The invocation was given by Councilperson Waters. 3. Council considered approving the minutes of the regular meeting held February 20, 1985. Mayor Cline proclaimed the month of March as Youth Art Month. Mayor Cline named Curtis Herrod as Employee of the Quarter and complimented him on the fine job he is doing for the City. Mr. Herrod was presented a plaque. 6. Mr. Eugene Hovey, City Auditor, presented the annual audit to Council. 7. The Mayor asked for citizen input regarding the City of La Porte's FY 1985 Community Development Block Grant Project Proposals. There was no citizen input. The proposals receiving consideration this year are major water distribution improvements and fire hydrant placement in the Spenwick Place neighborhood, and additional funding to supplement the City's ongoing dangerous building demolition program. 8. Council considered an ordinance updating City of La Porte Electrical Code. This had been tagged from the meeting of February 20 by Councilperson Skelton. • Councilperson Skelton addressed sections of the ordinance he was not in agreement with: Section 1, article 1.20 regarding insurance requirements and Section 3, regarding master electrician licenses. Motion was made by Councilperson Skelton to pass section 2,, 4,, 5 and 6. Second by Councilperson Matuszak. Motion was made by Councilperson Gav to table the ordinance updating the Citv of La Porte Electrical Code until it could be rewritten by the City Attorney to reflect the changes. Second by Councilperson Waters. The motion carried, 8 ayes and 0 nays. - Ayes: Councilpersons Bridges, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Cline Nays: None 9. Council considered an ordinance changing two street names. The City Attorney read: ORDINANCE 1437 - AN ORDINANCE CHANGING THE NAME OF A PORTION OF WEST "F" STREET, TO MAGNA STREET, AND CHANGING THE NAME OF A PORTION OF WEST "G" STREET, TO FLOW STREET;~AND PROVIDING AN EFFECTIVE DATE HEREOF. Second by Councilperson Westergren. The motion carried, 5 ayes and 3 nays. Ayes: Councilpersons Matuszak, Pfeiffer, Gay, Skelton and Westergren Nays: Councilpersons Bridges, Waters and Mayor Cline 10. Council considered awarding a bid for fencing at the North Broadway Baseball Field. Motion was made by Councilperson Gav to table this item until more details re~ardin~ titles soil evaluation, etc, could be studied. Second by Councilperson Westergren. Council considered awarding a bid for pool filters. Motion was made by Counci~persQn Westergren to accept staffs recom~nenda~~on and award the bid for two pool filters to the low bidder. Mavfield Pool Co.. in the amount~~'~LO_.459.00. Second by Councilperson Skelton. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Bridges, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Cline Nays: None 12. Council considered appointing members to the Redistricting Committee. Motion was made by Councilperson Waters to approve the appointment of William Bowers and Terrv Fletcher to the Redistricting Committee as alternates. Second by Councilperson Bridges. The motion carried, 8 ayes and 0 nays. Second by Councilperson Pfeiffer. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Bridges, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and hlayor Cline Nays: None 13. Council addressed a workshop item, which was to discuss a bid for a motor grader. Motion was made by Councilperson Westergren to table this item until such time that the Director of Public Works gets statistical information re~ardin~ the motor grader. Second by Councilperson Skelton. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Bridges, Matuszak, Waters, Pfeiffer, Gay, Skelton Nays: None • 14. There were no administrative e r ports. 15. Council action: Councilpersons Bridges, Gay, Skelton*, Westergren and Mayor Cline brought items to Council's attention. Councilperson Gay requested an executive session on a legal matter. 16. Council adjourned into executive session at 8:33 P.M. and returned to the Council table at 9:17 P.M. 17. There being no further business to come before the Council, the meeting was adjourned at 9:17 P.M. Vtiicg.cn.ca C tine, ayo~. ~i • • EMPLOYEE_OF THE QUARTER - CURTIS HERROD Curtis Herrod is the Leadman of the Water/Wastewater Tap Crew. He exerts the leadership required of a Leadman in a professional manner, to the extent that his crew requires little foreman supervision. Curtis works with individual customers and companies to ensure that the tap installation meets the customer's needs and yet is cost effective to the City. Numerous verbal customer compliments on work done by Curtis and his crew have been received. Curtis has been efficient in planning and installing the taps, resulting in a great cost savings to the City. But, more importantly, the customer good will generated is of incalculable worth to the City. We are proud to have Curtis Herrod as an employee, and extend congratulations to him as Employee of the Quarter. • •• • !"_ NOTICE of CITIZENS PARTICIPATION MEETING To discuss and receive input on the City of La Porters FY 1985 Community Development Elock Grant Project Proposal(s). The meeting shall be held on Wednesday March 6, 1985, at 6 p.m. in the City of La Porte Council Chambers, 60~ West Fairmont Parkway, La Porte, Texas. • ORDINANCE NO. 1254- AN ORDINANCE AMENDING ORDINANCE NO. 1254, COMMONLY REFERRED TO AS CITY OF LA PORTE ELECTRICAL CODE, THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PROVIDING FOR THE ISSUANCE OF A LICENSE AND PERMIT BOND; PROVIDING FOR THE ADOPTION OF THE 1984 VERSION OF THE NATIONAL ELECTRIC CODE; ALTERING REQUIREMENTS FOR EMPLOY- MENT OF MASTER ELECTRICIANS; ALTERING THE SCHEDULE OF FEES FOR INSPECTION; ALTERING REQUIREMENTS FOR FLEXIBLE CONDUITS; ALTER- ING REQUIREMENTS FOR SERVICE DISCONNECTIONS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAWS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL NE GUILTY OF A MISDEMEANOR AND OPON CONVICTION THEREOF SHALL BE FINED IN ANY SUM NOT MORE THAN $200.00; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The Electric Code of the City of La Porte, Ordinance No. 1254, Part 1., Section 1.20, the Code of Ordinances City of La Porte, Texas, is hereby amended to read as follow, to-wit: 1.20 Insurance Requirements. No permit shall be issued until the master or maintenance electrician or his employer shall have arranged to carry the following insurance: (a) Workers compensation insurance on each and every one of his employees and this insurance shall be in accordance with the provisions of the Workers Compensation Act of the State of Texas; (b) Public liability insurance to the extent of $50,000.00 for any one accident and S100,000.00 for any person; (c) Property damamge insurance to the extent of 510,000.00 for any one accident and $100,000.00 in the aggregate; and (d) At the time of making an application for a permit under this Code, either the master or maintenance electrician or his employer shall have arranged for and shall file with the building official sufficient proof that said master or maintenance elec- trician or his employer shall have a license and permit bond, in the principal amount of 55,000.00, specifically conditioned upon the fact that the principal if granted a permit, will accomplish the work described in said permit in strict accor- dance with the terms of this Code, and of the National Electric Code, and will pay to the City any expense or damage incurred ~l • ORDINANCE 1254-B -2- • by it in correcting deficiencies in said work, said deficiencies being defined under the terms of this Ordinance and the National Electric Code. Such insurance shall be written by an accredited company under the supervision of the Board of Insurance Commissioners of the State of Texas. Evidence of compliance with the above insurance requirements shall be considered as having been met when the policy, or copy thereof, or certificate of insurance has been filed with and approved by the Electric Board. Such policy shall include an endorsement thereon that the Electrical Board will be notified at least fifteen (15) days in advance in the event of the policy or policies being cancelled or expiring before the expiration date of the license. Section 2. The Electric Code of the City of La Porte, Ordinance No. 1254, Part l., Section 1.30 of the Code of Ordiances of the City of La Porte, Texas, is hereby amended to read as follows, to-wit: 1.30 Adoption of National Electric Code. The regulations and rules of the National Board of Fire Underwriters embodied in the National Electric Code, 1984 version, are hereby adopted as the rules and regulations to govern and to be observed and followed in all electric wiring and in all electrical con- struction, installation, repair, alteration, operation and main- tenance of electric wiring, apparatus, and fixtures, except in- sofar as they may conflict with the provisions of the City of La Porte Electric Code. In a case of conflict between the pro- visions of the National Electric Code and the provisions of the City of La Porte Electric Code, the provisions of the City of La Porte Electric Code shall prevail. ~~ • • ORDINANCE N0. 1254-B -3- Section 3. The Electric Code of the City of La Porte, Ordinance No. 1254, Part 1., Section 2.13, the Code of Ordinances City of La Porte, Texas, is hereby amended to read as follow, to-wit: B. Master Electrician 2.13 "Bootlegging" Licenses Outlawed (a) Ito master electrician shall assign or in any other way convey his license, the use thereof, or any right thereunder, to anyan.e by power of attorney or any other process, or become invol~ae~3 in any type of agreement, assignment, or use whereby the master electrician will not have supervision, direction and control of the electrical work for which the electrical permit is obtained by the master electrician. (b) A master electrician who is employed as a master elec- trician for a person, firm, or corporation shall take out elec- trical permits only for that person, firm, or corporation, and shall saspervise, direct, and control the electrical work for which the electrical permit is obtained. The term "employee" as used shall be interpreted to mean a full time permanent employee Qaprroximately 40 hours per week), who has been employed by said person, firm, or corporation for a minimum of ninety (90) calendar days. A master electrician who is employed as a master electrician for a person, firm, or corporation, and who is attempting to take out permits for that person, firm, or corporation, shall verify that he has been a full time permanent employee of said person, firm, or corporation, for said minimum ninety (90) day period, said verification to be in the form of an Affidavit of Fact, executed both by the employer, and the employee, stating that the employee is a full time permanent F~ • ORDINANCE NO. 1254-B -4- u employee and has been a full time permanent employee of said person, firm, or corporation for said ninety (90) day minimum period. (c} ~ master electrician who is engaged in the electrical business for himself shall take out electrical permits for his business only and no electrical permit shall be taken out by any master electrician that he does not supervise, direct and control the electrical work for which the permit was obtained. (d} It is hereby intended to prevent a master electrician from securing a permit for the purpose of abating the spirit and intent of this Code by entering into any simulated scheme, transaction or device, whereby electrical work will be done by persons who are not employees of the master electrician, or e:~aployees of his employer. (e} Should any master electrician violate this provision or any of_ the other provisions specifying that the master electrician must direct, supervise and control the work for ~rhich he obtains a permit, his Master Electrician License issued to him under the provisions of this Code shall be revoked by the Electrical Board after notice and hearing. Section 4. The Electric Code of the City of La Porte, Ordinance duo. 1254, Part 1., Section 3.10, the Code of Ordinances City of La Porte, Texas, is hereby amended to read as follow, to-wit: 3.10 Schedule of Fees for Inspection. The Electric Code of the City of La Porte, Ordinance n1o. 1254, Part 2., Section 6.06, the Code of Ordinances City of La Porte, Texas, is hereby amended to read as follow, to-wit: 6.06 Flexibile Conduit. Flexible metallic conduit may be used, provided that said flexible metal conduit meets all specifications of the National Electric Code. Provided, however, that the wiring method of RX/Armour Clad is specifically pro- hibited. ~~ u ORDINANCE NO. 1254-B -6- • Section 6. The Electric Code of the City of La Porte, Ordinance No. 1254, Part 2., Section 6.09, the Code of Ordinances City of La Porte, Texas, is hereby amended to read as follow, to-wit: 6.09 Service Disconnect. Service disconnecting means shall be located so that the hight of center of the operating handles shall be not less than four (4) feet and not more than six (6) feet above the floor of the finish grade, except as installed in free standing or building type switchgear build to NEt~A speci- fications. Section 7. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and suhject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open ~~ieetings Law, Article 6252-17, Texas Revised Civil Stat~.ates Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 8. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reason, he held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared t~ he the intention of. this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, • ORDINANCE NO. 1254-B -7- • sentence, phrase or clause, or part thereof, may be declared invalid. Section 9. .Any person, as defined in Section 1.07(27), Texas Penal Code, who shall violate any provision of the ordinance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars (5200.00). JOERNS, DIRECTOR OF COMMUNITY DEVELOPMENT DATE: RUARY 27, 1985 SUBJECT: RECOMMENDED LIMITS FOR RE-NAMING OF WEST "F" TO MAGNA AND WEST "G" TO FLOW West "F" from 16th to the West right-of-way line of 17th is open but unimproved for thru traffic. It is surfaced and used for parking for the business operating in Block 824. Because the right-of-way is not used for thru traffic, I see no need to force a name change for the one block west of 16th. In fact it might be desirable for the City to contact the owners of Blocks 833 and 824 and suggest a joint application for a street closing since the right-of-way is used for support of the business(es). Therefore, the recommended limits for the changing of West "F" to Magna Street are from the east right-of-way line of 16th to the west right-of-way line of South 12th (approximate location of Little Cedar Bayou). West "G" from 16th west has been closed by Ordinance ~~1017. Therefore, the recommended limits for the changing of West "G" to Flow Street are from the east right-of-way line of 16th to the west right-of-way line of South 11th (approximate location of Little Cedar Bayou). Council may wish to consider the street names to be placed on the signposts in the following manner. Magna Street ("F" Street) Flow Street ("G" Street) This has been used effectively in other communities (i.e. Galveston) and it gives the community and the infrequent traveler the ability to recognize the new street name and not lose sequence on the existing alphabet street pattern. The name of West "F" Street, from the east right- of-way line of South 16th Street to the west right-of-way line of South 12th Street (being the approximate location of Little Cedar Bayou), is hereby changed to Magna Street, and said portion of said public street shall hereafter be known as Magna Street. Section 2. The name of West "G" Street, from the east right- of-way line of South 16th Street to the west right-of-way line of South 11th Street (being the approximate location of Little Cedar Bayou), is hereby changed to Flow Street, and said portion of said public street shall hereafter be known as Flow Street. Section 3. The new street names herein designated shall be placed on street sign posts in the following manner: Magna Street ("F" Street) Flow Street ("G" Street) Section 4. Bidders were required to propose a turnkey price for the installation of commercial grade fencing including a twenty-one foot backstop, 6 foot line fencing, 2-four foot walk gates, a twelve foot drive gate, and complete schedule 40 framing throughout. This fence will be constructed around the newly constructed North Broadway Softball Field. A balance of $46,000 is presently available to fund this project. Low bid meeting specifications was submitted by Houston Fence Co. in the amount of $8,224.00, a completion time of ten days, and a warranty of one year. I recommend the City of La Porte award the installation of the North Broadway Softball Field fencing to Houston Fence Company for the aforementioned amount on the basis of low bid meeting specifications. Ray - Purchasing Agent% i SUBJECT: Sealed Bid 440081 `• Advertised, sealed bids ~/0081 for the purchase of two single media pool filters were opened and read in City Council Chambers February 12, 1985 at 4 p.m. Sealed bids were mailed to eight local and statewide pool equipment distributors with the following three returning bids; (1) Mayfield Pool, (2) Miracle Water Distributors, and (3) Poolquip-Mc Neme. Bidders were asked to submit pricing on two single media, high rate, fully automatic filter systems with a minimum of 27 square feet of filter area. Filters should have a minimum capacity of twenty gallons per minute per square foot of filter media. Successful bidder is required to ship the unit.F.O.B. City of La Porte swimming pool and offload package unit to be installed by Parks Dept. employees under the supervision of the manufacturers representative. Low bid meeting specifications was submitted by Mayfield Pool Co. on an E.P.D. 20I dual tank filter system. Mayfield Pool Co. proposed to ship the filter within 10 days after receipt of order for $10,459.00. They offer a one year warranty and a one-percent (1%) discount if paid in full ten days after receipt. A total of $36,400 is presently appropriated to complete this project. I recommend that the City of La Porte award the purchase of two single- media pool filters to Mayfield Pool Company in the amount of $10,459.00 on the basis of low bid meeting specifications. Low bid was submitted by Fogel Equipment Company for a Fiat Allis FG-85 in the amount of $72,777.00. This unit exceeds all specifications, and comes with an extended two (2) year/5000 hour warranty. Delivery time is 45 days. Budgeted amount is $90,000. I recommend that the City accept low bid for a 150 H.P., diesel powered, articulated motor grader from Fogle Equipment Company in the amount of $72,777.00. This unit exceeds specifica- tions and the manufacturer has included an extended power train warranty of 2 years or 5,000 hours.
