JUNE 2, 1982
1. Call to order by Mayor Cline at 7:00 P.M.

2. The invocation was given by Councilperson Norman Malone.
3. A motion was made by Councilperson Malone to approve the minutes
of the La Porte City Council Meeting held May 19, 1982 with a
correction on item #6, changing the person making the motion
from Councilperson Skelton to Councilperson Pfeiffer. Second
by Councilperson Longley. The motion carried, 9 ayes and 0 nays.
Ayes: Councilpersons Malone, Longley, Matuszak, Graves,
Pfeiffer, Gay, Skelton, Westergren and Mayor Cline

4. Council considered the Mayor's recommendation that Councilperson
Norman Malone serve as Mayor Pro-Tem of the City of La Porte
from May 1, 1982 through April 30, 1985.
Motion was made by Councilperson Graves, seconded by Councilperson
Matuszak, to approve and adopt Ordinance No. 1321 as read by
Attorney Askins, "An Ordinance Appointing a Member of the City
Council (Norman Malone), To Serve as Mayor Pro-Tem of the City
of La Porte, for the Term May 1, 1982, Until April 30, 1985,
and Providing an Effective Date Hereof."

A motion was made by Councilperson Malone, seconded by Council-
person Matuszak to approve and adopt Ordinance No. 1321 as
read by City Attorney Askins, "An Ordinance Appointing a Member
of the City Council (B. Don Skelton, Sr.) to Serve as Mayor
Pro-Tem of the City of La Porte, for the Term May 1982,
Until April 30, 1985, and Providing an Effective Date Hereof."
The motion carried, 7 ayes, 1 nay and 1 abstain.

A motion was made by Councilperson [Westergren to approve and
adopt Ordinance No. 1322 as read by the City Attorney appointin
Jack Owen, City Manager; James B. [Villiamson, Judge of the
Municipal Court; Knox W. Askins•,• City Attorney; John D. Arm-
strong, Assistant City Attorney; Robert J. Montgomery, Prose-
cuting Attorney of the Municipal Court. Second by Council-
person Skelton. The motion carried, 9 ayes and 0 nays.

A motion was made by Councilperson Matuszak to approve and
adopt Ordinance No. 1323 as read by the City Attorney appointing
Dr. Genie Suhr, 910 S. Virginia, as Chairman (4-30-85), Bertha
Cook, 9802 Carlow, District 2 (4-30-85), and J. R. Spradling,
3302 Valley Brook, District 3 (4-30-85) to the Planning and
Zoning Commission. Second by Councilperson Malone. The motion
carried, 5 ayes, 2 nays and 2 abstain

7. Mayor Cline recommended the appointment of Paul Felgner to
the La Porte Ambulance Board.
A motion was made by Councilperson Matuszak to approve the
appointment of Paul Felgner, 10431 Collingswood, to the
La Porte Ambulance Board. Second by Councilperson Malone.
The motion carried, 9 ayes and 0 nays.

8. City Attorney Askins read: AN ORDINANCE APPOINTING THE
MEMBERS OF THE CITY OF LA PORTE AIRPORT ADVISORY COMMITTEE,
AND PROVIDING AN EFFECTIVE DATE HEREOF
A motion was made by Councilperson Skelton to approve and
adopt Ordinance No. 1324 as read by the City Attorney appointing
• Cliff Hyde, 10415 Rustic Gate, Chairman of the La Porte Air-
port Advisory Board; M. L. Miller, 301 South Idaho, as a member,
and H. L. Hartsoe as a member to serve until. April 30, 1985 or
until their successors are duly appointed. Second by Council-
person Westergren. The motion carried, 9 ayes and 0 nays.

9. City Attorney Askins read: AN ORDINANCE DESIGNATING THE OF-
FICIAL NEWSPAPER OF THE CITY OF LA PORTE, TEXAS, FOR THE TERM
MAY 1, 1982 UNTIL APRIL 30, 1985 AND PROVIDING AN EFFECTIVE
DATE HEREOF.
A motion was made by Councilperson Gay to approve and adopt
Ordinance No. 1325 as read by the City Attorney designating
the Bayshore Sun as the official City newspaper. Second by
Councilperson Malone. The motion carried, 9 ayes and 0 nays.

Pfeiffer, Gay, Skelton, Westergren and Mayor Cline

10. Council considered authorizing the City Attorney to dismiss
• the City of La Porte as a plaintiff in the lawsuit against
Harris-Galveston Coastal Subsidence District. After some
discussion, a motion was made to table this matter for further
consideration at a later date by Councilperson Westergren.

11. The City Attorney read: AN ORDINANCE AUTHORIZING THE CITY
SECRETARY OF THE CITY OF LA PORTE TO DESTROY CERTAIN REDEEMED
BONDS AND REDEEMED BOND INTEREST COUPONS; REQUIRING THE CITY
SECRETARY TO FILE A LIST OF THE REDEEMED BONDS AND REDEEMED
COUPONS SO DESTROYED; AND PROVIDING AN EFFECTIVE DATE IiEREOF
A_ motion was made by Councilperson Graves to approve and
adopt Ordinance No. 1326 as read by the City Attorney.
Second by Councilperson Malone. The motion carried, 9 ayes
and 0 nays.

12. Council considered the recommendation from Assistant Director
of Public- Works Gillett concerning bids received for an
"Engine Analyzer" for the garage. Bids were received from 5
vendors as follows:
Mitchell Tool Warehouse - $7,196.00
Automotive Equipment Brokers 5,615.90
Sun Electric 7,020.00
Sun Electric 3,996.00
Vasco Equipment Warehouse, Inc. 5,527.00
Autoscan Equipment Co., Inc. 5,677.95
A motion was made by Councilperson Gay to award the bid to
Sun Electric in the amount of $3,996.00 for Sun Model 1015
Engine Analyzer. Second by Councilperson Longley. The motion
carried, 9 ayes and 0 nays.

BY THE CITY; DETERMINING THE DATE, TIME AND LOCATION OF A
PUBLIC HEARING; AND CONTAINING OTHER PROVISIONS RELATING TO
THE SUBJECT
A motion was made by Councilperson Pfeiffer to approve and
adopt Resolution No. 82-7 as read by the City Attorney and
setting July 7, 1982, 7:00 P.M., as a date for Public Hearing
pursuant to the provisions of the Act and Chapter 107 of the
Rules for the purposes of establishing one or more eligib
blighted areas. Second by Councilperson Skelton. The motion
carried, 9 ayes and 0 nays.

14. The Council considered a recommendation from John Joerns,
Engineering Department, concerning the authorization by
Council to participate in the oversizing of an 8 inch to a
• 12 inch vaater line 6estinghouse Electric Corp. is prepared
to extend for some 2800 feet. This would be in keeping with
the plans to eventually complete a 12 inch outer loop along
Fairmont Parkway. The Westinghouse rate for water will be
12 times the normal rate.
A motion was made by Councilperson Matuszak authorizing the
expenditure of 15,000.00+ from the Water and Sewer Contingen
Fund to over size the 8" to 12" water line being extended by
T~7estinghouse Electric Corp. along Fairmont Parkway some 2800
feet. Second by Councilperson Malone. The motion carried,
9 ayes and 0 nays.

15. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING A PORTION OF NORTH G STREET; AND PROVIDING AN
EFFECTIVE DATE HEREOF
A motion was made by Councilperson Longley to approve and
adopt Ordinance No. 1327 as read by the City Attorney closing
that certain portion of North G Street between North 4th and
5th Streets. Second by Councilperson Westergren. The motion
carried, 9 ayes and 0 nays.

16. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING PORTIONS OF THE ALLEYS IN BLOCK SEVEN-A (7-A),
AND BLOCK SEVEN-D (7-D), NEBRASKA SYNDICATE SUBDIVISION, IN
THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS
A motion was made by Councilperson LVestergren to approve and
adopt Ordinance No. 1328 as read by the City Attorney vacati
and closing certain portions of the alley in Blocks 7-A and
7-D. Second by Councilperson Pfeiffer. The motion carried,
9 ayes and 0 nays.

17. The City Council considered authorizing re-bidding remaining
work on rehabilitation of sanitary sewer collection system
due to default by the original contractor.
Motion was made by Councilperson Skelton to table action on
this matter until the next regular meeting (June 16, 1982).

ayes and 0 nays.

18. Administrative Reports
City Manager Owen requested an executive session to discuss
a personnel matter
19. Council Action:
Councilperson Longley asked that a supply of the stick-on
seabulls be acquired to further the good public relations
they have inspired in the past.
Councilperson Matuszak called to the Public Works Department's
attention problems at the Catlett and Belfast outlets into
Big Island Slough on the west side next to the foot bridge.
He felt a danger to small children existed there.
Councilperson Gay requested an executive session to discuss
land acquisition.

20. The Council adjourned into executive session at 8:23 P.M.
Council returned to the Council table at 9:29 P.M.
A motion was made by Councilperson T~estergren to retain the
law firm of Sears and Burns to represent the City as Special
Counsel in the matters relating to the sanitary sewer rehab-
ilitation contract. Second by Councilperson Gay. The motion
carried, 9 ayes and 0 nays.

21. There being no further business to come before the Council,

require the City Council to designate an official newspaper for
the publication of legal notices.

AN ORDINANCE AUTHORIZING THE CITY SECRETARY OF THE CITY OF LA PORTS
TO DESTROY CERTAIN REDEEMED BONDS AND REDEEMED BOND INTEREST
COUPONS; REQUIRING THE CITY SECRETARY TO FILE A LIST OF THE RE-
DEEMED BONDS AND REDEE~SED_ COUPONS SO DESTROYED; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
Section 1. The City Secretary of the City of La Porte is
hereby authorized and directed to destroy all redeemed bonds
and redeemed bond interest coupons heretofore issued by the City
of La Porte, which have heretofore been paid by the City of
La Porte, in every case where a period of four years has elapsed
. since the date of payment. Said instruments shall be destroyed
by burning the same. '
Section 2. The City Secretary of the City of La Porte shall
file her certified statement with the permanent records of the
City of La Porte, itemizing the said redeemed bonds and redeemed
bond interest coupons, and the date of destruction of same.
Section 3. This Ordinance shall take effect and be in force
from and after its passage and approval.

SUBJECT: Engin Analyzer Bids
Bids have been received from five (5) vendors for an engine analyzer for the
Equipment Services Division. Attached is the bid tabulation sheet. Low bid
is from Sun Electric Company in the amount of THREE THOUSAND NINE HUNDRED NINETY
SIX DOLLARS ($3,996.00).
This machine will replace the analyzer now in use. The present machine will
only work on vehicles that do not have electronic ignition. This machine will
be used for tune ups, engine testing, and trouble shooting.
• Budgeted amount is THIRTEEN THOUSAND DOLLARS ($13,000.00). After testing several

A RESOLUTION AUTHORIZING PROVISION OF NOTICE TO THE TEXAS INDUS-
TRIAL COMMISSION AND PUBLICATION OF NOTICE 49ITH RESPECT TO A
PUBLIC HEARING TO CONSIDER DESIGNATION OF ONE OR MORE ELIGIBLE
BLIGHTED AREAS WITHIN THE CITY; DESCRIBING ONE OR MORE ELIGIBLE
BLIGHTED AREAS TO BE DESIGNATED BY THE CITY; DETERMINING THE
DATE, TIME AND LOCATION OF A PUBLIC HEARING; AND CONTAINING OTHER
PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, by resolution of the City Council (the "Governing
Body"), the City of La Porte (the "Unit"), authorized and approved
the creation of the City of La Porte Industrial Development
Corporation (the "Corporation") as a nonprofit industrial develop-
ment corporation under the provisions of the Development Corpor-
ation Act of 1979, Article 5190.6, Vernon's Annotated Texas Civil
Statutes, as amended (the "Act"); and
WHEREAS, the Corporation is authorized by the Act to issue
bonds on behalf of the Unit for the purpose of paying all or a
part of the costs of a "project" as defined in the Act, and to
lease or sell the project or to loan the proceeds of the bonds
• to finance all or part of the costs of a project; and
WHEREAS, the definition of "project" in the Act includes
the land, buildings, equipment, facilities and improvements (one
or more) found by the Board of Directors of the Corporation to
be required or suitable for the promotion of commercial develop-
ment and expansion and in furtherance of the public purposes of
the Act, or for use by commercial enterprises, all as defined
in the rules of the Texas Industrial Commission (the "Commission"),
irrespective of whether in existence or required to be acquired
or constructed thereafter, if such project is located in blighted
or economically depressed areas; and
PJHEREAS, as used in the Act, the term "blighted or economi-
cally depressed areas" means those areas and areas immediately
adjacent thereto within a city which by reason of the presence
of a substantial number of substandard, slum, deteriorated, or
deteriorating structures, or which suffer from a high relative
rate of unemployment, or which have been designated and included
in the tax incremental district created under Chapter 695, Acts
of the 66th Legislature, Regular Session, 1979 (Article 1066d,
Vernon's Texas Civil Statutes), or any combination of the fore-
going, the city finds and determines, after a hearing, substan-
tially impair or arrest the sound growth of the city, or consti-
tute an economic or social liability and are a menace to the
public health, safety or welfare in their present condition and
use; and

WHEREAS, the Act requires that a notice of a hearing at
which the city considers establishment of an economically depressed
or blighted area shall be posted at the city hall prior to such
hearing; and
'WHEREAS, Section 107.1(b)(9) of the rules (the "Rules") of
the Texas Industrial Commission (the "Commission") for industrial
projects sets out special rules for approval of commercial pro-
jects in blighted or economically depressed areas; and
WHEREAS, the governing body of the city desires to authorize
the financing of certain projects for commercial uses as provided
in the Act and the Rules by establishing one or more eligible
blighted areas;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE, THAT:
Section 1. A public hearing concerning designation of the
area(s) outlined in a heavy black line on the attached map of
the city as one or more eligible blighted areas, as defined in
• the Act and the Rules, shall be held in the City Council Chambers
at the City Hall, 604 W. Fairmont Parkway, La Porte, Texas, on
July 7, 1982, at 7:00 o'clock p.m., Central Daylight Savings
Time. Such public hearing shall be held pursuant to the provi-
sions of the Act and Chapter 107 of the Rules for the purposes
of establishing one or more eligible blighted areas.
Section 2. The City Secretary of the City is hereby author-
ized to notify the Commission of the intention of the City to
hold such public hearing by providing a certified copy of this
resolution to the Executive Director of the Commission not less
than fifteen (15) days prior to the date established for the
public hearing in Section 1 of this Resolution.
Section 3. Notice of the public hearing shall be published
once a week for two consecutive weeks in a newspaper of general
circulation in the City and notice of the public hearing shall
be posted at the City Hall at least fifteen (15) days prior to
the date of the public hearing. The notice as published and
posted shall contain a description of the area or areas to be
designated as an eligible blighted area (as shown on Exhibit "A"
hereto) and shall contain the date, time and location of the
public hearing.

Section 4. The notice as published and posted shall also
include the information shown on Exhibit "B" to this Resolution
with respect to the reasons for the designation by the City of
the eligible blighted area, the description of the overall objec-
tives of the City for redevelopment and recovery of the eligible
blighted area, a description of the type of projects for com-
mercial uses desired and authorized by the City to enhance its
redevelopment efforts in the eligible blighted area and a des-
cription of any exclusions or limitations by type or amount of
commercial uses which the City would consider detrimental to
its effort to redevelop the eligible blighted area.
Section 5. This Resolution is adopted for the purposes of
satis yang the conditions and requirements of the Act, and the
Rules, and for the benefit of the Corporation, the Unit, the
Commission, the residents of the Unit and all other interested
persons.
Section 6. The Governing Body has considered evidence of
the posting of notice of this meeting and officially finds,
determines, recites and declares that a sufficient written notice
• of the date, hour and place of this meeting and of the subject
of this Resolution was posted on the bulletin board at a place
convenient to the public in the City Hall of the Unit, for at
least seventy-two (72) hours preceding the scheduled time of
such meeting; such place of posting was readily accessible to
the general public at all times from such time of posting until
the scheduled time of such meeting; and such meeting was open
to the public as required by law at all times during which this
Resolution and the subject matter thereof were discussed, con-
sidered and formally acted upon, all as required by the Open
Meetings Law, Article 6252-17, Vernon's Annotated Texas Civil
Statutes, as arnended.

must meet all of the following conditions for the duration of
the bond financing:

economic feasibility analysis which
shows its economic viability.
(2) The project must increase the City's
tax base.
(3) The project must remove a blighted
. condition or create employment.
(4) The project must not contribute to
economic decline or blight in another
area.

GOALS AND OBJECTIVES FOR THE
ELIGIBLE BLIGHTED AREA
The following goals and objectives for the City's economi-
cally distressed areas will be applicable to the redevelopment
of the eligible blighted area in the use of IRB's. Generally,
the overall objectives are as follows:
(1) To promote the present and prospective health,
safety, rights to gainful employment and
general welfare of the people of the City
of La Porte and the State of Texas.
(2) To promote the continued existence, develop-
ment and expansion of commerce and industry
essential to the economic growth of the
• City of La Porte and the full employment,
welfare and prosperity of its citizens.
(3) To encourage the economic growth and stability
of the City by increasing and stabilizing
employment opportunities, significantly
increasing and stabilizing the property tax
base and promoting commerce within the City
and the State.
(4) To encourage employment of the inhabitants of
the EBA by encouraging employers to locate
projects which will employ such persons in or
adjacent to the EBA.

REASONS FOR THE DESIGNATION
The recommended area under consideration as an eligible
area for financing commercial projects with industrial revenue
bonds contains conditions of substantial blight and economic
distress.
In summary, the area has:
(1) A substantial number of substandard,
deteriorated and deteriorating structures.
(2) A substantial percentage of low/moderate
income residents; and
(3) A relatively high unemployment rate.
It also has City approved programs to address many of the
problems which cause blight and economic distress.

SUBJECT: Pa~ i pation in the Oversizing of an 8" to a 12" Line
LJes inghouse Electric Corp.
Westinghouse is developing a tract on Fairmont Parkway near the
intersection of Bay Area Blvd. Although the tract is in the Bayport
Industrial District, Westinghouse is prepared to extend approximately
2800 feet of 8" water main to-serve their needs. It is recommended
that the Council participate in the oversizing of an 8" to a 12" line.
This action would be in keeping with the plans to eventually complete
a 12" outer loop along Fairmont Parkway. Council has previously
participated in two similar oversizing requests along Fairmont Park~~aay
that will eventually become part of this outer loop. The approximate
cost of the oversizing is $15,000.00 which includes materials, installa-
tion, and the additional engineering fee. Westinghouse is aware that
. they are outside the City limits of La Porte and will have to pay 1 z
times the normal utility rate.
I recommend that the funds be taken from the Water & Sewer Contingency
Fund which has a balance of $169,000.00.

ORDINANCE NO. ~,~~ I
AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
NORTH G STREET; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has
been requested by the record owners of all of the property
abutting the hereinafter described portion of North G Street,
in the City of La Porte, to vacate, abandon, and permanently
close that portion of North G Street; and
WHEREAS, the City Council of the City of La Porte has
determined, and does hereby find, determine and declare that
the hereinafter described portion of North G Street is not
• suitable, needed, or beneficial to the public as a public
road or street, and that the closing of the hereinafter described
portion of North G Street is for the protection of the public
and for the public interest and benefit, and that the hereinafter
described portion of said North G Street should be vacated,
abandoned, and permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. 13,
Title 28, Art. 1175, of the Revised Civil Statues of the State
of Texas, 1925, the hereinafter described portion of North G
Street is hereby permanently vacated, abandoned, and closed by
• the City of La Porte, to-wit:
That portion of North G Street, lying
and being situated between Blocks 7-A
and 7-D, Nebraska Syndicate Subdivision
to the TOWN OF OF LA PORTE, Harris County,
Texas; and between the West right-of-way
line of North 4th Street and the East
right-of-way line of North 5th Street.
Section 2. The City Council officially finds, deter-
. mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the

City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas. Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this. ordinance and the subject
matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting
• thereof.
Section 3. This Ordinance shall take effect and be in
force from and after its passage and approval.

As you requested, we have inspected and appraised the above
mentioned properties.
• The objective of this appraisal is to appraise the property
for Market Value, which is defined as:
"The amount of money that a person desiring to sell
but not bound to do so, could, within a reasonable
time, procure for such property from a person who
desires and is able to buy, but is not bound to
purchase the property.
It is the amount that could be obtained at private
sale and not at a forced sale or auction sale."

THE ALLEYS IN BLOCK SEVEN-A (7-A), AND BLOCK SEVEN-D (7-D),
NEBRASKA SYNDICATE SUBDIVISION, TO THE TOWN OF LA PORTE, HARRIS
COUNTY, TEXAS.
WHEREAS, the hereinafter described portions of the alleys
in Block Seven-A (7-A), and Block Seven-D (7-D), of Nebraska
Syndicate Subdivision to the Town of La Porte have never been
opened or used as public thoroughfares, and the public utilities
now making use of such alleys have all given their written
consent for their closings; and
WHEREAS, the City Council of the City of La Porte has
f determined and does hereby find, determine and declare that
the hereinafter described portions of the said alleys are not
suitable, needed, or beneficial to the public as public alleys,
and should be vacated, abandoned and permanently closed;
NOW, THEREFORE, BE IT ORDAIidED BY THE CITY COUNCIL OF THE
