MINUTES OF THE BUDGET PUBLIC HEARING AND REGULAR MEETING
LA PORTE CITY COUNCIL
SEPTEMBER 26, 1988
1. The meeting was called to order by Mayor Malone at 7:00 P.M.

2. The invocation was given by Councilperson Shipp.
3. Council considered approving the minutes of the Public
Hearings, Revenue Sharing Budget Hearing and Regular Meeting
of Council held September 12, 1988.
Motion was made by Councilperson Skelton to approve the
minutes of the September 12 meeting as presented. Second by
Councilperson Cooper. The motion carried, 9 ayes and 0 nays.

4. The Mayor called to order the pUblic hearing on the fiscal
year 1988-89 City of La Porte budget.
Finance Director Jeff Litchfield and City Manager Bob Herrera
reviewed the 1988-89 budget.
The Mayor asked for public input regarding the budget. There
was none.

6. Council considered an ordinance regulating and licensing labor
agents within the City of La Porte.
The City Attorney read: ORDINANCE 1601 - AN ORDINANCE
REGULATING AND LICENSING LABOR AGENTS IN THE CITY OF LA PORTE;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING THAT
ANY PERSON WHO VIOLATES THE TERMS OF THIS ORDINANCE SHALL,
UPON CONVICTION, BE GUILTY OF A MISDEMEANOR, AND SHALL BE
FINED NOT MORE THAN $200.00 EACH DAY THAT SUCH VIOLATION
CONTINUES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
Motion was made by Councilperson Waters to adopt Ordinance
1601 as read by the City Attorney. Second by Councilperson
Porter. The motion carried, 8 ayes, 0 nays, 1 abstain.

18. Administrative Reports: City Manager Herrera asked Council to
keep their schedules as flexible as possible between October 3
and October 7 for interviews with our economic development
planners.
19. Councilpersons Matuszak, Porter, Skelton, Clarke and Mayor
Malone brought items to Council's attention.
The City Manager indicated that there will be a financial
report on the golf course at the next Council meeting. He
also suggested that a workshop be held in the near future to
discuss "traffic problems."
20. There being no further business to come before the Council,
the meeting was duly adjourned at 8:22 P.M.

Dear Mayor & City Councilmembers:
In accordance with the City's Charte r P rov is ions, I, hereby,
transmit the comprehensive annual budget of the City of La Porte,
Texas for fiscal year October 1, 1988 through September 30, 1989.
BUDGET MESSAGE
FY 1988-89
Noted as an enterprising year, La Porte's FY 1987-1988 has
focused on the timely completion and implementation of a $15.25
million Capital Improvements Program. The budgetary theme has
been a commitment to developing "creative administrative
approaches in the delivery of public services." This philosophy
served us well as the City faced its largest capital improvements
program ever and managed this challenge successfully in spite of
the difficulties arising from the Tax Reform Act of 1986.
This administration's accomplishments have included the comple-
tion of the 1985 General Obligation Bonds, the 1985 Revenue Bond
Series, and the 1986 General Obligation Bonds. In the past 24
months, City staff has initiated and will complete a package of
$15.25 million in Bond proceeds as follows:
$6.0 million in Sewer Infrastructure Improvements -
Series 1985 Revenue Bonds
$1.0 million in Street Improvements
Series 1985
$1.0 million in Drainage Improvements - Series 1985
$2.0 million in Parks - Series 1985
$1.0 million in Fire Department Improvements

These improvements were approved at a time Hhen the Houston
economy was at its dimmest. In La Porte, we chose to respo~d in
positive fashion. Under the leadership of the City Council, we
were able to roll back tax rates, maintain existing utility rates
and rely on fund balances and retained earnings to weather the
economic backlash from the Houston area.
The central administrative theme of FY 1988-89 is "a commitment
to planning." This theme will direct this administration's
efforts to prov ide qua 1 i ty public ser'v ice del i very. It shall
also enable staff to help position the City for the next
scheduled bond sales. The first such sale is scheduled for
December, 1988 and will be,earmarked for a Solid Waste Landfill.
The second bond sale, of $3.3 million, shall occur in
August, 1989 and will be restricted to water and sewer improve-
ments.
THE FY 1988-89 BUDGET
The City's FY 1988-89 budget for both the Gene ral and Util i ty
Funds will total $16,305,707. Compared to FY 1987-88's budget,
this figure reflects a 5.91 percent increase. However, were the
proposed Bayshore Municipal Utili ty District's annexation to be
excluded, this figure would result in only a 2.81 percent
increase over last year's budget.
Three budgetary priorities underlie the FY 1988-89 budget. They
are the annexation of the Bayshore Hunicipal Utility District;
the necessary preparations associated with the conversion to
surface water distribution; and lastly, the costs associated with
the completion of the previously mentioned Bond Projects.
In order to meet this coming year's maintenance and operational
expenses, staff is recommending the City's tax rate be increased
by two (2) cents on the tax dollar. This recommendation is not
made lightly nor without justification. In addition to the
reasons already provided, there are three additional factors
which impact the necessity for the tax rate increase.
First, Federal Revenue Sharing is now a fading memory and its
absence is already beginning to be felt. I believe its absence
will continue to be felt in years to come. In the past, Federal
Revenue Sharing provided the City coffers approximately $250,000
each Budget year.

Secondly, in 1984, the City's Parks and Recreation Department
administered a total of 47 acres of developed park land. By
October, 1988, this same department will be responsible for an
additional 74 acres of park land, bringing its maintenance
requirements up to 121 acres. This phenomenal development
requires that the City pay special attention to the. operating
details associated with the professional management of an
expanding parkland system.
Thirdly, faced with a mandate from the Harris-Galveston Coastal
Subsidence District, the City is charged with the responsibility
of converting its water supply from ground water to surface
water. Th,iseffort requires the City to incur an additional
contractual obligation of approximately $7.25 million or roughly
74 percent of the $9.8 million of Texas Water Development Bonds
issued to the La Porte Area Water Authority. This cost has to be
borne by the utility customer.
The completion of this critical project entails the building of
approximately 17 miles of transmission main from Houston's South-
east Water Purification Plant as well as an equity ownership in
that plant. Planning efforts indicate that the transmission
mains be sized for the year 2010. All of these improvements are
mandated to be in place by January, 1990 - a deadline imposed by
the Harris-Galveston Coastal Subsidence District.

In planning for staffing levels in FY 1988-89, a total of 40 new
positions were added. Of these, 33 are scheduled to be part-time
positions. The following are the new positions recommended:

Thirty-three of the new positions are the direct result of
matured bond programs. Of the remaining seven positions, six
will he added upon the annexation of Bayshore Municipal Utility
District. The remaining position is the Data Processing
Manager/Analyst position.
The Data Processing Manager/Analyst position will facilitate the
modernization and conversion of the City's data processing system
into a tr'ue management information system. This position was
recommended in a Hanagement Information System Study that was
conducted in FY 1987-88 and will help ensure maximum utilization
of the City's investment in computer technology that was made in

COl~CLUSION
It is expected that through this and future year's commitment to
planning, City staff will continue to become more results
oriented. This, in turn, will allow us to better position our-
selves to be pro-active and decisive in long-range planning.
This administration's goal is not simply to "fix" a one year
budget problem but instead to take the necessary planning steps
to resolve any long-term challenges before they become insur-
mountable problems.
Only through careful planning can the City of La Porte position
itself to face the challenges created by a global economy which
is fast paced and often turbulent. I am confident that planning
is the major ingredient needed to successfully propel the City of
La Porte into the 1990's.
Finally, I would like to acknowledge a job well done by staff
members associated with the planning and design of this budget.
In particular, I want to per'sonally extend my appreciation to
Finance Director, Jeff Litchfield and his fine staff for doing an
outstanding job in helping to prepare the budget. Lastly, but

AN ORDINANCE REGULATING AND LICENSING LABOR AGENTS IN THE CITY OF LA

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Definitions.
(a) The term "person" means an individual, partnership,
association, corporation, legal representative, trustee, trustee in
bankruptcy, or receiver.
(b) "Fee" means anything of value including money or other. valuable
consideration or services or the promise of any of the foregoing
received by a Labor Agent or Agency from or on behalf of any person
seeking employment, or employers seeking employees, in payment for
any service, either directly or indirectly. The term "fee" includes
the difference between the amount received by a Labor Agent and the
amount paid out by him to persons employed to render personal
services, to, for, or under the direction of a third person.
(c) "Employer" means any person employing or seeking to employ any
employee.
(d) "Employee" means any person performing or seeking to perform
work or service of any kind for compensation.
(e) "Labor Agent" means any person in this City who, for a fee,
offers or attempts to procure, or procures employment for employees,
or without a fee offers or attempts to procure, or procures
employment for any worker; or any person who for a fee attempts to
procure workers for employers, or any person, regardless of whether
a fee is received or due, offers or attempts to supp~y or supplies
the services of workers to any person, and includes any person who,
for a fee, provides in connection therewith one or more of the
following services: furnishes board, lodging, or transportation for
such workers; supervises, times, checks, counts, weighs, or
otherwise directs or measures the work; or disburses wage payments
to the workers.

(f) "City Manager" shall mean the City Manager of the City of La
Porte.
(g) "Deputy or Inspector" shall mean any person who is duly
authorized by the City Manager to act in that capacity.
Section 2. Exceptions.
The provisions of this Ordinance shall not apply to any
employment agency established and operated by this City, State, the
United States Government, or any municipal government of this State~
the provisions of this Ordinance shall not apply to any person who
may operate a labor bureau or employment office in conjunction with
his own business for the sole and exclusive purpos~ of employing
employees for his own business within this City, nor to any common
carrier operating in this City who may operate an employment office
in conjunction with his own business for the exclusive purpose of
employing employees for his own business within or without this
City, provided, that no fee or other charge or reduction is exacted
from the salary or wages of the employee for employment given. If a
fee or charge of any kind, either directly or indirectly is exacted
of the employee, then said employer is deemed an employment or labor
agent and is subject to the provisions of this Ordinance. The
provisions of this Ordinance shall not apply to farmers or stock
raisers acting jointly or severally in securing laborers for their
own use in this City where no fee is charged or collected, either
directly or indirectly for employment given~ the provisions of this
Ordinance shall not apply to any farm labor contractor registered
under the Farm Labor Contractor Registration Act of 1963, as amended
(7 USC 2041 et seq.)~ the provisions of this Ordinance shall not
apply to any person, corporation, or charitable association
chartered under the laws of Texas for the purpose of conducting a
free employment bureau or agency~ nor to any veterans'organization
or labor union~ nor to any nurses' organizations operated not for
profit, to be conducted by recognized professional registered nurses
for the enrollment of its professional members only for the purpose
of providing professional service to the public~ nor shall the

provisions of this Ordinance apply to employers, their
representatives and/or crew leaders engaged in agricultural
production and/or agricultural related services (packing, packaging,
and processing), who recruit workers through the Texas Employment
Commission.
Section 3. Application and Bond
(a) An application and Bond for a Labor Agency license shall be
executed on blank forms prescribed and furnished by the City
Manager. Such forms shall include waivers and consents to credit
checks, character references, and police investigations. An
application for a license to act as a Labor Agent may be made in
person or by mail to the City Manager upon a blank application form
which shall be verified by the applicant. Such application shall
also be accompanied by affidavits of at least five (5) creditable
citizens who have resided in the county in which said applicant
resides for at least three (3) years prior thereto, to the effect
that applicant or applicants are persons of good moral character.
The application must state the names and addresses of all partners,
associates and profit sharers of the business and shall list the
amount of their respective interest.
(b) The City Manager shall investigate each applicant. The City of
La Porte Police Department shall make available to the City Manager
all arrest and conviction records, and their files, on any applicant
for license under this Ordinance.
(c) The application shall be examined by the City Manager. If the
City Manager finds that the same complies with the law and the
applicant is entitled to a license and pays the annual license fee
of One Hundred Dollars ($100.00), a license shall be issued to the
applicant. Each license issued by the City Manager shall be good
for a period of one year from date of issuance.
(d) Each application for a labor agency license must be accompanied
by a surety or cash performance bond in the principal amount of
Twenty-five Thousand Dollars ($25,000.00). The bond shall be
payable to the City for the use and benefit of any damaged party and

conditioned that the licensee will pay any judgment recovered by any
consumer or the City, in any suit for damages, penalties or
expenses, including reasonable attorney's fees resulting from a
cause of action involving the licensee's labor agency activities.
A. Fees. A schedule of all proposed fees to be charged by a
licensee to its employees, shall first be filed with the City
Manager for his approval. These fees shall include, but not be
limited to, charges for obtaining employment; housing;
transportation; food and beverages; uniforms; tools; and the like.
Such fees shall be reasonable.
B. Persons Disqualified. No license to operate as a labor
agent may be granted to:
(1) a person who sells or proposes to sell alcoholic beverages
in a building or on premises where he operates or proposes
to operate as a labor agent; or
(2) a person whose license has been revoked within three (3)
years preceeding the date of application, or has not been
granted a license upon application, depending on severity
of cause for rejection; or
(3) a person who has been convicted of a felony.
c. Notice of Cancellation of Bond. Where the surety intends
to cancel a bond, thirty (30) days' notice of cancellation shall be
furnished by the surety to the City Manager prior to the effective
date of the cancellation.
Section 4. Revocation or Suspension of License
The City Manager shall have the authority, and it shall be his
duty, to revoke the license of any labor agent when it shall appear
to his satisfaction, upon notice and a hearing, which shall be held
before a Hearing Officer appointed by the City Manager, that such
agent has been convicted in a State or Federal Court of an offence
which under the laws of this State is a felony, or for any offense

involving moral turpitude, or that the agent had obtained his
license illegally or fraudulently or was guilty of fraud, false
swearing, ,or deception in securing his license. The City Manager
'shall have the authority, and it shall be his duty, to revoke or
suspend the license of any labor agent when it shall appear to his
satisfaction, upon notice and a hearing, that the agent has violated
any provision of this Ordinance.
The City Manager shall not revoke or suspend the license of any
agent until complaint in writing, made by a credible person, shall
be filed with him, specifying in general terms the grounds of the
proposed revocation or suspension, and a full and fair hearing given
to him thereon. Upon the filing of such complaint, the City Manager
shall fix a time and place, reasonably accessible to the agent
complained against for the hearing of said complaint. The City
Manager shall notify the agent so complained against of the time and
place fixed for said hearing by a registered letter addressed to him.
at his post-office address as the same appears upon his application
for license, accompanied by an exact copy of the complaint against
him: and mailing of such notice and copy shall be sufficient and
conclusive evidence of proper service of the procedure upon the
agent so complained against. The agent so complained against shall
have at least ten (10) days after the date said notice is mailed,
exclusive of the day of mailing and the day of hearing, before
hearing upon said complaint shall be had, and shall have the right
to file answer, introduce evidence and to be heard both in person
and by counsel. The City Manager shall have the power to summon and
compel the attendance of witnesses before him to testify in relation
to any such complaint, and may require the production of any book,
paper or document deemed pertinent thereto. Said City Manager shall
also have the power to provide for the taking of depositions of
witnesses and evidence may be heard either from witnesses present
testifying orally, or by deposition taken under such rules, and in
such fair and impartial manner as the City Manager may prescribe.
Said hearing shall be had before the City Manager and shall be

conducted in a fair and orderly manner, and in accordance with rules
of procedure to be adopted by the City Manager, which must be in
accordance with the terms and provisions of the Administrative
Procedure and Texas Register Act (Article 6252-l3a, Vernon's Texas
Civil Statutes). Any appeal from the decisions of the City Manager
shall be filed in the District Court of Harris County and said
appeal shall not have the effect of automatically staying the
decisions of the City Manager.
A. Failure to File Bond1 Suspension of License. If a licensee
fails to file a bond with the City Manager within 30 days after
notice of cancellation by the surety of the bond, the license issued
to the principal under the bond is automatically suspended until
such time as a bond is filed. A person whose license is suspended
pursuant to this section shall not operate as a labor agent during
the period of the suspension.
Section 5. Duties of Licensee
(a) In addition to the duties inherent in being a labor agent and
the duties required by this Ordinance or any other provision of law,
a licensee has the duties set forth in this section if he employs
workers to render services for third persons.
(b) A licensee shall promptly payor distribute to the proper
individuals all money or other things of value entrusted to the
licensee by a third person for such purpose.
(c) A licensee shall comply with the terms and provisions of legal
and valid agreements and contracts entered into between the licensee
in his capacity as a labor agent and third persons.
(d) A licensee shall have available for inspection by his employees
and by the third persons with whom he has contracted, a written
statement in English and Spanish showing the rate of compensation
he receives from the third persons and the rate of compensation he
is paying to his employees for services rendered to, for, or under
the control of such third persons.
(e) A licensee shall take out a policy of insurance with an
insurance carrier authorized to do business in the State of Texas in

the amount of $100,000/$300,000, which insures the licensee against
liability for damage to persons or property arising out of the
licensee's operation of, or ownership of, any motor vehicle for the
transportation of individuals in connection with his business,
activities, or operations as a labor agent.
(f) All vehicles used by a licensee for the transportation of
individuals in his operations as a labor agent shall have displayed
prominently at the entrance of the vehicle the name of the labor
agent and the number of his license issued by the City Manager.
(g) Each licensee shall, semimonthly or at the time of each.payment
of wages, furnish each worker employed by him either as a detachable
part of the check, draft, or voucher paying the employee's wages, or
separately, an itemized statement in writing showing in detail each
and every deduction made from the wages.
(h) Waiting rooms and sleeping quarters for employees shall be kept
in a neat, clean, and sanitary condition. Such quarters shall be
kept free of insects and pests. Mattresses and pillows shall be
well covered, and freshly laundered bed linens and towels shall be
furnished to each employee, at least weekly.
(i) A licensee shall furnish food and beverages to employees, for
which a reasonable charge may be made, through an on-premise
commissary or vending machines, or a combination of each. No
alcoholic beverages shall be sold on the premises.
(j) A licensee shall comply with all provisions of the Code of
Ordinances of the City of La Porte, the laws of the United States,
the State of Texas, and Harris County, as may be applicable.
(k) A licensee shall not allow employees to loiter or trespass on
property not owned or controlled by the licensee. A licensee shall
be responsible for the conduct of its employees, guests, and
invitees, while on its premises, and the license of a licensee shall
be subject to revocation in the event of repeated violations by its
employees of the ordinances of the City of La Porte, or any State or
Federal laws. Three or more violations within a thirty (30) day
period, shall be deemed "repeated" violations as used herein.

Section 6. Certain Acts Prohibited
No labor agent shall:
(a) Knowingly admit, or allow to remain on the premises of such
agent any prostitute, gambler, intoxicated person, drug dealer, drug
user or any person of bad character.
(b) Advertise his agency by means of cards, circulars, signs or in
newspapers or other publications, unless all such advertisements
shall set forth the name of the agent and the address of his labor
office; nor shall any such licensed person use any letterheads or
blanks not containing the name of such labor agent and the address
of his labor office.
(c) Publish or cause to be published any false or misleading
advertisement or notice relating to his labor agency.
(d) Give any false information or make any false representation
concerning employment to any applicant for employment.
(e) Send out an applicant for employment to 'any prospective
employer without first having obtained a bona fide written order
from such prospective employer.
(f) Furnish any male or female for immoral purposes; or send, or
cause to be sent, any male or female to enter as servant, inmate, or
for any purpose whatsoever, to any place of bad repute, house of ill
fame, or assignation house, or any house or place of amusement kept
for immoral purposes; the character of which such labor agent could
have ascertained by reasonable diligence.
(g) Furnish employment to any child, as defined by Federal or State
statute, in violation of the Statutes regulating the employment of
children or the compulsory attendance at school.
(h) Divide or offer to divide, directly or indirectly, any fee
charged or received with any person who secures workers through such
agent, or to whom workers are referred by such agent.
(i) No labor agent shall send any person to a prospective employer
who is conducting a "lockout" against all or part of his employees;
or whose employees, or a part of them are out on a strike, without
first apprising said person of the existence of said "lockout" or
strike.

Section 7. License as Evidence
Any application made by an employment or labor agent for a
license, or a certified copy thereof under the hand and seal of the
City Secretary, shall be received as evidence in any Court in this
State without necessity of proving the execution thereof.
Section 8. To Display License
(a) A labor agent shall keep conspicuously posted in his office the
license issued to him under this law.
(b) A labor agent shall display a duplicate of his license to each
person with whom he deals in his capacity as a labor agent.
Section 9. Prohibited Acts; Penalty
(a) Any person acting as a Labor Agent as defined by this
Ordinance, without having first filed with the City Manager of the
City of La Porte an application for license as Labor Agent, as
provided by this Ordinance, and without having first secured a City
license as provided, commits an offense. Each day of continuing '!
violation is a separate offense.
(b) A licensee who violates any provision of this Ordinance commits
an offense.
(c) An offense under this section is a Class C misdemeanor.
Section 10. Authority of the City Manager
The City Manager and his deputies or inspectors are hereby
empowered to enforce the provisions of this Ordinance, and shall
have the authority of peace officers in making arrests of any person
or persons who violate, in their presence, any of the provisions of
this Ordinance; and when such arrest has been made6 the City Manager
or his duly appointed deputies or inspectors may enter any
employment office at any reasonable time when such employment office
is open for business and inspect the registers and all other records
of whatsoever kind and character of such employment or labor agent
for the purpose of ascertaining whether the provisions of this
Ordinance are being violated, and the refusal of any employment or
labor agent to permit such inspection shall be a violation of the
Ordinance, and be sufficient reason for the City Manager to suspend

or revoke the license of such agent in accordance with the
provisions of Section 4 of this Ordinance.
A. Rules and Regulations. The City Manager may promulgate
rules and regulations to carry out the provisions of the Ordinance.
Section 11. Punishment
Any employment or labor agent who violates any provisions of
this Ordinance shall be deemed guilty of misdemeanor, and upon
conviction shall be fined any sum not less than Fifty Dollars
($50.00), nor more than Two Hundred Dollars ($200.00). Each day of
violation shall constitute a separate offense.
Section 12. Conflict with Other Ordinances
It is not the intent of this Ordinance to repeal, abrogate,
annul or in any way impair or interfere with existing provisions or
other laws or ordinances, except as the same may be specifically
repealed by the terms of this Ordinance. Where the conditions
imposed by any provisions of this Ordinance are either more or less
restrictive than comparable conditions imposed by another ordinance,
rule or regulation of the City of La Porte, the ordinance, rule or
regulation which imposes the more restrictive condition, standard,
or requirements shall prevail.
Section 13. Providing a Savings Clause
That in the event any section, or part of section or provision
of this Ordinance be held invalid, unconstitutional, or inoperative,
this shall not affect the validity of the remaining sections, or
parts of sections of this Ordinance, but the remainder of the
Ordinance shall be given effect as if said invalid, unconstitutional
or inoperative section, or part of section or provision, hand not
been included. In the event any penalty, right or remedy created or
given in any section or part of this Ordinance is held invalid,
unconstitutional or inoperative, this shall not affect the validity
of any other penalty, right or remedy created or given either in the
whole Ordinance or in the Section thereof containing such invalid,
unconstitutional or inoperative part, and if any exception to or any
limitation upon any general provision herein contained shall be held

to be unconstitutional or invalid, the general provisions shall
nevertheless stand effective and valid as if the same had been
enacted without such limitation or exceptions.
Section 14. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated1 and that this meeting has been open to the
public as required by law at all times during which this ordinance
and the subject matter thereof has been discussed, considered and
formally acted upon. The City Council further ratifies, approves
and confirms such written notice and the contents and posting
thereof.
Section 15. This Ordinance shall have no application to
personnel employment services, regulated by Article 522la-7,
Vernon's Annotated Texas Statutes, Revised, or medical or nursing
service agencies.
Section 16. This Ordinance shall be effective from and after
its passage, approval, and publication of its caption, as required
by law, and it is so ordered. Labor Agents in operation in the City
of La Porte on the effective date hereof shall have forty-five (45)
days to comply with the terms hereof.

SUMMARY & RECOMMENDATION
On July 6, 1988 Mr. Bill Jones requested the City of La Porte to
license surface use of the 16 foot alley adjace~t t~ lots 20-32,
Block 1101, Town of La Porte. The request asked that no fee be
passed on to'the applicant. The applicant intends to utilize the
area for construction and maintenance of parking areas and
landscaping.
Earlier staff correspondence indicates that the City has in the
past closed public right-of-way and "licensed" the surface use of
right-of-ways for vehicular and pedestrian use while retaining
continued use of the right-of-way by the City of La Porte and
public utilities holding franchises from the City. Recent
examples are the U.S. Post Office, and La Quinta Inn. U.S. Post
Office did not pay a closing/licensing fee as they are a
governmental entity with the power of eminent domain and therefore
exempted from closing fees by our procedures (RE~ Ordinance
81550).. La Quinta paid a closing/licensing fee based on an
appraisal of the property in unencumbered fee simple title,
surface rights only.
Other issues relating to McDonald's proposed development that have
been addressed by staff, Planning & Zoning, Board of Adjustments
and Council are;
1) Height of sign requested by McDonald's.
2) Updated floodplain information 'from Harris County Flood
Control.
3) Re-Iocation of La Porte State Bank sign (GUS).
4) Landscaped conservation setback adjacent to Little Cedar
Bayou.
All franchised utilities have responded to the City's inquiry.
The only agencies that offered any concerns to the closing were:
HL&P; which requires dedication of an easement covering
their facilities in the alley,
CLP; which requested abandonment of the waterline in the
alley of Block 1101 between lots 20-32 at no cost to the
City or maintenance of the waterline as long as license
is in effect.
Ordinance 81603 if passed will grant a license to McDonald's, its
successors and assigns to:
- Have exclusive rights of the surface of such alley for
driveways, lighting, parking, landscaping;
- Have the right and privilege to enter into a lease
agreement with La Porte State Bank for the construction
and operation of a sign in the N.W. corner of the alley
until 7/31/97.

In consideration for the license McDonald's shall:
- Execute an easement agreement between McDonald's
Corporation & HL&Pj
- Landscape & maintain the west 4' of such alley per terms
of La Porte Zoning Ordinance #1501j
- Landscape and maintain the approximate east 15 feet of
the Harris County Flood Control District right-of-way in
accordance with the requirements of the HCFCD (to be
passed on through the City of La Porte);
- The continued maintenance of this landscaping shall be a
consideration for the continuance of this license
agreement;
- Either abandon the existing waterline per City's
specifications or maintain the waterline during the term
of this licensej
- Remit to City of La Porte all net rentals received under
lease agreement between McDonald's Corporation and La
Porte State Bank.
In consideration for the license the predecessor in title to
McDonald's Corporation shall:
- Be required to deposit the sum of $5,811 cash with the
City of La Porte as a performance guarantee which will
be refunded upon the completion of the required
landscaping and the issuance of a Certificate of
Occupancy.
The proposed ordinance, if passed, becomes effective only upon;
1) The purchase of lots Twenty (20) through Thirty-Two
(32), Block Eleven Hundred One (1101), Town of La Porte,
Harris County, Texas, by McDonald's Corporation;
2) The execution and delivery of an easement by McDonald's
Corporation to Houston Lighting & Power Company;
3) The execution by McDonald's Corporation of an agreement
for landscaping of the "Conservation setback" areas;
4) The execution of a mutually agreeable sign lease between
McDonald's Corporation and La Porte State Bank; and
5) The delivery of the $5,000.00 cash performance guarantee
as provided for in Section 3 hereof.
Action Required by Council:
Approval of Ordinance #1603 granting a license to McDonald's
Corporation for use of'a portion of the alley in Block 1101;
providing a cash performance guarantee and providing other terms
and conditions of said license.

Dear Bob:
McDonald's Corporation plans to acquire a tract of land at Fairmont
Parkway and South 8th Street in La Porte, legally described as Lots
20 through 32, Block 1101, Town of La Porte, being 125' of frontage
on Fairmont Parkway, and 325' of depth on South 8th Street.
McDonald's proposed sketch plan also indicates the need for.surface
use of the adjoining sixteen foot City alley, for vehicular and
pedestrian ing~ess and egress, and vehicular parking.
The sketch plan indicates a 65' high identification sign at the
corner of Fairmont Parkway and South 8th Street. Finally, the
sketch plan indicates the removal of the La Porte State Bank "GUS"
sign from its present location, which is the western most twenty-
five feet of Lot 32, Block 1101, Town of La Porte, to a location in
the adjoining alley. The property on the west side of the alley is
owned by the Harris County Flood Control District.
The proposed sketch plan raises the following legal issues which
would have to be addressed by the City of La Porte:
1) The subject property is situated in a General Commercial
District~~eights of signs in the General Commercial District
are est~li$hed at a maximum of 45'. lThe present Burger King
si~5' ,; but it was constructed pr ior to the passage of
.~ n~~zon~ng o:dinance.) In order to al~ow ~ 65' .
ldentlfrc1ltlon slgn on the property, the dlstr'lct regulatlons
for General Commercial Districts would have to be amended.
This would require an application and hearing before Planning
and Zoning, a recommendation from Planning and Zoning to City
Council, and favorable action by City Council, to amend these
regulations.
2) The City of La Porte has in the past "licensed" the surface
use of City of La Porte alleys and streets, for vehicular and
pedestrian use, in conjunction with the continued use of such

alleys by the City of La Porte, and public utilitie~'holding
franchises from the City of La Porte. Recent examples are the
U.S. Post Office, and La Quinta. Appropriate safeguards could
be placed in an ordinance granting such a license to
McDonald's, as in the two examples given. I understand that
1., in order.. for: the City of La Porte to license the surface use
of,the alley, the City would need to negotiate a suitable
license fee with McDonald's. Even when the alley remains
open, I understand past policy on license agreements has been
to value the surface use of the alley in the same manner as if
an alley closing were occurring. An appraisal would be
required consistent with the City's street and alley closing
ordinances.
3) The City of La Porte could likewise license sufficient space
in the northwest corner of the alley, for the relocation of La
Porte State Bank's "GUS" sign. This sign is 18' foot high and
14' wide.' The National Electric Code would require that this
sign be so. constructed, that any point on the sign have a ten
.foot.linear clearance: from any energized lines. Houston
/,i.:Lighting' &':Power has indicated that the clearance could be
attained (if not already sUfficient) by virtue of a utility
pole relocation. This would be the responsiblity of the
developer, and would require an approximate expenditure by the
developer of $2,000.00. The "GUS" sign is presently located
at a point'which;would'impede a driveway planned by
McDonald's. McDonald's requires that the sign be relocated.
Again, the use of space in the City of La Porte alley by La
Porte'State Bank, for the "GUS" sign, could be the subject of
an ordinante granting a license to the Bank. The City of La~
Porte would need to consider an appropriate license fee for
sign, and would also need to insure that La Porte State Bank
(and McDonald's) would appropriately indemnify and hold the
City of La Porte and the franchise utilities of the City of La
Porte harmless for any utility construction or repair work
required in the alley.
4) The proximity of the proposed location'to Cedar Bayou raises
two concerns. First, the Flood Zone Map needs to be checked
to ascertain what the required elevation of the development
needs to be, or whether development would be prohibited
altogether due to the existence of a Flood Way on the proposed
tract. Second, staff needs to ascertain whether an additional
setback off of Cedar Bayou is required due to the existence of
Cedar Bayou as a designated conservation area on the Land Use
Map.

McDonald's assuming responsibility for
maintenance of these items.
Sidewalks along Fairmont Parkway will be
required as per the Development Ordinance
and the Comprehensive Plan.

OF THE SURFACE OF THE NORTH THREE HUNDRED TWENTY-FIVE FEET (325')
OF THE SIXTEEN FOOT (16') ALLEY IN BLOCK ELEVEN HUNDRED ONE (1101),
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS~ RETAINING PUBLIC UTILITY
EASEMENTS~ PROVIDING TERMS AND CONDITIONS OF SUCH LICENSE~ FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW~ AND PROVIDING AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Subject to the terms and provisions hereof, and
under and by virtue of the power granted to the City of La Porte
under its Home Rule Charter, and Chapter 13, Title 28, Article 1175,
of the Revised Civil Statutes of Texas, 1925, the City of La Porte
hereby grants a license for the use of the surface of the
hereinafter described portion of an alley in the City of La Porte,
to McDonald's Corporation, to-wit:
The North 325 feet of the alley in Block Eleven Hundred
One (1101), TOWN OF LA PORTE, Harris County, Texas,
being that portion of the alley lying and being adjacent
to Lots Twenty (20) through Thirty-two (32), both
inclusive, Block Eleven Hundred One (1101), TOWN OF LA
PORTE, Harris County, Texas, being a tract of land 16
feet by 325 feet.
Section 2. The term of this license shall be for so long as
McDonald's Corporation, its successors or assigns, operates a lawful
business on Lots Twenty (20) through Thirty-two (32), both
inclusive, Block Eleven Hundred One (1101), TOWN OF LA PORTE, Harris
County, Texas.
Section 3. As consideration for this license agreement,
McDonald's Corporation, its successors and assigns, agrees to
landscape and maintain a "conservation setback" on the West (4') of
such alley, in accordance with the terms and provisions of Ordinance
No. 1501, the City of La Porte Zoning Ordinance, which provides,
among other things, for landscaping with trees, shrubs, and
groundcover, with a planting plan required to be submitted and
approved by the City of La Porte.
In addition, McDonald's Corporation, its successors and
assigns, further agrees to landscape and maintain a "conservation
setback" on the approximate East fifteen feet (15') of the Harris
County Flood Control right-of-way, adjacent to said alley, in
accordance with the requirements of the Harris County Flood Control
District. It is anticipated that such requirements will call for

carpet grass, mulch, or like treatment of such property, without any
trees or shrubs being permitted. The landscaping and maintenence of
such landscape area for the City of La Porte, and such conservation
setback area for the Harris County Flood Control District, and the
continuing maintenance of such landscaping, shall be a consideration
for the continuance of this license agreement.
The predecessor in title to McDonald's Corporation shall be
required to deposit the sum of Five Thousand Eight Hundred Eleven
Dollars ($5,811.00) cash with the City of La Porte as a performance
guarantee, which deposit will be refunded by the City of La Porte to
the party making such deposit, upon the completion of the required
"conservation setback" landscaping hereunder and the issuance of a
certificate of occupancy by the City of La Porte.
Section 4. McDonald's Corporation, its successors and assigns,
shall have the exclusive right of use of the surface of such alley,
,
subject to the terms and provisions hereof, for driveways, lighting,
parking, landscaping, and the sign provided for in Section 5 hereof.
The license rights granted to McDonald's Corporation hereunder,
shall be subject to and limited by the terms and provisions of an
easement agreement between the City of La Porte and Houston Lighting
& Power Company.
McDonald's Corporation, at its option may either (1) abandon,
at its expense, the existing City of La Porte water line in the
alley, in accordance with City specifications~ or (2) use and
maintain such existing water line as a private water line, at its
expense, so long as this license agreement is in effect.
Section 5. The City of La Porte hereby grants McDonald's
Corporation, as licensee, the license, right and privilege to enter
into a lease agreement with La Porte State Bank, its successors and
assigns, for the construction and operation of a sign approximately
eighteen feet (18') high and fourteen feet two inches (14'2") wide,
in the Northwest corner of the portion of the alley herein

described, legally described as that portion of the alley adjacent
to Lot Thirty-two (32), Block Eleven Hundred One (1101), TOWN OF LA
PORTE, Harris County, Texas, for a term ending the 31st day July,
1997. No portion of such sign shall encroach upon a public right-
of-way. The location, construction and operation of such sign shall
conform to all applicable codes of the City of La Porte, and
requirements of Houston Lighting & Power Company. McDonald's
Corporation shall promptly remit to the City of La Porte, all net
rentals received by it under said lease agreement between McDonald's
Corporation and La Porte State Bank.
Section 6. This Ordinance shall be effective only upon (1) the
purchase of Lots Twenty (20) through Thirty-two (32), Block Eleven
Hundred One (1101), TOWN OF LA PORTE, Harris County, Texas, by
McDonald's Corporation: (2) the execution and delivery of an
easement by McDonald's Corporation to Houston Lighting & Power
Company: (3) the execution by McDonald's Corporation of an agreement
for landscaping of the "conservation setback" areas: (4) the
execution of a mutually agreeable sign lease between McDonald's
Corporation and La Porte State Bank: and (5) the delivery of the
$5,811.00 cash performance guarantee as provided for in Section 3
hereof.
Section 7. McDonald's Corporation, acting herein by and
through its duly authorized officer, joins in the execution of this
license agreement, to evidence its agreement and consent to the
terms and provisions hereof.
Section 8 Except as expressly set forth herein, this
Ordinance shall not limit or otherwise mitigate the provisions of
any other applicable City of La Porte ordinance or regulation
including, but not limited to, the terms and provisions of Ordinance
No. 1501, the City of La Porte Zoning Ordinance.
Section 9. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the

SUMMARY & RECOMMENDATION
If Ordinance #1603 passes, the City of La Porte will be licensing

In order for this to occur, the City of La Porte must protect
rights of franchised utilities and see that proper public utility
easements are executed. HL&P has responded to our inquiry
regarding the use of this alley and requests a ten foot utility
easement.

AN ORDINANCE APPROVING AND ADOPTING THE BUDGET FOR THE CITY OF
LA PORTE, TEXAS,FOR THE PERIOD OF OCTOBER 1, 1988, THROUGH
SEPTEMBER 30, 1989; FINDING THAT ALL THIS REQUISITE AND NECESSARY
HAVE BEEN DONE IN PREPARATION AND PRESENTMENT OF SAID BUDGET;
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the Charter of the City of La Porte, Texas, and the
Statutes of the State of Texas, require than an annual budget be
prepared and presented to the City Council of the City of La
Porte, Texas, prior to the beginning of the fiscal year of said
City, and that a pUblic hearing be held prior to the adoption of
said Budget; and
WHEREAS, the Budget for the fiscal year October 1, 1988,

through September 30, 1989, has heretofore been presented to the
City Council and due deliberation had thereon, was filed in the
office of the City Secretary on August 26, 1988, and a public
hearing scheduled for September 26, 1988, was duly advertised and
held.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF LA PORTE, TEXAS:

Section 1. That the Budget for the City of La Porte, Texas,
now before the said City Council for consideration, a complete
copy of which is on file with the City ~ecretary and attached
hereto by reference as Exhibit "A", is hereby adopted as the
BUdget for the said City of La Porte, Texas, for the period of
October 1, 1988, through September 30, 1989.
Section 2~ Be it FURTHER ORDAINED, that the said City
Council finds that all things requisite and necessary to the
adoption of said Budget have been performed as required by Charter
or Statute.

recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the pUblic at the City Hall of the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS,
ADOPTING THE 1988 APPRAISAL ROLL OF THE HARRIS COUNTY APPRAISAL
DISTRICT.
WHEREAS, the City's Assessor and Collector of Taxes submitted
to the City Council for approval the 1988 tax appraisal roll with
the tax amounts shown therein based upon the 1988 tax rate adopted
by the City Council by Ordinance No. ; and
WHEREAS, the City Council is of the opinion that the 1988
appraisal roll with the tax amounts shown therein should be
adopted; and
WHEREAS, the City's Assessor and Collector of Taxes has
reported to the Ci ty Council that there was situated in the Ci ty
of La Porte, as of January 1, 1988, property with a total
appraised value of $979,288,030 and a total taxable value of
$934,530,318; and
WHEREAS, new property added to the appraisal roll had a total
taxable value of $1,044,800 as of January 1, 1988; and
WHEREAS, property newly annexed by the City had a total
taxable value of $222,480 as of January 1, 1988.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF LA PORTE, TEXAS
Section 1. That the 1988 taxable roll in the amount of
$934,530,318 is hereby adopted.
Section 2. That the City Council officially finds,
determines, recites and declares that a sufficient written notice
of the date,hour, place and subject of this meeting of the City
Council was posted at a place convenient to the public at the
offices of the City of La Porte for the time required by law
preceding his meeting, as required by the Open Meetings Law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and that
this meeting has been open to the public as required by law at all
times during which this resolution and the subject matter thereof

zero nine cents ($.4909) on the one hundred dollars
($100.00) cash value thereof, estimated in lawful
currency of the United States for the current expenses
for the support, -maintenance, and improvement of the
City Government of said City of La Porte; and
(2) An Ad Valorem Tax of and at the rate of one eight point
nine one cents'($.18g1) on the one hundred dollars
($1DO.00) cash value thereof, estimated in lawful
currency of the United States, to pay current interest
on and provide one year-Is sinking fund and to pay all
of the principal and interest accruing on all
outstanding general obligation bonds and certificates
of obligation lawfully issued by the City of La Porte.
That this provides the sum of total Ad Valorem tax at the
rate of sixty-eight cents ($.68) on the one hundred dollars
($100.00) cash value thereof, estimated in lawful currency of the
United States.
Section 2. All property upon which a rate of taxation is
hereinabove levied shall be assessed on a ratio of one hundred
percent (100%) of the estimated market value thereof.
Section ~. That the sums hereinafter accruing and collected
from the hereinabove taxes so levied be and the same are hereby
appropriated for the support, maintenance, and improvement of the
City Government of the City of La Porte.
Section 4. The City Council officially finds, determines,

recites and declares that all notices required by law have been
pUblished, and that a public hearing as required by law was duly
called and held, and that all matters prerequisite to the
~stablishment and levy of an Ad Valorem tax have been
accomplished, all as required by the laws of the State of Texas,

thereof, irrespective of the fact that any other section,
s~ntence, phrase, or clause, or part thereof, may be declared
invalid.

The adoption of the Utility Fund Budget for fiscal year 1988-89 requires an
increase in utility rates of approximately 30 %.
The need for a 30 % increase is two-fold. First, the Utility Fund has reached
the point where its working capital balance (current assets over current
liabilities) needs to be maintained, and secondly, the impact of the cost of
converting from ground water to surface water, as mandated by the Harris-
Galveston Subsidence District, will be felt this year.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Section 26-11(a) of Ordinance 1284 is hereby
amended, to hereafter read as follows, to-wit:
RATES FOR WATER SERVICE
The fOllowing rates shall be applicable for water purchased
from the City of La Porte computed on a monthly basis:
A. Residential Use:
A minimum charge, per month, shall be $6.50.
B. Apartment Units, Duplex Units, Individual Mobile Homes
in Mobile Home Parks, with units not individually
metered for water:
A minimum charge per month, shall be $5.00 per living
unit(s) plus an administrative charge_of $.46 per meter
furnishing water to the customer.
C. Commercial and Industrial Use:
A minimum charge per month shall be made in accordance
with the size of the meter utilized to measure service
to the customer in accordance with the following
schedules:

(3) after the usage of the amount of water exceeds
the number of units billed times 2,000 gallons each

Section 2. Section 26-15 of Ordinance No. 1284 as amended
by Ordinance No. 1441, is, hereby amended, to hereafter read as
follows, to-wit:

The following rates shall be applicable for sewage treatment
by the City of La porte computed on a monthly basis:
A. Residenti al Use:
A minimum charge, per month,_ shall be $11.15.
B. Apartment Units, Duplex Units1 Individual Mobile Homes
in Mobile Home Parks, with units not individually
metered for water:
A minimum charge per month, shall be $7.42 per living
unit plus an administrative charge of $.64 per meter
furnishing sewer service to the customer.
C. Commercial and Industrial Use:
A minimum charge per month shall be made in accordance
with the size of the meter utilized to measure service
to the customer in accordance with the following
schedules:

customer each month shall be charged in accordance

(5) Computation of Volume based on water purchased:
Residential:
The volume of sewage treated shall be based
upon 95% of the resident's water volume billed
each month. However, the maximum residential
charge will be based on 95% of a resident's
average water billed for the water metered
during the months of November, December, and
January. .
For new residents, the basis will be 6,500
gallons rather than the average of November,
December, and January.
Commercial and Industrial:
~ The volume of sewage treated will be based
upon 85% of the monthly water consumption.
Multi-Units:
The volume charge to Apartment Units, Duplex
Units, Individual Mobile Homes in Mobile Home
Parks, with units not individually metered for
water, shall be based on 85% of the amount of
water billed each month.

from and after its passage and approval, with rates to be
implemented on all billings after October 1, 1988.'

On September 8, 1988, a meeting was held between City staff and
representatives from the La Porte Main Street Association, to
discuss activities held during the Main Street Fair. To ensure
public order, health, and safety during the Fair, the meeting
participants agreed that a local organization, officially
recognized by the City Council, is needed to coordinate fair
activities. The recognized organization would be required to
administer the Fair's activities in conjunction with the City of
La Porte.
The attached ordinance outlines the responsibilities of the
designated organization, and recognizes the La Porte Main Street
Association as the local organizer.
This ordinance has been reviewed by both the City and the La Porte
Main Street Association. City staff recommends the approval of
this ordinance.

AN ORDINANCE REGULATING THE ANNUAL LA PORTE MAIN STREET FAIR1
FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW1 AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. In order to preserve the public order, health, and
safety during the annual Main Street Fair in La Porte, the City
Council of the City of La Porte deems it necessary and expedient
that all Main Street Fair activities be coordinated by and through
one local organization committed to spending the time and effort
required to carry out the endeavor successfully. Accordingly, the
City Council of the City of La Porte hereby designates the La Porte
Main Street Association, a Texas non-profit corporation, as the
coordinating organization.
Section 2. The La Porte Main Street Fair shall be held on a
Saturday during the month of October each year. The exact date will
be coordinated between the City Manager and the La Porte Main Street
~ssociation. The ~a Porte Main Street Fair shall be held in 1988 on
Saturday, October 29, 1988.
Section 3. That portion of the public right-of-way between the
curb lines of Main Street in the City of La Porte, from the West
right-of-way line of North Broadway, to the East right-of-way line
of 8th Street, shall be closed to traffic between the hours of 7:00
A.M. and 7:00 P.M., each year on the date of the Main Street Fair,
upon thirty (30) days written notice from the La Porte Main Street
Association to the City of La Porte.
Section 4. The La Porte Main Street Association, the
coordinating organization, shall adopt reasonable rules and
regulations, a copy of which shall be filed with the City Manager,
governing activities at the annual La Porte Main Street Fair. The
La Porte Main Street Association, as the coordinating organization,
shall be the responsible party having jurisdiction of the event, and
shall have the right and responsibility to organize the Fair
activities, lease booth space, and oversee the Fair activities. The
La Porte Main Street Association shall coordinate security, fire and

safety, and health precautions with appropriate City of La Porte and
Harris County officials. Existing City of La Porte electrical
connections on utility poles along the Main Street right-of-way, may
be used during the Fair by the La Porte Main Street Association and
its 1esseesi provided, however all electrical connections shall
comply with all City of La Porte codes, and shall be approved by the
City of La Porte Building Official, or his designee. The La Porte
Main Street Association shall reimburse the City of La Porte for its
costs of electric power consumed.
Section 5. Appropriate banners publicizing the Main Street
Fair, may be installed at a location over Fairmont Parkway, a~d at a
location over Main Street, for a period not exceeding twenty (20)
days before the Fair date.
Section 6. The La Porte Main Street Association, as the
coordinating organization, shall obtain and file with the City
Manager, a certificate of insurance, e~idencing;$l,OOO,OOO.OO
liability insurance coverage for the Main Street Fair, which
coverage shall include damage to persons and property, including
provisions as to food service and liquor liability, which
certificate of insurance shall reflect the City of La Porte as an
additional named insured.
Section 7. The La Porte Main Street Association, the
, coordinating organization, shall file with the City Manager, at
least fifteen (15) business days before the Fair, a plan of police
and fire protection, trash and debris cleanup, electric wiring,
emergency vehicle routes, sanitation facilities, and other details
of planning for the Fair, which shall be subject to his approval.
Section 8. The La Porte Main Street Association, the
coordinating organization, shall take care that entrances to
buildings facing on Main Streeti intersecting street rights-of-waYi
and sidewalks and driveways, shall not be unduly obstructed by Fair
activities.
Section 9. All booth lessees shall be required to obtain and
display Texas State Sales Tax Permits, and, in the case of booths

Section 10. The City Council officially finds, determines,

Civil Statutes Annotated; and that this meeting has been open to the

ENCOURAGING'USX TO SEEK OTHER OPTIONS FOR THE TEXAS WORKS STEEL
MILL -OTHER THAN THE' SALE OF SUCH MILL TO THE COUNTRY OF IRAQ;
DIRECTING A COpy OF SAID RESOLUTION TO BE DELIVERED TO VARIOUS
LEGISLATORS REPRESENTING THE LA PORTE AREA; AND PROVIDING FOR AN
EFFECTIVE DATETHEREOF~'
WHEREAS, USX has proposed to sell to the County of Iraq its
Texas Works' Steel Mill; and
WHEREAS, the Texas Works Steel Mill is not only a valuable
asset to the community of La Porte, but also a valuable asset to
our nation as a part of the steel making capacity of the United
States; and
WHEREAS, the City of La Porte understands that Iraq is not
the only entity that is interested in buying the steel mill,
there being other potential American purchasers which would keep
the Texas Works in this area, and such potential purchasers are
willing to meet or exceed the offer from Iraq; and
WHEREAS, the City of La Porte further understands that at
least two of these potential American purchasers are willing to
structure their purchase in away that would ease any concerns
that USX may have over domestic competition in steel production;
and
WHEREAS, the City of La Porte further believes it is
inaccurate to call the Texas Works Steel Mill old and outmoded,
as only one other plant of the type of the Texas Works has been
built since the completion of the Texas Works; and
WHEREAS, the Texas Works Steel Mill was updated in the early
1980's by the means of computerization which indicates it is not
outmoded; and
WHEREAS, a sale of this plant to a purchaser willing to keep
it loqated in Texas would promote both local and national
concerns and allow USX to dispose of a plant that it no longer
wishes to own.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
.OF THE CITY OF LA PORTE, TEXAS
Section 1. That the City Council of the City of La Porte,
Texas, hereby urges and encourages USX to not sell the Texas
Works Steel Mill to Iraq, but instead pursue other options which
would result in the sale of this plant to a purchaser who would
keep it within the area.
Section 2. That the City Council of the City of La Porte,
Texas, further urges and encourages the Legislators representing
this area to protect both local and national interests by seeing
that the Texas Works Steel Mill is kept in the United States.
Section ~. The City Secretary is hereby directed to send
copies of this Resolution to all Legislators representing this
area.
Section 4. This Resolution shall take effect immediately
from and after its date of passage.

Approval of resolution setting aside funds for the reconstruction
of the Hillridge Street bridge pending approval of Federal-Aid
Off-System Bridge matching funds for the project.
On August 5, 1988, the City of La Porte requested assistance from
the State Department of Highways and Public Transportation in
obtaining federal funds for the replacing of the Hillridge Street
bridge on Big Island Slough. The State estimated the total cost
for replacing the bridge to be $252,500.00 with our twenty percent
(20S) share of the cost being $50,500.00.
Funding for our portion of the Hillridge Street bridge will be as
follows:
Total depletion of the Capital Improvement Fund
(approximately $34,000.00) with the remainder coming from the
General Fund contingency account (approximately $16,500.00).
Action Required by Council:
Approve the resolution subject to Federal-Aid Off-System Bridge
funding being granted to the State' Department of Highways and
Public Transportation for the Hillridge Street bridge replacement.

In reference to your letter of August 5, 1988, additions to the subject program
will be considered only in extreme circumstances. Exceptions will include
structures having critical condition ratings, particularly those which are located
on school bus routes. Qualifying structures will then be prioritized statewide
before submittal to the Administration.
Therefore, we require additional information. Please state if the bridge is on
a school bus or mail route, whether the road may be closed during constr~ction,
and if traffic can be routed onto other streets.
Also, confirmation of the City's ability to provide the 20 percent matching fund-
ing for replacement of the bridge on Hill Ridge Street at Big Island Slough is
needed. The total estimated cost is $252,500.

Since March of 1987, when District. 12 last considered the above
referenced bridge for rehabilitation or replacement, the condition of
the bridge has deteriorated substantially. We understand that it now
qualifies for the Federal-Aid Off-System Bridge Program.
The City of La Porte agrees that the Hill Ridge St. bridge should be
repa ired or replaced as soorl as possible and request s D istr ict 12' s
assistance in obtaining the 80% federal funding to match the 20% local
funding. We understand that District 12 is not asking for a
commitment on the City's share of funding at this time, but that this
request is necessary for you to give further consideration to adding
this bridge to the program.
The City administration and staff will support District 12
energetically in finding a solution to the problem of the Hill Ridge
St. bridge.

Hillridge Street Bridge
At our last Executive Staff meeting, Jeff Litchfield and I were
instructed to gather information for writing a response to a letter
from the State Department of Highways and Public Transportation. This
information is to be used to assist the State in the prioritizing of
the Hillridge Street Bridge with the Federal-Aid Off-State System
Bridge Replacement and Rehabilitation Program.
The attached letter from Mr. Herrera responds to the issues raised by
the State. These issues confirm the fact that the bridge is on the
school route, the mail route, and that Hillridge can be closed during
construction.
The final issue is the City's ability to provide its 20 percent of the
matching funds for the replacement of this bridge which is estimated
to be $50,500.00. Jeff Litchfield has provided the following possible
funding sources for the project:
1. General Fund contingency account,
2. Federal Revenue Sharing contingency,
3. Remainder of General Fund Capital Improvement Fund (estimated
at $34,000 with remainder coming from source 1 or 2).
We recommend using the General Fund Capital Improvement Fund balance
of $34,000.00 and $16,500.00 from the General Fund contingency
account.

This letter is in reference to our correspondence regarding the
Hillridge Street Bridge at Big Island Slough, Bridge No. L 32003-001,
in La Porte. The Hillridge Street Bridge is on both school bus and
mail routes. The critical condition of the bridge and the new posted
load limits have created problems primarily for the La Porte
Independent School District. The school buses must enter ejther
Spencer Highway or Fairmont Parkway several times as they pick up and
drop off children, thereby increasing the chance of injury.
Hillridge Street can be closed between Valleybrook Drive and Roseberry
Drive during construction of the bri,dge. All cross traff:i.c ~an be
routed to those two streets and exit Fairmont Park Hest Subdivision
from Hillmont Road or Myrtle Creek. Cross traffic can exit Fairmont
Park Subdivision from either Valleybrook Drive or Farrington
Boulevard.
The City of La Porte agrees to provide 20 percent matching funds for
the replacement of the Hillridge Street Bridge, which are estimated to
be $50,500.00

WHEREAS, the Hillridge Street Bridge needs to be rehabilitated

WHEREAS, the rehabilitation or replacement of the Hillridge
Street Bridge is eligible for funding provided through the Federal-

WHEREAS, the Federal-Aid Off-System Bridge Program provides

WHEREAS, the total estimated cost for replacement of the
bridge on Hillridge Street at Big Island Slough is $252,500.00, of
which the City of La Porte would be expected to provide 20%, or
approximately $50,500.00; and
WHEREAS, the City of La Porte has funds available to commit to
the project, and is desirous of rehabilitating or replacing the
Hillridge Street bridge;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
The City Council of the City of La Porte hereby
finds that the above cited recitations and findings of fact are
true.
Section 2. Provided that the State Department of Highways and
Public Transporation obtain federal funds from the Federal-Aid Off-
System Bridge Program in the approximate amount of $202,000.00 to
be used for the rehabilitation or replacement of the Hillridge

Street bridge, the City of La Porte sets aside $50,500.00 until
September 30, 1989.
Section 3. The City Council of the City of La Porte directs
that the City of La Porte's 20% share of the Hillridge Street
bridge rehabilitation or replacement be set aside from the Capital
-Improvement Fund which shall be depleted by virtue of this expend-
iture, in the approximate amount of $34,000.00, with the remainder
of the set aside funds, or approximately $16,500.00, tc be set
aside from the General Fund Contingency account.
Section 4. If, the above described earmark funds have not
been spent on or before September 30, 1989, the City Council of the
City of La Porte directs that all funds be reverted to the General
Fund of the City of La Porte.
Section 5. That the City Council of the City of La Porte

assistance and construction at an estimated cost of $12,020,000 to the

This Order shall become operative upon acceptance by Harris

Utility Adjustments
SUMMARY
The City has received State Highway Commission Minute Order No. 87519
announcing proposed improvements to Spencer Highway if the City and
Harris County will agree to pay for 50% of the cost of utility
adjustments, to maintain said improvements as required, to regulate
traffic and to prevent right-of-way encroachments. The City and Harris
County have until October 26, 1988 to agree to the terms of the Minute
Order by passing a resolution.

Staff has determined which city utili ties will need to be relocated
before the State Department of Highways and Public Transportation
(SDH&PT) undertakes the improvements to Spencer Highway' indicated in
the Minute Order. District 12, SDH&PT advises that the pavement width
is to be 84 'feet (6 tr...affic lane~ ... (\f'lnt.inllOUS center turn lane) with
curb and gutter drainage. City utilities parallel to Spencer Highway
must be located in an 8' wide strip between the future curb and the
right of line (width of right-of-way is 100 feet) . City util i ties
crossing Spencer Highway must be at least 3-1/2 feet below the gutter
line. With this in mind, staff has determined that the utilities to be
relocated are those shown on the attached aerial photo map. The
estimated cost of these utility adjustments is $322,000.00.
BACKGROUND

In July, the City received a copy of Minute Order 87519, passed by the
Highway Commission June 28, 1988 (Exhibit A). The City Council and
Harris County Commissioners Court have 120 days from June 28, 1988 or
unt il October 26, 1988 to pass the attached resolution (Exhi bi t B)
accepting the provisions of the Minute Order.
Those provisions include the City and Harris County agreeing to pay 50%
of the cost of utility adjustments. Staff investigation covered by
this memo is for the adjustment of city utilities only.

INVESTIGATION
(
Since most of the utilities on Spencer Highway nave not yet been
surveyed under the City Utility Mapping Program, a field utility
verification (U.V.) was done under the City U.V. procedure.
James Grayson of District 12, SDH&PT furnished drawings of the expected
pavement section (Exhibit C) and utility line cover requirements
(Exhibit D). Note that the pavement section is 84 feet wide (6 traffic
lanes + continuous center turn lane), curb and gutter. Since the
Spencer Highway right-of-way width is 100 feet, that leaves only an 8
feot utility corridor on both sides of the pavement.
Note also that the thickness of the pavement structure is 23 inches and
that city utili ties must be 18 inches below that. If it is assumed
that the roadbed is lowered 18 inches to provide drainage across the
curb, then city utilities crossing Spencer Highway must be at least 5
feet below existing natural grade.

Staff conducted the U.V. with the above listed information in mind. An
office U. V. was first done and plotted on city topo maps. Then, a
field U. V. was done to validate the office U. V. Measuredowns were
taken at manholes, but rim elevations were not determined; a visual
comparison was made between manhole covers and natural grade to make
sure they were close. Pavement widths were measured at selected
locations and distances of fire hydrants, valves, manholes and
cleanouts from edge of pavement were also measured. Using this
procedure, it was possible to determine that only the following city
utilities will need to be relocated (See aerial photo map at Exhibit
F):
1) The 12" water line on the north side of Spencer Highway located
between Underwood Road and Big Island Slough;
2) The 8" sanitary sewer force main which crosses Big Island Slough on
.the bridge;
3) The 12" water line crossing at Valleybrook Drive;
4) The 8" sanitary sewer serving the lots in Fairmont Park Subdivision
Section One located next to the south right-of-way line of Spencer
Highway, between Valleybrook Drive and Farrington Boulevard; and
5) The 8" water line on the south side of Spencer Highway between South
16th Street and State Highway 146.

Once the utilities to be relocated were determined, the distances
involved were measured from city topo maps and features such as
manholes were counted. Then, the cost of these utility adjustments was
estimated (See Exhibit E) using unit prices from recent city projects
or from "Contractors Date Report" files.

Blinds are needed at Sylvan Beach to facilitate utilization of visual aid,
which has been a problem during day and early evening hours, and they will
also conserve energy.
Carpet is needed to protect the maple dance floor for banquet seating.
The above items were not budgeted items. Council was informed at the
1988/89 budget hearing (August, 1988) that these items were being sent out
for bid. As of August 1988, funds available are $13,127.00.
Sealed bids #0276 for carpet and blinds at Sylvan Beach were opened and
read on September 5, 1988.
Staff recommends awarding bids as follows:
Blinds (41 @ $89.12 ea./2 @ $84.00 ea.) to Sherwin williams on the basis
of their low bid meeting specifications in the amount of $3,821.92 and
Carpet (520 yds) to Home Decorating's on the basis of their low bid

SUMMARY & RECOMMENDATION
Neither the Little Cedar Bayou Park project nor the Bay Forest
Golf Course project included any perimeter fencing as part of
their base bid.
Meetings between City of La Porte staff and Bay Point Townhomes
Association have resulted in the request for chain link fencing
without pedestrian access along the common north-south boundary
line separating the park and the subdivision. The Bay Point
Townhomes Homeowners Association has indicated that they would
fence the boundary along "M" Street. Likewise, the Golf Course
Advisory Board has discussed with staff the potential problems
along the common boundary between the Golf Course and Little Cedar
Bayou Park. The Golf Course Advisory Board has recommended the
installation of a'six foot chain link fence with gates installed
at appropriate locations to allow for the passage of maintenance
equipment and emergency vehicles.
The award of Sealed Bid 80281 Alternate 83 will provide 3,853 foot
of six foot chain link fence with 4 - 10' wide gates. This amount
of fencing will cover the boundary conditions described above
(except boundary between the subdivision and the "M" Street
right-of-way).

Action Required by Council:
Approve the award of Sealed Bid 80281 to Withers Fence in the
amount of $24,928.91.' The recommended funding source for this
award (and the required clearing) is the Little Cedar Bayou
Contingency Fund which has a current balance of $24,928.91. The
award shall be subject to the completion of the clearing of the
line by Daniels Dump Truck Hauling per terms of his proposal dated
8/26/88. '

Advertised, sealed bids #0281 for fencing at Little Cedar
Bayou Park were opened and read on September 6, 1988. Bid
requests were mailed to four area suppliers with the following two
returning bids: 1) Brooks Fence and 2) Withers Fence.
Suppliers were asked to submit three separate bids: 1) a base
bid of 2,290 feet, 2) alternate bid #1 of 3,391 feet, and 3)
alternate bid #2 of 3,853 feet.
Low bid on each option was submitted by Withers Fence.
Withers per foot price is slightly higher, but the cost of the
gates is included in that price.
Total cost to the city, depending on which option we choose,
would be: Base Bid - $14,816.30, Alternate #1 - $21,939.77, or
Alternate #2 - $24,928.91.
