REGULAR MEETING OF THE LA PORTE CITY COUNCIL
DECEMBER 15, 1982
l. The meeting was called to order by Mayor Cline at 7:00 P.M.
Members of the City Council Present: Councilpersons

2. The invocation was given by Councilperson Malone
3. Mr. K. Z. Wright addressed Council concerning the deep
drainage ditch recently dug by Harris County Flood Control
along Park Street. The Council's attention was called to a
copy of a petition signed by 257 residents of the City of
La Porte which was presented to County Judge Jon Lindsay on
wednesday morning. The petition requests some acceptable
action by the County to alleviate the immediate dangers
presented by the deep ditch and requests the return of the
property believed to have been unlawfully taken by the County.
Harris County Engineer Dick Doss was present in the meeting
and expressed County Commissioner Fonteno's concern in this
ma tter. He further stated the matter is in the hands of an
engineering firm. Doss requested time to complete his inves-
tigation and make his recommendation. Doss asked to appear
before the Council at the first meeting in January to present
Council with his recommendations to the County Commissioners
Court.
. Councilperson Skelton requested a letter be sent to Judge
Lindsay and Commissioner Fonteno expressing the Council's
support of the petition presented by 257 residents of La Porte.

Mayor Cline assured Council she would write to Commissioners
Court, thanking them for Mr. Doss being present in this meeting
to better know and understand the problems along Park and
Garfield Streets and expressing the Council's support of the
petition.
4. Council considered the minutes of the December l, 1982, meeting.
Corrections were made on page 5, item 8, "The estimated cost
to go from an 8 inch line to a l2 inch line may approach
$70,000.00"; then on page 4, item D, Councilperson Westergren
stated she would 'refrain from discussion or voting on this
resolution."

. 5. Council considered Change Order #5 for Contract I- Sewer
Treatment Plant - E.P.A. Project No. C-48l176-03-0. After
review of the requested change order and a letter from Dave
Corbin to the Texas Dept. of Water Resources, a tnotionwas
made by Councilperson Matuszak to approve Change Order #5
in the amount of $3l,862.22, bringing the total current
contract pri'ce to $3,075, 690.lI. Second by Councilperson
Longley. The motion carried, 9 ayes and 0 nays.

6. Council reviewed and considered recommendations concerning
bids received on various City vehicles as follows:

A motion was made by Counci1person Skelton to accept the
recommendations by staff and award the bids as submitted
on sedans, dump trucks, various pick-up trucks and a back-
hoe. Second by Councilperson Matuszak. The motion carried,
8 ayes and 1 nay.
Ayes: Counci1persons Longley, Matuszak, Graves, Pfeiffer,
Gay, Skelton, Westergren and Mayor Cline
Nays: Councilperson Malone
7. Council considered recommendations by Staff concerning
awarding a bid for front load solid waste containers. The
staff recommended the City award the bid to Duncan Equip-
ment Co. as follows:
3 cu. yard - $259.00 each
4 cu. yard - $295.00 each
6 cu. yard - $417.50 each
8 cu. yard - $497.00 each

8. Council considered Staff recommendations on bids received
for plastic garbage bags, .to Adams Industries ,Inc., in the
amount of $.3989 per pound for the first 500,000 bags and
$.4379 per pound for the remaining 500,000 bags, a total
bid price of $60,667.90 for 1,000,000 bags.
A motion was made bh Councilperson Nestergrentoawardthe
bid for plastic gar a~e bags to Adams Industries, Inc., for
one year in the amount of ~60,667.90 for one million bags.
Second by Councilperson Skelton. The motion carried, 9 ayes
and 0 nays.

9. Council considered the Staff recommendation to award the bid
. for a rubber tire, hydraulic excavating and grading machine;
the low bid was an alternate bid received from Highway Equip-
ment Co. for $80,277.00 and is for the purcha.se of the machine
that the City is presently leasing.

A motion was made by Councilperson Gay to award the bid for
the Grading Machine to Hi-Way E~uipment Co. in the amount
of $80,277.00. Second by Councl.lperson Skelton. The motion
carried, 9 ayes and 0 nays.

lO. Council considered Staff recommendation concerning bids
received on a street sweeper. A motion was made by Council-
person Graves that the City purchase a four wheel, self-
propelled mechanical street sweeper from Davis Truck and
Equipment for the bid amount of ~64,832.00. Second by
Councilperson Matuszak. The motl.on carrl.ed, 8 ayes and 0
nays.

Gay, Skelton, Westergren and Mayor Cline
Nays: None
. Councilperson Malone was away from the Council table.
ll. Council consiJdered Staff recommendation concerning bids
received for lOOO feet of four-inch double jacket fire hose.
A motion was made by Councilperson Malone to award the bid
for the lOOO feet of, four-inch fire hose to Claude Wright
and Associates in the amount of $5,780.00. Second by
Councilperson Westergren. The motion carried, 9 ayes and
o nays.
Ayes: Councilpersons Malone, Longley, Matuszak, Graves,
Pfeiffer, Gay, Skelton, Westergren and Mayor Cline

l2. Council consdiered the recommendation of Building Official
paulissen concerning awarding a mowing contract.
A motion was made b:v Councilperson Graves to award a one-
year mowing contract to Sentell Lawn Maintenance. Second by
Councilperson Malone. The motion carried,9 ayes and 0 nays.

l3.- Council considered Staff recommendation for awarding a
demolition contract. A motion was made by Councilperson
Skelton to award the bid for demolition of dan<irerousbui1dings
to Daniel's Dump Truck and Hauling for a low b~d of~7,800.00.
Second by Councilperson Gay. The motion carried, 9 ayes and
o nays.

l4. City Attorney Askins read: AN ORDINANCE AUTHORIZING AND
ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIRE-
MENT SYSTEM, "UPDATED SERVICE CREDITS" IN SAID SYSTEM FOR
SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEMS IN
THE EMPLOYMENT OF THE CITY OF LA PORTE; PROVIDING FOR IN-
CREASED PRIOR AND CURRENT SERVICE ANNUITIES FOR RETIREES AND
BENEFICIARIES OF DECEASED RETIREES OF THE CITY; ALLOWING
CERTAIN EMPLOYEES OF THE CITY, WHO PERFORMED OR HEREAFTER
PERFORM ACTIVE SERVICE IN THE ARMED FORCES (OR THEIR RESERVES
. OR AUXILIARIES) OF THE UNITED STATES UNDER HONORABLE CONDI-
TIONS DURING PERIODS OF CONFLICT WITH FOREIGN FORCES, TO
APPLY AND MAKE DEPOSITS FOR, AND TO RECEIVE SPECIAL CREDIT

A motion was made by Counci1person Graves to approve and adopt
Ordinance No. l349 as read by the City Attorney and requested
a coPy of the current TMRS handbook. Second by Councilperson"
Malone. The motion carried, 9 ayes and 0 nays.

l5. Fire Chief Sease introduced Mr. Joe Lammers of the Lammers
Partnership, Architects and Planners, of Bay town, Texas.
Chief Sease stated he had reviewed several different firms
concerning expansions at Fire Station #1. Of those firms
contacted, Chief Sease recommended The Lammers Partnership
be retained to prepare the design and construction of the
expansion of Fire Station #1.
. A motion was made by Counci1person Westergren to approve the
architectural firm of The Lammers Partnership to prepare the
necessary design for expansion of Fire Station #lat 6 percent
of construction cost. Second by Councilperson Matuszak. The
motion carried, 8 ayes and 0 nays.

16. City Attorney Askins read: AN ORDINANCE DISANNEXING CERTAIN
TERRITORY HERETOFORE ANNEXED TO THE CITY OF LA PORTE; CON..
TAINING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF
A motion was made by Councilperson Westergren to pass and
approve Ordinance No. l350 as read by the City Attorney,
disannexing the 75% of the pr.operty owned by Union Carbide
Corporation, north of SH 225 and west of Strang Road.
Second by Councilperson Skelton. The motion carried, 9 ayes
and 0 nays.

l7. Administrative Reports:
City Mariager Owen requested an executive session on a
personnel and legal matter.
l8. Council Action:
Councilperson Malone requested an executive session on a
legal question. Malone discussed the complaints he has
received concerning a modular home moved into the Coupland
Drive subdivision. He asked if there was anything that
could be done to prevent this kind of thing from happening
again. City Attorney Askins stated the State of Texas over-
rode cities and passed legislation permitting modular homes
to be placed where they meet the square footage requirement
and are not prohibited by deed restrictions. Deed restric-
tions still could be drawn for the Diamond "c" subdivision
and they would be binding on all properties whose owners
sign but not on the properties whose owners do not sign.
Councilperson Longley extended safe and happy holiday wishes.
Councilperson Matuszak wished Merry Christmas to all.

Councilperson Graves requested an executive session on a
contractual matter.
Councilperson Pfeiffer asked that Council be advised in
advance of setting date to advertise for bids on even
budgeted items.
Councilperson Gay thanked everyone for coming out and
thanked Mr. Faris for his Christmas gift.
Councilperson Skelton wished everyone a Merry Christmas and
requested an executive session on land acquisition and
personne 1.
Councilperson Westergren joined the other Councilpersons in
wishing everyone a Merry Christmas.
Mayor Cline read letters from Representative Ed Watson and
Chet Brooks stating that as soon as funds were available, a
contract will be let for an overpass at SHl46 and Fairmont
~ Parkway.
Mayor Cline read a letter of resignation from Andy Wilson on
his appointment to the Planning and Zoning Commission.
19. The Council retired into executive session at 9:04 P.M.
Council returned to the Council table at lO:l6 P.M.
20. There being no further business to come before the Council,
the meeting was duly adjourned at lO:l7 P.M.

Gentlemen:
My office has been contacted by a large number of people
who are deeply concerned about Harris County's construction
of a very deep drainage ditch on Park street in LaPorte.
, So far, 257 neighbors have signed petitions to express
their concern and other petitions are being cirulated.
Copies are enclosed.
What relief can be given this community and how quickly can
it be accomplished? This isa problem that can only escalate.
It will not disappear.
We urgently await your advice and action in this matter.

vIe, the undersigned citizens of LaPorte, Harris County, Texas, wish to
state our objections to the Parle street drainage di tch lying south of
Fairmont Parkway and extending to Little Cedar Bayou. Our major con-
cerns are as follov!s:
1. The unauthorized ta1dn~ of lane1. by Harris County.
The County has proceeded under the mist~cen notion that
the Parle Street rir,ht-of-\'laY is 100 feet, vmen actually it is
70 feet. Erosion ~'Jill undoubtedly ta]ee more property over
the years, as evidenced by the situation in the block south
of Garfield street where as much as 30 feet of property has
washed a;'!a~.r. The enormous size of the ditch has c2used a
devaluation of the abutting property and places an '2xtrer.re
hardship on those property o~~ers in gaining access.

2. The extreme hazard to children 9.:ld motorists.
The width and depth of the ditch pose a danger in that
small children are attracted to such areas and could easily
drm'm uhi 1 e p 1 ayi nr-; . The ditch is located in a residential
neighborhood very near the school. Its proximity to Park
Street poses a hazard to motorists.
. 3. The i~uediate neighborhood appears to be in danger of flooding.
Undersized culvert pipes have been placed beneath Forrest
and Garfield streets. The depth of the ditch from Garfield
south to the bayou \".'ill allow tide "\'later to flm'.' U':) to Gar-
field Street, thus preventing proper drainage into the bayou
and creating a mosquito prOblem.
He respectfully request that further construction worl< be stopped un-
til these problens are resolved.

cerns are as follo~s:
1. The unauthorized taki n,rr, of la!1d by TJarri s County.
The County has proceeded under the mistal'~en notion thrt t
the Parl~ Street ri"J'ht-of-\'lay is 100 feet, "lhen actually it is
70 feet. Erosion ",,'fill undoubtedly ta~:e more Droperty over
the years, as evidenced by the si tuation in the bloc1~ south
of Garfield Street \':here as much as 30 feet of pro:")crty hRs
washed m'lay. The enormous size of the di tch has cr1uscd a
devaluation of the abutting property and places an extrcr:le
hardship on those property O\'mers in :rainino; access.
2. The extreme hazard. to chi ldren and motori sts.
The width and depth of the ditch pose a da!1~er in that
small children are attracted to such areas and could easily
drm-Tn \'/hile playini7. The di tch is locp,ted i!1 a residential
neighborhood very near the school. Its proximity to Park
Street poses a hazard to motorists.
. 3. The immediate neiqhborhood appears to be in dan~er of floodin~.
Undersized culvert pipes have been nlRcedbeneath Forrest
and Garfield streets. The depth of the ditch fron Garfield
south to the bayou will allow tide water to flow up to Gar-
field Street, thus oreventino; proper drainage i!1to the bayou
and creatin~ a mosquito problem.
We respectfully request that further construction work be stooped un-
til these prOblems are resolved.

CONTRACT T. CHANGE ORDER NO. 5
This letter is to outline the items requested on Change Order, No. 5 which have
been previously verbally approved over the telephone. The following is a
summary of the change order items and their respective costs:
. 1. 580' additional fencing on north side of plant $ 3,855.00
2. Surface mounted folding gates on upstairs
overhead roll-up door openings on dewatering
building 2,045.00
3. Outfall guide chute for catenary bar screen 1,386.00
4. Outfall guide chute for sludge belt press
machine 1,953.00
5. Splash guards for rotor aerators 21,733.22
6. Lightening arrestor and single phase
protection on electrical 890.00
Total $31,862.22
The additional fencing was required to fence off the new plant site from the old
plant site and to include the old drying beds as part of the new plant site.
The drying beds will be used from time to time when the belt press is not in
operation. The folding gates on the dewatering building were added as a safety
precaution for times when the roll-up doors were open. The outfall guide chute
on the catenary bar screen was installed to allow the debris collected from the
screen to be discharged into a dumpster. The outfall guide chute for the sludge
belt press machine was installed to channel the sludge cake from the machine

through the second floor opening. The splash guards for the rotor aerators
were necessary to help block the splash and spray produced by the action of
the rotors. The lightening arrestor and single phase protection systems
were installed as additional safety precautions.
With regard to the splash guards for the rotor aerators, it was approved
for the contractor to perform that work on a cost plus 15% basis. All of
the materials receipts and time sheets have been reviewed and have been
found to be in compliance with the contract documents guidelines for cost
plus 15% change order work.
This change order also requests a contract time extension for 191 calendar
days which would cover the time period of July 16, 1982 to January 22, +983.
This should allow adequate time for the contractor to complete all punch' list
items.
Three copies of the Change Order are enclosed for your files. If you have any
questions, please contact me. Your review and formal approval of this change
order as soon as possible will be greatly appreciated.

Truck with an Animal Shelter. A total of $15,032.00 is presently appro-
priated for this unit in the Humane Division Budget for 1982-83. This
unit represents an addition to the fleet and will be used to handle the
excessive amount of calls presently being handled by one unit.

On Monday, October 25th, 1982, a bid opening was held to purchase
a 3/4 - Ton Truck which is budgeted for the Wastewater Division of
Public Works. Four bids were received ranging from a low bid of
$8,793.08 by Timmers Chevrolet, to a high bid of $9,294.85 by Jay
Marks Chevrolet.
All four bidders either met or exceeded specifications for the unit.
Highlights of the Timmers Chevrolet bid are; (1) 8,600 Ibs. GVW, (2)
. 24 month warranty, and (3) 70 day delivery time.
I recommend we accept the low bid of $8,793.08 by Timmers Chevrolet
and order this unit immediately upon approval by City Council. If you

The City of La Pott~ has received two bids for a Rubber Tire, Hydraulic
Excavatirig arid Grading Machine.
Low bid was frQm Highway Equipment Company for $80,277.00. This bid,
listed as an alternate, is for the purchase of the machine that the
City of La Porte is presently leasing. The lease agreement, approved
by Council on August 4, 1982, was for$5,400.00 per month for four months,
or $21,600.00.
Next lowest bid was also from Highway Equipment Company for $101,877.00.
. This bid is for a totally new machine. Because Highway Equipment Company
is applying all of the money from the lease toward the purchase of the
leased machine, and the machine was new at the beginning of the lease
period, I recommend that the City of La Porte purchase the leased machine
for the bid amount.

1000 ft. of four-inch double jacket fire hose. Five sealed bids
were opened. A total of $6,500.00 is budgeted for this expendi-
ture within the Fire Suppression Division 1982-83 budget.
Of the 5 bids received, four bidders met t'he specifications. In
reviewing the bids with Purchasing and Fire Suppression it is our
joint recommendation that the City accept the low bid by Claude
Wright and Associates in the amount of $5,780.00.

. Benefits to Retirees provision. If the City plans to adopt these provisions, the
ordinance must be adopted and received in our office prior to January 1, 1983. It
would be most helpful if we could receive your ordinance at the earliest possible
date, as there will be many records to update here in the office; and too, we will
need to notify the City's retirees of the change in their retirement benefits.
You may be interested to know that 369 cities have adopted Updated Service
Credit and Increased Benefits to Retirees. We have also talked to other cities
who have adopted these benefits but who have not yet mailed their ordinances to
our office.

The Updated Service Credit and Annuity Increases study for the City of La Porte has been
completed. Enclosed you will find the specifications used in computing the retirement and
annuity increase estimates and in calculating the City's contribution rate under the proposed
plans of Updated Service Credit and Annuity Increases. Also, we have enclosed benefit
estima,tes for both active employees and retirees under the various proposed plans.
In looking at the various proposed plans, you will note that under Plan 1, the City can adopt
100% Updated Service Credit. Also, the City could adopt Plan A under Annuity Increases,
( . which would grant each retiree an increase equal to 70% of the change in the Consumer Price
, Index, less previously granted increases. If the benefits of Plan I (Updated Service Credit) and
Plan A (Annuity Increases) are adopted, the City's 1983 contribution rate will be 4.96%.
In looking at the City's rate to adopt these increases, you will note that the 1983 rate is less
than the 1982 rate the City is currently paying. The primary reason for this decrease is due to
the fact that the City will have a new 2.5 year amortization period in which to fund the
increased benefits.
For an individual contemplating retirement in 1982, the deferment of retirement until 1983
should be considered, since in most cases the adoption of Updated Service Credit will
significantly improve retirement benefits. In any case, employees should compare retirement
benefits under the City's present plan with the estimated benefits shown on the attached
listing before finalizing their retirement decision.
R~cent amendments to the TMRS Act allow member cities of TMRS to adopt Updated Service
Credit and Annuity Increases on an annual basis and we have had a great deal of interest from
member cities in these benefits. Should you have any questions concerning the study or the
retirement estimates, please feel free to call us for an explanation. We look forward to
working with you in providing increased retirement benefits for your employees and retirees.

Since this project is an addition, there are a number of unknowns involved

provide the most economical service to the City of La Porte, we would recommend
that this work be done on a hourly rate basis. The cost would be for only the

of total cost, we have estimated that this service will run somewhere between
$16,000 and $20,000. Therefore we would propose to do the project on the above
mentioned hourly rate with a maximum not to exceed $20,000. This work would
I include preliminary plans, preparation of a bid package. assistance for bidding
and construction administration.

Ladies and Gentlemen:
Reference is made to that certain Industrial
. District Agreement between the City of Laporte and Union
Carbide Corporation for the six-year term commencing
January 1, 1981.
The initial improvements to the property described
in said Industrial District Agreement will be completed and
placed in use prior to December 3l, 1982. Accordingly, on
behalf of Union Carbide Corporation, we hereby respectfully
petition the City of LaPorte to disannex and annex portions
of such property so that 25% of the total value of such
property and the improvements thereon shall be annexed to
the City of LaPorte.
Enclosed herewith is a plant plot plan showing
the layout of the initial improvements, being the shaded
area labeled Plant #7. The area on the plant plot plan
enclosed by red lines encompasses 25% of the tital value of
such property and the initial improvements thereon. Union
Carbide Corporation will shortly furnish a survey of such
area by a registered surveyor for use in the disannexation
ordinance.

ORDINANCE NO. 1350

( AN ORDINANCE DISANNEXING CERTAIN TERRITORY HERETOFORE ANNEXED
TO THE CITY OF LA PORTE; CONTAINING A SAVINGS CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section l. The hereinafter described territory, to the
extent to which the same has been previously annexed to the
City of La Porte, and made a part of the corporate boundaries
of the City of La Porte, Texas, by prior annexation ordinance
of the City of La Porte, is hereby disannexed from the corporate
. limits of the City of La Porte, and, after the effective date
( of this Ordinance, shall not constitute a part of the corporate
territory of the City of La Porte, to-wit:
That certain 57.580 acre tract of land, described
in conveyance to Union Carbide Corporation, a
New York corporation, in Deed dated November l2,
1980, and duly recorded under Harris County
Clerk's File No. G7535l9, in the Official Public
Records of Real Property in Harris County, Texas,
SAVE AND EXCEPT a 0.4454 acre tract of land being
a part thereof, said 0.4454 acre tract of land
being more particularly described by metes and
bounds as follows:
COMMENCING FOR REFERENCE at a point for the
Northeasterly corner of the 57.580 acre tract as
located in the Westerly right-of-way line of
Strang Road (60-foot wide right-of-way);
~ THENCE, South 030 02' 34" East, with the Easterly
line of said 57.580 acre tract and with the
Westerly right-of-way line of Strang Road for a
distance of 600.65 feet to the POINT OF BEGINNING
of the herein described 0.4454 acre tract;
THENCE, South 030 02' 34" East, continuing with
said Easterly line of the 57.580 acre tract, same
being the Westerly right-of-way line of Strang
Road, for a distance of 20.00 feet to a point
for Southeast corner;
THENCE, South 860 57' 26" West, leaving said
right-of-way line, for a distance of 420.00 feet
to a point for corner;
THENCE, North 030 02' 34" West, for a distance of
70.00 feet to a point for interior corner;
. THENCE, South 860 57' 26" West, for a distance of
180.00 feet to a point for the most Westerly
Southwest corner;

of 50.00 feet to a point for Northwest corner;
THENCE, North 860 57' 26" East, for a distance
of 200.00 feet to a point for corner;
THENCE, South 030 02' 34" East, for a distance
of 100.00 feet to a point for interior corner;
THENCE, North 860 57' 26" East, for a distance
of 400.00 feet to the POINT OF BEGINNING;
CONTAINING within these metes and bounds 0.4454
acres (l9,400 square feet) of land area, more
or less.
. Section 2. Nothing herein contained shall affect the

validity of the remaining portion of the Ordinance or Ordi-
nances under which the hereinabove described territory, or
any portion thereof, was originally annexed, and it is the
intention of the City Council of the City of La Porte that only
the above described territory, or so much thereof which has

been previously annexed to the City of La Porte, shall be dis-
annexed from the corporate limits of the City of La Porte, Texas.
Section 3. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the

~ City Council was posted at a place convenient to the public at
the City Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-l7, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The
City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
. Section 4. This Ordinance shall take effect and be in
force from and after its passage and approval.
