C MINUTES OF THE PUBLIC HEARING ON REVENUE SHARING JULY 30, 1984 The public hearing on revenue sharing was called to order at 7:11 P.M. at the request of the City's Chief Executive Officer, City Manager Jack Owen. Mayor Pro Tem Deotis Gay presided. Mr: Owen read briefly from the regulations regarding revenue sharing public hearings and explained the purpose of the hearing. He reported the amount of estimated funds that would be available for revenue sharing is $258,718 from the Federal revenue sharing fund and an estimated carryover fund balance from last year of $91,282, for an estimated total of $350,000. !~~ _-" Mayor Pro Tem Gay asked if there was anyone present who would like to make a proposal for the expenditure of these funds. Mr. Cecil Knight of the Spenwick Addition proposed that street lights into the addition be installed at several locations: C Canada Road and Spencer, Clarkville and Spencer, Bayer and Spencer, Hilldale and Spencer, Andricks and Underwood, Belfast and Underwood, Carlow and Underwood and Catlett and Underwood. Mr. Owen stated that the City might be able to handle this particular request from the other budget without resort:~ng to revenue sharing funds. Mr. Gay proposed a $12,000 expenditure for Gulf Coast Community Services transportation project and a television set and a piano for the Jenny Riley Civic Center. Councilperson Matuszak stated he would like to see a road put on the east side of the Leo Rizzuto elementary school so that students living in Fairmont Park East would have access getting to the school. This would be an extension of Catlett. Mr. Owen replied that it is best not to have items in revenue sharing that would require going out for bids, due to the require- ments of the Bacon-Davis Act being so strict that it would cost more than the funds to be allocated. Mr. Matuszak stated that he realized that, but the request still stood. Councilperson Westergren would like to see us look into pro- viding sewage to those people on West D adjacent to the airport. She recognized the fact that it could not be done with revenue sharing funds, but perhaps the funds could be used to purchase street materials or other types of material, then some of that money could be used to do the sewage. ~~ --- Virginia Cline, Mayor ~" a- !~~ °~ C Minutes, Public Hearing on Revenue Sharing July 30, 1984, Page 2 • Mr. Matuszak suggested that perhaps we could also get street materials for D Street and pave it. Mr. Skelton noted that the street was on the paving list. Mr. Gay was in accord with the sewage and street paving. c Mr. Skelton agreed with Mrs. Westergren that sewer is needed in that area, but noted that it would take half a million dollars to put everyone on the sewer line. Mrs. Pauline Lewis requested that North Fifth Street be fixed. Mr. Skelton requested, as a citizen, that a $24,000 appro- priation be used to build three fishing piers of 100 feet each, on the City right-of-ways - two in the far east part of La Porte and one the other side of Sylvan Beach Mr. Matuszak would like $20,000 used to continue the beauti- fication program - perhaps the intersection of 146 and Spencer Highway being an example. Mr. Gay asked for a $5,000 appropriation to the park fund for the park on the west side of 146. There bein~~ no further input, the public hearing was adjourned at 7:29 P.M. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. By Deed dated December 13, 1974, filed for record in the office of the Harris County Clerk on January 24, 1975, under Harris County Clerk's File No. E351190, Stephen T. Cochran, et al, conveyed to the City of La Porte, certain prop- erty described as Tract II in said Deed, as right-of-way for the extension of Bay Area Boulevard from Fairmont Parkway to Spencer Highway. Subsequently, Stephen T. Cochran, et al, have conveyed the land immediately contiguous to said Tract II to PPG Industries, Inc., a Pennsylvania corporation. Also, subsequent to said con- veyance, the County of Harris and the Harris County Flood Control District, have requested the widening, and the realignment, of said proposed right-of-way. The City of La Porte, a municipal corporation, and PPG Industries, Inc., a Pennsylvania corporation, are agreeable to the realignment of said right-of-way. Section 2. The City Council of the City of La Porte hereby authorizes the Mayor to execute, and the City Secretary to attest the execution of, a Special Warranty Deed, conveying said Tract II, as described in said Deed dated December 13, 1974, from Stephen T. Cochran, et al, to the City of La Porte, a municipal corporation, as recorded under Harris County Clerk's File No. E351190, said con- veyance to be from the City of La Porte, a municipal corporation, by Special Warranty Deed, to PPG Industries, Inc., a Pennsylvania corporation. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. Based on Texas Court decisions, it is my opinion that a quorum is a majority of the whole Council, i.e., it will take five Council members present to constitute a quorum to conduct a lawful meeting. A majority vote of the members present and voting is usually sufficient to carry an issue, although certain State laws require a larger vote, such as on certain zoning matters, for example. However, on most issues, if a quorum of five members is present, a majority of that number, or three Councilpersons, would constitute a majority vote. Section 4.03, Sub-paragraph (c), of the Home Rule Charter, provides that the budget shall be adopted by the favorable votes of at least a majority of all members of the whole Council. Thus, five favorable votes will be required for the adoption of the budget, which sets the tax rate. Yours very truly, Knox W. Ray - Purchasing Agent, ,~ ~ I`` // SUBJECT: Sealed Bid 40046 - Sign Mat~gh~al Advertised, sealed bids 460046 for the City of La Porte's annual sign material contract were opened and read in City Council Chambers July 23, 1984 at 4 p.m. Bid Invitations were mailed to seven manufacturers and distributors of sign material with responses being received from the following vendors: 1) Crabtree Barricade Systems, 2) Safety Lights Co., 3) Price Barricade Signal, Inc., 4) Vulcan Signs, and 5) Sargent-Sowell, Inc. The materials specified in the annual contract will be• purchased on an as needed basis by the Street Division of the City of La Porte for sign fabrication and ~ maintenance programs. These materials are presently purchased on spot quotations in quantities less than $3,000 per order. Purchasing these items in bulk from an annual fixed price contract will enable the Street Division to save up to 15y over prices paid under the present purchasing procedure. ~ Materials were divided into sections with Section I covering reflective sheeting, sign faces, letter and numbers and Section II covering sign blanks, hardware, and channel posts. Low bid in Section IC by~Crabtree Barricade Systems was rejected for being non- specific. Low bid in Section 2B by Sargent-Sowell Inc. and second low bid in Section 2B by Price Barricade and Signal Inc. were both rejected for specifying "all or none" on their bid quantities. The City of La Porte is unable to comply with "all or none" requirements due to its' inability to accurately forecast actual consumption of these materials. I hereby recommend that the City of La Porte award an annual contract to the following vendors by Section on the basis of low bid meeting specifications: 1. M. Jones Survey, A-482. The boundary survey of the 300 acre tract will require substantial work to re-establish the boundaries. The Southwest corner and Southeast corner have been obliterated or lost due to construction over the years. The Northwest and Northeast corners of the Airport do not exist except for the 8" Fence corner post which are approximate. The boundary survey will include locating the existing Humble Pipeline right-of-way and preparing a survey plat to indicate the results of our survey. You also requested surveying each lease site and locating the runway and taxiways. In order to survey the lease sites, it would be necessary to first locate the centerline of the existing runways and taxiways to make certain that the lease sites do not extend into the present clear zones. All corners of the lease site and Airport .boundary will be monumented with 5/8 inch iron rods 33± inches in length. As per your instructions, no improvements will be located are shown other than the centerline of existing runways and taxiways. It would be in the City's best interest to have some survey work performed to bring in some control and pin things down. I realize this microcomputer is almost twice as expensive as the IBM microcomputer also proposed, but if the City is going to follow the data processing strategy currently in effect, the Model 10/SP is the only practical solution. Other reasons are: • The bid specifies that the microcomputer be capable of running the City's office automation products supplied by Data General, C.E.O. C.E.O. is not easily/practically run on the IBM PC -this would cause an operator severe problems when switching from a Data General terminal to the microcomputer. . • The potential problem of whose problem it is when a hardware malfunc-..:on occurs while the microcomputer is connected to the City's host system.
