OCTOBER 12, 1987
1. The meeting was called to order by Mayor Malone at 6:07
P.M.

2. The invocation was given by Mayor Malone.
3. Council considered approving the minutes of the regular
meeting held September 28, 1987.
Motion was rnade by Councilperson Skelton to approve the
minutes of September 28 as presented. Second by
Councilperson Clarke. The motion carried, 5 ayes and 0
nays.
Ayes: Councilpersons Matuszak, Porter, Skelton, Clarke and
Mayor Malone
Nays: None
4. There were no citizens wishing to address Council.
5. Council considered a resolution nominating a member for the
Harris County Appraisal District.
Motion was rnade by Councilperson Steelton to nominate Tom
Bartlett as a member of the Harris County Appraisal
District. Second by Councilperson Mat;uszate. The motion
carried, 5 ayes and 0 nays.
Ayes: Councilpersons Matuszak, Porter, Skelton, Clarke and

alternate representative to Houston-Galveston Area Council
General Assembly.

Motion was made by Councilperson Clarke to designate B. Don
_Skelton as representative and Ed Matuszak as alternate
representative to the Houston-Galveston Area Council
General Assembly. Second by Councilperson Porter. The
motion carried, 5 ayes and 0 nays.

7. Council considered awarding a bid for sign materials.
Motion was made by.Council~erson Matuszak to award the bid
for sign materials to Vulcan Sims. Second by
Councilperson Skelton. The motion carried, 5 ayes and 0
nays.

8. Administrative Reports
The City Manager reported that starting with the October
billing, a 7 percent sales tax wi_11 be added to the charges
for garbage service for' all users except schools and
churches. The added charge is due to recent State
?.egislata.on which taxes many services not previously taxed.
The City Manager presented a status report on the CIP
Manager third-party contract. Several firms have been
interviewed, and the choice narrowed down to three: CRS
Sirene, Dannenbaum Engineering, and Project Managerlent
Services. He hopes to come before Council. in about a week
with the service contract.
The third item mentioned was a joint workshop meeting with
the Golf Course Advisory Board on October 14.
The last item was far Council's consideration of having a
called meeting of Council on October 19, in order to bring
several items to Council's attention. These are Little
Cedar Bayou Park, third-party administration contract, and
other items. It was decided to hold the meeting at 7:00
P.M., i_f possible, due to several Council members having a
previous commitment.

10. There was no executive session due to the scheduled item
having already been addressed during the meeting.
11. There being no further business to come before the Council,
the meeting was duly adjourned at 6:25 P.M.

During the last session of the Texas Legislature, Section 6.03 of the Property Tax
Code was amended to confer on the chief appraiser of an appraisal district those
ministerial functions previously conferred on the county clerk with respect to the
election of members of the board of directors of an appraisal district. This
amendment became effective on September 1, 1987.
Members of the Board of Directors of the Harris County Appraisal District serve two-
year terms beginning January 1 of each even-numbered year. Accordingly, the
election of members of such Board of Directors must be conducted this fall to select
those persons who will serve in that capacity for the terms beginning January 1,
1988, and ending on December 31, 1989.
Pursuant to the provisions of the Property Tax Code and resolutions adopted in 1981
by more than three-fourths of the taxing units entitled to vote on the selection of
members of the Board of Directors of the Harris County Appraisal District, such
Board of Directors is composed of five members. Of this number, one director is
appointed by the Commissioners Court of Harris County; one is appointed by the
City Council of the City of Houston; one is appointed by the Board of Trustees of the
Houston Independent School District; one is selected by the governing bodies of all
incorporated cities and towns, excluding the City of Houston, within the Appraisal
District; and one is selected by the governing bodies of all school districts, other
than the Houston Independent School District, within the Appraisal District.
To be eligible to serve on the Board of Directors, an individual must be a resident of
the Harris County Appraisal District and must have resided in the District for at least
two years immediately preceding the date he or she takes office. An individual who
is otherwise eligible to serve as a member of an appraisal district board of directors
is not ineligible because he or she is a member of the governing body of a taxing
unit or because he or she is an elected official. However, by an amendment to
Section 6.03 of the Property Tax Code effective September 1, 1987, an employee of a
taxing unit that participates in the Harris County Appraisal District is no longer
eligible to serve on the District's Board of Directors unless such individual is also a
member of the governing body or an elected official of a taxing unit that
participates in the District. By way of example only, a member of the governing

body of a school district who is also a city employee would be eligible to serve on
the Appraisal District's Board of Directors. (It should be noted that the foregoing
limitation does not affect the eligibility of a person serving a term as director of an
appraisal district on the effective date of this change in the law to serve for the
remainder of his or her present term of office.)
The procedures to be employed in the selection of members of the Board of
Directors of the Harris County Appraisal District for the two-year term commencing
on January 1, 1988, are as follows:
FOR CITIES AND TOWNS OTHER THAN THE CITY OF HOUSTON
Each city and town, other than the City of Houston, may nominate one candidate
for that position on the Appraisal District's Board of Directors to be filled by such
cities and towns. Such nomination must be by resolution duly adopted by the
governing body of such city or town.
On or before October 14 1987, the presiding officer of each
governing o y ma ing suc a nomination must submit the name of
such city's or town's nominee to the Chief Appraiser of the Harris
County Appraisal District. Such submittal should be in the form of or
accompanied by a certified copy of the resolution making such
nomination.
On or before October 29, 1987, the Chief Appraiser of the Harris
County Appraisal District will prepare a ballot, listing the candidates
nominated by such cities and towns alphabetically according to the
first letter in each such candidates surname, and deliver a copy of such
ballot to the presiding officer of the governing body of each such city
and town.
On or before November 14 1987, the governing body of each such
city an towns all cast, y resolution, its vote for the one candidate
of its choice and submit the same to the Chief Appraiser. Such
submittal should be in the form of or accompanied by a certified copy
of such resolution.
On or before November 30 1987, the Chief Appraiser will count the
votes cast y suc cities an towns, declare the results thereof, and
submit the same to the governing body of each such city and town
and to each of the candidates nominated by such cities and towns. In
the event of a tie vote, the same will be resolved by a method of
chance chosen by the Chief Appraiser.
FOR SCHOOL DISTRICTS OTHER THAN
THE HOUSTON INDEPENDENT SCHOOL DISTRICT
The candidates nominated and the candidate selected by all school districts, other
than the Houston Independent School District, within the Harris County Appraisal
District shall be nominated and selected by such school districts at the same time

and in the same manner as that heretofore described for all cities and towns, other
than the City of Houston, within the Harris County Appraisal District.
FOR THE COUNTY OF HARRIS THE CITY OF HOUSTON
AND THE HOUSTON INDEPENDENT SCHOOL DISTRICT
On or before November 14 1987, each of the governing bodies of the
County o Harris, t e City o Houston, and the Houston Independent
School District shall appoint, by resolution, one member to the Board
of Directors of the Harris County Appraisal District for atwo-year term
of office commencing on January 1, 1988.
On or before November 30 1987, each such governing body shall
eliver or cause to a elivere a certified copy of the resolution
appointing its representative to such Board of Directors to the
Secretary of the Board of Directors of the Harris County Appraisal
District.
The names and addresses of the Secretary of the Board of Directors and the Chief
Appraiser of the Harris County Appraisal District are as follows:

A RESOLUTION OF TKE CITY COUNCIL OF THE CITY OF LA PORTS, TEXAS,
NOMINATING A CANDIDATE FOR A POSITION ON THE BOARD OF DIRECTORS
OF THE HARRIS COUNTY APPRAISAL DISTRICT
WHEREAS, those cities and towns, other than the City of
Houston, within the Harris County Appraisal District have the
right and responsibility to elect one person to the Board of
Directors of the Harris County appraisal District for a term of
office commending on January 1, 1988, and extending through
December 31, 1988; and
taHEREAS, this governing body desires to exercise its right
to nominate a candidate for such position on said Board of
Directors.'
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LA PORTS, TEXAS:
Section 1. That the facts and recitations set forth in the
preamble of this Resolution be, and they are hereby, adopted,
ratified, and confirmed.
Section 2. That Tom Bartlett be, and he or
she is hereby, nominated as a candidate for that position of the
Board of Directors of the Harris County appraisal District to be
filled by those cities and towns, other than the City of Houston,
within the Harris County Appraisal District for a two-year term
of office commencing on January 1, 1988.

SUMMARY ~ RECOMMENDATION
The 1988 Houston-Galveston Area Council General Assembly will
meet in February. As a member of H-GAC, the City, being a home
rule city with population under 99,999 according to the 1980
census, is entitled to designate one representative and one
alternate to the Assembly. These designees must be elected
official members of our governing body.
Since there will be a dinner meeting of home rule city
representatives on November 19, our designees must be received by
H-GAC by October 26, so that they can forward an agenda to our
representatives.
The resolution included in this agenda item request is the
form sent by H-GAC for our use.

I am writing regarding the appointment of your city's representative to
H-GAC's 1988 General Assembly.
H-GAC's Bylaws provide that each member home rule city under 99,999
according to the 1980 U. S. Census is entitled to designate one representative
and one alternate to the H-GAC General Assembly, which will meet in February.
I am enclosing the appropriate form for your use in officially designating
a representative and alternate. The designees must be elected official mem-
bers of your city's governing body (Bylaws attached).
A dinner meeting of home rule city representatives is scheduled for
November 19. Details of this meeting will be sent to you when arrangements
have been completed. At that meeting your 1987 H-GAC Board representatives
will report on this year's activities, and look ahead to issues and progress
of 1988.
Your attendance and participation in this meeting is particularly valuable,
since it gives your representatives and the H-GAC staff insight on your wishes
and needs. The main business item for the meeting will be selection of two
representatives to serve as 1988 members of the H-GAC Board of Directors. An
agenda for the dinner meeting will be forwarded to your representatives as
soon as we have received your official designations.
In order that arrangements for our meeting can be completed, we would
appreciate receiving your 1988 General Assembly designations by October 26,

DATE: September 24, 1987
Advertised sealed bid 440212 for sign materials were opened and read in City Council
chambers on September 21, 1987. Bid requests were mailed to five suppliers with the
following four returning bids: (1) Safety Lights Company, (2) Vulcan Signs, (3)
Crabtree Barricade Systems, and (4) Road Runner Traffic Supply.
Materials were divided into two sections as follows: Section I - Reflective sheeting,
letters and numbers, and sign faces, and Section II - Blanks, hardware, and channel
posts. All material in section 1 had to meet M.U.T.C.D. specifications for reflective
sheeting and must also be approved by the Texas Highway Department Materials Testing
Division.
Low bid meeting specifications was submitted by Vulcan Signs.
Please submit your recommendation along with an agenda.request.form by the prescribed
time before the next regular Council meeting. If there is a need to delay bringing
this to Council, please notify me.

Sales Tax on Garbage Fees
October 7, 1987
The state sales tax base has been broadened with the passage of
House Bill 61 to include many new services not previously taxed.
Among these included is garbage and other solid waste collection
or removal services.
4Jhen the October service is billed a seven percent sales will be
included in the charges for garbage service. However, the state
does exempt our schools and churches from collection of this
tax.
The new sales tax rate effective October 1, 1887 was brought to
six percent. The City of La Porte also invokes a one percent
sales tax on taxable goods and services within our city limits.
This gives a total sales tax of seven percent.
The Revenue Collection Division will begin billing the sales tax
on our utility bills in late October. This tax is mandated by
state legislation and is not invoked or changed at the local level
of government.
