1. Meeting called to order by Mayor Virginia Cline at 7:00 P.M.

2. The invocation was given by Councilperson Norman Malone.
3. Council considered the minutes of the Regular Meeting of
the La Porte City Council held January 19, 1983. Councilperson
Skelton asked that under item #l, others present - Pam Smith
of the La Porte Broadcaster be added;. in item #4, that the
word "National" be struck and that under item #6, Council Action,
the letter from Marie Smith, 115 S. Virginia,. the minutes re-
flect the two employees' names "Joe Hamilton and Alva Averett.
Councilperson Skelton made a motion to accept the minutes as
corrected. Second by Councilperson Pfeiffer. The motion
carried, 7 ayes, 1 abstain, and 0 nays.

6. .Paula Bridges addressed the Council on the need. in the City
of La Porte for a "Truck Ordinance."
7. Council considered.: AN ORDINANCE ANiENDTNG CHAPTER 25, .ARTICLE
IV, SECTION 25-64, OF THE CODE OF ORDINANCES OF THE CITY OF
LA PO RTE TO INCLUDE BOATS, HOUSE TRAILERS, TRUCK TRACTORS,
RANCH TRAILERS, AND UTILITY. TRAILERS; AND AMENDING CHAPTER. 25,
ARTICLE V, SECTION 25-80, ET SEQ, OF THE CODE OF ORDINANCES
OF THE CITY OF LA PO RTE; BY ADDING TO THE DEFINITION OF TRUCK
TRAFFIC; BY ADDING DEFINITIONS OF "BOAT", "DAYTIME", HOUSE

After brief discussion, a motion to amend the Ordinance No.
1351 by adding the figure 10,000 pounds to Section 25-80
Definitions: Light Truck - Any truck (as defined in this
article) with a limited manufacturer's rated carrying capacity
of 10,000 pounds. Second by Councilperson Longley. The motion
to amend carried,. 8 ayes and 0 nays.

14. Council considered an application by Airco Industries, located
on Fairmont Parkway west of Bay Area Blvd., for a three (3)
inch water tap. Airco Industries is outside-the La Porte City
Limit, but a 12-inch water line is available which was extended
some time ago by Westinghouse. Airco has agreed to fund the
entire project and to comply with all requirements of the out-
of-the-City water use policy.
A motion was made by Councilperson Malone to ap rove the Airco
Industries application for a water tap. Second by Counci person
Longley. The motion carried, 9 ayes and 0 nays.

15. Council was advised by the City Secretary that she had received
a call from Scott White asking that his request for sewer
service outside the City Limits be-removed from the agenda.
This met with Council approval.
16. Council considered the City Manager's recommendation to fill
a vacancy on the Civil Service Commission.

17. Administrative Reports:
City Manager Owen advised Council the computer report is
ready for presentation at the February 9 Special Called
Workshop.
Owen stated .the staff's activity report is out and asked
for Council comments.
The City Manager requested- an executive session on Land
Acquisition (Article 6252-17, Section 2(F)).
18. Council Action:
Councilperson Ma one informed Council he had received 67
phone calls concerning the beer license at Sweet Pea's
Ice House on Underwood Road and had several letters sup-
porting him in his stand.
Councilperson Matuszak commented on the clean socks at the
airport and asked that Chief Freeman .take some emergency
action to alleviate a dangerous situation on the Fairmont
Parkway approach to SH146.
Councilperson Graves reported he had received a few calls
about the beer license; he further requested the Animal
Control Ordinance be updated to cover the keeping of exotic
animals on private property.
Councilperson Pfeiffer made a statement concerning his favor-
able stand on a "Greenbelt Ordinance." He further requested
that the newspaper get their facts straight before they are
printed.
Councilperson Skelton told the Council he had received a
phone call from a retired City Employee, Max Quitter, thanking
the Council for his recent increase in retirement payment.
Skelton requested an executive session on a personnel matter.

Mayor Cline read a letter she had received from Mildred
Runnels, a retired City of LaPorte employee, thanking
the Council for her recent increase in retirement benefits.
Cline requested an executive session on a legal matter.
19. Council adjourned into executive session at 9:13 P.M. to
discuss legal, personnel and land acquisition matters.
Council returned to the Council table at 10:D2 P.M.
20. There being no further business to be brought before the
Council, the meeting was duly adjourned at 10:04 P.M.

Martha is a very dependable, loyal, and hard working employee. She gets along
well with all employees, and handles the public with ease and concern.
Martha wants to learn all she possibly can about her job and the Department of
Public Works. She follows projects through to completion.
Martha is a fiery responsible, prompt individual and does her job well.

SUBJECT: Employee of the Month
DATE: December 1, 1982
Walter Barnes, Chief Operator, has displayed qualities close to a model
employee for the City of La Porte. He has given of his own time, unselfishly,
on many occasions to check on the personnel and operation of equipment at the
Wastewater Treatment Plant. He displays a dedication for his work and. the"area
of responsibility belonging to him. Most importantly, he has given a spirit and.
high morale to his employees. His employees have a thirst for. knowledge that was
unseen in the past, and Walter freely and patiently imparts his: knowledge of lab
testing, plant operation, and pump maintenance. He has been most responsible to
my every request, responding with an appreciated promptness and thoroughness.
Walter does his job very well.

Re: Chapter 25, Article IV, Section 25-60, et, seq.
of the Code of Ordinances of the City of La Porte,
the Truck Route Ordinance

Dear Ladies and Gentlemen:
In the fall of 1981, the La Porte Police Department, the. Municipal
Judge, and the Municipal Prosecutor of the City of La Porte, brought
to the attention of the office of the City Attorney a difficulty in
our present Truck Route Ordinance. The difficulty centered upon the
fact that 18-wheeler trucks and truck tractors were parking in
residential subdivisions within the city limits of the City of
La Porte. Upon an attempt by the Police Department to prosecute
under the terms of our current Truck Route Ordinance, it was dis-
covered that the drivers of said trucks were claiming that the
residential property upon which they were parking was a truck terminal,
and that, under an exception that existed to the Truck Route Ordinance,
the parking of said trucks on said residential property was permissible
under the terms of our current ordinance.
The Municipal Prosecutor suggested to the office of the City Attorney
that an amendment to the Truck Route Ordinance, said amendment
defining the term "truck terminal", so as to negate the claim by the
truckers that their residential property was indeed a truck terminal
under the terms of the current ordinance. To shore up enforceability
of the current Truck Route Ordinance, then, the office of the City
Attorney prepared a definition of truck terminal, said definition
appearing before the City Council in its agenda packet this evening.

Asa further aid to enforceability of the ordinance by the Police
Department, the office of the City Attorney, noting that all truck
terminals currently existing within the City of La Porte are located
directly adjacent to existing truck routes, limited the location
of all future truck terminals to areas directly .adjacent to existing
truck routes, or any truck routes that might be designated in the
future. As a further aid to enforceability of the ordinance on the
part of the La Porte Police Department, a clause was added restricting
parking of certain defined vehicles (including trucks) on residential
lots.
After numerous public meetings, it was discovered that application
of the new provision restricting parking of certain designated
vehicles, including trucks, to non-residential areas, had an unequal,
and in some cases, unfair impact upon many residents of the City of
La Porte. Specific concerns were raised regarding application of the
ordinance to utility trailers, boats, recreational vehicles, and
vehicles incidental to the raising or cultivating of livestock or
crops, those vehicles being particularly located in the Lomax area.
Also, many current truck owners within the City of La Porte voiced
concern that the parking of their trucks on their property was not a
matter properly regulated by a truck route ordinance.
To alleviate these concerns, the ordinance was subsequently amended
to exclude from its application, utility trailers, boats, recreational
vehicles (house trailers), and ranch trailers. Further, one ton
trucks were excluded from the applicability of the ordinance, and
an attempt was made to write a special permitting section to allow
the parking on residential property of any trucks (18-wheel trucks),
provided that certain qualifications were met.
The attempt to provide for a special permit to allow even 18-wheel
trucks to park on certain residential properties, provided certain
qualifications were met, was flawed, both from a legal and an
enforcement stand point. The attempt had to be abandoned as being
unworkable. It quickly became apparent that the ordinance had been
watered down to the point that all the exceptions contained in the
ordinance had become the rule.
The most recent amendment to the proposed Truck Route Ordinance,
represents a back-to-basics approach. By getting away from the
concept that residential parking of certain vehicles should be
restricted, and moving to strictly regulate the travel of certain
vehilles on non-truck routes, the ordinance becomes basic, and
more easily enforceable.

The proposed ordinance makes several changes in the old law. These
changes are:
(1) The parking prohibitions in current Section
25-64 are expanded, retaining the current four
hour limit, but adding a prohibition of certain
vehicles parking on the streets of the City of
La Porte during any nighttime hours;
(2) New definitions have been provided for boat,
daytime, house trailer (specifically meant
to include recreational vehicles), nighttime,
ranch trailer, shipping container, shipping
container storage yard, truck terminal, and
utility trailer;
(3) The definition of light truck is expanded in
order to include one ton trucks;

(4) The definition of truck traffic is restricted,
so as to exclude from the term of the ordinance
boats, house trailer, ranch trailers, and
utility trailers; and
(5) As noted above, the truck terminal exception
to the Truck Route Ordinance has been removed,
and in its place the more enforceable restriction
of the location of truck terminals to designated
truck routes has been added in its place.
Simply put, then, the Truck Route Ordinance now requires commercial
motor vehicles, pull trailers, semi-trailers, shipping containers,
trailers, trucks, and truck trailers to travel only upon designated
truck routes. On the other hand, automobiles, boats, house trailers,
light trucks (specifically including one ton trucks), ranch trailers,
and utility trailers, need not stay on designated truck routes, and
are free to travel anywhere in the City of La Porte. Most importantly,
this ordinance does not restrict the use of private property in any
way, shape, or fashion.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Chapter 25, Article IV, Sec. 25-64, of the
Code of Ordinances of the City of La Porte is hereby amended
to hereafter read as follows, to-wit:
"Sec. 25-64. Parking time limit for trailers,
semi-trailers, etc.
• It shall be unlawful for any person to leave,
stand, or park a trailer, semi-trailer, pole
trailer, ranch trailer, boat, house trailer,
utility trailer, or truck tractor, either
attached or unattached to a motor vehicle, on
the public streets of the City for a period of
time in excess of four (4) hours, or during any
nighttime (as defined herein) hours."
Section 2. Chapter 25, Article V, Sec. 25-80, of the
Code of Ordinances of the City of La Porte is hereby amended,
to hereafter read as follows, to-wit:
"Sec. 25-80. Definitions.
The following words and phrases, when used
in this article, shall, for the purpose of this
article, have the meanings respectively ascribed
to them as follows:
Boat. A water craft not more than twenty-
five feet in length, measured from end to end,
over the deck, excluding shear, and manufactured
or used primarily for non-commercial use; for
purposes of this article only, the term "boat"
shall also include the trailer designed and
used for the transportation of said boat over
the public streets and highways.

• Commercial motor vehicle. Any motor vehicle
other than a motorcycle, designed or used for
the transportation of property, including every
vehicle used for delivery purposes.
Da time. One-half hour before sunrise to
one-our after sunset.
Gross weight. The weight of a vehicle with-
out~ plus the weight of any load thereon.
House trailer. A recreational vehicle,
trai er, or semi-trailer, which is designed,
constructed, and equipped as a temporary dwelling
place, living abode, or sleeping place, and is
equipped for use as a conveyance on streets and
highways.
Light truck. Any truck (as defined in this

to include those trucks commonly known as one-
ton trucks, pickup trucks, panel delivery
trucks, and carryall trucks.
. Nighttime. Any time period other than daytime.
Pole trailer. Every vehicle without motive.
power designed to be drawn by another vehicle
and attached to the towing vehicle by means
of a reach, or pole, or by being boomed or
otherwise secured to the towing vehicle, and
ordinarily used for transporting long or
irregularly shaped loads such as poles, pipes,
or structural members capable, generally, of
sustaining themselves as beams between the
supporting connections.
Ranch trailer. A vehicle with or without
motive power other than a pole trailer,
designed for carrying livestock, ranch imple-
ments, or other moveable personal property
attendant to the business and recreational
use of the raising of livestock or crops.
Semi-trailer. Every vehicle, with or with-
out motive power, other than a pole trailer
or ranch trailer, designed for carrying persons
or property and for being drawn by a motor
vehicle and so constructed that some part of its

Truck tractor. Every motor vehicle designed.

Utility trailer. A trailer as defined herein
without motive power, less than twenty-five feet
in length.
Section 3. Chapter 25, Article V, Sec. 25-84, of the
Code of Ordinances of the City of La Porte is hereby amended,

Section 6. The City Secretary of the City of La Porte shall
• forthwith issue Notice of said election by causing a substantial
copy of this Ordinance to be published one time in the BAYSHORE
SUN, which is hereby found and declared to be a newspaper of
general circulation in said City, not less than ten (10) days
nor more than thirty (30) days prior to the date of the said
election.
Section 7. Upon a candidate tendering his application on
the form prescribed, the City Secretary shall furnish to such
candidate all information relative to the qualifications for
the office being sought; the method of placing the candidate's
name on the ballot; the. amount of the required filing fee; and
any other pertinent information concerning said election.
• Section 8. Each candidate for the office of Mayor or Council-
person must be a resident elector of the City. Each candidate
for the office of District Councilperson must also be a resident
of the district for which he files.
Section 9. The deadline for a candidate to make applica-
tion to have his name appear upon the ballot for•such election,
is hereby designated and established as 5:00 o'clock P.i4.,
Wednesday, Niarch 2, 1983. No application shall be accepted
for filing prior to February 3, 1983. The filing fee for each
candidate for the office of Councilperson is hereby established
as Fifty Dollars ($50.00). 'rhe filing fees shall be used to
defray the cost of the election, and said fees shall be prorated
and any surplus shall be refunded to said candidates. As an
alternative to paying a filing fee, a candidate may obtain a

Section 10. Said election shall be held in accordance with
• the provisions of the City Charter of the City of La Porte, and
the general election laws of the State of Texas governing general
and municipal elections, so far as same may be applicable thereto.
Section 11. Immediately after said election, the officers
holding the same shall make and deliver the returns of the
results thereof and the accompanying records for use in the
official canvass to the City Council of the City of La Porte,
and the City Council shall canvass said returns at the earliest
practicable time, and shall, immediately after canvassing the
returns, declare the results of the election. The Mayor shall
immediately thereafter deliver to the candidate for whom the
majority of votes has been polled for each respective office,
a certificate of election. Such elected officials shall assume
• their duties within ten (10) days thereafter, Sundays excluded,
upon their taking the oath of office.
Section 12. Each and every provision, paragraph, sentence
and clause of this Ordinance has been separately considered and
passed by the City Council of the City of La Porte, Texas, and
each said provision caould have been separately passed T.aithout
any other provision, and if any provision hereof shall be ineffec-
tive, invalid or unconstitutional, for any cause, it shall not
impair or affect the remaining portion, or any part thereof, but
the valid portion shall be in force just as if it Yiad been passed

Several members of Council have inquired of our office as to the
validity of the appointments to the Planning and Zoning Commission
under the present ordinance, which provides for appointment by the
Mayor with confirmation by City Council.
It is my opinion that the appointments of the present members of the
Planning and Zoning Commission, as nominated by the Mayor and con-
• firmed by the City Council, are all valid appointments. The error
in the previous ordinance was the application of a portion of the
powers of the City Council, outlined in Article II, Section 2.09(d),
of the Charter of the City of La Porte, to the Mayor, in the appoint-
ment process. Nevertheless, the Mayor's nominees were confirmed by
the City Council, and, in my opinion, are lawfully appointed.
The appointees to the Planning and Zoning Commission, as all city
officers and appointees, serve at the pleasure of a majority of the
City Council.

I have enclosed a copy of Airco Industry's request for potable water.
As you know Airco Ind. is located on the south east corner of Fairmont and
Bay Area Blvd. in our industrial zone. Airco will require a 3" tap on the
recently installed 12 in. water main to Westinghouse.
Airco will fund the project entirely. This includes the normal front
foot fee payment of $7,927.44 plus the actual cost of installing a 3" water
tap. The estimate of tap fees is not complete at this time.
Note that all requirements of the recently adopted City water use
policy will be adhered to. This will include a reduced pressure zone
backflow preventer.

As per our recent phone conversation and your request, I sub-
mit herewith plot plans 0-168-4P-1 and 5017-062 showing the
meters and bounds of the Airco site requiring potable water.
This site is presently served by a 6" line carrying untreated
Trinity River Water. Filtration and chemical treatment are
used prior to using this water for our process (cooling) water
and lavatories. We have explored the additional treatment
required to make this water potable but have been unable to
• find a system compatible with our limited needs.
At present we employ approximately 20 people on the day shift
and 5 each on the afternoon and night shift. Our estimate
of water usage is approximately 6000 gallons per day. We would
like to tap a 3" line into your existing 12" line on the
north side of Fairmount Parkway adjacent to our property. To
this end, please have your Building Inspection Department send
me the necessary forms to make this tap and the fee required.
I would also appreciate a copy of the City Code covering
material specifications, etc. required for this service.
Upon your approval to make this tap, I will engage the services
of a local engineer to draw up the plans and obtain the easements
necessary to install this line. Please advise if you require
additional information from me at this time. As you know, we
have been very anxious to get potable water to our site and
thank you for your anticipated cooperation in this matter.

Referencing your letter of January 12, 1983 regarding Airco's fire
protection system, the present fire protection system uses a fire
pwrp with the cooling tower sump as its only supply. The cooling
tower system is supplied solely by the City of Houston with Trinity
River water.
I hope the above satisfies your requirement for information on our
fire protection system.
