1. Meeting called to order by Mayor Pro-Tem Skelton at 7:00 P.M.

2. The invocation was given by City Attorney Askins.
3. Council considered the minutes of the Regular Meeting of the
La Porte City Council-held January 5, .1983. A motion was made
by Councilperson Malone to approve and accept t e minutes as
presented. Second by Councilperson Matuszak. The motion car-
ried, 6 ayes and 0 nays.

4. Mayor Pro-Tem Skelton proclaimed the month of February as
"Children's Dental Health Month" and "National Heart Month."
5. Mrs. Cheryl Angelli cancelled her appearance before Council.
6. ..Joseph W. Chadwick requested the Council to reconsider his
application for an on-premise beer permit at 2199 Underwood
Road.

OPEN AND CLOSING; PROVIDING SALE OF BEER FOR CONSUMPTION OFF
PREMISES SHALL NOT BE AFFECTED; DEFTNTN6 SOURCE OF AUTHORITY;
PROVIDING THAT NO LICENSE SHALL BE LSSUED EXCEPT FOR THE

Councilperson Malone requested the City Manager to call to
the Police Chief's attention the enforcement of Ordinance

7. Council considered Ordinance 915-T: AN ORDINANCE GRANTING
A PERMIT UNDER SECTION 18-A-3 OF"ORDINANCE NO 915,."PIPELINE
TRANSPORTATION," BEING-.CHAPTER 18-A OF THE CODE OF ORDINANCES
OF THE CITY OF LA PORTE, TEXAS; AND .APPROVING THE APPLICATION
OF ENTERPRISE PRODUCTS COMPANY, TO CONSTRUCT TWO SIX INCH (6")
PIPELINES; AND PROVIDING AN EFFECTIVE DATE HEREOF.
A motion was made. by Councilperson Graves to approve and
adopt Ordinance No. 915-T as read-. Second by Counc~rson
Pfeiffer. The motion Carrie , 6 ayes and 0 nays.

9. The Council considered a lease agreement between the City
of La Porte-and the First United Methodist Church of La Porte
.for the Church to construct and maintain a parking lot behind
the Edith Wilson Public Library.
A motion. was made by Councilperson Malone to authorize the
City Manager on behalf of the City of La Porte to enter into
a contract. with the 1F rst United Methodist C urc of La Porte.
Second by Councilperson Gay. The motion carried, 6 ayes and
0 nays.

10. Council considered declaring an emergency and appropriating
funds for repairs to Water Well #1 and Water Well #4.
A motion was made by Councilperson Gay to declare an emer-
gene and appropriate $13,159.51 from the water and sewer
improvement fund for repairs to Water Well l an Water
Well #4. Second by Councilperson Graves.. The motion car-

11. Bob McDaniels presented to Council in final form the expanded
drainage study contracted with O'Malley and Clay.
12. Donna Pfeiffer cancelled her appearance before Council to
discuss the destruction of 200 year old oak trees in her
alley (between "D" and Park).
13. .Council considered an agenda addendum:
•
Awarding. the construction contract for installation of a 12-
inch A.C. water main from North "L" Street to the Trammel Crow
Distribution Center site on SH 225. Council reviewed the
recommendations of H. Carlos Smith Engineers & Surveyors and
the bid tabulations (a part of the official minutes of this
meeting).

14 . Committee Reports
1. Truck Ordinance Committee - In Longley's absence, Skelton
reported on workshop meeting held January 12. The meeting
went very well and four.. (4) changes are to be brought. to
Council Workshop on January 26.
2. Solicitor's Ordinance Committee - Malone reported the
proposed ordinance has been submitted.. to the Attorney's
office for his review before bringing. it to Council
.Workshop.
3. Game Room Ordinance Committee - Pfeiffer.-reported the
committee met January 13 to look at the hours set by
• that ordinance. They have asked that the City Attorney
review the legalaties of that ordinance.
4. Annexation Committee. - Matuszak reported the committee
met.. January 10 and reviewed the legal steps for annexa- '-~Y----
tions. They are. at this time investigating the budget .:.;,~..~..,,
ramifications of the total area of our E.T.J.
5. Sign Ordinance Committee - This committee has had no
official meetings.. They have requested John Armstrong
do an ordinance for their consideration.
15. Administrative Reports:
-City Manager Owen asked ,for an executive session on a matter
of land acquisition.
Owen.. asked the Council to consider setting a special workshop
for February 9, 1983. One item to be discussed is a review
of proposals for .the data processing equipment. Owen ad-
vised Council. that quarterly activity reports will be out
within a week.
16. Council Action:
Councilperson Graves requested speed-limit signs along the
Fairmont Parkway construction. Graves requested an executive
session on a personnel matter.

Mayor Pro-Tem Skelton xead Al Fields resignation from the
La Porte Area Emergency Corps Board of Directors.
Skelton also read a letter expressing. the grateful. apprecia-
tion_of Marie Smith, 115 South Virginia., for the work done
and the employees' consideration during that work.
17. Council adjourned into executive session at 8:25 P.M.
Council returned to the Council table at 9:10 P.M.

18. There being no further business to be .considered by the
Council at the time, the meeting was duly adjourned at
9:10 P.M.

TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE
PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVIDING
FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEER FOR CON-
SUMPTION OFF PREMISES SHALL NOT BE AFFECTED; DEFINING SOURCE OF
AUTHORITY; PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR

WHEREAS, the City of La Porte desires to regulate the closing
hours for the sale of beer by retailers selling beer for consump-
tion on premises in accord with provisions of Vernon's Texas
Codes Annotated, Section 109.32 of the Alcoholic Beverage Code
of the State of Texas.

SUBJECT: Pipeline Permit - Enterprise Products Company
The City of La Porte has received an application from Gullet & Associates,
Inc., representing Enterprise Products Company, for a permit to install
two (2) six (6) inch pipelines in the Old ha Porte Road rip~ht-of-way from
Houston~Avenue to Wanda Petroleum meter station. ..Furthe,r convexsatons'with
John Olson with Gullet & Associates indicate that Enterprise Products
Company wants to extend the line west to the ~'xxon Pipeline Corridor,
which is approximately thirty (30) rods west of the Wanda Petroleum
meter station.
The Public Works Department has no objection to the construction, or
the additional extension west. Mr. Olson will write another letter
to the City Secretary out7_ining proposed changes, and detailing the
connection to be made at the Exxon Pipeline Corridor.
I recommend that the City draft an ordinance granting the pipeline
permit for Council action.

We have completed our investigation of the alignment proposed by Enterprise
Products. The pipeline as proposed does not conflict with any existing or
proposed utility (water, sevrer, street). This information has been forwarded to
Public Works and the final handling of the permit request.

I would like to recommend Larry Coker to fill the vacancy
that has been created by the resignation of Al Fields.
Mr. Coker resides at 201 South Third, La Porte, and has ex-
pressed an interest in the Emergency Medical Services of
La Porte. I feel that Mr.-Coker would be an asset to the
Ambulance Board and the City of La Porte. Your considera-
tion is appreciated.

We understand, by conversation with your City Engineer's that
the request for a permit of construction by Enterprise Products
Company will be on the agenda Wednesday night 12 January 1983.

In that conversation we reported that the line would extend
• approximately 33 rods (544 + - feet) further West to a connection
in Dow Chemical property adjacent to the Exxon Corridor. This connection
is 0.79 miles East of Sens Road.
We were informed this extension would not alter the favorable
recommendation the Engineer's intend making. We enclose drawing
WA-575-18RR-C (2 each) for your use and information.
If you have any questions or need more information please do not
hesitate to call. When the permit has been issued and is ready to
be received please call us. We will come to your office to pick it
up .

MEMORANDUM

SUBJECT: Old La Porte Road
In recent weeks I have had several conferences with
Mr. J. H. Badders, Principal Right-of-way agent for Gullett
and Associates, Inc. His reason for calling on me in the be-
ginning was a search to establish abandonment of Old La Porte
Road. He had searched Harris County Records and found no
record of the road ever having been abandoned.
This is the series of events I conveyed to him:
•
In 1976, the City of Lomax was preparing to install a
sewer line and went to the County to get proper permits to
place the line along Old La Porte Road. The County informed
us the road had never been carried on their road log since it
was a state highway. City Attorney Walter Queen and I spent
several days reading minute's of the Commissioners Court to be
sure the road had never been officially abandoned. There was
nothing. We then went to the State Highway Department; they
traced the road and its repairs for several years but found
no official dedication and no abandonment.
We found Old La Porte Road on maps back as far as 1918,
and found that in 1931 the new State Highway 225 was built and
opened to traffic. The County began to maintain the right-of-
way until 225 was officially completed and then they only main-
tained the section from 26th Street west approximately 900 feet
for those citizens who lived along that area. Harris County
stopped maintaining that section of Old La Porte Road in 1968
and the street was maintained by the City of Lomax from 26th
Street was approximately 1000 feet and from Houston Avenue
east a distance of 500 feet.
Enterprise Products Company is proposing to lay two six-.
inch pipelines 20 feet inside the Old La Porte Road right-of-way,
from the Wanda Petroleum meter site to Houston Avenue where the
line will turn north across the S.P. tracks, SH225, and out of
our City limits line will travel east.

Dear Ms. Waters:
Gullett & Associates, Inc., represents Enterprise Products Company in
obtaining right-of-way's and permits for two (2) six (6) inch pipelines from
an existing meter site to a second meter site on DuPont property to the North.
These two meter sites are the "heart" of the entire project. The petroleum
products carried by these lines will be directed, metered and controlled
from these stations.
The course of the two six inch lines will lie off existing Arco lines,
. as shown in the detail, and exit Northerly 0.8 miles from Sens Road into the
DuPont property all in the Enoch Brinson Survey, Abstract 5 as shown.
Since Old LaPorte Road (abandoned) is involved, we are appealing to
both the County of Harris and the City of LaPorte for this very necessary
permit. Any fees will come from this office as well as further information
or answers to questions you may have. The pipelines will be constructed under
any and all ordinances or restrictions as may be required by City of LaPorte
or Harris County.
Thank you for your timely action on behalf of Enterprise Products Company.
It is most appreciated. We expect to begin construction within the next
fifteen to twenty days and time is of the essence.

AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE
NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE
CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS; AND APPROVING
THE APPLICATION OF ENTERPRISE PRODUCTS COMPANY, TO CONSTRUCT TWO
SIX-INCH (6") PIPELINES; AND PROVIDING AN EFFECTIVE' DATE HEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte has
received an application dated November 22, 1982, from Enterprise
Products Company, requesting a permit under Section 18-A-3 of
Ordinance No. 915, being Chapter 18-A of the Code of Ordinances
of the City of La Porte, to construct two six-inch (6") nominal
diameter pipelines crossing the City of La Porte, all as shown
on said application. The application of Enterprise Products
Company, has been reviewed by the City's Director of Public Works,
who has found that .said application meets all requirements of
said Ordinance No. 915, and has recommended its approval.
Section 2. The City Council of the City of La Porte hereby
approves the application of Enterprise Products Company, dated
November 22, 1982, and this Ordinance shall constitute a permit
to Enterprise Products Company, to lay and construct said pipe-
line within the City of La Porte, all in conformance with the
requirements of said Ordinance No. 915.
Section 3. This Ordinance shall be in full force and effect
from and after its passage and approval.

PROJECT SUMMARY: At the August 18, 1982, Council meeting, after
passage of the Resolution naming the "Edith T.4ilson
Public Library", Councilperson Westergren asked
what had been done to rename the North Side Civic
Center to the Jenny Riley Civic Center. Mayor
Cline suggested City Manager Owen and Councilperson
Westergren work with the Parks and Recreation
Director Sherwood on this matter and further sug-
• gested they coordinate their efforts with Lester
Simon of Harris County Community Development, since
the building was built with Community Development
fund money.
I was directed by Councilperson Westergren to re-
quest a resolution be prepared. by Knox for this
agenda.
ACTION R~QUIR~D: Passage of the Resolution.
Direct Director of Parks & Recreation to order
new letters for building.
Appoint a dedication committee and set date for
dedication.
ALTERNATIVES: This resolution could be delayed until letters for
front of building arrive, then pass Resolution and
set date for dedication. This suggestion is made
due to the time it took to obtain the letter for
the library sign.

AS THE "JENNIE RILEY CIVIC CENTER," IN APPRECIATION AND RECOG-
NITION OF JENNIE RILEY.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
WHEREAS, Jennie Riley was instrumental in organizing a
recreation program and the Northside Civic Center in 1970; and
WHEREAS, for more than fifteen (15) years, Jennie Riley
has worked to provide the youth of La Porte with recreation and
educational programs; lectures; Black history classes; and has
assisted children with their school homework; and
WHEREAS, Jennie Riley helped organize a work-study program
with the NASA Manned Spacecraft Center, for the young women of
the community; and
• WHEREAS, Jennie Riley has been active in government, civic,
cultural, and church activities in La Porte; and
WHEREAS, Jennie Riley has worked for the integration of
the public schools; establishment of satellite health clinics;
organization of a Black Youth Club and Black History Week; the

The City of La Porte was contacted by Reverand Howard Williams of .
the First United Pethodist Church. of La Porte concerning the feasibility
of building a parking lot for church parking behind the Edith Wilson
Public Library. The area in question is part of Block 242, lots
11, .1.2, 13, and 14, which are owned by the City.
An agreement has been drawn up to lease the property to the First
United Methodist Church of La Porte for CITE DOLLAR ($1.00) per year.
The Church is to construct and maintain the parking lot, which is
to be for the combined use of the Church, the City, and the La Porte
Independent School District. In the event of future expansion of the
Library, the parking lot will revert back to the City.

This Agreement of Lease made and entered into this the /9~ day
of , 1983, by and between the CITY OF LA PORTS, a
municipal corporation in Harris County, Texas, hereinafter called
LESSOR, and FIRST UNITED METHODIST CHURCH OF LA PORTS, a non-profit
corporation organized under the laws of the State of Texas, existing
in the City of La Porte, Harris County, Texas, hereinafter called
LESSEE;
W I T N E S S E T H:
I.
LESSOR, for and during the term hereof and at the rental herein
specified, does hereby lease, let and demise unto LESSEE, subject to
• the provisions and stipulations herein contained, the following lots,
tracts or parcels of land, lying and being situated in La Porte,
Harris County, Texas, and more particularly described as follows,
to-wit:
Lots Eleven (11), Twelve (12), Thirteen (13),
and Fourteen (14), Block Two Hundred Forty-two
(242), La Porte Township, Harris County, Texas.
II.
This lease shall be for a term of forty (40) years, beginning
at 12:00 o'clock noon of the date first hereinabove written, subject,
however, to cancellation upon sixty (60) days written notice by one
party to the other at the addresses of LESSOR'S or LESSEE'S agents
designated below.
• III.
LESSEE agrees to pay to LESSOR, as rental upon the demised
premises, an amount of Forty Dollars ($40.00) upon execution of this
contract by the parties hereto, which sum represents rental at the

rate of One Dollar ~.00) per year for the ~ of this lease as
hereinabove defined.
IV.
LESSOR agrees to deliver possession of and control to all of
the demised premises on the date and hour herein specified, provided
however, that LESSOR reserves the right, subject to the limitations
herein in during the term of this lease, from time to time, and at
its own expense and by its officers, agents, or contractors, to make
such renovations, repairs and changes in and about the premises, as
the CITY OF LA PORTE seems desirable, particularly reserving the right
to maintain or repair utilities or other municipals appurtenances in
or about the leased premises, and LESSEE agrees to make no claim
against the CITY OF LA PORTE, its officers, agents, and contractors,
for interference with their leasehold interest or for loss or damage
to their business during such renovations, .repairs, and changes.
• Further, LESSEE specifically agrees that LESSOR shall have an unre-
stricted right of ingress and egress to the leased premises for the
purpose of making said repairs and alterations to utilities or said
leasehold municipal appurtenances.
V.
LESSOR covenants and agrees with LESSEE that LESSEE may only
use the demised premises for a parking lot. Further, LESSEE specifi-
cally covenants and agrees with LESSOR that said parking lot shall
only be used for parking incidental to either LESSEE'S church related
activities, any activities of the CITY OF LA PORTE, or any of its
departments or agencies, or any parking needed for activities related
to the La Porte Independent. School District or any of its agencies.
VI.
LESSOR covenants and agrees with LESSEE that LESSEE may, during
the term hereof, make such alterations or changes to, and may construct
such improvements upon the demised premises, so long as said altera-

tions, changes, or constructed improvements upon. id demised premises
are strictly limited to the construction, repair, alteration, change,
or improvement of a parking lot consistent with the purposes described
in the above paragraph.
VII.
LESSOR and LESSEE hereby agree that any notice required to be
given to LESSOR shall be deemed promptly given to LESSOR when addressed
to FIRST UNITED METHODIST CHURCH OF LA PORTE, at 502 San Jacinto
Street, La Porte, Harris County, Texas, 77571, and sent by certified
mail with proper postage affixed, to said address and notice is
required to be given to LESSEE shall be deemed properly given to
LESSEE when addressed to the City Attorney, City of La Porte, P. 0.
Box 1218, La Porte, Harris County, Texas, 77571, and sent by certified
mail with proper postage affixed to said address.
• VIII.
LESSOR and LESSEE agree that, in the event either party shall
deem the other party in default of any of the terms. hereof, due
notice of such default shall be given to the party deemed guilty
of such default, who shall then have twenty (20) days in which to
remedy the default, if any. The failure, on the part of either
party hereto, to exercise any rights or remedy given to them hereunder
shall not be deemed to operate as a waiver by said party of the
right to exercise such right or remedy at any other or future time.
IX.
All alterations, additions and improvements made in or to the
leased premises shall, unless otherwise provided by written agreement
or by the terms hereof, be the property of LESSOR and remain and
• be surrendered with the premises, and LESSEE hereby waives all
claim for damages to or loss of any property belonging to the LESSEE
that may be in or upon the premises.

X.
LESSEE shall not assign, transfer, sublease, or pledge, surrender,
or otherwise encumber or dispose of this lease or any estate created
by this lease, or .any interest in any portion of the same, or permit
any other person or persons, company or corporation to occupy the
premises, without first obtaining the written consent of LESSOR.
XI.
LESSOR shall not be liable to LESSEE or LESSEE'S officers, agents,
employees, guests, invitees, or trespassers for any damage caused to
his or their persons or property by water, rain, snow, ice, sleet,
fire, storms and accidents, or by breakage, stoppage or leakage of
water, gas, heating, and sewer pipes or plumbing upon, about, or
adjacent to the premises.
XII.
• LESSEE, at the expense of LESSEE, shall keep in force, during
the term of this lease, insurance, issued by responsible insurance
companies and in form acceptable to the City Manager of the CITY OF
LA PORTE, for the protection of LESSOR against all liabilities,
judgments, costs, damages, attorney's fees, and expenses which may
accrue against, be charged to or recovered from LESSOR, by reason
of damage to the property of, injury to or death of any person or
persons on account of any matter or thing which may occur on or
about the demised premises, any policy or policies in the amount

SUBJECT: Cost of Repair - Water Well #1 and #~+
On October 15, 1982, the 250 hp well motor at #1 water well, :located
in Fairmont Park, shorted out, burning up the motor. Cause is unknown.
The control system at this well was also damaged. Because this well is
essential for proper pressure, not only for potable water but also for
fire protection, this problem was deemed an emergency, and repairs were
started.
Layne Texas Company was hired to pull, repair, and reinstall the old
motor. Total cost of repairs is SIX THOUSAND TWENTY EIGHT DOLLARS
AND SEVEN CENTS ($6,028.07).
After reinstallation, problems were encountered with the automatic
control. system. Layne Texas and Gulf States Electric were contacted
to look at the problem, and Gulf States Electric was hired. In
order to save money, Gulf States attempted to rebuild the existing
control system. However, they were unable to locate a schematic of
the system after contacting the manufacturer, because of the age of
the system. This process took several weeks. To avoid further delay,
Gulf States was instructed to replace the electronic starting apparatus
with an across the line direct starter. This system, which is much
simpler and easier to maintain, should provide more trouble-free
service. Total cost for replacing starter unit is FOUR THOUSAND FIVE
HUNDRED EIGHTY FIVE DOLLARS AND EIGHTY CENTS ($!+,585.80). Date well
began producing again was December 21, 1982.
On December 22, 1982, the 125 hp well motor at #~+ water well, located
at Broadway and D~:ain, shorted out, burning up the motor. Cause is
unknown. Loss of this well seriously effected system pressures, and
work was authorized for Layne Texas Company. The motor was removed,
rebuilt, and replaced at a cost of TWO THOUSAND FIVE HUNDRED FORTY FIVE
DOLLARS AND SIXTY FOUR CENTS ($2,545.64). The control system was also
checked, and new contacts have been ordered for the starter. Work was
complete and the well was producing on December 29, 1982.

# 4 are as follows:

Bids were recieved and opened on Friday, January 14, 1983
at 3:00 p.m. at City Hall on the above referenced project.
Mrs. Betty Waters, City Secretary, recieved and opened the
bids with Mr. John Joerns, myself and Mr. Fred Beck in attend-
ance, along with various contractor representatives.
Bids have been tabulated, copies of which are handed you herwith,
and analyzed.
The low base bid was submitted by Sabine Consolidated, Inc.,
• Port Arthur, Texas, in the amount of $187,325.00. The how
bid for Alternate No. 1, was submitted by David Wight
Construction Co., Inc. Freiendwood, Texas, in the amount of
$184,773.20. The low bid for Alternate No. 2 was submitted by
Marathon Construction Co., Inc.,Houston, Texas, in the amount
of $254,871.00. The low bid for Alternate No. 3 was also
submitted by Marathon Construction Co., Inc., in the amount
of $231,515.45.
In analyzing the bids the cost of the extra work items
were taken into consideration. These major extra work items
consist of wellpointing and steel sheet piling, which we
believe will be necessary to construct the crossing at the
Southern Pacific Railroad and State Hwy. 225. It was necessary
to install the water line at a depth of approximately 14 feet
at this location in.order toa avoid conflict with 9 pipelines
parallel to the railroad. Soil boring were taken at this
location and indicate water bearing sand. All of the
contractors, prior to bidding were advised that the cost of
the extra work items would be considered in awarding the bid.
In this respect, we would recommend awarding the bid to Sabine
Consolidated, Inc. of Port Arthur, Texas, in the amount of
$249,722.75. Their bid considering the cost of the extra work
items would be approximately $33,392.70 less than the bid
of Marathon Construction Co., Inc., when considering the cost
• of their extra work items.

Water Main from North "L" Street to TCDC Site
FISCAL SUMMARY: As per an executed utility extension agreement, TCDC will be
responsible for the costs associated with the installation of
an 8-inch water main (estimated cost $184,773.20). The City of
La Porte has previously agreed to participate in the oversizing
of the main to a 12-inch and $70,000 has been approved for over-
sizing (Council minutes 12/1/82). The estimated cost of oversizing,
$55,000, is well within the allocated funds.
.ACTION REQUIRED: Award of construction contract to Sabine Consolidated pending
receipt of ($184,773.20) to be deposited in escrow.
ALTERNATIVES: Award contract for construction of an 8-inch water main as per
utility extension agreement.
RECOMME"dDATION: Staff concurs with the recommendation by H. Carlos Smith Engineers
and Surveyors to award the contract for the construction of a 12"
A.C. water line (Alternate 3) to Sabine Consolidated pending receipt
of the escrow amount by TCDC. Total contract amount of $249,722.75
plus an estimated $12,000 extra work items.
