JULY 21, 1982
1. The meeting was called to order by Mayor Cline at 7:00 P.M.
Members of the City Council Present: Mayor Virginia Cline,
Councilpersons Norman Malone, John Longley, Edward Matuszak,
Kevin Graves, Lindsay Pfeiffer, Deotis Gay, B. Don Skelton,
Linda Westergren

2. The invocation was given by Councilperson Skelton.
3. The Council consdiered the minutes of the Regular Meeting of
the La Porte City Council held July 7, 1982.
A motion was made by Councilperson Longley to approve and
adopt the minutes as presented. Second by Councilperson
Malone. The motion carried, 9 ayes and 0 nays.

4. Mayor Cline opened a public hearing to hear citizen recom-
mendations for the use of General Revenue Sharing Funds for
fiscal year 1982-83. City Manager Jack Owen stated the anti-
cipated amount of $384,653.61 would be budgeted for fiscal
• year 82-83.

Lou Lawler - 1400 North 10th - appeared as the Civic Affairs
Chairman of the La Porte-Bayshore Chamber of Commerce.
Lawler requested Council to consider $15,000.00 being set
aside for the "La Porte Beautification Program." This pro-
gram includes entry signs at the City limits and landscaping
for the major entryways of the City. Lawler further re-
quested the Council to remember the new Christmas lighting
started in 1981 and set aside $5,000.00 for continuing that
program.
Susan Hodgson of the Baytown Area Women's Center appeared
before Council requesting $6,600.00 be set aside to support
the Center. Hodgson gave a brief review of the Center's
function.
There being no further response to the Mayor's call for
citizen input, the public hearing was closed at 7:15 P.M.
5. City Attorney Askins requested an executive session at this
time to discuss a legal matter with the Council.
Motion was made by Councilperson Skelton to adjourn into
executive session. Second by Counci person Matuszak. The
motion carried, 9 ayes and 0 nays.

6. Council considered re-bidding the remaining work on the
rehabilitation of the sanitary sewer collection system.
A motion was made by Councilperson Matuszak to authorize the
re-bidding of the remaining sanitary sewer rehabilitation
work. Second by Councilperson Gay. The motion carried, 9
ayes and 0 nays.

Mayor Cline asked for a brief break in the agenda that she
might recognize two citizens who had returned for a visit to
La Porte. They are presently making their home in London,

with a seagull pin, the City logo.

7. Council considered the appointments to the La Porte Electrical
Board. Mayor Cline read the recommendations:
Walter Gernand - representative from HL&P
Knox Askins - Legal representative
David Paulissen - Code Enforcement
Lindsay Pfeiffer - Elected representative
Gene Pfeiffer - Master electrician
C. E. Brown - Master electrician
A motion was made by Councilperson Westergren to approve the
appointments presented by Mayor Cline for the La Porte Elec-
trical Board. Second by Councilperson Skelton. The motion
carriedr 9 ayes and 0 nays.

8. Mr. Bill Fleener appeared before Council to make a presenta-
• tion for sanitary sewer service from the Fairmont Park sewer
plant to property he proposes to develop east of College View
Municipal Utility District. After some discussion Mayor
Cline asked Council approval to refer Fleener's proposal to
a workshop meeting. The City Secretary was directed to place
this item on an emergency adendum for the July 26 workshop.
9. The City Attorney read: A RESOLUTION OF THE CITY OF LA PORTE,
TEXAS, RATIFYING AND AUTHORIZING ITS PARTICIPATION IN THE
COALITION OF CITIES WITH ORIGINAL JURISDICTION TO INCLUDE DATA
SHARING AND INTERVENTION WITH SAID COALITION IN THE HL&P RATE
REQUEST.

10. The Council considered a recommendation by John Joerns and
Jerry Hodge putting a moratorium on the installation of culvert

11. Council considered that Jack Owen, City Manager, will complete
six months of service with the City of La Porte on July 25, 1982.
A motion was made by Councilperson Longley authorizing a
$4,000.00 per year increase in salary to take effect August 2,
1982. Second by Councilperson Westergren. The motion carried,
9 ayes and 0 nays.

12. City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 1100, AN ORDINANCE REGULATING GAME ROOMS, PROVIDING
LICENSING PROCEDURES AND FEES, REGISTERING OF SKILL OR
PLEASURE ORIENTED COIN OPERATED MACHINES AND PAYMENT OF OC-
CUPATIONAL TAX THEREON, REGULATING HOURS OF OPERATION, PRO-
VIDING STANDARDS FOR OPERATION, PROVIDING THAT ANY PERSON
VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY
OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY
SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); CONTAINING
A SEVERABILITY CLAUSE; FINDING COMPLIANCE T/~IITH THE OPEN
MEETING LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.

13. The Council considered the recommendation from Chief Inspector
David Paulissen concerning bids received for the demolition
of dangerous buildings. Bids received were as follows:

Paulissen recommended the bid be awarded to Daniels Truck
Hauling.
A motion was made by Councilperson Longley to award the bid
for the demolition of certain dangerous buildings to Daniels
Truck Hauling. Second by Councilperson Westergren. The
motion carried, 9 ayes and 0 nays.

14. Council considered John Joerns' recommendation that Lockwood,
Andrews and Newnam, Inc., be retained by the City of La Porte
to evaluate the proposed Southern Pacific Development.
A motion was made by Councilperson Westergren to retain the
firm of Lockwood, Andrews and Newnam, Inc., to evaluate the
rezoning request by Southern Pacific and appropriating
X20,000.00 from the General Fund Contingency. Second by
Councilperson Skelton. The motion carried, 9 ayes and 0 nays.

15. There were no administrative reports.
16. Council Action:
Councilperson Skelton requested an executive session on a
personnel matter.
17. Mayor Cline entertained a motion for executive session.
Motion was made by Pfeiffer, second by Malone. The Council
adjourned into executive session at 8:23 P.M. Council re-
turned to the Council table at 8:37 P.M.
18. There being no further business to be brought before the
Council, the meeting was duly adjourned at 8:40 P.M.

SUBJECT: Revenue Sharing Act
Within the administrative provisions of the Revenue Sharing Act
there are two significant requirements which all cities must abide
by. The first is a procedure outlining and establishing public
hearings on the proposed use of the funds and adoption of the funds
into a budget format. The second requirement is on reporting.
In accomplishing the first requirement, the City is responsible
for publishing a notice, in at least one newspaper of general circu-
lation, proposing a use hearing for public input. (see attachment)
This meeting is solely to provide the citizens of La Porte an
opportunity to provide written and oral comments on the possible
uses of such funds before the City Council. It should be noted that
Revenue Sharing funds are not government funds which have been
encumbered to remedy problem areas, but funds which are allocated to
cities for expenditures as determined by the respective City Council.
The City is then required to have a second public hearing. This
hearing will be for discussing and adopting a Revenue Sharing Budget.
At this hearing citizens shall have the opportunity to provide
written and oral comments to the City Council and to ask questions
• concerning the entire Revenue Sharing Budget and its relation to
budget line items. This meeting is scheduled for September 1, 1982.
Within thirty (30) days after adoption of the Revenue Sharing
Budget, the City will then publish„ in at least one newspaper of
general circulation, a notice of the availability for inspection of
the adopted Revenue Sharing Budget.
At the close of the fiscal year, the City is responsible for
submitting a report to the federal government setting forth the
amounts and purposes for which Revenue Sharing funds have been
appropriated, spent or obligated for the fiscal year received. The
report will also identify differences between the actual use of
funds received and the proposed use of such funds.

A RESOLUTION OF THE CITY OF LA PORTE, TEXAS, RATIFYING AND
AUTHORIZING ITS PARTICIPATION IN THE COALITION OF CITIES
WITH ORIGINAL JURISDICTION TO INCLUDE DATA SHARING AND INTER-
VENTION WITH SAID~OALITION IN THE HL&P RRTEUEST, DOCKET
N0. 4540, BEFORE E TEXAS PUBLIC UTILITIES ISSION.
WHEREAS, on June 16, 1982, the Houston Lighting and Power
Company (HL&P) f~d a Statement of Intent t~change its rates
for electric service within the City of La Porte, Texas, and
throughout its service area and has requested that said changes
• become effective on July 22, 1982; and
6JHEREAS, the Public Utilities Commission of Texas has
original jurisdiction over said rate request within the unin-
corporated areas of the service area; and
WHEREAS, the City of La Porte, Texas, has original juris-
diction over said rate request within its corporate limits; and,
Tr7HEREAS, the complexities of the issues and the magnitude
of the requested rate increase requires extensive study, data
and analysis for the City to responsibly exercise its original
jurisdiction and protect the general welfare of all ratepayers;
residential, commercial and industrial; within its boundaries;
and,
WHEREAS, historical precedent has shown that the system-
. wide rate imposed under current procedures before the PUC results
in the virtual nullification of City Council action and eliminates
any meaningful impact of the City's exercise of its legislated
original jurisdiction on the rate-making process; and,
WHEREAS, the City of La Porte, Texas, desires to cooperate
in a joint effort with other cities with original jurisdiction
to provide for adequate analysis of the issues raised by the
rate change request and to establish or restore real authority
and a genuine impact on the rate setting process to municipalities
with original jurisdiction; and,

WHEREAS, the City of La Porte, Texas, has taken appropriate
steps, including the suspension of the requested rate increase by
Ordinance No. 1331 adopted on the 7th day of July, 1982, to exer-
cise its original jurisdiction and to participate in the inter-
vention in the unincorporated areas rate-setting process before
the PUC (Docket No. 4540) filed by the Coalition of Cities with
Original Jurisdiction;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
• THE CITY OF LA PORTE, TEXAS:
THAT the City Council of the City of La Porte, Texas, hereby
ratifies and authorizes the full participation of the City of
La Porte, Texas, in the Coalition of Cities with Original Juris-
diction, to include data and analysis sharing and intervention as
a member city with the Coalition in the HL&P Rate Change Appli-
cation, Docket No. 4540, now pending before the Texas Public
Utilities Commission.

In the past, the City has allowed residents to install culverts across
entire property frontages. This work was performed by City crews, with the
citizen paying for material. There are several problems associated with this
practice.
The primary problem is maintenance. These culverts must be kept clean to
maintain flow and long runs of pipe are difficult to clean, especially if
objects are lodged inside. In addition, they are difficult to inspect for
obstructions and shifts in grade. If resetting the culverts becomes necessary
due to shifting or if it is determined that the culverts need lowered and/or
• sized larger, this requires digging up what the resident Holy considers part
of his yard, with the additional expense of clean up and landscaping.
Another problem associated with this practice is capacity. With a heavy
rain, once the water level fills the pipe, any additional water has nowhere to
go, and overflows upstream. This delays runoff, and could result in upstream
flooding.
It is recommended that the City declare a moratorium on this practice, with
the exception of commercial development. This moratorium ~vill prevent installation
of long runs of culvert which may soon require readjustment due to our ongoing
drainage maintenance program. The staff recommends that the moratorium remain in
effect until a specific and comprehensive drainage policy can be formulated by
staff for Council approval.

of the City of La Porte is hereby amended, to hereafter read

Section 2. If any section, sentence, phrase, clause, or

any part of any section, sentence, phrase, or clause, of this
ordinance shall, for any reason, be held invalid, such invalidity
shall not affect the remaining portions of this Ordinance, and
it is hereby declared to be the intention of this City Council
to have passed each section, sentence, phrase or clause, or
part thereof, irrespective of the fact that any other section,
sentence, phrase or clause, or part thereof, may be declared
invalid.
Section 3. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public at
the City Hall of the City for the time required by law preceding
this meeting, as required by the Open P~Ieetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The
City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 4. Any person, as defined :in Section 1.07(27),
Texas Penal Code, who shall violate any provision of the
ordinance, shall be deemed guilty of a misdemeanor and upon
conviction shall be punished by a fine not to exceed Two Hundred
Dollars ($200.00).
Section 5. This Ordinance shall be effective fourteen
(14) days after its passage and approval. The City Secretary
shall give notice of the passage of this ordinance by causing

the caption hereof to be published in the official newspaper
in the City of La Porte at least twice within ten (10) days
after the passage of this ordinance.

SUBJECT: Cq ~ultant Selection for Proposed Southern Pacific Development

On Tuesday, July 13th, proposals were received in response to the
City's request for proposal to evaluate a request by Southern Pacific
Railroad Company to develop a storage yard, and a rail-served complex
of warehouses, service centers, and offices. The firms submitting
proposals were:
(1) Carter & Burgess, Inc.
(2) Environmental Planning & Design
(3) Lockwood, Andrews & Ne~,vnam, Inc.
(4) Turner Collie & Braden, Inc.
Although each of the firms appear to be quite capable, I felt that
• the proposal submitted by Lockwood, Andrews & Newnam, Inc. presented the
best detailed approach to the project. In addition, Lockwood, Andrews
& Newnam, Inc.'s list of past project experience included some activities
very similar to the scope outlined in our proposal. Lockwood, Andrews
& Ne~vnam, Inc. has indicated that the study can be completed within the
strict time frame outlined by the City. The budget proposed by Lockwood,
Andrews & Newnam, Inc. to perform the scope of work as outlined is
$20,000.00. The actual fee, however, will depend on the final scope of
services as negotiated by the City of La Porte and the Consultant.
I recommend that Lockwood, Andrews & Newnam, Inc. be retained by
the City of La Porte to evaluate the proposed Southern Pacific Develop-
ment. The recommended source of funds is the General Fund Contingency
which has a fund balance of $ 321,000.00

items and has met the insurance requirements. I ~oould respectfully recommend
the award of this demolition contract to Daniels Dump Truck Hauling in the
