The meeting was called to order by Mayor Malone at 6:05 P.M. Members of City Council Present: Mayor Norman Malone, Councilpersons Betty Waters, John Lloyd, Ed Matuszak, Mike Shipp, Jerry Clarke Members of City Council Absent: Councilpersons Alton Porter, Deotis Gay, B. Don Skelton Members of City Staff Present: City Manager Bob Herrera, City Attorney Knox Ask ins, City Secretary Cherie Black, Assistant City Manager John Joerns, Administrative Assistant to the City Manager Janie Luna, Director of Public Works Steve Gillett, Police Chief Charles Smith, Director of Community Development Joel Albrecht, Assistant Director of Public Works Buddy Jacobs, Finance Officer Jeff Litchfield Others Present: Mike Martinez, Lou Lawler, Marie Coffman, Shelby Woodard, Lewis McLain, David McLain, Melissa Doyle (Bayshore Sun), 8 citizens 2. The Mayor proclaimed the month of February as Heart Month. Mike Martinez, Lou Lawler, Marie Coffman, Shelby Woodard and Melissa Doyle accepted the proclamation. Mrs. Everlena Thornton wished to address Council to oppose demolition of a building on her property. Mrs. Thornton was advised that since no member of the Code Enforcement Division was present at the meeting, her request would be forwarded to the Code Enforcement Division, who will meet with her to discuss the matter. 3. Council considered an ordinance setting a speed limit on Fairmont Parkway, which had been tabled at the meeting of January 25, 1988. Police Chief Charles Smith reviewed the ordinance and the reasons for the speed limit change. Minutes, Workshop and Special Called Meeting La Porte City Council February 1, 1988, Page 2 After discussion, motion was made by Councilperson Matuszak to table the ordinance until more statistics can be obtained on the area of Fairmont Parkway that is affected ~v the ordinance. Second by Councilperson Lloyd. The motion carried, 6 ayes and 0 nays. Ayes: Councilpersons Waters, Lloyd, Matuszak, Shipp, Clarke and Mayor Malone Nays: None 4. Council considered a resolution extending the sign moratorium. The City Attorney read: RESOLUTION 88-3 - A RESOLUTION EXTENDING THE MORATORIUM TO EXPIRE MARCH 31, 1988, ON THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION OF PERMANENT SIGNS AND BILLBOARDS IN THE CITY OF LA PORTE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. Mntinn was made by Councilperson Matuszak to approve Resnluti~n 88-~ as read bk,the Citty Attorney. Second by Councilperson Lloyd. The motion carried, 6 ayes and 0 nays. Ayes: Councilpersons Waters, Lloyd, Matuszak, Shipp, Clarke and Mayor Malone Nays: None 5. The called meeting was adjourned and the workshop meeting called to order. 6. Lewis McLain presented a review of the utility rate study. 7. There being no further business to come before the Council, the meeting was duly adjourned at 8:12 P.M. Malone, Mayor ~ ~ ~ • RESOLUTION NO. 88-3 A RESOLUTION EXTENDING THE MORATORIUM TJ EXPIRE MARCH 31, 1988, ON THE ISSUANCE OF BUILDING PERMITS FOR THE CONSTRUCTION OF PER'NANENT SIGNS AND BILL- BOARDS IN THE CITY OF LA PORTS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTS: Section 1. The Planning and Zoning Commission of the City of La Porte held a public hearing on November 19, 1987, and discussed a comprehensive amendment to the Zoning Ordinance of the City of La Porte, regulating signs and billboards. It was contemplated that final action on sign regulations would be taken by the City Council of the City of La Porte prior to January 31, 1988. To that end, the City Council on November 9, 1987, passed Resolution No. 87-25, creating a moratorium on the issuance of building permits for the erection of permanent signs and billboards in the City of La Porte. The Planning & Zoning Commission of the City of La Porte has not passed on a final recommendation to the City Council regarding sign regulations, and no final action on sign regulations will be taken by the City Council prior to January 31, 1988, the date of exviration of the prior established moratorium. , The City Council therefore hereby finds that a need exists to extend the moratorium created on the November 9, 1987, by Resolution No. 87-25, said extension of said moratorium to expire on March 31,..1988, on the issuance of building permits for the erection of signs and billboards in the City of La Porte. Real estate signs, and other signs of a temporary nature, except for portable signs, shall be excepted from this moratorium. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. l • RESOLUTION N0. 88-3, Page 2 Section 3. This Resolution shall be effective from and after its passage and approval.
