MARCH 14, 1984
1. The meeting was called to order at 7:07 P.M. by Mayor Cline.

2. The invocation was given by Councilperson Malone.
3. The minutes of the regular meeting held February 15 were con-
sidered for approval.
Motion was made by Councilperson Skelton to ap rove the minutes
of the February 15 meetin as resented. Second by Council-
person Malone. The motion carried, 8 ayes, 0 nays .and 1 abstain.

Westergren, Malone, and Longley
Nays: None
Abstain: Mayor Cline (was not present at Feb. 15 meeting)
4. Mayor Cline proclaimed Youth Art Month and presented the
proclamation to Ms. Elizabeth Brown, representing La Porte
Independent School District.
5. Lou Lawler, representing La Porte-Bayshore Seamen's Center,
made a presentation to Council to request a $5,000 "boost" to
help the Center keep going. Dick Bell gave a short statistical
• report on the number of seamen using the facility.

Staff will look into whether or not the City can legally
monetarily assist the Center, since its actual location is
not within our city limits.
6. Council considered a request from Space City International
Air Show to hold an air show at La Porte~Municipal Airport.
After a presentation by Dr. E. Harvey, Gary Mitchell and
Mr. Lapsley and questions from Council, motion was made by
Councilperson Westergren to table this item for further
study until the meeting of March 21. Second by Councilperson
Matuszak. The motion carried, 7 ayes and 2 nays.

7. Council considered an ordinance amending the City of La Porte
electrical code.

ADDING THERETO ARTICLE VI, "WILD ANIMALS;" PROVIDING THAT ANY

9. Council considered an agreement with Kay Homes for sewer
service in Brookglen Section III.
Motion was made by Councilperson Gay to approve the agreement
with Kay Homes and authorize the Mayor to sign the agreement.
Second by Councilperson Matuszak. The motion carried, 9 ayes.

13. Council considered giving financial assistance to TML for the
Cities for Responsible Cable TV Coalition.
Motion was made by Councilperson Graves to contribute $750.00
as the City's portion to the Cities for Responsible Cable TV

14. Administrative Reports
Mr. Owen reported that the Texas Department of Water Resources
had approved plans and specifications for the cleaning, TV
inspection and point repairs for portions of the sanitary sewer
collection system. This was on an EPA grant and is the re-
mainder of the original Tinker/McKnight project and covers part
of Fairmont Park. Will be bringing this back to Council very
soon to set a bid date for the ~projec~t.
A number of our staff have recently graduated from a Dale Carnegie
course and we are very proud of them.' Bob Herrera,.Deb~bie Cole,
Steve Gillett, Jackson Ray, Stan Sherwood, David Paulisseri,
Luis Morris and Paul Hickeribottom received their diplomas. They
attended on their own time, and he's looking forward to improved
job performance.
15. Council Action:

The trip to Washington was very productive.' Felt very good
when we left that we had accomplished a lot.. TML is as ac-
tive up there in promoting our special needs that Texas has
as they are effective in taking our stands against our Texas
legislators. It was an~excellent trip.
Happy to hear about our hospital.
How do we stand on our ice cream vendor ordinance? We need to
pull that one out and rush that one through.
Graves: Driving in he had noticed some green stakes wuth red
signs - some of them seem to too close to the roadway, especially
one by the picture show.
Sidewalk or street lights need to be started in the area of
G Street from Broadway to San Jacinto. Funds are budgeted, and
we need to get started on it.
• Pfeiffer: Had inquired about a traffic light at Farrington
and Fairmont Parkway. People are having trouble getting onto
Fairmont, particularly at the peak :travel hours.
The State was working today on 8th Street and Main. When are
we going to take over maintenance~of that?
G-~': Thanks for coming out. Grateful to Mrs. Lawler for
coming to'solicit funds for the~Seameri's Center. Hopes there
is some way this city can help in some capacity.
The trip to Washington was very educational to him; some of
the legislation they were working on, especially prayer in the
school. I
Skelton: ;Would like to .echo comments of Councilman Matuszak and
Councilman Gay on the trip to Washington. It was certainly
informative. I got hold of an old copy of a National Cities
Weekly. I left you all a copy of Status of Major. Legislation
in Congress Affecting Cities that I copied from it. I think
the Council needs this magazine; it is loaded with things that :~
will help the cities. The National League~of Cities is doing
a fine job,~but I think TML is doing a better job. And TML,
through our help, reversed the NLC position on cable TV.
• Has been getting calls on restoration of Sylvan Beach. Today's
paper indicated Precinct 2 has recieved~ over $2 million for

their parks; doesn't know how much will go.to Sylvan Beach.
Wondered if any others have been getting calls regarding the
restoration of Sylvan Beach.
In looking into the noise that we're getting, finds that the
noise pollution can be stopped only in the industrial zone.
Residential or commercial doesn't have anything on noise. We
need to look at that and get something on noise pollution.
We've got a lot of dogs running loose in my neighborhood. Has
been getting complaints.
Has had some letters regarding street work about wondering
when and if they're going to fix the driveways. Letters were
issued, but evidently people didn't get the, or go to the
front door, and were unaware of them.
Westergren: Has noticed for the last three weeks about dogs -
especially on Saturday mornings.
• Have we made any arrangements for the opening of the new addi-
tions to the fire station? Would like to see one of our native-
born citizens, George Sharp, Sr., recognized at the open house.
He's been a mayor of La Porte, a commissioner, and is the sole
surviving council member from the time they built the original
"new" city hall back in the 1930's. I think on this occasion
we really ought to recognize him.
Malone: I'm going to mention dogs, too.

Skelton: When we paved H Street several people inquired if
we were going to put a bridge there, and indicated they didn't
want one.
There is~a recommendation forthcoming from the consultants on
the transportation plan that I don't know if it goes across
H, but H is part of the east-west thoroughfare, if I remember
right.
Malone: One more thing, Mayor. I'd like to thank Jerry,
Mr.•Owen and the rest of the staff for the work they're doing.
I've had real good cooperation with them. •
Longley: Explained how he solved his dog problem.
Also, Jerry's doing a good job taking down the Fairmont sewer
plant.
Cline: Reiterated the report on the Washington trip. The
highlight was seeing the~President and hearing him speak.
• Had putt a copy in Councils mail box a resolution presented to
the Chamber of Commerce pertaining to TXTX Corporation. The
people in Shoreacres and that area have been having a real
problem with them. They have made~a permit to the Corps of
Engineers to construct a bulk transfer facility in the vicinity
of Barbour's Cut terminal. They have not been required to give
an invironmental impact statement and that has everyone puzzled
and a little upset. The date for comments deadline was March 12;
however, Mr. McElvogue of Morgan's~Point said today that that is
going to be extended. I would like for the City of La Porte to
consider whether or not they would have~any comments or to go
on record as to any comments as to this facility being relocated
to upper Galveston Bay.
Pfeiffer: ~I had some conversation with Dr. Yoder, who lives in
the residential area closest to it, and they had .some new carpet
ruined from tracking the coal dust, or whatever it is, in from
the back yard. I would like to see the City write a letter and
go on record as opposing the relocation.
Skelton: I hear the noise from this plant presently, and I am
just across the bay from them. Unless you are a real sound
sleeper, it will bother you all night, and so I think once they
move further east it will probably be~less.
• Cline: The purpose of Mr. McElvogue ~preseriting~the resolution
today was to ask for a public hearing to beheld on this so
people could get some answers to their questions and make this

company come and tell what they're going to do and also what
they're going to do to eliminate the problem they're having in
Shoreacres with the coal dust blowing. I've heard of some peo-
ple down there even having their air conditioners stopped up
from it and cars almost ruined.
The thing that concerns me is their project location - the request
they put in to the Corps of Engineers said that there was not
an environmental impact statement required. You can't tell me
that when they get out in the channel and start dredging,
driving pilings, etc., that's not going to be an impact on the
aquatic environment?
Matuszak: I'd think they'd have to be in violation of TACB
regulations.
Cline: No; Air Control says they don't have anybody to regulate
them .
General discussion followed.

Debby Rihn, with H & R Aviation, and representing Chapter 25 of
the International Aerobatic Club, has applied to the FAA for a
Certificate of Waiver to hold an airshow at the La Porte Municipal
Airport. The FAA has indicated that the certificate will be issued
when. special provisions and conditions are met - primarily safety
measures.
Although the primary responsibility for safety and operation of
the airshow rests with the sponsoring organization, Chapter 25
of the International Aerobatic Club, the City will need to provide
an ambulance and fire protection at the airport while the show is
in progress, in addition to crowd and automobile traffic control.
• Representatives of Chapter 25 of the International Aerobatic Club
will be a the Council Meeting on March 14, 1984, to present their
plan to meet FAA requirements and to request services needed from
the City. In addition, authorization is needed from City Council
to allow the airshow to take place on the La Porte Municipal Airport.

This letter is to introduce International Aerobatic Club Chapter 25 and hopefully
enlist your support in putting on one of the finest air shows ever seen in
Texas. IAC Chapter 25 is a nonprofit organization whose primary interest is
flying, promoting and competing in aerobatics. This year one of our members,
Deborah Rihn, won a place on the~U.S.A. Team which will compete in the World
Aerobatics Competition which will be held in Hungary in August of this year.
Another of our members, Dr. Eo~in Harvey was selected as the team physician.
We are duly proud.
• We, the air show, would intend to make a donation to the Aerobatics Foundation
in the name of our two members and to support their efforts. The rest of the
money above the club's operating cost would go to the charities of the choice
of the donors and contributors. Some of the major contributors already pledged
are: Coors Pepsi, Red Barron Pizza, Gullo Haas, Bud, Harold's, Monterrey House
and Casa Ole.
We expect all three major T.V. Networks to give us advertising and to be there to
cover the flying.
We welcome all civic and ,charitable organizations to participate to whatever
extent they can.
We intend to have the airshow Memorial Weekend, May 26, 27. We think LaPorte
would be a great place. We would expect 10 to 15,000 visitors each day.
IAC 25 has at this time arranged for total insurance coverage for the day before
and day after with a $2,000,000 limit. We will be happy to send you a copy of the
certificate as soon as we receive it.

AN ORDINANCE AMENDING THE ELECTRIC CODE OF THE CITY OF LA PORTE;
ADDING SECTION 8-41, ARTICLE IV, FINDING CONPLIANCE WITH THE
OPEN MEETINGS LAW; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE
GUILTY OF A MISDEMEANOR AND UPON CONVICTION THEREOF SHALL BE
FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00);
AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Article IV, Section 8, Subsection 8-41, of
the Code of Ordinance, City of La Porte, Texas, is hereby
amended to read as follows:
• "Any person, AS DEFINED IN Section 1.07 (27), Texas Penal
Code, found guilty of a violation of the provisions of the
electric code of the City of La Porte, as referenced herein,
shall, upon conviction, be subject to a fine not execeeding
TWO HUNDRED DOLLARS ($200.00). Each day such violation con-
tinues shall be deemed to constitute a separate offense."
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
• 6252-17, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The
City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 3. If any section, sentence, phrase, clause, or
any part of any section, sentence, phrase, or clause, of this
• ordinance shall, for any reason, be held invalid, such invalidity
shall not affect the remaining portions of this Ordinance, and

it is hereby declared to be the intention of this City Council
to have passed each section, sentence, phrase or clause, or
part thereof, irrespective of the fact that any other section,
sentence, phrase or clause, or part thereof, may be declared
invalid.
Section 4. Any person as defined in Section 1.07 (27),
Texas Penal Code, who shall violate any provision of the ord-
finance, shall be deemed guilty of a misdemeanor and upon con-
• viction shall be punished by a fine not to exceed Two Hundred
Dollars ($200.00).
Section 5. This Ordinance shall be effective fourteen
(14) days after its passage and approval. The City Secretary
shall give notice of the passage of this ordinance by causing
the caption hereof to be published in the official newspaper
in the City of La Porte at least twice within ten (10) days
after the passage of this ordinance.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Chapter Five, "Animals and Fowl," of the Code
of Ordinances of the City of La Porte, is hereby amended by
® adding thereto new Article VI, Wild Animals, to read as follows,
to-wit:
ARTICLE VI
Sec. 6-1. Wild Animals; caging, prohibition
against running at large.
(a) Wild animal as used in this section
shall mean and includes any wild mammal,
amphibian, reptile, or fowl which is not
naturally tame or gentle but is of a wild
nature or other characteristics would con-
stitute a danger to human life or property
if it is not kept or maintained in a safe
manner or in secure quarters. Such animals
shall include, but not be limited to lions,
tigers, leopards, panthers, bears, wolves,
alligators, crocodiles, apes, foxes,
elephants, rhinoceroses and all forms of
poisonous reptiles and other like animals.
(b) It shall be unlawful for anyone to
keep or harbor any wild animal within the
city limits unless the same is kept in a
cage in a safe manner and in secure quarters
or cage sufficient to contain such animal
at all times. No such animal shall be
housed within one hundred feet (100') of
any property line.
(c) It shall be unlawful for anyone who
owns, raises or keeps any wild animal to
allow the same to be at large outside of its
secure quarters or cage. In the event such
animal is discovered outside of the secure
quarters or cage, it shall be presumed that
the person who owns, raises or keeps the
® same, wilfully allowed it to roam at large
outside the secure quarters or cage.

(7) days of bringing such wild animal within
the city limits. Registration information
shall include name, street address, and
telephone number of the person keeping the
wild animal; the kind of animal; type of
quarters or cage; and location of quarters
or cage on the person's premises.
Section 2. Any person, as defined in Section 1.07(27),
Texas Penal Code, who shall violate any provision of the
• ordinance, shall be deemed guilty of a misdemeanor and upon
conviction shall be punished by a fine not to exceed Two Hundred
Dollars ($200.00).
Section 3. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
• has been discussed, considered and formally acted upon. The
City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 4. If any section, sentence, phrase, clause, or
any part of any section, sentence, phrase, or clause, of this
ordinance shall, for any reason, be held invalid, such invalidity
shall not affect the remaining portions of this Ordinance, and
it is hereby declared to be the intention of this City Council
• to have passed each section, sentence, phrase or clause, or

part thereof, irrespective of the fact that any other section,

Section 5. This Ordinance shall be effective fourteen

in the City of La Porte at least twice within ten (10) days

This Agreement made and entered into by and between the CITY OF
LA PORTE, a municipal corporation of Harris County, Texas, hereinafter
called "City", and KAY HOMES, INC., a Texas business corporation having
its principal office in Houston, Harris County, Texas, hereinafter
called "Kay Homes,"
W I T N E S S E T H:
1. The City of La Porte, by its Ordinance No. 1393, finally
passed and approved on December 28, 1983, has heretofore annexed and
• made a part of the corporate limits of the City, all of the area
which formerly comprised the College View Municipal Utility District.
Kay Homes was and is an active residential home builder in the former
College View Municipal Utility District. The sewer treatment plant
in the College View Municipal Utility District was not, at the time
of annexation, meeting current regulatory requirements to comply
with its operation permit. City's engineers have recommended the
construction of necessary lines and lift stations to transport the
effluent from College View Municipal Utility District to City's
central sanitary sewer treatment plant. Kay Homes has agreed to pay
certain sums to City to be applied toward the cost of such facilities,
in consideration of City agreeing to issue certain building permits
• to Kay Homes, so that Kay Homes may continue without interruption
its residential building program in Brookglen, Section III, a sub- .
division in Harris County, Texas. The fees paid to City hereunder
by Kay Homes shall be considered Capital Cost Recovery Fees.
2. For and in consideration of the payment of Two Hundred
Forty Six Thousand Nine Hundred Sixty~Dollars ($246,960.00) by Kay
Homes to City, the receipt and sufficiency of which is hereby acknow-
• ledged, as and for a Capital Cost Recovery Fee, to be deposited by
City to City's Water and Sewer Improvement Fund, to be used by City

for the purposes herein expressed, City agrees to issue to Kay Homes,
upon the request of Kay Homes or its agents, residential building
permits for the construction of single family residences, on the
remaining two hundred fifty-two (252) platted lots in Brookglen,
Section III, a subdivision in Harris County, Texas. ~At the time of ~~~?
application for building permits, the Capital Cost Recovery Fee pro-
vided for herein shall be considered paid by Kay Homes. However,
Kay Homes will remain liable for City's other building permit~..issuance
fees and expenses, as follows, to-wit:
• (1) City's standard building permit fee, based
on valuation of construction, as set forth
on Schedule K, City of La Porte's Standard
Building Code;
(2) Kay Homes' subcontractors shall be liable
for the City of La Porte's usual fee for
issuance of permits for mechanical, electrical,
and plumbing;
(3) In lieu of any other applicable water and
sewer connection and tap fees, Kay Homes
shall be required to pay the sum of Forty
Four Dollars ($44.00) on each building permit .
to reimburse City for the water meter and
the water meter box, and an inspection fee
of Five~Dollars ($5.00) on the sewer tap.
Kay Homes shall not be required to pay any other applicable water
and sewer connection and tap fees under City of La Porte Ordinances.
Kay Homes shall install the water and sewer taps in accordance with
City specifications. City shall install the water meter and water
• meter box.
3. In the event of any moratorium order by a state or federal
agency having jurisdiction over the City's operation of sanitary
sewer treatment facilities for Brookglen, Section III, which would
prevent Kay Homes from being issued a, building permit by the City
of La Porte, City agrees to reimburse Kay Homes,.upon its written
request, the sum of One Thousand Dollars ($1,000.00) per lot, for
• which building permits cannot be issued because of the existence
of such moratorium or other order by such state or federal regulatory

agency having jurisdiction. City reserves the right to appeal any
such state or federal order; provided, however, City shall not withhold
payment of such refund pending the final determination of such appeal.
4. City agrees with Kay Homes, that it will not, after the
effective date of this Agreement, issue any building permits in the
area which formerly comprised College View Municipal Utility District,
with terms and conditions more favorable than those accorded~Kay Homes
herein. If City issues any building permits in said area with terms
• more favorable than those accorded Kay Homes herein, City agrees to
amend this Agreement to embrace the more favorable terms of such
building permits, and make pro-rata refunds to Kay Homes. A single
family residential Capital Cost Recovery Fee of One Thousand Dollars
($1,000.00) per lot shall be considered the basis of this Agreement.

THE APPLICATION OF UNION CARBIDE CORPORATION DATED JANUARY 13,
1984, TO CONSTRUCT A SIXTEEN INCH (16") OXYGEN PIPELINE AND TO
CONSTRUCT A SIXTEEN INCH (16") NITROGEN PIPELINE; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte has
• received an application dated January 13, 1984, from Union
Carbide Corporation, requsting permit under Section 18-A-3
of Ordinance No. 915, being Chapter 18-A of the Code of
Ordinances of the City of La Porte, to construct a sixteen
inch (16") oxygen pipeline, and to construct a sixteen inch
(16") nitogen pipeline, crossing the City of La Porte, all as
shown on said application. The application of Union Carbide
Corporation has been reviewed by the City's Director of Public
Works, who has found that said application meets all require-
ments of said Ordinance No. 915, and has recommended its
approval.
Section 2. The City Council of the City of La Porte
• hereby approves the application of Union Carbide Corporation,
dated January 13, 1984, and this Ordinance shall constitute
a permit to Union Carbide Corporation to lay and construct
said pipelines within the City of La Porte, all in conformance
with the requirements of said Ordinance No.~915.
Section 3. This Ordinance shall be in full force and
effect from and after its passage and approval.

"P" Streets as well as a check for $300.00 to cover the permit fee. These
enclosures and the information which follows should satisfy the itemized list
of pipeline permit requirements (copy attached which accompanied your letter
• of 12/7/83.
As directed by item 7, three copies of maps showing the as-built route,
distances and shut-off valve locations will be provided upon completion of
the installation.

(Ord. N915)
1. Permit required if: new or replacement pipeline laid across,
along, or under any public place, ie: street, r.o.w., park, etc.
2. Permit granted by ordinance. Ordinance shall state which streets
or public property pipeline runs across or along, and the point(s)
of contact.
3. Depths required: four (4) feet from natural ground to two of pipe,
unless (1) street crossings must be six (6) feet and, (2) Ditch and
drainage crossings must be three (3) feet from the bottom of the
ditch/drainage structure.
~+. Applicant must submit to Director of Public Works plans accurately
showing location, course, and alignment of pipeline, a written
letter requesting passage of ordinance, including time, manner,
means, and methods of construction, commodity to be transported,
maximum pressure and temperature.
•
Plan shall show all proposed street crossings. Two copies
of plan and application to be submitted to Director of Public
Works.
5. Fees: Permit fee - $300.00
Annual Fee - $200.00
6. All street crossings shall be bored and cased. Permittee will
hold harmless the City from liability for injury or damage to
any person or property caused by actions of permittee. Permittee
shall pay all damages caused to the City by actions of permittee.
7. Provide three (3) maps, showing as-built route, distances and shut-
off valve locations, together with name and address of owner and
telephone number of at least one (1) officer or person available on
twenty-four (24) hour basis for emergency information and action.
Maps are to be filed with Building Official, who will distribute
copies to Fire and Public Works Department. Any change in twenty-
four (2~) hour contact information shall be immediately reported to
the Fire Department.
8. Pipeline signs denoting ownership shall be placed at all street
crossings and as needed.

The scope of this project will be installation of two (2) parallel (in
the •ame trench) pipelines for non-flammable gaseous nitrogen service at 465
psig initial operating pressure, n on-flammeble gaseous oxygen service at 350
psig initial operating pressure. All lines will be hydrostatically tested and
rattd for 720 psig maximum •llawable operating pressure, each briefly
described bclov.
1.1 One (1) 16" O.D. oxygen pipeline and one (1) 16" O.D. nitrogen
pipelinc, each approximately 157,700 linear feet will originate at a
tie-in point approximately 6500 feet rest of U.C.C. Linde LaPorte plant

saytovn-Bayport pipeline corridor, south within Exxon and Friendswood
corridors to Red Bluff Point area, across Galveston Bay, and then south
to terminate at U.C.C. S 6 I plant in Texas City approximately 3200'
south of Hwy. 348 and just east of Hwy. 146.

• ~ 8.0 Depth of Line:
8.1 In specifying depth of line, the recommendations of AREA and
ANSI 831.8 have been carefully considered along with reasonable
safety and installation practices.
8.2 The minimum depth of cover for the carrier pipe without benefit
of casing where highway loading is required will be 4'-0".
8.3 Cased railroad track crossing will have a minimum of 5'-6" cover.
8.4 Cased road crossings shall Dave a minimum of 4'-0" cover.
8.5 Minimum depth of cover for water crossing will be S'0".
9.0 Co nstruction Methods:
9.1 Pipeline shall be welded construction per API 1104 with 1005
x-ray of all butt welded joints.
9.2 Casings shall be installed under all railroad tracks and major
road crossings where uncased pipe is not permitted. Casings
shall be installed by boring or jacking. It is the owner's
desire to minimi:e casings and therefore heavy wall pipe will be
• used in lieu of casing when permitted. In cases where open
cutting is performed, traffic will be maintained on the roadway.

'~`• 9.3 All disturbed surfaces shall be restored to their original
condition.
9.4 The lints shall be pres:ure tested as indicated in section 4.3
of this specification.
9.S Vhen virgin soil conditions permit, it shall be used as
backfill, sufficiently compacted and rounded to give 1002
restoration. When virgin soil is not free of rocks and debris,
the line shall be installed in a 6" all around sand shading.
• 9.6 The contractor shall maintain safe and reasonable railroad and
vehicular traffic conditions throughout the route during the
construction period.
9.7 Adequate and uninterrupted drainage of railroad and vehicular
right-of-nays shall be maintained. If, in the course of
construction, it becomes necessary to block a drainage facility,
temporary drainage facilities shall be installed to maintain
adequate drainage. Permanent facilities shall be restored at
the completion of construction. All action taken shall be
approved by the right-of-way owner involved.
9.8 The Owner's contractor shall be responsible for maintaining the
integrity of all ezisting facilities, for adhering to all A.G.C.
safety standards and Dept. of Labor O.S.H.A. standards
10.0 Cathodic Protection:
10.1 The undezground portion of the line will be protected against
corrosion by a cathodic protection system designed in accordance
with the MACE Standard RP -01-69 (latest Rev.) "RecomDended
Practices for Control of Ezternal Corrosion on Ltnderground or
Submerged Piping Systess".
10.2 Test stations will be installed at each casing; foreign line
crossing (when required) and minimum 1000 ft. intervals along
the pipeline. Insulating flange sets will be installed at all
locations wheze the pipeline enters and leaves the ground.
10.3 Following construction of the pipeline, a post installation
cathodic protection s~vey will be conducted. A pipeline map
and annual maintenance and cathodic protection survey progras
will be set up.
11.0 Painting:
All aboveground sections of the pipeline, casing vents, cathodic
protection test stations, and pipeline markers will be painted.

~ ~ 12.0 Isolation Valves:
~ There rill be manual isolation valves located at the origin of the
• pipeline supply •nd •t each customer use point. The compressors feeding the
pipeline supply system are equipped with automatic trip/isolation controls and
valves.
13.0 Pipeline Markers:
Line markers will be installed at all major direction changes, and all
casing vent a, at nominal 1000 ft. intervals on straight runs of pipe, and on
cathodic test stations to fully identify the routing and location of the
installed line. Pipeline markers will specify the following:

Please find attached the proposal from Gaddy & Paul, Inc. for evaluation
and preparation of bid documents to repair the vehicle storage shed and
main Public Works building damaged by Hurricane Alicia, not to exceed amount
for Engineering Services of $4,000.
I recommend that the City Council authorize Gaddy & Paul, Inc. to prepare
• plans and specifications for the purpose of bidding the repair work to
be done at the Service Center.
Funds for this repair work are available from the insurance claim.

Dear Sir:
Thank you once again for considering GADDY & PAUL INC for additional
consulting engineering services. Enclosed is our brochure for your
use.
• We understand our assignment would consist of the repair and /or
replacement of those items at the Public Works Facility which received
hurricane damage and some items which are not hurricane related but
require immediate attention. The scope of work may be broken down as
follows:
1. Vehicle Storage Shed (19' eave height)
Repair at foundation and replacement of building structure,
including the necessary electrical work.
2. Public Works Building
a. Repair of door frame at north second floor entrance, repair
of window frame at the south wall of the coffee bar, repair
of the north wall of the second floor conference room, and
repair of the fascia siding at the west main entrance.
Replacement of damaged ceiling the can be included; however,
you may wish to handle this with your own forces.
b. Investigation and strengthening of the second floor above the
Parts Department.
c. Installation of missing steel columns and repair of the masonry
wall at the side of the Parts and Receiving area.

The above work will include field work for measurements and evaluations,
structural calculations, contract drawings and specifications, review of
contractor's submittals, and construction observation.
We propose that our fee for services be on a per diem basis for each hour
worked at the following rates:
Principal $40.00 / hour
Engineer $33.00 / hour
Draftsman $25.00 / hour
Clerical $12.00 / hour
Additional expenses, such as a foundation investigation (which we do not
anticipate) and printing of documents for bidding would be invoiced at
our direct cost.
We estimate that our total fee through review of bids (not including
• review of submittals and construction observation) would not be more than
$4,000 and we would not exceed this amount without your authorization.

In October of this year, severe mechanical and safety problems were discovered
on the 1981 Gradall (unit 701-47-48). There was a severe oil leak on the
auxillary diesel engine, brakes were locking, safety brake was not holding, the
main hydraulic cylinder rods were bent and hydraulic performance was poor.
Hiway Equipment, sole distributor for this machine in this area, was called in
several times to determine the cause of the problems, but could not without
taking the machine to their shop and tearing it down. Facilities and personnel
at the Equipment Services Division were not adequate to fix problems of this
magnitude, in addition to the extra workload due to the clean-up.
No firm estimate could be given without complete disassembly. In addition,
several drainage projects were underway, (Idaho, Nugent, Ohio, N. lst), and time
was essential to keep projects moving. Hiway Equipment stated that the machine
could be repaired in their shop in eight (8) days. Because of the mechanical
and safety problems, and on-going projects, it was decided to send the machine
in and have all necessary repairs performed.
The rear engine required rebuilding, at a total cost of $2,990.49. Total labor
and parts for repair of brake and hydraulic system totaled $4,010.37. Total
repair for entire machine totaled $7,000.86.
Due to the unknown extent of repairs needed, the safety hazard, and the need for
the machine to continue drainage projects, together with the sole source vendor
willing to do the job in eight (8) days, repairs were authorized.
I recommend that City Council approve payment for the repairs from the Equipment
Maintenance Account of the Street Division budget.

SUBJECT: Request For Financial Assistance From Your City
The purposes of this memo are two-fold: to thank you for the financial support
your city has already provided to Cities For Responsible Cable Policy, and to
request additional help from you.
As you are aware, Cities For Responsible Cable is a coalition of Texas cities
(see attached list) that was formed in mid-1983. Our goal is to thwart the
passage of federal legislation designed to preempt t}~e authority of cities to
regulate cable TV rates and services at the local level.
• The coalition's efforts have focused on two particularly detrimental bills pend-
ing in Congress--S. 66 and H.R. 4103. If either of these bills were enacted
into law, municipal regulation of CATV would be almost totally eliminated. The
city co~incil would no longer have the power to regulate basic service rates.
Also, any company providing service in a community would have a virtually abso-
lute right to have its franchise renewed whether or not such renewal was in the
public interest. Moreover, cable operators would have the right, existing fran-
chise provisions notwithstanding, fo delete service offerings without the city's
approval.
During the seven months since its formation, Cities For Responsible Cable Policy
has been successful on a number of fronts. First, we have been instrumental in
keeping S. 66 and H.R. 4103 stalled in House committee in Congress. fJithout the
coalition's active opposit.ton, it is likely that the legislation would have
already passed.
Secondly, the coalition has played a key part in organizing nationwide opposi-
tion to S. 66 and H~.R. 4103. Prior to the formation of Cities For Responsible
Cable Policy, interest in the cable issue was, because of lack of information,
limited. Now, however, hundreds of cities across the country have joined in the
battle .
And finally, our coalition was successful in getting the National League of
Cities to reverse its position on this issue. Previously, NLC had supported
legislation that would have diluted the cities' CATV regulatory powers. Now,
• in response to pressure brought by t}ie coalition, NLC is supporting our goal of
preserving the cities' basic regulatory powers.

These achievements were made possible because of financial assistance provided
by your city and the 195 other municipalities that contributed to our effort.
• Participating cities collectively contributed $62,b48, of which $61,541 was paid
out in attorney's fees for direct lobbying in Washington, and $1,107 was ex-
pended on mailings and other administrative items. Based on the record, these
funds obviously were well spent.
At this juncture, it is necessary for us to request that your city provide addi-
tional financial support to Cities For Responsible Cable Policy. Our nominal
expenditures to date have yielded substantial results, but S. 66 and H.R. 4103 ti
are still very much alive, and it will take considerable money and on-site work
in Washington by our coalition lobbyists in order to prevent the passage of
tt-ese bills.
Your city's financial assistance is urgently, and immediately, needed. I,le are
requesting contributions according to the following schedule:

Without the active financial support of Texas cities, chances are that we will
