Members of the Cit Council Present: Mayor Virginia Cline, Counci persons Ed Matuszak, Kevin Graves, Lindsay Pfeiffer, Deotis Gay, B. Don Skelton, Linda Westergren, Norman Malone, John Longley Members of the City Council Absent: None Members of the Cit Staff Present: City Manager Jack. Owen, City Attorney Knox As ins, Assistant City Secretary Cherie Black, Director of Administrative Services Bob Herrera, Director of Public Works Jerry Hodge, Graduate Engineer John Joerns Others Present: Thomas Nation; Charles D. Boyle; two repre- sentatives from Turner Collie & Braden; Linda Castleberry, Bayshore Sun-Broadcaster; Frieda Beaty, Baytown Sun; 8 interested citizens. 2. The invocation was given by Councilperson Gay 3. Council considered the minutes June 16, 1983. Mayor Cline declared the Public Hearing, regarding the request of Thomas Nation to rezone Outlots 38, 39, 40 ,. 41 and 42 of La Porte Outlots, from residential to commercial, to be open. • Mr. Nation reviewed his request for rezoning, stating his reason to rezone the property is to conform with other property in the vicinity. • i • Minutes, Public Hearing and Regular Meeting La Porte City Council July 6, 1983, Page 2 Questions were asked by Council and answered by Mr. Nation. Mayor Cline asked if anyone wished to speak in favor of the rezoning. No one responded. Mayor Cline asked if anyone wished to speak in opposition to the rezoning. There was no response. Mayor Cline declared the Public Hearing closed. Mayor Cline read a memorandum from the Planning and Zoning Commission recommending that one Outlots.$9, 40, 41 and 42 be rezoned, to conform with surrounding properties being zoned commercial only two (2) outlots deep. Motion was-made b Council erson Graves to acce t the recom- mendation o the P annin an Zonin Commission an a rove rezonin o on Out ots 3 an rom Resi entice to Commercia Secon y Counci person Matusza . • City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE N0. 780,- THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF Councilperson Graves amended his motion to: A rove and adopt Ordinance No. 780-AAAA as read by the City ttornev. Second by Councilperson Matusza T e motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Matuszak, Graves, Pfeiffer, Gay, Skelton, Westergren, Malone, Longley and Mayor Cline Nays: None 5. Council considered the request of Charles D. Boyle to close the alley in Block. 831, Town of La Porte, and close 15th Street between Blocks 8.31 and 832. City Manager Owen stated that there are certain drainage swales in that area that he feels that the developer should relocate or show how he proposes to handle the drainage on his plans. Also, he has been negotiating for a 16-foot addition to be added to the 14th Street right-of-way to make room to accommodate a future proposed sewer trunk main, and • Mr. Boyle is aware of this and is working out that agreement. • • • Minutes, Public Hearing and Regular Meeting La Porte City Council July 6 , 1983, Page 3 Motion was made b Council erson Matuszak to a rove the re nest endn satisfactor ne otiations or w atever it takes to insure that we do have the ro er a 'ustments in easement an rainage t at is require . Councilperson Matuszak stated that he .:had spoken with John Joerns and it seems imperative that we do get this easement in order not to stifle future development up and down that road. The closing of this alley will cause some pretty good financial impact on the City if this is closed without any alternate easements being granted. The motion was seconded by Councilperson Westergren. Questions were asked by Council regarding easements, drainage, etc.., and were answered by Mr. Joerns and the City Attorney. Additional 16-foot easements are needed along the 14th Street right-of-way for a major sanitary sewer project. If the City does not get all of these easements and some of the alleys • are closed, it would cause a zig-zag effect and present major problems with drainage. Developers will be asked at the time they submit their site plans to submit their proposed drainage improvements, including the relocation of any existing drainage swales. Mr. Matuszak stated he felt it was imperative to get all the. easements up and down the street so as not to be blocked in at this point and if it takes this type of a negotiation at this point then we should prudently do this. More dis- cussion followed. City Attorney Askins proposed that before Mr. Boyle is given a certified copy of the alley closing ordinances, the City prepare a letter for Mr. Boyle's signature and the Mayor or Mr. Owen's signature, granting the City an easement of the west 16 feet of Block 830 in exchange for the City closing the alley in Block 830. City .Attorney Askins read Ordinance 1367: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK EIGHT HUNDRED THIRTY-ONE (831), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; and Ordinance 1368: AN ORDINANCE VACATING, ABANDONING AND • CLOSING A PORTION OF SOUTH 15TH STREET; AND PROVIDING AN EFFECTIVE DATE HEREOF. • • Minutes, Public Hearing and Regular Meeting La Porte City Council July 6, 1983, Page 4 Mayor Cline asked if Councilperson Matuszak wished the adoption of the Ordinances to be a part of his motion. He answered in the affirmative. Councilperson Westergren restated her second. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Matuszak, Graves, Pfeiffer, Gay, Skelton, Westergren, Malone, Longley and Mayor Cline Nays: None 6. Council considered awarding a bid for cold mix patching material. Two bids were received. Azrock was the low bidder. None Council then consented to deviate from the order of business and consider item 8, since item 7 needed to be considered in conjunction with items 9, 10, 11 and 12. 8. Council considered the request of Decker McKim to close the alleys in Blocks 1098 and 1134, Town of La Porte. City Manager Owen told Council Mr. McKim has withdrawn his request to close K Street. John Joerns had talked with r1r. McKim and Mr. Joerns asks that Council not take action on this item until some negotiations can be concluded. Council returned to the Council table at 9:.01 P.M. 7. Council considered payment to Sears & Burns,. Attorneys at Law for payment of legal fees- through May 31, 1983. This is a termination agreement for the Sewer. Rehabilitation Project. Motion was made b Councilperson Westergren to authorize the riayor to sign an agreement with Busch, Hutchison terminating their contract for en ineerin services on the Sewer Rehabili- tation project. City Manager Owen stated that Chief Freeman is working on revising our hurricane and disaster plan and should have it ready for review soon.. He announced that at the next workshop RIMCO will present the insurance report. and it will probably be rather lengthy. The meeting will begin at 6:.00 P.M. 14. Council Action: Matuszak: Thanks to Jack Owen and staff for getting the es~nade project back on .track; is looking forward to the successful completion of it within a couple of weeks. Graves: The business at the corner of Barbour's Cut Blvd. an 6 is again a trashed-out looking place. There is a truck falling off of its dollies and junk piled almost to • the road again. C~ • • Minutes, Public Hearing and Regular Meeting La Porte City Council July 6, 1983, Page 7 Pfeiffer: Commended the staff for an excellent performance on Ju y 4. Probably one of the largest turnouts we've had. ~: Also commended Mr. Owen and staff. The youngsters seemed to really enjoy it; it was a wonderful thing for them. Skelton.: Has Mr. Owen found out anything on the cat ordinance? He is still getting calls regularly. Can we get more traps or do we need this on a workshop? Mr. Owen stated more traps will be added. Mayor Cline said they work very successfully.... Malone: Commended the newspaper on the letter they published about our Police Department. We need more letters like this commending our Police Department and other City employees. There has been a lot of flooding on "L" Street - he noticed many cups and debris that had been thrown out along the high- . way and they were blocking the drainage. We need to caution people somehow to be more aware of not littering the streets. Lon le Commended the Police Department on enforcing the true ordinance in Fairmont Park subdivision. He saw them helping one young man move his truck. He is still having a problem with dogs. Cline: Thanks for the many get well wishes received while e was in the hospital and for the flowers. It made her feel better to know someone was thinking about her. A lot of work went into the fireworks display.- Tim Anderson, Bill Baggett, Jackson Ray, Mark Lewis and Stan Sherwood spent many hours setting up for the display. She very cautiously set off the first fuse. They did an outstanding job and they hope to keep improving it each year. .What the public doesn't realize is that after the display is over there is still a lot of work to be done, dismantling the mortars, etc., and this takes awhile, also.. They are to be commended, and it is great that we have employees like that working for the city. 16. Mix Limestone Rock Asphalt Pavement - Grades A-D" were opened and read in the Council Chambers • May 9. 1983 at 4:00 PM. .Sealed Bids were received from the following vendors: (1) Whites Mines (2) Azrock Industries Inc. Cold mix will be purchased on an as needed basis for the stockpile located the Public Works Service Center. Low bid was submitted by Azrock Industries in the amount of $24.63 per ton on orders of over 1000 tons and $25.99 per ton on orders of less than 1000 tons. Azrock Industries Inc. will offer a one year contract with a fixed price for ninety days. Any increase or decrease in pricing after this period of'time will be based on fluctuations in the price of flux oil in the spot market. The City of La Porte must receive thirty days written notice of any proposed increases with proper documentation of the increased cost of raw material. • Azrock Industries 1983 bid price reflects a $.58 per ton decrease (2X) from the present contract price of this material. The City of La Portes' present contract will expire on May 30, 1983. I hereby recommend accepting the low bid from Azrock Industries for the purchase of "Cold Mix" and that a one year contract be executed. The TDWR did not see any problem with the City of LaPorte issuing separate contracts for cleaning and television inspection of the sewers in the rehabilitation project or for emergency repairs to the Catlett Lane sewer. 2. The EPA award amount will not be increased because of any of the extenuating circumstances of the LaPorte project. There is approximately $166,000 remaining in the grant. • 3. The TDWR stated that as long as remaining items for the rehabilitation project had eligible cost equal to the remaining .grant, the City of LaPorte could receive all remaining grant money. The estimate of remaining eligible cost for the project is over a half million dollars. 4. The effects of separate contracts for the project on bonding is not the concern of the EPA or TDWR. The City of:LaPorte should have its lawyer review the effects of separate con- tracts on bonding. 5. Since LaPorte has a population less than 25,000, the appli- cable 1978 procurement regulations provide the City of LaPorte the option to negotiate directly for a new engineer. As we discussed in the June 23 meeting, this action will require removal of the subject length of line from the EPA funded project. There appears to be more than a sufficient amount of work remaining in the EPA project to expend the amount of EPA funding remaining.
