OF THE
LA PORTE CITY COUNCIL
JUNE 13, 1984
1. The meeting was called to order by Mayor Cline at 9:35 P.M.
Members of City Council Present: Mayor Virginia Cline,
Councilpersons B. Don.Skelton, Linda Westergren, Norman Malone,
John Longley, Ed Matuszak, Lindsay Pfeiffer,
Members of City Council Absent: Councilpersons Deotis Gay,
Kevin Graves
Members of City Staff Present: City Manager Jack Owen, Assis-
tant City Attorney John Armstrong, City Secretary Cherie Black,
Director of Administrative Services Bob Herrera
Others Present: Arlene Arends, Bayshore Sun-Broadcaster; two
citizens
• The Mayor called Council's attention to the emergency addendum
item at their places at the Council table.
2. Council considered awarding a bid for ambulance units.
Motion was made by Councilperson Westergren to accept staff's
recommendation and award the bid for ambulance units to
Collins Ambulance Sales. Second by Councilperson Skelton.
The motion carried, 7 ayes, 0 nays.
Ayes: Councilpersons Skelton, Westergren, Malone, Longley,
Matuszak, Pfeiffer and Mayor Cline
Nays: None
Mayor Cline read a letter from Leola Mercado, complimenting the
Ambulance Corps for their prompt action when she had an emer-
gency recently.
3. Mayor Cline explained the emergency addendum, an ordinance
amending Ordinance 1405 which closed a portion of South 12th
Street, which erroneously retained a perpetual public utility
easement for the City. The agreement entered into between the
City and the owners of the property was that the City would only
retain a temporary easement until such time as the sewer line
• could be relocated.

SOUTH 12TH STREET LYING BETWEEN BLOCK ONE THOUSAND NINETY-
SEVEN (1097) AND BLOCK ONE THOUSAND NINETY-EIGHT (1098) FROM
THE SOUTH RIGHT-OF-WAY LINE OF FAIRMONT PARKWAY TO THE NORTH
RIGHT-OF-WAY LINE OF SOUTH "K" STREET; RETAINING A TEMPORARY
PUBLIC UTILITY EASEMENT; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.

4. Mayor Cline asked for any other business to come before the
Council.
Councilperson Matuszak reported on the appearance before the
• Port Commission of the committee opposing the ~TXTX operations .
With help fnam the Port Commission, they were able to get
TXTX ordered to clean up their operations or get out within
120 days. Councilperson Matuszak feels that they should be
shut down within the next 60 days, hopefully.
Mayor Cline announced that Sharon Eisenmenger from the State
Historical Oommission will be here June 18 at 6:30 P.M. to
present a program on the Texas Sesquicentennial and how La Porte
can participate. Although the celebration is in 1986, plans
must be made now so that projects can be coordinated.
5. There being no further business to come before the Council, the
meeting was duly adjourned at approximately 9:50 P.M.

SUBJECT: Need for Special ~al~!d~Meeting to Approve Ambulance Bids
It has been brought to my attention by several ambulance manufacturers that
the 1984 model year is drawing to a close for automobile manufacturers.
Should the City of La Porte wait to place ambulance orders after June 15, 1984,
delays of 120 to 160 days are likely for the ambulance delivery.
I recommend that City Council convene a special called meeting during the
workshop June 13, 1984 to ensure ambulance orders can be placed prior to
June 15. This will enable the approved bidder to confirm his factory order
before the model year deadline and save money in continued maintenance cost
on the units presently being operated by the La Porte Area Emergency Corps.

Advertised, sealed bids 440043 for the purchase of two (2) Type I ambulances
and one (1) Type II ambulance were opened and read in City Council Chambers
June 6, 1984 at 4:00 p.m. Sealed bids were mailed to eleven ambulance dis-
tributors and manufacturers with a total of six bids being returned.
Specifications directed vendors to enter pricing for all three new units and
deduct trade-in values for the two units (44502, 44503) presently being operated
by the La Porte Area Emergency Corps to arrive at a net total.
Low net total meeting specifications was submitted by Collins Ambulance Sales
and Service of Mansf field, Texas in the amount of $78,440. Collins also sub-
mitted an alternate emergency lighting system which, if accepted, would re-
duce the purchase price of the Type I units by $3,000 per vehicle and reduce
• the price of the Type II unit by $2,100. Total bid price for the three am-
bulances less trade-ins and the substitution of the alternate lighting system
totals $70,340. Delivery times will run 60 to 90 days on the Ford Type I
units and 30 to 60 days on the Ford Type II unit if orders are placed before
June 15, 1984.
I hereby recommend that the City of La Porte accept the low net total bid
meeting specifications submitted by Collins Ambulance Sales and Service in
the amount of $70,340 for the purchase of two (2) Type I ambulances and one
(1) Type II ambulance and the trade-in of units 4502 and 44503. I also re-
quest permission to negotiate a prompt payment discount with Collins Ambulance
Sales and Service to further reduce the stated net total.

AN ORDINANCE VACATING, ABANDONING AND CLOSING THAT PORTION OF
SOUTH 12TH STREET LYING BETWEEN BLOCK ONE THOUSAND NINETY-SEVEN
(1097) AND BLOCK ONE THOUSAND NINETY-EIGHT (1098) FROM THE SOUTH
RIGHT-OF-WAY LINE OF FAIRMONT PARKWAY TO THE NORTH RIGHT-OF-WAY
LINE OF SOUTH "K" STREET; RETAINING A TEMPORARY PUBLIC UTILITY
EASEMENT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has
been requested by the record owners of all of the property
abutting the hereinafter described portion of South 12th Street
lying between Block One Thousand Ninety-Seven (1097) and Block
One Thousand Ninety-Eight (1098) from the South right-of-way
line of Fairmont Parkway to the North right-of-way line of
• South "K" Street, to vacate, abandon, and permanently close
said portion South 12th Street; and
WHEREAS, the City Council of the City of La Porte has
determined, and does hereby find, determine and declare that
the hereinafter described portion of South 12th Street is not
suitable, needed, or beneficial to the public as a public road
or street, and that the closing of the hereinafter described
portion of South 12th Street is for the protection of the
public and for the public interest and benefit, and that the
hereinafter described portion of said South 12th Street should
be vacated, abandoned; and
WHEREAS, the City Council of the City of La Porte duly
• passed Ordinance No. 1405 on the 23rd day of May, 1984, vacating
the hereinafter described portion of South 12th Street; and
WHEREAS, said Ordinance No. 1405 erroneously retained a
perpetual right, privilege, and easement, with appropriate rights
of ingress and egress, to enter upon and construct, reconstruct,
maintain, operate, inspect, replace, repair, and remove public
utility facilities, together with all necessary improvements
under and across the thirty-six inch (36") sanitary sewer main
• located in the hereinafter described portions of South 12th
Street; and

WHEREAS, it was and is the intention of the City Council
of the City of La Porte to permanently abandon said public
utility easement, subject to retention of a temporary easement
for the operation of a thirty-six inch (36") sanitary sewer
main in the hereinafter described portions of South 12th Street,
until the sewer main located in the hereinafter described
portions of South 12th Street is relocated and abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
• Section 1. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. 13,
Title 28, Art. 1175, of the Revised Civil Statutes of the State
of Texas, 1925, and by way of vacating the public utility ease-
ment on the hereinafter described portions of South 12th Street,
in the City of La Porte, together with all rights appurtenant
thereto as described in City of La Porte Ordinance No. 1405,
the hereinafter described portions of South 12th Street is
hereby permanently vacated, abandoned, and closed by the City
of La Porte, as follows, to-wit:
That portion of South 12th Street
lying between Block One Thousand
Ninety-Seven (1097) and Block One
Thousand Ninety-Eight (1098) from
• the South right-of-way line of
Fairmont Parkway to the North
right-of-way line of South "K"
Street.
Provided, however, the City of La Porte
retains a temporary easement for the
operation of a thirty-six inch (36")
sanitary sewer main located in South
12th Street, until such sanitary sewer
main is relocated and abandoned.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
• date, hour, place and subject of this meeting of the City

Council was posted at a place convenient to the public at the
City Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The
City Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 3. This Ordinance shall take effect and be in
force from and after its passage and approval.
