Ra SUBJECT: Sealed B 10017: Nuclear Moisture Density Gauge Advertised sealed bids 10017 for the purchase of a "Nuclear Moisture Density Gauge" were opened and read aloud in Council Chambers September 7, 1983 at 4 P.M. The gauge will be used to simultaneously and accurately. measure den- sities and moisture content of fills, embankments, bases, sub-grades, and as- phaltic concrete by the Engineering Dept. In the past, such tests were done manually by outside firms at great cost and extensive delays. Nuclear density gauges provide non-destructive, statistical testing with speed and accuracy. A survey was taken of agency users of Nuclear Moisture Density Gauges including; (1) Texas Highway Dept., (2) U.S. Corps of Engineers, (3) Texas A&M University, (4) Trinity Engineering and Testing, and (5) Brown & Root, Inc. Information received from these agencies indicated that there were only two competitive units on the market which would fit the City of La Portes' applications. Bids were then obtained from both Component Sales & Service Inc. which sells the CPN Model MC-2 and from Troxler Electrical which sells the Troxler Model #3411B. Both units are very comparable to each other and meet all specifications set out by the Engineering Dept. I therefore recommend accepting the low bid by Troxler Electronics on their Model #3411B in the amount of $4,265.00. I trust this recommendation will meet with your approval. JR/mb cc: B. The numbers are disordered to the extent that emergency vehicles often waste precious time looking for an address. ' 'Jack Owen JO/cb ADMINISTRATION , e e CITY OF LA PORTE INTER-OFFICE MEMORANDUM TO: JACK OWEN DATE: 9-28-83 FROM: BOB HERRER~ I 11 '~ (le~~ SUBJECT: TAX ANTICIPATION NOTE DEFINITION: This particular type of note, sometimes called warrants, is issued in anticipation of collection of taxes, usually retireable only from tax collections, and frequently only from the proceeds of the tax levy whose collection they anticipate. HISTORY: July 1, 1981, the City of La Porte acquired a debt of the above nature for the La Porte Area Emergency Ambulance Coporation (LPAE'AC). Each year since then, the unpaid principal balance has been refi- nanced based on the amount that the LPAEAC has refunded to us and the current interest rate. The payment from LPAEAC is reflected by a reduction from their monthly contract payment. At this point the principal is approximately half paid and the interest paid equals slightly over $6,000. At this rate the note would be paid out by September 30, 1985, making this a four year project. Please note, this program does not cost the City of La Porte, we are merely providing a service. PROPOSAL: The City of La Porte could pay this note and finance for LPAEAC, and LPAEAC could continue to pay the City of La Porte at the current rate of principal and interest. This procedure would avoid the necessity of another bank agreement with Baysnore Bank and enable the City of La Porte to earn interest for their services. We would reflect approximately $6,000 from interest earned over the remaining two year life. ALTERNATIVE: Continue as historical records suggest. FINANCIAL: Princ~pal balance 9-30-83 equals $ 21,235.77 Interest rate quoted to finance equals 7.5% RECOMMENDATION: It is the recommendation of this administration that we payoff the note with Baysho~e, continue the repayment schedule with LPAEAC, and reflect revenue in our budget 1983-1984. Each maker, surety and endorser of this note expressly waives all notices, demands for payment, presentations for payment, notices of intention to accelerate the maturity, protest and notice of protest, as to this note, as to this note and as to each, every and all installments hereof. WHEREAS, it has been determined by the City Council of the City of La Porte (hereinafter "City"), that a necessity exists to borrow not to exceed the sum of TWENTY-ONE THOUSAND TWO HUNDRED THIRTY FIVE DOLLARS AND SEVENTY SEVEN CENTS ,($21,235.77), for payment of lawful expenses of the City, and that the anticipated current revenue from ad valorem taxes for fiscal year 1983-1984 will amount to far in excess of Twenty-one Thousand Two Hundred Thirty Five Dollars and Seventy Seven Cents ($21,235.77); and WHEREAS, Bayshore National Bank of La Porte, Texas, has agreed to make the City a loan in said sum, to be paid with seven and one- half per cent (7-1/2%) ,interest per annum thereon, on or before the 30th day of September, 1984, and WHEREAS, The City will have current revenue from the collection of said taxes, together with existing cash on deposit, available and sufficient to pay said obligation at maturity; THEREFORE.. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, that the Mayor be author.ized to issue a promissory note of the City (a true and correct copy of ' which is attached .hereto as Exhibit "A", incorporated by reference herein, and made a part hereof for all purposes), to be designated "Tax Anticipation Note for the Fiscal Year Beginning October 1, 1983, Ending September 30, .1984," such note to be in the principal sum of Twenty-one Thousand Two Hundred Thirty Five Dollars and Seventy Seven Cents ($21,235.77), to bear interest at the rate of seven and one-half per cent (7-1/2%) per annum until maturity, providing for ten per cent (10%) per annum interest on matured unpaid principal and interest from date of maturity until paid, and ten per cent (10%) attorney's fees, such note to be due and payable on or before the 30th day of September, 1984, and that said note be sold by the City to . e e -2- Bayshore National Bank of La Porte, Texas, at not less than par value. By Virginia Cline, Mayor ATTEST: Cherie Black, Assistant City Secretary e e RESOLUTION NO. 83-21 A RESOLUTION ACCEPTING A GRANT FOR AIRPORT PROJECT NO. 3-48-0127-01 WHEREAS, the City of La Porte, Texas (termed "Sponsor" herein), and the Department of Transportation, Federal Avia- tion Administration (FAA), desire to enter into a certain Grant Agreement which provides, federal participation in an Airport Master Plan update for the La Porte Municipal Airport; and WHEREAS, in response to a request duly filed by Sponsor, the FAA has prepared said Grant Agreement, a copy of which is attached, and has submitted it to Sponsor for acceptance and execu tion; and WHEREAS" it is determined to be in the interest of Sponsor and 'FAA to accept said Grant Agreement; NOW, THERE'FORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAPORTE: Section 1. In keeping with your idea that we should use the Industrial Districts to encourag~ industrial growth, but at the same time, administer it fairly and impartially, I recommend that the following new businesses be contacted for Industrial District contracts: Heller Warehouse Safeway Scaffolds . Texas Electric Drago Supply Kinco Equipment Dunn Equipment M.I.P. (a new equipment rental place) If you agree with this, I will get additional information on them for Mr. Askins to initiate the contracts. Regarding by ear to on them. on this. inventories stored in the new warehouses, I suggest we play this find out the amount of revenue and problems involved in collecting However, I would like an opinion from you and/or the City Commission At this time, I have no idea what the Harris County Appraisal District is going to do regarding your 19a4 industrial appraisals. For 1983, they farmed out a small percentage of the work to appraisal firms in School Districts where they had been working. For example, we had worked 76 industries in Galena Park I.S.D. in 1982, and they contracted with us to do only the personal property for 37 in 1983. If this trend is maintained, we may get to work some of the industries in the La Porte I.S.D. for 1984, and therefore some of yours. A:z... e e ~::....: ". -2- Mr. Bob Herrera, Director Adm. Services City of La Porte However, several of the industries in your Battleground Industrial District are in the Deer Park I.S.D., and it is doubtful that the Appraisal District would contract with us to work them. In short, we ma~ get to work some of your properties for the Appraisal District, but it will probably be less than half of them. The residential and land appraisals will all come from Region 6 of the Appraisal District. Mr. Hutton, who heads up that ~egion, is very capable and in my opinion, will do as good a job as is possible. Unfortunately, even with the best job, there are still going to some problems that will need to be worked out. He will work with us, I am sure. On the matter of our continuing to work for the City, I feel there is a definite service we can provide, the magnitude will depend on what the H.C.A.D. does. In any case, you are going to need someone with knowledge of the Industrial Districts and Contracts to pull the ~nformation together in a usable form. Also, to see that you pay H.C.A.D. for only the taxable property appraisals and not the "in-lieu" portions. My suggestion is that you budget about $30,000 for this item, but that we enter into a contract for only those services we are sure you will need from us. We can ammend the contract later, after we find out what the H.C.A.D. is going to do. Bob, I apologize for this letter being so long and not being more concise, but our situation is not clean cut. I have made suggestions, but I will be happy to work with you, Jack, the Mayor, and Commission in any way that you feel may benefit the City. WHEREAS, the City Council of the City of La Porte, passed and approved Sections 8-115 through 8-126 of the Code of Ordi- nances of the City of La Porte, creating a Board of Inspection to be composed of the Building Inspector or is duly authorized representative, the Fire Chief or his duly authori zed repre- sentative, and the Fire Marshal or his duly authorized repre- sentat:ive~ and WHEREAS, Section 8-ll8(a) of said Sections provide that: Whenever it shall come to the attention of the Board of Inspection or any member thereof, by reason of the carrying out of the necessary duties of such member, or by reason of a complaint of any citizen of the City or of the City Council, that a dangerous building exists, the Board shall, within twenty-four (24) hours of the receipt of said complaint, make a thorough inspection of said alleged dangerous building~ and WHEREAS, Section 8-ll8(c) provides that: After the inspection provided for in this Section has been made, with or without the aid of experts, the Board shall immediately report its conclusion in writing to each of the members of the City Counc il and to the City Attorney. Such report shall state the circumstances and the condition of the building upon which such conclu- sion was based. The report shall be filed in all cases no matter what conclusion is stated by the BOard ~ and WHEREAS, it has heretofore come to the attention of the Board of Inspection that the building located on Lot 23-26 Block 35 Bayfront Qs:\ e e Ordinance No. :1.380 , Page 2. Harris County, Texas, has, for the reason of neglect or misuse, been allowed to deteriorate into a condition of decay or partial ruin or has become a fire hazard, as defined in Section 8-117 of the Code of Ordinances of the City of La Porte: and WHEREAS, said Board of Inspection has heretofore ~ade and filed its written report, dated June 27.1983 , finding said building to be in fact a dangerous building: WHEREAS, City Council received such report, and ordered notice to the record owner of sa id property, Marv Wilson , whose address is 4210 Rusk Houston. Tx. 77023 , that a hearing as provided in Section 5 of said Ordinance would be held at 604 West Fairmont Parkway, at the Council Chambers, City Hall, City of La Porte, Texas, at which time the Council would hear evidence for and against the conclusions of the Board: WHEREAS, the Ci ty Secretary has heretofore served notice of said hearing upon said owner, by registered mail, return receipt requested, which return receipt indicates that said owner received said notice on August 2.1983 , a date more than ten (10) days before the date set for said hearing: WHEREAS, at said date, time, and place, City Council met in regular session to conduct such public hearing, at which time evidence was presented both for and against the conclusions of the Board of Inspection: WHEREAS, City Council, after due deliberation, and within fifteen (15) days after the termination of the hearing, is required to make its decision in writing and enter its order: and a-~~ e e Ordinance No. 1380 , Page 3. WHEREAS, City Council entered its order on , a day which is within fifteen (15) days after the termination of the hearing; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. This Ordinance contains ~he findings and orders of the City Council of the City of La Porte, and its conclusions, based upon the evidence presented at said hearing. Section 2. Based on the evidence presented at said hearing, the City Council hereby adopts the attached report of the Board of Inspection, in full, and incorporates such by reference herein as fully as though set out herein. Section 3. The City Council hereby finds, determines and declares such building to be a nuisance, and orders such build- ing condemned. Section 4. the City Council hereby finds, determines and declares that Mary Wilson , who resides at 6.?1n 'Rl1Cll- A.,7Cli l1n"C!t-nn~ Tv 77n?~ , is the record owner of the property on which this building is situated, and that as such record owner, the said Mary Wilson has been duly and legally noti- fied of these proceedings. Section 5. The City Council hereby orders the said M~TY Wilson to entirely remove or tear down such building, and further orders the said Mary Wilson to commence such removal within ten (10) days from the effective date of this Ordinance, and to complete such removal or demo- lition of such building within a reasonable time. The Ci ty Council hereby orders the Board of Inspection of the City of La Porte to cause a notice of the dangerous, insanitary condition of the building to be affixed in one or more conspicuous places on the exterior of the build- ing, which notice or notices shall not be removed or. defaced by any person, under penalty of law. Section 7. The City Council hereby orders the City Secre- tary to forward a certified copy of this Ordinance, to the record owner of said property, the said Mary Wilson , by registered mail, return receipt requested. Section 8. Should the said Mary Wil!'lnn not comply with the orders contained in this Ordinance relating to, the removal or demolition of such building within ten (10) days after service hereof, then the Board of Inspection of the City of La Porte shall enter upon the said premises with such assistance as it may deem necessary, and cause the said build- ing to be removed or demolished without delay, and the expenses of such procedure shall be charged against the said Mary Wilson , record owner of said property, and shall thereupon become a val id and enforceable personal obl i- gat ion of said owner of such 'premises, and the said Board of Inspection shall carefully compute the cost of such removal or demolition, which cost shall be hereafter assessed against the land occupied by such building, and made a lien thereon. Section 9. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public (1-4
