Members of City Council Present: Mayor Virginia Cline, Councilpersons Paula Bridges, Ed Matuszak, Linda Westergren, Norman Malone Members of City Council Absent: Councilpersons Betty Waters, Lindsay Pfeiffer, Deotis Gay, B. Don Skelton • Members of Citv Staff Present: Director of Administrative Services Bob Herrera, City Attorney Knox Askins, City Secretary Cherie Black Others Preser..~.~: Pete Dudley, Bayshore Sun Mayor Cline asked the City Attorney to review the boundaries of the subject annexation. The City Attorney gave the description and announced that the service plan was available for review. (A copy of the service plan is attached to these minutes.) The Mayor asked if there was anyone present who wished to speak in favor of the annexation. There was no response. The Mayor asked if there was anyone present wishing to speak in' opposition to the annexation.. There was no response. The Mayor declared the public hearing closed at 6:02 P.M. The agenda for the Called Regular Meeting was•then addressed. 1. Motion was made by Councilperson Matuszak to approve the minutes of the November 7 meeting as presented. Second, by Councilperson Malone. The motion carried, 5 ayes and 0 nays. Ayes: Councilpersons Bridges, Matuszak, Westergren, Malone and Mayor Cline Nays: None 4. Council considered purchase of police vehicles through H-GAC cooperative program. Furies through H-GAC, at a unit price of $9 03.72 Second by • Councilperson Matuszak. The motion carried, 5 ayes and 0 nays. Ayes: Councilpersons Bridges, Matuszak, Westergren, Malone and Mayor Cline Nays: None 5. Council considered an ordinance closing West F Street between Block 823 and Block 834, Town of La Porte. The City Attorney read: ORDINANCE 1421 - AN ORDINANCE VACATING, ABANDONING, AND CLOSING A PORTION OF THE RIGHT OF WAY OF WEST "F" STREET, LYING BETWEEN BLOCK 834 AND BLOCK 823, TOWN OF LA PORTS, AND BETWEEN THE WEST RIGHT OF WAY LINE OF SOUTH SEVENTEENTH STREET, AND. BEING A TRACT OF LAND EIGHT FEET BY TWO HUNDRED SIXTY SIX FEET, IN THE TOWN OF LA PORTS, HARRIS COUNTY, TEXAS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; • AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered a resolution approving agreement with La Porte Area Water Authority. Mayor Cline reminded Council that Mr. Owen had reported at the meeting November 26 that he was waiting on some figures to put in the resolution, and that the figures were not yet complete. Mr. Owen asks that this item be tabled until the meeting of December 5. Motion was made by Councilperson Westergren tg table item 6 until the meeting of December Second by Councilperson Bridges. Council considered recommendation of La Porte Area Water Authority on amendment to H.B. 1311 creating the La Porte Area Water Authority. Mayor Cline stated that Mr. Owen had conferred with the La Porte Area Water Authority and they had not submitted any recommendations at this time. Council considered granting an on-premise wine and beer permit to Spencer Country Cafe. The City Attorney read: ORDINANCE 1000-Q - AN ORDINANCE AMENDING ORDINANCE N0. 1000 OF THE CITY OF LA PORTE, TEXAS, DESIGNATING THE AREAS WHERE BEER FOR CONSUMPTION ON THE PREMISES MAY BE SOLD AND PROHIBITING THE SALE ELSEWHERE; PROVIDING FOR HOURS OF OPENING AND CLOSING; PROVIDING SALE OF BEEN FOR CONSUMPTION OFF PREMISES SHALL NOT BE AFFECTED; DEFINING SOURCE OF AUTHORITY; PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR THE AREAS HEREIN DESIGNATED; DEFINING RESTAURANT; GRANTING A PERMIT.; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. CJ • • Minutes, Public Hearing La Porte City Council November 28, 1984, Page CJ and Called Regular Meeting 5 Before the vote was taken, discussion was held regarding the various ways to insure that the ordinance was being complied with, and suggestions made as to how to go about filing a complaint in accordance with the ordinance. The vote was then taken, and the motion carried, 5 ayes and 0 nays. Ayes: Councilpersons Bridges, Matuszak, Westergren, Malone and Mayor Cline Nays: None 10. Administrative Reports There were no administrative reports. 11. Council Action Bridges: Inquired of Council if there were some way to combine workshop and regular meetings, since most discussion • is held at workshops on the same items that will appear on the agendas for the regular meetings. She feels it would be economically feasible in view of the utilities, etc., used to open the building for a meeting that could be taken care of after a workshop meeting. Mayor Cline suggested that perhaps it could be left to the discretion~of the City Manager and the City Secretary if it were possible to combine the meetings, dependent upon what agenda items were to be discussed and/or acted upon. General discussion was held and it was decided that staff be instructed to come up with a viable plan for Council meetings. The possibility of having a workshop one Monday a month was discussed. The City Attorney suggested that he, the City Manager and the Director of Administrative Services meet and discuss drafting an ordinance to cover meetings, agendas, methods, etc. Councilperson Bridges also suggested that speakers addressing Council be limited to 5 minutes unless it is a person representing a group, in which case limit them to 10 minutes. There was general agreement to this suggestion. • I • • Minutes, Public Hearing La Porte City Council November 28, 1984, Page • and Called Regular Meeting 6 Matuszak: Reported that the Homes Association in Fairmont Park would meet on the coming Monday night, and he felt that they would turn the care of the esplanades in Fairmont Park over to the City, due to financial reasons. Cline: Remarked that we had come close to not having a quorum for the meeting tonight, and stated she would probably not be at the December 5 meeting because she would not be in town. Several Councilmembers stated that they probably would not be able to attend, either. After a canvass of the Council present, it was decided that it would be best to cancel the meeting of December 5 if possible. Mr. Herrera stated that he and the City Secretary would look over the agenda items, and if there was nothing that could not wait, the meeting would be cancelled and the Council would be notified. Mayor Cline stated that the City Attorney had asked for an Executive Session on a legal matter. • 12. Council adjourned into executive session at 6:45 P.M. and returned to the Council table at 7:10 P.M. 13. There being no further business to come before the Council, the meeting was duly adjourned at 7:10 P.M. Ray SUBJECT: HGAC C oper a Vehicle Procurement Please find attached bid tabulation and recommendation from HGAC staff regarding police patrol sedans for the 1984-85 fiscal year. Base price for these units increased from just under $9,300 last year on 1984 Chev- rolet Impalas to $9,903.72 for 1985 Plymouth Gran Furys'. This repre- sents a 6X increase in price over units purchased last year, which is in line with the Big Three automobile manufacturers announced price increases for 1985 models (6X to 9X on selected models). I recommend the City of La Porte take advantage of this cooperative pro- curement effort by the HGAC and that orders be placed with HGAC staff by the November 30, 1984 deadline to insure receipt of units by Feb. 16, 1984. Should the Council approve the recommendations submitted by the Water Authority to amend this House Bill, we will need to submit these amendments to State Representative Ed Watson no later than December 5th, and request that he pre-register the bill. Box 1115 La Porte, TX 77571 RE: FILLING OF VACANCY ON BOARD OF DIRECTORS OF THE HARRIS COUNTY APPRAISAL DISTRICT • Dear Mr. Owens: Pursuant to the provisions of the Texas Property Code and resolutions adopted in 1981 by at least three-fourths of the taxing units entitled to vote on the appoint- ment of the members of the Board of Directors of the Harris County Appraisal District, an election is being conducted by the County Clerk to fill the vacancy created by the resignation of Mr. Fred Hartman, Chairman of the Board of Directors. It is the right and the responsibility of the governing bodies of all cities and towns, other than the City of Houston, participating in the District to select a person to fill the unexpired portion of the term to which Mr. Hartman was elected. This address is where "Mr. John's" cafe is presently located. Mrs. Marie Herbert is the owner of the building, and has leased it to Mr. Shah Shamsul Anam; therefore, a new permit application was necessary. WHEREAS, the City of La Porte desires to regulate the closing hours for the sale of beer by retailers selling beer • for consumption on premises in accord with provisions of Vernon's Texas Codes Annotated, Section 109.32 of the Alcoholic~Beverage Code of the State of Texas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. DEFINITIONS: Restaurant: A building or portion of a building, not operated as a dining room in connection with a hotel or boarding hotel, where the primary business is the on- premises sale of prepared food, with adequate kitchen facilities for the preparation of the food to be sold, the adequacy of said kitchen facilities to be based upon the seating capacity of the restaurant and the type of menu offered, and where alcoholic beverages may be sold under the following conditions: (1) At least sixty-five (65) percent of the gross • income shall be derived from the sale of prepared food . (2) Any outside entrances, outside separate identi- fication, outside signs or other advertising shall not use any of the words "bar," "tavern," "lounge," "ice house," or "beer," or any word of like import, to identify the business. (3) Beer shall be served as a beverage only in con- nection with the service of prepared food to a customer. (4) Whenever the building official on the basis of a sworn complaint from any credible person deter- mines that a violation of this section exists, he may require any person serving alcoholic beverages as an incidental use to provide the City, within thirty (30) days of notification, a verified audit for each of the preceding four (4) calendar quarters, showing the gross income derived from the sale of. alcoholic beverages and the gross income derived from the sale of food. Such verified audit shall be supported by copies of licensee's invoices and cancelled checks to substantiate its beer and food purchases. This Ordinance shall constitute a permit for the operation of a restaurant, as herein defined, at the above location, which permit shall be personal to the applicant, and non-transferable, and shall be further conditioned that the permittee shall comply with the provisions of the Texas Alcoholic Beverage Code, and all other applicable federal, state, and local laws and ordinances, including the provisions of this Ordinance. The City Council officially finds, determines, recites and declares that a sufficient written notice of the • date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 6.
