In lieu of the invocation by City Attorney Knox Askins, Mayor Cline asked that a moment of silent prayer be offered in the death of one of our prominent citizens Eugenia Riley. Funeral services were announced by Mayor Cline. 3. Council considered approving the minutes of the regular meeting of City Council held September 19, 1984. Council canvassed the votes cast in the Special Election held September 29, 1984. 6. The Mayor read the election returns and passed them to Council. Council considered Ordinance No. 1414 declaring the results of the Special Election held September 29, 1984. Waters Councilperson at Large Position A, after which they took their places at the Council Table. Councilperson Bridges thanked the persons involved in her campaign, her family and all the persons who voted for her. Councilperson Waters thanked her family for their support for her and all the persons who voted for her and hopes that she will be able to serve them fairly and in their best interest. .r- 8. Wallace to rezone Block 643, Lots 1-32, from commercial to light industrial to accommodate the expansion of Browning-Ferris Industries, Inc., facility on 16th Street. Mayor Cline asked Mr. Wallace if he would like to speak on behalf of his request. Mr. Wallace stated that he is requesting the rezoning of this area to accommodate the expansion of Browning-Ferris Industries. He stated that he is the property owner and is interested in selling the land in Browning-Ferris for their expansion. He stated that the property was currently zoned commercial and should be rezoned industrial to accommodate this expansion., Mr. Wallace stated that this property. is not actually on 16th Street, but instead is on 17th Street, adjacent to the switching yard for the railroad. Mayor Cline stated that this request had been reviewed by the Planning and Zoning Commission. . Mayor Cline stated that there is no such zoning as that of light industrial but should read industrial for this facility. Mayor Cline then thanked Mr. Wallace and asked if there were any other persons wishing to speak on this request. There were none. B. Council considered the reque~t of F. Carrington Weems, R. D. Fletcher and Myrl Peterson to rezone a 21.8288 acre tract of land south of Baypoint Townhomes from temporary R-1 to commercial to allow development of 4-plex apartments. Mayor Cline asked if Mr. Fletcher would like to speak on the behalf of his request. Mr. Fletcher stated that he had an option to buy fro~Mr. Weems a 21 acre tract of land in this location and would like to establish a development of 4-plex apartments. He stated that there would be approximately 16 dwellings per acre. He then passed photos of a current apartment complex out to Council for them to see what kind of establishment he had in mind for this area. t' . ~ ~ ~ ~ Minutes, Public ~rings and Regular Meetin~ La Porte City Co~il October 3, 1984, Page 4 . Mayor Cline asked a question of staff regarding their recommendation. Mr. Joerns stated that the sanitary sewer system was of main concern, but that the situation would be handled on a staff level. He stated that wastewater from this facility would be brought back to 8th Street. line which currently exists and should create no major problems. Mayor Cline stated that the staff recommendation is to approve this request as brought forth. There were additional questions of 2 citizens in the audience who asked Mr. Fletcher if there would be recreational facilities and how the tenants would gain access to the complex. Mr. Fletcher answered that access would be down 8th Street and also Highway 146, and that many recreational facilities would be included such as tennis courts, jacuzzi, swimming pool, etc. Mayor Cline then thanked Mr. Fletcher and asked if there were other questions of Mr. Fletcher. There were none. . C. Council considered the request of James Alexander to rezone Block 1, Lots 18 and 19, Spenwick Place, Section I, from residential to commercial to allow a rental' equipment business. Mayor Cline asked Mr. Alexander if he would like to speak on behalf of this request. Mr. Alexander stated that he had gone to the Planning and Zoning Commission with his request and that they had approved it and sent it to Council for final approval. He stated that he was wanting to sell the property to Mr. Tolar and that they were going to construct a retail business for the rental of equipment on this property. He stated that he had begun construction several months ago and had already put in plumbing from the ground but had to give up the project because of lack of funds to complete the project and the t' . ~ ~ ,... ~ Minutes, Public "'ringS and Regular Meeting~ La Porte City Council October 3, 1984, Page 5 . fact that the annexation took place and his property was rezoned R-1. He stated that he respectfully requests the Council to approve his rezoning so that construction may proceed. He then showed Council a plat of the area. Mayor Cline stated that this area on Spencer is predominately commercial and stated that possibly some permanent zoning needs to be established for this strip of land. Mayor Cline asked if anyone wished to speak in fav~r of the rezoning. Several citizens were present to speak in favor of rezoning the whole strip commercial along Spencer Highway. Those persons speaking were Vivian Covington, Russell French, Joe Hicks, William Bower, Glen Tolar, and R. W. Bramley. Mayor Cline thanked Mr. Alexander and closed the public hearings. Mayor Cline then stated that City Secretary Black had the recommendations on all the above subjects from the Planning and Zoning Commission. Mayor Cline then asked City Secretary Black to read the recommendations aloud. A copy of those recommendations is attached as part of these minutes. . 9. Council considered adopting Ordinance 780-DDDD to rezone Block 643, Lots 1-32, 'from commercial to industrial. Council considered reviewing bids and awarding the contract for cleaning, TV inspection and point repairs for portions of sanitary sewer system. Director of Community Development John Joerns explained that the September 5th bids were opened and read aloud for rebid number 3 for the cleaning, television, point repair for certain facilities in the City. Four (4) bids were received. The low bid was received from Naylor Industries in the amount of $121,211.50. The staff recommendation is to award the bid to the low bidder, Naylor Industries. Mr. Joerns explained that maps were included with the bid showing the locations of the specific lines involved. Mr. Joerns also explained that the majority of the lines were in the Fairmont Parkway vicinity. ~. Director of Administrative Service Bob Herrera explained that the reason for going out the second time for bids was mostly for legal purposes. The first rebid was protested by contractors and it was okayed by EPA's approval. The matter should be resolved. . ~ ~ ,... ~ e e . Council considered authorizing design services and additional service to Turner Collie & Braden Engineering Contract (Design of relief trunk sewer and wastewater treatment plant expansion). . Mayor Cline called on Director of Community Development John Joerns to discuss the topic. Mr. Joerns stated that the Engineering department had completed a report on this contract. He stated the report included information on Fairmont Parkway relief sewer and wastewater treatment plant. He stated that the final estimate on the relief sewer was 4.18 million dollars and the main wastewater treatment plant expansions is 3.06 million dollars. He said both figures were slightly less than had been anticipated. Mr. Joerns stated that sections of the recommendations both reports are consistent with those presented in the Master Plan, and are consistent with the improvement proposed and required and that staff is happy with them and ready to proceed with the final design. Mayor Cline asked if ~here were questions of Mr. Joerns. She stated that the authorization for this project is $320,400.00 dollars. It was discussed that there is $252,000.00 for engineering services, basic services to Turner Collie & Braden, who produced two projects and there is an additional $68,400.00 dollars for special services which include the survey work for both the sewer and plant and the geotechnical investigation which includes the soil investigations for these projects. Council considered the request for water and sewer extension to serve facility outside city limits. Councilperson Pfeiffer was excused from the discussion and action due to a conflict of interest on this subject. . Director of Administrative Service Bob Herrera discussed that the City had received an application for a water & sewer service for a four acre tract of land in the deannexed strip of land along the north side of Fairmont Parkway. The reason it is on the agenda for this meeting is that Council set a policy on this type of water sale, which must be specifically passed and approved by Council. He asked Mr. Joerns to give the specifics on the project. Mr. Askins stated that this area had been deannexed when the Bayport Industrial District was created. All of the land was owned by the Friendswood Development Corporation. He stated that the staff had been studying proposals for some annexations later this year. This strip of land is one of them and the Freezer warehouse on Highway 225. He mentioned that they paid full ad valorem taxes and remained in an undeveloped state. Mr. Joerns then stated that there is an existing 12 inch water line in the area and that the extension would be some 345 feet to service this area. The full cost of this project would be absorbed by Swisco under' current policy. He stated that a fire hydrant would be placed there also. Council considered hiring a schQol crossing guard for Leo Rizzuto Elementary school. j . Mayor Cline stated that a letter from Administrative Assistant Jerry Dennis of the La Porte Independent School District was in the agenda packet stating that he realizes that monies were not budgeted for the school crossing guard, but that the guard was really necessary since the school children are crossing such a dangerous intersection on Farrington Blvd. Mr. Dennis stated that the guard had already been hired even without Council action. The Mayor mentioned that she had received a letter thanking Council for their actions in hiring the guard. Mayor Cline then stated that she.had received a memo from Police Chief Freeman stating that the school crossing guard was completely necessary as he had asked patrolmen to survey the situation. Bob Herrera then stated that he had spoken with City Manager Owen concerning this problem and Mr. Owen had told the Police ~ department to go ahead and hire a crossing guard, but in a temporary capacity only, until the situation could be assessed and voted on by Council. Mr. Herrera stated that after talking with Lt. La Fitte that the person hired, realized that this was not a permanent position until Council approved or disapproved it. Mr. Herrera stated that since this amount was not budgeted, that the monies (uniform & equipment $248.85 and an annual salary of $4,868.85) would be absorbed in the Police department budget or could possibly be taken from the Contingency Fund. Chief Freeman then spoke to Council about the survey which was done by the police officers at this intersection. He stated that the need for the guard was completely justified. He stated that the need for this guard was of greater importance even than the crossing at Farrington and Spencer. Councilperson Waters asked if there was a 20 MPH speed limit sign there. Mayor Cline replied yes. She suggested that in Deer Park some of the older students were crossing guards and wore vests and a teacher accompanied them across the street. Council considered adopting Ordinance 1285-D setting civil service salary rates. . Councilperson Malone asked if this item could be tabled and discussed at a later time. Mayor Cline asked Council to go ahead and discuss it now. Mayor Cline stated that by passing this Ordinance, it would just go ahead and grant them a 3% cost of living increase. Bob Herrera stated that the ordinance will set out positions or classifications, the number of people in each classification, plus it reflects the cost of living increase given in the pay schedule. Councilperson Westergren asked if they would get their pay increase anyway even if the ordinance was not passed. City Attorney Askins stated that the ordinance is dated October 1st and even if there was a delay in passing it, the pay would be retroactive to October 1. He stated that Civil service required certain formalities. He stated that the ordinance must be done around the Ts~ of October each year. Association requesting to speak had been removed from the agenda. Mr. Askins stated that it was improper for them to speak without first going through the proper channels. He stated that it was improper for an association of a City, because of State laws, about union activities with governmental bodies to do anything that would be construed as negotiating with governmental bodies. He thought it to be improper. Mayor Cline stated that she did not feel that was the association's pretense and not the amount of monies they were receiving or about their salaries, but about the step program that we have, for pay increases here and we've discussed .that before. The Police department is not exactly like some of the other City departments. Mr. Askins stated that he did not feel that City Council should set up a workshop to discuss this problem. . Mayor Cline stated that Mr. Herrera had stated that they were planning to have some meetings about this item. He stated in talking with Chief Freeman, that a meeting has been set up between the Police Chief and the Association, and if need be, a meeting will be scheduled by the Chief with the La Porte management team. Mayor Cline asked if this item got on the agenda without any of that happening. Mr. Herrera replied that that was correct and that they had not even met with Chief Freeman. Mr. Herrera mentioned that the 3% increase was for all employees, as a cost of living increase. It was stated that the Ordinance could be amended at some point in time. 17. Request by Representative of La Porte Police Officer's Association to speak at this time This item was removed from the agenda at the request of the Police Officer's Association. 18. Council considered Ordinance No. 1415 denying application of Houston Lighting and Power to change rates to be charged in the City of La Porte. . Mayor Cline asked Mr. Wyatt if he would speak to Council on this item. Mr. Jim Wyatt of Houston Lighting and Power Company spoke. On June 15th HL&P did file notice of application during that session. Mr. Wyatt stated that he encouraged Council to take one of two actions either to suspend or deny. He recommended denying the leases for 90 days to go with the coalition of cities. You have tile October 15th to request a little speedier action on this. We are currently in hearing; have been since the 24th. Whatever action is filed, filed action the cities take, we more than likely appeal. The Commission will consolidate all appeals and hear them as part of the formal hearing. He stated that the final order would be in December or January and the rates would be put into effect February 1st. He stated that the rates will not go up until the PUC issues final order. The question was asked of Mr. Wyatt whether or not HL&P is planning to put any rates under bond. Mr. Wyatt replied that had been discussed; and doubtful it would happen. He stated that he couldn't remember under the "sunset" provisions the legislature reviewed the PUC bill and made quite a few extensive changes. Motion Has made by Councilperson Pfeiffer to adopt Ordinance 1415 ~nying application of Hou~Q.D.-Lighting and Power Company to change rates to be charged in-the City of La Porte. Council considered Resolution on Harris County Appraisal District (Res. No. 84-18) . Motion was made bY Councilperson Skelton t2-SQprove the Resolution No. 84-18 disapproving the budget adopted by the Harris County A~isal District; finding compliance with the Open Meetin&A-Law; and oroviding an effective date her~. Council considered adopting Resolution No. 84-19 regarding evidence of financial responsibility for sanitary landfill site. Assistant Director of Public Works Steve Gillett explained that as part of the process to apply for a permit to operate a solidwaste disposal facility, the Texas Department of Health requires all applications to give assurances of financial responsibility to provide assets to properly operate and eventually close the site to Health Department standards. Assurances are also required that the applicant will accept r' responsibility for proper operation and eventual closure. As the applicant, the City of La Porte is required to pass a Resolution accepting financial and operational responsibility to operate the proposed disposal facility. . .... ... ,... ~ e e . Council considered authorizing payment for emergency purchase of electric motor for Fairmont Park Water well number 1. . Assistant Director of Public Works Luther Maxey explained that on September 21st, lightning struck the electric motor at water well #1 in Fairmont Park. The power surge was so intense that the lightning arrestors were blown and still power was passed into the motor. The copper windings were melted and the internal case was heat cracked in numerous places. The City Council of the City of La Porte hereby finds, determines and declares that heretofore, to-wit: on the 6th day of September, 1984, at 7:00 P.M., a public hearing ~ was held before the Planning and Zoning Commission of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible re-classification of the zoning classi- fication of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. Where required by the City of La Porte (mandatory for all process-type plants) a reduced pressure zone backflow preventor must be installed to protect the City from any possible cross-connections 4. When recommended by the City of La Porte, a meter bypass will be i nsta 11 ed 5. All plumbing shall meet applicable State and City of La Porte code requirements. City of La Porte shall have the right to inspect any and all work related to the furnishing of potable water to the user 6. The proposed user shall be charged the customary front foot fees on the area developed and improved, including off-street parking areas but not including areas intended for future development (Ordinance 759-E) 7. The user shall pay 150% of the water rates currently in effect for users within the corporate limits of the City of La Porte 8. Electric Motor DATE: September 28, 1984 TO: FROM: Public Harks Director on Fairmont Hater Hell #1 On September 21, 1984, lightning made a direct ~trike on the electric motor at water well #1 in Fairmont Park. The power surGe ,.,as so intense that the lightning arrestors were blown and still power was passed into the motor. The copper windings were melted and the internal case was heat cracked in llumerous places. The motor was sent to 'ivestine;house for estimates on repair and rewi nding. After talking with Westinghouse personnel and U.S. Motors personnel, it is our opinion that the cost to repair the motor would be the same as a new purchase. This would be the third rebuild for this motor. A new motor has been located in Tennessee for $7,400.00 plus shipping. The drive shaft on the well would need to be shortened, as new electric motors are smaller than the old types. We estimate the total cost to be approximately $8,200.00. e The #1 well at Fairmont is one of the lead wells for the City and approximately one million gallons of water per day is pumped from this well. With extreme care and management of the remaining smaller wells, the water production demands can be met. It should be considered an emergency situation with this lead well out of service. The loss of another well would put the City in a crisis situation whereby peak production or fire fighting demands may not be met. We request that the situation be declared an emerge~cy and that funds be transferred from the Water/Wastewater Contingency Account to purchase and install a new motor on Water Well #1. Ray - Purchasing Agen Sealed Bid #0055: , Fittings, Gate Valves, and Fire Hydrants Advertised, sealed bids #0055 for PVC pipe, fittings, gate valves and fire hydrants were opened and read in City Council Chambers September 10, 1984 at 4 p.m. Sealed Bid invitations were mailed to eleven local and area distributors of these products with the following firms returning sealed bids; (1) Golden Triangle Pipe and Water Supply, (2) Utility Supply Co., (3) Corrosion Systems Inc., and (4) The Rohan Co. Products were divided into categories and bid evaluation was accomplished by weighted average within each section. Pricing remained favorable for almost all commodities with decreases of 29% to 51% noted in Section I.A. PVC Pipe. The cost of cast iron fittings in Section II. A. also showed decreases of 5% on most items with increasing prices of 2% noted on three line items out of eleven. Recommended bid awards are as follows: l. Section LA. - Low bid by weighted average of 75% - Utility Supply Co. 2. Section LB. - Low bid by weighted average of 57% - Utility Supply Co. 3. Section II.A. - Low bid be weighted average of 64% - Utility Supply Co. 4. Section II.B. - Low bid by weighted average of 80% - Utility Supply Co. Low bid in Section III, Fire Hydrants, by less than 1/2 of 1% was Golden Triangle Pipe & Water Supply. This firm bid the American B-62B fire hydrant. The current contract is held by Gifford Hill & Co. of Houston, Texas. Pricing under that contract is shown on the attached 'tabulation. . Low bid in Section I, Reinforced Concrete Pipe was submitted by White's Supply Co. in Bay town. Pricing compared favorably with 1983-84 contract prices with decreases between 2% and 49% over current prices being paid. White's Supply Co. was also low bid in Section II on miscellaneous supplies but pricing in this section reflected a sharp increase over current contract prices. The present contract is held by Admiral Linen Co. of Houston who has serviced the City of La Porte for at least seven years. Bid specifications called for an extensive background investigation of the three low bidders listed below; 1. Low Bid: National Linen (Weighted Average = 20) 2. Second Low Bid: Best Industrial Laundry (Weighted Average = 22) 3. Third Low Bid: Misco Textile Rental (Weighted Average = 24) Stage one of the selection process called for a check of references in the following catagoriesi (1) an account serviced for over five years, (2) an account serviced for one to five years, (3) an account serviced for less than a year, and (4) the most recent lost account. Although all three companies being considered received a favorable evaluation in this stage, Best Industrial Laundry was the most highly recommended with National Linen second and Misco Textile third. Stage two of the selection process involved plant inspections and evaluation of the key people who would be responsible for servicing the City of La Porte. Special attention was focused on each supplier's capabilities in the following areasi (1) plant capacity, (2) type of production process, (3) business and profit philosophy, (4) quality control system, (5) warehouse operation, (6) condition and age of capital equipment, (7) employee attitude, and (8) organi- zation of operation.
