1. The special called meeting of the La Porte City Council
was called~to order by Mayor Cline at 6:00 P.M.

2. The Mayor read the election returns and passed them to Council.,

OF THE REGULAR ELECTION HELD IN THE CITY OF LA PORTE ON
APRIL 7., 1984, FOR THE ELECTION OF COUNCILPERSON DISTRICT 1,
COUNCILPERSON DISTRICT~6, AND COUNCILPERSON AT LARGE POSITION B
Motion was made by Councilperson Skelton to adopt Ordinance
1404 as read by the City Attorney,. Second by Councilperson Gay.
The motion carried, 9 ayes,.0 nays.

3. Judge J. B. Williamson gave the oath of office to Norman
Malone, Councilperson District 1, Linda Westergren, Council-
person District 6, and Lindsay Pfeiffer, Councilperson at
Large Position B, after which they took their places at the
Council table.

Meeting
Councilperson Malone thanked the people for their interest
in the City, and wishes there were more interest. Feels
the citizens and Council can pull together to make this a
better city, which won't take a to t. because he thinks a lot
of this city and it's good now.
Councilperson Westergren thanked the people who participated
in the election. Thinks it shows a concientious effort to
protect our system, and that's very important to us. She
feels we have a chance .to move ahead and .do some positive
things in this community. It is a good community and she
thinks it will continue to be so.

Councilperson Pfeiffer. agreed with what they both said. He
looks forward to working with the City for the next three
years. We've got some~good~.programs going and he'd like
to see~them completed.. Would like ~to see the City set on a
course of policy that will continue to help it grow with
good fiscal responsibility and give~the citizens the best
they can.
Councilperson Skelton stated he was happy to see his three
colleagues join us again for another three years. It's a
good indication people want to see what we've started con-
tinue, and he's happy to have them back with us.
Councilperson~Gay commented that B. Don.said~what he was
planning on saying.
4. The emergency addendum was then read by Mayor Cline, pertaining
to the rebidding of the cleaning, .television inspection and
point repairs for portions of the sanitary sewer rehabilitation
project.
City Attorney Askins stated that a letter of protest had been
received (a part of these official minutes) from Wickwire,
Gavin & Gibbs, attorneys for Jesse~Lovelace~Construction Co.
Sears & Burns, counsel for the City, .is asking for Council
approval to reply to the letter. of protest.

2. The invocation was given by Councilperson Gay.
3. Council considered approving the minutes of the regular meeting
held April 4, 1984.
Councilperson Skelton had several.additions to the minutes:
(a) on item 7, he had commented that AMI had made their
interest know in the City of La Porte and said they could
move beds from one city to another; so they may have gone
ahead and started a request; (b) on item 8, he requested
staggered terms for the members of the Health Facilities
Development Corporation board; (c) on item 11, had requested
Mr. Owen to prepare a safety plan covering evacuation and
safety measures in the event of a pipeline disaster.
Motion was made by Councilperson Skelton to approve the minutes
as amended to include his comments. Second.by Councilperson
Westergren. The motion carried, 9 ayes, 0 nays.

4. Mayor Cline proclaimed April 23 through 29, 1984, as
Energy Conservation Week. Mr~.~Jim Wyatt of Houston Lighting
& Power accepted the proclamation.
5. Council considered electing a Mayor Pro Tem.
Motion was made by Councilperson Skelton to move agenda
items 5, 7 and 10 to an executive session on personnel.
Second by Councilperson Gay. The motion carried, 9 ayes, 0 nays.

6. Council considered approving the sale of beer on City property
for an air show at La Porte Municipal Airport on May 27 and
28, 1984.
Motion was made by Councilperson Matuszak that the sale of
C ~ beer on City property be permitted for the air show at La
Porte Municipal Airport on May 27 and 28, 1984, for the Inter-
national Aerobatic Club, the time being 30 minutes before
the air show until 30 minutes after the show, approximately
a three (3) hour period, with a fee of $S.OO for each day.
Second by Councilperson Westergren. The motion carried, 9 ayes,
0 nays.

7. Item 7, appointing a health officer, was moved to executive
session.
8. Council. considered ratifying~a resolution supporting Texas
Municipal League's "Pothole Bill."
City Attorney Askins read: RESOLUTION 84-3 - SUPPORTING
INCREASE STATE HIGHWAY FUNDING, PASSAGE OF THE POTHOLE BILL
AND INCREASED HIGHWAY USER CHARGES
Motion was made by Councilperson Longley to approve. Resolution
84-3 as read by the Cit Attorney. Second by Councilperson
Pfeiffer. The motion carried, 9 ayes, 0 nays.

9. Council considered a resolution concerning Banking Institutions.
City Attorney Askins read: RESOLUTION 84-4 - CONCERNING
BANKING INSTITUTIONS.
Motion was made by Councilperson Skelton to adopt Resolution
84-4 as read by the City Attorney.- Second by Councilperson
Matuszak.. The motion carried, 9 ayes, 0 nays.

10. Item 10, board appointments, was moved to executive session.
11. Council considered proposal. No. 1 of the La Porte Area
Emergency Ambulance Corps concerning purchase of new units.
After a presentation by Robert Head and discussion and
questions from Council, motion was made by Councilperson
Graves that proposal No. 1 as presented by the La Porte
Area Emergency Ambulance Corps, with the City going out for
• bids, be approved. Second.by Councilperson Malone.
Motion was made by Councilperson Skelton to table this item
for a workshop and bring it back.to the next regular meeting
for a vote, said workshop to be held at 6:00 P.M. on May 2.
Second by Councilperson Matuszak. The motion carried, 6 ayes,
3 nays.

12. Council considered updating the wrecker ordinance.
After questions from Council and a short report from Tim
Dewalt, representative of the wrecker board, motion was made
by Councilperson Pfeiffer to table this item for further
study of rates and insurance requirements in neighboring
cities. Second by Councilperson Skelton. The motion carried,
8 ayes, 1 nay.

13. Council considered amending ordinance 1168, Regulating
Drilling of Water Wells within the City.

City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE
NO. 1168, AN ORDINANCE REGULATING THE DRILLINGjOF WATER
WELLS WITHIN THE CITY; REGULATING THE USE AND SALE OF WATER
WITHIN THE CITY; PROVIDING EXCEPTIONS; PROVIDING THAT ANY
PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED
GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED
IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00);
CONTAINING A SEVERABILTTY CLAUSE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW;~AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Matuszak to adopt Ordinance
No. 11.68-A as read by the City Attorney. Second by Council-
person Westergre~n. The motion carried, 9 ayes, 0 nays.

14. Council considered the consent agenda:
(a) award bid for high pressure wash unit
(b) award bid for electrical repairs at water well #4
(c) award bid for annual contract to purchase front loading
solid waste containers
(d) approve advertising for bids to concrete parking areas
behind the fire administration building and police adminis-
tration building and authorize transfer of $15,000 from
Capital Improvement Contingency Fund.
Councilperson Graves requested that item 14 (a) be removed for
discussion.
Motion was made by~Councilperson Westergren to approve items
14b, award bid for electrical repairs on water well #4 in the
amount of $6,200; item 14c, award bid for front loading solid
waste containers to Scott & Hill Steel; and item 14d, advertise
for bids to concrete parking areas at the fire administration
building and police administration building and transfer
$15,000 from the Capital Improvement Contingency Fund. Second
by Councilperson Skelton. The motion carried, 9 ayes, 0 nays.

After questions to the Purchasing Agent and Assistant Director
of Public Works had been answered, motion was made .by Council-
person Graves to award. the bid .for high pressure wash unit
to Acme~Cleaning Equipment in the amount of $7,150. Second
by Councilperson Matuszak. The motion carried, 9 ayes, 0 nays.

gren, Malone, Longley, Matuszak and Mayor Cline
Nays: None
Mayor Cline read a proclamation designating April 22 through
28, 1984, as National Dance Week. Councilperson Matuszak
accepted the proclamation.
15. Administrative Reports
Mr. Owen called Council's attention. to the addendum to the
agenda, which is to appoint a hearing officer in regards to
the junk vehicle ordinance. .Two people had been contacted
~ and agreed to serve: Andrew Wilson and Edward "Buddy" Felscher.
~ ~~ Motion was made by Councilperson Graves to appoint Andrew
Wilson as hearing officer with Edward Felscher as alternate.
Second by Councilperson Westergren. The motion carried,
9 ayes, 0 nays.

Mr. Owen stated .that during Comprehensive Plan meetings, a
marina for the area had been brought~up.several times. Our
engineers contacted the Corps of Engineers and there is a
very good chance of~their making a feasibility study if such
marina would be feasible for our sYioreline area. It would
require a request from the City to have such and study made,
and the City would not.~be obligated in any way.
Mr. Owen was instructed to go ahead with it.
Mr. Askins reported that the~Secretary of State has chartered
the City of La Porte Health Facilities Development Corporation
and we have received the charter back from them.
Mr. Askins also reported that Harris County District Court
Judge Cochran has granted a permanent injunction in favor of
~ the City of La Porte against the construction of the Fairmont
Mobile Home Park.

Mr. Owen reminded Council of Mrs. Lou Lawler's request for
help for the Seamen's Center. At that time it was reported
that the City might have a van they would be releasing. A
15 passenger van will be available in about a couple of weeks.
What would Council like to see done with the van?
It was decided that Council would study the matter and make
a recommendation .
16. Council Action
6 ~: Thanked everyone for coming out.
Skelton: Offered to take Resolution 84-4 to the Harris County
Mayors' and Councils' Association meeting if Council so desired.
Stated the public hearing on the Comprehensive Plan has been
set back, with no reschedule date, as yet.' The meeting with
the steering commitee to•_.go over the draft will probably be
in a couple of weeks.
Westergren: Are we going to put grass on the landscaped area
along Fairmont~Parkway?
Mr. Owen: We will have to get funds from another source;
we did not budget funds for that.
Malone: Requested an executive session on a legal matter.
Also, has been getting reports on "The Cave", the teen-age
club on Underwood. Kids have been walking down Underwood,
which is dangerous, and there has been a report they are
trying~to buy beer at "Sweet Pea's" next door. Mr. Owen is
going to check this out for him.
Owen: Has a memo from the Building Inspector he received
just before 5 o'clock. He will put .a copy in Council's boxes.
Cline: Has received several calls, also. If it meets the
requirements of the Code Ordinance, doesn't know what the City
can do to stop it.
Longley: Is excited about the possibility. of a marina. It
would be a good thing for the City.
Matuszak: Expressed gratitude to everybody concerned in the
action taken against the mobile home park. It allows it to
go through the regular process now, which he hopes will have
~ the same outcome.

Gratified that we are going to move along with a feasibility
study on the marina. Certainly hopes it will come back in
the affirmative.
Cline: Put a letter in Council boxes from Mark Goode of the
State Highway Department, saying we are going to get the
overpass.
Owen: The speed limit signs are up and should be uncovered
in the next day or two:
Council adjourned into executive session at 8:55 P.M. and
returned to the Council table at 9:40 P.M.
Item 5 was addressed: Motion was made by Councilperson Malone
to elect Deotis Gay Mayor Pro Tem for 1984-85. Second by
Councilperson Matuszak. The motion carried, 8 ayes, 0 nays.
Councilperson~Graves had left the Council table to go to work.

Item 7 was addressed: Motion was made by Councilperson Skelton
to appoint Dr. P. J. Mock, Jr., as City Health Officer. Second
by Councilperson Pfeiffer. The motion carried, 8 ayes, 0 nays.

Malone, Longley, Matuszak and Mayor Cline
Nays: None
Item 10 was addressed:~ Motion was made by Councilperson
Matuszak to appoint Richard Matthews and Betty_T._Waters to
the La Porte Area Water Authority and to appoint Marty Manning
as Advisor. Second by Councilperson Westergren. The motion
carried., 8 ayes, 0 nays.

Motion was made by Councilperson Westergren to increase the
Ambu ance Board from 7 to 9 members and to appoint Johnny Land
and Bobby Powell. (Powell subject to legal approval) to serve
on this board. Second by Councilperson Malone.. The motion
carried, 8 ayes, 0 nays.

Appointments to the Fire Code Review Committee were postponed
until Council gets advice from Staff as to what direction the
board needs .to take. Councilperson Skelton requested the
attendance :records of members in order to appropriately appoint
members, and also requested copies of minutes from all
meetings of all commissions and boards be given to Council.
Industrial Development Corporation: Councilperson Longley
has asked to be removed from this board. Motion was made
by Councilperson Pfeiffer to appoint B. Don_Skelton to re-
place Mr. Longley. Second by Councilperson Malone. The
motion carried, 8 ayes, 0 nays.

Board of Adjustment appointments were postponed until Council
gets advice from Staff .
Motion was made. by Councilperson Malone to reappoint Karl
Johnston and Bobby Blackwell to the Planning and Zoning
Commission. Second by Councilperson Longley. The motion
carried, 8 ayes and 0 nays.'

Nays: None
Mayor Cline reported she had received an invitation from
Mayor Ritterhouse of Shoreacres to attend a meeting on the
TXTX Corporation.Since it conflicted with the Council meeting,
Staff member David Paulissen had attended.
Mr. Paulissen gave a short report on the meeting, and stated
that there has been a steering committee formed to address the
problems with TXTX. A member of our City Council to serve on
the committee has been requested."
Councilperson Matuszak agreed to serve on the committee.
18. There being no further business to come before the Council,
the meeting was duly adjourned at approximately 9:55 P.M.

SUBJECT: Sealed Bid IE0037 - Assorted;' rage Supplies

Advertised, sealed bids 40037 for the annual garage supply contract were
opened and read in City Council Chambers April 2, 1984 at 4 p.m. Sealed
bids were mailed to nine area vendors with bids being returned by the
following vendors; (1) Allen & Kerber Parts Inc., (2) Jones Oil Co., (3)
H & W Distributing Co., Inc., (4) Spencer Hwy. Auto Supply, and (5) Chickering
Oil Company.
Vendors were asked to provide firm pricing for a six month period with escala-
tion based upon documented price increases from the manufacturer. The City
of La Porte also required the successful vendor to supply three bulk tanks
with hose and pump for no extra charge. Garage supplies were divided into
two categories; Section I - Bulk Products, and Section II - Assorted Shop
Supplies.
The overall low bid was submitted by Jones Oil Company of Houston, Texas.
Prices averaged 8y lower than pricing under the current 1982-83 contract.
A thorough review of bulk products bid indicates that all specifications
have either been met or exceeded by Jones Oil Co.
Low bid on Section II meeting specifications was submitted by Chickering Oil
Co. of Houston, Texas. Prices submitted by Chickering Oil averaged two (2)
percent below prices being paid under the current 1982-83 contract.
I hereby recommend awarding the 1984-85 contract for bulk products, Section I,
to ,Tones Oil Co. and the 1984-85 contract for garage supplies, Section II, to
Chickering Oil Co. on the basis of low bid meeting specifications. I trust this
recommendation will meet with your approval.

SUBJECT: Replacement of the wall located at i+01 South First Street.
During replacement of the sewer main in the alley easement behind
~+Ol South First Street the clay the fence was destroyed. The sewer
main was one (1) foot east and ten (10) foot deep beneath the fence.
Also, the sewer main had to be relaid in the same trench due to
other utilities in the easement, such as underground telephone, 1+
inch gas main and a 4 inch water main.
The excavation was solid shored with oak boards and hydraulic Speed
Shore equipment, however, the wall type fence could not.be`.lield.
A temporary fence has been placed to secure a dog belonging to the
resident. It should be noted that the resident has been most patient
and understanding in this situation, but the City is obligated to
replace the fence.
Attached is a copy of a memo from Jackson Ray showing a potential
cost of SEVEN THOUSAND ONE HUNDRED TWEATTY DOLLARS ($7,120.00) to
complete the work, less the cost of the concrete footing. The footing
can be constructed by City crews with an estimated cost of ONE THOUSAND
THREE HUNDRED FIF'T'Y DOLLARS ($1,350.00) for forms, rebar, and concrete.
Please ask for EIGHT THOUSAND FIVE HUNDRED DOLLARS ($8,500.00) from
water/wastewater contingency fund ~acc~ount #003-810-810=000 and
permission to bid this project. Please call if I can be of further
assistance.

SUBJECT: REPLAGEM ;~OF TILE WALL - 401 S. FIRST STREET

Per your request of March 6, 1984 I have developed the following cost data
concerning the the wall removed by city crews for the oversized sewer line
being installed in the alley between First St. and Broadway in the 400 block.
The wall is 83 linear feet long by 6 feet tall. It is basically constructed of
a concrete beam with piers every five feet, the blocks, reinforcing mesh, and
mortar. It was originally built in 1953 and has survived to the present day
with no modifications. The owner, Bill Jones, indicates he will accept no sub-
stitutions in rebuilding this wall.
I contacted a total of ten masonry contractors in the Bay Area to obtain quota-
tions to rebuild this wall. At the present time I have received two bids on re-
placing this structure to its original state. They are as follows;

Labor Cost - $6,415
Total Cost - $10,200

Neither quotation includes repouring the beam. Should the beam need to be re-
poured the City of La Porte will need to make arrangements to have this done
at additional cost. ~~
It is important to note that if Bill Jones could be persuaded to accept a wall
constructed of cinder block as a replacement for his existing wall the total
job cost could be lowered to the $2500 range.
I will continue my efforts to obtain more quotations for comparison purposes.

Advertised, sealed bids4E0039 for the purchase of a continuous forms detacher
were opened and read in City Council Chambers April 9, 1984 at 4 p.m. Sealed
bids were mailed to eight area vendors and office supply companies with five
returning bids.
The continuous forms detacher (burster) will be operated by all City divisions
that use computer generated continuous forms. It is a labor saving device
which allows the operator to automatically separate continuous forms in an
efficient manner while eliminating the need for manual forms separation.
A tie for low bid was submitted by the Moore Business Forms Co. in Alvin and
their location in Beaumont, Texas on the Moore ~~3250. This unit was tested by
City staff in the fall of 1983 and found to be acceptable for both current needs
and projected future usage.
I hereby recommend 'awarding the purchase of a continuous forms detacher to
Moore Business Forms in Alvin on the basis of a tie for low bid in the amount
of $4,081.85 and a delivery time of thirty days.
Should the unit need servicing in the future it is anticipated that the Alvin,
Texas location would be better able to expedite repair due to their location.

The mechanical condition reports show mayor wear and critical
points in the drive and suspension system. Power steering could
fail very quickly and at any time during an emergency run when
quick steering with complete control is critical.
Front end suspension shows the effect of hard stops and
typical stress due to hard turns during emergency runs. Brakes
are "glared" which is common in emergency vehicles frith excessive
sear.
Transmission shows numerous signs of nearing totsl.mechsaical

RECOMMENDATION
The information compiled in this report suggests the following con-
clusions:
I. Four noteable individuals- mechanics and an
engineer- state that both ambulances #502
and #503 have major problems. These indi-
viduals provide both an unbiased and dis-
interested opinion of what they feel is fact.
II. The need fora "third out" vehicle is re-
quired due to actual occurance during the
past nine months and geographical makeup
of the area.
III. Pro-forma figures indicate the ability of
the corporation to afford the additional
debt required to purchase three new veh-
icles and the cost of their operation. The
ability to afford is based upon the cur-
rent subsidies granted for fiscal 1983
thru 1984.
We, the Board of Directors, Officers, and Employees of the La Porte
Area Emergency Corporation respectfully submit the following recom-
mendation:
That the City of La Porte support and approve
the purchase of three new 1984 Ambulances des-
cribed in Proposition I. That the City of La
Porte endorse the incurrance of additional
debt to purchase these vehicles on behalf of
the La Porte Area Emergency Corps. That this
debt be for three years and incorporate that
currently outstanding on Unit X502 fora total
of $81,000.

SUBJECT: La Porte Community Night
In order to help create community involvement in businesses, organizations,
and citizens, the Parks and Recreation Department has set up La Porte
Community Night at the Astrodome. The Houston Astros will play the
Chicago Cubs on Friday, May 11, at 7:35 p.m. All seats purchased at
the designated outlets in town will be $2.00 for that night. The
Mayor will throw out the game ball and the high school choir will sing
the National Anthem prior to the game. La Porte Community Night will be
announced and ,put on the scoreboard. This is La Porte's Night to be
recognized in the Houston area and a chance for the community to come
together at ari American tradition; Baseball.
