PUBLIC HEARINGS AND REGULAR MEETING
LA PORTE CITY COUNCIL
AUGUST 12, 1985
1. The meeting was called to order by Mayor Malone at 6:00 P.M.

2. The invocation was given by City Attorney Askins.
3. Public Hearing - request to allow duplex in R-2 zone - Block
983, N. 1/2 of lot 25 and all of lots 26-28.
Mayor Malone called the public hearing to order, and asked for
anyone wishing to speak in favor of the request to come
forward. There was no response. He then asked for anyone
wishing to speak in opposition to the request to come forward.
Again, there was no response.
Chief Building Official addressed Council regarding this
request, since the applicant, Ms. Margaret Conner, is out of
state.

The Mayor declared the public hearing closed, and asked the
City Secretary to read the recommendation of the Planning and
Zoning Commission. The City Secretary read the
recommendation, which was to allow the duplex to be placed in
an R-2 zone.
4. The Mayor called the public hearing on the proposed use of
revenue sharing funds to order. The Mayor requested input
from the public regarding these proposed funds.
Mr. Buford Leonard, representing the Veterans of Foreign Wars,
requested approximately $1,500 in funds to purchase flags and
flagpoles for La Porte cemeteries.
Mr. John Paul Zemanek, representing the Chamber of Commerce,
requested $20,000 for a controlled fund to be used to attract
bigger and better industries and businesses to the La Porte
area.
Councilperson Gay, acting at the request of the La Porte
Community Civic Club, requested funds to purchase land across
the street from the North Broadway baseball field in order to
place existing playground equipment there. He felt that this
would alleviate the problem of small children being injured
while playing on the equipment while a ball game was in
progress. The Community Civic Club also requested that a room
be added to the Jennie Riley Community Center in order that
banquets and similar activities could be held without having
to move equipment and such out of the main room of the Center.
A piano and a television set were also requested for the
Center.
There being no further input, the Mayor declared the public
hearing on revenue sharing funds closed.
5. Council considered approving the minutes of the regular
meeting held July 22, 1985.
Motion was_made by Councilperson Waters that the minutes of
the July 22 meeting be approved as presented. Second by
Councilperson Pfeiffer. The motion carried, 9 ayes and 0
nays.

6. Council considered approving the minutes of the emergency
called meeting held July 25, 1985.

7. Council considered approving the minutes of the special called
council meeting held July 29, 1985.
Motion was made by Councilperson Lloyd to approve the minutes

Pfeiffer. The motion carried, 9 ayes and 0 nays.

8. Council considered approving the minutes of the special called
meeting held August 5, 1985.
Motion was made by Councilperson S~glton to approve the
minutes of the August 5 meeting as presented. Second by
Councilperson Gay. The motion carried, 9 ayes and 0 nays.

9. Mayor Malone proclaimed August 17, 1985, as Volunteer
Firefighters Recognition Day. Councilperson Walker presented
the proclamation to volunteer fireman Keith Walker.
10. Special presentations were made by Mayor Malone to the

A. A plaque of appreciation to Doug Latimer, former chairman
of the Planning and Zoning Commission, for his contributions
to the City in that capacity.
B. A meritorious achievement award to Bob Bishop for his
heroic efforts to revive an accident victim.
C. A meritorious achievement award to Charles '~Tim~~ Hargrave
for his heroic efforts in leading three children to safety
during a fire.
D. The Employee of the Quarter award to Cynthia Alexander of
the Finance Department, for her outstanding contributions of
service to the City.
Council then considered item 18, due to the bond consultants
having another meeting they needed to attend.
Council considered setting a date for sale of five million
dollars in general obligation bonds and six million dollars in
revenue bonds.
Motion was made by Councilperson Waters to authorize the City
Manager and the bond consultant~~~yid Egtzgt, to set a date
for the last two weeks in September for the bond sale, to
coineisl~-w~~h_~sla1<e__that_ would be to the best interest of the
Citv. Second by Councilperson Skelton. The motion carried, 9
ayes and 0 nays.

11. The regular order of the agenda was then continued. There
were no petitions, remonstrances, communications, or citizens

13• Council considered approving a list of dangerous buildings.
Building Inspector Mark Lewis presented a list of dangerous
buildings as determined by the Board of Inspections. He
presented slides showing the condition of each of the
structures.
Motion was made by Councilperson Waters to approve the list of
dangerous buildings and to set September 9, 1985, as a public
hearing date for owners to appear before CQ~ancil. Second by
Councilperson Gay. The motion carried, 9 ayes and 0 nays.

14. Council considered declaring an emergency and approving
expenditure of funds for emergency repairs to lift station ~~6.
Motion was made by Councilperson Westergren to declare an
emergency and approve the expenditure of $x,761.15 for
~merggt~cy repairs to lift station #6. Second by Councilperson
Skelton. The motion carried, 9 ayes and 0 nays.

15. Council considered approving a proposal for inspection of
water storage facilities.
Motion was made by Councilperson Westergren to approve the
proposal of Donald Graesser, P.E.,.for inspec~~QD of water
storage facilities. Second by Councilperson Pfeiffer. The
motion carried, 9 ayes and 0 nays.

16. Council considered awarding a bid for flooring and carpet at
the Police Administration building.
Assistant City Manager apprised Council that the Police
Department is under a mandate from the state to provide a
separate juvenile holding room. He stated that if flooring
and carpet were installed in the Administration building at
this time, they might have to be removed in order to move
walls, etc., to rearrange accommodations to include the
juvenile holding room. Significant structural renovation will
be required to do this.
Motion was made by Councilperson Skelton to table this item
until it is known where the rooms would be located. The
motion died for lack of a second.
r(otion was made by Councilperson Westergren to reject all bids
for flooring and carpet for the Police Administration
building. Second by Councilperson Matuszak. The motion
carried, 8 ayes and 0 nays. Councilperson Gay was away from
the Council table during the vote.

17. Council considered approving Change Order 4~1 to City of La
Porte Project 84-5002, Police and Fire Station parking lots.
Motion was made by Councilperson Gay to approve Change Order
~1 to City of La Portg project 84-5002. Second by
Councilperson Skelton. The motion carried, 9 ayes and 0 nays.

18. Council had considered this item earlier in the meeting.
19. Council considered approving a permit from the Houston Port
Authority to install utilities on Houston Port Authority
property.
Motion was made_by Councilperson Walker to approve the permit
from the Houston Port Authority,, in the amount of $6,787.50,,
to install utilities on their property. Second by
Councilperson Waters. The motion carried, 9 ayes and 0 nays.

20. Workshop Items
A. Council discussed an ordinance regarding street and alley
closings. After discussion, ID.otion was made by Councilperson
]dalker to charge 50X of the appraised value for street and
allev closings. Second by Councilperson Westergren.
Councilperson Skelton requested that this item be tagged to
~he_next workshoF meeting, therefore, no vote was taken.
B. Council discussed bids for a trailer mounted man-lift.
After discussion, Councilperson ~T~~~er requested that this
item be tagged to the next regular meeting in order to find
h-ow much the City has spent in the past year in maintenance
costs on traffic signals.
C. The proposed redistricting maps were presented. Mayor
Malone introduced members of the Redistricting Committee who
were in the audience. Andy Wilson, chairman of the
Redistricting Committee, gave a synopsis of how the Committee
arrived at their conclusions in drawing up the redistricting
maps. He presented several maps for Council's study.
21. Council was to consider awarding a bid for trailer mounted
man-lift, but this item had been tagged under item B of the
Workshop items.

22. Council considered setting a public hearing date regarding
redistricting.
Motion was made by Councilperson Matuszak to table this item
to tie next workshop for further study of the maps. Second by
Councilperson Gay. The motion carried, 8 ayes and 1 nays.
Ayes: Councilpersons Lloyd, Matuszak, Waters, Pfeiffer, Gay,
Skelton, Westergren and Mayor Malone
Nays: Councilperson Walker
23. Administrative Reports - City Manager Owen reminded Council of
the budget workshops scheduled for August 13, 14 and possibly
the 19th
24. Council Action - Councilpersons Walker, Lloyd, Matuszak,
Waters, Pfeiffer, Gay, Skelton, Westergren and Mayor Malone
brought items to Councilts attention. Councilperson Lloyd
re9uested an executive session on personnel.
25. Council adjourned into executive session at 7:58 P.M. under
V.A.T.S., Article 6252-17, Section 2(G) (Personnel) and
returned to the Council table at 9:15 P.M.
26. There being no further business to come before the Council,
the meeting was duly adjourned at 9:15 P.M.

SUBJECT: DUPLEX ZONING BLK. 983 N1/2 LT 25, ALL LT 26,27,28, L.P.
The City has received a request from Mrs. Margaret Conner to allow the
conversion of a single family home in a "R-2" district to a duplex.
HISTORY
The site in question is located Idorth of Main Street on N. Holmes.
The home is surrounded on all sides by single family dwellings. This
home was damaged by fire and will require extensive remodeling before
it could be occupied. Since remodeling is required, firs. Conners
wishes to convert the home into a duplex. The Zoning Ord, requires
that duplexes in a "R-2" zone contain at least 850 sq. ft. per unit.
This request proposes 1100 sq. ft. per unit. The home presently
contains two (2) kitchens and two (2) full baths.
ANALYSIS
The zone in which this home is located is called a single family
dwelling and duplex district. Prior to August of 1970 a duplex was an
allowable use within a "R-2" zoning district. The Zoning Ordinance
was amended in 1970 ~to require notice and public hearings (see
amendment 780-G attached). The current ordinance requires that a
duplex go through essentially a re-zoning process from its current
status to "duplex". The ordinance now requires that notice and public
hearing be•completed and, as with a true re-zoning, council must make
the final determination. Duplexes in and of themselves are
traditionally compatible with single family homes. Pdo negative impact
is expected on the surrounding area. The site now contains two (2) on
site parking spaces, as required by ordinance, so parking will not be
a problem.
RECOMMENDATION
Plans submitted by Ms. Conner indicate that the structure can be
remodeled to meet the requirements of the zoning ordinance and
building codes. Based on the above information the staff sees no
problem with the granting of duplex zoning for the site in question.

AN ORDINANCE AMENDING ORDINANCE NO. 780, THE CITY OF LA PORTE
ZONING ORDINANCE, PASSED AND APPROVED ON FEBRUARY 5, 1968, AND
PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The City Commission of the City of La Porte and
the City of La Porte Planning and Zoning Commission have hereto-
fore called, and have held, a Joint Public Hearing on August 17,
1970, to consider amending the City of La Porte Zoning Ordinance,
Ordinance No. 780, so that Section 13-201, Sub-paragraph (2),
shall hereafter read as follows, to-wit:
"(2) Duplexes, upon petition of the property owner
and after notice and public hearing thereon as

provided in Article Seventeen hereof."
Section 2. Following such Joint Public Hearing, the
City Planning and Zoning Commission has met in executive
session, and has issued its final report, which is attached
hereto as Exhibit A, incorporated by reference herein, and made
a part hereof for all purposes, finally recommending such amend-
ment to Ordinance No. 780.
Section 3. Section 13-201, Sub-paragraph (2), is hereby

amended, and shall hereafter read as follows, to-wit:
"SECTION 13-200 'R-1' SINGLE-FAMILY DWELLING AND DUPLEX DISTRICT
REGULATIONS
"13-201 (2) Duplexes, upon petition of the property owner
and after notice and public hearing thereon as
provided in Article Seventeen hereof."
Section 4. This Ordinance shall be effective immediately
upon its passage and approval.

On July 10, 1985, solid waste employee Bob Bishop was
returning from the landfill when he witnessed an accident
involving a tractor trailer and a passenger car. The vehicle
began to burn, and after reporting the information to authorities
via radio, Mr. Bishop and another witness pulled a man from the
burning car and began CPR on the victim until paramedics arrived.

Charles "Tim" Hargrave was on his regular route with the
solid waste department on August 5, 1985, when he noticed flames
coming from a garage apartment on South Brownell Street. The
building was close to the house, and when he saw a little girl
come out of the house, he went inside and found two other children
asleep. He woke them, and led all three children to safety.

SUBJECT: Performance of Cynthia Alexander
The City of La Porte owes a great deal to Cynthia Alexander for
her excellent and unselfish performance through a period of
radical change in the Finance Division. In February, the
Director of Administrative Services and the Finance Officer left
the City of La Porte. The burden for all financial matters fell
to Nell Lange, Senior Acountant.
Cynthia stepped in to assist Ms. Lange by taking on as much as
she could of the senior accountants day-to-day activities.
Cynthia worked a great deal of overtime during this period both
evenings and on weekends.
In May the situation became more difficult when Nell Lange left
and even more fell on Ms. Alexander to perform. She was able to
meet this difficult period in a very capable fashion. She
continued to perform her payroll tasks efficiently and
streamlined the processing of the bi-weekly pay system. This
allowed her to provide additional time to accounting areas
previously controlled by the Senior Accountant.
Cynthia later assisted in the orientation of the new Senior

It is the unanimous opinion of this Inspection Board, after using City of La Porte
Ordinance ~~ 1060 (Standard Housing Code, 1976 Edition) as it guide in making the
inspection, that this building is in fact dangerous, but still repairable. All
repairs or alterations required to be done shall be done in accordance with all
City of La Porte Codes and Ordinances applicable. If the repairs or alterations
order is not complied with within the timetable set out in City of La Porte
Ordinance ~~ 1145 , it is then the Lmanitmus opira.~ of this inspection board that

Emergency repairs to Lift Station #6 on South 8th Street by McKey
Construction. The concrete bottom of the lift station was eaten away
allowing shell and mud to intrude and plug the pumps, stopping sewer
services to Baypointe Townhomes.

SUBJECT: Lift Station #6 on South 8th Street
Due to an excessive depth of over 24 feet, McKey Construction was called
in on an emergency basis to assist the Wastewater Department in the repair
of Lift Station #6. After excavation the problem was determined to be
that the original builder had not set the wet well tube properly on the
concrete slab base. The tube was offset over the edge of the base,
sufficient that a laborer could put his hand into the wet well for a
length of approximately 5 or 6 feet, around the base.
The exterior of the wet well base was cleaned and 4 cubic yards of 5~
sack High-Early set concrete was poured around the base. The sewer will
be blocked from the wet well and bypass pumped to another manhole. This
will erable us to clean mud and shell from the interior of the wet
well, which has blocked pump suction. Another 18 inches of concrete will
be placed on the interior bottom of the wet well to prevent future
leakage.
As soon as we are aware of total cost of this repair, I will forward the
information to you. Please call if you need additional information.

Dear Sir:
We are pleased to forward this proposal for the inspection
services in connection with the evaluation of the elevated and
ground storage facilities within the City of LaPorte.
We will make an inspection of the interior and exterior of the
tanks within the city as indicated in the City of LaPorte
R.F.P. #UUU4, Inspection of Water Storage Facilities. We will
during the course of the inspection evaluate the existing
coatings, inspect the structural members for structural
integrity, check metal for pitting, inspect welds visually to
determine whether repairs are required, check riveted tanks to
insure rivets are not leaEsing or will not leak after
refinishing, and make recommendations for x-ray where
necessary. Photographs will be taken of the tanks to portray
their present condition. A written report will be made
detailing the findings, with the supporting photographs.
We will in our inspection provide the recommendations as to the
work required to bring the tanks into compliance with the Te:cas
State Department of Health and the United States Occupational
Safety and Health Act. We will in addition provide
recommendations as to which tanks should be taken completely
out of service due to condition. We will not provide an
analysis of the overall storage requirements under the scope of
this proposal.
Within this proposal we will provide recommendations as to the
type of finishes that may be applied for best service,
estimated COSt5 and life factors.

to, personal injuries to the foregoing or any third person.
We shall require that all storage tanks be drained on the
schedule which is mutually agreed upon by the personnel of the
City of LaPorte. In addition, all ground storage tanF;s shall
have the lower side hatch removed and replaced by City
personnel. We shall also be provided necessary keys for
entrance into the tanks prior to climbing any tank. Reclimbs
caused by failure to have proper Freys will be a basis of
additional charge as indicated above.
We shall not be responsible for any damages or injuries caused
by or to any employees of the City of LaPorte should they be
injured during the removal of the hatches or should they climb
up on or enter into any of the tanks during the e.cecution of
this contract proposal.
Should this proposal meet with your approval, please sing in
the appropriate place and return one copy to our office. We
will then be prepared to worF; out a mutually acceptable
schedule for the completion of the work.

Advertised, sealed bids 40107 for the removal and installation of
carpet and vinyl flooring at the La Porte Police Station were opened
and read in City Council Chambers July 8, 1985 at 4 p.m. Sealed bid
invitations were mailed to the following four area carpet companies;
(1) Loy's Carpet Center, (2) Sherwin Williams, (3) La Porte Carpet,
and (4) The Interior Agent. Quotations were received from Loy's Carpet
Center and Sherwin Williams.
Bidders were asked to submit pricing on the installation of approx-
imately 265 yards of vinyl flooring and 565 yards of carpeting after re-
moval of the worn flooring presently in use. The successful contractor
will be responsible for proper surface preparation and warrant the in-
stallation for one full year.
Low bid meeting specifications was submitted by Sherwin Williams,
Inc. in the amount of $9,109.56 and a completion time of thirty days
after award. A total of seventeen-thousand, seven hundred and ten dollars
($17,710) is currently appropriated in the 1984-85 Capital Improvement
Budget to complete this project.
During the 1985-86 Budget sessions, staff became aware of the Police
Department's chronic need for additional space in their facility. On site
inspection indicates the possibility that the current floor plan could be
remodeled to yield more functional office space without physical addition
to the building. If this plan was pursued, it would be in the best interest
of the City of La Porte to delay any floor covering work until a comprehensive
remodeling plan can be established. Funds currently allocated for this pro-
ject would be sufficient to pay for engineering services necessary to design
a functional lay out for the Police Department.
If City Council is supportive of this approach I recommend rejecting
all bids for the installation of flooring in the Police Station. Should
Council not place this project as a priority, then I recommend the City of
La Porte accept the low bid meeting specifications from Sherwin Williams, Inc.
in the amount of $9,109.56 to complete this project.

necessary for the extension of utilities to serve their development on SH146.
Therefore, an alternate route was established through land owned by the
Houston Port Authority.
The Houston Port Authority does not grant easements. Their standard
practice is to issue a permit for the installation of utilities. The permit
is for a period of 50 years and has a fee of $6,787.50. B.M.W. will cover
this & any other expenses associated with securing the permit. According
to Houston Port Authority, the land will soon be owned by Tenneco. At that
time, the City will negotiate with Tenneco and secure a permanent utility
easement.
5. Alternative: Pay the property owner along the initial route $10,000 or
proceed with condemnation which would substantially delay the project and
may result in more expense.
6. Recommendation: Approve the permit from Houston Port Authority to install
utilities, pending receipt of $6,787.50 from B.M.W.. B.M.W. shall also be
