REGULAR MEETING OF THE LA PORTE CITY COUNCIL
MARCH 21, 1984
1. The meeting was called to order by Mayor Cline at 7:00 P.M.
Members of Cit Council Present: Mayor Virginia Cline, Council-
persons Ed Matusza Linsday Pfeiffer, Deotis Gay, B. Don Skelton,
Linda Westergren and Norman Malone
Members of City Council Absent: Councilpersons Kevin Graves
and John Longley
Members of City Staff Present: City.Manager Jack Owen, City

2. The invocation was given by Councilperson Skelton.
3. Council considered approving the minutes of the regular meeting
held March 14, 1984.
Motion was made by Councilperson Skelton to approve the minutes
as presented. Second by Councilperson Gay. The motion carried,
7 ayes and 0 nays.
Ayes: Councilpersons Matuszak, Pfeiffer, Gay, Skelton, Wester-
gren, Malone and Mayor Cline
Nays: None
4. Mayor Cline proclaimed the last week in March as "FFA Week" in
La Porte, and praised the local FFA chapter and their sponsor
for their excellent achievements.
Jimmy Jernigan, president of the FFA Club, and David Berrier,
FFA Sponsor, accepted the proclamation.
5. Council considered approving the request of Space City Inter-
national Air Show to hold an air show at La Porte Municipal
Airport.

person Skelton. The motion Carrie ayes, 0 nays, 1 abstain.

Abstain: Councilperson Graves, who had arrived at the Council
table at 7:31 and had not heard the complete presenta-
tion of the agenda item.
6. Council considered an ordinance closing a portion of West "K"
and South 9th Street.
It was explained that this portion of the streets had been
inadvertently left out of the ordinances originally closing
these streets.
City Attorney Askins read: AN ORDINANCE VACATING, ABANDONING
AND CLOSING A PORTION OF WEST "K" STREET AND SOUTH 9TH STREET,
• CONTAINING A TRACT OF LAND 30 FEET BY 39'.5 FEET, CONTAINING
0.0272 ACRES; RETAINING PUBLIC UTILITY EASEMENTS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFEC-
TIVE DATE HEREOF.
Motion was made by Councilperson Gay to adopt Ordinance 1402
as read by the City Attorney. Second by Councilperson Pfeiffer.
The motion carried, 8 ayes and 0 nays.

7. Council considered an ordinance granting a.pipeline permit~to
Gulf Oil Corporation.

UNDER SECTION 18-A-3 OF ORDINANCE NO. 915, "PIPELINE TRANS-
PORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF
THE CITY OF LA PORTE, TEXAS; AND APPROVING THE APPLICATION OF
GULF OIL CORPORATION DATED MARCH 5, 1984, TO CONSTRUCT A SIX
INCH (6") PROPYLENE PIPELINE; AND PROVIDING AN EFFECTIVE DATE
HEREOF
Motion was made by Councilperson Matuszak to adopt~Ordinance

8. Council considered an ordinance allowing a duplex in an R-1
zone.
City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY ALLOWING
A DUPLEX TO BE LOCATED ON THAT CERTAIN PARCEL OF LAND HEREIN
DESCRIBED, SAID LAND BEING ZONED R-1 RESIDENTIAL; AND PRO-
VIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Skelton to adopt. Ordinance No.
780-BBBB as read by the City Attorney. Second by Councilperson
:Malone. The motion carried, 8 ayes and 0 nays.

• 9. Council considered approving a one-year contract with Bay
Area Disposal Service for Spenwick and College View areas.
Mr. Owen stated the performance bond has been received and
everything is in order. It was requested that the budget
revenue be amended by $39,000 and the expenditure side by
$51,000, and pick up the difference from the budget.
Motion was made by Councilperson Skelton to approve the one-
year contract with Bay Area Disposal Service. Second by
Councilperson Pfeiffer. The motion carried, 8 ayes and 0 nays.

10. Council considered advertising for bids for cleaning, TV inspec-
tion and point repairs. for portions of sanitary sewer collection
system (EPA project C-48-1176-03)~.
Motion was made by Councilperson Matuszak .to approve advertisin
for bids for EPA project C-48-..1176-03;.such bids to be opened
at the Council meeting on May 2, 1984. .Second by Councilperson
Pfeiffer. The motion carried, 8 ayes and 0 nays.

11. Council considered a.ppointmen~ts to the La Porte Area Water
Authority Board.
Motion was made by~Councilperson Skelton to table this item
until the April 4 meeting in~orcler to try to find a person
living .within the City of La~Porte~ETJ to serve on this board.
Second by Councilperson Matuszak. The motion carried, 8 ayes
and O nays.

12. Administrative Reports:
Mr. Owen complimented the office staff for their hard work
preparing the information for the Justice~Aepartment. They
put in many long hours and he is extremely proud of them.
Also, a special word of appreciation .to Knox Askins, who spent
many, long hours and extra phone calls trying to expedite the
proceedings.
• ~ Announced. that the County has started work on the roads in
Spenwick and we should end up with some very good streets out
there.
13. Council Action:
Matuszak: Thanked Mr. Owen and the whole staff for their fine
job on the Justice Department work.
Certainly need to do something about 146 and Fairmont Parkway.
Maybe we can get a red-red delay or speed bump, or something to
slow people down. Something needs to be done immediately on
this before more lives are lost.
Graves: Thanks to the staff for the information he had requested..
Pfeiffer: Would like to see staff look into condemning house
trailers, or whatever, that had been damaged during the hurricane.
He has been getting several calls on this.
G_~: Grateful for work staff and Knox Askins did on Justice
Department information.
Skelton: The eyeball-to-eyeball contact we all had with the
people in Washington helped, a lot, too, in addition to the work
• done by staff. Thanks to all of them.

Has a report about go cart racing on North Farrington. Ap-
parently a police officer had informed the riders that it was
now a designated place to ride go carts. This is not true, and
it really needs. to be stopped, as it is~d~angerous to the kids
riding them, as well as posing a hazard to planes if the carts
get too close to the runway. Hopefully, the perimter fence will
help deter this situation.
Requested that staff look into furnishing a copy of the full
fire report each month rather than the one page report given
now, in order to get a better handle on what the fire depart-
ment is doing.
Westergren: It is time to do something about the intersection
a.t 146 and~Fairmont Parkway, whether it be heavier patrolling,
pushing to get the speed limit reduced; but we must do something.
It would be unfortunate if we let it go and some family is wiped
out in an accident out there.
Skelton: We have sent representatives to Austin to meet with
the Highway Department and our legislators, and.we keep getting
• the same old answer; "we.need money." They've got the engineering
work done and it's_ on the schedule, but it's getting the money.
You're right - we need to do something right now.
Owen: Our police department has been .given instructions to patrol
there more, and they have been doing so. My .personal observa-
tion has been that so many people are just traveling through, and
they can't be "trained" to slow down there.
Cline: I have written the Governor, the Chairman of the State
Highway Commission and to Omer Poorman of ,District 12. I don't
anticipate them writing right back and saying they have the
money and will build the overpass. Every time they say there
are no funds to build highways. I.f anyone .else has any ideas?
Matuszak: We have a bank that looks out on that intersection.
If we're having accidents as frequently as we are, it wouldn't
take but~one 8-hour video tape, from. their camera,. splice it
showing the accidents, and send it to Austin so they can see
for themselves . I think .that would, .be very effective . Another
thing would be to send a letter to the Highway Department every
time there is an accident where someone is injured. Bombard
them every time something happens.
Malone: Are we going to-bide on the City float this year?
Cline: Polled the Councill. All present indicated they would
ride on the float. ~

14. Council adjourned into executive .session at 8:26 P.M. and
returned to the Council table at 9:01 P.M.

dear Mr. Owen:
This letter is to introduce International Aerobatic Club Chapter 25 and hopefully
enlist your support in putting on one of the finest air shows ever seen in
Texas. IAC Chapter 25 is a nonprofit organization whose primary interest is
flying, promoting and competing in aerobatics. This year one of our members,
Deborah Rihn, won a place on the~U.S.A. Team which will compete in the World
Aerobatics Competition which will be held in Hungary in August of this year.
Another of our members, Dr. Eo•in Harvey was selected as the team physician.
We are duly proud.
We, the air show, would intend to make.a donation to the Aerobatics Foundation
in the name of our two members and. to support their efforts. The rest of the
money•above the club's operating cost would go to the charities of the choice
of the donors and contributors. Some of the major contributors already pledged
are: Coors Pepsi, Red Barron Pizza, Gullo Haas, Bud, Harold's, Monterrey House
and Casa Ole.
We expect all three major T.V. Networks to give us advertising and to be there to _
• cover the flying.
We welcome all civic and .charitable organizations to participate to whatever
extent they can.
We intend to have the airshow Memorial Weekend, May 26, 27. We think LaPorte
would be a great place. We would expect 10 to 15,OOO.visitors each day.
IAC 25 has at this time arranged for total insurance coverage for the day before
and day after with a $2,000,000 limit. We will be happy to send you a copy of the
certificate as soon as we receive it.

Debby Rihn, with H & R Aviation, and representing Chapter 25 of
the International Aerobatic Club, has applied to the FAA for a
Certificate of Waiver to hold an airshow at the La Porte Municipal
Airport. The FAA has indicted that the certificate will be issued
when special provisions and conditions are met - primarily safety
measures.
Although the primary responsibility for safety and operation of
the airshow rests with the sponsoring organization, Chapter 25
of the International Aerobatic Club, the City will need to provide
an ambulance and fire protection at the airport while the show is
in progress, in addition to crowd and automobile traffic control.
Representatives of Chapter 25 of the International Aerobatic Club
• will be a the Council Meeting on March 14, 1984, to present their
plan to meet FAA requirements and to request services needed from
the City. In addition, authorization is needed from City Council
to allow the airshow to take place on the La Porte Municipal Airport.

We had a meeting Thursday afternoon w;ith.Dr, Harvey to
ascertain exactly what he expected of the police department at th.e
time of the air show. As we understand at this t#me our duty will
be street traffic control and some uniformed officers for visibility
to aid in crowd control.
It is-our understanding that Dr. Hax`yey and others connected
with the show will provide all personnel for parking cars, crowd
control, and guards for all airplanes, both those planes involved in
the show and planes that are home-based at La Porte Airport.
In order to provide for an orderly entry and exit from the
proposed air show the following plan of action concerning th.e Police
Department is submitted.
All police department personnel used for this event will either

be off-duty regular officers, or reserve officers. All slots needed
will be filled by La Porte Police Department personnel, regular and
reserve, first and if unable to adequately fill the slots-, outside
agencies will be contacted. (Morgans Point, Pct. 8 Constables, Seabrook
and Harris County) All regular licensed personnel will receive $12.00
•
•
•
per hour for each. hour worked and the dame amount per hour will be
donated to the La Porte Police Res:eryes, by 'the pramoters.•of~;the air
show, for each reserve officer that works. A total of ten (10) officers
will be needed each day: two officers at West Maim and Farrington and
West Main and 26th Street; one officer at the VIP parking area and the
Air National Guard parking lot; and four G4~ officers in the spectator
area. All officers will report at 10:00a.m. and work until 4:OOp.m.,
for a total of six hours. The cost will be $720.00 per day, for a
total of $1,440.00.
In order to maintain a smooth flow of tra~~ic before, during
and after the show, the following actions are recommended:
10:00a.m. - All officers report to assignments and begin
• directing traffic as needed.
12:30p.m. - All traffic on West Maim between Farrington and
26th will be rerouted if not attending air show.
Barricades will be placed at Farrington and 26th.
Street.
4:OOp.m. - Barricades remain in place until all parking spaces
are nearly empty. Westbound lanes of Wrest Main at
Farrington and eastbound lanes~at West Main and
26th will be open to traffic.
Alternate: If Driftwood is open to traffic, two officers will be
needed to handle traffic and barricades will be needed also. If Airport
Boulevard is open to traffic, one officer will be needed. The additional
cost would be $432.00.
We have written Harris County Engineer Dick Doss, asking their
permission to block Spencer Hwy. during the mentioned hours, since Spencer
Hwy. is a county roadway. We will forward the county's answer to your
• office immediately upon receipt.

On May 26th and May 27th, 1984, plans are underway to have
an air show at the La Porte Municipal Airport, located on Spencer
• Highway in La Porte.
We have a verbal request from the promoters to close Spencer
Highway to all traffic during the time of the show, approximately
four hours each day, in order to insure the safety of spectators and
the safety of those traveling Spencer at that time. The City of La
Porte will furnish all traffic control.
Your earliest consideration in this matter will be appreciated.

AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
WEST "K" STREET AND SOUTH 9TH STREET, CONTAINING A TRACT OF
LAND 30 FEET BY 39.5 FEET, CONTAINING 0.0272 ACRES; RETAINING
PUBLIC UTILITY EASEMENTS; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the. City Council of the City of La Porte has
been requested by the record owners of all of the property
abutting the hereinafter described portions of West "K" Street,
and South 9th Street, containing a tract of land 30 feet by
39.5 feet, containing 0.0272 acres, in the City of La Porte,
• to vacate, abandon, and permanently close those portions of
West "K" Street and South 9th Street; and
WHEREAS, the City Council of the City of La Porte has
determined, and does hereby find, determine and declare that
the hereinafter described portions of West "K" Street and South
9th Street are not suitable, needed, or beneficial to the
public as a public road or street, and that the closing of
the hereinafter described portions of West "K" Street and
South 9th Street are for the protection of the public and for
the public interest and benefit, and that the hereinafter
described portions of said West "K" Street and South 9th Street
should be vacated, abandoned, and permanently closed;
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PO RTE:
Section 1. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. 13,
Title 28, Art. 1175, of the Revised Civil Statutes of the State
of Texas, 1925, the hereinafter described portions of West "K"
• Street and South 9th Street are hereby permanently vacated,
abandoned, and closed by the City of La Porte, to-wit:

Being a 0.0272 acre tract of land, which
is part of the West "K" Street Right-of-
way and part of South 9th Street Right-
of-way according to the plat of the
Town of La Porte as recorded in Volume
60, Page 112 through 114 of the Harris
County Deed Records. The 0.0272 acre
tract of land is more particularly
described by metes and bounds as
follows:
Beginning at a 5/8 inch iron rod found
for the Southeast corner Block 1100,
Town of La Porte; said point being
coincident with the point of intersection
of the North right-of-way line of West
"K" Street and the West right-of-way
line of South 9th Street; said point
being the Northwest corner of this
0.0272 acre tract.
Thence, East; coincident with the South
boundary line of that certain portion of
South 9th Street right-of-way previously
vacated, abandoned and closed by City
of La Porte Ordinance No. 1389, dated
November 16, 1983; a distance of 30.00
feet to a point for the Northeast corner
of this 0.0272 acre tract.
Thence, South a distance of 39.50 feet to
a point for the Southeast corner of this
tract.
Thence, West a distance of 30.00 feet to
a point for the Southwest corner of this
tract.
Thence, North; coincident with the East
boundary line of that certain portion
• of West "K" Street as vacated, abandoned
and closed by City of La Porte Ordinance
No. 1390, dated November 16, 1983; a
distance of 39.50 feet to the POINT OF
BEGINNING.
Provided, however, the City of La Porte
SAVES AND EXCEPTS a public utility
easement under said 30 feet by 39.50
feet portion of South 9th Street and
West "K" Street, for the City of La Porte
water, sanitary sewer, and storm sewer,
and also for the use and benefit of all
other public utilities holding franchise
• agreements with the City of La Porte.

It is the intention of the City of La
Porte that the above' described 30 feet by
39.50 feet portion of South 9th Street and
West "K" Street shall be permanently closed
to through pedestrian and vehicular traffic
of all kinds, and for any other surface and
aerial uses, except the herein retained sub-
surface~public utility easements, and any
necessary right to use the surface, in
connection with the exercise of such public
utility easements.
The City of La Porte, for itself, its
successors and assigns, and the public
utilities holding franchises from it,
• shall have the perpetual right, privilege
and easement, with appropriate rights of
ingress and egress and reasonable working
area for construction and maintenance,
to enter upon and construct, reconstruct,
maintain, operate, inspect, replace,
repair and remove public utility facilities,
together with all necessary improvements
under and across said 30 feet by 39.50
feet of South 9th Street and West "K"
Street, as described herein.
All paving plans and specifications shall
be subject to the prior approval of
the City of La Porte, including, but
not limited to the placement of construc-

Re: Gulf Oil Corporation Pipeline
Replacement 6" Propylene
Per our previous communications, Gulf Oil Corporation has initiated
plans to improve portions of its 6" propylene pipeline in the
LaPorte area. The attached map "Hi-Lites" the Phase I project
parameters, and more specifically regarding City of LaPorte
domain, will be construction along Old LaPorte Road to a point
North of Fairmont Parkway.
The decision to replace this pipeline is based on rising maintenance
expenditures expected of a facility installed in 1951 utilizing state
of the art lap weld pipe and casing accommodations for road
• crossings. As discussed, our proposed replacement pipe will be of
superior design, and we respectfully request permission to use
concrete coated pipe in lieu of steel casing for road crossings.
Further, in keeping with Chapter 18-A of the LaPorte Code of
Ordinances, Gulf Pipeline Company acting as Agent for Gulf Oil
Corporation, hereby applies for a permit to replace subject pipeline
in accordance with the following information:

AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-A-3 OF ORDINANCE
NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE
CODE OF ORDINANCES OF THE CITY OF LA PORTS, TEXAS; AND APPROVING
THE APPLICATION OF GULF OIL CORPORATION DATED MARCH 5, 1984,
TO CONSTRUCT A SIX INCH (6") PROPYLENE PIPELINE; AND PROVIDING
AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
• Section 1. The City Council of the City of La Porte has
received an application dated March 5, 1984, from Gulf Oil
Corporation, requesting permit under Section 18-A-3 of Ordinance
No. 915, being Chapter 18-A of the Code of Ordinances of the
City of La Porte, to construct a six inch (6") propylene pipe-
line, crossing the City of La Porte, all as shown on said
application. The application of Gulf Oil Corporation has been
reviewed by the City's Director of Public Works, who has found
that said application meets all requirements of said Ordinance
No. 915, and has recommended its approval.
Section 2. The City Council of the City of La Porte
hereby approves the application of Gulf Oil Corporation, dated
• March 5, 1984, and this Ordinance shall constitute a permit to
Gulf oil Corporation to lay and construct said pipeline within
the City of La Porte, all in conformance with the requirements
of said Ordinance No. 915.
Section 3. This Ordinance shall be in full force and
effect from and after its passage and approval.

DISCUSSION OF CASED PIPELINE
CROSSING ROADS OR STREETS
VERSE UNCASED PIPELINES
CROSSING ROADS OR STREETS
Although cased pipelines have been used for many years, updated technology
has brought forth better conditions and safer aspect to pipelines as shown
below. The U.S. Department of Transportation, Title 49 C.F.R. Parts 195,
State Department of Transportation and Safety, American National Standard
Institute (ANSI), American Petroleum Institute (API), Harris County
Commissioners are some of the governing organizations under which pipelines
are designed that allows pipeline to cross roads and street without casing but
requires different types of protection.
Although we respect the requirements and ordinances of the City of LaPorte,
Texas we sincerely request that the replacement pipeline be installed across
city street as shown on the attached plats without casing but coated with 1"
layer of concrete reinforced with wire mesh- over the bitumastic coal tar
coating. Even if requirements for non-casing calls for additional foot of cover
or installation of reinforced concrete slab in the drainage ditches below grade
we think more would be accomplished than casing the pipeline. It is thought
that the city of LaPorte would be best served giving the safest means living
with the pipeline industry.
1. The most important aspect for non-cased road is that the carrier pipe
(pipe which contains the liquid) will be cathodically protected by
magnesium anodes or electrical rectifiers. With the bitumastic coal tar or
epoxy coatings a minimum of cathodic protection will be required. With
casing, the carrier pipe cannot be cathodic protected since the casing will
prevent the carrier pipe from receiving the cathodic protection current.
2. Also it is very difficult with expansion of the pipe and casing due to
wetting and drying of the soil as well as temperature changes the casing
and carrier pipe become in contact with each other causing damage to the
coating and shorting the casing and carrier pipe. When shorting the pipe
and casing occurs, the cathodic protection is partly lost. To correct this
shorting of the pipe and casing they must be excavated to remove the
short. If the short is not removed additional cathodic protection must be
applied and even then the pipe may require removing or replaced if
damages are sever.
3. The casing will give a certain amount mechanical protection from external
outside forces depending on the type of equipment is used and the
experience of the equipment operator. A tooth of a backhoe or a plow
installing cable would probably puncher both the casing and carrier. The
1" concrete coating would offer just as much protection as the casing.
4. Lowering the carrier pipe would probably help the chances of less damage
of the pipe. Additional cover-in drainage ditches would be beneficial to
prevent ruptures.

5. Another method to prevent outside damage would be to install 6" thick
steel reinforced concrete slab in the drainage ditch. This slab would
cover the width of the drainage ditch extending two feet on both side of
pipeline and approximately one foot above the pipeline. On crossing
where ditches are not needed and concrete curb may or may not inplace
then the concrete slab will be installed in 10 feet section to the right of
way line.
• 6. Added wall thickness of pipe may give some addition to safety but
normally does not prevent accidents.
If approved the Gulf Oil Corporation 6" pipe replacement across City of
LaPorte streets and roads will be bored and pulled using concrete coated line
pipe cathodically protected with magnesium anodes without casing.

AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, BY ALLOWING A DUPLEX TO BE LOCATED ON THAT
CERTAIN PARCEL OF LAND HEREIN DESCRIBED, SAID LAND BEING ZONED
R-1 RESIDENTIAL; AND PROVIDING AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
finds, determines and declares that heretofore, on the '6th day
of October, 1983, at 7:00 o'clock P.M., a public hearing was
• held before the Planning and Zoning Commission of the City of
La Porte, Texas, pursuant to due notice, to consider the question
of the possible reclassification of the zoning classification
of the hereinafter described parcel of land. Said possible
reclassification, if granted, would permit a duplex to be placed
upon the hereinaf ter described parcel of land, said land being
zoned R-1 Residential. There is attached to this ordinance as
Exhibit "A", and incorporated by reference herein and made a
part hereof for all purposes, a copy of "Notice of Public Hearing",
which the City Council of the City of La Porte hereby finds was
properly mailed to the owners of all properties located within
two hundred feet (200') of the properties under consideration.
• Section 2. The Publisher's Affidavit of Publication of
notice of said hearing is attached as Exhibit "B", incorporated
by reference herein and made a part hereof for all purposes.
Section 3. Subsequent to such public hearing, the City of
La Porte Planning and Zoning Commission met in special session
on October 6, 1983, to consider the permitting of a duplex within
an R-1 Residential classification, which were the subject of such

SUBJECT: Slid Waste Contract
DATE: March 1, 1984
The City of La Porte has recently annexed two (2) areas west of the
city, Spenwick and College Uiew Municipal Utility Districts. Spenwick
MUD has been dissolved, and is presently receiving all city services.
College View MUD will be dissolved on March 27, 1984.
Spenwick MUD had no formal garbage collection contract before annexation.
However, College View MUD has a three (3) year contract with Bay Area
Disposal Service, cancelable only for failure to perform. The contract
period is from July 1, ]983 through June 30, 7986.
The Public Works Department collected data in June 1983 and determined
that the annexation of these two (2) areas would stretch the ability of
the Solid Waste Division to provide service to these areas. Rapid growth
in the western portion of the city and thermnending closing of the
Harris County Landfill wi17 require an additional collection crew.
In order to allow time to budget for the additional crew and equipment,
and to shorten the contract period with Bay Area Disposal Service, the
Public Works Department has negotiated a contract with Bay Area Disposal
Service fora one (1) year period beginning April 1, 1984 through March
31, 1985. The orginal contract price per month per residence was EIGHT
Dollars ($8.00) per month. The negotiated price is EIGHT DOLLARS AND
FIFTY CENTS ($8.50) per month per residence. The increase is due to the
shortening of the contract and the increased service the contractor will
have to provide to equal city service.
The contractor will carry the required liablity insurance and obtain
a ONE HUNDRED THOUSAND DOLLAR ($100,000) performance bond or post a
FIFTEEN THOUSAND DOLLAR ($15,000) cash bond. The city will provide
plastic bags to residents,~and the contractor will be responsible for
all .other costs, including landfill fees. This contract will be for
College View and Spenwick. Although the city began collection in
Spenwick on January 31, 1984, the development occurring in new subdivisions
is rapidly expanding present routes to the limit. The contracting of
• these two (2) areas for one (1) year will allow the Solid Waste Division
time to budget funds in October, purchase equipment, and reroute the entire
city from four routes to six routes.

SOLID WASTE COLLECTION AGREEMENT
This Agreement made and entered into by and between the CITY OF
LA PORTE, a municipal corporation of Harris County, Texas, hereinafter
called "City", and DENNIS DECKER, doing business as BAY AREA DISPOSAL
SERVICE, a sole proprietorship, hereinafter called "Contractor".
W I T N E S S E T H.
This Agreement is made and entered into by and between City and
• Contractor to provide solid waste and trash collection service to
all residences, except commercial properties, within the boundaries
of the former College View Municipal Utility District and the former
Spenwick Place Municipal Utility District, both of which were finally
annexed to the City of La Porte on December 28, 1983. This Agreement
supercedes that certain agreement between Bay Area Disposal Service,
as Contractor, and College View Municipal Utility District, dated
July 19, 1983, which former agreement shall be null, void, and of no
further force and effect, from and after the effective date hereof.
I.
This Agreement shall be for a one (1) year term, commencing
April 1, 1984, through March 31, 1985.

II.
City agrees to pay Contractor for the services to be performed
under this Agreement, the sum of EIGHT DOLLARS AND FIFTY CENTS ($8.50)
per occupied residence, per calendar month. Any occupied residence
shall include an occupied mobile home, an occupied unit of an apartment
project, and an occupied unit of a duplex, fourplex, or other multiple
'family dwelling. It shall not include unoccupied residences, mobile
homes, or multi-family units. City shall make payment to district
• based on City's records as to occupancy of the property, in accordance
with City ordinances, on or before the 10th of the month following

the month in which services are rendered by Contractor. Contractor
shall be entitled to payment for services rendered, whether or not
City is able to collect from City's customer.
III.
Solid waste disposal pick up days shall be on Tuesdays and Fridays
of each week, between the hours of 7:00 o'clock a.m. and 7:00 o'clock
p.m. Trash pick up day shall be on Friday of each week. Contractor
shall be obligated to maintain at least the same level of service
as is provided by City to its other customers within the City of
• La Porte, as of the effective date hereof. The terms and provisions
of Chapter 12 of the Code of Ordinances of the City of La Porte,
"Garbage and Trash," is incorporated by reference herein and made
a part hereof for all purposes, and shall establish the level of
service. City shall furnish all solid waste collection service to
commercial establishments, which are excluded from this Agreement.
If the collection day falls on New Year's Day, Memorial Day, July 4,
Labor Day, Thanksgiving Day, or Christmas Day, Contractor shall make
collection on the next scheduled pick up day. City shall provide
plastic bags to the residents of the area covered by this Agreement,
at no cost to either the Contractor or the residents, all in accordance
with established ordinances of the City of La Porte. Residents
may purchase additional plastic bags from the City, in accordance
• with such ordinances. Contractor shall make no additional charge
for picking up trash. Service specifications shall be in accordance
with Chapter 12 of the Code of Ordinances of the City of La Porte,
and, in addition, Contractor shall comply with all laws, rules, and
regulations of the State of Texas, the Harris County Health Department,
and any other agency having jurisdiction. Contractor shall arrange
for its own sanitary landfill, in which to deposit the solid waste
• collected, and Contractor shall be responsible for its own sanitary
landfill fees.

IV.
Contractor agrees to use enclosed compactor type vehicles to
perform all services except for the large, heavy trash pick up.
Contractor shall provide necessary covering for heavy trash pick up
trucks, and shall avoid spillage of same on City streets and roads.
V.
This Contract may be cancelled only for failure of the Contractor
to perform services required of Contractor under the terms and
provisions of this Contract. Contractor shall not be responsible
• for failure to perform in the event of act of God, or act of war.
Strikes or work stoppages shall not be considered grounds for refusal
to perform by Contractor, however.
VI.
The relationship between City and Contractor shall be that of
owner and independent contractor. Contractor shall be solely respon-
sible for the supervision of, and payment to, and the acts of its
agents and employees in the performance of their duties. Contractor
agrees to save and hold harmless City against all claims, loss,
damage, injury, or liability, howsoever caused, resulting from the
operations, or the acts of Contractor, its agents, servants, and
employees, including City's reasonable attorney's fees.
• VII.
Contractor shall, at all times during the term hereof, keep in
force, and shall furnish City with a certificate of insurance on same,
of public liability insurance with minimum limits $100,000/$300,000
and $20,000 property damage, and worker's compensation insurance
for its employees, which insurance shall meet the minimum requirements
of the laws of the State of Texas. In addition, Contractor shall
• file, at its option, either (1) a payment and performance bond of
$100,000.00, or (2) a $15,000.00 cash deposit, with City, to guarantee

its performance hereunder. Any performance bond shall be underwritten
by a corporate surety licensed to do business in the State of Texas.
IN WITNESS HEREOF, the parties hereto have placed their hands
and the signatures of their duly authorized agents, on this day
of March, 1984. This Agreement shall be effective April 1, 1984.

The plans and specifications for your wastewater facilities project
have been approved, and a copy is being returned under separate cover.
All construction items shown on the plans are considered eligible for
federal participation, however, federal funding will be limited to funds
remaining from the original contract. Please make the approved plans
and specifications available at the construction site for the contractor,
state, and federal personnel.
• As you are aware, these wastewater facilities, when in operation, must
produce the quality of effl uent specified by the City's waste discharge
permit. Should it become necessary to discharge raw or partially treated
sewage during construction, please be advised of the following require-
ments:
a. At least thirty days before commencement of any discharge of
untreated or partially treated wastewater, the city should
submit an application to the Executive Director of the Texas
Department of Water Resources (TDWR) for authorization to
discharge. Such application should include justification,
' time schedules, alternatives to minimize and control the
discharge, and other information deemed necessary to evaluate
• the proposed discharge.
b. Such application must be in accordance with Texas Water
Development Board Rules concerning Temporary Orders (31 TAC §§
341.92 - 341.94).

Water Commission may consider approval of temporary discharges
during construction at a public hearing called for this purpose.
This letter is addressed to the aspect of adequate collection and treatment
of wastevrater before discharge to the waters of the State of Texas and
should not be construed as preempting any approvals that may be required
by other federal, state, or local governmental agencies.
With the approval of these plans and specifications, you are authorized
to advertise for and open bids on this project. However, please do not
award a contract until we advise you to do so. Please be advised that
before we can authorize award of a contract you must have secured your
local funds.
When you give the advertisement to the printer for publication, please for-
ward three copies to this agency.
We are enclosing the following documents:
1. CG-192, Bidding Requirements
For your information and guidance in complying with the
regulations and requirements for advertising, preparation
of bidders' proposals, opening bids, and submitting the
bid documents immediately after bids are opened.
2. CG-176, A Current Wage Decision and CG-185, General Conditions
They must be included in the contract specifications before
bids are opened. It is important that we be notified of
any changes made in bid opening date and contract award date
to assure the wage decision is current and valid. Notice
