like to see
at least that item rebid or at least investigation to the
specifications to see if the rest of the cities around us
are using 1962 specifications and we insist on 1972. T'd
suggest perhaps we ought to look into this a little bit
further. I'm not so sure it's the quality of material we
are buying that's going to be up-graded. If there's a
problem with the 1962 specs, it might be with the applica-
tion, not the material. T just hate to see one price and
two no-quotes. I don't think that's an adequate attempt to
purchase.
Skelton: Madame Mayor, as pointed out in workshop, we can
cancel these things and go out for rebid at any time that we
elect. Since most of this is a petroleum product, the industry
continues to change their prices. I think we need to have
something that the City can procede with the street program
• rather than have people wait for material and for us to have
to approve each time they need a batch of asphalt. This
allows us to go ahead and we are not committed to go any fur-
ther than we would like and we can change this at any time.
Gay: This was discussed in workshop and as Mr. Askins said,
we are not really obligated for the whole year. This is only
a formality. We need to get this approved so we can get on
with this.
Matuszak: Madame Mayor, I'd like to suggest that perhaps
this is a little specious. I found in my practice when you
have a blanket purchase agreement, the purchasing agent takes
the easiest route, send me another load, send me another load,
rarely do they ever check to see if the market is up, down, or
lower. At Mr. Hodge's own admittance, he was a little con-
cerned that the limestone contracts were a little high. I
submit that when one goes with a long .term contract and is
not assured of obtaining anything, specifically in the way
of a guaranteed price, that we will take the easiest price
and say send me another load at that price.
Westergren:,. Madame Mayor, I wish to second the motion in order
that we may bring this to a vote.
Cline: I have a motion by Skelton to award the bid, second

Cline: The motion carries.
Askins: Mr. Matuszak made a statement as quoting me as
having said last week that this was a formality to circumvent
bidding. I would not want that statement to go unchallenged.
I did say it was a formality, but it was not intended to cir-
cumvent the bidding; it was intended to comply and it does.
It does comply with the bid laws and I would like to re-
• empathize as I did last week, this is not a contract, no
element of it is a contract. It was a trip to the market,
so to speak, to obtain open-ended quotes which are available
for acceptance later if we choose to do so. It is the nature
of the market, particularly with petroleum products, that
there is much price instability. I agree with Councilperson
Matuszak that you might want to instruct the purchasing agent
to agressively test the market from time to time as to per-
haps more favorable quotes being available, as any business
would do. And this is a business. Certainly there is nothing
in the bid law, since we have complied with the bid law, to
prevent the purchasing agent from testing the market for
better prices.
Matuszak: I didn't mean to directly quote you. I guess it
was my term. I should have used it.
Cline: Mr. Askins, what you are saying is that we are not,
in essence, signing a contract for a year to keep buying this
material at this price?
Askins: That is correct. This was done as it has been on an
annual basis as a method of obtaining quotes from bidders
through a bid publication. We can use these, but if we can
better them, we can do so and certainly should do so.
• Graves: In that sense, then, can we go back out for bids?

Askins: Yes, but you don't have to go back out for bids,
since the bidding process has been accomplished, the pur-
chasing agent can do it on an informal basis just as any
business agent would do.
Cline:. We have a motion, second, and the motion has carried,
but I would like to say that perhaps we should put on a work-
shop agenda sometimes when it's not overly crowded and really
discuss it more thoroughly.
9. Council considered awarding the bid for nine (9) 55 gallon
drums of 91 percent malathion for mosquito control to Public
Health Equipment and Supply Company for $17.43 per gallon.
Motion was made by Councilperson Westergren to award the bid
for 91 percent malathion to Public Health Equipment and Su -
ply Company for 17.43 per gallon. Second by Councilperson
Skelton. The motion Carrie 9 ayes and O nays.

10. Council considered the recommendation of Director of Public
Works to award the bid for a one-ton utility vehicle to be
used as an equipment services vehicle to Joe Camp Ford in the
amount of $13,656.32.
Motion was made by Councilperson Pfeiffer to table action on
this bid until such time as Mr. Hodge o tains certain informa-
tion he had promised concerning cost of equipment for the
truck, liability insurance, num er of f ats fixe last year
and such. The motion was seconded by Councilperson Malone.
The motion carried, 9 ayes and 0 nays.

11. Council considered appropriating funds for Public Liability
Insurance on all properties owned by City of La Porte.
A motion was made by Councilperson Gay to enter a Public
Liability Insurance with Ken Strum Insurance Agency for the
City of La Porte for the remainder of the fiscal year and
appropriating 2.00 from t e - 0 Capita Improvement
Contingency and 18,88 .00 from t e Genera Fun Contingency
Reserve. Second by Councilperson Westergren.

Matuszak: I recommend that we look into this particular item
for next year's budget and possibly solicit other bids on
this item next year. I believe we have time to do this.
The motion carried, 9 ayes and 0 nays.

12. Council considered authorizing a transfer of $3,229.87 from the
Parks Land Acquisition Fund for payment of delinquent taxes
on 21.658 acre tract of park land along Little Cedar Bayou.
A motion was made by Councilperson Skelton to authorize the
transfer of $3,229.87 from Parks Land Acquisition Fun or
the payment of delinquent taxes ue on 21.658 acres of park
land due to the La Porte Independent School District. Second
by Councilperson Graves. The motion carried, 9 ayes and 0 nays.

13. Administrative Reports
City Manager Owen stated he had none, but requested an executive
session on personnel.
14. Council Action
Graves: I would like to know if the La Porte Girls Softball
Association has been taken care of? This item should be
placed on the workshop.
Gay: I would like to discuss plans for the dedication of the
North Side Civic Center.
Skelton: I would like to report on work being done on the
railroad tracks on SH 225. I had a call from Mx. Patterson
on April 20 to let us know they have a new schedule. They
will start on the east bound lane. on April 22, on the west
bound lane April 28.
Cline: I have an emergency addendum for the. April 21st
Council meeting.
• Council action needed to declare an emergency at water well
#4 at Main and Broadway Streets.

Mr. Hodge informed the Council of the loss of a motor at
water well #4 two weeks ago. The motor was replaced and
the damaged motor sent out for repairs. U.S. Electrical
Motors stated the motor was beyond repair. Hodge stated
the loss of another well could create a crisis situation
for the City water supply. Informal bids were taken for
a new 125 HP, vertical hollow shaft, 1800 RPM, 405 TP
frame, 460 volts. Hodge recommended the acceptance of the
bid submitted from Houston Armature Works due to immediate
delivery.
A motion was made by Councilperson Skelton to declare an
emergency and authorize the acceptance of the Houston
Armature Works bid of 5,194.00 to e funded from the Water
and Sewer Contingency Fund. Second by Councilperson Gay.
The motion carried, 9 ayes and 0 nays.

• Mayor Cline proclaimed May 1982 "Operation Community Pride
Month."
City Attorney Askins asked for an executive session on a
legal contractural matter.
15. The City Council entered into an executive session at 8:25
P.M.
The Council returned to the Council table at 10:16 P.M.
16. There being no further business to be brought before the
Council, the meeting was duly adjourned at 10:18 P.M.

FINDINGS AND CONCLUSIONS OF THE BOARD OF INSPECTION:
It is the unanimous opinion of this inspection board, after using
• Cites of La Porte Ordinance ~~1060 (Standard Housing code, 1979 Edition)
as its Quide in making the inspection, that this building is in fact
dangerous, not repairable: and should be demolished. This building does
not provide the basic minimum housing standards deemed essential for
safe and healthful living for a residential occupancy and is a threat to
public safety, health, and the general welfare of the citizens of La Porte.

AN ORDINANCE AMENDING CHAPTER 23, "TAXATION," OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, BY EXEMPTING SIXTY THOUSAND
DOLLARS ($60,000.00) OF THE ASSESSED VALUE OF RESIDENCE HOME-
STEADS OF DISABLED ADULTS AND PERSONS SIXTY-FIVE (65) YEARS OF
AGE OR OLDER FROM ALL AD VALOREM TAXES LEVIED BY THE CITY OF
LA PORTE FROM AND AFTER JANUARY 1, 1982; FINDING COMPLIANCE WITH
THE OPEN ~NIEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Section 23-3, Chapter 23, "Taxation," of the
Code of Ordinances of the City of La Porte, Texas, is hereby
amended to read as follows, to-wit:
"TAXATION"
"Sec. 23-3. Exception to payment of Ad Valorem Taxes.
From and after January 1, 1982, Sixty Thousand Dol-
lars ($60,000.00) of the assessed value of residence home-
steads of an adult who is disabled for purposes of payment
of disability insurance benefits under Federal Old-Age,
Survivors and Disability Insurance, or is sixty-five (65)
years of age or older shall be exempted from ad valorem
taxes levied by the City of La Porte; provided, however,
that any person desiring the right of exemption shall first
complete and file with the Tax Assessor-Collector of the
City of La Porte a sworn statement stating his name, age,
and the legal description of said residence homestead; if
disabled, a copy of Social Security disability certifica-
tion; and, provided further, that no residence homestead
shall be entitled to more than one residence homestead
tax exemption."
Section 2. This Ordinance shall take effect and be in
force from and after its passage and approval.
Section 3. The City Council officially finds, determines,
• recites and declares that a sufficient
written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated; and that this meeting has been
• open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further

This is in response to your request fora Comprehensive General
Liability policy on a short term basis. That being from the
date the City requests coverage be put in force to October 1,
1982. This is to advise that this is in order and based on an
annual premium of approximately $39,000, the premium for that
period of time would be approximately $17,000.
At the present time, the annual cost of a $1 million umbrella
is $12,000. On the short term basis the cost would be
approximately $5,000.
If these coverages are requested by the City, they can go into
effect immediately.

SUBJECT: La Porte School Taxes {Delinquent)
It has been brought to my attention by George Sharp, tax assessor
far La Porte Independent School District, that upon purchase of
the 21.658 acres of Parks land along Little Cedar Bayou the
school department overlooked delinquent taxes in the amount of
$3,229.87. Mr. Sharp has agreed not to charge a penalty in
interest on this amount from the time of purchase until May 1
because of the error in their department.
My recommendation for paying the taxes in the amount of $3,229.87
is from the Parks Land Acquisition Fund.
