Re: Closing of Alley in Block 1123
Dear Mayor, Councilwoman and Councilmen:
The shopping center development taking place on the
corner of Fairmont Parkway and Broadway is causing serious
interest in a similar development of Block 1123, lying
between the Auction Barn and the Pizza Inn.
It cannot be developed unless the alley is closed. On
behalf of the owners of Block 1123, I respectfully request
that its alley be closed as soon as possible.

The Public orks Department has investigated the request to close the alley
in Block 1123. An eight (8) inch sanitary sewer line is located in this
alley, but investigation revealed that a fifteen (15) inch sanitary sewer
line runs parallel with it, and the line in the alley serves no on. In
addition, the line in the alley runs only through this block.
The Public Works Department has no objection to abandoning the line and alley,
and will plug the line upon closing the alley.
If you should have any questions, please advise.

ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY
IN BLOCK ELEVEN HUNDRED TWENTY-THREE .(1123), IN THE TOWN OF
LA PORTE, HARRIS COUNT Y, TEXAS.
WHEREAS, the said alley in Block Eleven Hundred Twenty-three
(1123) of the Town of La Porte has never been opened or used as
a public thoroughfare, and the public utilities now making use
of such alley have all given their written consent for its
closing; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that
the said alley is not suitable, needed, or beneficial to the
public as a public alley, and should be vacated, abandoned and
permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE
Section 1. The alley located in Block Eleven Hundred
Twenty-three (1123) of the TOWN OF LA PORTE, Harris County,
Texas, is hereby permanently vacated, abandoned and closed by
the City of La Porte .
Section 2. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Te xas Revised Civil Statutes Annotated; and
that this meeting .has been open to the public as required by
law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting
thereof.

Section 3. This Ordinance shall take effect and be in
force from and after its passage and approval.

WHEREAS, the City of La Porte owns and operates the La Porte
Nfunicpal Airport; And,
o~TfiEREAS, the City of La Porte i`fiunicipal Airport has been and will
be designated a reliever airport by the Federal Aviation Administration;
And,
WHEREAS, the City of La Porte Municipal Airport has in excess of
two hundred (200) based aircraft and a high activity of transient aircraft;
And,
WHEREAS, the safety of airport users would'be jeopardized by the:
operation of ultralight aircraft; And,
WHEREAS, the City of La Porte is having prepared an Airport boaster
Plan by qualified consultants.
NOW, THEREFORE be it resolved that the City of La Porte
(1) Prohibits the operation of ultralight aircraft at'the City'of
La Porte Municipal Airport for safety reasons, And,
(2) The City of La Porte shall instruct the Airport Master Plan
consultants to further investigate the use of ultralight aircraft at
the La Porte bunicipal Airport to determine if the operation of these
aircrafts can be included in normal aviation activity at the La Porte
P~unicipal Airport without creating a safety hazard.

use for the alley in Block 1123 However- if Council decides to close the alley
the sanitary sewer should be properly ~luQaed at each end at the owner's expense
and the City should require a hold harmless statement to ~rot~ct the Cj.~y from
~occil,lP liability if owners decide. to build over the line.
