Members of City Council Present: Mayor Virginia Cline, Councilpersons Ed Matuszak, Betty Waters, Lindsay Pfeiffer, B. The invocation was given by Councilperson Malone. 3. Council considered approving minutes of the public hearing and regular meeting held December 19, 1984. Mayor Cline inquired if everyone had received the corrected copy of the minutes and asked if there were any other corrections. Council considered City participation in a 12" water line extension to Fairmont Plaza Shopping Center. Director of Community Development Joerns explained that this was a part of the utility extension agreement that the City had entered into in July. Due to a misunderstanding by the project's architect, a change order had been issued by the architect and construction on the water line began before all the specs and plans were in and approved. Joerns stated he had been in conference with their engineer, the City Attorney and the general contractor, to develop a plan for completion of the proposed work and the method for considering the City's participation. (This plan is contained in the memo attached to these minutes.) Councilperson Waters expressed concern that the City would not be within its legal limits because the cost was over the maximum $3,000 allowed without going out for bids. City Attorney Askins explained that in projects of this kind, the City approves contracts where the City does not actually contract it; it is done by the subdivider, contractor, or • engineer, where we have careful control over the plans and specifications. Bids are taken by the contractor, and inspections to see that it is constructed according to plans and specifications before our formal acceptance. In this case, everything was done before we knew about it. The matter came up and investigation into what had happened was made; random inspections by the Engineering Department were advised to make sure everything had been done by the contractor according to the plans and specifications. This was subsequently done, and the Engineering Department was satisfied that everything had been done correctly. The only violation that was found was that the contractor had "jumped the gun" in starting without the City's final approval. The City Attorney stated that the contractor had gone out for bids, which the City reviewed, and that we are simply participating in it. Mr. Joerns stated that the cost of materials from the contractor was slightly higher than what the City could have secured the materials for, and he made adjustments on the amount the City would participate in based on the difference in cost. • ~ ~ • Minutes, Regular Meeting, La Porte City Council January 7, 1985, Page 3 Motion was made by Councilperson Westergren that the City participate in a 12" water line extension to Fairmont Plaza Shopping Center, in the amount of $~,455.6g. Council considered emergency replacement of a 150 hp electric motor at water well 1~4 (Main & Broadway). City Manager Owen explained that this motor had burned, and after inspection of it, it was found that it could be replaced at slightly under the cost of having it repaired. Council considered awarding a bid for chemical, insecticide and janitorial supplies. Motion was made by Councilperson Westergren to accept staff recommendation and award the bid for chemical,, insecticide and .janitorial supplies to the low bidders meeting specifications= Morse Wholesales Van Waters end Rogers, Lone Star Brush and Chemical, and Industrial Chemical Cleaner. Second by Councilperson Waters. The motion carried, 8 ayes and 0 nays. Council considered awarding a bid for Police Department forms printing. Mr. Owen stated that Lighthouse Printing was the low bidder by a considerable amount, and that staff recommends that the bid be awarded to them. Motion was made by Councilperson Wester~ren tQ accept sta.f~ recommendation and award the bid for Police Department forms printin to Lighthouse Printing inthe_amount of $4.717.50. Council considered approving a preliminary list of dangerous buildings. Slides of the buildings, along with legal descriptions and • addresses, were presented by Inspector Mark Lewis. Council considered appointing a redistricting committee. City Attorney Askins stated that the redistricting must be fair and equitable in order to gain Justice Department approval when it is presented to them in Washington. They will insist that there be substantial minority community participation both from a standpoint of membership on the redistricting committee and also from publicity to the minority community to let them know when meetings will be held so that they can participate. It was Mr. Askins' suggestion that at least two black and two brown citizens be on the committee. Mayor Cline queried Council regarding how many members should serve on the redistricting committee. Councilperson Waters highly recommended that there be 9 members on the committee - one member to be appointed by each member of Council. She • felt that this would be a fair representation of the City, and that we would also have a fair minority representation in this way. The following names were submitted: Mayor Cline stated that Councilperson Gay had notified her that he would like to submit the name of Lola Phillips as the appointee from his district. Motion was made by Councilperson Matuszak that the names submitted be appointed to the redistricting committee. Second by Councilperson Skelton. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Matuszak, Waters, Pfeiffer, Skelton, Westergren, Malone, Bridges and Mayor Cline Nays: None Mayor Cline instructed staff to notify these people of their appointment, and a date of January 16 at 7:00 P.M. was set for the organizational meeting of the committee. • Mayor Cline noted that an addendum had been posted to the agenda at the request of the City Manager. The Mayor read the addendum and Certification by the City Secretary of the posting of same. The addendum item was: Nancy Neely - Regarding Police Department Clothing Allowance. The Mayor then read a memo from the City Manager regarding the above, a copy of which is an official part of these minutes. Mrs. Neely was in the audience, and Mayor Cline inquired if she still wished to speak, since the matter had been resolved. Mrs. Neely declined. The Mayor then struck the addendum from the agenda. 10. Administrative Reports: Mr. Owen reminded Council that John Lloyd would be present at the workshop meeting on January 14 to present the Capital Improvement Committee's report, and urged everyone to be present. • I • • Minutes, Regular Meeting, La Porte City Council January 7, 1985, Page 7 11. Council Action Matuszak: Thanked staff for getting the crossing light at Farrington and Spencer. Requested that the matter of final payment to TC&B be further tabled to one further workshop than he had previously requested. Waters: Recommended that in order to expedite meetings, if the agenda was brief enough, to hold a workshop session after a regular meeting. If the workshop session were too lengthy, it could be continued at the next scheduled workshop. Council's concensus was that this was a very good idea, and left it to the discretion of staff which meetings would be handled in this manner. Wester~ren: Has had a phone call regarding Bay Area Blvd. extension. The caller was very concerned about the traffic that comes and makes turns off of Fairmont Park onto Bay Area, • in particular trucks that have in the past turned over. The caller wanted to know where we stood on that. Mr. Owen replied that we have had some discussions with PPG about possibly revising some of their requests, and other matters concerning land acquisition. They have passed this request on to their office, but at this time we have heard nothing from their home office. It all boils down to a matter of money - the difference over and above what the County has in their budget to build the project. Malone He had seen an article on one of the well known ladies•~in La Porte, and Sylvan Beach was mentioned in the article. Her goal was to see us purchase it. Where do we stand on Sylvan Beach now? Is it a dead issue? The pavilion or the whole thing? Mr. Owen replied that the Capital Improvements Committee would be making a recommendation on the pavilion in its report at the workshop meeting on January 14. As to the park itself, he has nothing to report on it at this time. • ~ I ~ ~ • Minutes, Regular Meeting, La Porte City Council January 7, 1985, Page 8 Inquired if we were going to hire any high school students this summer, and if so, when could they start applying? The answer was yes, in departments like Parks and Recreation, some high school students were usually hired, and the applications normally were in the first part of June. Bridges: Has had several calls concerning the mineral deposits being found in their water in district 2. Mr. Hodge said he was not aware of this, and Mr. Owen suggested a sample be taken of the water, bring it to us, and we would have an analysis done of it. Cline: She is glad to be over her flu bout and be back in harness and starting the new year. • • 12. There was no executive session. 13. There being no further business to come before the Council, the meeting was duly adjourned at 7:04 P.M. The agreement included a provision for the City to participate in the cost of the 12" waterline installation subject to council approval and competitive bidding. CJ The standard utility extension agreement also calls for the developer's engineer to prepare plans and specifications for review and approval by the City. Unfortunately, the architect on the project issued a change order and the contractor .began installation of the 12" waterline based on a revised plumbing and site plan drawing from the architect. Since plans and specifications had not been approved, the City stopped construction of the wateline. Since that time, I have met with representatives of Fairmont Plaza Joint Venture, their general contractor, and their engineer to discuss: (1) the approved plans and specifications vs. what was installed by the contractor prior to being "shut down". (2) the steps necessary to complete construction according to the approved construction drawings and specifications. (3) the City's position on participation in the oversizing since the project was not competitively bid. • • cont. Fairmont Plaza Shopping Center Page Two Based on that meeting and several phone conversations with the developer and Knox Askins, I have devised the following scheme for completion of the proposed work and method for considering the City's participation. (1) Locate (developers responsibility) and inspect the section of waterline already installed for general conformance to the approved plans and specifications. (2) Review invoices and price quotations submitted by the developers contractor. Compare these prices to the City's cost for same materials. (3) If the above comparison is favorable, recommend to Council City participation in the oversizing from 8" to 12" (material cost only). (4) Submit to City Council for approval. (5) Require completion of all waterlines as per utility extension agreement and approved plans and specifications. (6) Final inspection, approval and submittal of record drawings. • • The above strategy is subject to slight modification pending the outcome of the field investigation and inspections of previously completed work. Attached is a breakdown of the contractors costs/quotes for various 8" and 12" diameter materials, as well as the City's costs/quotes for the same materials. Although comparable, the contractors costs are approximately $416.81 higher than the City's estimated costs. Obviously, this project has not proceeded according to the provision of our standard extension agreement. However, based on the spirit of cooperation exhibited by the developer and the cost information provided, I recommend that Council authorize $3,455.69 for participation in the installation of oversizing (materials only) of approximately 640 ft. of waterline. The motor was taken to Re19.ance Electric for evaluation and a repair estimate. After evaluation, Reliance estimated ONE THOUSAND SEVEN HUNDRED AND FIFTY DOLLARS ($1,750.00). The Purchasing Agent, Jackson Ray, got a second estimate from Westinghouse Electric. They gave an estimate of ONE THOUSAND DOLLARS ($1,000). We picked the motor up from Reliance and took it to Westinghouse. After the motor was dis-assembled, there was extensive stator and ironwork damage found. Westinghouse estimated repair costs at THREE THOUSAND FIVE HUNDRED NINETEEN DOLLARS ($3,519). Jackson requested prices for a replacement motor from several vendors. Westinghouse quoted a new motor at THREE THOUSAND FIVE HUNDRED DOLLARS ($3,500). It is more cost effective to purchase the new motor. • ti'7s have lost two well motors due to electrical malfunctions during the past three (3) months. With this in mind, I have requested Jackson to send out requests for proposals on an electrical survey of the entire water supply system for the purpose of supplying electrical protection for the well and booster pump motors. I feel that we need to purchase this motor on an emergency basis. We are able to operate the system with this well down with no problem. However; should we lose another well, we would be in an extremely critical situation. For the above reasons, I recommend that we purchase this motor as soon as possible. Should any more information be desired, please advise.
