Wilmore, Code Officer SUBJECT: Cars on R.O.W. of Old La Porte Road, DATE: May 24, 1984 I originally received a telephone call from Mr. Ben Seymour and he was upset because I had red tagged his vehicle which was parked ;along Old La Porte Road next to Louisiana Chemical. I informed Mr. 'Seymour that I had not tagged his car and that he should talk with the police department whom he had called originally. I transferred him back to the dispatcher at the police station, but she did not think he needed to talk to them; therefore, she transferred him back to me. By this time he was getting angry about the whole thing. I took his phone number and then called and talked with Lt. Powell who in turn had Sgt. Fields go and talk with the gentleman. Mr. Seymour insisted that the land was private property so Sgt. Fields came to City Hall to .verify this with the Engineering Department. They did not have any ;specific information to show that it was city right-of-way, so he passed the information on to me and asked me to tag Mr. Seymour~s car ~as well as the other vehicle parked by his. Sgt. Fields informed Mr. Seymour that I would be red tagging the vehicles since it was private property and told~him if he had any questions to contact me. Mr. Seymour did call and ask what my procedure was and then asked me to definitely tag his car and go ahead and schedule a hearing for him so he could tell the City what he thought of our stupid laws. After talking with Mr. Seymour I talked with Jesse Taylor who assured me that the property in question was right-of-way property and that I did not have the authority. At that time I contacted Betty Waters who found a December, 1982 memorandum stating that the property was indeed a City right-of-way. I furnished a copy of this memo to Sgt. Fields who was off duty at the time but when he came back on duty several days later he had one of his men arrange for the removal of both vehicles. Waters SUBJECT: Old La Porte Road In recent weeks I have had several conferences with Mr. J. H. Badders, Principal Right-of-way agent for Gullett and Associates, Inc. His reason for calling on me in the be- ginning was a search to establish abandonment of Old La Porte Road. He had searched Harris County Records and found no record of the road ever having been abandoned. This is the series of events I conveyed to him: In 1976, the City of Lomax was preparing to install a sewer line and went to the County to get proper permits to place the line along Old La Porte Road. The County informed us the road had never been carried on their road log since it was a state highway. City Attorney Walter Queen and T spent several days reading minutes of the Commissioners Court to be sure the road had never been officially abandoned. There was nothing. We then went to the State Highway Department; they traced the road and its repairs for several years but found no official dedication and no abandonment. We found Old La Porte Road on maps back as far as 1918, and found that in 1931 the new State Highway 225 was built and opened to traffic. The County began to maintain the right-of- way until 225 was officially completed and then they only~main- tained the section from 26th Street west approximately 900 feet for those citizens who lived along that area:. Harris County stopped maintaining that section of Old La Porte Road in 1968 and the street was maintained by the City of Lomax from 26th Street was approximately 1000 feet and from Houston Avenue east a distance of 500 feet. Enterprise Products Company is proposing to lay two sixes inch pipelines 20 feet inside the Old La Porte,. Road right-of-way, from the Wanda Petroleum meter site to Houston Avenue where the line will turn north across the S.P. tracks, SH225, and out of our City limits line will travel east. PROJECT SUMMARY: Staff would like Council to consider budgeting for a cost recovery study for the City of La Porte in budget , year 1984-'85. The proposed study will be designed to develop a ~ program which will match revenue against expenses for departments, which have user charges, regulatory fees, license, and permits. The benefits derived from a study of this nature ~ are: (a) immediate recovery of additional revenue from increased user fees and (b) the City will have the knowledge of what the different fees cost. Thus the City can then set fees t at cost, or make an objective determination to subsidize an activity by charging fees that are lower than the cost of service provided. 4. ACTION REQUIRED: Allow representative from firm of David M. Griffith to make short presentation on "How a Cost Recovery ~ Study could benefit the City of La Porte." 5. ALTERNATIVE: 6. RECOMMENDATION: Staff recommends that if Council agrees that a Cost Recovery Study for the City of La Porte would be beneficial ~_ and is needed, that Council authorize staff to budget that Study (1984-'85) and authorize staff to prepare and mail out a request for proposals to qualified firms to perform the study during the ~_ month of August 1984. ~. Alternative 2 is a two coarse surface treatment, 8" calcium sulfate base, and 6" lime stabilized subgrade. Although the residential street projects are within original budgeted funds, only two alternatives are given because the overall project, which includes residential and commercial, will be over the original budget. The following is a. cost comparison for the two alternatives for the above mentioned residential streets: Alt. 1 Alt. 2 Easy Street 24,375 23,605 Mossy Street 19,638 19,007 Willow View Road 46,512 45,137 Plainbrook Road 49,611+ 48,159 Lemon Lane 65,535 62,135 North "P" Street 44,519 43,052 Battleview Drive 29,796 28,886 Flintrock Drive 20,021 19,269 Total 300,010 289,250 The commercial street improvement projects include the following streets: West Polk, West "G", North 17th, West "F", West "E", and West Adams. The alternatives were similar for all streets with the exception of West "E". Mr. Smith recommended an alternative of reinforced concrete on this street because of the heavy traffic loads. It is our suggestion that this year we use the set of standards used in the past and choose from the alternatives recommended by staff. This will result in savings of dollars and allow more study into the change of policy of constructing reinforced concrete streets. For all commercial streets with the exception of West "E", alternative 1 would consist of l~" asphaltic concrete, 8" limestone base, and 6" lime stabilized subgrade. ' Plans and specifications have been prepared by Carlos Smith Engineering. The estimate to restore the property is approxiamtely $140,000. This project would be eligible for Federal Emergency Management Administration J funds as discussed with FEMA officials from Austin. We are requesting permission to go out for bids so that this property can be restored in a timely manner. Council considered the request of Decker McKim to rezone La Porte outlots 18, 19, 20, 21 and 22. Mayor Cline stated that this item had been previously tabled at the request of Councilperson Westergren and~that Council- person Westergren had asked to put the item back on the agenda. Mayor Cline called Council's attention to the memo from the Planning and Zoning Commission recommending that only Outlots 19, 20, 21 and 22 be rezoned from Residential to Commercial, and leaving :Outl:ot 18 zoned Residential. ,~ r • ~ • Minutes, Regular. City Attorney Askins read: ORDINANCE 780-000C - AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTS ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. Councilperson Westergren amended her motion to include'hdoption of Ordinance 780-000C as read by the City Attorney." Second by Councilperson Graves. Council considered the sale of a van to the Seamen's Center. Mr. Owen stated an informal appraisal had been made on the van by Joe Camp Ford, and that they placed an average value of $2,000 on the van. City Attorney Askins stated he had explored the various possibilities this van might be presented to the Seamen's Center, and that from a legal standpoint there is no way this could be done. However, there is a possibility that a contract could be worked out for the van to be used.to trans- port seamen into La Porte to shop, etc., if the Council deter- mines this would be beneficial to the City. It was Council's consensus that they would like to help the Seamen's Center if at all possible. Motion was made by Councilperson Matuszak that the City Attorney look into the legality of drawing up a contract with the Seamen's Center to provide transportation; for the value of the vehicle in kind. Council considered the issuance of industrial revenue bonds to Process Products, Inc. This item was requested by Councilperson Gay, who had asked for tabling at the May 23 meeting so that he could talk with his constituents about it. Councilperson Gay asked that the City Attorney read the reso- lution on the issuance of these bonds if there was no further discussion. Councilperson Matuszak asked if the noise ordinance had been looked at to see what recourse was available if the noise livel gets too high. Mr. Owen stated he had spoken with the Chief Building Official and the ordinance is very weak in that area. City Attorney Askins stated the proposed new zoning ordinance will be much more sophisticated on the technology of this type, and no existing use would be "grandfathered." C City Attorney Askins read: RESOLUTION 84-5 - A RESOLUTION APPROVING ISSUANCE BY THE CITY OF LA PORTE INDUSTRIAL DEVELOPMENT CORPORATION OF AN ISSUE IN THE AMOUNT OF $500,000 OF THE CITY OF LA PORTE INDUSTRIAL DEVELOPMENT CORPORATION INDUSTRIAL DEVELOPMENT REVENUE BONDS (PROCESS PRODUCTS, INC. PROJECT) SERIES 1984; APPROVING THE RESO- LUTION OF THE ISSUER AUTHORIZING THE BONDS, THE ISSUANCE OF THE BONDS AUTHORIZED THEREBY AND THE PLAN OF FINANCING APPROVED THEREBY AND THE BOND DOCUMENTS; AND APPROVING THE PROJECT TO BE FINANCED WITH THE BONDS. Council was to consider the request of Eddie Gray to close 17th Street between Blocks 1177 and 1178. This item was cancelled at the request of Mr. Gray because all of the paperwork was not completed. It will be put on the agenda for the June 20 meeting. 8. Administrative reports Mr. Owen reported the group from St. Petersburg visited and were very pleased with what they ~~saw. The reason they are interested in coming here is the way our .personnel has accepted and worked with the data processing. All the credit for that goes to Bob Herrera and his staff of people who are working with that. The City Attorney has requested an executive session on a contractual matter. Mayor Cline added that a gentleman from Greenville had come up at the TML meeting in Corpus and was very complimentary to our staff and our data processing program. Councilperson Longley arrived at the Council table at 7:30 P.M. c 9. Council Action 6 ~: Enjoyed the TML conference in Corpus. He got a lot out of it. Someone had spoken with him at the conference and told him they were coming to our city. Feels credit is due to Mr. Herrera. Enjoyed seeing those that are out at the meeting tonight, in view of the bad weather we're having today. Skelton: Would like to go back to the same questions he asked the first of May - has anything been done on the sidewalk on G Street between Broadway and San Jacinto? (Mr. Owen replied a letter has been written to Carlos Smith for a proposal for the alignment of the sidewalk there, with the idea of entering into a contract in the very near future for the design of that.) Second, the blue containers on Park Street have been moved a little closer to the roadway - it's about 12 to 14 inches now, so we are getting to the stripe. I do think the City has a liability there that's just staring us in the face. We need to get something done about that. Owen: We are working on that particular problem. The location sometimes gets to be a problem because they do have to be accessible to the trucks; unless we can get an off-street lo- cation, that sometimes gets to be quite a problem. westergren: Her container problem has been solved. Now you can see at the corner of 8th and B without taking your life in your hands. Longley: Pleased to see the quality of the programs at TML have improved.- it was very beneficial and he~is pleased with that. A~ • ~ • Minues, Regular Meeting, La Porte City Council C June 6, 1984, Page 5 Matuszak: Would like to poll Council about a resolution supporting the efforts of the group and the City of Shore- acres in opposing the operations of TXTX as it exists today. It is causing some damage and should be operated in a proper manner. They sank a barge out there a week ago Sunday and they are still in the process of trying to resurrect it. They are spilling this coke all over the place, and it is causing problems. Met with Richard Leish, executive director of the Port, this past Monday, and he was not exactly cooperative. They have the power to terminate this operation; as a matter of f act, they do not have, to the best of my knowledge, a written agreement with TXTX. It's operating on a pure verbal agree- ment. We got the opinion that, in effect, they didn't care. We are going to appear this coming Monday, at 2 P.M., in front of the Port commissioners and tell them our side of the story. Hopefully, we will get some responsible relief. Mr. Leish said he could not do anything; it was up to the Port. (The Council indicated they would support the resolution if the City Attorney approved its content.) C Would like to..look into getting some street lights at either end of~ Driftwo.od. There is a meter box on Redbud (later determined to be 3831 Redbud.). that is smashed and needs to be replaced. Graves: Inquired if swimming pool had closed that day (be- cause of the bad weather). Asked, in regards to the letter the City had received, if the Bayshore Company was under the impression they would have their streets paved almost immedi- ately of ter the limestone was put on it? I feel it was a little "pushy." I was almost offended by it. Cline: I think you'll find that was back in '78 or '79, and that was at the time they were told the City would top the streets as soon as they did the next year's budget or got their street list prepared. And that's how long they've been waiting. Pfeiffer: Congratulations to the Mayor on her election as president of the Texas Mayors, Councilmembers and Commissioners Association. The Mayor did a fine job of representing the City this past weekend, and thanks to all the Council who at- tended. We had some good seminars,.the fellowship was enjoy- able, and I appreciate the opportunity to go. Cline: It is quite an honor to serve as president of the State Association of Mayors, Councilmembers and Commissioners, and I think we did have some good programs in Corpus Christi this year, and some informative ones. I think that was due to the work of 'the committee that I chaired, and the fact that we had some people that have been attending seminars and had a good feeling for what we needed. I attended one of the sessions on industrial revenue bonds, and there are some changes coming on the bonds. what changes, no one knows for sure, but there are changes coming. We may have to redefine ours before too long, and when the Federal govern- ment gets through they'll probably have a "per cap" on them. I just wanted to let the Council know there are going to be some changes. I think they're kind of putting a clamp and a frown on commercial and retail business, and for some small cities, I think that's really unfair, because they need it, like we do. Thoroughly enjoyed the two speakers C lightened the whole day.. I enjoyed there to support me Saturday at the have another good one next year. 10. Mayor Cline explained the emergency addendum, an ordinance amending Ordinance 1405 which closed a portion of South 12th Street, which erroneously retained a perpetual public utility easement for the City. Councilperson Matuszak reported on the appearance before the C Port Commission of the committee opposing the TXTX operations. With help from the Port Commission, they were able to get TXTX ordered to clean up their operations or get out within 120 days. Councilperson Matuszak feels that they should be shut down within the next 60 days, hopefully. Mayor Cline announced that Sharon Eisenmenger from the State Historical Commission will be here June 18 at 6:30 P.M. to present a program on the Texas Sesquicentennial and how La Porte can participate. Although the celebration is in 1986, plans must be made now so that projects can be coordinated. 5. Wilmore, Code Officer SUBJECT: Cars on R.O.W. of Old La Porte Road DATE: May 24, 1984 I originally received a telephone call from Mr. Ben Seymour and he was upset because I had red tagged his vehicle which was parked along Old La Porte Road next to Louisiana Chemical. I informed Mr. Seymour that I had not tagged his car and that he should talk with the police department whom he had called originally. I transferred him back to the dispatcher at the police station, but she did not think he needed to talk to them; therefore, she transferred him back to me. By this time he was getting angry about the whole thing. I took his phone number and then called and talked with Lt. Powell who in turn had Sgt. Fields go and talk with the gentleman. Mr. Seymour insisted that the land was private property so Sgt. Fields came to City Hall to verify this with the Engineering Department. They did not have any specific information to show that it was city right-of-way, so he passed the information on to me and asked me to tag Mr. Seymour~s car as well as the other vehicle parked by his. Sgt. Fields informed Mr. Seymour that I would be red tagging the vehicles since it was private property and told him if he had any questions to contact me. Mr. Seymour did call and ask what my procedure was and then asked me to definitely tag his car and go ahead and schedule a hearing for him so he could tell the City what he thought of our stupid laws. After talking with Mr. Seymour I talked with Jesse Taylor who assured me that the property in question was right-of-way property and that I did not have the authority. At that time I contacted Betty Waters who found a December, 1982 memorandum stating that the property was indeed a City right-of-way. I furnished a copy of this memo to Sgt. Fields who was off duty at the time but when he came back on duty several days later he had one of his men arrange for the removal of both vehicles. Enclosure ~, • • MEMORANDUM December 14, 1982 TO: John~Joerns, Jerry Hodge, Knox Askins FROM: Betty T. Tnlaters SUBJECT: Old La Porte Road In recent weeks I have had several conferences with Mr. J. H. Badders, Principal Right-of-way agent for Gullett and Associates, Inc. His reason for calling on me in the be- ginning was a search to establish abandonment of Old La Porte ~~ Road. He had searched Harris County Records and found no record of the road ever having been abandoned. . This is the series of events I conveyed to him: In 1976, the City of Lomax was preparing to install a sewer line and went to the County to get proper permits to place the line along Old La Porte Road. The County informed us the road had never been carried on their road log since it was a state highway. City Attorney Walter Queen and I spent several•days reading minutes of the Commissioners Court to be sure the road had never been officially abandoned. There was nothing. :9e then went to the State Highway Department; they traced the road and its repairs for several years but found no official dedication and no abandonment. TrJe found Old La Porte Road on maps back as far as 1918, and found that in 1931 the new State Highway 225 was built and opened to traffic. The County began to maintain the right-of-~ way until 225 was officially completed and then they only-main- tained the section from 26th Street west approximately 900 feet for those citizens who lived along that area:. Harris County stopped maintaining that section of Old La Porte Road in 1968 and the street was maintained by the City of Lomax from 26th Street was approximately 1000 feet and from Houston Avenue east a distance of 500 feet. Enterprise Products Company is proposing to lay two six-. inch pipelines 20 feet inside the Old La Porte~.Road right-of-way, from the Wanda Petroleum meter site to Houston Avenue where the line will turn north across the S.P. tracks, SH225, and out of our City limits line will travel east. Specifications directed vendors to enter pricing for all three new units and deduct trade-in values for the two units (~~502, 4503) presently being operated by the La Porte Area Emergency Corps to arrive at a net total. Low net total meeting specifications was submitted by Collins Ambulance Sales and Service of Mansfield, Texas in the amount of $78,440. Collins also sub- mitted an alternate emergency lighting system which, if accepted, would re- duce the purchase price of the Type I units by $3,000 per vehicle and reduce the price of the Type II unit by $2,100. Total bid price for the three am- bulances less trade-ins and the substitution of the alternate lighting system totals $70,340. Delivery times will run 60 to 90 days on the Ford Type I units and 30 to 60 days on the Ford Type II unit if orders are placed before June 15, 1984. I hereby recommend that the City of La Porte accept the low net total bid meeting specifications submitted by Collins Ambulance Sales and Service in the amount of $70,340 for the purchase of two (2) Type I ambulances and one (1) Type II ambulance and the trade-in of units 44502 and 44503. I also re- quest permission to negotiate a prompt payment discount with Collins Ambulance Sales and Service to further reduce the stated net total. Should the City of La Porte wait to place ambulance orders after June 15, 1984, delays of 120 to 160 days are likely for the ambulance delivery. I recommend that City Council convene a special called meeting during the workshop June 13, 1984 to ensure ambulance orders can be placed prior to June 15. This will enable the approved bidder to conf irm his factory order before the model year deadline and save money in continued maintenance cost on the units presently being operated by the La Porte Area Emergency Corps. PROJECT SUMMARY: Staff would like Council to consider budgeting for a cost recovery study for the City of La Porte in budget year 1984-'85. The proposed study will be designed to develop a • program which will match revenue against expenses for departments, which have user charges, regulatory fees, license, and permits. The benefits derived from a study of this nature ~ are: (a) immediate recovery of additional revenue from increased user fees and (b) the City will have the knowledge of what the different fees cost. Thus the City can then set fees ~ at cost, or make an objective determination to subsidize an activity by charging fees that are lower than the cost of ~ service provided. 4. ACTION REQUIRED: Allow representative from firm of David M. Griffith to make short presentation on "How a Cost Recovery ~ Study could benefit the City of La Porte." 5. ALTERNATIVE: ~ 6. RECOMMENDATION: Staff recommends that if Council agrees that a Cost Recovery Study for the City of La Porte would be beneficial ~ and is needed, that Council authorize staff to budget that Study (1984-'85) and authorize staff to prepare and mail out a request for proposals to qualified firms to perform the study during the ~ month of August 1984. 7. The original arrangements with the Carter Trust, with Charles D. Boyle acting as the representative of that trust, were to restore the property to its original condition. Plans and specifications have been prepared by Carlos Smith Engineering. The estimate to restore the property is approxiamtely $140,000. This project would be eligible for Federal Emergency Management Administration funds as discussed with FEMA officials from'Austin. We are requesting permission to go out for bids so that this property can be restored in a timely manner. Alternative 2 is a two coarse surface treatment, 8" calcium sulfate base, and 6" lime stabilized subgrade. Although the residential street projects are within original budgeted funds, only two alternatives are given because the overall project, which includes residential and commercial, will be over the original budget. The alternatives were similar for all streets with the exception of West "E". Mr. Smith recommended an alternative of reinforced concrete on this street because of the heavy traffic loads. It is our suggestion that this year we use the set of standards used in the past and choose from the alternatives recommended by staff. This will result in savings of dollars and allow more study into the change of policy of constructing reinforced concrete streets. For all commercial streets with the exception of West "E", alternative 1 would consist of 1'-z" asphaltic concrete, 8" limestone base, and 6" lime stabilized subgrade. Alternative 2 would be 1~" asphaltic concrete surface, 10" calcium sulfate base, and 6" lime stabilized subgrade.
