OF THE
PUBLIC HEARING AND SPECIAL CALLED P~IEETING
OF THE LA PORTE CITY COUNCIL
APRIL 28, 1982
1. The Public Hearing was called to order by Mayor Cline at
7:00 P.M.
2. Mayor Cline stated this meeting has been called to consider
public input on a request to rezone a 4.5 acre tract of
land on McCabe Road from Residential (R-1) to Commercial.
The request was made by Mr. Gerald Teel.
Mr. Teel came forward to discuss his purchase of the property
and plans. He answered numerous questions from the Council.
Mr. Delbert Walker recommended to Council that this rezoning
be denied until such time as the new zoning ordinance and
map is adopted.
• 3. Mayor Cline stated this meeting has been called to also
consider public input on a request to rezone a 23 acre tract
north of the intersection of State Highways 225 and 146
(south of the tunnel - west side of 146) to Industrial with
a "Special Use Permit."
Mr. Kenneth W. Schmidt, President of Maritime Services, Inc.,
came forward to inform Council of his request to rezone the
23.83 acres for container storage and repair. He further in-
formed Council of his plan to utilize the frontage of SH 146
for a motel or office facility.
Mr. Schmidt answered questions from the Council.
Mr. B. J. Faulkner voiced his feelings concerning containers
in the City.
4. Mayor Cline adjourned the Public Hearing at 7:32 P.M.
5. Mayor Cline called to order the Special Called Meeting of the
La Porte City Council.

DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF

There was no motion forthcoming.
Mayor Cline declared the issue dead for lack of a motion.
7. The City Attorney read: AN ORDINANCE AMENDING ORDINANCE NO.
780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE
CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED;
AND PROVIDING AN EFFECTIVE DATE HEREOF
(23 acre tract more or less, out of Lot Thirteen (13), Staashen
Subdivision, Save and Except that Portion now being Utilized
by Central Freight Lines, Inc.)
A motion was made by Councilperson Longley to accept and
approve Ordinance No.~80-YYY as rea y City Attorney Askins.
Second by Councilperson Pfeiffer. T e motion carried, 6 ayes
and 3 nays.

MEMORANDUM

SUBJECT: Request for Rezoning of 4.5-Acre Tract on McCabe Road
Planning and Zoning met on March 4, 1982, to consider a're-
quest for rezoning of a 4.5 acre tract of land on McCabe Road,
just west of Broadway. Mr. Gerald Teel was present as petitioner.
The tract is located between Forest View Mobile Home Park
and a Harris County Flood Control ditch. The elevation of the
property is approximately 7 feet. The elevation limits the use
of the property considerably, and makes housing undesirable.
At the time the property was annexed, it received the R-1
zoning classification which is required by law. It has never
received any permanent zoning classification. The request is
for Commercial classification.
• Our preliminary recommendation is to rezone the tract to
Commercial. We wish a public hearing to consider this request.

Gentlemen:
This is to request your consideration for the zoning of the property
described by the attached Exhibit "A" located within the City of LaPorte,
Texas, to the category of commercial/light industrial. The property in
question was annexed by the City of LaPorte sometime in the past and
apparently fell into the automatic R-1 zoning rating at that time. The
property is located on McCabe Road just west of its intersection with Old
Highway 146 (LaPorte-Seabrook Road) and is immediately west of an 80 foot
drainage easement and is surrounded on the west and north by a Mobile Home
Park. Other properties along McCabe Road at this point are either
developed commercially or have not yet been developed. (From the asking
prices of the property, it is evident that no one intends for it to be
single family residential).

We wish to schedule a public hearing to consider this request
for rezoning. Our preliminary recommendation is to grant such
rezoning to Industrial with a special use permit under Ordinance
780-XX to allow truck terminal or oceanic container storage and
repair.

Maritime Services, Inc. respectfully requests the re-zoning of a
23.85 acre tract which we are in the process of purchasing from
Central Freight Lines, Inc. We request a zoning change with a
special use permit for the establishment of a container depot.
The tract boundaries are State Highway 146 on the east, E.I. Du Pont
De Numours & Co. on the north, Strang Road on the west or Union Carbide
Corporation, and Westinghouse Electric Corporation on the south.
The only major highway that this tract touches is State Highway 146.
The proposed tract is heavily wooded, fronting on State Highway 146.

AN ORDINANCE A24ENDING ORDINANCE NO. 780, THE CITY OF LA PORTS
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN-
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
Section 1. The City Council of the City of La Porte hereby
finds, determines and declares that heretofore, to-wit, on the
24th day of March, 1982, at 7:00 P.P4., a joint public hearing
was held before the Planning and Zoning Commission, and the City
Council, of the City of La Porte, Texas, pursuant to due notice,
• to consider the question of the possible re-classification of
the zoning classification of the hereinafter described parcel of
land. There is attached to this Ordinance as "Exhibit A," and
incorporated by reference herein and made a part hereof for all
purposes, a copy of "iJotice of Public Hearing" which the City
Council of the City of La Porte~tiereby finds was properly mailed
to the owners of all properties located within two hundred feet
(200') of the properties under consideration.
Section 2. The Publisher's Affidavit of publication of
notice of said hearing is attached hereto as "Exhibit B,"~incor-
porated by reference herein and made apart hereof for all purposes.
Section 3. Subsequent to such public hearing, the City of
La Porte Planning and Zoning Commission met in special session-
on 1~larch 24, 1982, to consider the changes in classification
which were the subject of such joint public hearing. The City
Council of the City of La Porte is in receipt of the written
recom:nerdations of the City of La Porte P1anr7ing and Zoning Com-
mission, by letter dated March 24, 1982, the original of which
letter is attached hereto as "Exhibit C," incorporated by ref-
• erence herein, and made a part hereof for all purposes.

Section 4. The City Council of the City of La Porte hereby
accepts the recommendation of tl~e City of La Porte Planning and
Zoning Commission, and the zoning classification of the herein-
after described parcel of land, situated within the corporate
li~iits of the City of La Porte, is hereby changed in accordance
therewith, and the zoning classification of said parcel of land
shall hereafter be "Light Industrial," and with a special use
• permit, with use strictly limited to alloca a container storage
and repair yard. The description of said parcel of land re-zoned
is as follows, to-wit:
That certain 23-acre tract of land,
more or less, out of Lot Thirteen (13),_
Staashen Subdivision, SAVE AND EXCEPT
that portion noc•~ being utilized by
Central Freight Lines, Inc., as more
particularly shown on a plat outlined
in yellow, attached hereto as Exhibit
"D", incorporated by reference herein,
and made a part hereof for all purposes.
Section 5. It shall be a condition of this Special Use
Per^~it that, at all times while the above-described property is
used as a container storage and repair yard, that five feet (5')
of said property along Highway 146 be densely planted and contin-
uously maintained as a "green belt" visual screen, using pine'
trees and shrubbery. Failure to keep and maintain such "green
belt" shall cause this Special Use Per,nit to be subject to revoca-
tion by City Council.
Section 6. All ordinances in conflict herewith are repealed,
to the extent of~conflict only.
Section 7. This Ordinance shall be in effect from and after
its passage and approval.
