Council considered a resolution authorizing the Mayor to sign a grant agreement with the FAA for funding the update to the Airport Master Plan. Texas 7 7586 ( i 13) 474-4151 n U • June 27, 19$3 We have recently completed a review of our distribution easement design practices and have made several minor changes to improve consistency and practicality. The attached drawings indicate dimensions for the four standard types of distribution easements necessary for construction of our power lines on private property or in residential subdivisions. These designs will become effective July 1, 19$3• The sixteen foot ground portions of dedicated utility easements are typically shown on new subdivision plats. If the aerial portions of these easements are not properly described, we secure the required additional space through separate documents. This is often confusing as the same ease- ment gets recorded in separate locations. If your subdivision developers intend to dedicate utility easements, the following language added to the plats will be beneficial to all parties concerned: Owners have dedicated and by these presents do dedicate to the use of the public for public utility purposes forever unobstructed aerial easements five feet, six inches (5'6") in width for perimeter lots, seven feet (7'0") in width for back-to-back lots from a plane sixteen feet (16') above the ground level upward, located adjacent to all public utility easements shown hereon. We hope this information will be helpful to you in project plan- ning. It would be beneficial if your developer would contact us early in the design phase to discuss individual jobs as electric service arrangements are influenced by many factors. CSU'watt~-- -~• '~ wwc ~ • • ORDINANCE NO. 705- K ~~ AN ORDINANCE AMENDING SUBSECTION 4.03(10), FINAL OR RECORDED PLAT" OF SECTION 4, "PROCEDURE", OF ORDINANCE NO. 705 (AN ORDINANCE PROVIDING RULES AND REGULATIONS GOVERNING THE PLATTING OR REPLATTING OF LAND INTO SUBDIVISIONS IN THE CITY OF LA PORTS AND WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTS); AMENDING SUBSECTION 5.08(2), "EASEMENTS", OF SECTION 5, "GENERAL STANDARDS FOR SUBDIVISIONS", OF SAID ORDINANCE NO. 705; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDI- NANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); CONTAINING SEVERABILITY AND REPEALING CLAUSES; FIND- ING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS: • Section 1. Subsection 4.03(10), "Final or Recorded Plat" of Section 4, "Procedure", of Ordinance No. 705, an Ordinance providing rules and regulations governing the platting or re- platting of land into subdivisions in the City of La Porte and within the extraterritorial jurisdiction of the City of La Porte, is hereby amended to read as follows, to-wit: "SECTION 4.03 FINAL OR RECORDED PLAT. ... (10) a .letter from the servicing utility companies stating that the plat includes the easements required by them in the furnishing of utilities to this and future subdivisions. (A) It is the present policy of the Houston Lighting and Power Company to usually require sixteen foot (16') ground ease- ments (eight foot [8'] per to t) on back to back lots, and fifteen feet (15' ) ground easements on all perimeter lots • in any particular subdivision. Further, Houston Lighting and Power Company usually requires unobstructed aerial easements five feet, six inches (5'6") in width for perimeter lots, seven feet (7'0") in width for back to back lots from a plane sixteen feet (16') above the ground level upward, located adjacent to all the aforementioned easements. (B) Pursuant to the policy stated in sub- section (A) above, the final plat require d in this section of any particular sub- division shall contain the following language, when applicable: ~ -7 • Ordinance No. 705- K , Page 2. Section 2. Subsection 5.08(2) "Easements", of Section 5 • "General Standards for Subdivisions" of Ordinance No. 705, an Ordinance providing rules and regulations governing the platting or replatting of land into subdivisions in the City of La Porte and within the extraterritorial jurisdiction of the City of La Porte, is hereby amended to read as follows, to-wit: "SECTION 5.08. EASEMENTS. ... (2) Utility easements to be worked out with the public and private utility companies pursuant to the requirements established herein, including but not limited to the requirements of subsection 4.03(10) above. Section 3. Any person, as def fined in Section 1.07(27) , Texas Penal Code, who shall violate any provision of the ordi- nance, shall be deemed guilty of a misdemeanor and upon convic- tion shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Section 4. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, • sentence, phrase or clause, or part thereof, may be declared invalid. ~~~ • Ordinance No. 705- K , Page 3. Section 5. All ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of conflict only. Section 6. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. Section 7. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Ha 11 of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. Ra Sealed B X0017: Nuclear Moisture Density Gauge Advertised sealed bids #0017 for the purchase of a "Nuclear Moisture Density Gauge" were opened and read aloud in Council Chambers September 7, 1983 at 4 P.M. The gauge will be used to simultaneously and accurately. measure den- sities and moisture content of fills, embankments, bases, sub-grades, and as- phaltic concrete by the Engineering Dept. In the past, such tests were done manually by outside firms at great cost and extensive delays. Nuclear density gauges provide non-destructive, statistical testing with speed and accuracy. A survey was taken of agency users of Nuclear Moisture Density Gauges including; (1) Texas Highway Dept., (2) U.S. Corps of Engineers, (3) Texas A&M University, (4) Trinity Engineering and Testing, and (5) Brown & Root, Inc. Information received from these agencies indicated that there were only two competitive units on the market which would fit the City of La Portes' applications. Bids were then obtained from both Component Sales & Service Inc. which sells the CPN Model MC-2 and from Troxler Electrical which sells the Troxler Model ~3411B. Both units are very comparable to each other and meet all specifications set out by the Engineering Dept. I therefore recommend accepting the low bid by Troxler Electronics on their Model ~~3411B in the amount of $4,265.00. I trust this recommendation will meet with your approval. JR/mb cc: B. Mrs. Armand is willing to serve if appointed.
