MINUTES OF THE PUBLIC HEARINGS AND REGULAR MEETING
LA PORTE CITY COUNCIL
MAY 11,1987
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of City Couneil Present: Mayor Norman Malone,
Councilpersons Betty Waters, John Lloyd (arrived at 7:10), Ed
Matuszak, Alton Porter (arrived at 7:12), Mike Shipp, Deotis

2. The invocation was given by Councilperson Waters.
At this time, Mr. Robert Clowers addressed Council regarding
a resolution he wishes to have passed by Council in support
of having the companies who are going to build the Fred
Hartman bridge use steel from the United States rather than
foreign made steel. Council will put this resolution on the
agenda for June 8, 1987.
3. The Mayor called the public hearings regarding dangerous
buildings to order. The buildings are located at 701 South
Nugent, 202 West Fairmont Parkway, and 8423 Avington.
Mark Lewis, building inspector, briefly reviewed the
condition of the buildings and the procedures to be taken if
Council desires to continue the process.

Mr. Lewis gave staff's recommendations on the buildings. It
is to table for 120 days the ordinance dealing with 701
Nugent and to proceed with the process on the buildings
located at 202 West Fairmont Parkway and at 8423 Avington.
The Mayor asked for public input regarding the dangerous
building at 701 Nugent. Mr. Robert Allen addressed Council,
and stated that the reason he has not already started making
repairs is that he is recovering from cancer surgery and has
been unable to proceed. He stated he will begin repairs as
soon as permits can be obtained.
There was no other input regarding 701 Nugent.
The Mayor asked for input regarding 202 West Fairmont
Parkway. There was none.
The Mayor asked for input regarding 8423 Avington. Mr. Jim
Sproule addressed Council regarding the conditions of the
house and yard at 8423 Avington, and expressed his concern
for the potential health hazards and vandalism at that
location. He was in favor of the house being demolished.
Since the house is posted, he could not go on the property to
do any kind of cleaning up of the yard, etc., and it is
getting worse every day.
There being no further input, the Mayor declared the public
hearings closed.
4. Council considered approving the minutes of the public
hearings and regular meeting held April 27, 1987.
Motion was made bv Councilperson Skelton to approve the April
27 meetings as presented. Seeond by Councilperson Waters.
The motion earried, 6 ayes and 0 nays. CCouncilpersons
Lloyd, Porter and Gay had not yet arrived.)

5. Mayor Malone proclaimed Police Week, Public Works Week, and
appreciation to the Optimist Club for sponsoring the CHICKEN
Club.
6. Mr. Lee Allen and Mr. Blake Page, representing the La Porte
Soccer Association, presented Council with a check in the
amount of $700 to help the Parks and Recreation Department
maintain the soccer field in Fairmont park. They were very
appreciative of the City's efforts, and wished to show their
support.
7. The SWA Group presented a slide presentation of the schematic
plans for Little Cedar Bayou Park. They reported that
everything is on schedule, within budget, bids will be going
out in July, and construction should start about the end of
August or the first part of September.

This ordinance had been tabled by Councilperson
at the meeting of June 23, 1986. Councilperson
placed the ordinance back on the agenda for action.
The Mayor read an emergency addendum to the agenda, which
stated there would be an executive session on a legal item:
Discuss with City Attorney possible claim on street closing.
The executive session was called to begin after the
completion of item 8, and pertained only to item 9.
The City Attorney read: ORDINANCE 1495 - AN ORDINANCE
VACATING, ABANDONING AND CLOSING THAT PORTION OF MONTANA
STREET BEING AN EIGHTY (80') FOOT RIGHT-OF-WAY, TOWN OF LA
PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made bY Councilperson Matuszak to adopt Ordinance
14QS as read by the Citv Attorney. Second by Councileprson
Clarke.
Motion was made bv Councilperson Skelton to amend the motion
to stipulate in the Ordinance that if the Church ever sold
the property the City would charge the new owners for the
alley. Second by Councilperson Gay.

After a legal oplnlon by the City Attorney, Councilperson
Skelton withdrew his motion to amend and Councilperson Gay
withdrew his second.
The original motion was voted, and carried, 7 ayes and 0
nays.

Clarke and Mayor Malone
Nays: None
Council adjourned into executive session at 7:00 P.M. and
returned to the Council table at 7:06 P.M.
9. Council considered an ordinance closing alleys in Block 1106,
Lots 1-16, 17-32.

procedures.

AMENDING CHAPTER 21, "STREETS AND SIDEWALKS", ARTICLE III,
"VACATING AND ABANDONING STREETS AND ALLEYS", OF THE CODE OF
ORDINANCE OF THE CITY OF LA PORTE; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING FOR AN EFFECTIVE DATE
HEREOF.
Motion was made bY Councilperson Skelton to adopt Ordinance
1550 as read bY the City Attorney. Second by Councilperson
Gay. The motion carried, 9 ayes and 0 nays.

19. Council considered an ordinance approving amendment to City
of La Porte FY 1986-87 Budget.
The City Attorney read: ORDINANCE 1515-B - AN ORDINANCE
AMENDING ORDINANCE 1515, AN ORDINANCE APPROVING AND ADOPTING
THE BUDGET FOR THE CITY OF LA PORTE, TEXAS, FOR THE PERIOD OF
OCTOBER 1, 1986, THROUGH SEPTEMBER 30, 1987; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Gay to adopt Ordinance
1515-B as read by the City Attorney. Second by Councilperson
Matuszak. The motion carried, 9 ayes and 0 nays. The motion
carried, 9 ayes and 0 nays.

PLEASE NOTE: Subsequent to the meeting, it was discovered that
the actual ordinance number should be 1514-A. The Ordinance has
been corrected to reflect this number.
21. Council considered approving the 1987 agreement between
Harris County and the City of La Porte for Fire Protection
Services.

agreement between Harris County and the City of La Porte for
fire protection services. Second by Councilperson Waters.

22. Council considered authorizing payment of freight charges for
pipe.
Motion was made bv Councilperson Skelton to authorize payment
of freight charges for 220 LF Dia 42" class 72 Hobas pipe, in
the amount of $4,500. Seeond by Councilperson Matuszak. The
motion carried, 9 ayes and 0 nays.

23. Couneil eonsidered awarding a concession contract for Sylvan
Beach Pavilion.
Motion was made bv Councilperson Porter to award the
concession contract for Sylvan Beach Pavilion to Concession
Management at 26.5%. Second by Councilperson Lloyd. The
motion carried, 9 ayes and 0 nays.

24. Council considered awarding a bid for police uniforms and
accessories.
Motion was made bv Councilperson Waters to award the bid for
police uniforms and accessories to Burke Uniforms, low bidder
meeting all specifications. Second by Councilperson
Matuszak. The motion carried, 9 ayes and 0 nays.

25. Administrative Reports:
The City Manager announced that since the regular meeting
scheduled for May 25 would fall on a holiday, there would be
no meeting on that date, and no called meeting on May 18
since there were no agenda items to be considered.
Mr. Herrera also announced the resignation of the Purchasing
Manager, Tim Blackwell, who is taking a position with Metro.
Everyone will be sorry to see Tim go, but wish him well in
his new position.
26. Council Action:
Councilpersons Waters, Lloyd, Matuszak, Porter, Shipp, Gay,
Skelton, Clarke, Mayor Malone and City Attorney Askins
brought items to Council's attention.
27. Council adjourned into executive session at 7:49 to discuss a
personnel matter - Discuss appointments to various boards and
commissions - and returned to the Council table at 8:38 P.M.
Council then addressed agenda items 14, 15, 16, 17 and 20, as
follows.
14. Council considered an ordinance appointing member to the City
of La Porte Electrical Board.
The City Attorney read: ORDINANCE 1546 - AN ORDINANCE
APPOINTING A MEMBER TO THE CITY OF LA PORTE ELECTRICAL BOARD,
TO FILL THE UNEXPIRED TERM OF LINDSAY PFEIFFER, POSITION;
CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Gav to adopt Ordinanee 1S46
as read bv the Citv Attornev, with B. Don Skelton being named
to the position. Second by Councilperson Lloyd. The motion
carried, 9 ayes and 0 nays.

15. Council considered an ordinance appointing member to the City
of La Porte Zoning Board of Adjustment.
Motion was made bv Councilperson Waters to table this
ordinance. Second by Councilperson Skelton. The motion
carried, 9 ayes and 0 nays.

16. Council considered appointing a member to the Southeast Texas
Housing Finance Corporation.
The City Attorney read: ORDINANCE 1548 - AN ORDINANCE
APPOINTING A MEMBER TO THE SOUTHEAST TEXAS HOUSING FINANCE
CORPORATION BOARD OF DIRECTORS; CONTAINING A REPEALING
CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Waters to adopt Ordinance
1548 as read bv the City Attorney, to name Patricia Muston as
a member of the Board for a term to expire April iO, 1989.
Second by Councilperson Lloyd. The motion carried, 9 ayes
and 0 nays.

17. Council considered an ordinance appointing members to the
City of La Porte Planning and Zoning Commission.

APPOINTING A CHAIRMAN; A MEMBER, DISTRICT 2; AND A MEMBER,
DISTRICT 3, TO THE CITY OF LA PORTE PLANNING AND ZONING
COMMISSION, FOR A TERM TO EXPIRE APRIL 30, 1989; AND A
MEMBER, DISTRICT 6, TO FILL AN UNEXPIRED TERM TO EXPIRE APRIL
30, 1988; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF.

Motion was made bY Councilperson Shipp to adopt Ordinance
1549 as read bY the City Attorney, appointing Douglas Latimer
as Chairman; Inge Browder, member, District 2; Janet Grayes,
member, District ~; and Jack Gresham to fill the unexpired
term as member, District 6. Second by Councilperson
Skelton. The motion carried, 9 ayes and 0 nays.

20. Council considered a resolution appointing a nominee to the
Harris County Appraisal District Board of Directors.
The City Attorney read: RESOLUTION 87-7 - A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, NOMINATING A
CANDIDATE TO FILL THE UNEXPIRED TERM OF A POSITION ON THE
BOARD OF DIRECTORS OF THE HARRIS COUNTY APPRAISAL DISTRICT.
Motion was made bY Councilperson Skelton to approve
Resolution 87-7 as read bY the City Attorney, and submit the
name of Linda Westergren. Second by Couneilperson Porter.
The motion carried, 5 ayes and 4 nays.

28. There being no further business to come before the Council,

Revisions to Street & Alley Closing Ordinance
and Pending Requests for Street & Alley Closings
The draft ordinance incorporating the changes to the Street & Alley
Closing Ordinance requested by Counci I is complete. The RFP for
appraisal servic~s is being prepared and should be ready for
advertising during the first week in Hay. Consideration of this
ordinance is tentatively scheduled for the May 11 Council meeting.
Since the ordinance is designed to be effective the date of passage,
I recommend that Council authorize staff to select Hugh Landrum to
perform any necessary appraisals which occur prior to the City
selecting an appraiser. Mr. Landrum is familiar with La Porte and
currently performs the appraisals for the City's Industrial District
Contracts and is a licensed fee appraiser.
Also, Counci I need s to be awa re that the re are
street and alley closings that need to be resolved.
Askins' and my opinion that applications, submitted
of the new ordinance, should have the right to
allowed under our existing ordinance.

WHEREAS, the City Council of the City of La Porte has
been requested by the record owners of all of the property
abutting the hereinafter described portion of Montana Street
being an eighty (80') foot right-of-way. Beginning at a point
in the- South right-of-way line of "J" Street (Now known as
Fairmont Parkway) ~ said point being the Northeast. corner of
Block 1112~ thence South, along West right-of-way line of
Montana Street. A distance of 216 feet to apoint for a corner~
said point being Southeast corner of Lot 14, Block 1112~ thence

Exhibit "A" attached hereto and fully incorporated by reference
herein, is hereby permanently vacated, abandoned, and closed
by the City of La Porte.
Section 2. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
Ci ty Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The
city Council further ratifies, approves and confirms such
written notice and the contents and posting thereof.
Section 3. This Ordinance shall take effect and be in
force from and after its passage and approval.

beneficiaries, any executors, administrators, assigns, or successors
in interest, remise, release and forever discharge the City of La
Porte, and. its successors, of and from all manner of action and
actions, cause or causes of actions, suits, debts, sums of money,
dues, claims, or demands whatsoever in law or in equity, which I, my
beneficiaries, or successors in interest have ever had, now have, or
will have against said city, by reason of cause or thing whatever,
occuring in relationship to the abandonment of the aforedescribed
right-of-ways, whether the same be upon contract or upon tort.
Without limiting the generality of the foregoing, this release
specifically applies to the existance of a four inch (4") water line in
the aforedescribed right-of-way being abandoned by the City of La Porte.
I, my beneficiaries, and successors in interest, understand that said
water line exists, that it has been abandoned and capped,' and that
the removal of said water line, or any damages accruing or occurring
due to the existence of said water line in said abandoned right-of-
ways, occur at my, my successors in interest or beneficiaries' risk.
In addition, I, my beneficiaries or successors in interest
understand that if water, waste water, or other utilities of the City
of La Porte are to be furnished to said property, that same shall be
at my, my successors in interest or beneficiaries' expense, and that
all City of La Porte standard policies regarding the provision of
utilities to said property shall apply.

LEONE AND OLIVE AVENUE BETWEEN BLOCKS 33 AND 34, BEACH PARK
SUBDIVISION (AS RECORDED IN VOLUME 67, PAGE 148, HARRIS COUNTY
DEED RECORDS), JOHNSON HUNTER SURVEY, A-35, IN THE TOWN OF LA
PORTE, HARRIS COUNTY, TEXAS AND IS MORE PARTICULARLY DESCRIBED
BY METES AND BOUNDS ON EXHIBIT "A", ATTACHED HERETO AND FULLy
INCORPORATED BY REFERENCE HEREIN: FINDING COMPLIANCE WITH THE

tangency.

Church and Mr. and Mrs. Edward Wolf contains two (2) sanitary sewer
service lines to the church. The City will maintain these lines to
thenortn right-oi'-\vay. J.i:<c of North Circle Drive. It will be the
property owner's'responsibility for maintenance beyond that point.
This is current City policy on maintaining sewer services.
As long as this.policy is made clear to the requestors, the Public
Works Department has no objection to this street closure request.

THRU:
Tonight we are holding the public hearing for the three buildings
presently .being considered as dangerous buildings. The buildings are
located at:
(1) 8423 Avington
(2) 202 West Fairmont Parkway
(3) 701 So. Nugent
At the close of the hearing a separate ordinance condemning each of
these buildings will be considered. If passed the ordinances will
order the owners toreinove their buildings within ten (10) days. If
the owner does not demolish himself, the City will advertise for bids
and have the buildings demolished. A bill for demolition will be sent
toeachbwrier and if not 'paid 'within a specified time, a .lien will be
placed against the property in question.

(1) Pass the ordinance and condemn the building.
(2) Defeat the ordinance.

21,Bavfront TRACT, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, TO BE
IN FACT A NUISANCE; ORDERING SUCH BUILDING CONDEMNED; FINDING
THAT Howard E. & Florence Allen IS THE RECORD OWNER SAID
PROPERTY; ORDERING THE SAID OWNER TO ENTIRELY REMOVE OR TEAR
DOWN SUCH BUILDING; ORDERING THE SAID OWNER TO COMMENCE SAID
REMOVAL OR DEMOLITION WITHIN TEN (10) DAYS FROM THE EFFECTIVE
DATE OF THIS ORDINANCE; ORDERING THE BOARD OF INSPECTION. TO
PLACE A NOTICE ON SAID BUILDING; ORDERING THE CITY SECRETARY TO

authorized representative, the Fire Chief or his duly authorized
representative, and the Fire Marshal or his duly authorized
representative; and
WHEREAS, Section 8-118(a) of said Sections provide that,
whenever it shall come to the attention of the Board of
Inspection or any member thereof, by reason of the carrying out
of the necessary duties of such member, or by reason of a

complaint of any citizen of the City or of the City Council,
that a dangerous building exists, the Board shall, within
twenty-four (24) hours of the receipt of said eomplaint, make a
thorough inspection of said alleged dangerous building; and
WHEREAS,

prov ides that,
after the
inspection provided for in this Section has been made, with o~
without the'aid 6f experts, the Board shall immediately report
its conclusion in wri ting to each of the members of the Ci ty
Counc il and to the City Atforney.. Such report shall state the
circumstances and the eondition of the building upon which such
conclusion was based. The report shall be filed in all cases no
matter what conclusion is stated by the Board; and
WHEREAS, it has heretofore come to the attention of the
Board of Inspect ion that the bu ild ing loca ted on Lots 1 & 2;
Blk. 2.1, Bavfront Tract, Harris County, Texas, has, for the
reason of neglect or misuse, been allowed to deteriorate into a
condition of decay or partial ruin or has become a fire hazard,
as defined in Section 8-117 of the Code of Ordinances of the
City of La Porte; and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated Februarv19, 1987, finding said
building to be in fact a dangerous building;
WHEREAS, City Counc il received such report, and ordered
notice to the record owner of said property, Howard E. &
Florence Allen, whose address is 408 Bull Run, League Ci tv,
Texas 77573 that a hearing as provided in Section 5 of said
Ordinance would be held at 604 West Fairmont Parkway, at the

Chambers, City Hall, City of La Porte, Texas, at which time the
Council would hear evidence for and against the conclusions of
the Board;
WHEREAS, the City Secretary has heretofore served notice of
said hearing upon said owner, by registered mail, return receipt
requested, which return receipt indicates that said owner
received said notice on. Aoril 1~, 1987, a date more than ten
(10) days before the date set for said hearing;
WHEREAS, at said date, time, and place, City Council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions
of the Board of Inspection;
WHEREAS, City Counc iI, after due del iberation, and wi thin
fifteen (15) days after the termination of the hearing, is
requ ired to make its dec is ion in wri t ing and enter its or,der;
and
WHEREAS, City Council entered its order on April 24, 1987 a
day which is within fifteen (15) days after the termination of
the hearing; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. This Ordinance contains the findings and orders
of the City Council of the City of La Porte, and its
conclusions, based upon the evidence presented at said hearing.

Section 2. Based on the evidence presented at said
hearing, the City Council hereby adopts the attached report of
the Board of Inspection, in full, and incorporates sueh by
reference herein as fully as though set out herein.
Section ~. The City Council hereby finds, determines and
declares such building to be a nuisance, and orders such
building condemned.
Sec t ion 4. The City Counc il hereby finds, determines and
declares that Howard E. & Florence Allen, who resides at !I..Q...8.
Bull Run, League Citv, Texas 77573, is the record owner of the
property on which this building is situated, and as such record
owner, the said Howard E. & Florence Allen has been duly and
legally notified of these proceedings.
Section 5. The City Council hereby orders the said Howard
E. & Florence Allen to entirely remove or tear down such
building, and further orders the said Howard E. & Florence Allen
to commence such removal within ten (10) days from the effective
date of this Ordinance, and to complete such,. removal or
demolition of such building within a reasonable time.
Section 6. The City Council hereby orders the Board
Inspection of the City of La Porte to cause a notice of the
dangerous, insanitary 6ondition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which nottQ~. or Bhall not be removed or defaced by any person~
under penalty of law.
Section 7. The City Council hereby order the City
Secretary to forward a certified copy of this Ordinance, to the

record owner of sa id property, the said Howard E. & Florence
Allen, by registered mail, return receipt requested.
Section 8. Should the said Howard E. & Florence Allen not
comply with the orders contained in this Ordinance relating to
the removal or demolition of such building within ten (10) days
after service hereof, then the Board of Inspection of the City
of La Porte shall enter upon said premises with such assistance
as it may deem nec essa ry , and cau se the sa id bu ild ing to be
removed or demolished without delay, and the expenses of such
procedure shall~be charged against the said Howard E. & Florence
Allen record owner of said property, and shall thereupon become
a valid and enforceable personal obligation of said owner of
such premises, and the said Board of Inspection shall carefully
compute the cost of such removal or demolition, which cost shall
be hereafter assessed against the land occupied by such
building, and made a lien thereon.
Section g. The City Council officially finds, determines,
rec i tes and decl ares that a suffic ient written not ice of the
date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
City Hall of the City for the time requi red by law preced ing
this meeting, as required 'by the Open Meetings Law, Article
6252-17, Texa s Rev i sed C i viI Sta tu ses Annotated; and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The
City Council further ratifies, approves and confirms such

THRU :
Tonight we are holding the public hearing for the three buildings
'presently being considered as dangerous buildings. The buildings are
located at:
(1) 8423 Avington
(2) 202 West Fairmont Parkway
(3) 701 So. Nugent
At the close of the hearing a separate ordinance condemning each of
these buildings will be considered. If passed the ordinances will
order the owners to remove their buildings within ten (10) days. If
the owner does not demolish himself, the City will advertise for bids
and have the buildings demolished. A bill for demolition will be sent
to each owner and if not paid within a specified time, a lien will be
placed against the property in question.
When considering th~se ordinances, three options are available:
(1) Pass the ordinance and condemn the building.
(2) Defeat the ordinance.
(3) Table the ordinance and allow the owner 120 days
to make necessary repairs.

WHEREAS, Sec t ion 8-118 (c) prov ides that, after the
inspection provided for in this Section has been made, with or
without the aid of experts, the Board shall immediately report
its conclusion in writing to each of the members of the City
Council and to the City Attorney. Such report shall state the
circumstances and the condition of the building upon which such
conclusion was based. The report shall be filed in all cases no
matter what conclusion is stated by the Board; and
WHEREAS, it has heretofore come to the attention of the
Board of Inspection that the building located on Lots 17 & 18;
Blk. 179, La Porte Tract, Harris County, Texas, has, for the
reason of neglect or misuse, been allowed to deteriorate into a
condition of decay or partial ruin or has become a fire hazard,
as defined in Sec t ion 8-117 of the Code of Ord inances of the
City of La Porte; and
WHEREAS, said Board of Inspection has heretofore made and
filed its written report, dated Februa rv 6, 1 g87, find ing sa id
building to be in fact a dangerous building;
WHEREAS, City Council received such report, and ordered
notice to the record owner of said property, Thomas R. Fraizer,
whose address is P.O. Box 11~4, La Porte, Texas 771)71 that a
hearing as provided in Seetion 5 of said Ordinance would be held

WHEREAS, the City Secretary has heretofore served notice of
said hearing upon said owner, by registered mail, return receipt
reque-sted, . which return receipt'. indicates that said owner
received said notice on Aoril 1~, 19B7, a date more than ten
(10) days before the date set for said hearing;
WHEREAS, at said date, time, and plaee, City Council met in
regular session to conduct such public hearing, at which time
evidence was presented both for and against the conclusions
of the Board of Inspection;
WHEREAS, City Counc iI, after due del iberat ion, and within
fifteen (15) days after the termination of the hearing, is
required to make its decision in writing and enter its order;
and
WHEREAS, City Council entered its order on April 2g, 19B? a
day which is within fifteen (15) days after the termination of
the hearing; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. This Ordinance contains the findings and orders
of the City Council of the City of La Porte, and its
conclusions, based upon the evidence presented at said hearing.

Section 2. Based on the evidence presented at said
hearing, the City Council hereby adopts the attached report of
the Board of Inspection, in full, and incorporates such by
reference herein as fully as though set out herein.
Sec tion i. The City Counc il hereby find s, determines and
declares sueh bUilding to be a nuisance, and orders such
building condemned.
Section 4. The City Counc il hereby finds, determines and
declares that Thomas R. Fraizer, who resides at P.O. Box 11i4,
La Porte, Texas 77571, is the record owner of the property on
which this building is situated, and as such record owner, the
said Thomas R. Fraizer has been duly and legally notified of
these proceedings.
Section 5. The City Council hereby orders the said Thomas
R. Fraizer to entirely remove or tear down such building, and
further orders the said Thomas R. Fraizer to commence such
removal within ten (10) days from the effective date of this
Ordinance, and to complete such removal or demol i tion of such
building within a reasonable time.
Section 6. The City Council hereby orders the Board
Inspection of the Ci ty of La Porte to cause a notice of the
dangerous, insanitary condition of the building to be affixed in
one or more conspicuous places on the exterior of the building,
which notice or shall not be removed or defaced by any person,
under penalty of law.
Section 7. The City Council hereby order the City
Secretary to forward a certified copy of this Ordinance, to the

registered mail, return receipt requested.
Section 8. Should the said Thomas R. Fraizer not comply
with the orders contained in this Ordinance relating to the
removal__or demolition of such building within ten (10) days
after service hereof, then the Board of Inspection of the City
of La Porte shall enter upon said premises with such assistance
as it may deem necessary, and cause the said building to be
removed or demolished wi thout delay, and the expenses of such
procedure shall be charged against the said Thomas R. Fraizer
rec.ord owner of sa id property, and shall thereupon become a
valid and enforceable personal obligation of said owner of such
premises, and the said Board of Inspection shall carefully
compute the cost of such removal or demolition, which cost shall
be hereafter assessed against the land occupied by such
building, and made a lien thereon.
Section 9. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
City. Hall of the City for the time requ ired by law preceding
this meeting, as required by the Open Meetings Law, Article

meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof

Revisions to Street & Alley Closing Ordinance
and Pending Requests for Street & Alley Closings
The draft ordinance incorporating the changes to the Street & Alley
Closing Ordinance requested by Council is complete. The RFP for
appraisal services is being prepared and should be ready for
advertising during the first week in May. Consideration of this
ordinance is tentatively scheduled for the Hay 11 Council meeting.
Since the Ordinance is designed to be effective the date of passage,
I recommend that Council authorize staff to select Hugh Landrum to
perform any necessary appraisals resulting from the passage of this
Ordinance. This relationship should continue until the RFP' s are
returned, evaluated and a recommendation can be given to Council.
Hugh Landrum is familiar in La Porte and Currently performs the
appraisal for the City's Independent District Contracts.
Also, Council needs to be aware that there are several pending
street and alley closings that need to be resolved.
It is both Knox Askins and my opi-nion that applican'ts have the right
to claim rights and benefits provided by the current Ordinance.

INTERNAL GUIDELINES FOR REVIEW OF REQUEST
TO CLOSE, VACATE AND ABANDON STREETS OR ALLEYS
WITHIN THE CITY OF LA PORTE
The following guidelines are offered as considerations for
reviewing requests to close, vacate and abandon a City right of
way by City staff or City council.
These guidelines are based on records of previous requests and do
not depict every situation that may occur. Careful consideration
of each individual case is recommended.
CONSIDERATIONS FOR APPROVAL:
1) To facilitate development of land larger than one half (1/2)
of standard City block (125' X 400').
2) To open larger tracts of land to development, where one
owner, has ownership on both sides of the requested closure.
3) To exchange lands with developers and or land owners in order
to provide additional or relocated rights of way and or
utility corridors for City use.
4) To convert rights of way to park land, open space or other
public uses planned by the City.
5) To reduce the amount of City maintained corridors which
require funding from the public and do not benefit the City.
6) To facilitate phasing out of the grid type road system in the
older areas of the City in order to reach a more efficient
street network.
7) To support the Capital Improvements projects of other
governmental agencies and franchised utilities.
CONSIDERATIONS FOR DENIAL:
1)
Where existing or proposed utilities, whether
franchised are located, including (water, sewer,
natural gas or storm sewer etc.) and where an
maintenance easement cannot be provided or the
relocated at no expense to the City.

ORDINANCE NO. 1550
AN ORDINANCE AMENDING CHAPTER 21, "STREETS AND SIDEWALKS", ARTICLE
III, "VACATING AND ABANDONING STREETS AND ALLEYS", OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW: AND PROVIDING FOR AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Section 21-25, "Application fee", Sub-paragraph (c),
under Chapter 21, "STREETS AND SIDEWALKS", Article III, "Vacating,
Abandoning and Closing Streets and Alleys", of the Code of Ordances
of the City of La Porte, is hereby amended and shall hereafter read
as follows, to-wit:
"(c) A governmental entity having the power of emi-
nent domain shall be exempted from the payment
of an application fee under this section."
Section 2. Section 21-28, "Final Determination by City Council:
Appraisal: Conveyance" under Chapter 21, "STREETS AND SIDEWALKS",
Article II I, "Vacating, Abandoning and Closing Streets and Alleys II ,
of the Code of Ordinances of the City of La Porte, is hereby amended
and shall hereafter read as follows, to-wit:
"Section 21-28. Final Determination By City Council: Appraisal
Conveyance: Exemptions.
Upon compliance with all provisions of this Article, the City
Council shall make a final determination as to whether or not an
application filed under this Article shall be granted or denied.
City Council may waive bid procedures and publication requirements in
the sale or the disposal of real property interests belonging to the
City of La Porte in the following circumstances:
(1) narrow strips of land, or land so shaped or so small as to
be incapable of being used independently as zoned or under
applicable subdivision or other development control ordinances,
in which event such land may be sold to the abutting property
owner or owners in proportion to their abutting ownership, such
division between owners to be made in an equitable manner:
(2) streets or alleys, whether owned in fee
in which event such land or interest may be
owners or owners in proportion to their

easements, including transactions which may be partly for cash
and partly by trade or exchange:
(5) land owned by the City of La Porte which it desires to
have developed by contract with an independent foundation: or
(6) any interest in land that is conveyed by the
Porte to a governmental entity having the power
domain.

County Appraisal District, before reduction by any applicable tax
exemptions, which average square footage Prime Rate fair market value
appraisal shall be multiplied by the total square footage contained
in the tract of land sought to be closed, which product shall be
then multiplied by a factor of 1.5.
If either the Applicant or the City Manager, "or his designee",
do no:t: agree oq the result obtained," then. an independent fee appra~~
sal shall be obtained by the City of La porte," by an independent tee
appraiser selected by the City of La Porte, at Applicant I s sole

porte owns such tract of land as a street, alley, or easement, the
value shall be determined at not less than 75% of the value determined
in the manner provided in this paragraph.
Governmental entities shall be exempted from the payment of fair
market value to the City of La Porte.
Section 3. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,

ADOPTING THE BUDGET FOR THE CITY OF LA PORTE, TEXAS, FOR THE PERIOD
OF OCTOBER 1, 1986, THROUGH SEPTEMBER 30, 1987: FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW: AND PROVIDING AN EFFECTIVE DATE HEREOF.

Section 1: Ordinance No. 1515 of the City Council of the City
of La Porte, heretofore passed and approved on the 29th day of
September, 1986, is hereby amended as set forth on Exhibit "A" attached
hereto, incorporated by reference herein, and made a part hereof for
all purposes. Except as so amended hereby, Ordinance No. 1515 shall
remain in full force and effect. The Budget Revisions justifications
are attached hereto as Exhibit "B", incorporated by reference herein,
and made a part hereof for all purposes.

BUDGET REVISIONS JUSTIFICATIONS
Debt Service - General obligation debt related to the Utility Fund
was budgeted twice in the G.F. through the following procedures:
1) Effective tax rate computation
2) Administrative transfer from the Utility Fund.
These two procedures will provide ~1, 332,764 for general obligation
debt retirement in fiscal 1987. However, the amount of debt to be
retired in fiscal 1987 is 666,382. Therefore, the additional amount
budgeted can be used to fund other unanticipated expenditures.
SolidVJaste - Com. Revenue - Revenues were budgeted initially for a
three month period. Council indicated a desire to continue the
solidwaste commercial division since it is self-supporting. An
additional nine months of operations will increase revenue $236,082.
Horl(mans' ComDensation - premiums were projected by T!1L in October
1986 to be 190,717. However, the City budgeted only ~161,288. Later
in the year TML did a re-rate based on pool experience. The re-rate
increased ~.JOrkmans' compensation for the Ci ty for the current year.
Also, the State Board of insurance raised rates which became
effect i ve January 1987. These combi ned changes inc rea sed Horkmans'
compensation insurance $41,088.
General Liabilitv/Casualty - premiurils increased $233,199 due to a
re-rate process by the Texas Municipal League. The original budget
is insufficient to accomodate this additional cost.
Solidwaste-Commercial division originally budgeted for three

The City Council, at the May 4, 1987 workshop, indicated a desire
to increase trash collection frequency from one time per month to
a two week collection cycle. Attached is a proposed amended
budget to accomplish this goal, together with ftn analysis of the
difference between the original FY 86-87 budget of $908,225 and
the proposed amended budget of $941,110, an increase of $32,885.
If the Council wishes to increase trash collection frequency from
one time per month to a two week collection cycle, I recommend
that the proposed budget amendment be adopted. It is anticipated
that the program can be implemented in one month from date of
approval.

Attached is a copy of the proposed amended budget for the above
referenced division, along with an analysis of the current funding
level as compared to the pr-oposed'-funding-level ;-The p-~opose(i- .. ,

It should be noted that the estimated revenue for this division
presented at the May 4, 1987 Council workshop was shown to be
$289,438, which would produce a $20,265 surplus. Because past
revenues were substantially higher than the projected revenue for
FY 86-,8-7, ~ the projected-revenue was reexamined, and it now. appears
that there will be a FY 86-87 commercia~'revenue of $314,832.
This revised revenue projection will produce a $45,659 surplus.
The proposed budget amendment will be self supporting, and I
recommend its passage.

We are requesting that" $275,000 be transferred to the general
liability and worker's compensation insurance accounts in order to
allow the City to pay its rema ining annual premiums and po ssi ble
deductibles. Our analysis indicates that $145,661 was underbudgeted
in October 1986 for general. liability and worker's cOl1}p~ns~tion
insurance. Add i tionally, we':-:-le:.a--r~ned only dcrys, -:-ago that 6Ur-:-aritfual

$509,138, retroacti ve to October 1986. Our worker's compensation
insurance has also risen some 6%, retroactive to October 1986.' The
requested $275,000 will bring our insurance accounts to solvency for
the remainder of the fiscal year.
The attached table (Exhibit A) demonstrates our insurance shortfalls
for FY 8(;i-87.
\ole will receive a TML bill- for the month of -May in --the- --amount - of
$111,.375.62. This is the annual-premium rerate adjustment. Of this
figure, $42,429 is the monthly premium installment leaving
approximately $69,000 as this year I s adjustment. This figure is
included in the total adjustment request of $273,425. While these
figures may be alarming, our efforts have already resulted in
$36,580 of premium savings which would have driven the requested
figure that much higher.. The annual premium rerates and state board
of insurance increases in January' 1987 are significant factors in
this year's adjustment.

WHEREAS, Harris County desires to provide fire fighting and fire protec-
tion services to certain unincorporated areas of Harris County hereinafter desig-
nated to preserve the property of the County and to preserve and protect the public
health of the citizens of the County; and
WHEREAS, the City is willing to furnish fire fighting and fire protection
services to said unincorporated areas of Harris County for the considerations
hereinafter provided;
NCW, THEREFORE, KNCW ALL MEN BY THESE PRESENTS: That in consideration
of the mutual covenants, agreements and benefits to both parties, it is AGREED
as follavs:
I.
During the term of this agreement, the Ci ty aorees to furnish fire
fighting and fire department protection services to the unincorporated areas
adjoining the corpora~e limits of this City designated by Zone Number 34
on the official fire protection zone map of Harris County, to which reference
is here made.
II.
Harris County agrees to pay the sum of $ 7, 090 . 00 to the City for
fire fighting and fire protection services to the unincorporated area of Harris
County pursuant to Paragraph I of this agreement. The County agrees said sum

III.
The term of this aqreement shall be one (1) year beqinnino January 1,
19~, and ending December 31, 1987.

but not be limited to, the followiro: Answering all calls for help-and assistance
in extinguishinq fires in the area designated in Paragraph I of this agreement:

IX.
The City aqrees- to furnish the-Fire Marshal of Harris County, not later
than the fifth (5th) day of each month, a monthly report listing the total number
of -runs' made into the unincorporated areas of Harris County designated iri - paragraph
I; of this agreement for_ the-previous month and such other information relating
to fire fighting and fire prevention services of the City as may be requested
by the 'Fire Marshal of Harris County. Said report shall be made on the forn

As per the letter from Mr.Siegfreid Wolte dated December 17, 1986,
Hobas Durotec offered to supply two hundred and twenty (220) feet of
forty-two (42) inch Hobas pipe to construct the crossover connection
at Bay Area Blvd. and Fairmont Parkway approved as Change Order No. 4
to McKey Construction Co., Inc. by Council action on April 27, 1987.
This connection will allow abandonment of Lift Station No. 29. The
only cost to the City for this pipe would be freight changes as detailed
in the above letter.
Authorization -from the City Council needs to be obtained to pay the

Each bidder was required to submit a statement showing: (a) capital
structure, (b) operatinq experience~ (c) present concession
operation, (d) other present operations, (e) gross revenues, (f)
business references and (g) other qualifications of which are
attached. Also ~ttached is Concession Management Services, Inc.
capital structure and gross revenue for 1987.
Concession Management Services is responsible for catering the
Pasadena Fair Ground Festival and the Fourth of July 1987 Festival
at Pasadena Fair Grounds.
Based on all references checked and positive responses, the staff
is recommending the proposal be awarded to the concessionaire sub-
mitting the highest percentage, Concession Management.
