Members of the City Council Present: Mayor Virginia Cline, Councilpersons John Longley, Edward Matuszak, Kevin Graves, Lindsay Pfeiffer, Deotis Gay, Don Skelton, Linda Westergren Members of the City Council Absent: Councilperson Norman Malone Members of the City Staff Present: City Manager Jack Owen, City Attorney Knox Askins, City Secretary Betty Waters, Director of Administrative Services Bob Herrera, Assistant Director of Public Works Steve Gillett, Chief Inspector David Paulissen, Chief Accountant Dortha Gray., Code Enforce- ment inspectors Lamar Hollaway, Ervin Griffith, and Mark • Lewis, Accounting personnel Betty Whitten, Judy Mathews and Nell Lange. Others Present: Four representatives of the press, 12 interested citizens, and Representative Ed Watson 2. The invocation was given by City Attorney Askins 3. The Council considered the minutes of the Regular Meeting of the La Porte City Council held October 6, 1982. A motion was made by Councilperson Matuszak to accept and approve the minutes as presented. Second by Councilperson Gay. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Westergren, Longley, Matuszak, Graves, Pfeiffer, Gay, Skelton and Mayor Cline Nays: None 4. Mayor Cline recognized the Accounting Department of the City for their outstanding efforts in obtaining the International Institute of Municipal Accounting`s highest award, the "Certificate of Conformance." Those representing the Ac- counting Department were Chief Accountant Dortha Gray and members of her staff, Betty Whitten, Judy Mathews and Nell • Lange. • • • Minutes, Regular Meeting, La Porte City Council October 20, 1982, Page 2 5. Mayor Cline extended special recognition to the Code Enforcement Department for their outstanding efforts to make La Porte a better place to live. Mayor Cline con- gratulated David Paulissen for having the only such de- partment in the State of Texas where all inspectors are State certified. A certificate of appreciation was pre- sented to the department. 6. Mayor Cline named the Public ~nlorks Employee of the Month, Larry Wright and thanked him for his efforts to do his best job for the City. 7. A letter was read from Busch, Hutchison & Associates in reference to the bids received on the Sewer Rehabilitation Project No. C-481176-03-0. They stated the apparent low bidder was Reliance Construction, Inc., in the amount of $552,392.50. They are in the process of checking the background and references at this time, and are not pre- pared to make a recommendation. 8. Council considered the recommendation by Graduate Engineer • John Joerns for the City to participate in the oversizing of a sanitary sewer line extension to service Kindercare on Myrtle Creek Road. The City's cost to increase from 6" to 8" would be $709.10. A motion was made by Councilperson Skelton to authorize the oversizing of the sanitary sewer line to service Kinder- care on Myrtle Cree Road from a 6" to an 8" line. The amount of 709.10 to be paid from the T~ater and Sewer Improve- ment Fund. Second by Councilperson Matuszak. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Westergren, Longley, Matuszak, Graves, Pfeiffer, Gay, Skelton and Mayor Cline Nays: None 9. Council considered the sale of the frame building, formerly the City of La Porte Public Works office building located at 404 West Fairmont Parkway, containing four (4) rooms and a bathroom. The Bill of Sale was read by the City Attorney. Second by Councilperson Matuszak. Mayor Cline asked for recommendations for appointments to the H-GAC 1983 General Assembly. Councilperson Longley placed the name of Councilperson Don Skelton before the Council for consideration. Councilperson Matuszak placed the name of Mayor Virginia Cline as 1983 alternate. Motion was made by Councilperson Longley that Councilperson Skelton be appointed as the 1983 H-GAC General Assembly Representative with Mayor Virginia Cline appointed alternate. Second by Councilperson Westergren. T e motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Westergren, Longley, Matuszak, Graves, Pfeiffer, Gay, Skelton and Mayor Cline. • Nays: None 11. City Attorney Askins read: A RESOLUTION AUTHORIZING THE CITY OF LA PORTE TO BORROW THE SUM OF THIRTY THOUSAND EIGHT HUNDRED SIXTEEN DOLLARS AND TWENTY-NINE CENTS ($30,816.29), TO BE EVIDENCED BY A TAX ANTICIPATION NOTE, PAYABLE OUT OF CURRENT TAXES COLLECTED DURING THE FISCAL YEAR BEGINNING OCTOBER 1, 1982, AND ENDING SEPTEMBER 30, 1983 A motion was made by Councilperson Skelton to accept and approve Resolution No. 82-18 as read by the City Attorney. City Attorney Askins read: AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE NO. 915, "PIPELINE TRANS- PORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PO RTE, TEXAS; AND APPROVING THE APPLICA- TION OF SEAGULL PRODUCTS PIPELINE COMPANY, TO CONSTRUCT A SIX-INCH (6") PROPYLENE PIPELINE; AND PROVIDING AN EFFECTIVE DATE HEREOF. • A motion was made by Councilperson Gay to approve and adopt Ordinance No. 915-R as read by the City Attorney. Second by Councilperson Graves. Councilperson Matuszak presented a complaint he had received from a citizen concerning the dirty wind sock at the airport. City Manager Owen stated he felt he could take care of the dirty sock. Councilperson Skelton gave an update report on actions of the TML Legislative Committee. 16. No executive session was required. 17. There being no further business to be brought before the Council, the meeting was duly adjourned at 7:35 P.M. Mr. Wright has been in the Solid Waste Division eight (8) months. In this short amount of time Larry has had a variety of jabs. He has held the positions of welders helper, brushpicker driver, and is presently the commercial mack driver. In all of these positions, Larry has put out remendous amounts of effort to be the best at his job. On one instance, Larry brought a can of car wax to the job and completely waxed the entire cab of the brushpicker. Mr. Wright has shown that whatever job he may encounter, he will give it his best. He is very dependable, hard working, and cares about his job, the City, as well as his fellow peers. Larry also worked two (2) Saturdays in the 1982 May clean-up campaign, and I must add, he worked very hard. As Larry's superintendent, I feel that he is a big asset to the Solidwaste Division, and to the City of La Porte. • • r~ • CITY OF LA PORTE INTER-OFFICE MEMORANDUM • To: Betty Waters - City Secretary FR01: John Joerns - Engineering Dept. SUBJECT: Sanitary Sewer Extension Kindercare - Myrtle Creek Road DATE: October 7, 1982 The facility needs only a 6" sewer line; however, the staff recommends that the City participate in the oversizing of the 6" to an 8" sanitary sewer. The 8" sanitary sewer is recommended because of the commercial zoning and the potential high volume users. H-GAC's Bylaws provide that each member home rule city with less than 25,000 population according to the official 1980 U. S. Census is entitled to designate one representative and one alternate to the H-GAC General Assembly, which will meet in mid-January. I am enclosing the appropriate form for your use in officially desig- nating a representative and alternate. The designees must be elected official members of your city's governing body (Bylaws attached). A dinner meeting of home rule city representatives is tentatively sched- uled for November 18th. Details of this meeting will be sent to you when the arrangements have been completed. At that meeting your 1982 H-GAC Board representatives will report on this year's activities, and look ahead to issues and progress of 1983. Your attendance and participation in this meeting is particularly valuable, since it gives your representatives and the H-GAC staff insight on your wishes and needs. The main business item for the meeting will be selection of two representatives to serve as 1983 members of the H-GAC Board of Directors (Bylaws attached). An agenda for the dinner meeting will be forwarded to your representatives as soon as we have received your official designations. PlHEREAS, it has been determined by the City Council of the City of La Porte (hereinafter "City"), that a necessity exists to borrow not to exceed the sum of THIRTY THOUSAND EIGHT HUNDRED SIXTEEN DOLLARS AND TWENTY-NINE CENTS ($30,816.29), for payiilent of lawful • expenses of the City, and that the anticipated current revenue from ad valorem taxes for fiscal year 1982-1983 will amount to far in excess of Thirty Thousand Eight Hundred Sixteen Dollars and Twenty- nine Cents ($30,816.29); and WHEREAS, Bayshore National Bank of La Porte, Texas, has agreed to make the City a loan in said sum, to be paid with seven and one- half per cent (7-1/2%) interest per annum thereon, on or before the 30th day of September, 1983; and WHEREAS, the City will have current revenue from ttie collection of said taxes, together with existing cash on deposit, available and sufficient to pay said obligation at maturity; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY •OF LA PORTS, that the Mayor be authorized to issue a promissory note of the City (a true and correct copy of which is attached hereto as Exhibit "A", incorporated by reference herein, and made a part hereof for all purposes), to be designated "Tax Anticipation Note for the Fiscal Year Beginning October 1, 1982, Ending September 30, 1983," such note to be in the principal sum of Thirty Thousand Eight Hundred .Sixteen Dollars and Twenty-nine Cents ($30,816.29), to bear interest at the rate of seven and one-half per cent (7-1/2%) per annum until maturity, providing for ten per cent (10%) per annum interest on /-/ • • • -2- matured unpaid principal and interest from date of maturity until paid, and ten per cent (100) attorney's fees, such note to be due and payable on or before the 30th day of September, 1983; and that said note be sold by the City to Bayshore National Bank of La Porte, Texas, at not less than par value. When such note has been duly executed by the Mayor, and attested by the City Secretary, and delivered to said Bank, with a certified copy of this Resolution, such indebtedness thereby evidenced shall be fully binding upon the • City; and BE IT FURTHER RESOLVED that the City hereby appropriates and sets aside the sum of Thirty Thousand Eight Hundred Sixteen Dollars and Twenty-nine Cents ($30,816.29) out of the current revenues from the collection of ad valorem taxes, and cash on deposit, for the payment of such indebtedness. BE IT FURTHER RESOLVED, the City Council of the City of La Porte officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council of the City of La Porte was posted at a place convenient to the public at the City Hall, City of La Porte, La Porte, Texas, for the time required by law preceding this meeting, as required •by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated, and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The 8" line will carry ethylene at a maximum pressure of 2160 PSI and a maximum temperature of 60° F. The 6" line will carry propylene at a maximum pressure of 2160 PSI and a maximum temperature of 60° F. All lines will be bored and cased at depths shown on the accompanying profile drawings. Construction is scheduled to begin around Nov.10, 1982. • Enclosed with this application are two (2) copies of a map of La Porte, showing the route of the line, and copies of drawings and pro- files depicting the street crossings.
