MINUTES OF THE
PUBLIC HEARING AND REGULAR MEETING
LA PORTE CITY COUNCIL
MAY 13, 1985
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Council Present: Mayor Norman Malone,
Councilpersons Delbert Walker, John Lloyd, Ed Matuszak, Betty
Waters, Lindsay Pfeiffer, Deotis Gay, B. Don Skelton, Linda
Westergren
Members of Citv Council Absent: None
Members of Citv Staff Present: City Manager Jack Owen, City
Attorney Knox Askins, City Secretary Cherie Black, Police
Chief Herb Freeman, Director of Parks and Recreation Stan

2. The invocation was given by Councilperson Skelton.
3. Public Hearing - Request of Glenn Tolar to rezone Block 10,
Lots 165-166, Spenwick Place, from Residential to Commercial
to accommodate development of a day care center
The Mayor called the public hearing to order. Mr. Glenn Tolar
was present and reviewed the request for Council.
Questions from Council were answered by Mr. Tolar.
Mayor Malone asked for those wishing to speak in favor of the
rezoning. He then read a letter from Russell French, which
asked questions regarding the rezoning. The Mayor then read a
memo from Chief Building Official David Paulissen with staff
recommendation regarding this location.

Mr. William Franks, representing the child care facility
planning to locate on the property, addressed the questions
from Mr. French's letter and from Council.
The Mayor asked for anyone wishing to speak in opposition to
the rezoning to come forward. There was no response.
The Mayor declared the public hearing closed and requested the
City Secretary to read the recommendation of the Planning and
Zoning Commission. The Planning and Zoning Commission
recommended that the zoning request be approved.
4. Council considered approving the minutes of the public hearing
and regular meeting held April 17, 1985.
Motion was made by Councilperson Skelton to approve the
minutes of April 17 ashresented. Second by Councilperson
Gay. The motion carried, 9 ayes and 0 nays.

Pfeiffer, Gay, Skelton, Westergren and Mayor Malone
Nays: None
5. Council considered approving the minutes of the special called
meeting held April 29, 1985.
Motion was made by Councilperson Waters to approve the minutes
of April 29 as presented. Second by Councilperson Westergren.
The motion carried, 8 ayes, 0 nays, 1 abstain.
Ayes: Councilpersons Walker, Lloyd, Waters, Pfeiffer, Gay,
Skelton, Westergren and Mayor Malone •
Nays: None
Abstain: Councilperson Matuszak (was not present at meeting
of April 29)
Councilperson Matuszak read a statement regarding his
residency in the City. He asked, as a personal priviledge,
for a 10 minute recess to discuss the issue with any
individual who might be present and wished to talk with him.

The Mayor called a 10 minute recess. The meeting reconvened
at 6:30 P.M.
6. Mrs. Marilyn Broussard was scheduled to address Council, but
was unable to be present.
7. Council considered adopting a resolution supporting the La
Porte-Bayshore Chamber of Commerce.
The Mayor called for John Paul Zemanek, Executive
Vice-President of the La Porte-Bayshore Chamber of Commerce to
come forward. The Mayor read Resolution 85-7.
Motion was made by Councilperson Skelton to adopt Resolution
85-7 as read by the Mayor. Second by Councilperson Matuszak.
The motion carried, 9 ayes and 0 nays.

9. Council considered an ordinance rezoning Block 10, lots
165-166, Spenwick Place.
The City Attorney read: ORDINANCE 780-IIII - AN ORDINANCE
AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING
ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE
DATE HEREOF.

10. Council considered an ordinance establishing new sewer rate
and sewer fee structure.
The City Attorney read: ORDINANCE 1441 - AN ORDINANCE
AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND SEWAGE
DISPOSAL," SECTION 26-15, OF THE CODE OF ORDINANCE OF THE CITY
OF LA PORTE; ESTABLISHING A NEW SEWER RATE AND SEWER FEE
STRUCTURE; CONTAINING A SEVERABILITY CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made ~ Coun_cilperson Llovd to adopt Ordinance 1441
as read by the Citv Attornev, substituting a c~ of 10,000
gallons for 15,OOO,~allons where it appears in the ordinance.
Second by Councilperson Walker. The motion carried, 9 ayes

11. Council considered awarding a bid for annual mowing contract.
The City Manager reported that the low bidder meeting specs
was Steve Echols, and that staff recommendation is that the
bid be awarded to him.
Motion was made by Councilperson Westergren that the annual
mowing contract bid be awarded to Steve Echols. Second by
Councilperson Waters. The motion carried, 9 ayes and 0 nays.

Pfeiffer, Gay, Skelton, Westergren and Mayor Maloen

12. Workshop Items:
Discuss speed ordinance for the City of La Porte - A
representative of Traffic Engineers, Inc:, was present and
reviewed the speed .limit study conducted by his staff. After

discussion by Council, it was recommended that parts of the
survey be redone and a report given to Council at a later
date.
Council then discussed the request of containerhouse to close
the alley in Block 437, Town of La Porte. After discussion,
Councilperson Lloyd moved to put this item on another
workshop. The motion was seconded by Councilperson Walker.
After further discussion, Councilperson Walker withdrew his
second and Councilperson Lloyd withdrew his motion.
13. Council considered an ordinance closing the alley in Block
437, Town of La Porte.
The City Attorney read: ORDINANCE 1442 - AN ORDINANCE
VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK
FOUR HUNDRED THIRTY-SEVEN (437), IN THE TOWN OF LA PORTE,
HARRIS COUNTY, TEXAS.
• Motion was made by Councilperson Walker to apt Ordinance
1442 as read by the City Attorney. Second by Councilperson
Matuszak. The motion carried, 8 ayes, 0 nays, 1 abstain.
Ayes: Councilpersons Walker, Lloyd, Matuszak, Waters,
Pfeiffer, Gay, Skelton, and Mayor Malone
Nays: None
Abstain: Councilperson Westergren
14. Administrative Reports:
The City Manager suggested to Council that, since the next
regular meeting falls on the Memorial Day holiday, a special
called meeting be held after the workshop on May 20, to take
care of any items that might be necessary.
15. Council Action: Councilpersons Walker, Matuszak, Waters, Gay,
Skelton, Westergren and Mayor Malone brought items to
Councils attention.
16. Mayor Malone called for an executive session on personnel.
Council adjourned into executive session at 8:12 P.M. and
returned to the Council table at 9:05 P.M.

After returning to the Council table, the Mayor requested the
City to read a letter of commendation and support for the City
Manager, which was signed by the Mayor and all members of
Council.
17. There being no further business, the meeting was duly
adjourned at 9:08 P.M.

The City has received and reviewed a request dated 2/12/85 for
are-zoning from Mr. Glen Tolar on the above described property
REQUEST
hir. Glen Tolar of the Glen Tolar Company has requested a re-zoning of
Block•10, Lots 165 & 166, Spenwick Place. The request is to re-zone
the tract from its temporary "R-1" residential zoning classification
to "C" commercial to allow the construction of a day care center.
This •use is allowable in a "C" zone under the terms of the Zoning
Ordinance. '
ANALYSIS
As you know, this property is in the newly annexed area of Spenwick.
It still maintains its temporary "R-1" zoning classification due to
the annexation and is recommended to•be "R-1" single family in the
proposed master plan. The property lies along the North side of West
Main (Spencer Hwy.) about 200 feet West of Underwood Road. It is
adjoined on the West side by an existing retail strip center that was
built by Mr. Tolar just prior to annexation. It is adjoined on the
East side by a small restaurant. This site is directly across West
Main from the large Safeway shopping center and is surrounded on both
sides by existing commercial. uses. The use is compatible with
existing uses in the area. •
RECOMMENDATION
This request is in keeping with the Planning and Zoning Commissions
policy for the annexed area in that there is a specific use indicated
on the request. The described use is compatible with the area and
would not have a negative impact on the community. Based on these
facts the staff would recommend the granting of is this request to
re-zone the above described property from temporary "R-1" to "C"
commercial to allow the construction of a day care.

RESOLUTION 85-7
WHEREAS, the La Porte-Bayshore Chamber of Commerce has, for
many years, served the community by encouraging the business
growth of the City of La Porte; and
WHEREAS, the Chamber has sponsored and promoted many
activities, such as Sylvan Beach Day, for the benefit and pleasure
of our citizens and surrounding communities; and
WHEREAS, the Chamber continues to be a major force in
striving to attract businesses to locate in our City and in
promoting the City at every opportunity.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE
THAT, the City of La Porte will continue to support the La
Porte-Bayshore Chamber of Commerce in their endeavors for the good
of the City and its citizens.

AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTS
ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN
PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
Section 1. The City Council of the City of La Porte
hereby finds, determines and declares that heretofore, to-wit:
on the 4th day of April, 1985, at 7:00 P. M. , a public hearing
was held before the Planning and Zoning Commission of the City
of La Porte, Texas, pursuant to due notice, to consider the
question of the possible re-classification of the zoning classi-
fication of the hereinafter described parcel of land. There
is attached to this Ordinance as "Exhibit A," and incorporated
by reference herein and made a part hereof for all purposes, a
copy of "Notice of Public Hearing" which the City Council of
the City of La Porte hereby finds was properly mailed to the
owners of all properties located within two hundred feet (200' )
of the properties under consideration.
Section 2. The Publisher's Affidavit of Publication of
notice of said hearing is attached hereto as "Exhibit B,"
incorporated by reference herein and made a part hereof for
all purposes.
Section 3. Subsequent to such public hearing, the City
of La Porte Planning and Zoning Commission met in special
session on April 4, 1985, to consider the Chang es in classi-
f fication which were the subject of such public hearing. The
City Council of the City of La Porte is in receipt of th e
written recommendations of the City of La Porte Planning and
Zoning Commission, by letters dated April 5, 1985, the ori-
ginal of which letter is attached hereto as "Exhibit C," in-
corporated by reference herein, and made a part hereof for all
purposes.

Section 4. On the 13th day of May, 1985, at 6:00 P. M. , a
public hearing was held before the City Council of the City of
La Porte, pursuant to due notice, to consider the question of

herein and made a part hereof for all purposes, a copy of
"Notice of Public Hearing" which the City Council of the City

properties under consideration.
Section 5. The Publisher's Affidavit of Publication of
notice of said public hearing before the City Council of the
City of La Porte is attached hereto as "Exhibit E," incorporated
by reference herein and made a part hereof for all purposes.
Section 6. Subsequent to such public hearing, the City
Council of the City of La Porte reveiwed the written recommenda-
tions of the City of La Porte Planning and Zoning Commission,
and all of the evidence presented before it, and the City Council
of the City of La Porte hereby accepts the recommendation of
the City of La Porte Planning and Zoning Commission, and the
zoning classification of the hereinafter described parcel of
land, situated within the corporate limits of the City of
La Porte, is hereby changed in accordance therewith, and the
zoning classif ication of said parcel of land shall hereafter be
"District C Commercial". The description of said parcel of
land re-zoned is as follows, to-wit:
All of Lots One Hundred Sixty-five (165) and
One Hundred Sixty-six (166), Block 10, of
SPENWICK PLACE, SECTION TWO (2), an addition
in Harris County, Texas, according to the map
or plat thereof recorded in Volume 48, Page 11,
of the Map Records of Harris County, Texas.

recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council

Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the con-
tents and posting thereof.
Section 8. This Ordinance shall be in effect .from and
after its passage and approval.
Section 9. The City Secretary of the City of La Porte is
hereby directed to notify the applicant of the zoning reclassifi-
cation that has been approved by the City Council of the City
of La Porte and is contained herein. Said notification shall
specifically contain the following language:
TO THE APPLICANT:
The application for rezoning you filed with the
City of La Porte has been approved. Take notice,
however, that the City of La Porte is undergoing
a Comprehensive Plan adoption process. This Plan
adoption process includes the possibility that the
entire City of La Porte, specifically including your
property, would be rezoned.
The granting of your application in no way affects
this possible comprehensive rezoning effort by the
City of La Porte, and you should understand that
in order to insure your input as to the future
zoning classification your property might have,
you should attend the public hearings that will
be scheduled.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Sec. 26-15, "Sewer Service Charges," of Article
II, Chapter 26, of the Code of Ordinances of the City of La
Porte is hereby amended, to hereafter read as follows, to-wit:
"Sec. 26-15 - Sewer Service Charges:
(1) Each single-family dwelling unit individually metered for
the consumption of water shall be charged for sanitary
sewer service a basic monthly charge of $4.25, plus 70$
of the "net" water bill; provided, however, for meter
readings from June, through September 30, each single-
family dwelling unit individually metered for the consump-
tion of water shall be charged for sanitary sewer service,

sewer service for that portion of the "net" water bill in

Advertised, sealed bids ~i0092 were opened and read in City Council Chambers
April 8, 1985 at 4 p.m. Bid invitations were mailed to seven area lawn
maintenance firms with the following five returning bids; (1) Tom Hootman,
(2) Goldston Mowing, (3) Sentell Lawn Maintenance, (4) Steve Echols, and
(5) Master's Landscape and Lawn Service.
Bidders were required to submit firm pricing for routinely performing contract
mowing service for the City of La Porte under the direction of the Code Enforce-
ment Division. Pricing was submitted for mowing vacant lots with a brush hog,
mowing undivided acreage and mowing residential homesites.
Low bid was submitted by Steve Echols of La Porte, Texas in the amount of
$8.75 per 25' x 125' lot, $6.75 for each additional contiguous lot, $39.75
per undivided acre, and $15 per residential homesite.
These prices are 3~ to 5% less than prices under the current contract. I hereby
recommend the City of La Porte award the 1985-86 Contract for Mowing Service to
Steve Echols on the basis of low bid meeting specifications.

In March of 1985, the City of La Porte commissioned a speed limit study to be
performed on various thoroughfares within the City. The results of the study
satisfies the requirements of Article 670H, Vernon's Texas Civil Statutes, for
a traffic engineering study to set prima facie speed. The study was performed
by Traffic Engineers, Inc.
Not all streets are included in the study. However, the study looks at all
major thoroughfares, and several minor ones. Streets not listed in the study
or the ordinance will automatically be 30 M.P.H.
The study includes several County roads. Harris County was sent a copy of the
study, and attached is a response from the County Engineer offering no objections.
A representative of Traffic Engineers, Inc. will be present at the Council meeting
to present the results of the study, and answer any questions.

TRAFFIC SPEED STUDY

A traffic speed study was developed by Traffic Engineers, Inc. for the City of La Porte,
which involved twelve City streets. The purpose of the study was to establish speed
limit zones for each of these streets based on the traffic 85th percentile speed. The
study consisted essentially of the collection and analysis of speed data, field inspections,
and the development of recommended speed limits and zones.
Personnel of the City's Public Works Department collected the speed data during the
month of February of 1985, utilizing a police radar unit. From this data, the 85th
percentile speed was computed for every location, as well as statistical parameters
related to the distribution of the data. The results are summarized in tabular form
in the following sections within the report. The Public Works Department also provided
accident records for an accident analysis at the various streets involved in the study.
Data Collection
Data was collected over a two week period during the month of February, 1985. The
speed survey involved the following streets:
1. Spencer (W. Main) -Luella Blvd. to Highway 146
2. Fairmont Parkway -Bay Area Blvd. to Park Street
3. North "L" Street -Underwood to 26th (Sens Rd.)
4. North "P" Street -Underwood to 26th (Sens Rd.)
5. North "H" Street -Lomax School Road to 26th Street (Sens Rd.)
6. Underwood -Highway 225 to Fairmont Parkway
7. 26th Street (Sens Rd.) -Highway 225• to Spencer (W. Main)
8. Myrtle Creek -Underwood to Spencer (W. Main)
9. Driftwood Drive -Spencer (W. Main) to Fairmont Parkway
10. 16th St. -Fairmont Parkway to Barbours Cut
11. Barbours Cut -South 16th St. to North Broadway
12. Park Street -San Jacinto to City Limits (past Blackwell)

At least two locations per street were chosen for speed check, making a total of 26
locations. The radar unit used to detect the speed of vehicles was partially concealed
behind the dashboard of an inconspicuous vehicle, so as not to alert drivers of a radar
check. A total of 125 cars in two directions were surveyed at each location. Only the
speed of regular passenger cars traveling normally in anon-passing fashion, was measured.
At streets that carry heavier traffic, peak hours were avoided in order to exclude lower
speeds due to potential traffic congestion or heavy traffic flow. Where traffic was
light, two hours worth of data was collected instead of 125 vehicles.
Data Analysis
The 85th percentile speed of vehicles passing a given point is the speed at or below
which 85 percent of the vehicles passing the point are traveling [1l. One way to calculate
the 85th percentile speed is to add the tally marks as shown in the cummulative total
column in Figure 1. Eighty-five percent of the total number of vehicles checked is
then computed and the speed of the 85th percentile car is determined. Figure 1 shows
the 85th percentile car circled (106 is 85% of 125). The speed in the same row as the
106th car is the 85th percentile speed. In the figure, it corresponds to 48 miles per
hour.
This procedure was used to compute the 85th percentile speed at each of the 26 locations.
The results are summarized in the first column of Table I. Said table also contains
a sypnosis of statistical analysis parameters derived from the speed data. These
parameters, namely the mean speed, standard deviation, mean variance, mean standard
error and confidence intervals, were calculated using a computer model.

In general, 85th percentile speeds were greater than the observed speed limits; in several
cases, they exceeded the speed limit by five to ten miles per hour. In one instance,
along North H Street, the 8Sth percentile speed exceeded the speed limit by 20 miles
per hour. These reflect the disagreement between posted speed limits and the speed
at which drivers normally travel. An accident analysis did not reflect a high accident
concentration at any particular location.

Recommendations
Two major factors influenced the decision of determining speed zones. The first, of
course, was the computed 85th percentile speed. The second factor was a field inspection
of each street under the study. An emphasis was placed in the field observations; in
most cases, speed limits lower than the 85th percentile speed were chosen because
of street characteristics such as uncontrolled driveway access or narrow pavements.
Also change in horizontal alignment as in the case of Myrtle Creek.
Where there existed a differential of 85th percentile speed between two different
locations within a street segment under consideration, but homogeneous street
characteristics made it possible, a single speed limit was recommended for the entire
length of the segment. Table II is a summary of the, recommended speed limits. A
map outlining the limits of each proposed speed zone is included at the end of this report.
Advisory speed signs were not necessary at any of the streets under the study.

Some existing speed limit signs at approaches to school zones are recommended to remain
unchanged, even though the speeds within the applicable street lengths were not surveyed.
These signs have the function of gradual speed reduction into a school zone.

Existing school zones were given particular attention. The three school zones located
by streets within the study scope had adequate length and were correctly signed under
the standards prescribed by the Texas Manual of Uniform Traffic Control Devices, with
the exception of some school advance signs that were out of their correct location;
such was the case at the Baker Junior High and Lomax Elementary School zones. Figure
2 shows the correct placement of this sign, which is in advance of the school zone.
The recommended speed limits are within a frame of existing conditions. Future
development along the streets of the City of La Porte will make it necessary to revise
these speed limits as conditions change and urban growth continues.
The efficient participation of the Public Works Department personnel during the data
collection phase of the study was appreciated.

AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY
IN BLOCK FOUR HUNDRED THIRTY-SEVEN (437), IN THE TOWN OF LA PORTS,
HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block Four Hundred Thirty-
Seven (437) of the Town of La Porte has never been opened or
used as a public thoroughfare, and the public utilities now
making use of such alley have all given their written consent
for its closing; and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare that
the said alley is not suitable, needed, or beneficial to the
public as a public alley, and should be vacated, abandoned and
permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTS:
Section 1. The alley located in Block Four Hundred Thirty-
Seven (437) of the TOWN OF LA PORTS, Harris County, Texas, is
hereby permanently vacated, abandoned and closed by the City
of La Porte.
Section 2. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting
