~ ~ • MINUTES OF THE REGULAR MEETING OF THE LA PORTE CITY COUNCIL JUNE 1, 1983 1. The meeting was called to order by Mayor Virginia Cline at 7:00 P.M. Members of the Cit Council Present: Mayor Cline, Council- persons Jo n Long ey, Ed Matusza ,Kevin Graves, Lindsay Pfeiffer, Deotis Gay, B. Council considered approving the minutes of the regular City Council meeting held May 18, 1983. After Mayor Cline noted a correction that .had already been made to the original .minutes, motion was made by Councilperson Graves to accept the minutes as resente Secon y Counci person S e ton. Mayor Cline proclaimed June 5-11, 1983, as "PBX Telecommuni- cators Week". 5. Mayor Cline proclaimed "Sonja Angelo Day" June 4, 1983. • 6. Council considered the request of C. D. Boyle to close the alleys in Blocks 733 and 734, Town of La Porte. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING AND CLOSING .ALL OF THE ALLEYS IN BLOCKS SEVEN HUNDRED THIRTY- THREE (733) AND SEVEN HUNDRED THIRTY-FOUR (734), IN THE TOWN OF LA FORTE, HARRIS COUNTY, TEXAS.. Motion was made by Councilverson Skelton to avnrove and adopt Ordinance No. 1360 as read b the Cit Attorne Second by Counci person Gay. T e motion Carrie ayes and 1 nay. Ayes.: Councilpersons Longley, Graves, Pfeiffer, Gay, Skelton, Westergren and Mayor Cline Nays: Councilperson Matuszak 8. The request to set a date for a Public Hearing on rezoning Outlots 38, 39, 40, 41 and 42 of La Porte Outlots, requested by Thomas Nation, was considered by Council. Mayor Cline read a letter from. Planning & Zoning Commission chairman Doug Latimer regarding this request and asking that the date for public hearing be set for July 6 so that legal requirements could be met. Second. by Counci person Skelton. The motion carried $-ayes and 0 nays. Ayes: Councilpersons Longley, Matuszak, Graves, Pfeiffer, Gay, Skelton, Westergren and Mayor Cline Nays: None 11. Council considered Ordinance 780-DDD-.A, to rezone Outlot 62, La Porte Outlots. This outlot was inadvertently left off the original Ordinance 780.-DDD. City Attorneg Askins read: AN ORDINANCE. AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING .THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND. PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Skelton to approve and adopt Ordinance No. 780-DDD.-A as read b the Ct Attorne Second by Councilperson Westergren. T e motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Longley, Matuszak, Graves, Pfeiffer, Gay, Skelton, Westergren .and Mayor Cline Nays: None 12. Administrative Reports: City Manager Owen requested an executive session on pending litigation. 13. Council Action: Longley: Enjoyed the ride on the aerial fire truck. Matuszak: Would like the staff to begin ground work on the sign or finance. Would like Council to be provided with copy of Civil Defense plan and asked that the plan be updated. He would like to see a practice held once a year. He likes the idea of giving employee awards for safety. Pfeiffer: Congratulated Mrs.. Angelo-for the enjoyment she a~i~ght to citizens through her work. ~: Thanked people for coming out. Requested an executive session on personnel matters. Skelton: Proud of new fire equipment and of our fire depart- ment, and that he lives in a.city that is able to give them the equipment we have so they can do their best job in the safest manner possible. Has received some complaints from senior citizens about the air conditioning on .the bus at the Multi-Purpose Center. He requests that it be looked into. Westergren: Thank you to Mrs. Angelo for the work she has put in with our students. • Cline: Every member of Council is going to the Mayors, Councilmembers and Commissioners meeting in E1 Paso this year. It should be a very good meeting and she hopes everyone en- j oys it . 14. Motion was made b Council erson Wester ren to ad'ourn into executive session. Secon y Counci person S e ton. OF THE ALLEYS IN BLOCKS SEVEN HUNDRED THIRTY-THREE (733) AND SEVEN HUNDRED THIRTY-FOUR (734), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. WHEREAS, the said alleys in Blocks Seven Hundred Thirty- three (733) and Seven Hundred Thirty-four (734) of the Town of La Porte have never been opened or used as public thoroughfares, and the public utilities now making use of such alleys have all given their written consent for their closing; and WHEREAS, the City Council of the City of La Porte has determined and does hereby find, determine and declare that • the said alleys are not suitable, needed, or beneficial to the public as public alleys, and should be vacated, abandoned and permanently closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The alleys located in Blocks Seven Hundred Thirty-three (733) and .Seven Hundred Thirty-four (734) of the TOWN OF LA PORTE, Harris County, Texas, are hereby permanently vacated, abandoned and closed by the City of La Porte. Section 2. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the • City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally • acted upon. In reviewing the bids, I recommend we accept the low bid of $3,234.82, submitted by Bayshore Electric of La Porte, Texas, for performing the needed electrical work, and • recommend accepting the bid submitted by Tex-All Electrical Contractors for the Oneac transformer in the amount of $14,500.00. The bid proposal by Tex-All Electrical Contractors for the Oneac transformer was not the low bid. I recommend it over.-the others for the following reasons. Of the three (3) transforme::.bids submitted for consideration, only the Oneac Model ~6CS 31240 has the ability to deal with voltage fluctuations and transients at a speed compatible with our computer. The Oneac also produces ten (10)times less heat in operation than the Sola transformer, saving a substantial amount in air conditioning costs. Oneac will fully warranty the unit for five (5) years and cover completely most servicing on the premises. When selecting a transformer to perform these functions, it is important that the unit have a response time that is compatible with the computer response time. Should the transformer not perform quickly enough, fluctuations, unscheduled power outages, and/or high voltage transients will be passed through the transformer and into the computer's logic and memory. This will cause the computer to "crash" which will in turn damage various components of computer hardware including loss of stored data. High speed transients which last leas that, .5 seconds can bypass inefficient transformers and cause varying amounts of damage to core planes, magnetic drums, power supplies, and semicon- ductors in the logic and memory sections of the computer.l It is therefore imperative that transformer selection be based upon response time to transient and voltage fluctuations. On December 2, 1980 the Planning and Zoning Commission recommended to City Council that the rezoning requxest be approved. A Public Hearing was held on January 7, 1981 and the rezoning was approved. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 7th day of January, 1981, at 7:00 P.M. , a joint public hearing was held before the Planning and Zoning Commission and the City Council, of the City of La Porte, Texas, pursuant to • due notice, to consider the question of the possible re- classification of the zoning classification of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. Section 2. The Publisher's Affidavit of Publication of notice of said hearing is attached hereto as "Exhibit B," incorporated by reference herein and made a part hereof for all purposes. • Section 3. Subsequent to such public hearing, the City of La Porte Planning and Zoning Commission met in special session on January 7, 1981, to consider the changes in classi- fication which were the subject of such joint public hearing. • The City Council of the City of La Porte is in receipt of the written recommendations of the City of La Porte Planning and Zoning Commission, by letters dated January 7, 1981, the original of which letter is attached hereto as "Exhibit C," incorporated by reference herein, and made a part hereof for all purposes. .a S ~ • Ordinance No. 780-DDD-A, Page 2. Section 4. The City Council of the City of La Porte hereby accepts the recommendation of the City of La Porte Planning and Zoning Commission, and the zoning classification of the hereinafter described parcel of land, situated within the corporate limits of the City of La Porte, is hereby changed in accordance therewith, and the zoning classification of said parcel of land shall hereafter be "District C--Apartment and Commercial District." The description of said parcel of land • re-zoned is as follows, to-wit: La Porte Outlots 56, 57, 58, 61, 62, 63, 64, and 65, Harris County, Texas. Section 5. This Ordinance is passed and approved to correct Ordinance No. 780-DDD, passed and approved January 7, 1981, which, through clerical error, failed to include La Porte Out- lot 62 among the property rezoned. All ordinances in conflict herewith are repealed, to the extent of conflict only. Section 6. This Ordinance shall be in effect from and after its passage and approval.
