REGULAR MEETING OF THE LA PORTE CITY COUNCIL
NOVEMBER 3, 1982
1. Meeting called to order by Mayor Cline at 7:00 P.M.
Members of the City Council Present: Mayor Virginia Cline,
Councilpersons Norman Malone, John Longley, Ed Matuszak,

Linda Westergren

The invocation was given by Councilperson Skelton
3.
Mayor Cline proclaimed "National Youth Week," "National
School Appreciation Day" and "Teacher Appreciation Day"
4.
Mayor Cline called for anyone present wishing to speak con-
cerning 16 dangerous buildings and she read the following:

1. Outlot 250, West 100 ft. - E. D. Wiggle
m. Part Tract #44 - E. Brinson Survey - Carroll A. Lewis
are down and recommended the ordinance be pulled.
Mrs. W. B. Henderson of Ft. Worth appeared before Council to
request at least 6 weeks or maybe 8 weeks before any action
is taken to remove the building on Lot 5, Block 2. The
Inspection Department reported it would be about that long
before they could get to it if they put it at the end of the
list. This met with Council approval.
Mr. George Merritt requested additional time to remove the
building at Lot 20-21, Block 26, since he was late receiving
his notice. He had not changed the property into his name
and the former owner had received his notice. Council agreed
to work with him but recommended he proceed at once.
There being no other request to be heard, the public hearing
was closed.
5. Council considered the minutes of the Regular Meeting of the
La Porte City Council held October 6, 1982. A motion was
made by Councilperson Pfeiffer to approve and accept the
minutes as presented., Second by Councilperson Westergren.
The motion carried, 9 ayes and 0 nays.
Ayes: Councilpersons Malone, Longley, Matuszak, Graves,
pfeiffer, Gay, Skelton, Westergren and Mayor Cline
Nays: None
6. The City Manager presented for Council's consideration and
approval of an item exceeding the required amount for bids,
Christmas decorations for the streets. In order to match
last year's purchase, it was recommended that authorization
be given to purchase matching street decorations from the .
Valley Decorating Company, not to exceed $5,OOOrOO.A motion
was made by Councilperson Longley to authorize purchase of a
one source item, Christmas decorations for the streets to ..
match those purchased last year, from the Valley Decorating
Company, not to exceed $5,000.00. Second by CouncilpersQn
Graves. The motion carried, 8 ayes and 1 nay.

7. It was brought to Council's attention the Police Department
has accumulated numerous bicycles and they are running out
of storage room. Lt. LaFitte requested an auction be authorized
to accomplish two purposes: (1) to provide an opportunity for
some child to get a bicycle for Christmas and (2) to provide
room in the Police storage area.
A motion was made by Councilperson Graves to hold a bicycle
auction Saturday, December 4, 1982, at 10:00 A.M., in the
I. J. Kibodeaux Service Center yard. Second by Counci1person
Matuszak. The motion carried, 9 ayes and 0 nays.

Pfeiffer, Gay, Skelton, Westergren and Mayor Cline

Mayor Cline stated than an oppontunity would be given prior
to the auction for anyone to properly identify their bicycle
to the satisfaction of the Police Chief.
8.
Council considered the recommendation of Parks Director
Stan Sherwood concerning the renovating of the La Porte Muni-
cipal Swimming Pool. After some discussion concerning the
amount of the bid and local availability, a motion was made
by Councilperson Matuszak to table this matter until the next
regular meeting to give Sherwood time to check with local
establishments on this job. Second by Councilperson Wester-
gren. The motion carried, 9 ayes and 0 nays.

10. Administrative Reports:
City Manager Owen reminded Council of the November 8, 1982,
workshop at 7:00 P.M. to review the final report from L.A.N.
on the Southern Pacific request for rezoning.
Owen stated the solid waste study is proceding on course. The
computer study is complete and proposals will be in on the
19th of November. The aid conditioning study was received today
and staff has not had time to review it.
Mr. Owen requested an executive session on a personnel matter.
11.
Council Action:
Counci1person Matuszak gave a report on the Texas Municipal
League Conference in Ft. Worth
Counci1person Graves requested an executive session on a
legal matter.
Counci1person Pfeiffer requested staff to check on the traffic
lights at 5 Points to see if they could be put back on demand
in order to move traffic a bit better.
Counci1person Skelton discussed several complaints he has
received concerning the ditch on Park at Garfield.
Counci1person Westergren asked that the City proceed with the
renaming of the North Side Civic Center to the "Jennie Riley
Civic Center."
12. Mayor Cline adjourned the meeting at 8:20 P.M. into executive
session.
The Council returned to the Council table at 9:03 P.M.
13. There being no further business to come before the Council,
the meeting was duly adjourned at 9:04 P.M.

SUBJECT: Christmas Decorations
Please see attached memo from Jackson Ray, Purchasing Agent.
The City purchased Christmas decorations last year as a means of showing
Community Christmas Spirit. The decorations were purchased from the Valley
Decorating Company and recognized as a sole source vendor.
.
In this year's budget, 1982-1983, apprpximately five thousand dollars was
funded for the purpose of buying additional matching decorations. Since
the procurement of these decorations w~ll exceed $3,000.00 in value, it
will be necessary to receive approval from City Council if the City wishes
to recognize the Valley Decorating Company as a sole source vendor. If
the City decides to go out for bids th~re may be some difficulity in
receiving Christmas decorations prior to December 20, 1982.
If the intent of City Council was to purchase conforming Christmas
decorations this year, then I recommend the City be authorized to purchase
from The Valley Decorating Company and not to exceed $5,000.

Below you will find current pricing for Christrras Decorations. In 1981
the City of La. Porte recognized The Valley Decorating Co. owned by Owen
Dry as a sole source vendor for Christmas decorations. Prices and speci-
fications for decorations are as follows:
1. Omanent Skyliner w/Secondary Drape - $581. 00 Each
2. Double Halo Candles - Pole Mounted - Lighted - $212.00 Each
The price on item number one (1) has not escalated since 1981. The cost
of item number two (2) has escalated 8% from 1981 prices. Delivery time
of decorations is approximately four (4) weeks from date of order. At
present, there is $5,000 appropriated in the City of La. Porte's 1982-83
budget for these decorations.

I recommend we purchase these decorations from The Valley Decorating Co.
due to the necessity of conforming decorations.

SUBJECT: Renovating La Porte Municipal swimming Pool
On Friday, October 22, we received one (1) bid for renovating La Porte
Pool. The one bid was in the amount of $20,600.00 from Cahill and
Stone located in Flossmoor, Illinois. The budgeted amount for
replastering the pool was in the amount of $17,328.00, which is
approximately $3,272.00 over the budgeted amount.
In the 1982-83 Capital Fund under Park Land and Field Improvement
there is approximately $7,000.00 contingency set aside. It is my
recommendation that $3,272.00 be taken from that amount to cover the
cost of the bid.
Attached is the copy of the bid proposal and also a list of pools
in the United States that have been replastered by Cahill & Stone.

been allowed to deteriorate into a condition of decay or partial
ruin and become a fire hazard, and is so situated as to endanger the

Section 1. This Ordinance contains the findings and orders

Section 2. Based on the evidence presented at said hearing,
the City Council hereby adopts the attached report of the Board of
Inspection, in full, and incorporates such by reference herein as
fully as though set out herein.
Section 3. The City Council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.
Section 4. The City Council hereby finds, determines and
declares that Hue J. BurnS , who resides at 402 W. Tyler
La. Porte, Texas , is the record owner of the property on which this
building is situated, and that as such record owner, the said
Hue J. Burns has been duly and legally notified of these
proceedings.
Section 5. The City Council hereby orders the saidHue J.

WHEREAS, The City Council of the City of La Porte, passed
and approved Sections 8-115 through 6-l26 of the Code of Ordinances,
City of La Porte, creating a Board of Inspection to be composed of
the Building Inspector or his duly authorized representative, the
Fire Chief or his duly authorized representative, and the Fire
Marshal or his duly authorized representative;
WHEREAS, such Code sections provide that, whenever it shall
come to the attention of City Council that a nuisance exists, as
defined in said Ordinance, such Board shall within twenty-four (24)
hours of the receipt of such complaint make a thorough inspection
of such alleged nuisance, and thereafter immediately make its report
in writing as further provided in said ord~nance;
WHEREAS, it has heretofore come to the attention of City
Council that the building located on Lot 34-35 Bayfront, Block 69,
210 So. Ohio.
Harris County, Texas,has, for the reason of neglect or misuse has
been allowed to deteriorate into a condition of decay or partial
ruin and become a fire hazard, and is so situated as to endanger the
person and property of others;
WHEREAS, City Council heretofore, to-wit: on Wednesday,
September 1, 1982
, ordered said Board of Inspection to make its
thorough inspection of said building located on said property, and to
thereafter make its report in writing, as provided in said Ordinance,
of the circumstances and condition of the said building;

Section l. This Ordinance contains the findings and orders
of the City Council of the City of La Porte, and ~ts conclusions,
based upon the evidence presented at said hearing.
Section 2. Based on the evidence presented at said hearing,
the City Council hereby adopts the attached report of the Board of
Inspection, in full, and incorporates such by reference herein as
fully as though set out herein.
Section 3. The City Council hereby finds, determines and
declares such building to be a nuisance, and orders such building
condemned.
Section 4. The City Council hereby finds, determines and
declares that Doyle M. Little ,who resides at 210 So. Ohio
, is the record owner of the property on which this
building is situated, and that as such record owner, the said
Doyle M. Little has been duly and legally notified of these
proceedings.
Section 5. The City Council hereby orders the said
Doyle M. Little to entirely remove' or tear down such building, and
further orders the said Doyle M. Little to corrrrnence such
removal within ten (lO) days from the effective date of this
Ordinance, and to complete such removal or demolition of such
building within a reasonable time.
Section 6. The City Council hereby orders the Fire Chief
of the City of La Porte to cause a notice of the dangerous,
insanitary condition of the building to be affixed in one or more
conspicuous places on the exterior of the building, which notice
or notices shall not be removed or defaced by any person, under
penalty of law.
Section 7. The City Council hereby orders the City Secretary
to forward a certified copy of this Ordinance, to the record owner
of said property, the said Doyle M. Little
, by registered mail, return receipt requested.

WHEREAS, The City Council of the City of La Porte, passed
and approved Sections 8-1l5 through 6-l26 of the Code of Ordinances,
City of La Porte, creating a Board of Inspection to be composed of
the Building Inspector or his duly authorized representative, the
Fire Chief or his duly authorized representative, and the Fire
Marshal or his duly authorized representative;
WHEREAS, such Code sections provide that, whenever it shall
come to the attention of City Council that a nuisance exists, as
defined in said Ordinance, such Board shall within twenty-four (24)
hours of the receipt of such complaint make a thorough inspection
of such alleged nuisance, and thereafter immediately make its report
in writing as further provided in said ordinance;
WHEREAS, it has heretofore come to the attention of City
Council that the building located on Lot 22,23, Block 88, La Porte
Harris County, Texas,has, for the reason of neglect or misuse has
been allowed to deteriorate into a condition of decay or partial
ruin and become a fire hazard, and is so situated as to endanger the

SUBJECT: Renovating La Porte Municipal Swimming Pool
On Friday, October 22, we received one (1) bid for renovating La Porte
Pool. The one bid was in the amount of $20,600.00 from Cahill and
Stone located in Flossmoor, Illinois. The budgeted amount for
replastering the pool was in the amount of $17,328.00, which is
approximately $3,272.00 over the budgeted amount.
In the 1982-83 Capital Fund under Park Land and Field Improvement
there is approximately $7,000.00 contingency set aside. It is my
recommendation that $3,272.00 be taken from that amount to cover the
cost of the bid.
Attached is the copy of the bid proposal and also a list of pools
in the United States that have been replastered by Cahill & Stone.
