i • MINUTES OF THE PUBLIC HEARINGS AND REGULAR MEETING LA PORTE CITY COUNCIL AUGUST 10, 1987 1. The meeting was called to order by Mayor Malone at 6:00 P.M. Members of City Council present: Mayor Norman Malone, Councilpersons John Lloyd, Ed Matuszak, Alton Porter, Mike Shipp, Deotis Gay (arrived at 6:20 P.M.), B. The invocation was given by Mayor Malone. 3. Mayor Malone opened the public hearing to hear the request of J. P. Jackson to consider rezoning a 165' x 140' tract out of W. M. Jones Survey, A-482, from R-3 high density residential to GC General Commercial to allow expansion of his business located at 9901 Fairmont Parkway. Councilperson Shipp excused himself from the Council table during this public hearing, due to conflict of interest. The Mayor asked for input from those in favor of the rezoning request. J. P. Jackson, owner of the business, addressed Council, asking that the zoning change be to Neighborhood Commercial with special conditional usage of boat storage, with 80 percent being used for neighborhood boat storage and • M Minutes, Public Hearings and Regular Meeting La Porte City Council August 10, 1987, Page 2 20 percent being used by Texas Parks and Wildlife Department. Mr. Jackson emphasized that time is critical in this rezoning, as the Parks and Wildlife Department needs to be moved from their present location by September 1. Janet Gray Wahrlich addressed Council to appeal Planning and Zoning's determination of boat storage as a general commercial use and the decision by the Planning and Zoning Commission denying the rezoning change from residential 3 to general commercial. She stated the Planning and Zoning Commission had made the correct decision based on the zoning map they were working with at that time, but since the time of the meeting a substantial amount of research had been done by herself into this matter, and feels that she has facts that would support Council tonight to make a determination that boat storage is a neighborhood commercial use, with conditional screening. She then went on to explain the reasons to support this determination. Eddie Gray addressed Council in support the rezoning to Neighborhood Commercial with a special conditional use permit. Garry Collins, Parks and Wildlife Department, spoke in support of the rezoning. Carl Ferguson, President of the Fairmont Park West Community Improvement Association, spoke in support of the rezoning. The Mayor called for anyone wishing to speak in opposition to the rezoning. No one came forward. The Mayor declared the public hearing closed. Councilperson Shipp returned to the Council table at that time. 4. The Mayor opened the public hearing on the request of New Jerusalem Church for a special conditional use permit to allow Church expansion in a residential zone, Block 62, Lots 17, 28, 19, 20, Town of La Porte. ~ ~ Minutes, Public Hearings and Regular Meeting La Porte City Council August 10, 1987, Page 3 The Mayor asked if anyone wished to speak in favor of the special conditional use permit. No one came forward. The Mayor asked if anyone wished to speak in opposition to the special conditional use permit. No one came forward. The Mayor declared the public hearing regarding New Jerusalem Church closed. 5. The public hearing on the revenue sharing budget was opened by the Mayor after consideration of item 6. City Manager Bob Herrera reviewed the revenue sharing budget. The Mayor called for public input regarding the revenue sharing budget. There was none, and the Mayor declared the public hearing closed. 6. Council considered approving the minutes of the regular meeting of Council held July 27, 1987. Motion was made by Councilperson Skelton to approve the July 27 minutes as presented. Second by Councilperson Clarke. The motion carried, 7 ayes and 0 nays. (Councilperson Gay had not yet arrived.) Ayes: Councilpersons Lloyd, Matuszak, Porter, Shipp, Skelton, Clarke and Mayor Malone Nays: None 7. A. Tom Turner, Manager, USI Chemical plant, addressed Council regarding expansion of the USI plant in this area. He is asking Council support in the form of incentives that will cause the parent company, National Distillers, to build the plant in La Porte. One of the things Mr. Turner is asking for is a total tax abatement for a five-year period on the potential expansion. Mr. Turner would like a response by September 1, 1987. The City Manager was instructed by Council to work with Mr. Turner to see what can be worked out. The City Manager will have a response for Council by September 1. • ~ Minutes, Public Hearings and Regular Meeting August 10, 1987, Page 4 B. Harry Predmore, representing BOC/Airco, addressed Council regarding the City's landfill permit application. They wish to make sure that the methane gas level will be such as not to interfere with their company's processes. BOC/Airco is not opposed to the landfill, but want the technical design to be such that the methane emissions from the landfill do not cause a shut-down at their plant. With that assurance (of a good technical design), the company would withdraw its demand that methane from the landfill would not adversely affect their plant. They had hoped that La Porte would hire a consultant to do a very sophisticated engineering job and study that would give Airco confidence that the methane emission from the proposed landfill would not cause them a problem. Since that hasn't happened, Airco has recently obtained a consultant to establish and complete the findings of the possibility of methane emissions and what the effect would be on their location. More time is needed to complete the study, examine the findings, and consult with La Porte representatives on the findings; therefore, he is asking that the City of La Porte join with BOC/Airco in having a motion for a 45-day continuance in the Texas Department of Health hearing. Ms. Jo Davis then addressed Council as a representative of the Citizens for a Quality Environment, in regards to the Town Meeting scheduled for August 22. She asks that a mail-out be done by the City so that every citizen can be informed of the meeting, especially since an exit poll is to be done. She feels this would insure the objectivity of the exit poll. 8. Council considered an ordinance rezoning a 165' by 140' tract out of W. M. Jones survey, A-482, from R-3 high density residential to GC general commercial. Councilperson Shipp excused himself from the Council table during consideration of this item. The City Attorney read: ORDINANCE 1501-A - AN ORDINANCE AMENDING ORDINANCE N0. 1501, THE CITY OF LA PORTE ZONING ORDINANCE, BY CHANGING THE CLASSIFICATION OF THAT CERTAIN PARCEL OF LAND HEREIN DESCRIBED; AND PROVIDING AN EFFECTIVE DATE HEREOF • Minutes, Public Hearings and Regular Meeting La Porte City Council August 10, 1987, Page 5 In Section 6, the words "General Commercial" were changed to read "Neighborhood Commercial," and "with conditional use for boat storage" added. Motion was made by Councilperson Skelton to adopt Ordinance 1501-A as read by the City Attornev. Second by Councilperson Gay. After questions from Council were answered, the vote was taken and the motion carried, 7 ayes and 0 nays. Ayes: Councilpersons Lloyd, Matuszak, Porter, Gay, Skelton, Clarke and Mayor Malone Nays: None Motion was made by Counci~erson Porter to adopt Ordinance 15 Q1-A as amended. Second by Councilperson Lloyd. The motion carried, 7 ayes and 0 nays. Council considered an ordinance appointing a member to the La Porte Area Water Authority. The City Attorney read: ORDINANCE 155+ - AN ORDINANCE APPOINTING MIKE WADSWORTH AS DIRECTOR, POSITION 3, OF THE LA PORTE AREA WATER AUTHORITY, TO FILL THE UNEXPIRED TERM OF CARY BURNLEY, TO EXPIRE SEPTEMBER 1, 1987; AND APPOINTING MIKE WADSWORTH TO A TWO YEAR TERM AS DIRECTOR, POSITION 3, OF THE LA PORTE AREA WATER AUTHORITY FOR A TERM TO EXPIRE SEPTEMBER 1, 1989; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Council considered an ordinance authorizing Municipal Court to collect special expense fee for services performed on dismissed cases. The City Attorney read: ORDINANCE 1555 - AN ORDINANCE AUTHORIZING THE MUNICIPAL COURT TO COLLECT A SPECIAL EXPENSE FOR SERVICES PERFORMED ON DISMISSED CASES; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. Motion was made b ~ Councilperson Skelton to adopt Ordinance 1555 as read by the City Attorney. Second by Councilperson Clarke. The motion carried, 7 ayes and 0 nays. Council considered approving the request of New Jerusalem Church for a special conditional use permit to allow Church expansion in a residential zone. Motion was made by Councilperson Shi.Qu to approve the special conditional use permit for New Jerusalem Church. Second by Councilperson Lloyd. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Lloyd, Matuszak, Porter, Shipp, Gay, Skelton, Clarke and Mayor Malone Nays: None 12. Council considered approving an agreement with the Port of Houston Authority for emergency medical service for 1987-1990. Motion was made by Councilperson Matuszak to approve the agreement with the Port of Houston Authority for emer~ency medical services. Second by Councilperson Gay. The motion carried, 8 ayes and 0 nays. Council considered awarding a contract for a golf cart/pedestrian tunnel. Motion was made by Councilperson Skelton to award the bid for the golf cart/pedestrian tunnel to Allgood Construction Company in the amount of $120,188 ~9~ with the understanding that if the adjusted base bid can be met the amount will be $104,022.9. Second by Councilperson Porter. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Lloyd, Matuszak, Porter, Shipp, Gay, Skelton, Clarke and Mayor Malone Nays: None 14. Council considered awarding a bid for demolition of dangerous buildings. Motion was made b Y Councilperson Shinn to award the demolition bid to Walker's Dump Trucker Inc } in the amount of x.5050.00. Second by Councilperson Clarke. The motion carried, 8 ayes and 0 nays. Ayes: Councilpersons Lloyd, Matuszak, Porter, Shipp, Gay, Skelton, Clarke and Mayor Malone Nays: None 15. Administrative Reports: A. Replacement of radios and emergency lights for patrol units. Police Chief Charles Smith addressed this item. The Police Department is in need of funding in the amount of $49,050.00 in order to replace obsolete radios and emergency lights on patrol units. This would include purchase of ten (10 Motorola 8 channel Syntors at $2,800 each and conversion of seven (7) 4 channel Motorola Syntors at $900 each, and purchase of ten (10) "Edge" 9000 (or equivalent) light bars at $1,375 each and five (5) siren units at $200 each. ~ ~ Minutes, Public Hearings and Regular Meeting La Porte City Council August 10, 1987, Page 8 The City Manager advised Council that this is not a budgeted item and could not be added to the budget at this time. His recommendation was for Council to deny Chief Smith's request and for Chief Smith to pursue other avenues of possibly obtaining the needed funds. Council denied Chief Smith's request for funding. The City Manager queried Council as to their wishes regarding a mail-out to citizens advising them of the Town Meeting on August 22. Council generally agreed to the mail-out and the City Manager advised Staff to go ahead with the project. 16. Councilpersons Lloyd, Matuszak, Porter, Skelton, and Mayor Malone brought items to Council's attention. Councilperson Skelton requested that a special called meeting be held before the workshop meeting scheduled for August 17, in order to consider support of a candidate for the Port Commission position in the event that La Porte's selected candidate did not receive the appointment and there was a tie between the other two candidates. 17. Council adjourned into executive session at 7:55 P.M. to discuss the following items: A. Legal - Consult with attorney on sanitary landfill permit hearing Legal - Sweet Pea's alcoholic beverage permit hearing Personnel - Discuss applications of Port Commission candidates Council returned to the Council table at 8:52 P.M. 18. Jackson, owner and operator of J.P.'s Gu1F service station at 9901 Fairmont Parkway, has petitioned the City of LaPorte Council to rezone the property north and west of his present location from multi-family housing to light commercial. After meeting -with Mr. Jackson, at which time he discussed his plans to build a storage facility which would be sur- rounded by a cyclone fence and plants for eye appeal and lighted by at least six mercury-vapor lamps for security, this board unanimously appraved the following resolution which we respectfully submit for your consideration. Resolved that the board of directors of Fairmont Park West Community Improvement Association has investigated the potential impact of Mr. J.P. Jacksons' proposed plans on the surrounding community and unanimously agrees the beauty and value of surrounding properties will be enhanced with no hazards to the health or safety of residents - and therefore recommends to the City Council of the City of LaPorte that they approve the zoning change to accommodate Mr. Jacksons' petition. Jackson/Eddie Gray - Request to re-zone 165 x 140 ft. tract of the W.ri. Jones Survey A-482 From "R-3" to "GC" BACKGROUND & ANALYSIS The tract is question is located in an "R-3" zone. It is situated immediately behind J.P.'s Service Center at 9901 W. Fairmont Parkway. Eddie Gray is the owner of record and he has authorized Mr. Jackson to act as his agent for this re-zoning request. In considering this request there are several factors to be considered regarding zoning suitability and over-all impact of this development on the City's comprehensive plan. Zoning. The use proposed for this tract is a boat and R.V. storage facility with both inside and outside storage. A review of the zoning ordinance's use tables and the Standard Industrial Classification (S.I.C.) manual has not yielded a specific use number for this type of facility. Use numbers that could be applied to this type establishment are 4222 & 4226 (public warehousing). These uses are listed as permitted in B.I., L.I. and H.I. zones. Another use number that might be applied is 4469 (water transportation services). This use number specificlly includes storage and repair of boats, but it is not listed anywhere in the zoning ordinance. Staff has not found any use listing for R.V. storage. Section 6-400; Table A, does list open and outdoor storage as a conditionally permitted G.C. use, subject to the requirements of Section 6-600 B, (screening requirements). ,. ,, ,;. • Planning & Zoning Commission Jackson/Gray Request July 6, 1987 Page 2 • Because the proposed use falls into a gray area of the zoning ordinance, the first item to be determined is the suitability of this use in a G.C. zone. In making this determination it should prove helpful to refer to Section 6-301 (purpose) of the zoning ordinance. The site will be adjoined on four (4) sides by "R-3" property. The south side abutts the current facility which is a non-conforming use in a "R-3" zone. It is useful at this time to consider the section of the zoning text that addresses non-conforming uses as follows: Section 4 - 200 Non-Conforming Bt~ilding.~, Structures, and Uses The general public, the Planning Commission and the Board are directed to take note that non-conformities in the use and development of land and buildings are to be avoided, or eliminated where now existing, wherever and whenever possible, except when necessary to preserve property rights established prior to the date these regulations became effective as to the property in question, and when necessary to promote the general welfare and to protect the character of surrounding property. It shall be the responsibility of the Planning Commission and the Board to assist the City Council in achieving this goal by advising the City Council of their recommendations thereon. As necessary, the City Council may from time to time on its own motion or upon cause presented by interested property owners inquire into the existence, continuation or maintenance of any non-conforming use within the City. The following section should also be noted: Section 4-202 Non-Conforming tlses 1. Continuance of Non-Conforming Uses: Any non-conforming use may be continued in operation on the same land area and on the same floor in a structure of structures which were occupied by the non-conforming use on the effective date of any amendment by which the use became non-conforming, but such land or floor area shall not be increased, except that such limitation shall not apply for farming uses. These sections clearly intend to prevent the enlargement of non-conforming uses and structures. The request is for the 140 x 165 tract only and would place this single tract in the middle of an "R-3" zone surrounded on four sides by "R-3" property. This situation is usually termed spot zoning and is extremely poor zoning practice. • • Planning & Zoning Commission Jackson/Gray Request July 6, 1987 Page 3 A review of the zoning map and its development process indicates that; (1) the tract in question is about 100 ft. from the "R-3" zone to the east, (2) the zoning conformed, as much as possible, to the current owners plan for the area; (3) no commercial use was proposed for this location on the land use plan and (4) the intent of the closest commercial zone is that of "NC" Neighborhood Commercial. This use does not fall within a "NC" use. The development will not impact the traffic and utility provisions of the comprehensive plan. It does however, appear to run contrary to the intent of the land use plan. The intent of the plan is to establish a ratio governing types of land use within the City, and to provide buffers between commercial and lower density residential areas. CONCLUSION The request is not in conformance with the land use plan. It would become an island of "GC" - General Commercial, within an "R-3" zone. This zone change request is contrary to the intent stated for non-conform~.ng uses. Based on the information there is no technical. support for this proposed zone change request. Jackson's request to rezone the above mentioned tract from "R-3'r to G.C. was considered by the Planning and Zoning Commission during the July 16, 1987 meeting. The following concerns were raised by the Commission while discussing this matter: (1) That approval of this request would not be in keeping with the City's firm intention of avoiding spot zoning. (2) Tha~t~this request deviates from the intent of the City's Comprehensive plan, specifically the land use portion of the plan. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte here- by finds, determines and declares that heretofore, to-wit: on the 16th day of July, 1987, at 7:00 P.M., a public hearing was held before the Planning and Zoning Commission of the City of La Porte, Texas, pursuant to due notice, to consider the question of the possible re-classification of the zoning classi- fication of the hereinafter described parcel of land. There is attached to this Ordinance as "Exhibit A," and incorporated by reference herein and made a part hereof for all purposes, a copy of "Notice of Public Hearing" which the City Council of the City of La Porte hereby finds was properly mailed to the owners of all properties located within two hundred feet (200') of the properties under consideration. This property is zoned as R-1. They are proposing to build a new recreational/education building, and parking lot located adjacent to their existing facility. Section 5-600, Table A of the Zoning ordinance lists religious institutions as a conditionally permitted use in R-1 zones. This use must meet the requirements of Section 5-800(A). These requirements are as follows: A. A green belt planting strip shall consist of evergreen groundcover, and shall be of sufficient width and density to provide an effective screen. The planting strip shall not be leSS than six (6) feet in height. Earth mounding or berms may be used, but shall not be used to achieve more than two (2) feet of the required screen. The planting plan and type of shrub shall require the approval of the Planning Commission, based upon a recommendation of the Director of Community Development. A required screening fence shall be constructed of masonry, brick, wood, or steel. Such fence shall provide a solid screening effect, and not exceed eight (8) feet in height. The design and materials used in constructing a required screening fence based upon a recommendation by the Director of Community Development. Screening will be required in the following situations: a. 8ecreational buildings, community centers, religious, and'; private and public educational institutions: i; '~ b. manufactured housing parks and subdivisions screened from abutting uses. The church is requesting a special exception to the setback requirements of Section 5-700, Table B. This section designates the following setbacks for religious institutions: 30 ft. - front 20 ft. - rear 10 ft. - side The church is specifically requesting exceptions to the front and rear setback requirements. They are making this request under the guide lines set forth in Section 11-605 (2) & (4). Item 2 deals with rear yards and reads as follows: A rear yard exception where the actual rear yard setback of any four (4) or more lots in the same blocl; does not meet the rear yard requirements of these regulations. EMERGENCY AMBULANCE SERVICE REQUIREMENTS Contractor covenants and agrees to furnish ambulance service in compliance with th'e following requirements: ~. (1) Contractor shall have and maintain at least two (2) ambu- lances and crews available twenty-four (24) hours daily for emergency dispatch, in conformity with the standards set ~ ~ -2- forth in Paragraph III hereof. Contractor reserves the right to arrange for back-up units when both of the two (2) ambulances are in service, and the further right to activate mutual assistance agreements with other governmental enti- ties in the event of calamity or disaster conditions. Nothing set forth herein is meant to diminish the ability of Contractor to arrange for back-up units when both of the two ambulances are in service, or diminish the right of Contractor to activate mutual assistance agreements with other governmental entities in the event of calamity or disaster conditions. (2) Equipment and crews shall be located at a point or points within the City of La Porte to be selected by Contractor. It is the intention of the parties that same shall be so located that an ambulance can reach any area within the premises of Port within a reasonable period from the time of dispatch, and it is within the contemplation of the parties that ten (10) minutes is deemed to be a reasonable period of time. III. STANDARDS REQUIRED FOR AMBULANCES AND ACCESSORY EQUIPMENT Contractor covenants and agrees to furnish at his own expense ambulances and accessory equipment which comply with the following standards: (1) A total of '';not less than two (2) Mobile Intensive Care ambulances shall be furnished by the Contractor twenty- four (24) hours a day, to the premises of Port. Provided, that said two (2) ambulance requirements shall not apply, when either or both of said units are engaged in providing emergency ambulance service to a point or points as contemplated within the contract area, said contract area specified in paragraph XIII. One of said units may be on call at a backup location within the City of La Porte or the premises of Port upon dispatch of the initial unit required to be maintained within the City of La Porte. Each vehicle must have a patient capacity of not less than two (2) patients. (2) All ambulances must be inspected and approved by the Chief of Emergency Medical Services of the City of La Porte and must be of a type and design suitable for transporting injured persons. Said vehicles shall be at all times in a state of good mechanical repair and shall be equipped with tires in good condition and not showing unusual wear. (3) All such ambulances must be licensed as Mobile Intensive Care Units in compliance with Article 44470 of the Revised Civil Statutes of the State of Texas, and amendments thereto, and in compliance with the Rules and Regulations of the State Board of Health. ,~ , (4) (a) Each'; ambulance shall be equipped with a two-way radio which transmits and receives on frequencies designated fore-use by the City of La Porte. -3- (b) Radios will be operated on City of La Porte local government frequency - 155.625 megacycles, or such other frequency which the City may designate. (c) Radios must be maintained to meet current F.C.C. specifications. The maintenance costs will be borne by the Contractor. (d) Radios must have an annual frequency check by the City of La Porte Radio Technician. (e) Contractor will comply with all F.C.C. regulations. The assigned radio frequency is shared with other City services. Contractor shall keep all radio messages brief and clear, and shall avoid unnecessary transmis- sions. (7) The Emergency Medical Services Chief of the City of La Porte shall determine the standards for ambulance equipment. In determining the adequacy of equipment, the Emergency Medical Services Chief shall take into consideration the current list of minimal equipment for ambulances as required by Article 44470 of the Revised Civil Statutes of the State of Texas. IV. INSPECTION AND APPROVAL OF AMBULANCES AND ACCESSORY EQUIPMENT BY CITY All ambulances and accessory equipment shall be subject to inspection by the Emergency Medical Services Chief of the City of La Porte, or his duly appointed representative, and if at any time same are not in compliance with the provisions hereof, or if any ambulance is in need of mechanical repairs in order to insure its satisfactory condition, then such ambulance shall not be used until all defects are remedied to the satisfaction of the Emergency Medical Services Chief. Appropriate substitute equipment shall be provided in the event any vehicle or equipment is not available for service for one (1) week, and '..immediate written notice of such shall be furnished by Contractor to Port. V. TRANSPORTATION TO HOSPITAL Contractor shall transport patient to the nearest hospital pro- viding an emergency service, that will take the patient, unless the patient's safety or the patient him or herself specifically dictates otherwise. In the;;~,:event the patient is incapacitated, the Paramedic -4- • attendant shall designate transportation of patient to the nearest hospital. VI. CHARGES PERMITTED CONTRACTOR Contractor shall be permitted to charge the following base charge, to-wit: (1) Ambulance Service and Invalid Coach Service: (a) Contractor shall be entitled to charge fees for its services rendered, said fees being subject to change from time to time upon thirty (30) days written notice from Contractor to Port. The fees chargeable by Contractor to Port on the effective date of this Contract are specifically enumerated on Exhibit "B", attached hereto and fully incorporated by reference herein. Contractor shall be entitled to change said fees upon written notice to Port, said fee change be- coming effective on the thirtieth (30th) day following delivery of the written notice from Contractor to Port. (b) Method of dividing cost among patients if more than one if carried in the same ambulance simultaneously to one hospital: One and one-half (1-1/2) times the regular rate, divi- ded by the number of patients transported; each patient to pay, equal amount. Contractor shall never deny emergency service because of a person's inability to pay. (c) The collection of such fees shall be the sole responsi- bility of the said Contractor. Contractor shall vigor- ously pursue the collection of any such fees. Fees specified in said Exhibit "B" may be subject to change, upon approval of the Port, from time to time. VII. DISPATCHING Contractor shall have its own telephone number, with a minimum of two (2) incoming lines. Emergency calls shall be received by Contractor at the 911 Emergency Service number. VIII. COMPLIANCE WITH LAW AND ORDINANCES Contractor agrees to operate the ambulances in accordance with the requirements of the State and Federal law, and applicable municipal ',:r .'. or county ordinane~s, as the same now exist, and as may be amended ~; from time to time hereafter. -5- IX. LIABILITY INSURANCE During the term of this contract and any extensions thereof, Contractor shall purchase and keep in full force and effect, public liability insurance on each of its ambulance units, and professional liability insurance (mal~~ractice insurance) on each of its employees administering patient care, with minimum limits of One Hundred Thousand Dollars ($100,000.00) for property damage; One Hundred Thousand Dollars ($100,000.00) for each person; and Three Hundred Thousand Dollars ($300,000.00) for each accident. In addition, Contractor shall keep and maintain Worker's Compensation insurance on its employees. In addition, Contractor shall maintain collision and liability insurance on the ambulances as described on Exhibit "A", with at least maximum limits of One Hundred Thousand .Dollars ($100,000.00) per occurance property damage; One Hundred Thousand Dollars ($100,000.00) per person; Three Hundred Thousand Dollars ($300,000.00) per occurance for bodily injury; and uninsured and under-insured motorists coverage pro- viding at least One Hundred Thousand Dollars ($100,000.00) per person, and Three Hundred Thousand Dollars ($300,000.00) per occurance on bodily injury. Notwithstanding the foregoing, Contractor shall not be required to obtain insurance in excess of liability limits established in the Texas Tort Claims Act, Vernon's Revised Civil Statutes, Art. 6252-19 et seq, in cases where said Act is applicable. Contractor shall file certificates of insurance coverage with Port during the teem of this contract and any extensions thereof. On all said insurance policies, Port shall be named as an additional insured. X. INDEPENDENT CONTRACTOR It is expressly agreed and understood by all parties hereto that Contractor is an independent. contractor in his relationship to Port. XI. INDEMNIFICATION AND ASSUMPTION OF LIABILITY Contractor covenants and agrees to indemnify, and does hereby indemnify, hold harmless and defend, Port, its agents, servants or employees, from and against any and all claims for damages or injuries to persons or property of whatsoever kind or character, whether real or asserted, arising out of or incident to the operation of its emergency ambulance service and all other of its operations arising under or otherwise incident to the provisions of this contract; and Contractor hereby assumes all liability and responsibility for inju- ries, claims or suits for damages to persons or property, of whatever kind or character, whether real or asserted, occuring during the term of this agreement, arising out of or by reason of the operation of its emergency ambulance service and all other of its operations arising under or otherwise incident to the provisions of this contract. XII. REVOCATION OF CONTRACT Port and Contractor may cancel this contract, without cause, after ninety (90) days prior written notice from the cancelling party to the other party. Such notice shall be sent by Contractor to Port at: Post Office Box 2562, Houston, Texas 77252. Such notice shall be sent by Port to Contractor at: City of La Porte, Post Office IIox 1115, La Porte, Texas 77571, Attn: City rianager. XIII. SERVICE AREA Contractor's primary obligation hereunder is to serve the area described as the premises of Port referred to in Paragraphs II and III r,. ,, above, plus the area within the City of La Porte's Battleground Indus- ;;; trial District, the City of La Porte's Bayport Industrial District, ~ ~ -7- and any other entities within the extraterritorial jurisdiction of the City of La Porte. Contractor, however, shall have the right and privilege to furnish ambulance service to other entities, including cities and water districts, within the boundaries of the La Porte Independent School District; provided, that the basic level and quality of service to Port, as provided for herein, is not diminished. Contrac- for shall not enter into any contract with any such other city, water district or industry, containing terms and provisions more favorable to any such city, water district or industry, than those contained herein. Contractor shall be entitled to retain revenues received under such other contracts. Contractor shall charge its usual and customary fees for such service within such other cities and entities, which fees shall not be less than those prescribed hereunder. Con- tractor shall file a copy of any such other agreement with Port, within fifteen (15) days of the execution thereof. ~' XIV. PAYMENTS TO CONTRACTOR Port shall make a payment to Contractor on or before the day of 1987, of SIX HUNDRED DOLLARS ($600.00), with a like installment being payable and due from Port to Contractor on or before the first day of each subsequent month thereafter, during the term of this contract as described herein. XV. TERM This Contract shall become effective at 12:01 a.m. Central Day- light Time, on the 1st day of October, 1987, and shall remain in full force and effect until the 30th day of September, 1990, unless otherwise cancelled as provided in paragraph XII above. We have reviewed your request in depth, understanding the expense involved in constructing the tunnel, and find we would not be able to approve this grade crossing due to the hazards it would protend to pedestrians, carts, and the tra- veling public; even at a reduced speed limit in the area as you suggested. It is our recommendation that the proposed tunnel be provided for crossing at this location. If we may be of further assistance, please contact Mr. Bob Stafford of my office at 869-4571. Smith, Chief of Police SUBJECT: Replacement Radios and Emergency Lights for Patrol Units DATE: July 15, 1987 Sir: I am requesting funding in the amount of $49,050.00 to replace obsolete radios and emergency lights on patrol units. This is not a budgeted item. At this present time, ten (10) of the patrol fleet vehicles are equipment with Micor radios that are ten (10) years old. These radios have met and exceeded their useful life. As electronic equipment ages, its reliability decreases and needs to be replaced. Item 1: Purchase Ten (10) Motorola 8 channel Syntors $2,800.00 each $28,000.00 Convert Seven (7) 4 channel Motorola Syntors C $ 900.00 each $ 6,300.00 Ten (10) of the fleet cars are equipped with emergency light bars that are approaching ten (10) years old. Five (5) of these are the obsolete twin beacon ray type light bars and need replacement. • Item 2: Purchase Ten (10) "Edge" 9000 (or equivalent) light bars @ $1,375.00 each $1,750.00 Five (5) siren units @ $ 200.00 each 1000.00 TOTAL REQUESTED $49,050.00 Purchase of this equipment is necessary for the safety of the officers and the citizens they serve. In the area of radio's, poor or marginal communications is a's bad as no communication at all.
