The invocation was given by City Attorney Askins. 3. The Council considered the minutes of the Regular Meeting of La Porte City Council held September 15, 1982. A motion was made by Councilperson Pfeiffer to accept and approve the minutes as presented. Second by Councilperson Gay. The m to ion carried, 6 ayes and 0 nays. Ayes: Councilpersons Longley, Matuszak, Graves, Pfeiffer, Gay and Mayor Cline Nays: None 4. Mayor Cline recognized the Public Works Employee of the month. 5. The engineering firm of Busch, Hutchison, Inc., opened and read bids received on the Sanitary Sewer Rehabilitation Project. Bids received were as follows: Shur-Flo, Inc. $985,675. Channel Constru ction Co., Inc. 982,436. Jesse Lovelace Const. Co. 755,6.45. Mar Len, Inc. 659,085. • Reliance Const. Co. 552,392. McCullough Asso c., Inc. 561,690. Co., Inc. 620,705. • • Minutes, Regular Meeting, La Porte City Council October 6, 1982, Page 2 Dave Corbin of Busch, Hutchison, advised Council the bids would be tabulated and a recommendation presented for Council consideration at the October 20 Council meeting. 6. b1r. Ebarb was not present. Councilperson Malone was seated at the Council table at 7:20 P.M. 7. Mark Schiavone, General Manager of the La Porte office for Kip-Lee Cable Television, Inc., spoke to the Council con- cerning five new programming services being added to the basic package: Cable channels 14, 15, 19, 28 and 29. He answered questions about service and gave the Council a new service number for the La Porte area - 470-2663. Schiavone asked Council to approve realignment of local VHF channels 2, 8, 11 and 13 to place them on 4, 11, 5 and 10, respectively, in order to improve reception on these channels. A motion was made by Councilperson Graves to authorize re- • alignment of local VHF channels 2, 8, 11 and 13 and place them on 4, 11, 5 and 10, respectively, .there y waiving Section 13, Paragraph H, of Ordinance 1175 of t e City of La Porte in order to improve t e reception on t ese signifi- cantly viewed local stations. Council considered three (3) different group insurance plans submitted by Ken Strum Insurance Agency, Inc., to be carried by Business Men's Assurance. After reviewing all plans as presented, a motion was made by Councilperson Matuszak to purchase plan III with a prior-needs clause and a 30-day waiting period for all new employees. Second by Councilperson Pfeiffer. The motion carried, 7 ayes and 0 nays. II Time 52,778.75 40,102.75 30 days 58,603.50 51,963.50 90 days 69,870.00 58,516.24 20 days After reviewing the recommendation of Stan Sherwood, Parks Department, and John Joerns, Engineering Department, a motion was made by Councilperson Matuszak to award the bid to Shirley Construction Company, Inc., in the amount of 52,778.75 to be paid as per P.O. # 17829, from Account No. 800-702 as appears in the 1981-82 Budget. Second by Councilperson Graves. T e motion carried, 7 ayes and 0 nays. Ayes: Councilpersons Malone, Longley, Matuszak, Graves, Pfeiffer, Gay and Mayor Cline Nays: None • 11. Council reviewed inspection forms and other information for fifteen (15) dangerous buildings. Each of the buildings is found to be dangerous to the residents of the surrounding neighborhood and a threat to the health, safety and well- being of the citizens of La Porte by the Board of Inspection (Mark Lewis, Certified Inspector; Joe Sease, Fire Chief; and Paul Hickenbottom, Fire Marshal). Administrative Reports: City Manager Owen reported Bob Herrera has been gathering truck ordinances from all over the state for Council's review. Owen brought Council up to date on the computer study and the solid waste study. Councilperson Matuszak stated the Green Belt Committee would meet Thursday at 4:15 in the Conference Room at City Hall and that the proposed ordinance would. be ready for review by Council at the October 11 workshop. City Attorney Askins informed the Council he is preparing a calendar to be considered for the Annexation Committee. City Secretary Waters stated a first draft Solicitors Ordi- nance is in the hands of the two other committee members and • she is waiting for their critique before making a final draft of the proposed ordinance to be presented to Council. • • Minutes, Regular Meeting, La Porte City Council October 6, Page 5 13. Council Action: Councilperson Longley requested an executive session on personnel. Councilperson Matuszak asked that Public Works check the break-up of the concrete at Valley Brook and Spencer. 14. A motion was made by Councilperson Longley, seconded by Councilperson Malone, to adjourn into executive session at 7:59 P.M. Motion carried. Council returned to the Council table at 8:50 P.M. 15. Fairmont LaPorte, Texas 77571 In our continuing efforts to improve your Cable Television service in LaPorte, Kip-Lee has added five new programming services to your channel lineup: Cable Channel 14 15 19 28 29 Progra:r~ming Cable Health Network PTL Network Daytime Satellite News Channel WOR - New York In addition to adding these services, Kip-Lee proposes to realign the cable lineup in order to better serve the public. (Please see attached lineup). This realignment would take the local V. H. F. channels 2, 8, 11, and 13 and place them on 4, 11, 5, and 10 respectively The phenomenon of direct pickup interference that plagues local channels 2, 8, 11 and 13 has caused poor reception for subscribers that do not'have-.a converter. Moving significantly viewed local stations 2, 8, 11, and 13 to other channel carriage that do not experience this difficulity will increase public satisfaction. This change will only rearrange the current lineup, no channels will be dropped oz moved out of the Basic Service. In order to make this improvement Kip-Lee Cable Television asks the council for a waiver of Section 13, Paragraph H, contained in ordinance 1175. "Further, the channel selector of the converter shall be numbered so that grantee may carry all relevant over-the-air television signals on the channel number o~ the station. City Commission may waive :the requirement of this section if it is technically infeasible." Although this requirement is feasible, we believe this channel realignment will lead to greater public satisfaction and therefore ask your assistance on this matter. SUBJECT: Bid Opening Project 80-8; Little Cedar Bayou Park Improvements On Friday, September 24, at 4 p.m. bids vrere opened on the proposed improvements to Little Cedar Bayou Park. The improvements include installation of approximately 500 L.F. of storm sewer, construction of one junction box, and earthwork. This construction will allow the City to reclaim usable park space from the open ditch outfall constructed by the developers of Garden t4alk Townhomes. After revieaving the bids staff recommends that a contract for the work described in Alternate I be awarded to Shirley Construction Company in the amount of $52,778.75. Alternate I is recommended because the City would not be able to .purchase the needed fill material and monitor the borrow source ,_ Cheaper- .than the ._$2,676. I responded from my residence at or about 7:30 A.M. on 8-20-82 and arrived at or about 7:35 A.M. the same date. 212 showed me the storage shed and I noticed a small fire had been started near the entrance. __ It is the opinion o f this officer that the fire was accidental in nature, possible started by children playing with matches. It is the recommendation of this officer thaw the storage shed and the burnt house on this property should be considered by the building dept. as being dangerous and demolished.
