AN ORDINANCE PROVIDING FOR THE APPROVAL OF THE AGREEMENT DATED BETWEEN THE STATE OF TEXAS AND THE CITY OF La Porte , FOR THE CONTINUED EXISTENCE, USE, OPERATION, AND MAINTENANCE OF HIGHWAY TRAFFIC SIGNAL(S) AT THE LOCATION(S) SHOWN ON EXHIBIT 1, ATTACHED HERETO AND MADE A PART HEREOF, IN THE CITY OF La Porte ; PROVIDING FOR THE EXECUTION OF SAID AGREEMENT; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF La Porte SECTION 1. That the certain agreement dated between the State of Texas and the City of La Porte for the continued existence, use, operation, and maintenance of certain highway traffic signal(s) at the~:location(s) shown on EXHIBIT 1, attached hereto and made a part hereof, in the City of La Porte , be and the same is hereby approved, and The Mayor is hereby authorized to execute said agreement on behalf of the City of La Porte , and to transmit the same to the State of Texas for appropriate action. SECTION 2. That this Ordinance takes effect immediately from and after its passage, and it is accordingly so ordained. GOODE IN REPj,Y,~FER TO FILE N Reference is made to our letter of April 5, 1984, (see Attachments) concerning the maintenance of traffic signals on State designated highways in Ia Forte: A municipal traffic signal agreement is required when transferring responsibil- ities from the State to a City. Attached for your consideration are four copies of the State's agreement (Traffic Signal-Type 3A Mod.), the accoi~anying Ordinance, City Secretary's Certificate, and a list of power source locations for electrical payments to the utility company. Please execute and return the following to this office: 1. Official Action -Original and three copies of the Ordinance and City Secretary's Certificate. 2. Agreement -Original and three copies signed by the proper officials. One Dopy of the Agreement with supporting documents will be returned to you upon completion by the State. We are, by copy of this letter, notifying the local poRaer company in your area. They will send all billings for power consumed after April 15, 1984, to you. 1886 ~W ~p~` 1986 v Hon. The invocation was given by Councilperson Deotis Gay. 3. Council considered approving the minutes of the regular meeting held June 20, 1984. Motion was made by Councilperson Skelton to approve the minutes as presented. Second by Councilperson Malone. The motion car- ried, 8 ayes and 0 nays. Council considered approving the minutes of the special called meeting held July 11, 1984. Motion was made by Councilperson Longley to approve the minutes as presented. Second by Councilperson Skelton. The motion carried, 6 ayes, 0 nays, 1 abstain. Mayor Cline presented a plaque to Kathy Hutton, Finance Department, for being .named Employee of the Quarter, and commended Kathy for her service to the City. 7. Council considered approving a contract with HDR for sanitary landfill design and permit application. Larry Richardson of HDR was present to answer questions. Councilperson Skelton congratulated Mr. Richardson on his recent promotion. There were no questions from Council regarding the contract. Motion was made by Councilperson Skelton to approve the contract with HDR for sanitary landfill design and permit application. Second by Councilperson Gay. Council considered hiring the firm of Lloyd, Gosselink and Ryan to represent the City for the sanitary landfill permit application. The City Attorney reported that this firm is expert in the field of landfill permit applications. Such application are highly technical, and the City Attorney feels the firm will do an excellent job for the City. Motion was made by Councilperson Westergren to hire the law firm of Llo d, Gosselink and Ryan to represent the City for the sanitary landfill permit application. Second by Council- person Malone. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Skelton, Westergren, Malone, Longley, Matuszak, Graves, Gay and Mayor Cline Nays: None 9. Council considered change of street names in Brookglen Section ITI. City Attorney Askins read: ORDINANCE 1408 - AN ORDINANCE CHANGING THE NAMES OF CERTAIN STREETS WITHIN BROOKGLEN SUB- DIV:CSION, SECTION III; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. ~~ • r-_ ~i~ C Minutes, Regular Meeting, La Porte City Council July 18, 1984, Page 3 Motion was made by Councilperson Matuszak to adopt Ordinance 1408 as read by the City Attorney. Second by Councilperson Westergren. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Skelton, Westergren, Malone, Longley, Matuszak, Graves, Gay and Mayor Cline Nays: None 10. Council considered accepting bids for street paving and drainage improvements. John Joerns presented the bid tabulations to Council. They will be attached to the minutes. Several paving material options for residential and commercial streets had been con- sidered for the project. Mr. Joerns detailed each of them for Council. After questioning from Council regarding prices, materials, areas to be paved, engineering fees, addition funds needed, etc., motion was made by Councilperson Matuszak to accept Alternate I and II. Second by Councilperson Graves. C After further discussion and questions, Mr. Herrera asked that before the vote was taken, that the motion include the transfer of whatever funds are necessary from the General Fund contingency fund . Motion was made by Councilperson Westergren to amend the motion, & to accept the second recommendation for $398,152.04. Second by Councilperson Skelton. The amendment was defeated, 2 ayes, 3 nays, 3 abstain. Ayes: Councilpersons Skelton, Westergren Nays: Councilpersons Matuszak, Graves, ai~d.Mayor Cline Abstain: Councilpersons M~lo.ne, Longley, Gay The vote on the main motion was then taken; to accept Alternate I and II for $473,760. Council considered approving a resolution for the termination of Step I of EPA Grant, Lomax planning area. C-481176-01-3;' FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council erson Matuszak then made the motion to transfer funds from the General Fund Contingenc Fund to the Public Works Street Improvement Fund .in the amount of~ 40,500 for the street paving and drainage project. Second by Councilperson Graves. The motion carried, 7 ayes and 0 nays. Council considered awarding a bid for fire apparatus. Motion was made by_Councilperson Skelton to award the bid for fire apparatus to Sutphen Corporation in the amount of $133,561. Council considered approving an agreement with Harris County for fire protection in unincorporated areas. Motion was made by Councilperson Westergren to approve the agreement with Harris County for fire protection in unincorporated areas. Second by Councilperson Gay. The motion carried, 7 ayes, 0 nays. Council considered a resolution for authorizing a lease-purchase agreement funding for La Porte Area Ambulance Corps. Mr. Herrera stated the ambulances had been authorized on June 13 and were scheduled for delivery in late July or early- to mid-August. The total cost is estimated to be $85,000. Staff recommends a lease-purchase agreement whereby the City of La Porte will borrow from a bank on a promissory note with a three year pay out and an interest rate of 8.6$., The City will then lease the equipment to the La Porte Area Ambulance Corps at a monthly fee of $2,600 for 36 months. City Attorney Askins read: RESOLUTION 84-7 - A RESOLUTION AUTHORIZING THE CITY OF LA PORTE TO BORROW THE SUM OF EIGHTY- FiVE THOUSAND AND NO/100 DOLLARS ($85,000), FOR THE PURCHASE OF THREE AMBULANCES, WHICH PROMISSORY NOTE SHALL BE ISSUED UNDER THE AUTHORITY OF THE TEXAS PUBLIC PROPERTY FINANCE ACT, AND SHALL BE SECURED BY THE FULL FAITH AND CREDIT OF THE CITY OF LA PORTE. C Motion was made b Councilperson Westergren to adopt Resolution 84-7 as read b the City Attorney. Second by Councilperson Skelton. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Skelton, Westergren, Malone, Longley, Matuszak, Graves, Gay and Mayor Cline Nays: None 15. Council considered approving a contract with Carlos Smith for engineering services for the restoration of the Carter Trust property. Mayor Cline inquired if anyone had received word regarding the purchase of this property. Mr. Hodge reported they have asked for a letter but it has not been received as yet. He had been in telephone contact with FEMA, and was informed that under their guidelines they are not allowed to fund any purchase of any rights-of-way and/or property or lands. Councilperson Matuszak inquired if we had received a request from the Carter Trust to restore the property. City Attorney Askins reviewed the events leading up to the present action, and stated it will be carried on the City of La Porte books as "hurricane damage" in order that the City can attempt to recover 75$ of the cost from FEMA. After the figures are complete and the bid is let, a formal settlement agreement and release will be drawn up between the City of La Porte and the owner. ~~ • •~ • ~~, Minutes, Regular Meeting, La Porte City Council C July 18, 1984, Page 6 Mr. Matuszak asked if the Carter Trust had formally requested in writing, for the City to restore the property. The City Attorney replied that although it had not been explicitly re- quested, there had been quite a good bit of exchange of corres- pondence between the City and Carter Trust attorneys that could legally be regarded as a formal request. Councilperson Matuszak asked if the contract should have the City of La Porte called "owner" since they are not the owners. Mr. Askins replied that normally. the contracting party or the paying party is called the owner in contracts of this type. Councilperson Matuszak asked why there was a difference in engineering fees in this project and the street paving project. It was explained that charges are done on a curve - the lower the cost, the higher the fee. Councilperson Skelton asked if we could get the City to where we would not be obligated for any liability after the work is done and the release is signed if at some time in the future the property is sold. City Attorney Askins said that we will get a full and final release covering every type of claim and be binding on the owner and his asignees. The next stage of C the work will be for the City Engineer to certify to the City and to the Carter Trust the plans and specs. At that point we will sign a release before them. Mayor Cline questioned whether or not a price had been set on the purchase of the land. Mr. Hodge replied that he thoug}t it was around $300,000. Council considered awarding an annual contract for street materials. Purchasing Agent Jackson Ray stated that the recommendations are all low bid meeting specs, and asked for a contingency contract to the second low bidder. Mr. Gay inquired where the funds were budgeted, and was in- formed they are budgeted in the streets or maintenance depart- ments . ~b •~ • C Minutes, Regular Meeting, La Porte City Council July 18, 1984, Page 7 Motion was made by Councilperson Skelton to accept staff's recommendation and award the bid for street materials to Parker Brothers for hot mix and black base and to Radcliff Material for hot mix-cold laid asphalt, and award a con- tingency contract to Radcliff Material for hot mix and black base should Parker be unable to perform during the life of the contract. Second by Councilperson Graves. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Skelton, Westergren, Malone, Longley, Matuszak, Graves, Gay and Mayor Cline Nays: None 17. Council considered a resolution appointing a chairman of the Sesquicentennial Committee. Mayor Cline reported that all the necessary information was not ready to act on at this time and requested this item be postponed. C Motion was made by Councilperson Westergren to table this item. Administrative Reports Mr. Herrera reported that the City of Paris, Texas, visited our computer site, and that the City of Friendswood would be here July 19. The City of Ft. Walton, Florida will visit possibly August 15 or 16, and the City of Ft. Walton would like their City Manager to meet with our City Manager. 19. Council Action Westergren: Asked, in regard to the Lakeland Group, if the City had heard anything from the Subsidence District in regard to the pumping of water. Mr. Herrera replied that we have not heard anything back from them. Asked if we contacted them and asked for comments. Mr. Herrera replied he has conferred with Jack Owen for their response. Longley: Mayor, I would like to defer my comments to you. Matuszak: Did we learn anything about the signal lights on Farrington and Spencer? Understood that the County had ap- proved that light - the funding of it. Asked Mr. Herrera to check on it. Will be studying all the various effects of pollution on our natural resources. The major sources of pollution, as he understands it, are the ship channel and Lake Houston. It will be an exciting committee and he will keep Council informed on everything. Mayor Cline: Congratulations on your appointment. Did you get this from serving on the TXTX for us? G_~: Is glad to be at the meeting. Would like to acknowledge our sister city of Shoreacres who is visiting tonight. Hopes they will come back again. Mayor Cline: Reminded Council of the meeting of the La Porte Area Water Authority on Thursday night. Skelton: And, tomorrow night is the meeting of the Harris County Mayor and Council, also. Mayor Cline: Announced she had an unpleasant chore to do. She then read.a letter of resignation from John Longley, Council- ` person representing District 2. Mr. Longley is moving from this area. The Mayor offered her regrets that i~Rr. Longley has tendered his resignation and stated we hate to see Mr. Longley leave. Longley:Thank you. I really hate to leave. The letter cannot come close to the emotions I truly feel. It was extremely dif- ficult for me and certainly a hard decision I had to make, and it was not made lightly and it is~something I'll have to live with. I do appreciate everyone. Mayor Cline: John,~you've done an excellent job and you served on our IDB, you were here at the onset of that Board, and seen some of the things that came and worked hard to get them. And you have helped a great deal with the progress of the City, and we're all going to miss you very much. Skelton: John, I would like to echo that, also, for all the many contributions you've made to the City of La Porte. I thank you. Matuszak: And I'd like to second that, also. I know we'll all miss you. John gave us quite a bit of history here. I believe you're the only one in this town that's ever had a tied election. Although we like you, we don't like the person who's taking you away. Gam: I have enjoyed, too, working with you for the number of years we have had together. We have had some beautiful times on Council and various other meetings, and I'm also going to miss you. Westergren: John, it's difficult to lose you because you have added considerably to this group as a governing body, and I wish it weren't true, but unfortunately, it is, and we will sincerely miss you, and thank you for the time you've given in this period of time. Graves: I guess I'll have to echo it, also. I was prepared for a roast. Since I don't have anything nice to say--no, really, it's been good working with you. I'll never forget the truck ordinance. The State will leave the highway traffic signal(s) in place at the location(s) shown on EXHIBIT 1. 2. The City will operate and maintain the signal(s) at their expense. 3. The City will pay all power costs for operating the signal(s). 4. The City will obtain written approval of the State Department of Highways and ~'ublic Transportation before making any changes in the design of operation and timing of the signal(s) or before removing any part of the installation(s). 5. The City will return any and all parts of said highway traffic signal installation(s) to the State should (they) be removed by the City for any reason other than for installation on a State or Federal numbered highway route at a location approved by the State. 6. In the event the signal installation(s) covered by this Agreement become unnecessary or (are) removed for any reason, this agreement shall terminate. 7. Indemnification. The City agrees to indemnify the State against any and all damages and claims for damages to adjoining, abutting or other property for which the State is or may be liable arising out of, incident to or in any way connected with the existence or the use of such signal installation(s) and does hereby agree to indemnify the State against any and all court costs, attorney's fees and all expenses in connection with suits for such damage and shall, if requested to do so in writing, assist or relieve the State from defending any such suits brought against it. 1 AGREEMENT (TRAFFIC SIGNAL - TYPE 3A MOD.) 2-4 6-82 .~ • • !-- , Nothing herein contained shall be construed to place upon the State any manner of liability for injury to or death of persons or for damage to or loss of property arising out of or in any manner connected with the use of the project, and the City will save the State harmless from any damages arising from said maintenance and/or use of said project. 8. WHEREAS, Article 6701d, Vernon's Texas Civil Statutes, provides that whenever the governing body of the City of La Porte shall deter- mine upon the basis of an engineering and traffic investigation that any prima facie speed limit therein set forth is greater or less than is reasonable or safe under conditions found to exist at any inter- section or other place or upon any part of a street or highway within the City of La Porte, taking into consideration, but not limited to, the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signage giving notice thereof is erected at such intersection or other place or part of said street or highway; and, WHEREAS, the City Council of the City of La Porte has directed that an Engineering and Traffic Investigation take place for the purpose of ascertaining reasonable and safe prima facie speed limits on certain street or highways within the City of La Porte; and WHEREAS, the results of said Engineering and Traffic Investi- gation have become known unto the City Council of the City of La Porte; and WHEREAS, the City Council of the City of La Porte finds that it I ORDINANCE NO. 1410 Page 2 CJ is consistent in promoting the health, safety, and welfare of the citizens of the City of La Porte to designate maximum speeds upon said certain streets and highways of the City of La Porte based upon the results of said Engineering and Traffic Investigation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: SECTION 1. Upon the basis of an Engineering and Traffic Investi- gation heretofore made as authorized by the provisions of Article 6701d, Vernon's Texas Civil Statutes, the following maximum speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and prudent; and such speed limits are hereby fixed as the maximum rates of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows, and any speed in excess of the limits specified and during the times as set out shall be prima facie evidence that the speed is not reasonable and prudent and that it is unlawful, and that said speed limits upon the named streets and highways, or parts thereof, described as follows, are established pursuant to the Code of Ordinances, City of La Porte, Harris County, Texas, Chapter 25, Traffic, Article 2, Section 25-1 et sec. The above described speed limits are hereby fixed at the rate of speed indicated for vehicles traveling ~~pon said named streets and highways, or parts thereof, described as follows, to wit: (A) Along West Main from State Highway 146 to a point 150 feet west of 26th Street (Sens Road), a distance of approxi- mately 1.0275 miles; the prima facie maximum speed limit is hereby established at 35 miles per hour. (B) Along West Main from a point 150 feet west of 26th Street (Sens Road) to Underwood Road, a distance of approximately 2.4148 miles; the prima facie maximum speed limit is hereby established at 40 miles per hour. (C) Special School Zones (1) Notwithstanding any other provisions of this ordinance, and not by way of limitation of any other heretofore properly designated school zones, it shall be unlawful for any person to drive any motor vehicle at any rate of speed in excess of 20 miles per hour at any of the following designated school zones: ~~ • ORDINANCE NO. 1410 Page 3 (a) Along West Main Street from a point 540 east of Farrington Boulevard to a point 280 west of Farrington Boulevard, a distance of approximately .1742 miles; (b) Along Farrington Boulevard from West Main Street to a point 850 feet south of West Main Street, a distance of approximately .1610 miles. The speed limit established in this section shall be in effect between seven o'clock a.m. and nine o'clock a.m., and between two o'clock p.m. and four o'clock p.m., Monday through Friday of each week, from the first day of September, or the beginning of the school term, whichever event first occurs, until the last day of May immediately following, or the last day of school, whichever event last occurs, of each and every year when the school zone to which such limit applies is properly signed or posted as a school zone. Timed flashing lights, as well as fixed signs, may be used to sign or post a school zone, as directed by the Chief of Police of the City of La Porte. SECTION 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as reugired by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase or clause, of this ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of the City Council to have passed each section, sentence, phrase, clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. ~~ • • ORDINANCE NO. 1410 Page 4 Section 4. Any person, as defined in Section 1.07 (27), Texas Penal Code, who shall violate any provision of this ordinance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict only. Section 6. This ordinance shall be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. It is a concrete line, 11 to 1?_ feet deep, that has been in service for longer than 30 years. T}ie joints are open and the top half of the pipe is missing in numerous areas. The sewer cleaner could not pass th.rou.gh the line to adequately respond to complaints of sewer stoppage. We found. that mud. and sections of -the pipe were falling into the flow line and causing stoppage. Ad.d.itionally, tha water blast of the sewer cleaner would cause more material to break fr•r-.e 'to plug the sewer flow. City craws started the replacement project, however, due to the wet subsurface from the open pipe, the.cquipment and crew could not cope: with the unstable soil. After several cave-ins, I was afraid for the lives of the crew, damage to the City equipment and possible damage to adjacent building slabs. McKey Consi~•ruction, Inc. was contacted to assist with a laz•ge backhoe, adequate shoring materials and a crew experienced in working unstable and caving soil. . To complete the project the sewer pipe was halved 1;0 10 foot joini;s, in lieu of standard 20 foort joints and placed between solid shoring. City crews will complete the cleanup. The scope of our consulting services for this project will be designed to satisfy all geotechnical requirements outlined in the Texas Department of Health (TDH) "Municipal Solid Waste Management Regulations" with revisions effective 12 July 1983. Specific phases of the consulting services are: o Geotechnical Field Investigation - We will make additional geotechnical borings (11 to 14 additional borings in the 20 to 40 ft depth range) to complement borings advanced during the preliminary site evaluation. We will also install 3 or 4 permanent groundwater monitoring wells as per the requirements for at least 1 uP9radient and 2 downgradient monitoring wells. If a strong interest is evidenced by the TDH, we will perform resistivity sounding and profiling of~the site. o Laboratory Evaluation - We will conduct a program of index and engineering property tests in our Houston Soil Mechanics Laboratory in order to develop operational and groundwater protection recommendations for the proposed landfill. However, we anticipate that-additional consultation with DPW and HDR and meetings with the TDH may be necessary after completion of the report. Because of the presence of growth faults in the general area of this site and some evidence that a fault may exist on the property south of the site, some additional geological study will be required relative to the the fault issue. We will try to develop sufficient evidence from existing data (additional aerial photos, geophysically logged borings, etc.) to demonstrate that no active growth faults cross the site. Gathering and interpretation of this type of evidence is reasonably straight-forward and should be budgeted at $1,500 to $3,000. If, however, this type of study does not satisfy the TDH or if intervener claims must be refuted, a more extensive fault study may be required. The more extensive study, commonly referred to as a "Second Phase" study, requires a series of deep geophysically logged borings in order to check for offsets of geologic units (direct evidence of faults). A second phase fault study would be conducted if required to satisfy the TDH or in defense of the permit application. That study would be conducted to verify a fault does not exist on the proposed landfill site or is not present within some distance from the proposed site such that it would affect the site. We anticipate that our work would include the following: o Conduct a field study consisting of geophysically logged boring holes approximately 300 ft deep along traverses normal to suspected fault directions; and o Prepare a report outlining our findings with appropriate maps to illustrate the location of borings, any fault locations, and hazard zones. The most reliable method of establishing fault locations is by geophysically logged boreholes in lines approximately normal to a fault. Typically, three to five boreholes establish fault offset with any degree of reliabilityre Aesingle line of borings may be suitable to resolve the presence or absence of a fault along any one boundary. However, two or more lines of borings may be required to show an absence of faulting on a property, particularly if it is necessary to define the distance to a fault that is nearby but offsite. ~~ • • !„"' ' Woodward-Clyde Consultants Division of Public Works Mr. Jerry Hodge July 19, 1984 Page 4 Based on our experience, costs for such studies typically range from $1,500 to $2,000 per boring including geophysical logging and our report. We anticipate that the costs to conduct the study at and adjacent to the proposed landfill site then might range from $10,000 to $40,000. The magnitude of the second phase study would depend entirely on the reason for conducting the study. If a second phase study becomes necessary, the anticipated time required to complete the study would be 4 to 6 weeks. In summary, we anticipate the geotechnical engineering study for this permit application will require a budget in the range of $20,000 to $35,000. COND_ ITIONS Woodward-Clyde Consultants warrants that our services are performed, within the limits prescribed• by our Clients, with the usual thoroughness and competence of the engineering profession. No other warranty or representation, either expressed or implied, is included or intended in our proposals, contracts, or reports. For any damage .on account of any error, omission, other professional negligence, our liability will be limited to a sum not to exceed $30,000 or our fee, whichever is less. In the event that the Client does not wish to limit our professional liability to this sum, we will waive this limitation upon the Client's written request provided that the client agrees to pay for this waiver an additional consideration of 1096 of our total fee or $1,000, whichever is greater. Kibodeaux Memorial Public Works Service Center were opened and read in City Council Chambers July 9, 1984. Plans and specifications for this project were prepared by Gaddy and Paul Inc., Structural Engineers of Houston, Texas. A total of ten sets of specifications and blueprints were picked up from the Engineer's offices and a total of ten bids were received. The bid submitted by Longhorn Welding Service was rejected for lack of bidders bond. Sureties were retained on the low three bidders until a complete evaluation could be made of each firm's proposal. The three low bids are shown below: (1) De Mar Engineering - $53,700 (2) Drymalla Construction Company - $60,018 (3) Moore & Moore General Contractors - $62,820 Low bidder was asked to submit a detailed chronological construction schedule and a list of work references prior to award. All material requested was sub- mitted July 13, 1983. Both the proposed sixty day construction schedule and De Mar Engineerings' list of references were favorable. I hereby recommend awarding the Reconstruction of Storm Damage at the Public Works Facility to De Mar Engineering in the amount of $53,700 and a completion time of sixty days after award. City of La Porte specifications asked for pricing on "Lime Slurry" that would meet specification X264 established by the Texas Highway Dept. in 1982. Pricing was to be submitted for lime slurry picked up at the plant and delivered to the jobsite. Only Chemlime of La Porte, Texas submitted both delivered and picked-up pricing. A low bid of $65.50 per ton of dry solids delivered was submitted by Southwest Basics Co., Inc. of Richmond, Texas. A detailed review of this firm's physical plant reveals the lack of an on site certified weight scale to verify weights before delivery. Since this product is paid for by weight and not by volume, I have rejected the low bid due to their inability to certify true weight. I hereby recommend the City of La Porte award its annual contract for the supply of lime slurry to Chemlime Inc. in the amount of $72.50/ton delivered and $65.00/ton picked up. This was accomplished prior to the Public Utility Commission's "rural rate case", and the Coalition therefore participated in the PUC proceedings not only as an intervenor, but also as a group of approximately 60 unified local regulatory authorities from which HL&P appealed a $181.5 million rate decision. These combined voices were heard: the Commission ultimately approved a $182.6 million revenue increase, even though the PUC staff recommended a much higher increase. Because of this success, we propose to take the same approach in the case recently filed by HL&P. Hopefully, our efforts will again play a meaningful role in the regulation of electric rates in this area. I am sending a similar letter to all cities in HL&P's service territory which have retained original jurisdiction. If you wish to participate in this effort, please request authorization of the attached draft resolution from your City Council and forward a copy certified by the City Secretary to me. Upon receipt of these resolutions, we will file a Motion to Intervene on behalf of the Coalition in the PUC proceedings. On a related matter, it is extremely important that by Friday, July 20, 1984, all cities within the Coalition suspend the effective date of HL&P's proposed rate change for a period of ninety (90) days.
