minutes of the October 12 meeting as presented. Second by

After a presentation by Director of Parks and Recreation
Stan Sherwood and comments by the City Manager, motion was

the proiect in smaller packages. Second by Councilperson
Gay. The motion carried, 6 ayes and 0 nays.

10. Council considered adoption of tax rate and considered
setting a public hearing date.
The City Manager addressed Council and stated that Staff
recommends a tax rate of 66 cents per X100 of valuation.

Motion was made by Councilperson Skelton__that the tax rate
be set at 66 cents per $100 of valuation and that a public
hearing be set for November 2,. 18.7. Second by
Councilperson Shipp. The motion carried, 6 ayes and 0
nays.

11. Administrative Reports:
A. Stan Sherwood introduced Tim O'Connor and David Pippin,
staff members of the Parks and Recreation Department. Mr.
O'Connor presented a brief history of the Texas Games and a
video made at the 1987 Texas Games was viewed by Council.
The 1989 Games will be partially hosted by the City of La
Porte, and help will be needed in many areas from staff and
Council, as well. as interested citizens.
B. In the absence of Chairman David Brady, member Dennis
Dunham of the Golf Course Advisory Board made a
presentation to Council on the naming of the golf course.
The name selected as winner in the contest to name the golf
course is La Porte's Bay Forest. Second place name was La
Porte Bayshore Golf Course, and third place name was 13-a-y ~~~.~"~,
If there is no conflict with this name being used
elsewhere in the area, La Porte's Bay Forest will be used.
C. City Manager Bob Herrera announced that there will be a
Houston International Business-Expo held at Astrohall on
October 22, from X4:00 to 9:00 P.M. The La Porte Bayshore
Chamber of Commerce and the City will join together for a
booth at the Expo. It is felt that this will be good
publicity for La Porte and what it has to offer.
Councilperson Skelton reported on the businesses that will
be represented and the type of booth that La Porte will
offer. Councilperson Porter said any volunteers to help
with the booth will be welcome.
12. Council Action:
Councilpersons Porter, Shipp, Gay, Skelton, Clar4ce and

Budget Analysis and Memorandum
SUMMARY & RECOMMENDATION
During the six (6) month Budget review process, heavy trash pick
up removal was increased to twice a month pick up. This option
was approved in May, 1987. Comparison of expenditures and revenue
resulted in the recommended $1.00 a month increase for residential
trash pick up during FY87-88 budget preparation. Our revenue
projections in our adopted budget include the $1.00 a month fee
increase, bringing the fee to $7.50 a month.
Attached is an ordinance amendment to increase the fee $1.00.
Staff recommends the ordinance be adopted.

SUBJ: Residen ial Solid Waste Fees
DATE: October 13, 1987
Attached for your consideration is an ordinance amending our
present fee for residential trash pick up by $1.00. This need has
been brought about by increasing our heavy trash pick up to a
twice a month service.
Review of our expenditures and revenue depicts rising costs and a
greater gap between the two. This was reviewed during our budget
preparation and workshops. We have included the $1.00 per month
fee increase in our adopted budget revenue projections, as
previously stated during Council budget workshops. Staff
concludes this fee increase is needed and is therefore my
recommendation.

AN ORDINANCE AMENDING ARTICLE III, SECTION 12-41, SUB-PARAGRAPH (a), "GARBAGE AND
TRASH," OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTS; REFLECTING A NEW RATE

WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTS:
Section 1. Sub-paragraph (a), Section 12-41, of the Code of Ordinances of
the City of La Porte, is hereby amended, to hereafter read as follows, to-wit:
"Sec. 12-41. Rates prescribed--For residences.
(a) There shall be charged, assessed and collected, for
garbage, trash and rubbish collection by the City from residential
dwelling .units, which term shall be construed to include duplex
units, individual apartment units, and individual mobile homes at
mobile home parks, the sum of seven dollars and fifty cents
($7.50) per unit per month, plus applicable sales tax."
Section 2. The City Council officially finds, determines, recites and
declares that a sufficient written notice of the date, hour, place and subject of
this meeting of the City Council was posted at a place convenient to the public
at the City Hall of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil
Statutes Annotated; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject matter thereof
has been discussed, considered and formally acted upon. The City Council further
ratifies, approves and confirms such written notice and the contents and posting
thereof.
Section 3. If any section, sentence, phrase, clause, or any part of any
section, sentence, phrase, or clause, of this ordinance shall for any reason, be
held invalid, such invalidity shall not affect the remaining portions of this
Ordinance, and it is hereby declared to be the intention of this City Council to
have passed each section, sentence, phrase or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase or clause, or
part thereof, may be declared invalid.

Section 4. This Ordinance shall be effective from and after its passage and
approval. The rates established hereunder shall be effective for billings after
October 19, 1987.

SUMMARY & RECOMMENDATION
Ordinance
At the Texas Municipal League conference held October 8-10, 1987,
the TML Executive Board passed resolutions endorsing the passage
of several amendments to be addressed by voters at the General
Election on November 3, 1987. These resolutions were subsequently
approved by the TML membership.
The attached City of La Porte resolutions presented for your
consideration at this time are based on the resolutions passed at
TML. It is very important that these amendments be approved on
laJovember 3, as they are beneficial to all Texas cities and their
citizens.

SUPPORTING AMENDMENT NUMBERS 7, 8, AND 23 ON THE NOVEMBER 3,
1987, GENERAL ELECTION BALLOT
WHEREAS, Amendment No. 7 on the November 3, 1987, general
election ballot will, if passed, provide authority for $400
million in state general obligation bonds to finance local
public facilities; and
WHEREAS, Amendment No. 8 on the same ballot will, if
passed, provide authority for $500 million in state general
obligation bonds to finance correctional and/or MHMR
facilities; and
WHERE~IS, Amendment No. 23 on the same ballot will, if
passed, provide authority for $400 million in state bonds for
water supply, water quality, and flood control purposes; and
WHEREAS, Amendments 7, 8, and 23 comprise the "Build
Texas~~ program which TML actively supported during the 70th
Regular Session of the Texas Legislature; and
WHEREAS, the Build Texas Program, particularly Amendment
No. 7, will assist Texas cities in providing needed public
facilities.

RESOLUTION N0. 87-18
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF LA PORTS
SUPPORTING AMENDMENT N0. 17 ON THE NOVEMBER 3, 1987, GENERAL
ELECTION BALLOT
WHEREAS, the Texas Legislature has passed and the Governor
has signed historic tort reform measures; and
WHEREAS, those tort reform measures are highly
advantageous for Texas cities and will provide a large measure
of predictability and stability with regard to municipal
liability; and
I~;HEREAS, one of those tort reform measures has caused the
following proposed Constitutional amendment to be placed on the
November 3, 1987, general election ballot:
"The constitutional amendment authorizing the
Legislature to define for all purposes the governmental
and proprietary functions of a municipality;"
and
WHEREAS, such amendment shall appear on the ballot as
Amendment No. 17; and
WHEREAS, the passage of Amendment No. 17 is needed to
ensure meaningful and lasting tort reform for Ter.as cities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LA PORTS
THAT the City Council of the City of La Porte supports the
passage of Amendment No. 17, and encourages other municipal
officials to also support this Amendment.

A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF LA PORTS
SUPPORTING ECONOMIC DEVELOPMENT INITIATIVES ON THE NOVEMBER 3,
1987, GENERAL ELECTION BALLOT
WHEREAS, Texas cities actively supported economic
development measures during the last regular session of the
Texas legislature; and
WHEREAS, economic development programs are vital to the
continued fiscal health of Texas cities; and
WHEREAS, Amendment No. 4 on the November 3, 1987, general
election ballot will, if passed, authorize the legislature to
provide for programs and to make loans and grants of public
money to aid economic development in Texas; and
WHEREAS, Amendment fIo. 5 on the same ballot will, if
passed, authorize certain cities to aid the construction of
turnpikes, toll roads, and toll bridges by guaranteeing bonds
issued by the Texas Turnpike Authority; and
Z~'HEREAS, Amendment No. 6 on the ballot will, if .passed,
authorize the legislature to provide for state financing of the
development and production of Texas products and businesses;
and
Z,iHEREAS, Amendment P1o. 11 on the ballot will allow local
option property tax exemptions for inventory located
temporarily in the state; and
WHEREAS, Amendment No. 19 on the ballot will, if passed,
allow the legislature to authorize $500 million in general
obligation bonds to support the U.S. Department of Energy's
superconducting supercollider if it is sited in Texas; and
WHEREAS, these five amendments have great potential to
assist Texas cities in their economic development efforts.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LA PORTS
THAT the City Council of the City of La Porte supports
passage of Amendments ~, 5, 6, 11, and 19.

General contractor for construction of Little Cedar Bayou
Park CLP 486-5201.
In the June 1985 Bond election the voters approved the sale
of bonds for construction of a Regional Park to be located
along Little Cedar Bayou. A total of $1.1 million in bonds
were sold. In addition the City received a grant from Texas
Parks and Wildlife in the amount of $680,000.
On September 11, 1987 the City opened bids for construction.
The apparent low bidder was Gamma Construction with a bid of
$1,732,078 and a construction schedule of 240 calendar days.
The second low bid was received from Strata Build, Inc., with
a bid of $1,782,000 and a construction schedule of 222 days.
Staff does concur with architect's recommendation that City
Council reject all bids submitted for the Little Cedar Bayou
Park and instruct staff to initiate the rebidding process
immediately.
Action Required by Council:
Reject all bids submitted for the construction of Little
Cedar Bayou Park and instruct staff to start the rebid
process.

SUBJECT: Little Cedar Bayou Park
On September 11, 1987 the City opened bids for construction. The
apparent low bidder was Gamma Construction with a bid of $1,732,078
and a construction schedule of 240 calendar days. The second low
bid was received from Strata Build, Inc., with a bid of 1,782,000,
and a construction schedule of 222 days.
We have received a recomrnendation from our Park Consultants,
S.W.A.,concerning the bids for Little Cedar Bayou Park. S.W.A. is
recommending for the rejection of a7.1 bids and for the rebidding of
the project through smaller parcels a.e., the buildings as a separate
bid, the pool as a separate bid and the sate work as a separate bid.
They have suggested that this process would bring several additional_
bidders into the arena, who are speci.alasts in the respective area;,
they will be bidding. The net result wi]_1 hopefully be a reduced cost
to the City for the park project.
Another advantage of the rebidding process is the maintaining of the
quality of the Little Cedar Bayou Park. Should we use the existing
bids we would need to negotiate to reduce the bid price by reducing
the items and quantities, thereby reducing the overall quality of the
project. As reflected in the attached recommendations for price
reductions.
There are some distinct disadvantages to the rebid process, they are
as follows:
1. Time loss - the project would not be completed until later in
the summer of 1988. The attached rebid schedule reflects a
completion date of August 15th, but a more realistic date
should be around September 1st.

2. Management - the project manager caill have a greater amount
of difficulty coordinating multiple contractors instead of a
singular contractor due to their overlapping work areas.
3. Revenues - there will be a loss in the revenues projected in
the 1987-88 budget for the pool located within the project
because of the time delays. Offsetting somewhat, the loss in
revenue, will be the reduction of personnel needed to
maintain the park and to operate the pool.
~4. Existing pool - there will be the increased expense for the
operation of the existing pool for one more season. There
are some existing problems today with the rrrunicipal pool
involving several leaks which need to be repaired before we
operate the pool next year. The costs for the repairs have
not been ascertained as of this date.
Based on the recommendation from S.W.A. and our concern for quality we
would lose through the negotiation process, staff does concur with
S.W.A. and does recommend that all bids be rejected. We further ask
that we start the rebid process immediately to not lose any additional
time.

Dear Mr. Herrera:
SWA Group recommends that all of the bids received on
September 11, 1987 for Site Development of Little Cedar
Bayou Park be rejected and that the bid documents be
restructured into several separate bid packages under
the supervision of the City of La Porte's Construction
Management Consultants and in coordination with the
appropriate City of La Porte staff.
The bids received ranged from a low of $1,732,078.00 to
a high of $2,047,000.00. Ten 'Add' Alternates and one
'Deduct' Alternate were received with the bids.
Separate bids for the fishing pier ranged from a low of
$39,848.00 to a high of $46,000.00
The minimum acceptable park development package is as
follows:

SWA has investigated methods of reducing the •
construction costs, but these cuts drastically reduce
the quality of the Park.

Th~e inherent nature of this type of park construction
requires the labors of many different crafts and,
_ therefore,•-minimizes the number of interested general
contractors~~willing to construct park projects.
Reorganizing the park construction into smaller
acceptable packages will increase the number of bidders
and create a more competitive bidding effort. Prior to
releasing the documents, SWA will incorporate design
revisions that have been identified in the review
process since the receipt of bids. Attached for your
review is a Proposed Schedule for the rebidding effort,
Bid Summary and Recommendations for Price Reduction.

Calculation of Effective Tax Rate

State property tax laws require if the proposed tax rate goes over
the three percent limit above the Effective Tax Rate, the
governing body must take a record vote on a ~~proposal to consider
the tax increaset~. The governing body must also schedule a public
hearing on the proposal. This hearing must be at least seven days
after the vote and published notice for public hearing. Following
the public hearing at a later date the governing body may hold a
public meeting to adopt the rate and pass the tax rate ordinance.
The tax rate proposed ($.66/$100) is three percent above the
Effective Rate and will invoke the public hearing and notice
requirements. Council may consider November 2, 1987 for a public
hearing date. The following regular meeting of November g, 1987
would be the first date available for adoption of the tax rate.
The notice requirements specify results of this vote will be
published with the meeting notices normally required.
Action Required by Council:
Formal motion by Council calling for proposal to consider the tax
rate increase above the Effective Rate and date set for public
hearing.

SUBJECT: Recommended Budget Rate for FY 87-88
It is staff's recommendation that Council adopt a budget with a tax
rate of 66 cents per 100 dollars valuation (.66/$100 valuation). This
amount will smooth over the loss of $290,000 in Federal Revenue
Sharing, assist in paying for operational needs to maintain new
facilities generated by the City's Bond Programs and minimize the use
of the General Fund to balance the budget.
The adopted tax rate should be structured to protect the overall
credit worthiness of the General Fund and to maintain stable and
reliable City programs which deliver a service. The following factual
conditions require serious considerations when adopting a tax rate for
La Porte's future.
1. Loss in Revenue Sharing of $290,000 or .03 cents of tax rate used
for operations and capital outlay.
2. 1/2 cent of tax rate is allocated to cover salaries of employees
connected with capital irnprovement projects generated by our Bond
Programs. This level is expected to increase to 1 cent for FY
88-84.
3. An additional $15,000 or 1/6 cent of tax rate is necessary in FY
88-8Q for funding a full year of tcao police officers added in FY
87-88 (g month operations budgeted).
4. Loss of $15,000 or 1/6 cent of tax rate in interest income is
projected for FY 88-89.
5. A 2~ increase in operations is projected for 1988-89 to offset
rising insurance premiums, follow through of Pay for Performance
Plan, increases in utility costs (electrical, gas, telephone,
water) in the amount of $198,000 or 2.25 cents.
