The public hearing on dangerous buildings and regular meeting of the La Porte City Council was called to order by Mayor Cline at 7:00 P.M. Members of the City Council Present: Mayor Virginia Cline, Councilpersons Lindsay Pfeiffer, Deotis Gay, B. Don Skelton, Linda Westergren, Norman Malone, John Longley, Ed Matuszak and Kevin Graves Members of the City Council Absent: None . The invocation was given by Councilperson Gay 3. Council considered approving the minutes of the Regular Meeting held September 7, 1983. Motion was made by Councilperson Skelton to approve the minutes as presented. Second by Councilperson Malone. The motion carried, 8 ayes, 0 nays, 1 abstain. Ayes: Councilpersons Pfeiffer, Gay, Skelton, Westergren, Malone, Longley, Matuszak and Graves Nays: None Abstain: Mayor Cline, due to her being out of the City on that date . e e . Minutes, Public Hearing and Regular Meeting La Porte City Council September 21, 1983, Page 2 Director of Administrative Services Bob Herrera introduced Debra Cole, new Chief Accountant and Finance Officer, to the Council. 4. Mayor Cline called the public hearing on dangerous buildings to order. The list of dangerous buildings was read by the Mayor as follows: 100 block North 3rd Street Block 57, Lots 31-33, La Porte Ed Wolf, 811 Bayshore Drive, La Porte 203 South "Y" Street, Oakhurst Addition Block 1, Lot 4 Ed Crather, 203 South "Y", La Porte 402 North 2nd Street Block 86, Lots 14~16, La Porte Adam Sinegal, P.O. Box 389, La Porte . 431 North Broadway Block 85, Lots 29, 30, La Porte Edna B. Palmer, P.O. Box 1102, Liberty 500 South Lobit Block 35, Lots 23-26, Bayfront Mary Wilson, 4210 Rusk Avenue, Houston 700 Block South Blackwell Block 25, Lots 17, 18, Bayfront J. M. Stout, Box 8012, Anchorage, Alaska 10529 North Avenue "p" Outlot 381, Tract "C", La Porte Gerald Chapman,10529 North "P", La Porte Mayor Cline asked if there was anyone who wished to speak in regards to any of these buildings. . Mr. Gerald L. Chapman, representing Gerald Chapman, spoke regarding 10529 North "P". He explained that he had been in the City only a few weeks and that his brother had been trying to demolish the remains of the house which had burned. He has made arrangements for a front end loader, : !but was delayed in getting it because of the hurricane. He asked for an extension of at least 2 weeks in order to get the debris cleared away. Mr. Chapman was granted a 2-week extension. e e . Minilltes, Public Hearing and Regular Meeting La Porte City Council September 21, 1983, Page 3 Mr. Ed Wolf spoke regarding the property located in the 100 block of North 3rd Street. He stated he felt this property was not dangerous. He is using it for storage and it has been boarded up since the hurricane. He has been repairing it for some time. Slides of the building were shown to Council and the dan- gerous areas pointed out. After discussion, Council re- quested that the dangerous openings around the building and the windows be boarded up immediately so children cannot get into the building. Mr. Wolf will work with the Inspection Department to bring the building to a safe level within 120 days from the time the permit is taken out. . Jonathan Stout spoke for his father,J. M. Stout, regarding the property in the 700 block of South Blackwell. He stated his father is in Alaska. His father had requested that he get outside bids to get the house rebuilt from the ground up but that it would be around October 6 before the esti- mates were in. He requested an extension until he could get the estimates to his father and see what he wanted to do. Mayor Cline reminded Mr. Stout that this building had been declared dangerous and needs to be demolished. Mr. Stout said they wanted to tear it down themselves and use what material they could salvage to rebuild, to restore the building as much as possible to its original form. Mr. Skelton stated he had had numerous calls on that house and he had looked at it himself, and in his opinion there is nothing in that house that can be salvaged due to termite damage, etc. He recommends that the house be demolished as planned. Mr. Stout will be given time to remove some items out of the house. Mrs. Mary Wilson spoke regarding the property at 500 S. Lobit. She wished to know the cost of demolishing the building. The cost and what it included was given at $1,000 for her particular building. She was informed that a system of monthly payments could be arranged over a year if she so desired. . Councilperson Gay spoke for Adam Sinegal on the property at 402 North 2nd Street. Mr. Sinegal will get in touch with the Inspection Department. Mr. Gay said he will demolish his mother's old place himself. e e . The property in the 100 block of North 3id belonging to Mr. Ed Wolf will be taken off the demolishing list, and he must take out a building permit within 30 days and board up the open places in his building. The property at 10529 North Avenue "P" belonging to Mr. Gerald Chapman will be taken off the demolishing list and must be cleaned up in 30 days. 5 . Council considered awarding a bid for demolition. Council erson Wester ren to award the b1 for emo 1t10n to Daniels' Dump Truck Hauling. Second by Councilperson Skelton. Council considered closing the alley in Block 830, Town of La Porte. City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK EIGHT HUNDRED THIRTY (830), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. Motion was made by Councilperson Skelton to adopt Ordinance 1381 as read by the City Attorney. Second by Councilperson Pfeiffer. The motion carried, 7 ayes, 1 nay. Ayes: Councilpersons Pfeiffer, Skelton, Westergren, Malone, Longley, Matuszak and Graves Nays: Mayor Cline Councilperson Gay was away from the Council table at this time. P8 . Jimmie Ray Spradling spoke to Council regarding his feelings on the inequity of the sewer rate in comparison to the water rate and the fact that not all water went through the sewer. He asked if there was a solution, at least for the summer months, when people water their yards and plants. Paula Bridges spoke to Council regarding water/sewer/garbage rate increase. Council considered an ordinance regulating water and sewer rates. City Attorney Askins read: AN ORDINANCE AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND SEWAGE DISPOSAL," OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; ESTABLISHING A NEW RATE AND FEE STRUCTURE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made'by Councilperson Pfeiffer to approve and adopt Ordinance 1382 as read by the City ,Attorney. Second by Councilperson Graves. The motion carried, 7 ayes and 2 nays. Ayes: Councilpersons Pfeiffer, Gay, Skelton, Westergren, Malone, Matuszak and Graves Nays: Councilperson Longley and Mayor Cline 10. Council considered an ordinance regulating garbage rates. City Attorney Askins read: AN ORDINANCE AMENDING ARTICLE III, SECTION 12-41, ET. SEQ.,"GARBAGE AND TRASH," OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; REFLECTING A NEW RATE STRUCTURE FOR RESIDENTIAL AND COMMERCIAL GARBAGE AND TRASH COLLECTION; CONTAINING A SEVERABILITY CLAUSE; FINDING COM- PLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFEC- TIVE DATE HEREOF. Motion was made by Councilperson Pfeiffer to approve and adopt. Ordinance 1383 as read by the City Attorney. Second by Councilperson Malone. The motion carried, 6 ayes and 3 nays. Council considered an ordinance adopting the tax rate for fiscal year 1983-84. Mr. Owen reviewed the budget. City Attorney Askins read: A RESOLUTION APPROVING AND ADOPTING THE BUDGET FOR THE CITY OF LA PORTE, TEXAS, FOR THE PERIOD OCTOBER 1, 1983, THROUGH SEPTEMBER 30, 1984, FINDING THAT ALL THINGS REQUISITE AND NECESSARY HAVE BEEN DONE IN PREPARA- TION AND PRESENTMENT OF SAID BUDGET. Motion was made by Councilperson Longley to adopt Resolution 83-20 as read by the City Attorney. Second by Councilperson Matuszak. The motion carried, 7 ayes and 2 nays. Administrative Reports City Manager Owen reminded Council that the Comprehensive Plan would be discussed at a public meeting on Monday, September 26 at 7:00 P.M. in the Council Chambers. Skelton: Knows most all the Council would like to vote no on the budget and say we'd like to get by on about half the amount that's in the budget, but we all worked hard on this for a lot of nights, and this is the best of two worlds that we could come up with. This was in general agreement with the majority at the workshops. So with those considerations, and looking ahead for the future of this city, in a way that will give our folks a better place to live, I felt that we had to support this. Whether I was for it or not, I had to support it. Westergren: A lot she could say about what went on tonight, the water rates, sewer rates, garbage rages, budget - but I think I'll pass. Malone: Didn't want to raise the budget any more than we had to, especially the water rates, because his bill is pretty high, too. Appreciates Mr. Owen and his crew working hard on this budget. Most especially appreciates the way it was handed to us. Doesn't remember getting sheets like this before, and it made it very easy to see what we have. Would like to welcome Debra on board, who is heading a department that's very close to his heart. Matuszak: Welcome, Debra. Bob Herrera did an outstanding job of getting the budget together and deserves consider- able praise, as does the rest of the staff that contributed to it. Didn't really want to have to raise any of the rates, probably nobody did, but we have to face the facts that they were needed. City employees will be honored tomorrow at 5:00 P.M. at the Firemen's Hall in appreciation of the work they did during the hurricane; he intends to be there. 18. Council adjourned into executive session at 9:16 P.M. and returned to the Council table at 9:36 P.M. Item 14 was then taken up by Council, being appointments to the La Porte Area Water Authority. Motion was made by Councilperson Graves to reappoint Travis Doughty and .;Terry Bramlett to the La Porte Area Water Authority and to name the third person at the meeting of October 5. The log house at 719 S. Blackwell is one of the oldest log houses in East Harris County. Since 'we bought it we have purchased all of the adjacent land we could get. The house has some historical significance. It was built over the spot where the soldiers were mustered out of service after the battle of San Jacinto. We used to have many with metl detectors coming by to try to find something of value, from our historical past. But of more significance is the fact that it was in this house that the first book to leave our planet for another celestial body (the moon) was r made. Aerospace Ministries has designated this house as an historical place. Through the Vice President who was one of the committee members responsible for putting the bible on the moon, Aerospace Ministries is hoping that this would become some sort of national land mark. (The old landmark down by sylvian beach, which burned a few years ago, just about did away of all of the landmarks that LaPorte has to offer, except for that gastly looking terminal building-~hat someone moved down by the park.) Nevertheless, in spite of its historical significance, the various hurricanes which have come through LaPorte has taken its tole. For years we have fought with the city to construct an adequate deep drainage ditch along the road, but have failed. During Hurricane Carla water entered the house. We were in the house during another storm when two feet of water came into the house. Two years ago, when we were last in LaPorte, or the beginning of last year, we made three decisions related to the structure. (1) we would bring fill into the adjacent lots so that, if the house were reconstructed for historical purposes it would be at a elevation that it would. be on a solid foundation, and not suffer the pains it has suffered in the past. (2)We would reconstruct the fence around the place, and we would give to Aerospace Ministries the building as an historical object, if they wanted it. When we were there we began reconstructing the fense around the place, to conform to the spot where the ortginal wire fence had gone around the adjacent lots and the lots where the house stands. The front part was not completed, because about 31,000 cubit feet of fill had to be brought into the lots. &-1 e . ..-:::=- e .. Hurricane Alicia brought about two and a half feet of water into the house, and so damaged the house to a point that it may not be feasible to reconstruct the house as a landmark like we had wanted. If we can get a low-interest loan, we would reconstruct all the way up to the window level with new materials, replace the structure with a new structure. In discussing the matter with the board of directors of Aerospace Ministries, enough of the building should be salvaved and reconstructed to indicate the historical achievement that occured in the house. The following steps, to conform to the city's desire to do something about the structure, have been planned for some time. We are only reasserting them at this time. e 1. Complete the land fill up to the level required by the city - this is up to the top edge of the cross ties across the front of the property. 2. Level and pack the fill and clean off all brush. 3. Demolish and move the garage? structure and its contents. 4. Disconnect the electricity. 5. Complete the fence after the fill is complete. 6. Complete the purchase of two small triangles of land, locked into the ,back of our property so that the entire area can be secured.' 7. Assist Aerospace Ministries in their fund raising drive to procure funds to restore this building. The drive is to begin this Christmas and go for three months only. 8. An assessment is to be made by the fifteenth of April of immediate steps to be taken to restore the building. 9. If the drive is unsuccessful, and/or a low-interest loan cannot be secured, Aerospace Ministries has been informed that the building would be torn down and they have been assured that enough of the logs would be saved and stored so that they would form at least one wall in some sort of historical monument. e 10. While I sympath~ze with your wish to salvage at least a portion of the house at 719 South Blackwell for historical preservation. I am afraid you were correct when you surmised damage from Hurricane Alicia was severe enough to render the hous~ un-salvagable. Because of this we (The Board of Inspections) will stand by our recommendation that the house be demolished. If the City's demolition contractor demolishes the house, it will be taken to the ground and all materials will be removed from the site. If you or Aerospace Ministries wish to salvage any material from the house, 4It it must be done prior to the demolition contractor arriving on the site. The timetable as it stands now is as follows. Bid opening for demolition contractor will take place Monday September 19,1983. The public hearing will take place Wednesday September 21,1983, Thursday 22,1983 the demolition contractor will be released to begin tearing down all the buildings council has chosen to condem. Such report shall state the circumstances and the condition of the building upon which such conclu- s ion was based. Sec. 26-19A, of Article II, Chapter 26, of the Co de of Ordinances of the Ci ty of La Porte, shall be amended to hereafter read as follows, to-wit: e "Sec. 26-19A. Water and Sewer Rates and Fees. "Upon recommendation of the Director of Public Works, the City Council of the City of La Porte, pursuant to the directives established in Article I I of Chapter 26 of the Code of Ordinances of the City of La Porte, hereby establishes the following rates and fees: "(a) Sec. 26-11(a) Each single-family' dwelling unit individually metered for the consumption of water shall be charged for water service furnished by the City a base rate of $4.50, covering the first 2,000 gallons of water consumed (or a part thereof). All consumption in excess of 2,000 gallons, or any part thereof, shall be charged at the rate of $1.60 per 1,000 gallons. e "(b) Sec. 26-12A For every water meter functioning properly upon which a request for testing is received, there shall be a charge of $25.00 for each test. This charge shall not apply' to any request to test a meter which is found to be not functioning properly. " (c) Sec. 26-13 (c) - Re connect fee: I)j ring regular hours (9:00 A.M. to 5:00 P.M.), the reconnect fee shall be $7.50; after the aforementioned hours, the reconnect fee shall be e $15.00. !,-,\ e e e Ordinance No. \, ~:J- , Page 2. "(d) Sec. 26-l3(d) - In cases where any person gives the City a check in payment of water and sewer services which is not honored by the drawee bank for any reason, an additional charge shall be levied against such person of $10.00. "(e) Sec. 26-14 - Deposit Schedule: 1. Single-family residence consumers shall place on deposit the sum of $30.00~ e 2. The deposit for commercial water consumers shall be established at the discretion of the Director of Public Works, upon standards set forth in Se c . 2 6 -14 ( c) ~ 3. The deposit for multiple-family dwellings [as defined in Sec. 26-l4(d)] shall be set at the discretion of the Director of Public Works, in reliance upon the standards set forth in Sec. 26-l4(c) of Article II, Chapter 26 of the Code of Ordinances of the City of La Porte. "(f) Sec. 26-15 - Sewer Service Charges: 1. Each single-family dwelling unit individually metered for the consumption of water shall be charged for sani tary sewer service a basic monthly charge of $4.25, plus 70% of the "net" water bill~ 2. Commercial connections shall pay for sani tary sewer service at the same rates as single-family dwellings; e 3. The monthly sewer service charge for duplex units, apartment units and individual trailer units in trailer courts, with units not individually metered for water, will be determined by multiply- ing the rate of $4.25 times the number of indi- vidually constructed duplex or apartment units, or times the number of existing trailers in the project; plus 70% of the total "net" water bill for the current month." Section 2. Ray - Purchasing Age d Concrete Pipe Advertised sealed bids #0014 for the purchase of "Reinforced Concrete Pipe" were opened and read in City Council Chambers August IS, 1983 at 4:00 P.M. Bid packages were mailed to seven concrete pipe producers with responses being received from the following venders; (1) Gifford-Hill Pipe Co., (2) Monroe Ferrell Concrete Pipe Co., and (3) White Supply Inc. Reinforced concrete pipe is purchased by the Street Division on an as needed basis for use i~ their continuing drainage rehabilitation program. Competing venders bid firm prices for 6 months with an escalation clause based on in- creased prices in raw material. Sealed bids were divided into two sections with Section I being composed of various diameters of pipe' and Section II being composed of miscellaneous items used in pipe installations. Low bid in Section I was Gifford-Hill Pipe Co. of Houston, Texas and low bid on Section II was White Supply Co. of Bay town, Texas. Pricing in Section I decreased from 1982-83 contract prices on the average of 3% to 4%. Pricing in Section II decreased from 30% to 57% over prices currently being paid in the spot market. I hereby recommend awarding a one-year contract to Gifford- Hill Pipe Co. to supply all items in Section I and a similar contract to White Supply Company for all items in Section II. Our findings indicate that: (a) The hardware in the micro field with the longest track record for surveying and other technical applications is Hewlett-Packard. Hewlett-Packard also provides considerable upward mobility. I (b) The software available runs from approximately $1,500 to $5,000, The two most impressive software packages have been one provided by Hewlett-Packard and one provided by Lewis & Lewis Company. Both of these packages are under $3,000 and are designed to run specifically on Hewlett-Packard hardware. A software conversion at a substantial additional cost (estimated $5,000 - $8,000) would be required in order to operate with other brands of hardware. Additional Highlights Software (1) The Lewis & Lewis software besides providing all the normal surveying functions also includes alpha-numeric capabilities up to- 16 characters for labeling at points. (2) The Lewis & Lewis Company is a surveying/engineering company which also markets software. Their daily contact with surveying and engineering problems provides them with the needed insight to produce practical and well-documented software. (3) The Lewis & Lewis Company provides an update service which will keep us abreast of ongoing changes and enhancements at a cost of $100/year. (4) The necessary software to begin operations is marketed at an estimated cost of $1,500.00. Hardware (1) Hewlett-Packard hardware has an extensive track record in the technical fields and also has Houston based maintenance operations. (2) The City already has a Hewlett-Packard 41C calculator which can be used as a field data collector with the HP 86 B computer. AGREEMENT OF LEASE THE STATE OF TEXAS ~ ~ COUNTY OF HARRIS ~ Th is Agreement of Lease made by and between FRATERNAL ORDER OF EAGLES, BAYSHORE AREA 2753, known herein as LESSOR, and the CITY OF LA PORTE, a municipal corporation, known herein as LESSEE, both of Harris County, Texas, WIT N E SSE T H: LESSOR does, by these presents, lease and demise unto LESSEE the following described property, lying and being situated in the City of La Porte, Harris County, Texas, to-wit: Lot Seventeen (17) through Twenty-four (24), both inclusive, Block One Hundred Forty-nine (149), TOWN OF LA PORTE, Harris County, Texas, according to the map or plat thereof recorded in the office of the County Clerk of Harris County, Texas, reference to which is here made for all purposes, upon the terms, conditions, covenants and agreements following: I. The term of this lease shall be from the 1st day of June, 1983, to the 31st day of May, 1984, and continuing automatically thereafter, until cancelled by either party, upon sixty (60) days written notice to the other party hereto. LESSEE agrees to obtain and maintain at its sole cost and expense, public liability insurance and property damage insurance to protect LESSOR and LESSEE against all loss or damage from the claims of all persons who may be in or on the leased premises by the invitation, consent or sufferance of LESSEE. Such public liabili ty insurance shall have minimum bodily injury limits of $100,000 for each person and $300,000 for each accident, with respect to any accident oc~urring on the leased premises. LESSEE shall furnish LESSOR certificates of all insurance coverage. e V. At the end or other termination of this Lease, LESSEE shall have the right to remove any improvements constructed by it on the leased property. _ VI. The permitted use of the demised premises is for an outdoor recreation area for the City of La Porte Senior Citizens MUlti-Purpose Center. LESSEE, in the use and occupation of the demised premises and in the prosecution or conduct of any business therein, shall com- ply with all requirements of all laws, orders, ordinances, rules and regulations of the Federal, State, County and Municipal authorities. VII. LESSEE covenants that it will not use or permit to be used any part of the demised premises for any dangerous, noxious, or offensive trade or business and will not cause or maintain any nuisance in, at,.or on the demised premises. LESSOR, its agent or attorney, shall have the right to enter upon said premises and to inspect the same during all reasonable hours. VI I I.
