The Regular Meeting of the La Porte City Council was called to order by Mayor Cline at 7:00 P.M. Members of the City Council Present: Mayor Virginia Cline, Councilpersons Kevin. Graves, Lindsay Pfeiffer., Deotis Gay, B. Don Skelton, Linda Westergren, John Longley and Edward Matuszak Members of the City Council Absent: Councilperson Norman Malone • Members of the City Staff Present.: City Manager Jack Owen, Assistant City Attorney John Armstrong, Assistant City Secre- tary Cherie Black, Graduate Engineer John Joerns, Director of Parks and Recreation Stan Sherwood, Assistant Director of Public Works Steve Gillett Others Present: Sue and Peter Lenes; Rory Miggins; Ginger Thompson; Representatives from Turner Collie & Braden; Linda Castleberry, Bayshore Sun-Broadcaster; Susan Humphrey, Baytown Sun.; 8 interested citizens 2. The invocation was given by Councilperson Gay 3. Council considered approving the minutes of the public hearings and Regular Meeting held July 20, 1983. Motion was made. by Councilperson Longley `to approve the minutes of the July 20, 1983, meeting as presented. Second by Council- person Pfeiffer. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Graves., Pfeiffer, Gay, Skelton, Westergren, Longley, Matuszak and Mayor-Cline Nays: None 4. Mayor Cline .presented. the Employee of the Month: award for June to Sue Lenes.. Sue was given a certificate of appreciation for her outstanding contributions to the City. 5. Council considered a request from the Waterfront Festival to send correspondence to Jim Fonteno to approve a temporary beer license on Labor Day Weekend for the Waterfront Festival to be held at. Council considered granting a variance to the subdivision ordinance to Mrs. Norma Hootman. Motion was made by 'Councilperson Skelton to grant the variance on building a street to Mrs.. Norma.Hootman with the stipulation that it be applied to one residence only and that an agreement be drawn. to that effect. Second by Councilperson Gay. The motion carried, 8 ayes and O nays. Ayes: Councilpersons Graves, Pfeiffer, Gay, Skelton, Wester- gren, Longley, Matuszak and Mayor Cline Nays: None 7. Council considered hiring a firm to prepare the City's Compre- hensive Plan. Motion was made by Councilperson Matuszak"to:accept staff's recommendation to hire Turner.. Collie & Braden to prepare the Com rehensve Plan and Sewage Master. Plan for the City at a price not to exceed $204,430, and to appropriate 56,0.00 from the Contingency Fund to cover the amount nat u gEte Second by Councilperson Westergren. T e motion. Council considered appointing. a member to the Appraisal Review Board. Motion was: made by Councilperson Skelton to appoint Sam Sailer to the unexpired term of Charles D. Boyle on the Appraisal Review Board. Second by Councilperson Graves. The motion Carrie 8 ayes and O nays. BOYLE, ON THE CITY OF LA PORTS APPRAISAL REVIEW BOARD; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was_made by Councilperson Skelton to approve and adopt Ordinance No. 1371 as read by the Assistant City Attorney. Second by Councilperson Graves. The motion car- red, 8 ayes and 0 nays. Ayes: Councilpersons Graves, Pfeiffer, Gay, Skelton,. Westergren, Longley, Matuszak and Mayor Cline Nays: None 9. Council considered approving a homestead exemption for tax year 1984. After discussion, motion was. .made 'by Councilperson Skelton to grant a 20 percent .homestead .exemption .for tax year 1984. Second by Councilperson Matuszak.. Assistant City Attorney Armstrong read Ordinance No. 1372: AN ORDINANCE AMENDING CHAPTER 23, "T1~XATION," OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTS, BY .ADDING SECTION 23-4 THERETO, EXEMPTING TWENTY PER CENT (20~) OF THE MARKET VALUE OF RESIDENCE HOMESTEADS, BUT NOT LESS THAN-FIVE THOUSAND DOLLARS ($5,000.00), FROM ALL AD VALOREM TAXES LEVIED BY THE CITY OF LA PORTS FROM. AND AFTER JANUARY 1, 198.4; FINDING COMPLIANCE WITH-THE OPEN MEETINGS LAW; AND ..PROVIDING AN EF- FECTIVE DATE HEREOF. The motion carried., 7 ayes and 1 nay. After discussion by Council, motion was made by Councilperson. Skelton to place this item back on_the August l0 workshop agenda for fuf'ther stud and then on the regular. agenda for August 17. Second by Councilperson Matuszak. The motion carried, 7 ayes and 1 nay. Council considered appointing a member to the Industrial Development Corporation. Motion was made by Councilperson Pfeiffer to amend Article VII of the Articles of Incorporation. of the City of La-Porte Industrial Development Corporation. by appointing Jerry Dennis to the vacancy created by the resignation of Douglas F. Lati- mer, Jr. Second by Councilperson Graves.. The motion carried, 8 ayes and 0 nays... Ayes: Councilpersons Graves, Pfeiffer, Gay, Skelton, Westergren, Longley, Matuszak and Mayor Cline Nays: None 12. Council considered awarding a bid for a security system at the Public Works Service Center. Motion was made by Councilperson Graves to accept'staff's recommendation and award the bid for a securit .system for the Public Works Service Center to ADT in the amount of $12,130. Second by Councilperson Pfeiffer... The motion carried, 8 ayes and 0 nays.. Ayes: Councilpersons Graves, Pfeiffer, Gay, Skelton, Westergren, Longley, Matuszak and Mayor Cline Nays: None 13. Council considered permitting W. A. Silvey, Jr., to dig a well. Mr. Silvey is planning a 60 acre. mobile .home park in the Spen- wick MUD. He has a permit. to build a package sewage treatment plant and has requested permission from the Harris-Galveston Coastal Subsidence District to drill a 10-inch well to produce 350 gallons per minute. Council needs to consider whether or not to Appose the issuance of the well permit. The area is within the City's ETJ and within the jurisdiction of the La Porte Area Water Authority. It is felt by City Manager Owen that if Council wishes to oppose the well permit, the City should be prepared to furnish the water that is needed. Staff recommends to oppose the issuance of the well permit due to subsidence, and to supply the water needed. Discussion fol- lowed. Mr. Cary Burnley of College View MUD was in the audience, and stated that College View MUD had opposed the permit. Motion was .made by Councilperson Matuszak to oppose the permit to allow W. A. Silvey, Jr .., to dig a well. Second by Council- . person Skelton. The motion carried, 8 ayes and O nays. Council considered awarding a bid for traffic signalization maintenance. After discussion, motion was made by_Counclperson Westergren to reject. the-bids received and.rEbid the traffic signaliza- tion maintenance project. Second by Councilperson Pfeiffer. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Graves, Pfeiffer, Gay, Skelton, Westergren, Longley, Matuszak and Mayor Cline Nays: None 15. Administrative Reports: City Manager Owen. asked. to-set budget workshop essions for August 29, 30, 31 and September l and 2, beginning at 5:30 P .M . on each date . Mr. Owen asked for an executive session on land acquisition and a legal matter. T6. Council Action: Graves: Thanks. for the smaller agenda. Would like to know how many studies and much has been spent on them in the last year and a half. It seems like a lot to him. Asked for an executive session on a contractual matter. Gam: Thanks to the wonderful people for coming out;. he is happy to see their smiling. faces. Skelton: We have two La Porte Area Water Authority. members in the audience tonight and we're glad to have them. Longley:. Wondered if everyone could hear him with the new microphone set-up. He is impressed with it. Matuszak: The award to Sue Lenes was well accepted as far as he is concerned. She's just dynamite and he certainly enjoys calling City Hall on a daily basis. Urges anyone who knows someone in the BayMud area to get them to vote August 13 one way or the other on the annexation. 1Z. Motion was made by Councilperson Graves to adjourn into exec- utive session. Second by Councilperson Pfeiffer. Council adjourned into executive session at7:55 P.M. and returned to the Council table at 8:54 P.M. 18. There being no further business to be brought before the Council, the meeting was duly adjourned at 8:55 P.M.
