Members of the City Council Present: Mayor Virginia Cline, Councilpersons Deotis Gay, Don Skelton, Linda Westergren, Norman Malone, John Longley,. Ed Matuszak, Kevin Graves, Lindsay Pfeiffer Members of the City Council Absent: None Members of City Staff Present: Director of Administrative Services Bob Herrera, City Attorney Knox Askins, Assistant Director of Public Works Steve Gillett Others Present: Jim Sullivan, Kay Homes; Linda Castleberry, Bayshore Sun-Broadcaster; David Byford, Baytown Sun; 18 interested citizens The invocation was given by Councilperson Skelton. The minutes of the public hearing and regular meeting held September 21, 1983, were considered. Motion was made by Councilperson Westergren to approve the minutes of the September 21, 1983, meeting as presented. Second by Councilperson Skelton. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Gay,. Skelton, Westergren, Malone, Longley, Matuszak, Graves, Pfeiffer and Mayor Cline Nays: None The minutes of the special called emergency meeting held September 28, 1983, were considered. Motion was made by Councilperson Pfeiffer to approve the minutes of the September 28, 1983, meeting as presented. The motion carried, 6 ayes, 0 nays, 3 abstain. Mr. Jim Sullivan of Kay Homes spoke to Council in favor of the annexation of Spenwick MUD and College View MUD. 6. Council considered annexation of College. View and Spenwick MUDs. Mayor Cline asked for discussion from Council. Councilperson Longley asked if there had been any contact with the County in doing road repair work in that area. Mayor Cline replied in the negative. Mr. Herrera explained to Council that the time frame for annexing these areas is very short in able to get them on the tax rolls by January. Mayor Cline and City Attorney Knox Askins reviewed the schedule needed to finalize the annexa- tion. Motion was made by Councilperson Pfeiffer to proceed with the annexation as outlined by City Attorney Askins. Second by Counclperson Westergren. The motion carried, 6 ayes and 3 nays. • Ayes: Councilpersons Gay, Skelton, Westergren, Malone, .Longley and Pfeiffer Nays: Councilpersons Matuszak, Graves and-Mayor Cline 7. Council considered amending-the Subdivision Ordinance to reflect changes to Houston Lighting & Power easement require- ments. The Ordinance reads as follows: ORDINANCE N0. 705-K - AN ORDINANCE AMENDING SUBSECTION 4.03(10), "FINAL OR RECORDED PLAT" OF SECTION 4, "PROCEDURE", OF ORDINANCE N0. 705 (AN ORDINANCE PROVIDING RULES AND REGULATIONS GOVERNING THE PLAT- TING OR REPLATTING OF LAND INTO SUBDIVISIONS. IN THE CITY OF LA PORTE AND WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF LA PORTE); AMENDING. SUBSECTION 5.08(2), "EASEMENTS", OF SECTION 5, "GENERAL STANDARDS FOR SUBDIVISIONS", OF SAID ORDINANCE NO. 705; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS- DEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); CONTAINING.SEVER- ABILiTY AND REPEP;LING CLAUSES; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made by Councilperson Skelton to amend the sub- division ordinance to reflect changes to`Houston Lighting an Power easement requirements. Second by Counci person Matuszak.. Council considered awarding a bid for a nuclear moisture density gauge. Motion was made by Councilperson Graves to accept staff's recommendation and award the bid for a nuc ear density moisture gauge to Troxler Electronics in the amount of $4,265.00. Second by Councilperson Matuszak. The motion carried, 8 ayes, 0 nays, 1 abstain. Ayes: Councilpersons Skelton, Westergren, Malone, Longley, Matuszak, Graves, Pfeiffer and Mayor Cline Nays: None Abstain: Councilperson Gay 9. Council considered an ordinance setting the pay scale for Civil Service employees. City Attorney Askins read: AN ORDINANCE AMENDING .ORDINANCE N0. 1285-B, "AN ORDINANCE IMPLEMENTING POLICEMEN'S CIVIL SERVICE; ESTABLISHING CLASSI- FICATIONS; NUMBER OF AUTFiORTZED POSITIONS TN EACH CLASSI- FICATION; ESTABLISHING PAY SCHEDULES; CONTAINING A SEVER- ABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; CONTAINING A REPEALING CLAUSE; AND PROVIDING AN EFFEC- TIVE DATE HEREOF." After discussion by council on possible inequities in the pay schedule when moving from police officer to sergeant, motion was made by Councilperson Skelton to approve-and adopt Ordinance 1285-C as rea by the City Attornev. Second by Councilperson Pfeif er. The motion carried, 8 ayes and 1 nay. Ayes: Councilpersons Gay, Skelton, Westergren, .Longley, Matuszak, Graves, Pfeiffer and Mayor Cline Nays: Councilperson Malone Staff was requested to review the Civil Service salary scale and present recommendations to Council in three months for next year's budget. 10. Council considered an appointment to the La Porte Area Water Authority. Motion was made by Councilperson Skelton to defer this ap- pointment until such time as the roposed annexation is ,c~o_.m~le~te. Second by Councilperson Gay. The motion carried, a7 yes and 2 nays. Mayor Cline requested to hear the report from Turner Collie & Braden on the Catlett Sewer Rehabilitation Project in execu- tive session, due to pending litigation. Motion was made by Councilperson Westergren for an executive session on item 11, report from Turner Collie & Braden on the Catlett Sewer Rehabilitation Project. Second by Council- person Skelton. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Gay, Skelton, Westergren, Malone, Longley, Matuszak, Graves, Pfeiffer and Mayor Cline Nays: None 12. Administrative Reports: Director of Administrative Services Herrera. reported the third quarter activity reports had been distributed. He thanked Council for the annual employees' picnic. 13. Council Action: Gam: Thanked citizens for coming out and. being a part of the meeting . Skelton:- Had received the activity report and .appreciates that type of report because you can read it in just a few minutes and know what's going on all over the City. It saves driving many miles. As a member of the TML resolutions committee, he will be in that meeting Friday morning and will support the City of Bellaire's resolution. Appreciates the citizens who turned out - always happy to have them. Malone: Requested executive session on two personnel items. Matuszak: Announced that October 25 will be Commissioner Jim Fonteno Appreciation Day in La Porte, to publicly express the City's appreciation for the fine things Mr. Fonteno has done for our City. The festivities will be held between 11 and 1:00 at a place to be designated. The dedication of the sign on the Fairmont Parkway esplanade will be held, and hopefully a ribbon cutting. 1 1+ • Minutes, Regular Meeting, La Porte City Council October 5, 1983, Page 5 Graves: Apologizes for not being at the picnic Saturday; he had to work all weekend at the boat races in Clear Lake. Maybe his colleagues would see fit to donate a month's salary next year so he can go - how about that, Mr. Malone? (Let the minutes reflect Mr. Malone said yes.) Cline: Went to the City of Dallas with Director of Public Works Jerry Hodge. They were very warmly received, and Dallas officials were very surprised that La Porte city of- ficials would take the time and effort to have two plaques made up and make a special trip to Dallas to present them to the City of Dallas in appreciation of their help with the cleanup after Hurricane Alicia. One plaque was presented to the Mayor of Dallas and one to John Tipple, Streets & Sanitation Director. They were very pleased, and most appreciative of the special plaques. A plaque will also be given to the City of San Antonio at a later date in appreciation of their help. Last Saturday was a milestone in the City of La Porte - it was the first time City employees have been recognized for their years of service to the City. We had a service award; we had. some beautiful pins made up, and we had 52-54 awards to be presented. I'm very sorry that none of you were here to participate in this. We had three people receiving 20- year awards; one person recieved a 15-year award.; ten year awards and 5 year awards were given. And the people who were there to receive the awards were emotionally overcome because the City had given them .recognition; they were given a pin, and I think it was a beautifully designed pin. we had a good attendance at the picnic and everyone enjoyed it. I personally want to thank the staff who made this picnic possible. They worked very diligently and very hard - Bob Herrera, Jerry Hodge, Steve Gillett, Stan Sherwood who was the chairman, Chief Freeman. Chief Freeman stayed there all night Friday night so he could guard the meat. Everyone had a very nice time and enjoyed receiving their awards, and I just wish that you all could have been there. Malone: Would like to make people aware of the Chaplain's Program that is going on. This program is for notifying relatives of victims of accidents, etc. Eight .out of 12 ministers in our area are involved in this program, .and it's not an easy task. I think we need to inform `our citizens of this so they'll know we're doing more than repairing roads. '`~ -~~ a ~, • Minutes, Regular Meeting, La Porte City Council October 5, 1983, Page 6 14. Council adjourned into executive session at 8:00 P.M. and returned to the Council table at 8:42. 15. There being no further business to be brought before the Council, the meeting was duly adjourned at 8:43.
