The meeting was called to order by Mayor Malone at 6:05 P.M. Members of Citv Council Present: Mayor Norman Malone, Councilpersons Betty Waters, Ed Matuszak, Lindsay Pfeiffer, B. Don Skelton, Linda Westergren Members of City Council Absent: Councilpersons John Lloyd, Alton Porter, Deotis Gay Members of Citv Staff Present: Assistant City Manager Richard Hare, City Attorney Knox Askins, Assistant City Secretary Gwen Vann, Director of Parks and Recreation Stan Sherwood, Director of Community Development John Joerns, Fire Chief Joe Sease Others Present: Mr. and Mrs. J. Discuss and consider proposed revisions of administration and consulting contract with James Benefits. The Mayor announced. that this item would be postponed due to the James Benefits representative being unable to be present because of airline schedule problems. 3. Presentation of management alternatives for Little Cedar Bayou Golf Course. Director of Parks and Recreation Stan She David Nivens of the City of Ft. Worth was but had also had scheduling conflicts and present. Minutes, Workshop and La Porte City Council July 21, 1986, Page 2 Special Called Meeting The City Attorney read: RESOLUTION 86-22 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS DESIGNATING CERTAIN CITY OFFICIALS AS BEING RESPONSIBLE FOR ACTING FOR AND ON BEHALF OF THE CITY OF LA PORTE IN DEALING WITH THE TEXAS PARKS AND WILDLIFE DEPARTMENT FOR THE PURPOSE OF PARTICIPATING IN THE LAND AND WATER CONSERVATION FUND ACT OF 1965; CERTIFYING THAT THE CITY OF LA PORTE, TEXAS, IS ELIGIBLE TO RECEIVE ASSISTANCE UNDER SUCH PROGRAM. Motion was made by Councilperson Skelton to approve Resolution 86-22 as read by the City Attorney. Second by Councilperson Matuszak. The motion carried, 6 ayes and 0 nays. Ayes: Councilpersons Waters, Matuszak, Pfeiffer, Skelton, Westergren and Mayor Malone Nays: None 5. Discuss and consider water extension serving Block 143, Lots through 8 and Block 144, Lots 17 through 32 as requested by J. L. and Barbara Holloway. After presentations by Director of Community Development John Joerns and McKim Realty representative Al Ward, it was recommended by the Mayor that since the request is a deviation from City utility extension policies, other avenues be investigated to assist the Holloways in being able to open their business; he asked that figures and recommendations be brought back to Council. 6. Discuss and consider administration and interpretation of personnel rules related to compensation and absence. The City Attorney read Resolution 86-23, which reaffirms the responsibilities of the City Manager to develop, administer and interpret personnel policies and procedures as they apply to all departments and employees. Motion was made by Councilperson Matuszak to ap. r Resolution 86-2~ as read by the City Attorney. Second by Councilperson Westergren. The motion carried, 6 ayes and 0 nays. The tax presentation due to be presented was not held due to the City Manager's absence. The emergency addendum was then addressed by Council. 1. Consider declaring an emergency and ratifying expenditure for emergency repairs to Sylvan Beach Pavilion for damages due to vandalism. Motion was made by Councilperson Waters to declare an emergency due to Sylvan Beach vandalism and ratifv expenditures in the amount of $8,000. Second by Councilperson [destergren. The motion carried, 6 ayes and 0 nays. Ayes: Councilpersons Waters, Matuszak, Pfeiffer, Skelton, Westergren and Mayor Malone Nays: None Council authorized John Joerns to accept a quote for a price to cut away the deck leading to the pavilion, thus reducing the accessibility into the building. The quote was less than the $3,000 which would require going out for bids. 2. Consider posting reward for information leading to the arrest and conviction of party or parties responsible for destruction of property at Sylvan Beach Pavilion. Motion was made by Councilperson Skelton to offer a $1,000 reward for information leading to the arrest and conviction of party or parties responsible for destruction of property at Svlvan Beach Pavilion. Second by Councilperson Westergren. The motion failed, 2 ayes and 4 nays. Ayes: Councilpersons Skelton and Westergren Nays: Councilpersons Waters, Matuszak, Pfeiffer and Mayor Malone Motion was made by Councilperson Matuszak to offer a $500 reward. Second by Councilperson Waters. The motion carried, 6 ayes and 0 nays. Council adjourned into executive session on Personnel to discuss qualifications for the City Manager position and the emergency executive session item on Legal matters to consult with the City Attorney regarding vandalism at Sylvan Beach Pavilion, at 7:40 P.M., and returned to the Council table at 8:12 P.M. 9. There being no further business to come before the Council, the meeting was duly adjourned at 8:12 P.M. Malone, Ma o RESOLUTION N0. 86-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS DESIGNATING CERTAIN CITY OFFICIALS AS BEING RESPONSIBLE FOR ACTING FOR AND ON BEHALF OF THE CITY OF LA PORTE IN DEALING WITH THE TEXAS PARKS AND WILDLIFE DEPARTMENT FOR THE PURPOSE OF PARTICIPATING IN THE LAND AND WATER CONSERVATION FUND ACT OF 1965; CERTIFYING THAT THE CITY OF LA PORTE, TEXAS, IS ELIGIBLE TO RECEIVE ASSISTANCE UNDER SUCH PROGRAM. WHEREAS, the United States Congress has passed the Land and Water Conservation Fund Act of 1965 (Public Law 88-578), authorizing the Secretary of the Interior to provide financial assistance to states, and political sub- division thereof, for outdoor recreation purposes; and WHEREAS, the Texas Legislature has adopted Article 6081r, V.A.C.S., for the purpose of allowing the State of Texas, and its political subdivision, to participate in the Federal program established under said Public Law 88-578, or such other programs as are hereinafter established by the Federal Government; and WHEREAS, the City of La Porte is fully eligible to receive assistance under this Program; and WHEREAS, the City Council of the City of La Porte is desirous of authorizing its administrative staff to represent and act for the City in dealing with the Texas Parks and Wildlife Department concerning this Program; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: Section 1: That the City Council of the City of La Porte hereby certifies that the City of La Porte is eligible to receive assistance under Public 88-578; as augmented by Article 6081r, V.A.C.S. Section 2: That the City Council hereby authorizes and directs its City Manager to represent and act for the City of La Porte in dealing with the Texas Parks and Wildlife Department for the purpose of this Program. The City Manager is hereby officially designated as the City's representative in this regard. Section 3: The City Council hereby designates its Finance Officer as the official authorized to serve as the City's fiscal officer to receive Federal funds for purposes of this Program. Section 4: The City Council hereby specifically authorizes the City officials herein designated to make application to the Texas Parks and Wildlife Department concerning the tracts of land to be known as Little Cedar Bayou Park in the City of La Porte for use as a park site. Malone, Mayor ATTEST: City Secretary APPROVED: City Attorney • CITY OF LA PORTE INTER-OFFICE MEMORANDUM July 14, 1986 T0: Jack Owen, City Manager • THRU: John Joerns, Director of omm nity Development FROM: Bob Speake, City Enginee SUBJECT: Proposed Water Line Extension To Lots 1-8 of Block 143 and Lots 17-32 of Block 144 SYNOPSIS The owners of the above referenced property have asked the City to extend water service to their property to serve a proposed plant nursery. They request City cost participation in the project as an exception to standard utility extension policy. No development plan for the property has been submitted to the City. The minimum size main is 8" and routes are available from the north and the west at a cost of $23,000 to $27,000. Staff recommends no City cost participation in the project and no reduction in the minimum allowable size of water main. BACKGROUND 1. Informal discussions with Mr. Al Ward, representing Decker McKim Realtors, resulted in letters from the owners June 12 and July 3 (See Exhibits A and B) requesting water service to their property with City participation. No participation formula has yet been proposed by the applicants. 2. Standard City utility extension policies require that the developer fund the entire cost of a minimum size fire main, with some reimbursement via future collections of front-foot fees (See Exhibit C). 3. The minimum size fire main to serve this proposed commercial development is 8" (See Exhibit D). 4. This property can be served via an extension from existing water mains located in the right of ways of North 16th, B, or 8th Streets or Fairmont Parkway. (See Exhibit E) • • IOM, Block 143/144 WL Ext, Page 2 5. Other than the letters submitted by the applicants (Exhibits A and B), staff has little knowledge of the development plan for the property. Development issues not yet settled are: A. The required Development Site Plan and Building Plans have not yet been submitted. B. How the developer plans to gain vehicular access to the property is not yet clear. C. Developer plans for sanitary sewage disposal via port-a-can are questionable. D. The developer plans to place a small portable office building on the property, which is in the 100 year flood plain. City Ordinance 1452 requires that first floors of all non-residential buildings therein be elevated at or above (or flood proofed below) the base flood elevation of 17 feet. Property elevations shown on City topo maps appear to range from 15 to 17 feet. E. The City and Harris County Flood Control District plan major channel improvements to Little Cedar Bayou which crosses this property. New channel right-of-way requirements have not yet been established. F. Little Cedar Bayou has also been designated a conservation area in the city's official Parks and Recreation Map. G. The western half of the property is currently zoned "Residential 2"; the eastern half is zoned "Commercial". H. Other development issues may surface as a part of site plan review. 6. The Water and Wastewater Improvement Account had an un-encumbered balance of $62,856.50 for water improvements at June 30, 1986. ANALYSIS 1. Staff has determined that the most cost effective means of serving this property is via a route from 16th Street down the north "F" Street right-of-way about 1700 feet at a cost of about $23,000. This route (with future laterals) will serve about 140 acres of vacant land designated for low to mid-density residential usage in the Comprehensive Plan. (See Exhibits E and F). • • IOM, Block 143/144 WL Ext, Page 3 2. An alternative means of serving this property is via an 8" main from North "B" Street down the west side of the SH 146 right-of-way at a cost of about $27,000. This 2200 foot route will serve three blocks of now vacant commercial property fronting on SH 146. (See Exhibits E and F) 3. City policies require private developers to completely fund development of their property, including bringing off-site utilities to their projects. In examining this request, staff took the position that this policy also enables the City to concentrate its publically-funded resources in areas where: A. Existing infrastructure needs upgrading; B. New infrastructure contemplated in the Comprehensive Plan is planned; or C. Clearly-defined growth patterns exist. CONCLUSION As well as being a clear deviation from existing policies, this project does not appear to satisfy any of the above criteria for City cost participation. RECOMMENDATION That Council should mot allocate funds for City participation in this project above and beyond existing policies, nor permit the installation of a water main less than 8" in diameter. The City Council of the City of La Porte re- affirms the legislative intent of the published personnel policies. Section 2. The City Council of the City of La Porte hereby directs the City Manager to interpret and implement these policies in a uniform and equitable manner, unless otherwise directed by local ordinance, State or Federal statute.
