MINUTES OF THE REGULAR MEETING OF LA PORTE CITY COUNCIL
MAY 9, 1988
1. The meeting was called to order by Mayor Malone at 6:00 P.M.
Members of Citv Council Present: Mayor Norman Malone,

2. The invocation was given by Councilperson Waters.
3. The Mayor proclaimed Mayas Correct Posture Month; the week
of May 15 through 21 as National Public Works Week; and the
week of May 15 through 21 as National Police Week, with
National Police Memorial Day being May 15.
4. Council considered approving minutes of the regular meeting
held April 25, 1988.
Motion was made bv Councilperson Porter to approve the
minutes of April 2S as presented. Second by Councilperson
Clarke. The motion carried, 7 ayes, 0 nays, and 1 abstain.
Ayes: Councilpersons Waters, Lloyd, Matuszak, Porter, Shipp,
Clarke and Mayor Malone

5. Council canvassed election returns of the May 7, 1988
election.
Motion was made bv Councilperson Llovd to adopt Ordinance
1585, showing Norman Malone as being reelected, Mike Cooper
from District 2, and until a recount shows otherwise, Ed
Matuszak, District ~, being reelected. Second by
Councilperson Clarke.
Before the vote was taken, the Mayor read a letter addressed
to the City Secretary, informing her that Robert Thrower,
candidate from District 3, had requested a recount, and
naming her as Recount Coordinator.
The City Attorney explained the procedure for a recount and
named Wednesday, May 11 at 9:00 A.M., as the time for the
recount. He suggested that Council hold a special meeting
before the workshop meeting scheduled for May 18, to canvass
the recount and give the oath of office to the winner.
He also explained that the canvass of the May 7 election
should be done and the oath of office given to the clear
winners. He read the list of candidates and the votes polled
as follows:
Mayor, Norman L. Malone - 1185
Councilperson District 2 - John R. Lloyd, 126; Cary L.
Burnley, 44; Mike Cooper, 239
Councilperson District 3 - Bob Thrower, 276; Ed Matuszak, 280
The vote was taken and carried, 8 ayes and 0 nays.
Ayes: Councilpersons Waters, Lloyd, Matuszak, Porter, Shipp,
Skelton, Clarke and Mayor Malone
Nays: None
Judge J. B. Williamson administered the oath of office to
Mayor Norman Malone, who in turn administered the oath of
office to incoming District 2 Councilperson Mike Cooper.
Councilperson Cooper then took his seat at the Council table.

6. Council considered an ordinance declaring the results of the
non-binding referendum election held May 7, 1988.
The City Attorney read: ORDINANCE 1586 - AN ORDINANCE
DECLARING THE RESULTS OF THE NON-BINDING REFERENDUM HELD IN
THE CITY OF LA PORTE ON MAY 7, 1988; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
The City Attorney announced the results of the referendum as
follows: Yes - 1346; No - 375
Motion was made bv Councilperson Shipp to adopt Ordinance
1586 as read bv the Citv Attorney. Second by Councilperson
Matuszak. The motion carried, 8 ayes and 0 nays.
Ayes: Councilpersons Waters, Cooper, Matuszak, Porter,
Shipp, Skelton, Clarke and Mayor Malone
Nays: None
The Mayor then asked Council to deviate from the agenda and
address item 18, executive session, under V.A.T.S. Article
6252-17, Section 2(E) (Legal), to consult with Charles
Dippel, Sears & Burns, regarding the EPA Rehabilitation
Project law suit. Council adjourned into executive session
at 6:20 P.M. and returned to the Council table at 6:32 P.M.
7. Workshop I~em: Discuss user fee structure for La Porte's Bay
Forest Golf Course
Alex Osmond, golf pro, and members of the Golf Course
Advisory Board, discussed with Council the fee structure,
rates, and memberships for the golf course. Several changes
were recommended and the City Attorney will revise the
ordinance to reflect these changes.
Motion was made bv Counciloerson Waters to table Item 9,
which was to consider the ordinance setting rates for La
Porte's Bay Forest Golf Course, until the meeting of May 2~,
in order to allow the City Attornev to revise the ordinance.
Second by Councilperson Cooper. The motion carried, with no
"nays" being heard.
Ayes: Councilpersons Waters, Cooper, Matuszak, Porter,
Shipp, Skelton, Clarke and Mayor Malone

Councilpersons Matuszak and Porter objected to the vote,
indicating that Council had not come out of workshop, and the
ordinance should be addressed at its proper time. The Mayor
then adjourned the workshop portion of the meeting.
The Mayor asked that Council permit item 16B to be addressed
at this time, since many EMS members were present and needed
to leave to go on duty, or had been on duty and needed to go
home.
Acting EMS Chief Gary Williams addressed Council regarding
the heroic efforts of two EMS personnel, Ray Nolen and Ron
Matejowsky, in rescuing a fall victim at the Fred Hartman
bridge site. These two young men went above and beyond the
call of duty in that the difficulty and danger of the rescue
was extreme. The City is very proud of these EMS personnel.
8. Mrs. Donna Gullett, 502 South Sixth, addressed Council
regarding an increase of strangers in her neighborhood. She
asked for help in the way of extra patrol or whatever else
could be provided.
9. Addressed under item 7. However, because some of the Council
were of the opinion that the motion had been voted before the
workshop item was adjourned, the Mayor asked for another
motion. Motion was made bv Councilperson Waters to table
this item until May 2~, as recommended bv the City Attorney.
Second by Councilperson Shipp. The motion carried, 6 ayes
and 2 nays.

10. Council considered approving a reciprocal agreement with La
Porte ISD for use of Sylvan Beach Pavilion/School facilities.
Motion was made bv Counciloerson Porter to approve the
reciprocal agreement between La Porte ISD and the City.
Second by Councilperson Clarke. The motion carried, 6 ayes
and 2 nays.

11. Council considered approving the 1988 agreement with Harris
County for rural/urban fire protection services by the City
of La Porte.
Motion was made by Councilperson

12. Council considered awarding a bid for a city hall generator
building.
Motion was made by Councilperson Skelton to award the bid for
the city hall generator building to Follis Construction in
the amount of $11,7~2. Second by Councilperson Clarke.
Motion was made by Councilperson Matuszak to table this item.
Second by Councilperson Cooper. The motion failed, 2 ayes
and 6 nays.

13. Council considered awarding a bid for replacement of air
conditioning coils and balancing air system for city hall.

system to Bay Refrigeration, in the amount of $16,775.
Second by Councilperson Shipp. The motion carried, 8 ayes
and 0 nays.

14. Council considered awarding a bid for removal of dangerous
buildings.
Motion was made bv Councilperson Skelton to award the bid for
removal of dangerous buildings to Daniels Dump Truck Hauling,
in the amount of $5,7QO. Second by Councilperson Shipp. The
motion carried, 8 ayes and 0 nays.

15. Council considered awarding a bid for construction of Little
Cedar Bayou southern sanitary sewer trunk main.
Motion was made bv Councilperson Waters to award the bid for
construction of Little Cedar Bavou southern sanitary sewer
trunk main to McKey Construction, in the amount of the base
bid of $149,134. Second by Councilperson Cooper. The motion
carried, 8 ayes and 0 nays.

16. Administrative Reports:
City Manager Bob Herrera called Council's attention to the
fact that there will be a workshop on long range planning on
May 18. At that time a special meeting will be held to
ratify the District 3 recount, give the oath of office and
seat the Councilmember. The meeting will convene at 6:00
P.M.
A. Teen Support Group/Citizens Advisory Committee - Acting
EMS Director Gary Williams addressed Council regarding an
advisory committee recently formed with assistance from
Humana Hospital Bay town, for a free counseling service
for youth who are having drug- and alcohol-related
problems. Ms. Dawn Tarver-Sills of Humana Hospital
Bay town explained the program in more detail. Mr.

Williams asked for Council's help in providing
transportation for the youth participating in the
program. Council agreed that the newly acquired City van
could be used to help transport the youth, and that
perhaps some City employees could volunteer to be
drivers. Mr. Herrera was given authorization by Council
to pursue this.

17. Council Action: Councilpersons Waters, Cooper, Matuszak,
Porter, Shipp, Skelton, Clarke and Mayor Malone brought items
to Council's attention.
18. The executive session had been held earlier in the meeting.
19. There being no further business to come before the Council,
the meeting was duly adjourned at 9:29 P.M.

AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION HELD IN THE CITY
OF LA PORTE ON MAY 7, 1988, FOR THE ELECTION OF A MAYOR; A COUNCIL-
PERSON, DISTRICT 2; AND A COUNCILPERSON, DISTRICT 3; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE
DATE HEREOF.
WHEREAS, there was held in the City of La Porte on the 7th day
of May, 1988, an election for the purpose of electing a Mayor; a
Councilperson
District 2; and a Councilperson -- District 3; all
in accordance with Section 8.10 of the Home Rule Charter of the City
of La Porte; and
WHEREAS, there were cast at said election for the following
listed persons the number of votes opposite their respective names:

AN ORDINANCE DECLARING THE RESULTS OF THE NON-BINDING REFERENDUM
HELD IN THE CITY OF LA PORTE ON MAY 7, 1988: FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW: AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, there was held in the City of La Porte on the 7th day
of May, 1988, a non binding referendum on the following proposition:
SHALL THE CITY OF LA PORTE OPPOSE THE APPLICATION OF HOUSTON
CHEMICAL SERVICES, INC., FOR A HAZARDOUS WASTE INCINERATOR

SUMMARY & RECOMMENDATION
On January 20, 1988, the staff presented a recommendation for
proposed user fees at the Bay Forest Golf Course to the Golf
Course Advisory Board.
The staff recommendation was made after completing a survey of
several golf courses in our area and workshops with the Golf
Course Advisory Board. The attached list furnishes information on
nine area courses. The facilities of the last two Lake Houston
and Cypresswood, compare closely with our Bay Forest Golf Course.
These two new courses are daily fee courses.
The proposed fees were converted into revenue projections based on
an estimated 40,000 rounds of play for the fiscal year 88-89 and
reflect an incoming revenue of $572,530.00 for the first full year
of operation based on $14.31 per round.
The Golf Course Advisory Board recommended that the City Council
set the user fees. at Bay Forest Golf Course as follows:

A motion was made by Richard Hayes and seconded by
Dennis Dunham to approve the minutes of the March 10,
1988 meeting. Minutes were approved as presented.
Dennis Dunham asked if a letter had been sent to Marion
Albanese in appreciation for her input in the logo for
the golf course. David said that it was his
understanding that John Joerns had called and talked
with her and made recognition at the Council meeting.
John added that she and Brian (City employee) would get
their picture in the paper and be taken out for lunch
for the job they did on the logo.

STATUS OF GOLF COURSE: Alex informed the Board that
everything was looking good at the course. The items
that need to be completed are the drainage areas, some
fairways and green slopes still need some grass added, a
few areas in the rough that need to be seeded, fi.x/patch
cart paths damaged by construction, repair leaking weir
on No.2, install main controller for water system
(can't be done until maintenance building is completed~
After contractor is satisfied with his work for
completion of the course, a final inspection will be
made by Jay Riviere and City staff. Dennis Dunham made
a request that the Board also make the final inspection,
as this will be the last opportunity to meet with the
contractor. All agreed and it was decided that the
Board would be included.

FOLLOW-UP ON ADVERTISEMENT: Alex told the Board the
advertisement for the tee markers, etc. was ~oming along
fine. The problem with the over selling and selling to
companies out of La Porte had been rectified. He said
that the City should be receiving the black and white
copies of the signs in the near future.

RATE AND FEE STRUCTURE: This item was brought back to
the Board to get final approval so it can be presented
to the City Council. This item had been tabled before
so a committee could Hork up and present the B.oard a
proposal for Charter Membership.
At this point Jim Longnecker made a motion and it was
seconded by Lloyd Roper to set a fee for La Porte
residents on a one day a \"reelc (I'ionday or Tuesday) basis
before noon at a special rate of $5.00. This would be
for La Porte residents only. After discussion of the
Board a vote was taken and the motion failed. Nays:
David Brady~. Reed Tolles, Dennis Dunham, Richard Hayes
and Ruede Wheeler.
Proposed Charter Membership - 200 Charter memberships
maximum at a fee of $600.00. The golf packet would
include: unlimited golf, name listed on permanent
plaque, photograph with the pro, bag storage, bag tag,
"Charter Member" golf hat, 20% discount each year that
membership is renewed (in the event that the package is
increased), membership will be billed as advertisement,
non-transferrable, scoreboard with inserts of
advertisers name will be changed weekly and Charter
Membership must specify an individual as the member.
These memberships will be an annual renewal. When the
program begins La Porte residents will be given first
choice and a time limit of 30/60 days will be set.
Ruede Wheeler felt that a good time to begin the
membership drive would be after the course is open and
the residents have had a chance to play on it a few
times, this would give them the opportunity to decide if
they wanted to purchase a Charter ,Membership or not.
A motion was made by Jim Longnecker and seconded by
Richard Hayes that the recommended rate structure and
the proposed "Charter Membership" be presented to City
Council for their approval. Hotion passed. This will
be done at the April 25th Council meeting.
Jim Longnecker asked to have the record reflect that he
is personally in opposition to the Charter Membership.
He further stated he was going to make a report to the
City Council as a citizen concerning the La Porte
residents rate and the Charter Membership.

It was also brought up about a set time for the senior
citizens to have for "tee off". After some discussion
by the Board it was decided to wait until a few months
after the course is open and see if there is any problem
being caused by not having certain times for tee off.
ITEM NO.6:
OTHER BUSINESS - CLUBHOUS~ John Joerns presented to
the Board the status of the clubhouse. He said that
Staff's recommendation to Council vIas to accept. the loV!
bid of Builders Construction subject to negotiation to
build only the' clubhouse at a price not to exceed .'
$195,500 and include alternate bid #2, the fire
sprinkler system at $6,000.00. Also to negotiate the
allowable construction days from 120 to 100. This would
also exclude the proposed sitework for the present
time. He stated that the alternate bid for the deck in
the amount of $10,636, could be added at a later date as
the amount far the clubhouse is already exceeding the
amount budgeted and the burglar alarm system ($4,000.00)
could be also added later and perhaps at a more
reasonable price. Staff feels that the bid on the
clubhouse alone is a very good price and should be
approved. The above recommendation will be presented to
City Council on Monday, April 11, 1988 for their
approval or rejection.
David Brady, as well as the rest of the Board, felt that
the deck should be included in the base bid and that it
was all considered to be one item and not an alternate.
The Board felt that to build the clubhouse without the
deck (to be added later) was wrong. David expressed
that if $10,636.00 was all that was keeping staff from
adding the deck that it should be done (all members
agreed). He said we are already over budget and he
didn't see how $10,000.00 could make that much
difference. In fact, if it does, then maybe the entire
clubhouse should be cancelled for now was the suggestion
made by the Board. But if the clubhouse is built, then
the deck should be included. The Board felt that the
deck and clubhouse were all one structure and should be
considered as such. A motion was made by Reed Tolles
and seconded by Dennis Dunham that the Board opposed the
awarding of the building without including the deck, or
considering the deck as an alternate. Motion carried.

The Board requested that when the clubhouse is presented
to City Council on April 11, 1988, that their desires
are also expressed. They felt that Council should have
their recommendation as well as those of Staff. John
Joerns assured the Board that this would be done.
There being no further business the meeting adjourned at 1:30 PM.
Next meeting scheduled for April 28, 1988 at 12:00 Noon.

SUGGESTED GUIDELINES FOR CHARTER MEMBERSHIPS
All Charter Memberships will be effective October 1, 1988 and run
through September 30, 1989.
The first thirty (30) days of Charter Membership sales will be limited
to La Porte residents only.
After the first thirty (30) days of sales, the general public will be
eligible to buy a Charter Membership. The $600.00 fee must be"paid in
one payment. Any Charter Membership purchased prior to October 1,
would be prorated back to the first day of the month purchased and
that fee in addition to $600 will be due at that time.
Example: If a Charter Membership was purchased July 15, 1988, the
pro-rated fee at $50.00 a month would be $150.00 and would be
due and payable at that time in addition to the $600.00 for
October 1988 - September 1989.
All Charter Membership sales will close at midnight September 30, 1988
and not open again until September 1, 1989 for the 1989-90 season.
Items number 2,3,4,5,6,10 and 11 of the proposed Charter Membership
package will be paid from the Charter Membership fees.

We are recommending the above GREEN FEE rates because we feel they
will be competitive with area Municipal Golf Courses. The rates are
higher, simply because our facility will warrant them and we will be
setting a new standard for Southern Texas Municipal Golf courses. Our
higher standard will emphasize automatic watering system, concrete
cart paths, club house facilities, location, maintenance facilities,
and an overall well conditioned golf course.
TWILITE GREEN FEES
$ 5.00
This is a discounted rate which most Municipal Golf Courses offer
approximately two and one half hours before dark to accommodate
players who prefer to play only nine holes or don't have time for
eighteen holes.
ANNUAL FEES
These are fees offered at some Municipal Golf Courses to generate
revenue and accommodate local avid golfers.
Our feeling on this subject is open the golf course for a period
of time and then consider our need of a rat~ of this nature. There
are some advantages and disadvantages.
An advantage is this will create fast bulk revenue. Another
advantage is that a player who accepts this offer will primarily play
at our golf course which creates revenue by other means such as cart-
fees, food and beverage and etc.
The disadvantages concerning annual rates would be'that a player
may take advantage of this rate to average his or her green fees well
below our normal green fees. Another disadvantage of annual rates
would include players not accepting restriction of play for certain
reasons such as tournaments, league play, necessary maintenance, and
weather.
All of these things should be weighed before adopting or not
adopting an annual rate.

pace of play would be more consistent.
PRIVATE CARTS
. We recommend that we should not permit private carts at Bay Forest
Golf Course. Doing this will serve more justice to our cart fleet and
cart paths investment.
Two major disadvantages of private carts are liability and
marshalling. We would not know the condition of these carts,
therefore we would not know the hazards and risks involved.
Marshalling would become a nightmare for the Pro Shop staff. It would
be extremely difficult to keep up with each private cart. Also, our

Dear Bob:
I enclose preliminary draft of an ordinance establishing the golf
course user fees.
In preparing the ordinance, I have followed the recommendations of
the Golf Course Advisory Committee, except in the instances noted
below.
I have made two changes on the Charter membership provlslon. First,
I have deleted the twenty percent (20%) discount each year that
membership is renewed. I simply do not feel that City Council
should bind itself more than the first year of operation, as to
whether they would even want to have Charter memberships thereafter.
To speak of a 20% discount for the renewal of a Charter membership,
implies that there might be some type of contract between the City
and the Charter members, that the Charter memberships indeed will be
renewed. I feel that should be left to future City Councils.
Secondly, on Charter memberships, the Committee recommended that the
entire cost of the membership be invoiced as advertisement. When
you look at all of the benefits of Charter membership, the
advertisement function is only one, and the City Council should make
a fair apportionment between advertisement, which would be a
possible deductible business expense for a businessman user, and the
other benefits of Charter membership which are strictly personal.
Some fair apportionment should be made and stated in the ordinance.
The only other item which I can anticipate, which has not been
addressed in the ordinance, is the fee to be charged to the La Porte
High School Golf Team. However, this probably will not be needed
until school starts in September.
Alex Osmond and I have worked together on this ordinance, and the
ordinance incorporates several recommendations of his, in addition
to those of the committee.

ORDINANCE NO.
AN ORDINANCE ESTABLISHING USER FEES AND RULES AND REGULATIONS FOR
THE CITY OF LA PORTE BAY FOREST GOLF COURSE, FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte, after
review of revenue projections and operation and maintenance and debt
service projections for the City of La Porte Bay Forest Golf Course,
hereby establishes user fees for the City of La Porte Bay Forest
Golf Course.
Section 2. The City Council of the City of La Porte hereby
establishes the following user fees for the City of La Porte Bay
Forest Golf Course:
Green Fees:
$ 9.00/Monday thru Friday, 18 holes1
$12.00/Saturdays, Sundays, and legal
holidays, 18 holes1
$ 4.50/Senior rate (Senior Citizens, 65 or
over, Monday thru Friday, onlY)1

Section 3. The use of privately owned motorized, electric or
fuel driven golf carts at the City of La Porte Bay Forest Golf
Course is prohibited.
Section 4. The Golf Course Manager shall implement a procedure
to readily identify persons entitled to the senior citizens rate,
and the City of La Porte resident discount. The Golf Course Manager
shall establish procedures for reservations of tee times. The Golf
Course Manager shall have thJe authority to close the golf course,
for maintenance and in cases of inclement weather.

Section 5. A maximum of two hundred (200) Charter memberships
may be sold at a fee of Six Hundred Dollars ($600.00) each. The
Charter memberships shall be non-transferable, and shall include the
following benefits:
a} unlimited rounds of golf,
b} name listed on permanent plaque,
c} photograph weith the q.olf professional,
d} bag storage,
e} bag tag,
f} Charter member golf hat,
g} Charter memberships will be invoiced, $
advertisement, and the remainder, $
benefits of Charter membership,
as

h} scoreboard with inserts of advertiser's name, to be changed
weekly,
i) Charter memberships are non-transferable, and the Charter
membership must specify an individual as the member,
j) The first thirty (30) days of Charter membership sales

through September 30, 1989,
1) no Charter membership shall be issued after August 31,
1988,
m} sales prior to October 1, 1988, shall include a prorated
amount from the date of sale to September 30, 1988,
prorated back to the first day of the month purchased, and
n) the entire amount of the Charter membership will be due in
cash at the time of purchase.
Charter membership does not include golf cart rental. The golf
course manager shall keep a record of the number of rounds of play
by each Charter member.
Section 6. The golf course manager shall promulgate and post
at the Clubhouse, reasonable rules and regulations governing the
operation and play at the golf course. The golf course manager shall
have the right to bar from further play at the golf course, any
person who, after warning, continues to violate any of such rules
and regulations.
Section 7. The rates hereby established shall remain in full
force and effect until modified or repealed by City Council.

Section 8. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated; and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 9. This Ordinance shall be effective from and after
its passage and approval.

COUNTY OF HARRIS
This Agreement, made and entered into effective the 15th day of
May, 1988, by and between the City of La Porte, a municipal
corporation of Harris County, Texas, hereinafter referred to as
"CITY", and the La Porte Independent School District, a body
corporate and politic, of Harris County, Texas, hereinafter referred
to as "LPISD",
WIT N E SSE T H:
CITY owns and operates the Sylvan Beach Convention Center.
LPISD is desirous of obtaining the use of such facilities for its
school functions.
LPISD owns and operates various recreational facilities. CITY
is desirous of obtaining the use of such facilities for its
citizens.
Therefore, pursuant to the authority granted by the Inter-local
Cooperation Act (Article 1581[h] V.A.T.S.), and in consideration of
the mutual covenants, agreements, and benefits to both parties, it
is hereby agreed as follows, to-wit:
1.
As part of the consideration expressed herein, CITY agrees to
furnish LPISD three (3) nights use of Sylvan Beach Convention Center
during each calendar year, on one (1) Wednesday, one (1) Friday, and
one (1) Saturday night. LPISD shall determine which school
functions shall be held at Sylvan Beach Convention Center, and shall
limit such use only to legitimate school functions involving
participation by its students. LPISD shall designate in writing to
CITY the dates chosen. LPISD shall pay any expenses for required
security, and for catering services. LPISD understands that CITY
has designated an exclusive beverage caterer, and several approved
food caterers, should food or beverages be served at LPISD functions
at Sylvan Beach Convention Center. Should LPISD food service
provider qualify with City as a food caterer, CITY agrees to waive

its usual food caterer gross receipts charge to such LPISD food
provider, for such three (3) nights use. LPISD agrees that no
alcoholic beverages will be served at LPISD functions at Sylvan
Beach Convention Center. LPISD will designate LPISD personnel, who
will be responsible for the conduct of student groups while
utilizing Sylvan Beach Convention Center. As part of the
consideration of this agreement, CITY waives its usual rental fees
for such three (3) nights use of Sylvan Beach Convention Center by
LPISD designated groups. Designation of LPISD student group use of
Sylvan Beach Convention Center shall be at the sole discretion of
LPISD officials. CITY will waive any insurance requirements of
LPISD. However, should LPISD food service provider qualify with
CITY as a food caterer, it shall furnish CITY with a certificate of
insurance as required by CITY ordinance. Any use of Sylvan Beach
Convention Center, beyond the three (3) nights use provided for
herein, shall be on the CITY's customary fees and regulations.
II.
As part of the consideration expressed herein, LPISD agrees to
allow CITY the use of its school buildings for CITY elections, and
the use of various LPISD recreational facilities, at times of the
year to be mutually agreed upon by representatives of LPISD and
CITY, which usage by CITY shall be secondary to usage of such
facilities by LPISD students. LPISD will waive any insurance
requirements of CITY. CITY will designate CITY personnel, who will
be responsible for the conduct of users of such LPISD facilities.
CITY agrees that no alcoholic beverages will be served at CITY
functions held at school buildings or recreational facilities. CITY
shall pay any expenses required for security during CITY functions
at LPISD facilities. The use of such designated LPISD facilities by
CITY, shall be without charge or remuneration by CITY to LPISD,
which shall be a part of the consideration for this agreement.
III.
TERM: This contract shall be effective May 15, 1988, through

May 14, 1989, and shall remain in force for subsequent one (1) year
periods thereafter, unless cancelled by either party to this
agreement, which cancellation may be without cause, upon ninety (90)
days prior written notice from the cancelling party to the other
party hereto.
IV.
Each party hereto covenants and agrees with the other party
hereto, to indemnify, save and hold harmless such other party, its
agents, servants or employees, from and against any and all claims
for damages or injuries to person or property of whatever kind or
character, whether real or asserted, arising out of or incident to a
use by a party hereto, of the other party's facilities, arising
under or otherwise incident to the provisions of this agreement.
EXECUTED in several duplicate originals, effective the ISth day
of May, 1988.

THIS AGREEMENT, made and entered into by and between HARRIS
COUNTY, a body corporate and pOlitic under the laws of the State of
Texas, hereinafter sometimes called "County," acting herein by and
through its County JUdge duly authorized to so act by an Order of
the Harris County Commissioners Court, and the City of
LaPORTE a municipal corporation duly organized and
existing under the laws of the State of Texas, hereinafter
sometimes . called "City," acting herein by and through its Mayor
duly authorized to so act by an Ordinance duly passed by the City.
WIT N E SSE T H:
WHEREAS, Harris County desires to provide fire fighting and
fire protection services to certain unincorporated areas of Harris
County hereinafter designated to preserve the property of the
County and to preserve and protect the public health of the
citizens of the County; and
WHEREAS, the City is willing to furnish fire fighting and fire
protection services to said unincorporated areas of Harris County
for the considerations hereinafter provided;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That in
consideration of the mutual covenants, agreements and benefits to
both parties, it is AGREED as follows:
I.
During the term of this agreement, the City agrees to furnish
fire fighting and fire department protection services to the
unincorporated areas adjoining the corporate limits of this City
designated by Zone Number 34 on the official fire protection
zone map of Harris County, to which reference is here made.
II.

Harris County agrees to pay the sum of $ 6,775.00 to the
City for fire fighting and fire protection services to the
unincorporated area of Harris County designated in Paragraph I of
this agreement. The County agrees that said sum is to be paid to
the City within thirty (30) days after the execution of this
contract.

III.
The term of this agreement shall be one (1) ~ear beginning
January 1 , 19~, and ending December 31 , 19 8 .
IV.
It is hereby agreed and understood that the fire fighting and
fire protection services to be furnished by the City under this
agreement shall inClude, but not be limited to, the following:
Answering all calls for help and assistance in extinguishing fires
in the area designated in Paragraph I of this agreement; furnishing
fire fighting personnel,' equipment and supplies to fight all fires
within the said area; and answering all calls and furnishing fire
fighting personnel, equipment and supplies to protect persons and
property within the said area which are endangered by fires in
adjacent areas; provided that the above described personnel,
equipment and supplies are not otherwise engaged in fire fighting
within the City.
V.
The City shall observe and comply with all Federal, State,
County and City laws, rules, ordinances and regulations in any
manner affecting the conduct of the services herein provided and
performance of all obligations undertaken by this agreement.
VI.
It is expressly understood that the County has the maximum sum
of $ 6,775.00 specifically allocated to fully discharge its
obligations under this agreement and it is expressly understood
that in no event shall the County be obligated to pay the City more
than the sum of $ 6,775.00 under the terms and provisions of the
agreement.
VII.
It is further agreed that in the performance of all
obligations undertaken by this agreement, the City has the right to
supervise, manage, control and direct the performance of fire
fighting and fire protection services; the County shall look to the
Ci ty for results only and the County shall have no right at any
time to direct or supervise the City or its agents or employees in
the performance of such services or as to the manner, means or
method in which the services are performed.

VIII.
The City agrees to deliver to the Fire Marshal of Harris
County a certified copy of the Ordinance authorizing the City to
enter this Agreement wi thin five (5) days after the execution of
this agreement.
IX.
The City agrees to furnish the Fire Marshal of Harris County,
not later than the fifth (5th) day of each month, a monthly report
listing the total number of runs made into the area of Harris
County designated in Paragraph I of this agreement for the previous
month and such other information relating to fire fighting and fire
prevention. services of the City as may be requested by the Fire
Marshal of Harris County. Said report shall be made on the form
provided by the Harris County Fire Marshal and shall be signed and
certified by an officer of the City.

Background:
The City of La Porte advertised for Bids on April 11, 1988
for the construction of a 12'x12' brick veneer building to house
the emergency generator. The bid also called for moving the
generator to the new location.
This expenditure has been budgeted for the last two (2)
years. We are happy to get this project under way as it is
extremely important during emergency situations. Amount budgeted
is $55,000.00
The City invited nine (9) General Contractors to bid the
project. We received two (2) bids. The bids were:

SUMMARY & RECOMMENDATION
On April 25, 1988 bids were opened at City Hall for the
construction of the LCB Park Sani tary Sewer Trunk Main (CLP No.
87-7102).
Alternate bids were taken for polyvinyl chloride (PVC) sewer pipe,
Hobas fiberglass-reinforced sewer pipe, boring and jacking
pavement, wet sand construction, and for disposal of excess pipe
backfill material on the park site. (See Exhibit "An).
The soil report for the project shows that water will be
encountered during trench excavation east of Garden Walk Drive.
Therefore, the work items associated wi th wet sand construction
must be included in the total contract price.
Staff would like to retain the option to bore and jack the streets
to prevent damage to completed construction on this park site.
Staff recommends this work item to be included in the total
contract price.
It is now uncertain that excess backfill soil can be disposed of
on the park site, therefore, staff recommends this work item be
included in the contract as an alternate.
Recommendation:
The Engineer, H. Carlos Smith, recommends award of the contract to
McKey Construction, Inc. for $147,629 (Base contract, bore & jack)
wet sand, and construction on site soil disposal) (See Exhibit
"B").
Staff recommends award of the contract to McKey Construction, Inc.
for $149,134.00 (Base contract, bore & jack, wet sand construction
and hauling off soil.)
A total budget of $200,000 has been established for this project,
of which $25,095 has been budgeted for engineering, $2020 for the
soils report, and $172,885 is available for construction.
Action Required by Council:
Award the contract to McKey Construction, Inc. for $149,134.00.

We are of the opinion that the availability of the LCB Park Site
for disposal of excess excavation material is nil,as the site
work is virtually complete, and no addition fill material will be
required. We also are of the opinion that some wet sand
construction will be required from approximately Station 12 + 00
to Station 20 + 00 based on the information in the soils
laboratory report. This 'is approximately 800 feet. The break
even distance for wet sand construction with the low base bid
would be 183 feet. Additional soils borings could determine more
-accurately the limits of this condition.

We would recommend that the bid of McKey Construction &
Equipment, Inc., under Option 9 be accepted based on the lower
costs of their extra work items. The definite possibility of
encountering some wet sand construction and also their much
shorter time of completion enhances this recommendation. McKey's
cost for P.V.C. pipe and Hobas pipe are identical and the City
may elect to use the Hobas pipe rather than the recommended
P.V.C. pipe.

The attached report is a synopsis of a Citizens Advisory Committee's efforts to
form a counseling service to serve the needs of the teen-aged population of
La Porte.

At the initiative of the La Porte Police Department's Juvenile Officer,
David Huckabee, a Citizen's Advisory Committee was formed to find a means in
which to aid the teens of La Porte with behavorial as well as drug and alcohol
related problems.
This committee is composed of:
Joyce Sease-La Porte Independent School District
David Holzmer-Harris County Youth Services
Melissa Doyle-Bayshore Sun
Officer David Huckabee-La Porte Police Department
Officer Ronald Parker-La Porte Police Department
Gary Williams- City of La Porte EMS
Reverend George Bennett-La Porte Community Church
The need existed for a program in which problem-prone teens can be referred
to by local Officers and parents~ The La Porte Independent School District has a
counseling program for school-related problems, although this program is not open
to outside referrals and is limited to the school year. This leaves program
participants to seek help outside of the City during the summer months, or in
many inst~nces, leaves the teen without help until the new school term begins.
The Advisory Committee's first meeting was held on April 11, 1988. At this
meeting, the purpose and need was discussed as well as the means to a solution.
It was decided to expand the committee and to begin a search for available
resources.

Re: TEEN SUPPORT GROUP/CITIZENS ADVISORY COMMITTEE
The second meeting was attended by Dawn Tarver-Sills, M.A. and
Carolyn Chennault, R.N. of Humana Hospital-Bay town. The current methods of
assistance was outlined by Ms Tarver-Sills and Carolyn Chennault, and a proposal
from Humana Hospital-Bay town was presented. The proposal was an offer of weekly,
group counseling to be held in La Porte. The offer was extended without charge or
expectation of reimbursements. The committee accepted Humana's offer and established
a starting date of May 2, 1988.
For some of the program participants, obtaining reliable transportation may
be difficult. A suggested solution to this problem would be for volunteer City
employees to provide weekly transporation utilizing the City's vans. The
provision of transportation would promote higher and more consistant attendance as
well as eliminate unsupervised gatherings following the meetings.
The use of the City's vans would generally be once a week and would involve
the transporation of participants to and from the meetings. The meetings are to be
conducted at the La Porte Community Church and will last ninety (90) minutes. The
use of the vans will be approximately three hours per week. It is understood by the
committee that City use of these vehicles will take precedence.
It is the committee's hopes that the City will approve of this program and
support the youth of La Porte.
The program outline, as submitted by Humana Hospital-Bay town is included
with this report.

Reverend George Bennett hosted a meeting to discuss community concerns with
regard to the adolescent population in the LaPorte area on 4-14-88. A Teen
Support Group Advisory Committee was formed and long-term goals were discussed.
Following is an outl ine of some short-term measures to be provided by the
counseling staff from Humana Hospital-Bay town.
FOCUS: Teen Issues/Parent Issues
PURPOSE: The development of better communications and more constructive
relationships between adolescents, their peers and others.
GOALS: To foster the development of increased self-awareness and increased
self-esteem.
To promote the development of effective coping and decision-making
skills.
To promote education and training in the development of more
constructive inter-relationships between teens, peers, parents,
teachers and others.
To provide accurate information and education with regard to
substance abuse.
METHOD: Support groups for adolescents and parents which will include:
group counseling
family counseling
inter-personal skills training
parent effectiveness training
relaxation training
assertiveness training

SUBJECT: FRED HARTMAN BRIDGE INCIDENT
On Monday, April 25, 1988, EMS unit #68~ responded to the con-
struction site of the Fred Hartman Bridge for a "Fall Victim". This
was not "the usual" but rather was extraordinary in that the victim
had fallen ninety (90) feet inside of a hollow bridge support.
Upon arrival at the scene, Driver Ray Nolan and Attendant
Ron Matejowsky were informed of the need to ascend the ninety foot
structure by means of scaffolding and ultimately, crossing a six inch
beam, some twenty feet long, in order to reach the opening of the
support.
The dangers encountered in this rescue were numerous and could
easily have resulted in severe injury or death, to one or both City
employees. The danger was compounded by the inability to utilize
safety belts during the climb. Despite the obvious risks involved,
Ron and Ray made the conscious decision to go beyond the realm of
normal duty requirements.
It is because of their dedication to the profession that the
patient is still living despite the potentially fatal injuries sus-
tained during the fall.
For their dedication and bravery, Ron and Ray deserve any and
all recognition that may be accorded them.

A 28-year.-old Seabrook man remains in
critical condition at Hermann Hospital in
Houston after falling about 90 feet inside a
, concrete pillar at the Fred Hartman
Bridge Monday afternoon.
Injured in the accident was William
Craig C;ourville.
'Gary Williams, assistant chief of the La
Porte Emergency Medical Service, said
the department received a call at 2: 07
p:m. Monday that a man had fallen from
the bridge.
Williams said two of his men, Ray
. Nolen, 23, of La Porte, who is an

emergency medical technician, and Ron
Matejowsky, 23, of Pasadena, a
paramedic, arrived at the scene expec-
ting to find the victim on the ground.
Instead they discovered that Courville,
a construction worker, fell some 90 feet in-
side the hollow bridge pillar. Williams
described the opening of the pillar as a 4
foot by 5 foot rectangular space.
The two emergency technicians, who
have no special training in high rise
rescue, climbed scaffolding some 65 feet
and then climbed rebar steel another 25
feet to get to the top of the pillar to rescue
the man.
Once at the top, Matejowsky attaclbled
his safety line onto cable extended from a
crane some four feet away, He then
jumped the four feet to straddle a metal
ball extended from the cable and rod Ithe'
ball down into the pillar to get to the vic-
tim, Nolen followed.
Once inside, the rescuers found Ithat
Courville was still alive but was suffe:ring
. from head injuries.
They stabilized the victim and ltIhen
placed him into a wire rescue basket and
he and the two rescuers were lifted toi the
top by crane and then' lowered to' the
ground.
