The meeting was called to order by Mayor Cline at 7:00 P.M. Members of the Cit Council Present: Mayor Virginia Cline, Councilpersons Norman Malone, Jo n Longley, Edward Matuszak, Kevin Graves, B. Don Skelton, Linda Westergren Members of the City Council Absent: Lindsay Pfeiffer, Deotis Gay Members of the City Staff Present: City Manager Jack Owen, City Attorney Knox Askins, City Secretary Betty Waters, Director of Public Works Jerry Hodge, Building Official David Paulissen, Director of Administrative Services Bob Her- rera, Graduate Engineer John Joerns Others Present: Frieda Beaty, Baytown Sun; Barbara Neal, La Porte Broadcaster; Jeff Patterson, Southeast Weekly; Melissa Lestarjette, Bayshore Sun; 9 citizens 2. The invocation was given by City Attorney Askins. 3. The Council considered the minutes of the Regular Meeting of the La Porte City Council held February 2, 1983. A motion was made by Councilperson Longley to accept the minutes as presented. Secon~ounci person Matuszak. T e motion carried, 6 ayes, 0 nays, and l abstain. Ayes: Councilpersons Longley, Matuszak, Graves, Skelton, Westergren and Mayor Cline Nays: None Abstain: Councilperson Malone due to his absence from the February 2, 1983, meeting 4. Mayor Cline proclaimed the week of February 21 through 26 as "Drug Awareness Week." 5. Mr. Tony Gonzales appeared before Council to~request a vari- ante at 518 South Utah to construct a carport. After review of the zoning ordinance, it was determined by the City Council that the official zoning ordinance of the City of La Porte does not allow for a variance to permit a carport which encroaches into the front building set back. • • • Minutes, Regular Meeting, La Porte City Council February 16, 1983, Page 2 6. Mr. Ernie Ganem appeared before Council to discuss the repair of his place of business after a fire on January 22, 1983. The Council listened to Mr: Ganem's presentation. He was requesting permission to reopen his business without rewiring first and without a 2-hour fire wall. City At- torney Askins advised Council it was not within their juris- diction at this time to waive code provisions or to over- ride the action taken by the Building Inspector, and that the Building Inspector was acting properly to enforce the building codes of the City of La Porte. 7. Council considered authorizing the City Manager to enter into negotiations with H.M.S., Tnc., fora data processing contract and appropriated funds. A motion was made by Councilperson Matuszak authorizing the City Manager to negotiate a contract with H.M.S., Tnc., for data processin equipment and a pro- priating 56,350.00 rom the Genera Fund Contingency. Second by Councilperson Westergren. The motion carried, 6 ayes and 1 nay. • Ayes: Councilpersons Longley, Matuszak, Graves, .Skelton, Westergren and Mayor Cline Nays: Councilperson Malone 8. City Attorney Askins read: AN ORDINANCE REPEALING CHAPTER 25, ARTICLE 4, SECTION 25-6Q, OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. A motion was made by Councilperson Skelton to approve and adopt Ordinance No. 135 as read by the City Attorney. Secon y Counci person Graves. T e motion carried, 7 ayes and 0 nays. City Attorney Askins read: A RESOLUTION SUPPORTING THE ENACT- MEND OF HOUSE BILL 194 AND URGING ALL ELECTED OFFICIALS IN THE STATE OF TEXAS TO PASS SAID LEGISLATION AND THE GOVERNOR OF THE STATE OF TEXAS TO SIGN THE SAME PIPELINES WITH ONE EIGHT-INCH (8") PIPELINE; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered approving the execution of an EPA Grant Assistance Agreement and appropriating funds. This Step I Grant would do an infiltration/inflow analysis of the Lomax sanitary sewer system. Administrative Reports: City Manager Owen requested a Special Workshop meeting for March 9 to hear H.D.R.~s report on the Solid Waste Study. 14. Council Action: Councilperson Matuszak recommended that the City Manager approach the County Commissioner concerning appropriate soil being placed on the esplanade on Fairmont Parkway for lands- caping. • Councilperson Skelton reported he had attended the hearing held in County Ju ge Lindsay's Court concerning the beer permit for Sylvan Beach Bait and Tackle. The permit was denied. Councilperson Westergren requested an executive session on personnel to discuss an appointment. Mayor Cline reported on the Legislative Conference held in Austin February 13 and 14. 15. Council adjourned into executive session at 8:35 P.M. Council returned to the Council table at 9:22 P.M. This building is owned by Ronald Tibideaux. Ernie Ganem, has leased this building since 1958. Ernie, had two areas in the building that were not seperated by a firewall. The restaruant area of the building was damaged by fire. This fire damaged wiring common to both areas as well as the non fire rated partition between the two areas. There is only one electrical service. to the building. This was disconnected by the Fire Department at the time of the fire. Late as the afternoon of January 28,1983, the Inspection Department was in- • formed by the Fire Marshal that the lounge portion of Ernies was open for business. After investigation it was determined that electrical service to the lounge area was illegally jumped from a neighboring building. No repairs had been made to the electrical system or the partition. wall. Due to life safty hazards and other. code violations "Buba`Ganem, Ernies sonywas told to remove power to the lounge and close for business. At 4:30 P.M. January 28,1983 power was removed from the building. Mr. Ernie Ganem, visited my office at 4:50 P.M. January 28,1983 to discuss items needed before the club could reopen. Ernie was told that 3 major items were needed, they are as follows: (1) . Have the structure inspected by an engineer and certified n~ i.~Cing'?~hat ,akte building is in a sound condition structurally. (2). Have said engineer design a two hour firewall to seperate and protect the assembly occupancy of the lounge from the damaged area of the building. (3). Rewire the entire club to present electrical code requirements. These above requirements are based on Sec. 10 1,4 (B) of the 1979 Standard Building code. This requires buildings damaged by fire in excess of 50% of the then physical value be made to conform to the codes as a new building. The City • of La Porte has a depreciated taxable value of approximately $32,000.00 on the building The La Porte Ind.. School District has it valued at approximately $ 22,550.00. The Fire Marshal's report indicates $50,000.00 damage. As of this date we have recieved certification from the engineer that the lounge area is structurally sound. We have also recieved a design of the 2 Hr. required firewall. If the firewall is installed as designed and the building is rewired to code the intent of bringing the building up to today's current codes will have been met. If all inspections are made and approved Ernie's will once • again be allowed to open. If I can provide any additional information please contact me. The grant agreement being considered here will provide funds for a Sewer System Evaluation Survey (SSES) utilizing the data from the Infiltration/ Inflow analysis. This SSES report preceeds an anticipated Step 2 + 3 grant application fora sanitary sewer rehabilitation contract. FISCAL SUMMARY: The total grant amount is $74,700.00, 75% is federally funded ($56,025.00) and 25% ($18,675.00) will be funded by the City. In addition there is an estimated $3,000.00 of ineligible expenses to be paid by the City of La Porte bringing the total local contribution to $21,675.00. ACTION REQUIRED: Approval and execution of EPA Assistance Agreement/Amendment • ALTERNATIVES: Do not accept the grant increase. RECON~IDATION: Approve the grant assistance agreement/amendment and authorize the City Manager to execute the agreement. WHEREAS, heretofore previously, House Bill 194 has been filed and is currently before the House of Representatives of the State of Texas; and WHEREAS, said legislation has been submitted to the gen- eral convention of the Texas Municipal League; and WHEREAS, the Resolutions Committee of the Texas Municipal League unanimously approved said legislation, and- the General Assembly of the Texas Municipal League likewise approved said • legislation; and WHEREAS, House Bill 194 provides needed flexibility for cities in the State of Texas to assist the property owners and residents in said cities in securing replacement of sanitary sewer laterals when the same becomes necessary because of the relocation and/or replacement of sanitary sewer mains; and WHEREAS, the health, safety and well-being of every person in any city in the State of Texas is dependent upon an efficient system for the transportation of sewage and wastewater products; and WHEREAS, it may be totally impossible for a resident of a city, faced with an expenditure of in excess of $1,000.00, to secure a low-cost loan for the money necessary to accomplish such replacement of a sewer lateral; and WHEREAS, the residents of Texas cities are fully protected under the terms of such legislation by reason of their options to withdraw in the event the cost for such work is excessive; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA POR E _, TEXAS: 1.
