The meeting was called to order by Mayor Malone at 6:00 P.M. Members of City Council Present: Mayor Norman Malone, Councilpersons Delbert Walker, John Lloyd, Ed Matuszak, Betty Waters, Lindsay Pfeiffer, Deotis Gay, B. Don Skelton, Linda Westergren Members of Citv Council Absent: None Members of Citv Staff Present: City Manager Jack Owen, City Attorney Knox Askins, City Secretary Cherie Black, Police Chief Herb Freeman, Director of Parks and Recreation Stan Sherwood, Chief Building Official David Paulissen, Director~of • Public Works Jerry Hodge, Assistant Director of Public Works Steve Gillett Others Present: John Paul Zemanek, La Porte-Bayshore Chamber of Commerce; Sammy Jacobs, La Porte police officer; James Gee, Disabled American Veterans; Paul Felgner; Pam Smith, Bayshore Sun; Allan Kimball, Houston Post; approximately 30 citizens 2. The invocation was given by Councilperson Skelton. 3. Public Hearing - Request of Glenn Tolar to rezone Block 10, Lots 165-166, Spenwick Place, from Residential to Commercial to accommodate development of a day care center The Mayor called the public hearing to order. Mr. Glenn Tolar was present and reviewed the request for Council. Questions from Council were answered by Mr. Tolar. Mayor Malone asked for those wishing to speak in favor of the rezoning. He then read a letter from Russell French, which asked questions regarding the rezoning. The Mayor then read a memo from Chief Building Official David Paulissen with staff recommendation regarding this location. • I • Minutes, Public Hearing and Regular Meeting La Porte City Council May 13, 1985, Page 2 Mr. William Franks, representing the child care facility planning to locate on the property, addressed the questions from Mr. French's letter and from Council. The Mayor asked for anyone wishing to speak in opposition to the rezoning to come forward. There was no response. The Mayor declared the public hearing closed and requested the City Secretary to read the recommendation of the Planning and Zoning Commission. The Planning and Zoning Commission recommended that the zoning request be approved. 4. Council considered approving the minutes of the public hearing and regular meeting held April 17, 1985. Motion was made by Councilperson Skelton to approve the minutes of April 17 ashresented. Second by Councilperson Gay. The motion carried, 9 ayes and 0 nays. • Ayes: Councilpersons Walker, Lloyd, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Malone Nays: None 5. Council considered approving the minutes of the special called meeting held April 29, 1985. Motion was made by Councilperson Waters to approve the minutes of April 29 as presented. Second by Councilperson Westergren. The motion carried, 8 ayes, 0 nays, 1 abstain. Ayes: Councilpersons Walker, Lloyd, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Malone • Nays: None Abstain: Councilperson Matuszak (was not present at meeting of April 29) Councilperson Matuszak read a statement regarding his residency in the City. The meeting reconvened at 6:30 P.M. 6. Mrs. Marilyn Broussard was scheduled to address Council, but was unable to be present. 7. Council considered adopting a resolution supporting the La Porte-Bayshore Chamber of Commerce. The Mayor called for John Paul Zemanek, Executive Vice-President of the La Porte-Bayshore Chamber of Commerce to come forward. The Mayor read Resolution 85-7. Motion was made by Councilperson Skelton to adopt Resolution 85-7 as read by the Mayor. Second by Councilperson Matuszak. The motion carried, 9 ayes and 0 nays. • Ayes: Councilpersons Walker, Lloyd, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Malone Nays: None 8. The Mayor read the following proclamations: Police Week - Accepted by Chief Herb Freeman and Sammy Jacobs National Public Works Week - Accepted by Jerry Hodge & Steve Gillett La Porte Night at the Astrodome - Accepted by Stan Sherwood Disabled American Veterans Month - Accepted by James Gee and Several members of the DAV 9. Council considered an ordinance rezoning Block 10, lots 165-166, Spenwick Place. The City Attorney read: ORDINANCE 780-IIII - AN ORDINANCE AMENDING ORDINANCE N0. 780, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF. /OU_1111 as reaa Qv Lne city Attornev. Council considered an ordinance establishing new sewer rate and sewer fee structure. The City Attorney read: ORDINANCE 1441 - AN ORDINANCE AMENDING CHAPTER 26, ARTICLE II, "WATER, SEWERS AND SEWAGE DISPOSAL," SECTION 26-15, OF THE CODE OF ORDINANCE OF THE CITY OF LA PORTE; ESTABLISHING A NEW SEWER RATE AND SEWER FEE STRUCTURE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made ~ Coun_cilperson Llovd to adopt Ordinance 1441 as read by the Citv Attornev, substituting a c~ of 10,000 gallons for 15,OOO,~allons where it appears in the ordinance. Second by Councilperson Walker. The motion carried, 9 ayes • and 0 nays. Ayes: Councilpersons Walker, Lloyd, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Malone Nays: None 11. Council considered awarding a bid for annual mowing contract. The City Manager reported that the low bidder meeting specs was Steve Echols, and that staff recommendation is that the bid be awarded to him. Motion was made by Councilperson Westergren that the annual mowing contract bid be awarded to Steve Echols. Second by Councilperson Waters. The motion carried, 9 ayes and 0 nays. Ayes: Councilpersons Walker, Lloyd, Matuszak, Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Maloen Nays: None 12. Workshop Items: Discuss speed ordinance for the City of La Porte - A representative of Traffic Engineers, Inc:, was present and reviewed the speed .limit study conducted by his staff. Council then discussed the request of containerhouse to close the alley in Block 437, Town of La Porte. After discussion, Councilperson Lloyd moved to put this item on another workshop. The motion was seconded by Councilperson Walker. After further discussion, Councilperson Walker withdrew his second and Councilperson Lloyd withdrew his motion. 13. Council considered an ordinance closing the alley in Block 437, Town of La Porte. The City Attorney read: ORDINANCE 1442 - AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY IN BLOCK FOUR HUNDRED THIRTY-SEVEN (437), IN THE TOWN OF LA PORTE, HARRIS COUNTY, TEXAS. • Motion was made by Councilperson Walker to apt Ordinance 1442 as read by the City Attorney. Second by Councilperson Matuszak. The motion carried, 8 ayes, 0 nays, 1 abstain. Ayes: Councilpersons Walker, Lloyd, Matuszak, Waters, Pfeiffer, Gay, Skelton, and Mayor Malone Nays: None Abstain: Councilperson Westergren 14. Administrative Reports: The City Manager suggested to Council that, since the next regular meeting falls on the Memorial Day holiday, a special called meeting be held after the workshop on May 20, to take care of any items that might be necessary. 15. Council Action: Councilpersons Walker, Matuszak, Waters, Gay, Skelton, Westergren and Mayor Malone brought items to Councils attention. 16. Mayor Malone called for an executive session on personnel. Glen Tolar of the Glen Tolar Company has requested a re-zoning of Block•10, Lots 165 & 166, Spenwick Place. The request is to re-zone the tract from its temporary "R-1" residential zoning classification to "C" commercial to allow the construction of a day care center. This •use is allowable in a "C" zone under the terms of the Zoning Ordinance. ' ANALYSIS As you know, this property is in the newly annexed area of Spenwick. It still maintains its temporary "R-1" zoning classification due to the annexation and is recommended to•be "R-1" single family in the proposed master plan. The property lies along the North side of West Main (Spencer Hwy.) about 200 feet West of Underwood Road. It is adjoined on the West side by an existing retail strip center that was built by Mr. Tolar just prior to annexation. It is adjoined on the East side by a small restaurant. This site is directly across West Main from the large Safeway shopping center and is surrounded on both sides by existing commercial. uses. The use is compatible with existing uses in the area. • RECOMMENDATION This request is in keeping with the Planning and Zoning Commissions policy for the annexed area in that there is a specific use indicated on the request. The described use is compatible with the area and would not have a negative impact on the community. Based on these facts the staff would recommend the granting of is this request to re-zone the above described property from temporary "R-1" to "C" commercial to allow the construction of a day care. 1 • • RESOLUTION 85-7 WHEREAS, the La Porte-Bayshore Chamber of Commerce has, for many years, served the community by encouraging the business growth of the City of La Porte; and WHEREAS, the Chamber has sponsored and promoted many activities, such as Sylvan Beach Day, for the benefit and pleasure of our citizens and surrounding communities; and WHEREAS, the Chamber continues to be a major force in striving to attract businesses to locate in our City and in promoting the City at every opportunity. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE THAT, the City of La Porte will continue to support the La Porte-Bayshore Chamber of Commerce in their endeavors for the good of the City and its citizens. The study was performed by Traffic Engineers, Inc. Not all streets are included in the study. However, the study looks at all major thoroughfares, and several minor ones. Streets not listed in the study or the ordinance will automatically be 30 M.P.H. The study includes several County roads. Harris County was sent a copy of the study, and attached is a response from the County Engineer offering no objections. The purpose of the study was to establish speed limit zones for each of these streets based on the traffic 85th percentile speed. The study consisted essentially of the collection and analysis of speed data, field inspections, and the development of recommended speed limits and zones. Personnel of the City's Public Works Department collected the speed data during the month of February of 1985, utilizing a police radar unit. From this data, the 85th percentile speed was computed for every location, as well as statistical parameters related to the distribution of the data. The results are summarized in tabular form in the following sections within the report. The Public Works Department also provided accident records for an accident analysis at the various streets involved in the study. Data Collection Data was collected over a two week period during the month of February, 1985. The speed survey involved the following streets: 1. Spencer (W. Main) -Luella Blvd. to Highway 146 2. Fairmont Parkway -Bay Area Blvd. to Park Street 3. North "L" Street -Underwood to 26th (Sens Rd.) 4. North "P" Street -Underwood to 26th (Sens Rd.) 5. The radar unit used to detect the speed of vehicles was partially concealed behind the dashboard of an inconspicuous vehicle, so as not to alert drivers of a radar check. A total of 125 cars in two directions were surveyed at each location. Only the speed of regular passenger cars traveling normally in anon-passing fashion, was measured. At streets that carry heavier traffic, peak hours were avoided in order to exclude lower speeds due to potential traffic congestion or heavy traffic flow. Where traffic was light, two hours worth of data was collected instead of 125 vehicles. Data Analysis The 85th percentile speed of vehicles passing a given point is the speed at or below which 85 percent of the vehicles passing the point are traveling [1l. One way to calculate the 85th percentile speed is to add the tally marks as shown in the cummulative total column in Figure 1. Eighty-five percent of the total number of vehicles checked is then computed and the speed of the 85th percentile car is determined. Figure 1 shows the 85th percentile car circled (106 is 85% of 125). The speed in the same row as the 106th car is the 85th percentile speed. In the figure, it corresponds to 48 miles per hour. This procedure was used to compute the 85th percentile speed at each of the 26 locations. The results are summarized in the first column of Table I. Said table also contains a sypnosis of statistical analysis parameters derived from the speed data. These parameters, namely the mean speed, standard deviation, mean variance, mean standard error and confidence intervals, were calculated using a computer model. In one instance, along North H Street, the 8Sth percentile speed exceeded the speed limit by 20 miles per hour. These reflect the disagreement between posted speed limits and the speed at which drivers normally travel. An accident analysis did not reflect a high accident concentration at any particular location. TRAFFIC ENGINEERS. INC. • • Recommendations Two major factors influenced the decision of determining speed zones. The first, of course, was the computed 85th percentile speed. The second factor was a field inspection of each street under the study. An emphasis was placed in the field observations; in most cases, speed limits lower than the 85th percentile speed were chosen because of street characteristics such as uncontrolled driveway access or narrow pavements. Also change in horizontal alignment as in the case of Myrtle Creek. Where there existed a differential of 85th percentile speed between two different locations within a street segment under consideration, but homogeneous street characteristics made it possible, a single speed limit was recommended for the entire length of the segment. Table II is a summary of the, recommended speed limits. A map outlining the limits of each proposed speed zone is included at the end of this report. Advisory speed signs were not necessary at any of the streets under the study. i- i Some existing speed limit signs at approaches to school zones are recommended to remain unchanged, even though the speeds within the applicable street lengths were not surveyed. The three school zones located by streets within the study scope had adequate length and were correctly signed under the standards prescribed by the Texas Manual of Uniform Traffic Control Devices, with the exception of some school advance signs that were out of their correct location; such was the case at the Baker Junior High and Lomax Elementary School zones. Figure 2 shows the correct placement of this sign, which is in advance of the school zone. The recommended speed limits are within a frame of existing conditions. Future development along the streets of the City of La Porte will make it necessary to revise these speed limits as conditions change and urban growth continues.
