SPECIAL CALLED MEETING OF THE
LA PORTE CITY COUNCIL
JULY 29, 1985
1. The meeting was called to order by Mayor Malone at 6:00 P.M.

2. Mayor Malone called an executive session on Personnel and

3. Council considered an ordinance ratifying the appointment of a
Police Chief.
The City Attorney read a letter from the City Manager
regarding the appointment (a copy is attached as an official
part of these minutes). The City Attorney then read:
ORDINANCE 1451 - AN ORDINANCE CONFIRMING THE APPOINTMENT OF A
CHIEF OF POLICE BY THE CITY MANAGER OF THE CITY OF LA PORTE;
FINDING IN COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.

Nays: None
The Mayor then introduced Chief Smith to the audience.

Walker. The motion carried, 9 ayes and 0 nays.

Council then went into executive session, at 6:54 P.M., on a
legal matter. They returned to the Council table at 7:33 P.M.
4. Council considered bids on trunk sewer across Highway 146 at
"K" Street.

5. Council considered taking proposals on casing for trunk sewer
across Highway 146 at "K" Street and proposals for
installation of such casings.

Dear Ladies and Gentlemen:
Pursuant to the provisions of Article 1269(m) revised Civil
Statutes, and pursuant to the provisions of the City Charter of
the City of La Porte, I hereby appoint, and submit to you for
your confirmation, as Chief of Police of the City of La Porte,
effective August 15, 1985, Mr. Charles E. Smith.
Mr. Smith is a twelve-year veteran of the City of Orange Police
Department and holds a Bachelor of Science degree in Criminal
Justice from the Lamar University. Mr. Smith was interviewed
by a panel consisting of:
Henry Ramirez - PPG Plant Manager
Robert Swanagan - Mobay Personnel Dept.
Jack Reynolds - Associate Executive Director of
the Texas State Bar Association
Mike Herbst - Chief of Police, University of
Houston - Clear Lake
Jerry Hayden - Champion Paper Co. Personnel Dept.
He was unanimously recommended by the Committee for the
position of Police Chief, and I concur in their evaluation and
recommendation.

ORDINANCE N0. 1451
AN ORDINANCE CONFIRMING THE APPOINTMENT OF A CHIEF OF POLICE BY
THE CITY MANAGER OF THE CITY OF LA PORTE; FINDING IN COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte is in
receipt of a letter from the City Manager of the City of La
porte, who is the Chief Executive Officer of the City of La
Porte, dated the 29th day of July, 1985, a copy of which is
attached hereto as Exhibit "A", incorporated by reference
herein, and made a part hereof for all purposes, appointing
Charles E. Smith as Chief of Police of the City of La
Porte, effective August 15, 1985.
Section 2. Pursuant to the provisions of Article 1269(m),
Revised Civil Statutes, the City Council of the City of La
Porte hereby confirms the appointment of Charles E. Smith
as Chief of Police of the City of La Porte effective August
15, 1985.
Section The City Council officially finds, determines,
recites and declares that a sufficient written notice of
the date, hour, place and subject of this meeting of the
City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings
Law, Article 6252-17, Texas Revised Civil Statutes
Annotated; and that this meeting has been open to the
public as required by law at all times during which this
ordinance and the subject matter thereof has been
discussed, considered and formally acted upon. The City
Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.

Turner Collie & Braden Project No. 13-02000-032
Gentlemen:
Sealed bids, addressed to the City of La Porte, were received
at City Hall, La Porte, Texas on July 24, 1985. Bids received
are as shown on the attached Bid Tabulation. Please note that
two of the three bidders qualified their proposal, indicating
a construction time in excess of the specified time.
After tabulation and review of all bids received, and since
construction time is critical, it is our recommendation that
the project be awarded on the basis of the lowest bid without
qualifications, in the amount of $194,995.00. No substitutions
were offered, therefore the Contract Amount will be $194,995.00.

DATE: July 26, 1985
SUBJECT: Possible Installation of Casing Across Highway 146
The Staff and Turner Collie and Braden are investigating the
availability of casing to cross Highway 146. If such casing is
readily available, another course of action is possible. The
Council could then authorize emergency proposals for the casing
and emergency proposals for the installation of the casing from
the three bidders that bid on the installation of the concrete
pipe.
By installing the casing, it is possible to provide for the
future installation of two types of sewer pipe that are more
resistant to the effects of hydrogen sulfide generated by
sewage.
We hope to have more complete answers concerning this
possibility by Monday afternoon. If this course looks
advantageous, we would recommend that the present bids be held
until the new proposals were received.
